    DeSantis is continuing to go full steam against recreational marijuana and other ballot initiatives, and it is not going well for him.

    The big news this week has been new tapes revealing Nixon stated marijuana was “not addictive and dangerous.” Nixon, who had a penchant for tapes which got him in trouble,  was the founder of the War on Drugs, which plagues the country to this day. But some leaders haven’t listened to reason and science. In fact the Florida’s governor’s fight against cannabis could put in hot water.

    It is public opinion and the medical community see value in legal cannabis by the positions of the American Medical Association and the American College of Physicians.  But the message has reached Florida. Governor DeSantis has lead the fight against marijuana, despite the a significant majority of his voters opposing his position. He has used a variety of tactics to get his way, often with poor results.  He fought medical marijuana, lost and his popular, he has fought the insurance industry and now the sunshine state has sky high premiums, he appointed a president of one the states premier university only for him to leave after extravagant spending.

    DeSantis opposes citizen-led amendments on the ballot this November and has tried to rise money to combat the swell of voters who support them. Reflecting the will of the public, the pro marijuana group has raised 5 times the amount as the governor’s team. But it seems the governor may have dipped into state funds to help. In a two-front battle, DeSantis is also at odds with the GOP Presidential nominee who. stated he plans to vote yes for the initiative. A direct opposition to DeSantis stance.

    A Florida public service announcement, funded by the state and promoted on social media last week, warns viewers not to drive high. In the middle of the 30-second video, the narrator says, “DUI crashes increase in states with legalized marijuana, putting everyone at risk.” The claim legalization leads to increased instances of impaired driving is misleading. Research on the topic has been mixed, and even federal reports have said the effects of cannabis use needs more research.

    Smart & Safe Florida, the campaign that put Amendment 3 on the November ballot, sent cease and desist letters to about 50 news stations across the state. It seems legal and ethic issues are right around the corner.

    One irony is the state is PSA talks about it causing higher insurance rates. Florida is among the most expensive states for auto insurance. According to estimates from Quadrant Information Services, Florida drivers pay $134 per month or $1,605 per year on average for minimum-coverage auto insurance. Property owners already pay more than four times the national average for home insurance, up from triple the national average just last year. The cost of homeowners insurance on average increased more than 40% in the last year.

    The American Medical Association and the American College of Physicians along with the federal agencies Health and Human Services (HHS) and the Food and Drug Administration (FDA) have all spoke up about the need for additional research to unlock medical benefits of cannabis. The acknowledge it can help, but need more information, including more understand about dosage. Now, a study reveals more data about cancer and cannabis which only reenforces their call to action.

    While cannabis is not a treatment for cancer, studies support marijuana-derived cannabinoids. TCH and CBD can help relieve symptoms and ease the side effects of cancer, including chemotherapy. More research can be done on treatment, but how do patients feel about using medical marijuana? The University of California San Diego and VA Health Care researchers partners for the one-year study. Team conducted a comprehensive survey of nearly 1,000 adult cancer patients at various stages of cancer treatment. What they discovered wasn’t a common sense surprise.

    The lead researchers Corinne McDaniels-Davidson’s published in the Journal of the National Cancer Institute. They explored the decision-making process, perceived benefits, and risks of cannabis use to address symptoms in adults with cancer.

    “There’s a vacuum in the world of cancer care. Many oncologists don’t talk to their patients about cannabis or refer them to a pain management specialist instead,” said McDaniels-Davidson, who is the associate director at the SDSU School of Public Health.

    “Our data shows about a third of the patients surveyed used cannabis after their diagnosis, but only a few of those patients said they had told their oncologist,” said McDaniels-Davidson.

    Cannabis has been used as medicine for thousands of years. The archeological site in the Oki Islands near Japan contained cannabis achenes from about 8000 BC, but it developed a bad name in the early 20th century. But the understanding it works is still strong. Survivors who perceived cannabis had any benefits were five times more likely to use it. Those who perceived there were any risks were nearly 60% less likely to have used it post-diagnosis.

    According to the study, cancer survivors diagnosed with stage 3 or 4 were also more likely to use cannabis.  Among those who used cannabis, 19% said they believed the misconception that it could treat or cure cancer.  Cannabis can not cure cancer, a fact which needs to be made clear, but it increasing can help treat the disease. This study gives medical professional another tool to talk with patients.

    The Court in Illinois, a legal state, makes a key ruling about cannabis

    With over 50% of the population in the US and 100% in Canada having access to legal cannabis, there has been some changes. All age groups are embracing it, including Boomers who are using it in bigger numbers for its medical benefits. Beer sales are down as people are embracing vapes and gummies over calorie filled and hangover inducing beer.  And the are figuring out how to keep people from driving under the influence. Now, a state court makes key ruling about marijuana which differentiates it again from alcohol.

    Law enforcement has treated cannabis like alcohol regarding driving under the influence. The smell of either gives probable cause, but now, for marijuana it is under doubt.  The Drug Enforcement Agency (DEA) is very slow walking a decision about rescheduling cannabis. Part of the reason for the DEA is to combat marijuana and rescheduling would change a focus.  Several sources say the agency is not keen on the change and hopes by delaying action until after the election, they may be given a pass.  But this court ruling adds more pressure.

    The ruling stemmed from a 2020 case in which Ryan Redmond was pulled over by Illinois State Police on Interstate 80 in Henry County. According to court records, Redmond’s license place was not properly secured to the vehicle and he was driving 3 miles over the speed limit.

    The trooper allegedly smelled marijuana coming from inside the car, and subsequently found a small amount of cannabis inside. Redmond was charged with a misdemeanor for transport of cannabis.

    Redmond exhibited no signs of impairment, leading Neville to opine that the trooper’s “reasonable suspicion” would not have advanced to a “probable cause search.”

    The court ruled the smell of cannabis doesn’t provide probably cause, unlike the smell of alcohol on the breath.

    This court’s ruling could have an impact on federal law. Currently, there isn’t a fully reliable way to test people with data, like an alcohol breath analyzer.  The next step in how the state adjusts will likely by copied by other states to avoid lawsuits.  This will have an impact on federal policy…and maybe nudge the DEA.

    As marijuana become legal across North America – the North Pole got caught in fight.

    Canada and a big chunk of the United States have legalized cannabis. The results have been improved medical options, a decrease in alcohol consumption, a reduction of youth use and some more chill people. But the journey to this point has been tough. Opponents have spread misinformation and slowed the process.  Even the current administration has be lackadaisical in the approach. Medical marijuana patients will tell you the benefits in trea tment of chronic pain, cancer, insomnia, inflammation and more. Veterans now have access to treatments to a proven help with PTSD.  It has been a battle, but, in one case, Santa saves Christmas for marijuana fans.

    Thomas O’Connor legally changed his name to Santa Claus in 2005 and is a monk, child welfare activist and local city council member.  He is also a cancer patient and a consumer of medical marijuana.  He resides in North Pole, Alaska, which originally banned all cannabis use.

    North Pole, Alaska, a small suburb of Fairbanks, is known for its year-round Christmas decorations, including candy cane–striped street lights. Santa Claus House is a Christmas store with walls covered in children’s letters to Santa and a huge Santa statue outside. Streets have names like Kris Kringle Drive and Mistletoe Lane.  In 2016, the local city council voted to ban marijuana businesses within its city limits. But they didn’t talk to the official leader of the North Pole, Santa Claus.

    When it happened (and it was covered by The Fresh Toast), Santa shared with Alaska’s KTUU. “I think they are not in this particular instance are not embracing the spirit of love. I think what they’re doing is engendering hate, which comes from fear.”

    But you don’t become Santa without having some good will, determination and drive.  Santa worked with the city and city council and managed to get the proposition overturned. Now the area boosts three cannabis dispensaries.

    And Santa? He continues his children welfare advocacy work and, as of 2022, is the mayor pro tem of North Pole.     The speed of cannabis mainstreaming is setting records.

    Since the first state went legal in 2016, consumers have moved to legal marijuana. Now, with over 50% of the country having access to it, things are starting to change.  And consumer use sets records on cannabis as all ages are starting to consume and consume more.  States who have full legal cannabis are bringing in more revenue from marijuana than alcohol. All fueled by consumers.

    The newest record is Michigan, a solid mid-western state. In the first year of it being available to the public, the state had $1 billion in sales.  Now, the Great Lakes State sets record with $295+ million in monthly marijuana sales. And it isn’t what you think, while it is being used to relax, it is also being used for its medical benefits.  Boomers, the generation who helped promote the War on Drugs, has turned to it for the medical benefits of managing inflammation, chronic pain, insomnia, and more.  And their grandchildren in Gen z are using it to combat anxiety. There generation has the highest amount of any other generation.

    The other record is cannabis is taking a bit out of beer. Beer sales are down, especially earlier in the week as people are turning to vaping and gummies for a quick, low calorie and dose to relax after a busy start to the week.  Year over year growth is strong.  In 2022, sales were $30 million and in 2024, it is on track to be $38 million. While beer sales still far outpace cannabis at $117 billion, sales dropped again in 2023 by 5.1%. Another reason big liquor companies are wading into the cannabis market.

    But the industry is still struggling and the Biden/Harris administration has failed to follow through on their 2020 promise to help the industry. Biden is one of the most seasoned policymakers in DC with 50 years of service, so it seems the failure of the DEA to make a move before the election could be planned. The DEA rescheduling move premiered at time to provide zero relief for the industry in 2024 as the DEA is not making an announcement until December.  Being post December, it could provide cover to the current administration to make make a move. Or if the GOP wins the presidency, Speaker Mike Johnson (R-KY) has made it clear he will move to reduce the industr

    Cannabis has become popular for every adult age group- but the surprise is Gen Z and Boomers are using it for similar reasons.

    Cannabis is fully legal to over 50% of the population and all groups are embracing its use. Proven healthier than alcohol, it has become much more common in all sets. Even Florida looks like it is going to vote for recreational cannabis. Long stigmatized as a way to get high, be lazy and lay about on the couch, it turns out it is become part of every day life…and part of a health regime. An example of how it is being used, Boomer and Gen Z consume marijuana for similar reasons.

    It is become so accepted, AARP did a study about use among Boomers. AARP is the largest  print magazine with 38 million readers…and their bulletin has 33 million.  A huge validator for the demographic. It also shows they are more open to more mainstream cannabis. This falls in line by the positions of the American Medical Association and the American College of Physicians.

    The AARP study revealed 21 percent ages 50-plus used some form of cannabis — be it food, drink, flower or another type— at least once in the last year, a report from the University of Michigan’s National Poll on Healthy Aging found. That’s up from 1 in 8 (12 percent) in 2021. In 2015 and 2016, roughly 3 percent of adults 65 and older used cannabis, according to research published in JAMA Internal Medicine.

    Roughly 68% of poll respondents who used cannabis products did so for help with sleep, the researchers found. Many also cited pain relief (63 percent), mental health, anxiety,  and mood (53 percent) and relaxation (81 percent) as reasons for using cannabis.

    What is interesting is Gen Z, the youngest adult generation, Gen Z, is an also a big fan of marijuana. They helped fuel the California Sober trend where you reduce or stop drinking and use weed instead.  One reason Gen Z has embraced weed is it helps with anxiety and mood.  They also use it for relaxation, way more so than other generation who tend to lean into alcohol.

    What is interesting is some Boomers and Gen X are consume marijuana in a more traditional way by smoking. Gen X and Boomers new to consuming tend to vape and use gummies.  The later two are more “on the go” and discreet and doesn’t have the smell. It is interesting the marijuana is bonding together two generations.

Long used as a natural pain killer, it is less addictive and the body responds positively.  Currently used, orticosteroid injections have been a staple in managing pain and inflammation. With new research showcasing the long-term effects of one of the most used treatments, doctors and researchers are concerned about the risks of injections and the potential risks involved with cortisone.

    A Boston University study found patients who had been given the medicine by injection found a risk for “accelerated adverse joint events after treatment.” Meaning, when a patient was treated for osteoarthritis or other joint pain via a shot of cortisone, it may have accelerated joint destruction and bone loss. The study also found certain preexisting conditions, such as older age and Caucasian race seemed to increase the risk for the outcome even more. Researchers recommended MRI pre-screening before injections were given to identify the area better and find if the danger could be accurately assessed before the dose was given. 

    Not only can medical marijuana be helpful, but so can CBD. The Arthritis Foundation has a guide to CBD for those that suffer from the condition. According to Dr. Daniel Clauw, a contributor to the guide, “Right now, it (CBD) appears to be fairly safe and might help certain types of pain.” 

    While CBD and THC can be used as part of a pain management regimen, they currently can not be the entire plan. Studies like the one conducted on cortisone treatments are bringing the conversations of cannabis and CBD to greater light and offering less stigmatization, but until more research is done, the best path for joint pain is still unknown.

    The California cannabis industry has been struggling. With high taxes from state, regional and local governments, the businesses are burdened with high operational costs. Additionally, the state has done little or nothing to reduce the black market. This has lead some companies have gone under. Despite consumer use growing. While there has been lots of talk, this is one of the first major action. When legalization first started sweeping the country, California was the largest market. But with New York slowly getting their act together after chaotic rollout of recreational, they may lose out of being the top market.

    This summer, the state legislature developed a bill to allow small producers to sell at local markets. This would be give some of the mom and pop more opportunity to reach consumers. They would only be allowed to see at markets in places like San Francisco where cannabis events are allowed by local governments. It would also cut overhead and the purchase price for customers, potentially reducing the huge black market in the state. The bill was forwarded to Governor Newsom, who is pondering whether or not to sign it and make it possible.

    Governor Newson is a seasoned politician who is always looking to the future. This could be the first step in helping a popular, and for the state, profitable industry.     While they have lower levels of chemicals, vapes may still damage endothelial cells. It may cause oxidative stress on the endothelial cells lining blood vessels. This can affect nitric oxide (NO) levels and their signaling in the body. This can be an issue as sufficient NO is necessary to produce an erection.

    One study suggests men who vape nicotine are twice as likely to experience erectile dysfunction when compared to men who don’t vape. And cannabinoid receptors at the level of both the brain and penis may negatively impact erectile function.

    The first study, published in the American Journal of Preventative Medicine, looked into deeper understanding of vaping and sexual health regarding men. They analyzed self-reported data from over 13,000 men over the age of 20. Among the findings: Men who used e-cigarettes were found to be 2.2 times more likely to have erectile dysfunction.

    Some caveats in the study include that the data was self-reported, with there being the possibility of bias. Another thing to be mindful of is the fact that the survey didn’t ask any questions on whether or not the men were taking medications which increased the risks of erectile dysfunction, like antidepressants.

    Nicotine has long been linked with a variety of sexual dysfunctions, including erectile dysfunction and decreased arousal. Researchers believe this link exists due to smoking and the damage it imparts on circulation, which can also increase the odds of heart disease and strokes. When circulation is impacted, it makes it more difficult for erections to occur naturally.

    Cannabis has long been used as an aphrodisiac, light use can relax the body and increase sensational.     In his quest as a foe of legal cannabis and for running a nanny state, will DeSantis allow Floridians to vote for marijuana? 

    DeSantis is recovering from his failed presidential bid and is working to shore up his reputation in Florida. He is known for being tough, driven and getting things his way. His historic fight with Disney has drawn national attention, but hasn’t fully gone as DeSantis planned. His reputation is bruised and he is stepping up his tactics. He has opposed legal cannabis from the beginning, so will DeSantis let Floridians vote on marijuana?

    Currently, DeSantis is using state resources to try to block the Sunshine State citizens from voting on another issues, but what about marijuana? DeSantis, despite receiving campaign donations from a few large cannabis operators, has been adamantly opposed.

    When medical marijuana was first put on the ballot, citizens were supportive. It was reasonable considering the amount of veterans and senior citizens in the state. PTSD and chronic pain are two of the ways the American Medical Association, Health and Human Services and science acknowledge cannabis has medical benefits. In general, Florida is in the top 3 states with retirees, a group the Governor thought he can rely on for support, but the state supported medical marijuana by 61%.  The governor said it wasn’t enough support, and made them vote again, clearly sharing he did not want it passed. It passed with 71%.  Now the state wants to pass recreational marijuana via a ballot initiative and the governor is unhappy.

    The pro-marijuana group gained enough signatures and has out raised the opposition $75 million to $14 million. In different current ballot initiative, DeSantis has taken another tack.  The other group also gained enough signatures and traction. But in an unprecedented move, the Governor has used state resource to go door to door to ask people if they signed the petition. Also, the governor has also allowed a state agency’s seal to be used in ads against a ballot initiative, a highly usual move.

    The GOP Presidential candidate has come out in support of recreational cannabis in Florida, but, so far, it has not swayed DeSantis in his stance.  The GOP leader and the governor have a fraught relationship, so it is unclear if it will make a difference in campaign.

    A post on the Facebook page of Great Smoky Cannabis Co., located on the Eastern Band of Cherokee’s western tribal lands, called the day “history in the making” with a video showing a line of people waiting outside the shop shortly before sales began at 10 a.m.

    The outlet already started July 4 to sell in-store or drive-thru products for recreational use to adults enrolled in the tribe or any other federally recognized tribe. It had opened its doors in April initially for adult medical marijuana purchases.

    Marijuana possession or use is otherwise illegal in North Carolina, but the tribe can pass rules related to cannabis as a sovereign nation. Of North Carolina and its surrounding states, only Virginia allows for the legal recreational use of marijuana statewide.

    Tribal members voted in a referendum last September backing adult recreational use on their reservation and telling the tribal council to develop legislation to regulate such a market. Those details were hammered out by the council, approving language in June that effectively decriminalized cannabis on Eastern Band land called the Qualla Boundary.

    The move was not without its opponents. Shortly before the referendum, Republican U.S. Rep. Chuck Edwards introduced legislation that would have removed federal highway funding from tribes and states that have legalized marijuana — a bill that ultimately died.

    The Great Smoky Cannabis marijuana sales center, located near the Harrah’s Cherokee Casino Resort, is predicted to be more of a revenue-generator for the 14,000-member tribe as its customer base is expanded.
