The end could be near for struggling retailer Bed Bath & Beyond, as it warned in a regulatory filing Thursday that it received a notice of default from its lender, JPMorgan Chase. Shares of Bed Bath & Beyond (BBBY) plunged more than 20% on the news, to about $2.56 a share.
The company said in its SEC filing Thursday that “at this time, the Company does not have sufficient resources to repay the amounts under the Credit Facilities and this will lead the Company to consider all strategic alternatives, including restructuring its debt under the U.S. Bankruptcy Code.”
Bed Bath & Beyond defaulted “on or around” January 13, according to the Securities & Exchange Commission filing. As a result, creditors are demanding immediate payment.
Bed Bath & Beyond could be forced to file for Chapter 11 bankruptcy reorganization due to its financial woes.
The company added that it is also cutting costs, lowering capital expenditures and closing stores and distribution centers.
Founded in 1971, Bed Bath & Beyond became a staple for affordable home decor, kitchenware and college dorm room furniture. The retailer became known for its ubiquitous 20% off blue coupons, and cavernous stores with merchandise stacked high to the ceilings.
But the company struggled to make the transition to online shopping and fend off larger chains such as Walmart (WMT) and Target
(TGT) (TGT). Many shoppers switched to those competitors as the novelty of Bed Bath & Beyond’s coupons faded – consumers can find plenty of cheaper alternatives on Amazon
(AMZN) (AMZN) and other online sites.
The company was also hit hard during the pandemic, closing stores temporarily during 2020 while rivals remained open. The company lost 17% of its sales in 2020 and 14% in 2021.
Bed Bath & Beyond has rotated through several different executives and turnaround strategies in recent years, including former Target executive Mark Tritton, who left the company last year after less than three years as CEO.
As of February 2022, Bed Bath & Beyond had 950 stores and 32,000 workers. The company also owns chidren’s retailer buybuy Baby.
Walmart announced an increase in base pay on Tuesday for its associates that will bring its average hourly pay to “more than” $17.50 an hour.

“We’re proud to continue investing in Walmart’s legacy by introducing new job opportunities and raising pay,” John Furner, president and CEO of Walmart U.S., wrote in a note to employees.
As part of the move, base pay for Walmart’s associates will increase from $12 an hour to $14 an hour, per CNBC. It’s also now reflected in the company’s “Working at Walmart,” page.
“Walmart’s starting hourly wage rates vary by region and role and have the following ranges: For store formats (e.g. Supercenter, Neighborhood Market grocery format): $14 to $32 per hour,” the site says.
Walmart’s 1.7 million U.S. workers also make it the nation’s largest private employer.
A spokesperson for Walmart told CNBC that, prior to this change, store associates made from $12 to $18 an hour. Now, the range will jump, to between $14 and $19 an hour. The change will be evident in March 2 paychecks for employees, Furner wrote.
Walmart is one of the many retail companies struggling to hire workers, as CNN noted — there are currently about 30,000 job openings. This has led to some minor wage competition. Amazon announced small pay raises for warehouse associates in October.
However, the retail trade sector lost jobs in November’s 2022 Job Openings and Labor Turnover report, while the overall job market remained robust.
Gregory Daco, chief economist at EY Parthenon, told CNBC it’s easier for companies like Walmart to avoid the large layoffs that are currently plaguing the tech sector because of labor churn, i.e., high turnover.
But Walmart raising its pay has a ripple effect, as it often functions as a local “minimum wage” as CNN noted.
“Hourly workers are still hard to find, and companies are continuing to compete for them by raising wages,” said Andy Challenger, senior vice president at labor firm Challenger, Gray & Christmas, per CNN.

The man accused of killing 23 people and wounding nearly two dozen others in the 2019 mass shooting at a Texas Walmart in 2019 intends to plead guilty to federal charges, according to court filings.
Days after the US government indicated it would not seek the death penalty, attorneys for Patrick Crusius filed a motion for a rearraignment, indicating he would change his earlier plea of not guilty.
“Defendant notifies the Court of his intention to enter a plea of guilty to the pending indictment,” the motion reads, and court records show the motion was granted.
Crusius, who is due back in court February 8, was indicted on 90 federal charges, including hate crimes and the use of a firearm to commit murder. The shooting, which took place in El Paso on August 3, 2019, marked one of the deadliest attacks on Latinos in modern US history.
Crusius previously pleaded not guilty to a state capital murder charge. The district attorney’s office in that case filed a notice indicating it would seek the death penalty.
Santa Fe, New Mexico, paid a local contractor $47,000 to round up about 3,000 shopping carts around the city in 2021 and 2022.
Fayetteville, North Carolina, spent $78,468 collecting carts from May 2020 to October 2022.
Shopping carts keep wandering away from their stores, draining taxpayers’ coffers, causing blight and frustrating local officials and retailers.
Abandoned shopping carts are a scourge to neighborhoods, as wayward carts block intersections, sidewalks and bus stops. They occupy handicap spots in parking lots and wind up in creeks, ditches and parks. And they clog municipal drainage and waste systems and cause accidents.
There is no national data on shopping cart losses, but US retailers lose an estimated tens of millions of dollars every year replacing lost and damaged carts, say shopping cart experts. They pay vendors to rescue stray carts and fork over fines to municipalities for violating laws on shopping carts. They also miss out on sales if there aren’t enough carts for customers during peak shopping hours.
Last year, Walmart paid $23,000 in fines related to abandoned shopping carts to the small town of Dartmouth, Massachusetts, said Shawn McDonald, a member of the town’s Select Board.
Dartmouth public workers spent two years corralling more than 100 Walmart carts scattered around town and housed them in one of the city’s storage facilities. When Walmart applied for a new building permit, the company was told it had to pay the town thousands of dollars in daily storage fees, McDonald said.
“It’s a safety issue with these carts careening down the hill. I had one that was left in the road as I was driving,” he said. “I got to the point where I got pissed.”
More municipalities around the country are proposing laws cracking down on stray carts. They are imposing fines on retailers for abandoned carts and fees for retrieval services, as well as mandates for stores to lock up their carts or install systems to contain them. Some localities are also fining people who remove carts from stores.
The city council in Ogden, Utah, this month approved an ordinance fining people who take store carts or are in possession of one. The measure also authorizes the city to charge retailers a fee of $2 a day for storage and handling fees to retrieve lost carts.
“Abandoned shopping carts have become an increasing nuisance on public and private properties throughout the city,” the council said in its summary of the bill. City officials “are spending considerable amounts of time to pick up and return or dispose of the carts.”
Matthew Dodson, the president of Retail Marketing Services, which offers cart retrieval, maintenance and other services to leading retailers in several western states, said lost shopping carts is a growing problem.
During the busy 2022 holiday season, Retail Marketing Service leased extra carts to retailers, and got back 91% of its approximately 2,000 carts, down from 96% the prior year.
Dodson and others in the shopping cart industry say the rise in lost carts can be attributed to several factors, including unhoused people using them to hold their belongings or as shelter. Homelessness has been rising in many major cities due to skyrocketing housing prices, lack of affordable housing, and other factors. There have also been incidents of people stealing carts for scrap metal.
Some people, especially in cities, also use supermarket carts to bring their groceries home from the store. Other carts drift away from parking lots if they aren’t locked up during rough weather or at night.
To be sure, the problem of wayward shopping carts is not new. They began leaving stores soon after they were introduced in the late 1930s.
“A new menace is threatening the safety of motorists in stores,” the New York Times warned in a 1962 article. “It is the shopping cart.” Another New York Times article in 1957 called the trend “Cart-Napping.”
There’s even a book, “The Stray Shopping Carts of Eastern North America: A Guide to Field Identification,” dedicated to the phenomenon and a system of identification for stray shopping carts, much like guides for bird-watching.
Edward Tenner, a distinguished scholar in the Smithsonian’s Lemelson Center for the Study of Invention and Innovation, said the misuse of everyday items like shopping carts is an example of “deviant ingenuity.”
It’s similar to talapia fishermen in Malaysia stealing payphones in the 1990s and attaching the receivers to powerful batteries that emitted a sound to lure fish, he said.
Tenner hypothesized that people take shopping carts from stores because they are extremely versatile and aren’t available elsewhere: “There’s really no legitimate way for an individual to buy a supermarket-grade shopping cart.”
Supermarkets can have 200 to 300 shopping carts per store, while big-box chains carry up to 800. Depending on the size and model, carts cost up to $250, said Alex Poulos, a sales director at R.W. Rogers Company, which supplies carts and other equipment to stores.
Stores and cart makers over the years have increased the size of carts to encourage shoppers to buy more items.
Stores have introduced several cart safety and theft-prevention measures over the years, such as cart corrals and, more recently, wheels that automatically lock if a cart strays too far from the store. (Viral videos on TikTok show Target customers struggling to push around carts with wheeled locks.)
Gatekeeper Systems, which offers shopping cart control measures for the country’s largest retailers, said demand for its “SmartWheel” radio-frequency locks has increased during the pandemic.
At four stores, Wegmans is using Gatekeeper’s wheel locks.
“The cost of replacing carts as well as the cost of locating and returning missing carts to the store led to our decision to implement the technology,” a Wegmans spokesperson said.
Aldi, the German grocery chain that’s rapidly expanding in the United States, is one of the few US retailers to require customers to deposit a quarter to unlock a cart.
Coin-lock shopping cart systems are popular in Europe, and Poulos said more US companies are requesting coin-lock systems in response to the costs of runaway shopping carts.

At least one person was wounded when a male suspect opened fire in a Walmart in Evansville, Indiana, Thursday night, authorities said. The suspect was shot and killed by officers, police said.
The incident was reported a little after 10 p.m. local time.
“Active shooter inside Walmart West,” Evansville police tweeted, advising the public to “avoid the area.”
At least one victim was hospitalized, Evansville police Sgt. Anne Gray told reporters in a briefing late Thursday night. His or her condition wasn’t known.
“At this time we don’t know how many other people he shot at, as far as any other people inside the store,” Gray said. “We’re still trying to gather that information.”
Gray said the suspect was killed after exchanging gunfire with police.
“There was multiple times that he was actually shooting at officers before they actually were able to shoot him,” Gray said.
Gray said he didn’t know if the suspect was an employee of the store or whether the shooting was random or targeted. His name and age weren’t immediately released.
Gray was also unsure of the type of gun the suspect used.
Walmart issued a statement saying, “The entire Walmart family is shocked by the senseless violence that occurred at our Evansville store, and our hearts are with our associate at this time. As we learn more, we’ll do everything we can to support our associates as they cope with this tragedy.”
On Nov. 23, a manager at a Walmart store in Chesapeake, Virginia, opened fire inside the store, killing six people before turning the gun on himself.

The US government said it would not seek the death penalty in its case against Patrick Crusius, who allegedly killed 23 people and wounded close to two dozen others at a Walmart in El Paso more than three years ago.
In the short, one-line-filing, First Assistant US Attorney Margaret Leachman did not include a reason for declining the death penalty.
In Texas, though, the district attorney’s office filed a notice last summer that it would seek the death penalty in the state’s case against Crusius.
The federal government indicted Crusius on 90 charges, including hate crimes and the use of a firearm to commit murder. The shooting, which took place on August 3, 2019, marked one of the deadliest attacks on Latinos in modern US history.
According to court documents, jury selection in the federal case is set to start in January 2024.
Back in September 2022, the US District Court for the Western District of Texas agreed to a January 17 deadline for the government to file notice on whether it would seek the death penalty.
The Texas case, meanwhile, has been bogged down by drama involving the former district attorney, Yvonne Rosales, who resigned in November. A trial date has not been set in that case.
Crusius has pleaded not guilty to the state capital murder charge and the federal charges.

CBS Essentials readers haven’t been able to get enough of The Pioneer Woman cookware and kitchen items this holiday season. Now, Walmart has discounted this ceramic cookware set from the best-selling brand in time for the holidays. The set includes twelve items; a 1-quart saucepan, a 3-quart saucepan with lid, a 4.5-quart saute pan with lid, a 5-quart Dutch oven with lid, 8″ and 10″ skillets, an egg pan, an acacia woodturner and an acacia wood ladle.
Walmart Marketplace is a popular destination for third-party companies to sell their products through the retail giant’s website. But one item slipped through the cracks recently, causing quite a controversy.
A pair of men’s hiking boots with a bright red “KKK” logo written on the tongue appeared on Walmart’s site. KKK is an abbreviation frequently used by the white supremacist hate group, the Klu Klux Klan.
The Council on American-Islamic Relations (CAIR) alerted Walmart about the shoes to “respectfully ask that they be removed,” according to Insider.
The store yanked the offensive boots off the site soon thereafter.
The boots have an impossibly long name, Harsuny Men’s Tactical Military Hiking Ankle Boot Outdoor Trekking Shoes, and sell for around $50. It is unclear if the company selling the boots is called Harsuny or if they have a racist agenda. At press time, no further information about the manufacturer has been released.
A spokesperson for Walmart told Best Life, “This item was listed by an outside third-party seller and removed because the item is inconsistent with our values and violates Walmart’s prohibited product policy.”
Like its chief competitor, Amazon, Walmart Marketplace allows third-party companies to sell their merchandise on its e-commerce site in exchange for a percentage of the profit.
“We have a process in place designed to prevent third-party sellers from offering inappropriate items on our platform,” a Walmart spokesperson said. “Still, at times, inappropriate items make their way onto our platform.”
In the case of the KKK-emblazoned boots, the system failed to detect an offensive item before it appeared on the site. Walmart wants to know why.
“We are reviewing how this happened and will apply what we learn to further improve our rules and processes to prevent the sale of inappropriate merchandise,” they said.
Oh yeah? Then why, when Kotaku called several brick-and-mortar stores just a few days before Christmas this year were we told inventory for both the PlayStation 5 and Xbox Series X consoles was either very limited or completely gone?
The truth of the matter is, while it has become somewhat easier to get your hands on new-gen consoles, doing so still requires diligence and patience—unless you want the smaller, cuter Series S, or can wait for shipping. Otherwise, much like last year, if you were hoping to walk in and out of a store with a brand-spanking-new console in hand, you’re likely out of luck.
Inventory In Brick-And-Mortar Stores Is Unreliable

You might be tempted to call up your local physical retailer like Best Buy or GameStop with the goal of buying a PlayStation 5 or Xbox Series X in the store. That’s certainly a possibility, though it depends on the console you’re going for.
A GameStop associate at a Manhattan, New York location told Kotaku over the phone that Sony’s system is “rarely” in stock and when it is on the store shelves, it’s gone within the week. The Xbox Series X is “a little more common,” the associate said, but the same inventory issue arises: When it is available, it’s sold out in just a few days’ time. This situation is repeated at other physical stores, including Best Buy and Walmart, with store associates at both retailers telling Kotaku in brief phone interviews that the PlayStation 5 and Xbox Series X are “occasionally” in stock but quickly sell out.
Surprisingly, things are a little different at Target. An employee at a Manhattan store said that the PlayStation 5 was actually sitting on the shelves “right now,” but folks looking to buy one couldn’t just walk in, take one to the counter, and check out. Instead, you have to do an in-store pick-up through the company’s website and, if inventory was available, then you could walk in with money and walk out with a PlayStation 5. In an eye-popping twist, the Xbox Series X was immediately available. The employee said, if I really wanted to, I could go buy Microsoft’s console this instant. They were quick to point out, though, that all system purchases—especially on the PlayStation 5—were limited to one per person due to “security concerns.” Yikes.
Online Retailers Are A Bit Better, But Not By Much
If brick-and-mortar stores are unreliable in terms of physical inventory, you may have a better chance at buying a PlayStation 5 or Xbox Series X online and shipping it to your home. All the major retailers typically have both consoles in stock and if they aren’t available by themselves, you can usually get it bundled with a game or subscription. There are some exceptions here, of course. GameStop, for example, is completely sold out of individualPlayStation 5s and Xbox Series Xs online right now. As is Best Buy on the PlayStation 5, though you can order the Xbox Series X if you have an account.
It’s always finicky ordering something from Walmart, as the company tends to partner with third-party sellers to complete transactions. But, as I’m checking the company’s website right now, PlayStation 5s and Xbox Series Xs are mostly available to purchase online—though the prices for these consoles seem to vary wildly. Target is similarly strange, withbothsystems either being “discontinued for shipping” or relegated to in-store pick-up only—if they are even available at all, of course. One quick note here, though: You could also order the PlayStation 5 or Xbox Series X directly from Sony and Microsoft’s official websites, and they appear to be in stock. Shipping here seems to be comparable to other major retailers as well, with orders placed now arriving just a few days after Christmas. Not bad.
Hey, You Could Always Just Get An Xbox Series S

You may have noticed I skipped one whole console: the Xbox Series S. That’s because, as I wrote earlier, Microsoft’s cheaper, smaller system is almost always available. Several associates across the brick-and-mortar stores told Kotaku over the phone that they had “plenty” of Xbox Series S’s sitting on their shelves at the moment. And while I was browsing around multiple online retailers, including Microsoft’s own website, the slimmer sister to the behemoth shoebox Xbox Series X was ready to be ordered.
Sure, it’s not the monster powerhouse that is the Xbox Series X. It can’t output native “true 4K” and only has four teraflops of processing power when compared to the bigger sister’s 12. And yeah, you do only get 512 GB of internal storage instead of 1 TB. But what the system lacks in power is made up by its impressive form factor and accessible price point. If you’re willing to make those minor trade-offs, then the Xbox Series S is an excellent way to get into this current generation of console gaming.
Another year is in the books, y’all. We made it through. The entertainment and technology industries are still getting battered by both the ongoing pandemic and semiconductor shortages, but it does appear that things are smoothing over a little. Maybe this time next year, the forecast of getting a PlayStation 5 or Xbox Series X will be significantly better. At the very least, we don’t have to worry much about bots anymore.

It must have been Christmas of 1991 that I found Space Quest IV: Roger Wilco and the Time Rippers under the tree, and got the gift of seeing exciting new possibilities in games.
I was a fan of adventure games, sure, having played a few games in Sierra’s King’s Quest series, not to mention Lucasfilm’s brilliant and bizarre early titles like Maniac Mansion and The Secret of Monkey Island. But this was my first experience with Space Quest, Sierra’s comedic sci-fi series starring Roger Wilco, the hapless space-janitor who finds himself thrust into one cosmic misadventure after another.
To be honest, I don’t remember much about the quality of Space Quest IV’s puzzles. What I do remember is how varied and vibrant its universe seemed, with harsh alien worlds, moody cantinas, and glitzy space-malls. But what really knocked my socks off about the game was how meta it was. After progressing a bit through Space Quest IV: Roger Wilco and the Time Rippers itself, poor Roger finds himself flung into (the non-existent) Space Quest XII: Vohaul’s Revenge II.

Today, it’s not so uncommon for games to break the fourth wall and wink knowingly at the player about being video games, to play with conventions in ways both tired and inspired. But wow, was this exciting for me in 1991! The game also sees you venturing into Space Quest X: Latex Babes of Estros (an obvious riff on the 1986 Infocom adventure Leather Goddesses of Phobos) and all the way back to the original Space Quest, which already looked humorously primitive and pixelated compared to 1991’s state-of-the-art graphics, making high(er)-definition Roger Wilco all the more conspicuous.

Space Quest IV may or may not be a great game, I honestly don’t remember well enough to say. I just remember sitting there on my Christmas break, awestruck by the clever meta-ness of it all, and having my mind expanded about the possibilities of what video game storytelling and structure could do.
Christmas came early for one long-time Walmart employee who received a life-changing payment thanks to one customer who was inspired by her story.
Eighty-two-year-old Carmen Kelly caught the eye of shopper Elizabeth Rizzo at an Arizona Walmart earlier this month.
Rizzo first posted a Tiktok talking to and showing Kelly working while using a cane, noting that she wasn’t able to sit during her shift and that she needed to work to pay off medical bills.
“I’m going to make sure this goes viral and get you some help, Carmen. I’m going to try my best,” Rizzo says in the video, which has now been viewed more than 15.2 million times.
“I could never, ever repay you and thank you,” Kelly says. “You’re changing my whole life and I just feel like God sent you to me.”
In a serendipitous turn of events, it was revealed in that TikTok that Rizzo and Kelly are in fact neighbors. The video also explained that Kelly and her family will be using a financial team and advisor to ensure that the funds collected will go into a trust for Kelly, noting that she must claim the funds by April but can begin transferring them at the end of this month.
Rizzo provided viewers with another recent update showing Kelly on the job. She excitedly thanked TikTok and told viewers that people in the store have been coming up and congratulating her.

One, partly owned by Walmart, is a fintech startup ready to take on a growing buy now, pay later (BNPL) industry dominated by existing businesses like Affirm — whose shares reportedly dipped Friday in response to the news.
CNBC cites an unnamed source in reporting that One is planning to launch a service for Walmart shoppers that they can use both in stores and online. It is set to launch within the next year and is viewed as an answer to economic volatility and consumer anxiety over inflation.
According to CNBC, Americans are feeling inflation’s effects on the costs of necessities, like housing and food, and this has spurred continued interest in alternative payments. With BNPL, consumers can take the stress off their bank accounts by making fixed, smaller monthly payments.
The Information first reported Walmart’s interest in One. It’s an unsurprising direction for the retail giant, which has long offered various financial services to low-income customers via money centers, where customers can print checks, load prepaid debit cards, and wire money.
CNBC notes that One comes with a Goldman Sachs pedigree — it’s led by Omer Ismail and David Starks, Goldman veterans who departed the venerable investment banking firm for the Walmart-backed startup in early 2021.

A Walmart worker who survived last week’s mass shooting at a Virginia store is suing the retail giant for $50 million, saying that she and others had complained about her former co-worker’s behavior prior to him carrying out the attack and that the store’s management failed to keep its employees safe.
Donya Prioleau, in a lawsuit filed Tuesday in Chesapeake Circuit Court, says the gunman, who worked as a store supervisor, kept a “kill list” of potential shooting targets. He also threatened retaliation if ever fired, saying “people will remember my name,” and expressed paranoia about being watched by the government, her suit states.
The Nov. 22 attack in Chesapeake left six people dead, not including the gunman, who was identified by police as Andre Bing.
“Many Walmart employees and managers, including Ms. Prioleau, had observed Mr. Bing exhibit bizarre and threatening behavior leading up to the shooting,” her lawsuit states, adding that Walmart had been warned that Bing “was violent and could harm others.”

Prioleau submitted a complaint about Bing via a Walmart Global Ethics statement form in September. It accused him of harassing her and making inappropriate comments, including about her age, height and socioeconomic status, according to the lawsuit.
On the same day that her ethics complaint was filed, Prioleau’s mother also spoke with a store manager to express concerns about her daughter’s safety in relation to Bing. Her mother was told that “nothing … could be done about Mr. Bing because he was liked by management,” according to the lawsuit.
“Walmart and its managers were aware of Mr. Bing’s behavior and threats, but kept employing him anyway,” her suit alleges.
A Walmart representative, in a statement to HuffPost on Wednesday, said the company is reviewing the suit and will respond as appropriate with the court.

In addition to physical injuries sustained while attempting to flee the violence, Prioleau states that she continues to experience severe anxiety, nightmares, sleeplessness, flashbacks, stomach pain and a loss of appetite.
“Bullets whizzed by … [Prioleau’s] face and left side, barely missing her. She witnessed several of her coworkers being brutally murdered on either side of her,” her suit states.
“As workplace shootings and violence become horrifyingly common, employers have a responsibility to understand the warning signs and take threats seriously in order to protect their employees and customers,” her attorneys, John Morgan and Peter Anderson of Morgan & Morgan, said in a statement.
“Our hearts are broken for the families of those who lost loved ones and for those, like Ms. Prioleau, whose lives will never be the same because of this trauma. We will work to hold Walmart accountable for failing to stop this tragedy.”
