    The motto of the Church of Scientology Volunteer Minister Corps, “Something can be done about it,” was put into action this month as Seattle volunteers celebrated the holidays at Food Lifeline.

    For more than a dozen years, Seattle Volunteer Ministers have been helping the homeless by volunteering with Food Lifeline.  Volunteer Ministers donate their time each month, sorting and packing food at the Food Lifeline facility that serves 275 food banks, meal programs and shelters in western Washington. Food Lifeline provides 91,000 meals daily to these programs.

    “We have been proud to partner with Food Lifeline for many years and look forward to continuing our work with them in 2017,” said Danar Hoverson, who coordinates Volunteer Minister efforts for the local group.

    Volunteer Ministers with the Seattle Church of Scientology recently completed a semiannual sock drive and delivered hundreds pairs of socks to local Seattle charities that support the homeless, including the Queen Anne Helpline, 157 Roy Street Men’s Shelter, and the Queen Anne Food Bank.

    In a letter to the Church of Scientology of Seattle, the executive director of the Queen Anne Food Bank wrote, “The commitment to honoring the dignity of those we serve is exemplified through the Church of Scientology congregation through this generous and thoughtful donation.”

    To address Seattle’s homeless situation, Seattle Mayor Ed Murray has proposed opening new city-supervised tent encampments in addition to those already existing in the area.

    With temperatures dropping across the region, the Church of Scientology Volunteer Ministers have donated and delivered five new tents to provide needed shelter.

    Volunteer Ministers follow The Scientology Handbook compiled from the works of humanitarian and Scientology Founder L. Ron Hubbard.  The book outlines tools that can be used to alleviate spiritual, emotional and physical travail and is available online at www.volunteerministers.org.

    Alberta’s family lawyers continue to wait for the Federal government to appoint new judges, while crisis-level delays erode access to justice.

    Heather Fraese, a family lawyer practicing in Calgary, summarized the crisis as follows: “if you had separated a year ago and were ready to go to trial today, you should expect to wait 6 months for a simple divorce trial, and up to 26 months if the issues are complex.     Alberta has the fewest judges per capita in Canada. While the province’s population has grown dramatically, the number of judges has not. In addition, judges have not been replaced as they have retired, resulting in a number of vacant positions. The problem is particularly acute in the major cities of Calgary and Edmonton, where court resources have fallen far behind rapid population growth.

    The Province of Alberta has recognized the issue and on October 20, 2016, announced the creation of 10 new positions for the Court of Queen’s Bench. However, the Federal Government has not yet acted to fill these positions or a number of existing vacancies at the Court. Taking the new positions into account, there are now 15 vacant positions, nearly a quarter of the total number of positions.

    The judge shortage has caused systemic delays at every stage of the divorce process, leaving individuals and families with no recourse in the public court system. At the same time, there has been a boom in private mediations and arbitrations. For those who can afford (and agree on) these solutions, justice is available, but at a price.

    Davidson Fraese Family Lawyers joins the Canadian Bar Association and the judges of the Court of Queen’s Bench in calling on the federal government to appoint a further 15 judges to the Court of Queen’s Bench to file existing vacancies and new positions.

    ​​​The Ethiopian National Movement (ENM) was launched on Sunday, October 30, after months of negotiations among four political parties that formed the coalition to lead and coordinate the struggle of the Ethiopian people for justice, freedom and democracy.

    Formed by the Patriotic Ginbot 7 Movement for Unity and Democracy, Oromo Democratic Front, Afar People’s Party and Sidama People’s Democratic Movement, ENM strongly condemns the killings, mass incarcerations and atrocities being committed against innocent civilians. It believes that the unjust rule of the brutal minority regime, which has declared a state of emergency to crush popular demand for change, is no longer sustainable.

    Ethiopians can no longer tolerate injustice, inequality and violations of their inalienable rights. They are saying enough is enough.

    ENM strives to create a peaceful transition in Ethiopia on the tombs of the dictatorial Tigrian minority regime, which has been inflicting unimaginable sufferings on the people of Ethiopia.     EMN envisions a truly federal democratic system that respects human, political and civil rights of all Ethiopians.  ENM firmly believes in the necessity of creating a peaceful transition to enable citizens fully exercise their rights and create an all-inclusive government through a democratic process.

    The national movement Hands for a Billion Lives was nationally recognized on Saturday, October 22, when thousands of participants in cities across the country as well as countries abroad, joined hands at precisely 2:22 p.m. local time, to symbolize a protective barrier to protect the billion lives estimated to die because of smoking-related disease this century. Hands for a Billion Lives supports federal legislation that will keep vapor products on the market. Thousands of vapers joined hands to bring awareness to the award-winning documentary “A Billion Lives,” which sparked this movement.

    Hands for a Billion Lives was joined by Matt Bradley of ‘The Deadliest Catch’ and actor Eric Roberts who said, “As a smoker for nearly 30 years, I am so pleased to finally be part of the solution. ‘The Billion Lives’ movie brings to the foreground, the profound importance of this movement. “The hands” ceremony was a gloriously fitting tribute to the memory of the lives lost, and the spirit of the lives that will be saved by this worthwhile mission. I am honored to have played a small role, in something so meaningful.”

    The World Health Organization projects that a billion people will die early this century from smoking. The movie notes that while new technologies evolved to help addicted smokers, money has corrupted the government departments and nonprofit organizations responsible for helping to fix the problem. To uncover the truth, director Aaron Biebert traveled across four continents to create the documentary.

    In April 2016, The Royal College of Physicians released a study that stated electronic cigarettes are 95 percent less harmful than tobacco cigarettes. In August 2016, the Food & Drug Administration started regulating the vaping industry, and only those who go through a lengthy and costly approval process, will survive. The new regulatory landscape set forth by the FDA has created an enormously cost-prohibitive environment for manufacturers to market their products to adult smokers and vapers and will largely hand the market over to only large manufacturers, such as big tobacco. These small businesses provide an aspect that the FDA has ignored, the support and education needed to remain successful, and if closed down, potentially millions of adult vapers will return to smoking and thousands of small businesses will be shut down, putting an estimated 37,000 to 57,000 employees out of work.

    “We hope the movie and the national movement will send an important message to Congress to consider how their unnecessary imposed regulations could do further harm to those who are using these products as an alternative for harm reduction,” says Schell Hammel, the organizer of Hands for a Billion Lives. “This is bigger than any one of us. This is about lives that will be lost if these regulations go through as written and Congress does not change the predicate date in the Tobacco Control Act.”

    “A Billion Lives” has already debuted in other countries and on October 26th at 6:30pm, the movie makes its Hollywood premiere at the famous Cinerama Dome Theatre on Sunset Blvd. It will continue to play regularly at Laemmle Music Hall four times a day for a full week from October 28th through at least November 4th.     The controversial decision to pardon one of Afghanistan’s most notorious warlords, who’s alleged offences include terrorist attacks and war crimes, has inspired an Afghan musical artist to pen and produce a song in protest. Gulbuddin Hekmatyar was pardoned by the Afghan government in September and Shuja Rabbani has released a song entitled ‘Butcher of Kabul’ in response.

    Hekmatyar has previously held political offices and the agreement could mean a return to both public and political life for him. The agreement now means that there is a peace deal between the Afghan government and Hekmatyar’s militant group Hezb-i-Islami. Rabbani, who is Afghanistan’s most influential social media user on Twitter, is among those objecting the decision. The release of Rabbani’s song, entitled after Hekmatyar’s infamous nickname, aims to act as a sign of peaceful protest to highlight the distrust and betrayal those that disapprove of the move feel towards the Afghan President Ashraf Ghani’s decision.

    Following two-day Brussels Conference on Afghanistan that concluded on Wednesday, Rabbani tweeted in protest, “The hypocrisy of Afghan President in Afghan Conference in Brussels – on one hand talking women’s rights, on another making peace with most misogynist figure known to Afghanistan such as Hekmatyar?!”

    Rabbani also criticized Federica Mogherini, High Representative of the EU for Foreign Affairs and Security Policy, for her remarks on welcoming the peace process by remaining silent on Hekmatyar’s war crimes by tweeting, “I’m shocked to see @FedericaMog welcome peace with Hekmatyar during the Afghan Conference. Has she seen the faces of victims of acid attacks by HIA?” making a reference to Hekmatyar’s political party.

    The music track begins with the sounds of explosions, sirens and children crying to reference and serve as a reminder the volatility and terror that the country of Afghanistan has experienced in recent decades. Rabbani is among Afghanistan’s most recognised English bloggers and social media influencers, he regularly comments on issues affecting his home country and wider trends through his blog and music.

    As an independent African-American voter it’s time that the African-American communities have an honest conversation about who the next president will be. 

    The 2016 Presidential Election might be the most important election in recent history of Blacks in America. As African-Americans come down from our emotional high of having a African-American President, and our nation focusing on Bathroomgate to protect less than 1 percent of our nation’s population. It is time for the Black community to reconsider our blind loyalty to the Democratic party. It’s remarkable that the African-American community, which is traditionally a conservative group, is just a side bar conversation in this year’s election cycle with pundits, and Black elites assuming that the majority Black community will automatically vote democrat. That is a mistake.

    In 1854 the Republican Party was created to end slavery, the question now is can Donald Trump end decades of economic slavery in the Black community? If history is truly the great road map, the African-American community should take a glance at both parties only on the facts, not emotion. Donald J. Trump is saying something to the African-American community that we’ve been waiting on a presidential candidate to pledge for a long time. Mr. Trump consistently talks about bringing jobs back to our community and rebuilding the economy in our community. We need jobs now. 

    Let’s take an honest look at the economic condition for Blacks for the last 8 years. Black youth have an almost 60% unemployment rate. There are more Black Americans living in poverty today (10.8 million at 26.2%) than there were in 2009 (25.8%). Blacks make up 13% of our nation’s population yet 26.4% of Black households receive food stamp assistance. The jobless rate for Blacks is currently 9.5%, nearly double the national average. One study found that over the past 15 years, the average hourly wage of African-American workers fell by 44 cents, while white and Hispanic wages rose by 48 and 45 cents during the same period.

    With the financial devastation of cities like Detroit, Baltimore, Philadelphia, Memphis and Milwaukee, it’s time for African-Americans in America to stop being so blindly loyal to any of the political parties and start voting for the party who has the best economic plan for Black America!

    ​It was a day he has replayed in his head thousands of times. In 2012, Don Seagraves arrived at his ex-wife’s house for his scheduled visitation with his three-year-old son, Urijah. But when he got there, Urijah and Don’s ex-wife, Ivonne, were gone. Don suspected that Ivonne had taken their son to Guatemala without following the judge’s order.

    Don and Ivonne had a joint custodial agreement, which Don had faithfully upheld. But even though Ivonne committed a crime when she violated the Court’s custody order, Don faces an uphill battle to be reunited with his son.

    “I just want to get him back where he needs to be and be a father to him.”

    Like Urijah, more than 1,000 outgoing international child abductions are reported to the U.S. State Department each year.  According to findings by the U.S. Congress in 2014, only one of every two abducted children taken from the U.S. to a foreign country with which the U.S. has reciprocal obligations under the Hague Child Abduction Convention are ever returned to the U.S.[1]

    According to Don and Ivonne’s custody agreement, neither party was allowed to leave the State of North Carolina with Urijah, pursuant to a Court order.  Then Ivonne filed a motion for permission to take Urijah to visit her family in Guatemala.

    Don objected. But Judge James H. Faison, III granted Ivonne permission, on the condition that she return to the United States by July 31, 2012.  Judge Faison’s court order also required Ivonne to share the telephone and mailing address where she and Urijah would be in Guatemala. But Ivonne left the U.S. in secret, leaving no information about her whereabouts. Soon after, an arrest warrant was issued by the Pender County Sheriff’s Office against Ivonne for felony parental kidnapping.

    “In North Carolina, state law makes it a felony to keep a child under the age of 16 outside the state in violation of a court order,” says Mark Spencer Williams, attorney for Don Seagraves.  See N.C. GEN. STAT. § 14-320.1.  “There is also a federal law, the International Parental Kidnapping Crime Act (IPKCA) codified at 18 U.S.C. § 1204, which makes what Ivonne did a criminal act.”

    The Court awarded Don sole custody as a result of the kidnapping, but Don has still not been able to locate his son. He has spent the past four years searching for him, despite his limited financial and professional resources; Don is a high school graduate who works in the construction industry, and he does not speak Spanish. He could not afford an attorney, let alone the extraordinary costs associated with civil and criminal remedies in a foreign country.

    Then Don made contact with Rice Law, a Wilmington North Carolina law firm. The firm took on Don’s case on a pro bono basis. With their help, the National Center for Missing and Exploited Children, Interpol, the CUE Center for Missing Persons, law enforcement, and private investigators were used to locate Urijah. The U.S. State Department asked the government of Guatemala to issue an “Alerta Alba Kenneth” which is its equivalent of an “Amber Alert.”  On August 19, 2016, after a four-year search, Don was notified that Urijah had been found, living with Ivonne in Guatemala. Ivonne was served with legal documents under the Hague Treaty, which will require her to appear in court in Guatemala on Don’s petition seeking the return of Urijah.

    But there is another obstacle— Guatemala has a history of noncompliance with this Treaty and the U.S. State Department has not taken action to enforce the treaty in Urijah’s case.

    The Hague Convention on the Civil Aspects of International Child Abduction (the Hague Convention) provides that a child who has been a habitual resident of the United States before being removed to a foreign country, and who has been wrongfully retained in another country in violation of the left-behind parent’s custodial rights, should be promptly returned to the country of habitual residence.

    One of the responsibilities of the U.S. Secretary of State is to address countries with a pattern of noncompliance, which can include withdrawal of U.S. assistance and requests for extradition of the kidnapper.[2]  However, even though the Hague Convention requires a hearing to be scheduled within six weeks, no hearing has even been scheduled in Don’s case. The State Department indicates it has not even been able to conduct a welfare and safety check on Urijah because “our Consular staff is restricted from entering the district where the child was located, due to security concerns.” 

    Kevin Brosnahan, spokesperson, Bureau of Consular Affairs at the U.S. State Department, indicated that, “due to privacy considerations, we are not able to discuss this case specifically.” However, Brosnahan notes that the State Department annual reports show that since joining the Hague Convention in 2008, Guatemala has been cited five times for patterns of noncompliance.

    As a result of Guatemala’s non-compliance and the U.S. State Department’s silence on the case, Don Seagraves has sought assistance from his elected officials, including Congressman David Rouzer (R-NC), Senator Thom Tillis (R-NC) and Senator Richard Burr (R-NC). Seagraves is asking that the State Department implement the sanctions required by the Goldman act against Guatemala until it complies with the Hague Treaty. Don is also asking that Ivonne be extradited to the U.S. on the kidnapping charge. 

    According to foreignassistance.gov, $225 Million in U.S. Aid is sent to Guatemala, yet it is one of only three countries listed as non-compliant with the treaty by the U.S. State Department[3]. To date, Don is not aware of any specific action that the State Department has taken for Guatemala’s pattern of non-compliance.

    It is cases like Urijah’s that have resulted in significant changes to our laws about international child abduction.  In 2004, Sean Goldman was abducted by his Brazilian mom, Bruna Bianchi, from her U.S. husband David. The case garnered national attention[4].  Ultimately, Secretary of State Hillary Clinton became involved in negotiations for the return of Sean Goldman[5]. Congressman Chris Smith (R-NJ) put financial pressure on Brazil through his efforts to stop aid to Brazil until Sean Goldman was returned[6].  After nearly six years, Sean Goldman returned home and in 2014, President Obama signed into law the Sean and David Goldman International Child Abduction Prevention and Return Act (P.L. 113-150).  The new law requires the U.S. Secretary of State to take action against countries like Guatemala that have a pattern of non-compliance, which can include the suspension of assistance and request for extradition of the parent who kidnapped the child.

    The attorneys and staff of Rice Law, PLLC have provided pro bono assistance to Mr. Seagraves since 2012.  According to Mark Spencer Williams, the Managing Partner at Rice Law, “the U.S. has an extradition treaty with Guatemala that would extend to child kidnapping, but our local law enforcement has indicated that Guatemala is not likely to extradite Ivonne Seagraves back to the U.S. to face criminal prosecution.”  According to Williams, “it is especially frustrating that countries sign these agreements but then do not abide by them.”

    To help Seagraves with some of the expenses associated with this, the Missing Children’s Defense Fund, a North Carolina non-profit 501(c)(3) will hold a charity golf tournament Saturday, 22 October 2016 at Echo Farms Golf & Country Club in Wilmington, North Carolina.

    Many local businesses and individuals are working to support the effort to reunite Don Seagraves with his son Urijah.  Neuwirth Motors has donated a new Jeep as a hole-in-one prize, and Buffalo Wild Wings is providing food and prizes. Numerous other sponsors have come forward to help Seagraves.

    “Our goal is to raise enough money that Mr. Seagraves can hire an attorney in Guatemala to help seek enforcement of the Hague Treaty and so he can travel to Guatemala for these hearings,” said Williams.

    ​​​​Following the recent deaths of Terence Crutcher of Tulsa, Oklahoma and Keith Scott of Charlotte, North Carolina, a US based NGO submitted an appeal as a matter of extreme urgency to five UN Human Rights Special Rapporteurs and the UN Working Group of Experts on people of African Descent, which conducted an official visit to the US in 2015.  “In January 2016, the ‘Working Group of Experts on People of African Descent’ described the violence against African and Indigenous descendants of colonialism and enslavement in the United States as an ‘epidemic of racial violence by the police’”, the organization reiterated to officials. 

    In the letter addressed to the Office of the High Commissioner for Human Rights for the United Nations at Geneva, which is currently in session with the 33rd Human Rights Council, the group also cited the Congressional Black Caucus’ recent symbolic march to the office of US Attorney General Loretta Lynch’s to deliver a similar appeal to the Department of Justice.

    African and Indigenous descendants of colonialism and enslavement from all walks of life believe that they are under siege (in the United States).

    “In a September 2016 letter to the United States Attorney General, the United States Congressional Black Caucus formally requested that she ‘aggressively pursue investigations, indictments and prosecutions through the Office of Civil Rights against any and all law enforcement officers who harm or kill innocent, unarmed black men, women and children.’ The Human Rights Council can and should join in that request.”

    Officer Betty Shelby who shot and killed unarmed citizen Terence Crutcher as he stood beside his disabled vehicle on the side of the road was charged with manslaughter and has been released on a $50,000 bond. No one has been charged in the death of Keith Scott and protesters who are now more peaceful on day six than they were on day one are calling for the resignation of the city’s mayor and police chief for botching the investigation which has been taken over by the state of North Carolina.

    “African and Indigenous descendants of colonialism and enslavement from all walks of life believe that they are under siege (in the United States). Although law enforcement killed some 1200 people in 2015, only 7 resulted in a charge with a crime and none were convicted. Police charged in the deaths for Americans like Walter Scott, LaQuan McDonald and Akai Gurley are free on bond, awaiting trial. African and Indigenous descendants of colonialism and enslavement are left feeling disenfranchised and devalued in the United States,” the organization said.

    Since 2014, several law enforcement related deaths have been caught on camera, more recently in real time and aired live via social media by family members and by-standers that have triggered massive waves of traumatic responses from the communities of African and Indigenous descendants of colonialism and enslavement in the United States.

    The letter directly quoted the Human Rights Council’s resolution language that described the purpose of the urgent appeal to the United Nations. “This communication is an urgent appeal about the increasing potential in a contentious climate for “time-sensitive violations that involve loss of life, life-threatening situations or imminent or on-going damage of a grave nature that require urgent intervention to cease” such occurrences.” 

    The letter concluded with a three-point request:
    – “Urge the Office of the High Commissioner for Human Rights to pay close attention to the human rights situation in the United States; Report regularly and publicly on the human rights situation in the country;
    – Establish a long term mechanism, such as a country specific special procedure mechanism to document the situation of human rights in the United States; assess priorities and report back periodically to the Human Rights Council;
    – Demand that all actors in the situation, beginning with the United States Department of Justice, ensure the protection of civilians, oversee the immediate cessation of any violations of international human rights and humanitarian law and put in place measures to prevent further violations;”

    The appeal was addressed directly to Victoria Lucia, Special Rapporteur on the rights of indigenous peoples; Ms. Rita Izsak, Special Rapporteur on minority issues; Mr. Mutuma Ruteere, Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance; Juan Ernesto Mendez, Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment; Pablo De Greiff, Special Rapporteur on the promotion of truth, justice, reparation & guarantees of non-recurrence; and members of the Working Group of Experts on people of African Descent, Mireille Fanon-Mendez, Sabelo Gumedze, Michal Balcerzak, Ricardo III Sunga and Ahmed Reid.

    Others alerted were the US Department of Justice, the White House, the Congressional Black Caucus, the Ambassador of the United States to the United Nations Human Rights Council and the office of Multi-Lateral and Global Affairs/Democracy Human Rights and Labor.

    In a 10-week investigation, The Medill Justice Project probed the complex issues involved in the three-strikes laws that have swept the country. The story examines prison overcrowding, the costs of incarceration, prosecutors’ discretion in pursuing convictions and the case of prisoner Rodney Fisher, a Tulsa man convicted of multiple burglaries and robberies in the 1980s and sentenced under the habitual offender law to 52 years in prison.

    In 2004, Fisher was found guilty of escaping from a minimum-security prison, yet again triggering the state’s habitual offender law. Typically, the sentence for a prison escape would range from two to seven years. But because Fisher had already been convicted of multiple felonies, the law allowed for the punishment to be multiplied. The range suddenly rose to six years to life.

    Fisher got life.  

    Under Oklahoma law, those convicted of murder can serve as little as 10 years. A robbery sentence can bring less time than that. Some nonetheless say Fisher, now 52, got what he deserved. Others point to action in states that have reformed draconian sentences. In Oklahoma, leaders are beginning to grapple with the consequences of one of the highest incarceration rates in the nation and the consequences of its habitual offender law.

    “The three-strikes laws raise important issues about crime and punishment in the United States that need to be addressed but offer no easy answers,” said Northwestern University Prof. Alec Klein, MJP’s director.

    Three Northwestern University students at The Medill Justice Project worked in collaboration with Oklahoma Journalists for Justice, a nonprofit investigative journalism organization based in Tulsa.

    ​​​To the 72 young men and women representing 41 countries at the 13th annual International Human Rights Summit, held this year at the United Nations in New York, it is time to end human rights abuse. From human trafficking to police brutality, extreme poverty, bullying, gang revenge and war, the delegates to the summit state that as brutal and violent as these are, they are resolved with education. 

    “Gangs in Timor were responsible for over 200 deaths each year,” said a youth delegate from Timor-Leste who has been part of the Youth for Human Rights volunteer force educating young people in their country on the Universal Declaration of Human Rights since 2011. “Now many of the over 300,000 young people who have received human rights education are young people who used to be part of these school gangs. These days, those school gangs have changed from being a problem to becoming human rights defenders because of the help of the human rights education program and the volunteers of our team.”

    “Our humanity is in peril. We are being separated—labeled by our religion, race, gender, nationality. Our unity relies on our humanity. It is our duty to teach and carry the Universal Declaration of Human Rights and practice it.”

    “Our humanity is in peril,” said Rahaf, the youth delegate from Saudi Arabia. “We are being separated—labeled by our religion, race, gender, nationality. Our unity relies on our humanity. It is our duty to teach and carry the Universal Declaration of Human Rights and practice it.”

    The Armenian delegate, Mariam, spoke of the “internally displaced persons in Armenia” and the more than 17,000 Syrian refugees the country is integrating into the population. “We must stand up to such hate and ignorance and speak up for those whose voices have been silenced,” she said, “those who are afraid to speak for fear of persecution. We must learn to accept our differences instead of trying to make sure we all fit the same mold.”

    Mr. Augustine Brian, provincial project coordinator of World Vision and director of Youth for Human Rights for his nation, shared with the youth and the 400 guests attending the summit how human rights education can undercut and reverse abuse even in the primitive and often violent Southern Highlands of Papua New Guinea. Brian was a victim of police brutality, but rather than seek revenge he searched for a solution online and found Youth for Human Rights. He adopted the program and has taken it throughout his province. He has now educated and partnered with the very police force that perpetrated his assault, who are now working with him to ensure fair treatment of the people of their district.

    As the emcee of the Summit made clear, this is not just a problem in developing countries. Award-winning filmmaker Ronald Lang spoke of his new film on human trafficking that aims to raise awareness and spark a movement to end this barbaric activity. “Human trafficking happens all over the world, even in my own backyard here in New York and we need to put an end to it,” said Lang.

    Youth delegates presented their work to their peers and the 400 guests attending and heard from human rights luminaries including ambassadors and representatives of permanent missions to the United Nations.

    In his presentation to the Summit, Ambassador Irenee Omositson Namboka, former United Nations Human Rights Protection Adviser and Associate Fellow, told the youth delegates that the right to education, including human rights education, is second only to the right to life. “Education is the primary vehicle by which economically and socially marginalized adults and children can lift themselves out of poverty and obtain the means to participate fully in their communities.”

    Mr. Vineet Kapoor, Police Adviser and Aide de Camp to the Governor of Madhya Pradesh, India, spoke of the importance of human rights education for “youth who are in vulnerable positions and who must learn to know and claim their rights, that is those in compulsory and bonded labor, in hazardous industries, vulnerable to human trafficking, deprived of school or college education, vulnerable to drug trafficking and substance abuse, living in extreme poverty and deprivation and those who lack family and community support for their well-being.” He stressed the importance of Youth for Human Rights International educational materials in the training of police officers, civil servants, government health staff and others in social services, so they come to understand that “it is not the authority of the state that they are exercising to dole out benefits to the public. Rather it is the duty of the state to deliver the claims of the rights-holding citizens whom they are duty bound to serve.”

    Youth for Human Rights International (YHRI) is the youth component of United for Human Rights, a global nonprofit organization. Founded in 2001 in Los Angeles, there are now more than 100 Youth for Human Rights International chapters around the world.     ​​​El Departamento de Justicia de EE.UU. ha entablado una demanda en la que alega que varios proveedores de servicios de modificación de préstamos hipotecarios violaron la Ley de Vivienda Justa y la Ley de Igualdad de Oportunidades de Crédito por intencionalmente discriminar a propietarios hispanos.

    Los demandados nombrados en la demanda son: The Home Loan Auditors LLC, Century Law Center LLC, SOE Assistance Center Inc., Spieker Law Office, intencionalmente dirigieron sus servicios de modificación de préstamos hipotecarios predatorios propietarios hispanos e interfirieron en su capacidad de recibir asistencia financiara para conservar sus hogares.

    La demanda entablado martes, 23 de agosto de 2016 en el Tribunal Federal de Distrito del Distrito Norte de California alega que los demandados exhibían una práctica de comercialización a propietarios hispanos, incentivándolos a que pagaran alrededor de $5.000 por auditorias de préstamo innecesarias e inefectivas.     “Tener como objetivo intencional a cualquier comunidad o persona con servicios hipotecarios predatorios debido a su grupo étnico u origen nacional viola la ley federal, perjudica a familias trabajadoras y hace daño a nuestra economía entera,” señaló la Secretaria de Justicia Auxiliar Adjunta Principal Vanita Gupta, a cargo de la División Civil del Departamento de Justicia.  “Los demandados en este caso trataron de explotar a comunidades hispanas y propietarios que ya sufrían debido a prácticas financieras abusivas y discriminatorias durante la Gran Recesión que causó la crisis del mercado de la vivienda de EE.UU. y la caída libre de nuestra economía.  La demanda entablada por el Departamento de Justicia sirve de fuerte recordatorio y transmite el claro mensaje de que trabajaremos sin descanso para permitirles a todos los propietarios de vivienda acceso a servicios hipotecarios libres de discriminación.”

    “Las familias hispanas que luchan por permanecer en sus hogares no necesitan promesas vacías que solo empeoran su situación de vivienda y financiera,” señaló Gustavo Velásquez, Secretario Adjunto de Vivienda Justa e Igualdad de Oportunidades con el Departamento de Vivienda y Desarrollo Urbano de los Estados Unidos.  “HUD se siente complacido que el Departamento de Justicia esté actuando contra personas y compañías que victimicen a dueños de casa debido a su país de origen o porque hablen español u otros idiomas.”

    ​​​​​​​​​​​​The Justice Department has filed a lawsuit alleging that several mortgage loan modification service providers have violated the federal Fair Housing Act and Equal Credit Opportunity Act by discriminating against Hispanic homeowners. 

    The defendants, The Home Loan Auditors LLC, Century Law Center LLC, SOE Assistance Center Inc., Spieker Law Office, targeted Hispanic homeowners for predatory mortgage loan modification services and impeded the homeowners’ ability to receive financial assistance to maintain their homes. 

    The complaint filed August 23rd, 2016 in the U.S. District Court for the Northern District of California alleges that the defendants marketed and encouraged Hispanic homeowners to pay approximately $5,000 for unnecessary and ineffectual loan audits. The defendants indicated to the homeowners that audits were essential for a loan modification while in fact the audits did not impact the loan modification process and did not provide any financial benefit.

    As part of their mortgage service the defendants encouraged their clients to stop making mortgage payments and to end all communication with their lenders. This led many homeowners to default on their mortgage payments and ultimately led them to lose their homes.

    This lawsuit originates from complaints filed with the U.S. Department of Housing and Urban Development (HUD) by two of the defendants’ former clients. 

    “Intentionally targeting any community or person with predatory mortgage services because of their ethnicity or national origin violates federal law, harms working families and hurts our entire economy,” said Principal Deputy Assistant Attorney General Vanita Gupta, head of the Justice Department’s Civil Rights Division.  “The defendants in this case tried to exploit Hispanic communities and homeowners already suffering from abusive, discriminatory financial practices during the Great Recession that drove the American housing market into crisis and our economy into freefall.  The Justice Department’s lawsuit serves as a stark reminder and sends a clear message that we will work tirelessly to ensure that all homeowners can access mortgage services free from discrimination.”

    “Hispanic families struggling to stay in their homes do not need empty promises that make their housing and financial situation worse,” said Gustavo F. Velasquez, HUD’s Assistant Secretary for Fair Housing and Equal Opportunity.  “HUD is gratified that the Department of Justice is taking action against individuals and companies that victimize homeowners because of where they come from or because they speak Spanish or other languages.”
