Two arrested after allegedly kidnapping elderly woman, attempting bank fraud in Ceres

(FOX40.COM) — A man and woman were arrested after kidnapping an elderly woman and attempting to have her withdraw a large amount of cash from a bank, the Ceres Police Department said.

A suspicious incident was reported around 10:53 a.m. at the Wells Fargo Bank located in the 2900 block of 4th Street after an elderly woman asked for help and stated that she was being kidnapped. Police said that when officers arrived at the scene, they found the woman with Delia Kelly, 38.

According to police, officers learned that Kelly and 33-year-old Nicholas Payton had brought the victim to the bank; however, Payton left the area before officers arrived. Officers located Payton one block from the bank.

Officers observed Payton wearing a backpack with a large imprint consistent with a firearm. After searching the backpack, officers found a loaded unserialized rifle.

Further investigation determined that Payton was prohibited from possessing firearms or ammunition as he was on active felony probation. Officials also said that he had multiple warrants and had a controlled substance.

Both Kelly and Payton were arrested and booked into jail on charges of kidnapping, elder abuse, and conspiracy to commit a crime. Payton received further charges of prohibited person
in possession of a firearm, a prohibited person in possession of ammunition, carrying a loaded
firearm in public, carrying a firearm while in possession of a controlled substance and
possession of an unserialized firearm.

CPD said that the elderly victim was safely released and reunited with her family.

Update: Fingerprint analysis determined that the woman arrested had falsely identified herself to investigating officers and intake deputies during the booking process. Jail staff identified her as Stephanie Maghoney, not Delia Kelly.

Maghoney had an active felony warrant out of the Tracy Police Department for burglary. She
was re-arrested for the outstanding warrant and additionally charged with felony
false impersonation, CPD released.
