The family of a woman who died while in custody at the Las Colinas jail in Santee filed a wrongful death lawsuit this week that alleges jail deputies ignored the woman’s repeated pleas for medical assistance in the hours leading up to her death.

Callen Lines, 31, died on May 12 due to fentanyl and methamphetamine toxicity, but according to the lawsuit filed Wednesday in San Diego federal court, jail staff were aware of her substance abuse history, yet failed to properly treat her withdrawal symptoms.

The complaint further alleges that just before her death, Lines was in medical distress and “screamed and begged for help, stating several times that she could not breathe and needed urgent medical attention.”

The lawsuit alleges she used the jail’s intercom system four times to notify staff that she was experiencing seizures and vomiting, but deputies “called her a `liar’ and terminated the calls.” During her last intercom call, she said she was going to pass out, to which deputies allegedly responded, “Sit down.”

Another deputy came by to perform a safety cell check and allegedly ignored Lines when she asked him to stop and speak with her.

She was found dead a few hours later.

The lawsuit alleges San Diego County’s “constitutionally deficient” practices for managing detainees with substance abuse issues was a factor in Lines’ death, as well as numerous others.

The complaint cites the 2019 in-custody death of Elisa Serna, which led to criminal charges against a jail doctor and nurse, the revocation of two jail doctors’ licenses, and a then-record $15 million settlement with Serna’s family. Serna also suffered from withdrawal symptoms that manifested in multiple seizures and bouts of falling down in her cell prior to her death, and was accused by some jail staff members of faking her symptoms.

The lawsuit also references the 2022 death of Vianna Granillo, who was suffering from withdrawal symptoms but was ignored by jail staff in the days just prior to her death, according to the complaint.

While Sheriff Kelly Martinez pledged to improve jail protocols for detainees with substance abuse histories, this week’s lawsuit alleges that any such protocols “were not meaningfully implemented as Ms. Lines was never continuously monitored for substance withdrawal, nor was she administered medication as prescribed — even though almost six years had passed since Elisa Serna’s death and three years since Vianna Granillo’s death.”

This week’s lawsuit was filed on behalf of Lines’ husband, two children, sister, and father. It names San Diego County, numerous medical staff members and jail deputies, and companies contracted to provide medical services to San Diego County’s jail facilities as defendants.

  • Stockton to pay $6M to family after man suffocates to death while in police custody

Stockton to pay $6M to family after man suffocates to death while in police custody

    [ad_1]

(FOX40.COM) — The City of Stockton will pay $6M as a part of a settlement to the family of a man who died in police custody in 2020.

Shayne Sutherland died at the hands of the Stockton Police Department in October of 2020 when his breathing was restricted during an arrest. Initial reports from the San Joaquin County Coroner’s Office stated that his death was accidental, however, an independent autopsy revealed that Sutherland died from positional asphyxiation.

“Things need to change because this is horrible. Nobody ever wants to lose their child, especially in this way,” said Karen Sutherland, Shayne Sutherland’s mother. “Knowing how my son died and suffering and begging for his life and calling out for me.”

Bodycam footage released by SPD shows part of the interaction between officers and Shayne Sutherland during the fatal incident. His family has fought for change in police policies ever since their loss.

“We believe that the city of Stockton should adopt the 1995 Department of Justice guidelines which state clearly that when you have an individual handcuffed, you get him up off his stomach as soon as possible, place them in what’s called a recovery position,” said the family’s attorney, James Desimone.

In response to the death of Shane Sutherland, a SPD spokesperson said “SPD sympathizes and recognizes that any loss of life is a tragedy that has a lasting effect.

We are dedicated to educating and training our Officers while collaborating with community partner organizations to best serve the community. We are dedicated to educating and training our Officers while collaborating with community partner organizations to best serve the community.”

  • Takeoff's Father Reportedly Joins $1 Million Wrongful Death Lawsuit

Takeoff's Father Reportedly Joins $1 Million Wrongful Death Lawsuit

Takeoff’s father joins the $1 Million lawsuit against the Houston establishment where his son was killed as a third party.

November marked a year since the tragic murder of Takeoff who fans were introduced to through the rap group MIGOS. The Atlanta rapper was shot inside 810 Billiards & Bowling in Houston, Texas during a heated argument over a dice game. Following the murder his mother Titiana Davenport filed a $1 Million wrongful death lawsuit against the venue citing adequate security measures.

Additionally, his mother is in a complicated fight for his $26 Million estate due to the rapper not having a will.

According to AllHipHop, Takeoff’s father Kenneth Ball has reportedly taken legal measures to join the lawsuit as a third party complicating the civil suit as well.

“[Kenneth Ball], the natural parent of [Takeoff], has suffered substantial pecuniary loss both in the past and in the future,” Brant J. Stogner told AHH. “Indeed, [Ball] has suffered past and future pecuniary loss, including funeral and burial expenses, psychological and psychiatric expenses, loss of advice, loss of counsel, loss of services, loss of care, loss of maintenance, and loss of support.”

If you’re curious how he was able to add himself to the lawsuit he did so by “intervening”. Third-Party “Intervenors” aren’t directly named in current legal situations and join by claiming a “personal stake” in the outcome. Furthermore, it doesn’t get more personal than a lawsuit over the murder of your son. Hopefully, the legal ordeals involving his passing end soon and the family can properly heal in peace. Both Quavo and Offset have publicly revealed the grieving process has been difficult for both of them.

After allegedly feuding they put their issues aside to celebrate Takeoff’s birthday and to celebrate him during the BET Awards. Hopefully, they continue to stay cordial so they can honor his legacy together as he would want.

  • The Champion Firm Obtains $17 Million Settlement in Wrongful Death Lawsuit Against MARTA

The Champion Firm Obtains $17 Million Settlement in Wrongful Death Lawsuit Against MARTA

    [ad_1]

    Press Release

    Mar 8, 2022

The Champion Firm, P.C., a Metro Atlanta personal injury law firm, obtained a $17 million settlement in a lawsuit against the Metropolitan Atlanta Rapid Transit Authority (MARTA). The lawsuit arose out of the death of a contractor who died on June 3, 2018, while performing work as part of a project to install a cellular wireless system in MARTA’s stations and tunnels.

The contractor’s surviving wife hired Darl Champion of The Champion Firm, P.C., and co-counsel Rudjard Hayes of Sanchez Hayes & Associates, shortly after her husband’s death. The lawsuit against MARTA was filed in Fulton County Superior Court in 2018.

In March 2022, faced with the prospect of a trial for the contractor’s death, MARTA agreed to settle all claims against MARTA and its employees for $17 million.

“Our client’s husband was a caring father, husband, son, brother, friend, and co-worker who was loved by all. Ultimately, after 3 years and 9 months of litigation, MARTA and its insurer took full responsibility and acknowledged the multiple errors that its employees committed,” Champion said. “While no amount of money will ever fill the tremendous void his loss has left in the lives of his wife, children, family and friends, this settlement will allow his wife and her children to have closure and financial security.”
