  • Long Island loses construction jobs for seventh straight month | Long Island Business News

    Construction employment on Long Island saw another year-over-year drop in September, the seventh straight month of declines, according to a new report from the Associated General Contractors of America. 

    Nassau and Suffolk counties lost 5,600 construction jobs from Sept. 2024 to Sept. 2025, a 7 percent year-over-year decline, falling from 83,400 to 77,800, the AGCA reports. Long Island’s construction employment decline was the fourth largest drop of the 360 metro areas in the report.  

    Regionally, the number of construction jobs in New York City was down 7 percent, losing 9,900 jobs from Sept. 2024 to Sept. 2025, falling from 145,000 to 135,100. New York City’s job loss was the largest in the country for that period. 

    Association officials noted that demand for industrial and data center construction remains robust, but demand in other sectors flags. 

     “The latest data on employment by metro area shows how spotty construction activity has become,” Ken Simonson, the association’s chief economist, said in a written statement. “Although a few project types, such as data centers, power, and certain infrastructure and manufacturing plants, are booming, many metro areas are experiencing a drop in activity.” 

    Metro areas adding the most construction jobs over the last year include the Arlington-Alexandria-Reston, Va. Area, which added 7,900 jobs for a 9 percent increase; followed by the Washington D.C area, which added 6,200 jobs for a 13 percent gain; and the Charlotte, N.C. area gaining 4,400 jobs for a 5 percent rise.  

    Besides New York City, the metro areas seeing the largest drops in construction employment from Sept. 2024 to Sept. 2025 include the Los Angeles-Long Beach-Glendale, Calif. area dropping 6,100 jobs for a 4 percent decline; the Las Vegas area, which lost 5,700 jobs for a 7 percent drop; and the Riverside-San Bernardino-Ontario, Calif. area which lost 5,600 jobs for a 5 percent drop.

  • Federal government disrupts major NY infrastructure projects: What contractors should know | Long Island Business News

    In Brief:

    As the federal government shutdown stretches on, New York’s construction sector is bracing for significant disruption. Approximately $18 billion in federal infrastructure funding is now frozen, impacting two of the city’s largest and most critical transit projects: The Hudson Tunnel reconstruction and the Second Avenue Subway extension. These high-profile transit projects represent billions in construction contracts and tens of thousands of jobs across the region.

     

    Hudson Tunnel project

    Part of the Gateway Program, this $17.2 billion initiative represents one of the most ambitious infrastructure undertakings in the Northeast. Having secured more than $11 billion through various federal grant programs, the project encompasses the construction of a new tunnel, along with the rehabilitation of the 115-year-old North River Tunnel, which was damaged during Superstorm Sandy. The rail link is considered vital to the Northeast Corridor’s economic health, with approximately 200,000 commuters relying on it daily. The project is expected to create over 95,000 direct, indirect and induced jobs during construction while generating $19.6 billion in economic activity.

     

    Second Avenue Subway extension

    A long-awaited and needed expansion into East Harlem, this project promises to bring improved transit access to over 100,000 residents. The extension is expected to reduce overcrowding on the Lexington Avenue line by 22 percent during morning rush hours. With Phase 2 of the project costing an estimated $2 billion, construction had been ramping up with federal support until the shutdown paused reimbursements and furloughed key Department of Transportation staff.

    Economic and operational impacts of the shutdown

    It goes without saying that the funding freeze is expected to significantly impact New York-based infrastructure contractors, especially those facing delayed timelines and potential job losses. While the Metropolitan Transportation Authority (MTA) has a set state-sponsored budget in place, it still relies on federal grants. The freeze is anticipated to affect MTA operations and delay future bids, with uncertainty likely to ripple through the broader economy, particularly in sectors tied to public infrastructure.

     

    How impacted contractors can respond

    It’s been a turbulent year for the construction industry. Tariff uncertainties, volatile markets and fluctuating labor costs have prompted new strategies throughout 2025. Now, the federal shutdown adds another challenge to the mix. With billions in funding frozen and project timelines up in the air, contractors are rethinking their approach in several key areas:

     

    Strengthening financial management

    This level of uncertainty is prompting sharper financial oversight from contractors, as projects that impact financial results are now in question. In any economic climate, the fundamental “tried-and-true” construction financial management tools—cash flow forecasts and project budgets—are essential. These reports will help management identify peaks and valleys in cash flow across projects and the company as a whole, allowing for proactive planning rather than reactive fixes.

     

    Evaluating liquidity options

    Even with the consensus that the shutdown will eventually be resolved, a prolonged funding freeze would impact operational liquidity. As part of ongoing financial modeling, it’s essential to understand where cash is accessible. The obvious source is working capital lines of credit from banks. Although interest rates are beginning to creep lower, there is still a cost to that capital.

    Contractors should evaluate other potential cash sources, including short-term loans from ownership, liquidation of marketable securities or other readily tradable investments and negotiating advance payment from project owners. Some firms may also consider temporarily scaling back discretionary spending or postponing equipment purchases to preserve cash reserves.

     

    Maintaining communication with financial partners

    Whether the stakeholders are bonding agents, sureties, bankers or other financial parties, transparent communication regarding the shutdown’s potential impacts could prove critical in maintaining relationships and reinforcing confidence in management. Demonstrating how the business could be impacted and outlining the plan(s) to remediate and alleviate those risks will build support for any short-term help.

     

    What’s ahead for New York?

    City officials have not yet announced emergency funding measures, but the pressure is mounting. With New York’s transit system serving over 3 million riders daily, any prolonged disruption could have cascading effects on mobility, employment and urban development. Industry leaders are urging Congress to reach a swift resolution as every day of delay costs time, money and public trust.

    For now, the industry waits—but contractors with strong financial buffers and proactive communication strategies may be better positioned to weather the uncertainty.

  • Commentary: The immigration raids are crushing L.A.’s fire recovery and California’s economy

    The crew had just poured a concrete foundation on a vacant lot in Altadena when I pulled up the other day. Two workers were loading equipment onto trucks and a third was hosing the fresh cement that will sit under a new house.

    I asked how things were going, and if there were any problems finding enough workers because of ongoing immigration raids.

    “Oh, yeah,” said one worker, shaking his head. “Everybody’s worried.”

    The other said that when fresh concrete is poured on a job this big, you need a crew of 10 or more, but that’s been hard to come by.

    “We’re still working,” he said. “But as you can see, it’s just going very slowly.”

    Eight months after thousands of homes were destroyed by wildfires, Altadena is still a ways off from any major rebuilding, and so is Pacific Palisades. But immigration raids have hammered the California economy, including the construction industry. And the U.S. Supreme Court’s ruling this week that green-lights racial profiling has raised new fears that “deportations will deplete the construction workforce,” as the UCLA Anderson Forecast warned us in March.

    There was already a labor shortage in the construction industry, in which 25% to 40% of workers are immigrants, by various estimates. As deportations slow construction, and tariffs and trade wars make supplies scarcer and more expensive, the housing shortage becomes an even deeper crisis.

    And it’s not just deportations that matter, but the threat of them, says Jerry Nickelsburg, senior economist at the Anderson Forecast. If undocumented people are afraid to show up to install drywall, Nickelsburg told me, it “means you finish homes much more slowly, and that means fewer people are employed.”

    Now look, I’m no economist, but it seems to me that after President Trump promised the entire country we were headed for a “golden age” of American prosperity, it might not have been in his best interest to stifle the state with the largest economy in the nation.

    Especially when many national economic indicators aren’t exactly rosy, when we have not seen the promised decrease in the price of groceries and consumer goods, and when the labor statistics were so embarrassing he fired the head of the Bureau of Labor Statistics and replaced her with another one, only to see more grim jobs numbers a month later.

    I had just one economics class in college, but I don’t recall a section on the value of deporting construction workers, car washers, elder-care workers, housekeepers, nannies, gardeners and other people whose only crime — unlike the violent offenders we were allegedly going to round up — is a desire to show up for work.

    And why am I telling you that?

    Because I know from experience that some of you are frothing, foaming and itching to reach out and tell me that illegal means illegal.

    So go ahead and email me if you must, but here’s my response:

    We’ve been living a lie for decades.

    People come across the border because we want them to. We all but beg them to. And by we, I mean any number of industries — many of them led by conservatives and by Trump supporters — including agribusiness, and hospitality, and construction, and healthcare.

    Why do you think so many employers avoid using the federal E-Verify system to weed out undocumented workers? Because they don’t want to admit that many of their employees are undocumented.

    In Texas, Republican lawmakers can’t stop demonizing immigrants, and they can’t stop introducing bills by the dozens to mandate wider use of E-Verify. But the most recent one, like all the ones before it, just died.

    Why?

    Because the tough talk is a lie and there’s no longer any shame in hypocrisy. It’s a climate of corruption in which no one has the integrity to admit what’s clear — that the Texas economy is propped up in part by an undocumented workforce.

    At least in California, six Republican lawmakers all but begged Trump in June to ease up on the raids, which were affecting business on farms and construction sites and in restaurants and hotels. Please do some honest work on immigration reform instead, they pleaded, so we can fill our labor needs in a more practical and humane way.

    Makes sense, but politically, it doesn’t play as well as TV ads recruiting ICE commandos to storm the streets and arrest tamale vendors, even as the barbarians who ransacked the Capitol and beat up cops enjoy their time as presidentially pardoned patriots.

    Small businesses, restaurants and mom and pops are being particularly hard hit, says Maria Salinas, chief executive of the Los Angeles Area Chamber of Commerce. Those who survived the pandemic were then kneecapped again by the raids.

    With the Supreme Court ruling, Salinas told me, “I think there’s a lot of fear that this is going to come back harder than before.”

    From a broader economic perspective, the mass deportations make no sense, especially when it’s clear that the vast majority of people targeted are not the violent criminals Trump keeps talking about.

    Giovanni Peri, director of the UC Davis Global Migration Center, noted that we’re in the midst of a demographic transformation, much like that of Japan, which is dealing with the challenges of an aging population and restrictive immigration policies.

    “We’ll lose almost a million working-age Americans every year in the next decade just because of aging,” Peri told me. “We will have a very large elderly population and that will demand a lot of services in … home healthcare [and other industries], but there will be fewer and fewer workers to do these types of jobs.”

    Dowell Myers, a USC demographer, has been studying these trends for years.

    “The numbers are simple and easy to read,” Myers said. Each year, the worker-to-retiree ratio decreases, and it will continue to do so. This means we’re headed for a critical shortage of working people who pay into Social Security and Medicare even as the number of retirees balloons.

    If we truly wanted to stop immigration, Myers said, we should “send all ICE workers to the border. But if you take people who have been here 10 and 20 years and uproot them, there’s an extreme social cost and also an economic cost.”

    At the Pasadena Home Depot, where day laborers still gather despite the risk of raids, three men held out hope for work. Two of them told me they have legal status. “But there’s very little work,” said Gavino Dominguez.

    The third one, who said he’s undocumented, left to circle the parking lot and offer his services to contractors.

    Umberto Andrade, a general contractor, was loading concrete and other supplies into his truck. He told me he lost one fearful employee for a week, and another for two weeks. They came back because they’re desperate and need to pay their bills.

    “The housing shortage in California was already terrible before the fires, and now it’s 10 times worse,” said real estate agent Brock Harris, who represents a developer whose Altadena rebuilding project was temporarily slowed after a visit from ICE agents in June.

    With building permits beginning to flow, Harris said, “for these guys to slow down or shut down job sites is more than infuriating. You’re going to see fewer people willing to start a project.”

    Most people on a job site have legal status, Harris said, “but if shovels never hit the ground, the costs are being borne by everybody, and it’s slowing the rebuilding of L.A.”

    Lots of bumps on the road to the golden age of prosperity.

    ROCKPORT — Advocates for affordable housing on Cape Ann and statewide are sending out a clarion call to lawmakers, urging them to back the state’s Affordable Homes Act, a $4 billion effort that seeks to support a wide array of housing projects across the state.

    Seen as the centerpiece of Gov. Maura Healey’s effort to tackle rising housing prices in the state, the Affordable Homes Act, filed in 2023, includes $4 billion in capital spending authorizations and 28 “substantive” policy changes, three executive orders and two targeted tax credits.

    The measure is the largest of its kind in state history, according to Rabbi Allen Lipson, organizer and development coordinator for the Essex County Community Organization (ECCO).

    “But the real estate lobby is pushing hard against the key funding mechanism and state reps are wavering,” he said. “The bill will be voted on in the next couple of weeks. So, we are organizing to save it before it’s too late.”

    ECCO has organized a meeting with regional lawmakers to try and convince them to back the bill which seeks to increase the amount of money available for affordable housing, reduce barriers to the production and preservation of housing, and give communities the tools to develop more housing where they need it, according to the Executive Office of Housing and Livable Communities.

    “We have an urgent opportunity to save funding for hundreds of millions of dollars in housing across the state,” Lipson said.

    The meeting is scheduled for Tuesday from 6:30-8 p.m. at the Rockport Public Library, 17 School St. in Rockport.

    Event organizers said Senate Minority Leader Bruce Tarr, R-Gloucester, and Rep. Ann-Margaret Ferrante, D-Gloucester, will attend.

    “We’ll be asking for their support for key provisions of the bill currently under attack,” Lipson said.

    “Non-Cape Ann residents are also welcome since this issue impacts everyone in the state.”

    Cahill touts financial strength in State of City address

    BEVERLY — Mayor Mike Cahill used his annual State of the City address this week to highlight accomplishments and to reiterate that the city is in a strong financial position.

    In a 30-minute speech at City Hall, Cahill said the city has built up reserves of over $30 million over the last decade — money that can be used to keep the city running smoothly in the event of an economic downturn.

    “Our reserves are meant to get us through a recession when revenues fall precipitously and to do so without wholesale layoffs and drastic deep cuts to critical services,” Cahill said.

    “These reserves are not meant to be used to outspend still strong and growing revenues during good economic times,” he added. “They are meant to help us keep delivering the services people need and rely on right through the worst economic times and through economic recovery from those bad times.”

    In his speech in front of the City Council on Monday night, Cahill ran down the accomplishments of each city department, calling it “a great year in Beverly.”

    Highlights mentioned by Cahill included:

    – The hiring of the first woman as city engineer, Lisa Chandler

    – Progress on upcoming traffic projects like a proposed roundabout at the intersection of Brimbal Avenue and Dunham Road, a traffic signal at the intersection of Corning, Essex and Spring streets, and the Bridge Street reconstruction project

    – Daily visits to the Senior Center are up 63%

    – Over 150,000 people visited the library

    – Two new parks on Simon Street will be completed this summer

    New tennis courts will be built at Centerville and Cove playgrounds

    – A major renovation of Holcroft Park will begin this summer

    – The city’s senior tax workoff program has grown from 50 to over 90 seniors

    – The city will launch its first Beverly Youth Council for young people to learn more about local government and advocate for youth issues

    – The Fire Department has ordered a new pumper truck, which will replace Engine 1 in Central Fire Station when it arrives

    – Five new civilian dispatchers have been hired for the combined civilian, emergency medical services, police and fire dispatch system, with the goal to be “fully civilian” by fall, freeing up uniformed police officers to serve out in the community

    – The city’s veterans department prevented the eviction of three veterans from their houses

    – The city received 73 of the 80 grants it applied for over the last fiscal year, bringing in over $5 million in revenue

    Cahill closed by thanking the city’s department heads and staff for their work.

    “Thanks in significant part to their contributions, the state of our city remains strong,” he said to the City Council. “With their partnership and with yours, I know the state of our city will improve and become ever stronger well into the future.”

    GLOUCESTER

    Sunday, May 5

    10:02 p.m.: A crash with property damage only was reported on Washington and Mansfield streets.

    5:16 p.m.: Police took a report of child abuse.

    4:23 p.m.: Trash dumping was reported on Eastern Point Boulevard. A pile of cutup posts and lumber dumped in a pile off to the side of a back driveway was discovered in a homeowner’s backyard. The homeowner gave a description of a man he had confronted on his property. The man told the homeowner he was “just checking the place out,” the report said. The homeowner said the man appeared to be acting suspiciously and he believed he was casing the home. The man then walked down the driveway and left. The homeowner did not see if he got into a vehicle. A neighbor did not see anything. Police planned to check with Eastern Point security to review footage to identify the man and a possible vehicle.

    3:15 p.m.: Police planned to file a criminal complaint against a 61-year-old New Hampshire woman on a charge of assault and battery on a police officer at the Rockport Police Department where people are held in custody with the Gloucester Police Department presently under renovations. 

    1:03 p.m.: Police provided mutual aid to Manchester police on Summer Street.

    5:59 a.m.: A hypodermic needle was retrieved from Commercial Street and dispose of safely.

    7:32 p.m.: Police assisted the Fire Department with a medical emergency.

    2:34 p.m.: Police responded to a disturbance on Essex Avenue.

    9:12 a.m.: A crash with injuries was reported at 54 Eastern Ave. Police planned to file a criminal complaint against a 53-year-old Gloucester man on charges of driving with a suspended license, negligent operation and a marked lanes violation. A vehicle was towed from the scene.

    9:07 a.m.: Debris was reported on Addison Street.

    7:11 a.m.: No action was required for a report of credit card fraud from Heights at Cape Ann.

    1:11 a.m.: As a result of a report of a suspicious motor vehicle at the Man at the Wheel statue on Stacy Boulevard and Western Avenue, police arrested a 61-year-old resident of Bow, New Hampshire, on charges of driving under the influence of drugs, disorderly conduct and negligent operation of a motor vehicle. Police arrived to find the vehicle parked on the boulevard in the center of the Fisherman’s Memorial, between the Man at the Wheel statue and the cenotaphs — the granite blocks and bronze plaques —and the railing. Police found the driver with her eyes closed, swaying her head side to side, and mumbling to herself. When ordered to put the car in park and shut it off, the woman at first refused, but eventually did so, th police  report said. The woman said she was on her way to New Hampshire from Logan Airport in Boston and decided to come to Gloucester “to speak with the ocean,” the report said. The woman became agitated as an officer asked her questions. She reportedly jumped out of her vehicle in an angry manner, telling police she could park somewhere else and there was no reason for them to be there. An officer informed the woman he had never seen a person park a vehicle in this manner in the 32 years he has lived in Gloucester. Police then asked her to submit to field sobriety tests, and after jumping up on the granite blocks and showing signs of impairment during two of the tests, police arrested her on a charge of disorderly conduct. The officer concluded the woman was driving under the influence of drugs, the report said. Police requested the vehicle be towed and saw fresh damage on both its sides. Police did not locate illegal drugs in the vehicle, but found the driver’s prescription for lorazepam. Police filed an immediate threat for her right to drive in Massachusetts.

    Friday, May 3

    9:14 p.m.: Police planned to file a criminal complaint with a charge of trespassing against a 49-year-old Gloucester resident of no known address. Police were dispatched for a report of a man sitting on the railroad tracks off Dory Road and refusing to move so that the inbound train could pass. While police were heading there, dispatch informed responding officers that witnesses said the man was walking toward the Cleveland Street crossing but was still on the tracks. Police walked the tracks about a half mile approaching the train but were unable to locate anyone on the tracks. The train engineer and conductor described the man as tall, balding with curly hair on the sides and wearing a red sweatshirt. This description matched that of a man police had escorted off the tracks in the same location the day before. Police eventually caught up with the man. Police reminded him of their prior conversation regarding trespassing on the tracks. He told police he has nothing to do and his family has always walked the tracks. He was not trying to harm himself, he was just bored, he told police, who told the man the tracks are posted as “No Trespassing,” and that they would be charging him for trespassing.

    Crashes with property damage only reported at the Blackburn Rotary at 2:13 p.m., and on Pirates Lane at 5:38 p.m.

    1:51 p.m.: Trash dumping was reported on Elm Street. A caller reported trash that has been put out a week in advance.

    10:40 a.m.: A 54-year-old Gloucester resident was arrested on an active warrant for a restraining order violation. The man was taken into custody after a motor-vehicle stop of a white Ford truck on Poplar Street and Bertoni Road. The man was taken to Peabody District Court.

    10:04 a.m.: A disabled vehicle was reported on Hesperus and Western avenues.

    7:42 a.m.: A report of annoying phone calls was under investigation. The log refers to charges being sought.

    1:27 p.m.: A report of a structure fire was confirmed at a Boardman Avenue address. “It was just contained to an oven,” said Lt. Robert Cavender. “It was out before we even got there. It was just a small oven fire contained to the oven.”

    Man seriously injured in Derry explosion

    DERRY — A man was seriously injured in a fiery explosion at a Chases Grove Road home Sunday night.

    The unidentified man, who suffered potentially life-threatening injuries, was pulled from the burning home at 607 Chases Grove Road by bystanders shortly before 7:40 p.m., according to Battalion Chief Ryan Bump of the Derry Fire Department.

    Firefighters from 12 communities responded to the blaze, which took nearly an hour to bring under control.   

    As firefighters from Derry and other communities fought the flames, emergency personnel from the Salem and Londonderry fire departments treated the injured man and transported him to an area hospital, Bump said in a release. 

    The Derry Fire Communications Center received multiple calls reporting an explosion and fire in the 784-square-foot manufactured home but none of the callers knew if anyone was inside the burning building, he said.

    Firefighters arrived only four minutes later to find half the residence engulfed in flames and to learn the man had been pulled to safety. At the same time that Derry’s Engine 2 responded, the department’s Engine 1 and Medic 1 were responding to another emergency call, Bump said.  

    The fire was declared under control at 8:35 p.m. but its cause remains under investigation. The state Fire Marshal’s Office is assisting Derry with the investigation due to the seriousness of the man’s injuries and the complexity of the fire scene, the battalion chief said.

    Along with Salem and Londonderry, fire crews also responded from Hampstead, Plaistow, Atkinson, Windham, Hudson, Manchester, Nashua, Auburn and Chester. The Derry Fire Department also received assistance from the town Police Department and the Derry Community Emergency Response Team (CERT).

    Andover voters approve MBTA zoning

    ANDOVER — Voters approved a zoning district on Tuesday that allows for the potential construction of up to 2,121 multifamily housing units.

    Only a day after more than 900 voters turned out Monday for the first day of Town Meeting, the state-mandated district was approved 434-196.

    To combat the housing crisis, the state passed a law in 2021 mandating that communities with MBTA transit stations or station located nearby create a zoning district that promotes the construction of multifamily housing, with the added requirement that 50% of the housing capacity must fall within a half mile of a transit station.

    Creating zoning for the units does not necessarily mean they would be built. Developers would still need to meet regulations; the town would just have less discretion to deny projects, according to planning officials. The district, crafted over the last three years, spreads the density over three sections of town – downtown, Ballardvale and the area off River Road near Old River Road.

    The proposed district was debated Tuesday night on the Town Meeting floor at Andover High School, but few voters lined up to oppose the measure.

    “Andover is aging and we need good housing that makes it possible for young people to live in town,” she said.

    Other residents were concerned about how the new zoning might change the town.

    “I moved to Andover because it is not densely populated,” said Mike Tompkins. “Andover would not be the first town to vote against this overreach.”

    The new district could be formally created relatively soon. The plan will now be sent to the state Attorney General’s Office, which has 90 days to approve the new zoning.

    The section of the district off River Road has sparked some concern since there is little infrastructure there. The area is dominated by parking lots, corporate buildings, restaurants and a hotel.

    “The river district aims to transform the area into a vibrant village-like feel,” said Jennifer Lemmerman, who chairs the volunteer group that drew up the district proposal.

    The location is not within a half mile of a MBTA transit station for the commuter rail line, though it does have a bus stop.

    The downtown zone would allow for up to 1,234 units with 119 in Ballardvale and 768 off River Road. The zone would allow for a unit density of up to 23.2 units per acre, with 17 units per acre for Ballardvale and 39 units per acre for the River Road area.

    Select Board Chair Melissa Danisch said the district is a “measured and thoughtful response” to the state’s requirement.

    “Reflects that fellow residents were listening,” she said.

    Danisch also spoke of the millions of dollars in the grants the town could lose if it does not comply with the law.

    State Sen. Barry Finegold, who received the opportunity to vote on MBTA zoning for the second time, also voiced his support.

    “I did vote for this because it is the right thing to do,” he said. “It has become impossible to afford to come to this community.”

    The proposed district has been well-received by officials. It would boost growth in town and pave the way for more private investment in infrastructure, they said.

    Some residents have voiced concerns that having more people in town would put a greater strain on school services. School and planning officials have said that would not necessarily be the case with enrollment more heavily tied to turnover of current housing stock rather than the construction of new units.

    The district would allow for up to 2,121 housing units – 90 more than previously allowed. Officials have said the state recommends a small buffer.

    A commuter rail line snakes through town and has stations in Ballardvale and the downtown.

    The state law was met with a mixed response from community officials around the state. Not complying with the law could carry serious consequences.

    In addition to the potential loss of grants, municipalities could also face legal action. Milton is being sued by the state after its residents chose to vote against a proposed district.

    At Town Meeting, one resident advocated for only approving the district once the legality of the state requirement was settled through the lawsuit.

    Andover had until the end of this year to approve the district or face consequences from the state.

    Supermom In Training: What do I do with all the keepsakes?

    Anyone who knows me knows that I’m the keepsake queen! Since high school I’ve kept scrapbooks, albums, and bins with everything from photos and notes to lucky coins, fortune cookie fortunes, ticket stubs, newspaper clippings, etc. (etc., etc.). 

    It really got out of control when I had my son. Suddenly I was keeping every scrap of paper with a squiggle on it. Once he started daycare my addiction became even more serious, and I found myself stuffing shoeboxes and empty diaper boxes with artwork, schoolwork, colouring pages, and (so much) more.

    Then this spring, I lost my mind (I quit smoking) and I started organizing my house. I mean really organizing it. It started with shelf liner in the bottoms of all the drawers in our kitchen and bathroom, which led to organizing what was in those drawers. Then I did cupboards. And finally, I tackled closets. The last one I did was my bedroom closet – the floor of it had been taken over with mementos. I found my high school diploma mixed in with printed photos, certificates of achievement, years of birthday and holiday cards, and umpteen arts and crafts. It was time to do something about it.

    So I bought one big bin for my son’s keepsakes. Whatever fit, I’d keep, and what didn’t got thrown out. I made lots and lots of piles. Some things were thrown out, and others were donated (like colouring books that were almost brand new).

    I made a small pile with my favourite three-dimensional crafts creations and displayed those in a modest square shadowbox. I also bought two pieces of posterboard and stapled together three sides to make a giant folder or portfolio, and after I weeded through all the papers my son had drawn, painted, and coloured on, I slid the rest in there. 

    In the end, I have the bin, portfolio, and shadowbox (instead of at least four boxes of stuff). As I add to them and have to make room, other things will have to go. But at least I have a system. And, as my professional organizer friends will tell you, it all starts with having a system!

    BOSTON — Nearly 100 cities and towns are sharing more than $11.8 million in state funding aimed at helping them reduce their energy usage and greenhouse gas emissions that are contributing to climate change.

    The state Department of Energy Resources is distributing the money to local governments through its Green Communities program, which provides funds for energy efficiency and renewable energy projects aimed at helping the state meet its ambitious goal of reaching net-zero carbon emissions by 2050.

    Several communities north of Boston will be getting a piece of the latest round of grant funding disbursements, according to a new report to the Legislature.

    Gloucester is getting $144,311 in grant money; Ipswich is getting $167,500; and Wenham is slated to receive $50,000, according to the state agency.

    The grants will pay for myriad projects, including the acquisitions of hybrid police cruisers, battery-electric vehicles and electric vehicle charging stations.

    Other projects include ventilation system upgrades, weatherization, and de-carbonization of schools, municipal buildings and facilities.

    Combined, the projects are estimated to produce energy savings of more than 31,000 MMBTUs, or roughly the same amount of energy consumed by more than 240 households, according to the state agency.

    When completed, the projects are expected to reduce greenhouse gas emissions by 1,897 metric tons every year — equivalent to taking 383 cars off the road.

    The Merrimack Valley Planning Commission is getting a nearly $64,000 grant for work on reducing energy consumption and costs, pollution and the development of renewable energy and alternative energy.

    Meanwhile, Manchester-by-the-Sea, Ipswich, Andover, Haverhill and Methuen will each be getting $15,000 Municipal Energy Technical Assistance grants from the state to cover the cost of green projects ranging from decarbonization of buildings to energy storage.

    About 290 cities and towns, accounting for about 89% of the state’s population, have been awarded a “green community” designation by the state agency.

    Since 2010, the state agency has awarded more than $177 million in Green Communities grants, according to the Baker administration.

    To qualify for funding, cities and towns must commit to reducing their energy consumption by 86,875 MM BTUs over the next five years.

    That’s equivalent to the energy use of 673 homes, or taking 1,222 gas-powered cars off the road, according to the agency.

    Massachusetts is required under a state law to meet ambitious benchmarks to reduce greenhouse gas emissions to “net zero” over 1990s levels by 2050.

    A climate change bill signed by then-Gov. Charlie Baker in 2022 requires the state to meet incremental goals every five years to reach a 50% reduction in emissions by 2030 before meeting the 2050 goal.

    The plan calls for expanding the use of wind power, solar and hydropower, as well as continuing to reduce overall energy usage and reliance on fossil fuel sources to keep the lights turned on and heat and cool the state’s homes and buildings.

    The state is also working to improve energy efficiency through the Mass Save program, which is funded by a surcharge tacked onto energy bills and proceeds from the Regional Greenhouse Gas Initiative, a cap-and-trade system aimed at reducing emissions from power plants.

    The fees drum up about $2 billion a year, which helps pay for home efficiency audits and other programs to reduce energy consumption.

    Rockport ZBA: Affordable housing missing from MBTA measures

    ROCKPORT — Alan Battistelli and his fellow Zoning Board of Appeals members said the Planning Board’s effort to create an MBTA housing district in town may have missed the mark.

    There is no specific consideration for affordable housing in the zoning articles to be presented for consideration by Monday’s Special Town Meeting, said Battistelli, chairperson of the Zoning Board of Appeals.

    And which board, Planning or Zoning, should have jurisdiction is up for debate, he said.

    “The chair of the Planning Board (Jason Shaw) is aware the Board of Appeals is not supportive of the Planning Board being the board that is handling the MBTA district,” Battistelli said. “We’re also unhappy that there is no affordable housing element in the bylaw.”

    “We realize there’s a clock ticking,” he said. “We just want the two boards to walk in together at Town Meeting with the warrant articles we favor. We decided that we unanimously do not want to see the Planning Board try to practice zoning. We believe strongly the ZBA should be practicing zoning.”

    Shaw said the both the Zoning and Planning Boards want a component in the town bylaw before Town Meeting that addresses an affordable housing. Any amendments to be made to the measure will probably be offered by the Rockport Affordable Housing Trust.

    “We certainly have a desire to have a certain percentage of family units as affordable housing,” he said. “We understand that. We are on the same page. It’s more a matter of timing and scope.”

    No controversy exists between Shaw’s board and the Zoning Board.

    “Site plan review is under the Planning Board’s jurisdiction,” he said. “We felt it would be more efficient and more cohesive with one board overseeing the article.”

    However, meeting Wednesday night, the Zoning Board voted 4-0 to support a move to create an ad-hoc committee to direct Rockport’s MBTA housing plan.

    The ad-hoc group could be made up of two members each from the Zoning and Planning Boards, and the Rockport building inspector, Battistelli said.

    The state has imposed a Dec. 31 deadline for MBTA communities like Rockport to present their plans for an MBTA housing district.

    The articles

    Special Town Meeting on Monday will consider Articles A and B, both related the state’s new multi-family zoning requirement for MBTA Communities.

    Article A is a multi-item measure that includes questions about amending the zoning bylaws and the “Transit-Oriented Village Overlay District” (TOVOD).

    Article B is aimed at creating a multi-family overlay district near the MBTA train station off Railroad Avenue by amending zoning bylaws.

    The new MBTA Communities Zoning Act requires that an MBTA community, like Rockport, have at least one zoning district of reasonable size in which multi-family housing is permitted as of right and meets other criteria set forth in the statute:

    There must be a minimum gross density of 15 units per acre.

    The district must be located not more than a half mile from a commuter rail station, subway station, ferry terminal or bus station, if applicable.

    No age restrictions can be made and the housing must be suitable for families with children.

    The planning measures regarding the creation of a new MBTA housing district, while well intended, fall short of what is needed for Rockport, Battistelli said.

    “We don’t want to get a multi-family district created without the responsibility of some affordable housing,” he said. “The affordable housing component is not written into the warrant article. It doesn’t mandate that there would be 10% affordable.”

    A motion may be made on the Town Meeting floor to attempt to modify or amend the proposed multi-family district to add multi-family housing, Battistelli said.

    “Right now, there’s zero affordable in the bylaw,” he said. “I believe that without it, we shouldn’t do this.”

    Timing for affordable housing aspect of measure

    Shaw suggested a consultant may be hired in the near future to advise all town boards about the nature of the proposed MBTA housing district. He said the consultant being considered has not yet been hired but that talks were taking place to sign a possible contract.

    It would be prudent to wait until fall Special Town Meeting to address the affordable housing aspect of the MBTA housing measure.

    “We’ll have a consultant who will be working with all boards,” he said. “It’s not a controversy at all. We’re all on the same page. It’s more a matter of do you want something now where things are incomplete, or should we wait until the fall? We’d have a more complete picture and a more complete bylaw.”

    For his part, Battistelli said the Zoning Board will likely make a separate motion to move jurisdiction of the MBTA zoning district from the Planning Board to the Zoning Board, which he believes is appropriate.

    “Otherwise, you have two boards making decisions in the same neighborhood,” he said. “One of the first things we do is teach our members how to write up these legal decisions and they stand up in court.”

    Of the five-member board, two members are attorneys.

    “We’ve saved the town millions by having these volunteers on the Board of Appeals,” Battistelli said.

    MANCHESTER-BY-THE-SEA — Considering 21 articles on the warrant was no easy task but annual Town Meeting wrapped it up in about three hours.

    Town Moderator Alan Wilson banged the gavel to convene the meeting Wednesday at Manchester Memorial Elementary School precisely at 6:30 p.m. and adjourned it at 9:12 p.m. Midway through, Wilson reported a quorum of 317 voters present.

    The meeting approved financing for a new senior center, the operation of a launch service in Manchester Harbor, and a number of capital projects, including $7,550,000 to make capital improvements to the town’s water and wastewater systems.

    It also approved a fiscal year 2025 budget amounting to $42,336,058, with $16,818,112 for the town operating and enterprise budgets for water and sewer, and debts; $19,060,435 for town’s share of Manchester Essex Regional School District’s operating budget and debt service; $243,385 for the North Shore Agricultural & Technical School; and $2,642,740 for capital items.

    Each of the above articles passed by substantial margins with voters using electronic vote tallying devices.

    Finance Committee Chairperson Sarah Mellish said the budgets received much careful consideration.

    “The Finance Committee feels this budget is prudent and addresses the needs of the town,” she said. “This is a lean budget that meets the town’s needs.”

    Article 6 authorizing the Select Board to raise or borrow $1 million to buy the Masons’ 26,045 square foot parcel at 10 Church St. needed a two-thirds majority and was approved by a sizable margin, prompting a rousing cheer. Many applauding were senior citizens.

    Select Board member Brian Sollosy moved the measure, which was seconded by Select Board member John Round.

    Responding to a question about whether the building is the right place for a town-operated facility, being at the edge of Manchester Harbor, Town Administrator Gregory Federspiel said the elevation of the Masons’ building protects it from storm surge.

    “This building is in pretty good shape,” Federspiel said. An appraisal a few years ago estimated the building’s value to be about $800,000.

    “We do feel the price is appropriate,” he said.

    The town will start running a launch service in Manchester Harbor after Town Meeting voted 309-34 to purchase to two launch boats and fund operating expenses for this fiscal year and next.

    Select Board member Catherine Bilotta said town officials, including Harbormaster Bion Pike, put together a prudent business plan for the launch service.

    “All of these costs are going to be reimbursed by user fees,” she said. “The entire endeavor is to be funded entirely by user fees.”

    Mellish said the effort should eventually be self-sustaining.

    “If you want to use a launch, contact the harbormaster and he’ll gladly take your money,” she said.

    The meeting also approved paying the town’s share of the Manchester Essex Regional School District’s $16,339,528 gross operating and maintenance budget for fiscal 2025, $2,720,907 to cover its long-term debt, and $660,000 for a feasibility study for Essex Elementary School.

    Superintendent Pamela Beaudoin said the Manchester Essex Regional School Committee will eventually narrow its focus to considering possible renovation or new construction for the school, 12 Story St. in Essex.

    “We really lean heavily on community experts,” she said.

    Spending $481,670 of Community Preservation Fund money on restoration of the First Parish Church steeple and resurfacing of the Sweeney Park basketball court, among other things, was approved, but not before a motion was made to eliminate $200,000 to fund the Manchester Affordable Housing Trust. The motion was defeated 178-45.

    Here is a condensed version of the articles on the meeting’s warrant and votes:

    14 – Hear and act on the report of the Community Preservation Committee on the fiscal 2025 Community Preservation budget and to appropriate $481,670 from the Community Preservation Fund money to meet the administrative and other expenses of the committee for fiscal 2025. APPROVED.

    Included in the $481,670 total amount is:

    – $200,000 for the Manchester Affordable Housing Trust Project funding.

    – $60,000 for restoration of the First Parish Church steeple.

    – $28,500 to resurface the Sweeney Park basketball court.

    – $25,000 for restoration of town cemeteries.

    – $24,400 for portico restoration at Hooper Trask House.

    18 – Set fiscal 2025 imitations on expenditures by the town’s recreation programs at $400,000; and the town’s Board of Health Emergency Dispensing Sites and Clinics Programs at $50,000.  APPROVED.

    19 – Amend the Tobacco Products Regulations and Tobacco Use Regulations of the town’s General Bylaws as fines and enforcement are covered by other bylaws and state statutes/regulations.  APPROVED.

    20 – Amend Article X, Section 23 of the General Bylaw on non-accessory signs by adding the language: “The provisions of this section shall not apply to non-accessory signs located on town-owned property, subject to the approval by the Select Board, nor to non-accessory signs on town-owned property used for educational purposes, subject to approval by the Manchester Essex Regional School Committee.”  APPROVED.

    Schools face loss of 41 positions due to $3.1M budget gap

    The inability of the city of Gloucester and its schools to fully close a $6.1 million shortfall between the cost of a level-service budget and increased funding provided by the city may mean the loss of 41 positions across the school district.

    Driven by skyrocketing out-of-district special education tuition and transportation costs, inflation, and the ending of federal COVID-19 relief funding, the schools administration says what costs $49.74 million to provide to Gloucester students this school year will cost $55.85 million next school year.

    The change represents an increase of nearly 12.3%, or $6.1 million, in the fiscal 2025 school operating budget.

    Superintendent Ben Lummis told the School Committee the city has indicated it can fund $3 million of the proposed $6.1 million increase.

    The city plans to do so through a combination of a $1.5 million supplemental appropriation and some one-time funding for the current fiscal year, which is money that can be used to offset prepaid tuition and special education costs for next year, and a $1.5 million increase in the schools’ operating budget for fiscal 2025 that begins July 1.

    However, the funding shift would still leave a $3.1 million gap to maintain level services.

    Facing a $2 million to $3 million shortfall, Lummis told the School Committee the effects could include:

    A loss of the house structure at O’Maley Innovation Middle School.

    Increased class sizes at O’Maley and Gloucester High coupled with reductions to areas of performing and visual arts, business, technology and physical education.

    Elementary art, music and physical education specialists and some social emotional learning supports.

    “So again, we don’t know if we are here yet,” Lummis said. “Yeah, well, we are here right now, OK, whether we end up here, we don’t know, we are still working on it.

    “It doesn’t mean all these areas are affected. We have to look at all of those and see where we can make changes.”

    He said the effect on social emotional learning programs will not mean all of those supports will go away “but some will.”

    With 83% of the schools’ operating costs tied up in personnel expenses, Lummis said cost reductions are found through staff cuts.

    For the first time, he outlined those cuts by school building, the number of positions and reduction in salary costs:

    Preschool, four positions, $225,000.

    Beeman, four positions, $200,000.

    East Veterans, five positions, $275,000.

    Plum Cove, three positions, $125,000.

    West Parish, four positions, $200,000.

    O’Maley, nine positions, $550,000.

    Gloucester High, eight positions, $550,000.

    District, four positions, $275,000.

    This adds up to cost savings of $2.3 million. Lummis said the reductions are made up of a broad range of positions, not just teachers. Some positions can be moved to grants and positions of staff who leave or retire will not be filled.

    More savings would come through savings from benefits of laid-off employees, moving services and supports to grants, and reductions in instructional supplies and materials.

    The process to finalize notifying staff was scheduled to wrap up last week.

    This week, the administration will meet with Gloucester Teachers Association leaders as dictated by contracts to go over expected cuts of teachers with professional status. Principals and supervisors would then inform staff and provide information on the process and next steps for each individual.

    The week of April 29, the administration would have to determine if further cuts would be necessary based on talks with the city administration. The schools have until May 7 to inform any additional teachers with professional teacher status whose positions are planned for elimination.

    Waiting to inform staff may keep everyone on edge, with the vast majority of the schools’ staff not at risk of losing their jobs, Lummis said.

    “So we are trying to balance speed with the best information we have, our obligation in terms of our contracts and at the same time treating folks with compassion as well,” he said.

    During the School Committee meeting, Lummis presented a slide showing areas of reductions including Tier 2 interventions, which support students in small groups, at all levels.

    At the preK-5 level, the reductions would affect social emotional learning and mental health supports; at the middle school, it would mean the loss of the house structure; and at Gloucester High the loss of preparation and support for post-secondary success.

    School Committee member Melissa Teixeira Prince asked what was meant by the inability to maintain the house structure, asking if this just meant larger class sizes. She said the loss of the house structure at the middle school was “scary.”

    “Parents don’t want to hear that,” she said.

    “It’s in jeopardy,” Lummis said. He said the house structure, while it adds to a sense of belonging with the same students sharing the same teachers, it constrains flexibility in terms of staffing.

    Breaking apart the house structure allows flexibility in terms of fully loading all the classes. He said while the house structure is crucial, it’s something the administration has to look at given the level of cuts.

    “It doesn’t mean at this point it’s definitely going to go away,” Lummis said.

    He also outlined cuts to programs at a $1 million to $2 million level that would not be as deep. This list included delaying the medical assisting exploratory launch as part of the high school’s Career/Vocational Technical Education program until September 2025, along with specialists and electives, reduced staff in one or more core academic areas in the middle and high schools, along with delays in IT infrastructure improvements, among other things.

    Prince said she was sensing the schools were facing at least $2 million in reductions.

    “I don’t want any of this conversation to sugarcoat, like, there’s going to be a happy ending here because I don’t believe there is going to be a happy ending,” she said. “There are going to be cuts. There are going to be cuts that are going to hurt and this is a place we haven’t been in many years.”

    Financial resources from the city “don’t appear to be there to make us whole at this day and time,” Prince said

    A School Committee vote on a public hearing for the budget is scheduled for Wednesday, with a public hearing on the budget scheduled for May 8. The School Committee would then vote May 22 to submit the school budget to the mayor and City Council. Lummis said those dates could change.

    MANCHESTER-BY-THE-SEA — To residents Gretchen Wood and Lisa Bonneville, the town’s library is a dream.

    But Wood and Bonneville want that dream to be accessible for all who visit Manchester-by-the-Sea Public Library — including those who are disabled. Both are members of the town Americans with Disabilities Advisory Committee.

    Access for all to the library’s offerings is critical, but is a challenge because “the library is very small and it has very tight spaces,” Wood said Thursday. “We have some pretty deep concerns about the library’s accessibility.”

    Wood and Bonneville hope the town shows its support for the library, calling for the approval of a financing measure at annual Town Meeting on Wednesday that would lead to a potential library building project.

    Article 9 asks the town to apply for, accept and expend Massachusetts Public Library Construction Program grant funds and re-appropriate $150,000 of the $200,000 previously appropriated for restroom renovations at the library, 15 Union St.

    Library Director Cynthia Gemmell, who supports passage of Article 9, said she will be at Town Meeting to potentially answer questions about the measure.

    “I would very much like to see the town support the article,” she said. “This is a preliminary step to see if we could have a plan for the potential renovation and expansion of the library. This will allow us to address the space issues, accessibility issues, lack of programming space, lack of meeting space and lack of collection space.”

    Successful passage of Article 9 would enable the town to apply for a matching state grant that will help finance the planning and design of the library project, Wood said.

    “This will not fund it,” she said. “It will merely get us into this round of grant funding. We can’t go forward unless we are accepted. It’s a small ask.”

    Library Trustee Sarah Davis said Article 9 is supported by the Trustees, the Select Board, and the Americans with Disabilities Advisory Committee.

    “It’s a requirement for keeping us in the running for a potential grant from the Massachusetts Board of Library Commissioners,” she said. “It’s a requirement.”

    The town needs to apply for the grant by May 31, Davis said.

    “We’ve been working on the application for years,” she said.

    Access for everybody

    Wood, who served as town clerk in Manchester for 23 years before stepping down 13 years ago, will volunteer as a timekeeper during Town Meeting deliberations on Wednesday.

    The library, she said, needs attention, adding using the restroom in the building is impossible for some.

    “It’s a very tiny restroom,” Wood said. “That’s a problem.”

    Access to the young adult programs is limited since the programs are held on the library’s upper level – reached only by climbing a narrow full flight of metal stairs.

    “Imagine the feelings of a young person with physical challenges facing this obstacle,” reads the letter by Wood and Bonneville. “Searching for a book in the stacks would be impossible for anyone in a wheelchair. Then, there is the problem of the existing very small restroom tucked into a corner of the reading room, where it is hardly adequate for anyone, but certainly completely inaccessible to anyone in a wheelchair or walker, or a parent with a child in a stroller.”

    The library is a resource in Manchester that needs to be optimized, Wood said.

    “We have a beautiful building that is very valuable to the town,” she said. “It’s time to use it.”

    Ground was broken and construction began on the library in 1886. The building, designed by noted architect Charles P. McKim, was dedicated on Oct. 13, 1887, according to the library’s website.

    “It’s an architectural gem,” Davis said, who added the library’s limited accessibility, limited meeting space and the narrow staircase to the upstairs loft are among the problems faced by patrons and library staff.

    “We want to have more meeting space to support programs, hold meetings and make interactions possible,” she said. “It’s really important to act now.”

    Town Meeting is slated to begin at 6:30 p.m. at Memorial Elementary School at 43 Lincoln St. in Manchester.

    Peabody STEM NHS students team up for science fun

    PEABODY — Popsicle sticks launching into the air. Barbies bungee-jumping off balconies. The STEM competition at Peabody Veterans Memorial High School made experimenting as fun as it is educational.

    Hosted by the PVMHS chapter of the National STEM Honor Society, high schoolers led groups of Higgins Middle School students and a fourth grade chapter of STEM NHS from South Elementary School as they explored different types of energy on Friday.

    The first Peabody chapters of this national society were established in the fall. Friday marked the first time they’ve come together for a multi-school event.

    The day allowed elementary students to be mentored by middle schoolers, who were in turn inspired by soon-to-be PVMHS graduates, said Courtney Lawrence, a digital literacy and coding teacher at the middle school.

    “This is bringing excitement to children who love to do this type of material,” she said. “It’s not for everybody, but when you put them with like-minded people, the sky’s the limit and it doesn’t matter what the age group is.”

    PVMHS science teacher George Hyatt led the event at the high school. His members of STEM NHS explored with younger students how science, technology, engineering and mathematics (STEM) could be seen in two main experiments.

    Students made stick bombs out of a woven chain of popsicle sticks held together by tension and a single stick at the end. Once that end stick was removed, the chain broke and its stored energy launched the sticks into the air in a wave-like motion.

    They also had to figure out how to make a rubber band rope that keeps a Barbie doll safe during a bungee-jumping experiment off the balcony in the PVMHS atrium. They had to consider the doll’s height and weight, along with the durability of the rubber bands, and create a graph of the data.

    Barbie did take a few headers to the tiled floor (and one group snipped off their doll’s hair). But with adjustments to the length of the rope, each group had her swaying safely from the balcony by the time pizza arrived for lunch.

    “You never usually get to do super fun experiments like this in regular class because there’s not enough time,” said Kiara Evans, a 17-year-old senior who got to work with her 13-year-old sister Liliana, an eighth grader. “It’s nice to have a chance to be with the middle schoolers and elementary schoolers, even if it’s just for a day.”

    40 years later, Carver still seeking new trial in deadly Elliott Chambers fire

    BEVERLY — For most people, their last image of James Carver is from a black-and-white photo from 1989, the year he was convicted of setting a fire that killed 15 people at the Elliott Chambers rooming house in Beverly.

    For four days last week, a different version of Carver appeared in a courthouse in Lawrence — in a wheelchair, in handcuffs, wearing court-provided headphones so he could hear the legal arguments over his latest effort to gain freedom.

    Carver, now 60, is asking for a new trial, the fifth time he has done so since he was sentenced to life in prison for the notorious Elliott Chambers fire on July 4, 1984. His attorneys say there is new evidence in the case due to advances in fire science and eyewitness identification, and that a new jury should hear that evidence.

    “It is overwhelmingly clear that justice was not done and that Mr. Carver is entitled to a new trial,” attorney Lisa Kavanaugh told Judge Jeffrey Karp on Friday in Lawrence Superior Court.

    The fire at Elliott Chambers, now the location of a CVS on Rantoul Street, was one of the deadliest in the state’s history. A jury found that Carver, who lived in Danvers at the time, set the fire in a fit of jealousy over his former fiancée dating a man who lived there. Fifteen people died, including a 9-year-old boy who was visiting his grandmother, the rooming house manager.

    Carver’s previous requests for a new trial have been denied four times. But the legal team representing him now, which includes attorneys from the state public defender’s Innocence Program and the Boston College Innocence Program, says that advances in fire science and eyewitness identification principles provides new evidence that merits a new trial.

    Craig Beyler, a fire science expert for the defense, said investigators at the time of the 1984 fire relied on “myths and misconceptions” about fire science that were common at the time. The investigators concluded the fire was started by someone using an accelerant, such as gasoline, to ignite a stack of newspapers on the floor of an alcove in the building.

    Investigators relied on the “myth” that fire does not burn down, and that the fire actually started in the overhead area of the alcove and could have been caused by an electrical problem, Beyler said.

    Carver’s attorneys also question the reliability of eyewitness accounts that either placed Carver at the scene of the fire or said he later confessed to setting it. They said a “vast body of scientific research” has emerged since Carver’s trial that bears on the reliability of a witness’ identification of Carver.

    Nancy Franklin, a psychologist who specializes in cognition and memory, including eyewitness identification, testified that the witness who identified Carver at the scene had limited time to observe him, in unreliable lighting conditions at night. The witness was a taxi driver who made his observations while stopped at a traffic light at the corner of Rantoul and Elliott streets.

    There are also questions about how “police feedback” influenced the witness, saying his descriptions of Carver became more detailed as the police continued to develop more evidence against Carver, Franklin said.

    Carver’s lawyers have also submitted evidence suggesting that Carver did not get proper representation from his original defense lawyer due to the lawyer’s “personal and criminal misconduct,” including substance abuse.

    In a court filing opposing Carver’s request for a new trial, prosecutors in the Essex County District Attorney’s office said the new evidence is not strong enough to “cast real doubt” on the justice of Carver’s convictions. They said the original investigators did consider whether the fire could have started overhead and “dropped down” to the floor of the alcove, but dismissed that possibility.

    As for the new science that might be used to challenge a witness’ identification of Carver being at the scene of the fire, prosecutors said that same science could also be used to revisit testimony from other witnesses who did not identify Carver as the suspect they saw that night.

    The new science “constitutes a double-edged sword, and would be as likely to harm the defendant’s case as to help it,” prosecutors said.

    They also said there was plenty of evidence beyond the fire investigation and eyewitness accounts that led to Carver’s conviction — including threats and confessions made by Carver himself.

    “We had a lot of evidence from the defendant’s own mouth,” Assistant District Attorney Catherine Semel told Karp at Friday’s hearing.

    Another hearing in the motion for a new trial is scheduled for May 29. Karp’s ruling is not expected for months and will be subject to appeal.

    Karp called the matter a “significant case,” saying, “The defense is asking me to vacate a 40-year-old conviction in a 40-year-old case where 15 people died.”

    Carver, who is serving time at Old Colony Correctional Center in Bridgewater, was transported to the courthouse in Lawrence each day for the hearing. His daughter attended the hearing on Thursday, sitting in the front row. She declined to comment for this story.

    Peabody Boy Scout’s bridge project to begin construction

    PEABODY — Boy Scout Aiden Walsh has wanted to see a footbridge over a muddy path near his house since he was a little kid struggling to get his bike through that muck. Now 17, he’s taking matters into his own hands.

    The 17-year-old Essex Tech junior and Peabody resident is building a 32-foot long concrete and wood footbridge between the Peabody Independence Greenway and Lalikos Park for his Eagle Scout project.

    Weather permitting, he’ll be at the park building the bridge with 40 or so volunteers over the next two weekends. He hopes to have it open by May.

    “This has been an idea in my head for years and the minute I was able to get started, I wanted to jump on it right away,” Walsh said.

    He’s officially been working on the project for about a year now, and has raised $600 so far through a GoFundMe fundraiser to buy materials, food for volunteers when they’re at the site and upkeep on the bridge once it’s built.

    Most of the materials he needs have been donated by the Building Center in Gloucester. He’s received help from his friend Zac Ouellette, who is a mason in Salem, Scoutmaster Jeff Serre, Boy Scout leader Ryan Morley, fellow members of Boy Scout Troop 59, his family and other volunteers.

    “There’s way too many people to thank for this,” Walsh said. “This isn’t just my project — this is Peabody’s project.”

    Christina Baran agreed. She stopped to thank Walsh for his work while out with her three dogs Tuesday evening, right after walking across a small wooden pallet that’s a makeshift (and not very effective) walkway over the muddy path the new bridge will cover.

    Baran said she’s supported Walsh’s GoFundMe and shared it with her neighbors in Rolling Hills, the neighborhood off Lowell Street where the park is located.

    “I might actually start crying because this means a lot,” Baran said after thanking Walsh. “It’s nice to see that sense of community and giving back.”

    “It’s such a need in that area, because getting access from the park to the bike path has been challenging,” said Walsh’s mother, Ana Walsh. “I’m just blown away and super proud of him for finding something that was so meaningful to the community.”

    Meet the man who has tasted everything on the Cheesecake Factory’s ridiculously long menu

    LOS ANGELES — and jabbed his fork into a chunk of glistening cashew chicken.

    He closed his eyes for a moment, considering the texture of the dish, a longtime staple that, after a couple-year hiatus, would soon return to the chain’s menu.

    “Not as soft as I’d like it,” he told the executive chef, who nodded.

    Next, he turned to the seared ahi tuna salad, but he doesn’t like fish, so he took a single bite of lettuce and radish before confidently setting down his fork.

    “Nicely dressed. Great crunch!”

    Third up was Cajun salmon with mashed potatoes and corn. He dredged a spoonful of potatoes through the sauce and his lips wiggled from side to side. He nodded twice.

    “OK, delicious.”

    In the 46 years since he opened the first Cheesecake Factory restaurant in Beverly Hills and grew it into the behemoth of casual dining with locations across the globe, David Overton — the company’s official taster, but also its chief executive and co-founder — has built a deep trust in the profitability of his own palate.

    Overton has tasted and approved every one of the menu’s more than 250 items, which despite the factory in its name, the company likes to emphasize are prepared from scratch on site or at the company’s two bakeries.

    “What I like, millions of people like,” Overton, 77, said on a recent morning at the company’s Calabasas Hills headquarters as he weighed in on new offerings. “I have the taste buds of the common man.”

    Over the last few decades, as Cheesecake Factory locations popped up at malls and suburban plazas, they brought to each new corner of the country a sense that you were now in on some universal slice of Americana — a slice, it turns out, that provokes impressively fierce reactions.

    It didn’t matter if you were Tucson, Tampa or Tulsa, you, too, could now laugh with family and friends as you collectively gorged yourselves on the chain’s iconic brown bread. Before long, you, too, would come to associate the restaurant’s decor — a mashup of Egyptian-style columns, dark-wood wainscoting and ethereal murals that, when combined, exude the same over-the-top-yet-somehow-appealing vibe as a Vegas casino — with a sense of nostalgia. This would become the backdrop of birthdays and graduations and late-night meals after prom.

    You were now part of the collective experience shared by doctor and author Atul Gawande, who penned a sprawling ode to the Cheesecake Factory in the New Yorker, a Los Angeles Times food columnist, who, in a viral review in 2019, called his love of the chain “irrational and possibly pathological,” and rapper Drake, who sings about his love for the Cheesecake Factory, christening it as “a place for families that drive Camrys and go to Disney.”

    But not all of the attention is fawning.

    The chain made national headlines in 2017, when a man detonated a homemade explosive device inside a Cheesecake Factory in Pasadena. The FBI said the case remains unsolved.

    Late last year, a video went viral on TikTok of a woman refusing to get out of the car during a first date.

    “This is the Cheesecake Factory,” she says, filming herself, in what some viewers suggested was a staged scene.

    “What’s the problem with that?” he asks.

    “This is a chain restaurant.”

    Before long, someone compiled a list, which also circulated on social media, of places women should refuse to go on first dates, listing Cheesecake Factory as No. 1. (No. 2, Applebee’s; No. 15, the gym; No. 16, church.) The discourse swept the internet, earning two separate pieces in the Washington Post, and loyal fans soon swarmed to the brand’s defense on X.

    “WHO THE HELL DOES NOT WANNA GO TO THE CHEESECAKE FACTORY? BRO IF I WAS TAKEN THERE I WOULD PROPOSE,” one person posted on X (formerly Twitter).

    “I literally met my husband at the bar of a Cheesecake Factory 10 years ago,” Rachelle Tomlinson tweeted. “Stop all the slander!”

    Tomlinson, 30, was on a girls trip to Honolulu in 2014 when she visited the chain for the first time. Tomlinson recounted in an interview how she can still visualize the moment the double doors opened and she locked into a gaze with a man with hazel eyes.

    “Legit love at first sight,” her husband, Sam, recalled, saying the other thing he remembers from that night is that he drank a bunch of Mai Tais.

    Exactly a year from their Cheesecake meet cute, they got married.

    Growing up in Detroit, Overton said, his family could afford to eat out only once a week, usually Sundays at a deli or Chinese spot.

    His father worked at a department store and his mother sold cheesecakes she baked in the family’s basement based on a recipe found in a newspaper. Back then, there were only two varieties — original and original with strawberry topping — and Overton said he and his sister earned a penny for every bakery box they helped their mother fold.

    Years later, when Overton was in his 20s and chasing dreams of becoming a rock ‘n’ roll drummer in San Francisco, his parents, Evelyn and Oscar, tired of Detroit and a string of business ventures that never took off, decided to move west.

    They opened a small, wholesale bakery in North Hollywood, expanding their cheesecake options to include several more flavors, but the Cheesecake Factory Bakery floundered. They were in their mid-50s, working long hours and struggling to find customers who would buy in bulk.

    “I was really getting tired of all these restaurateurs that wouldn’t buy the cake,” Overton said, recalling the frustration that inspired him to start a restaurant of their own.

    On the day they opened in Beverly Hills in 1978, they began welcoming patrons at 2 p.m. and, by 2:10 p.m., Overton said, they were so busy that people had to wait to be seated — an immediate rush he attributes to divine intervention.

    “God was really watching over us,” he said. “I like to say that we had a line in 10 minutes, and it’s really never stopped for the last 45 years.”

    The company opened its second location in Marina del Rey in the early ‘80s and, in 1991, opened the first out-of-state location in Washington, D.C. The next year, the company went public — ticker symbol: CAKE — and today has more than 200 locations in the U.S., as well as several in the Middle East, Mexico and Asia.

    Cheesecake Factory locations brought in $2.5 billion of the company’s $3.3 billion in revenue in 2022, an average of about $12 million in sales at each restaurant, according to the company’s latest annual report to shareholders. (The company also owns the growing chain North Italia, acquired in 2019, as well as Fox Restaurant Concepts, whose upscale, fast casual restaurants the chain sees as a vehicle for expansion.)

    A key growth point, the report notes, has been an increase in takeout and delivery orders, which accounted for about 25% of total sales that year.

    Last year was bruising for a restaurant industry still recovering from pandemic shutdowns and buffeted by rising costs and labor shortages. But during the first nine months of 2023, the Calabasas Hills company racked up increased sales and income, and continued to expand.

    They’ve differentiated themselves with ample portions, a variety of “craveable” dishes difficult to replicate at home and the fact that they, unlike some competitors, still prepare everything from scratch at each restaurant, said Joshua Long, who follows the company in his role as managing director of the financial services firm Stephens.

    “The brand,” Long said, “has really found a spot in the hearts of consumers.”

    As the company grew, so did the length of the menu.

    It started as a single page, front and back, of items simple enough that, if a chef walked out on him, Overton could make them himself — a factory burger, which sold in the early days for $2.10, the Avocado Delights sandwich for $1.75, a slice of cheesecake for $1.25.

    For several years, Overton’s taste buds kept him from adding fish to the menu, and he also dragged his feet on selling steak, because of its price tag.

    “If you went on a date,” he said, “I didn’t want anybody ordering the steak and you couldn’t afford it.”

    Whenever he ate at a rival restaurant, he kept an eye out for dishes he could simplify or transform. During a meal at the Peninsula Beverly Hills years ago, he saw a menu item of cheese straws with avocado, which inspired the idea for avocado egg rolls, now a top seller.

    “How did I let the menu get so big?” Overton said. “I didn’t know what the heck I was doing. If I knew what I was doing and understood the restaurant business, it probably wouldn’t have turned out this way.”

    But it worked — and today, it’s become a key marketing tactic.

    The sheer size of the multi-page, spiral-bound menu has earned a ribbing from Ellen DeGeneres and inspired Halloween costumes and a Buzzfeed list of jokes, including one that, given the menu’s girth, and cultural relevance, compared it to the Bible.

    “We get so much PR just cause of that big menu,” Overton said, smiling. “I always say that our greatest difficulty is the size of the menu, but our greatest defense against competition is the size of our menu.”

    The menu items themselves are a cacophony of calories.

    Every year, the Center for Science in the Public Interest, a nonprofit health advocacy group, releases an “Xtreme Eating Awards “ list of single restaurant dishes that contain around a full day’s worth of calories. Two Cheesecake Factory items made the latest list — an Italian combo plate at 2,800 calories and a French Dip cheeseburger with fries at 2,200.

    But when you bring up calories with Overton, he looks unfazed — decadence is part of the brand and besides, he says, people rarely finish a dish in a single sitting.

    “We’re the king of doggy bags,” he says. “I don’t pay a lot of attention to calories, because we let people choose what they want.”

    But if there’s one thing America wants more than delicious, fattening food, it’s the idea — the vow — that they will soon eat less of it. Enter: SkinnyLicious, the brand’s name for menu items with fewer than 600 calories, which they added to the menu in 2011.

    SkinnyLicious items, Overton said, account for around 15% of sales.

    In the winter of 1993, David Gordon, now the company’s president, was looking for a job as a restaurant manager.

    He had applied to two different places, including a Cheesecake Factory on the Westside, but was more interested in the other small chain — until he had his Cheesecake Factory interview.

    The people interviewing him ate a burger in the middle of the interview — “a little strange,” Gordon says — and steered the conversation toward the intricacies and caliber of french fries. Over 20 minutes, they discussed everything from starch levels to how hollow the fries felt when you bit into them.

    “It intrigued me,” Gordon said. “This is somewhere where quality is incredibly important.”

    Early in his career at the company, Gordon recalled asking the person in charge of operations if there was a chance he would be transferred. He was planning to buy a house in Redondo Beach, Gordon explained, but didn’t want to if he might be moved.

    “No, no, fantastic, things are great,” he recalled being told.

    But a few months later, the man in charge of operations asked him to move to Woodland Hills, promising Gordon that, within a year, he would get him back to the location closest to his home. As the year mark approached, the boss kept his commitment.

    “He cared about me as a person,” Gordon said, noting that the company still works hard to live out that ethos.

    Cheesecake Factory locations are notoriously busy, so if you’re going to ask workers to be slammed all day and prepare and serve more than 200 different items from scratch, the workers need to feel a connection to the restaurant and the people they work for, Gordon said.

    Last year, the Cheesecake Factory, whose restaurants employ about 35,000 people, was one of only two restaurant chains — Panda Express’ parent company was the second — to earn a spot on both Fortune’s 100 Best Companies to Work For and People’s Companies that Care lists, which survey employees about company culture, pay, retention, opportunities and fairness.

    Their reputation for conscientiousness took a hit in 2018 when the California Department of Industrial Relations held the company and two janitorial contractors jointly liable for more than $4 million in wage theft violations after an investigation found the contractors’ employees assigned to eight Southern California Cheesecake Factory restaurants didn’t get proper rest or meal breaks, and weren’t paid overtime while waiting for kitchen managers to review their work at the end of a shift. Although Cheesecake Factory didn’t directly employ the workers, state law dictates that companies relying on subcontractors for labor can be held liable for workplace violations.

    In January, the California Labor Commissioner’s Office announced that it had reached a $1 million settlement against the company and both contractors.

    Sidney M. Greathouse, the vice president of legal services for the Cheesecake Factory, issued a statement that said “the company denies any wrongdoing and no longer utilizes the services of the janitorial companies at issue in the case.”

    Today, the company sells more than 30 varieties of cheesecake, but a massive painting of one of the originals — a simple slice topped with strawberry filling — hangs above Overton’s desk in his office that looks out on the hills of Calabasas.

    Sprawled across his desk are several stacks of folders each about a foot high. He’s a few years from 80, but between work and spending time with his wife, children and grandchildren, he doesn’t have much down time.

    “I have no time for hobbies,” he says. “I don’t play golf. I don’t do any of that.”

    He thought back on his 20s, around the time he started the business, when he first learned that you didn’t have to print your signature literally, but could sign it however you wanted.

    He played around with it and, as he wrote, let emotion guide him, creating a flowing capital D, which then exploded into 14 looping, semi ovals that start big and trail off.

    “It’s an emotion,” he said. “I just felt like I was moving forward.”

    Through the years, a few people had mocked his signature, he said, including someone who wrote to him saying, “I’m so sorry, with a signature like that, I won’t be investing in your company.”

    But he stuck with it. His gut hadn’t failed him yet.
