    No antibiotics worked, so this woman turned to a natural enemy of bacteria to save her husband's life | CNN

    In February 2016, infectious disease epidemiologist Steffanie Strathdee was holding her dying husband’s hand, watching him lose an exhausting fight against a deadly superbug infection.

    After months of ups and downs, doctors had just told her that her husband, Tom Patterson, was too racked with bacteria to live.

    “I told him, ‘Honey, we’re running out of time. I need to know if you want to live. I don’t even know if you can hear me, but if you can hear me and you want to live, please squeeze my hand.’

    “All of a sudden, he squeezed really hard. And I thought, ‘Oh, great!’ And then I’m thinking, ‘Oh, crap! What am I going to do?’”

    What she accomplished next could easily be called miraculous. First, Strathdee found an obscure treatment that offered a glimmer of hope — fighting superbugs with phages, viruses created by nature to eat bacteria.

    Then she convinced phage scientists around the country to hunt and peck through molecular haystacks of sewage, bogs, ponds, the bilge of boats and other prime breeding grounds for bacteria and their viral opponents. The impossible goal: quickly find the few, exquisitely unique phages capable of fighting a specific strain of antibiotic-resistant bacteria literally eating her husband alive.

    Next, the US Food and Drug Administration had to greenlight this unproven cocktail of hope, and scientists had to purify the mixture so that it wouldn’t be deadly.

    Yet just three weeks later, Strathdee watched doctors intravenously inject the mixture into her husband’s body — and save his life.

    Their story is one of unrelenting perseverance and unbelievable good fortune. It’s a glowing tribute to the immense kindness of strangers. And it’s a story that just might save countless lives from the growing threat of antibiotic-resistant superbugs — maybe even your own.

    “It’s estimated that by 2050, 10 million people per year — that’s one person every three seconds — is going to be dying from a superbug infection,” Strathdee told an audience at Life Itself, a 2022 health and wellness event presented in partnership with CNN.

    “I’m here to tell you that the enemy of my enemy can be my friend. Viruses can be medicine.”

    How this ‘perfect predator’ saved his life after nine months in the hospital

    During a Thanksgiving cruise on the Nile in 2015, Patterson was suddenly felled by severe stomach cramps. When a clinic in Egypt failed to help his worsening symptoms, Patterson was flown to Germany, where doctors discovered a grapefruit-size abdominal abscess filled with Acinetobacter baumannii, a virulent bacterium resistant to nearly all antibiotics.

    Found in the sands of the Middle East, the bacteria were blown into the wounds of American troops hit by roadside bombs during the Iraq War, earning the pathogen the nickname “Iraqibacter.”

    “Veterans would get shrapnel in their legs and bodies from IED explosions and were medevaced home to convalesce,” Strathdee told CNN, referring to improvised explosive devices. “Unfortunately, they brought their superbug with them. Sadly, many of them survived the bomb blasts but died from this deadly bacterium.”

    Today, Acinetobacter baumannii tops the World Health Organization’s list of dangerous pathogens for which new antibiotics are critically needed.

    “It’s something of a bacterial kleptomaniac. It’s really good at stealing antimicrobial resistance genes from other bacteria,” Strathdee said. “I started to realize that my husband was a lot sicker than I thought and that modern medicine had run out of antibiotics to treat him.”

    With the bacteria growing unchecked inside him, Patterson was soon medevaced to the couple’s hometown of San Diego, where he was a professor of psychiatry and Strathdee was the associate dean of global health sciences at the University of California, San Diego.

    “Tom was on a roller coaster — he’d get better for a few days, and then there would be a deterioration, and he would be very ill,” said Dr. Robert “Chip” Schooley, a leading infectious disease specialist at UC San Diego who was a longtime friend and colleague. As weeks turned into months, “Tom began developing multi-organ failure. He was sick enough that we could lose him any day.”

    After that reassuring hand squeeze from her husband, Strathdee sprang into action. Scouring the internet, she had already stumbled across a study by a Tbilisi, Georgia, researcher on the use of phages for treatment of drug-resistant bacteria.

    A phone call later, Strathdee discovered phage treatment was well established in former Soviet bloc countries but had been discounted long ago as “fringe science” in the West.

    “Phages are everywhere. There’s 10 million trillion trillion — that’s 10 to the power of 31 — phages that are thought to be on the planet,” Strathdee said. “They’re in soil, they’re in water, in our oceans and in our bodies, where they are the gatekeepers that keep our bacterial numbers in check. But you have to find the right phage to kill the bacterium that is causing the trouble.”

    Buoyed by her newfound knowledge, Strathdee began reaching out to scientists who worked with phages: “I wrote cold emails to total strangers, begging them for help,” she said at Life Itself.

    One stranger who quickly answered was Texas A&M University biochemist Ryland Young. He’d been working with phages for over 45 years.

    “You know the word persuasive? There’s nobody as persuasive as Steffanie,” said Young, a professor of biochemistry and biophysics who runs the lab at the university’s Center for Phage Technology. “We just dropped everything. No exaggeration, people were literally working 24/7, screening 100 different environmental samples to find just a couple of new phages.”

    While the Texas lab burned the midnight oil, Schooley tried to obtain FDA approval for the injection of the phage cocktail into Patterson. Because phage therapy has not undergone clinical trials in the United States, each case of “compassionate use” required a good deal of documentation. It’s a process that can consume precious time.

    But the woman who answered the phone at the FDA said, “‘No problem. This is what you need, and we can arrange that,’” Schooley recalled. “And then she tells me she has friends in the Navy that might be able to find some phages for us as well.”

    In fact, the US Naval Medical Research Center had banks of phages gathered from seaports around the world. Scientists there began to hunt for a match, “and it wasn’t long before they found a few phages that appeared to be active against the bacterium,” Strathdee said.

    Back in Texas, Young and his team had also gotten lucky. They found four promising phages that ravaged Patterson’s antibiotic-resistant bacteria in a test tube. Now the hard part began — figuring out how to separate the victorious phages from the soup of bacterial toxins left behind.

    “You put one virus particle into a culture, you go home for lunch, and if you’re lucky, you come back to a big shaking, liquid mess of dead bacteria parts among billions and billions of the virus,” Young said. “You want to inject those virus particles into the human bloodstream, but you’re starting with bacterial goo that’s just horrible. You would not want that injected into your body.”

    Purifying phage to be given intravenously was a process that no one had yet perfected in the US, Schooley said, “but both the Navy and Texas A&M got busy, and using different approaches figured out how to clean the phages to the point they could be given safely.”

    More hurdles: Legal staff at Texas A&M expressed concern about future lawsuits. “I remember the lawyer saying to me, ‘Let me see if I get this straight. You want to send unapproved viruses from this lab to be injected into a person who will probably die.’ And I said, “Yeah, that’s about it,’” Young said.

    “But Stephanie literally had speed dial numbers for the chancellor and all the people involved in human experimentation at UC San Diego. After she calls them, they basically called their counterparts at A&M, and suddenly they all began to work together,” Young added.

    “It was like the parting of the Red Sea — all the paperwork and hesitation disappeared.”

    The purified cocktail from Young’s lab was the first to arrive in San Diego. Strathdee watched as doctors injected the Texas phages into the pus-filled abscesses in Patterson’s abdomen before settling down for the agonizing wait.

    “We started with the abscesses because we didn’t know what would happen, and we didn’t want to kill him,” Schooley said. “We didn’t see any negative side effects; in fact, Tom seemed to be stabilizing a bit, so we continued the therapy every two hours.”

    Two days later, the Navy cocktail arrived. Those phages were injected into Patterson’s bloodstream to tackle the bacteria that had spread to the rest of his body.

    “We believe Tom was the first person to receive intravenous phage therapy to treat a systemic superbug infection in the US,” Strathdee told CNN.

    “And three days later, Tom lifted his head off the pillow out of a deep coma and kissed his daughter’s hand. It was just miraculous.”

    Patterson awoke from a coma after receiving an intravenous dose of phages tailored to his bacteria.

    Today, nearly eight years later, Patterson is happily retired, walking 3 miles a day and gardening. But the long illness took its toll: He was diagnosed with diabetes and is now insulin dependent, with mild heart damage and gastrointestinal issues that affect his diet.

    “He isn’t back surfing again, because he can’t feel the bottoms of his feet, and he did get Covid-19 in April that landed him in the hospital because the bottoms of his lungs are essentially dead,” Strathdee said.

    “As soon as the infection hit his lungs he couldn’t breathe and I had to rush him to the hospital, so that was scary,” she said. “He remains high risk for Covid but we’re not letting that hold us hostage at home. He says, ‘I want to go back to having as normal life as fast as possible.’”

    To prove it, the couple are again traveling the world — they recently returned from a 12-day trip to Argentina.

    “We traveled with a friend who is an infectious disease doctor, which gave me peace of mind to know that if anything went sideways, we’d have an expert at hand,” Strathdee said.

    “I guess I’m a bit of a helicopter wife in that sense. Still, we’ve traveled to Costa Rica a couple of times, we’ve been to Africa, and we’re planning to go to Chile in January.”

    Patterson’s case was published in the journal Antimicrobial Agents and Chemotherapy in 2017, jump-starting new scientific interest in phage therapy.

    “There’s been an explosion of clinical trials that are going on now in phage (science) around the world and there’s phage programs in Canada, the UK, Australia, Belgium, Sweden, Switzerland, India and China has a new one, so it’s really catching on,” Strathdee told CNN.

    Some of the work is focused on the interplay between phages and antibiotics — as bacteria battle phages they often shed their outer shell to keep the enemy from docking and gaining access for the kill. When that happens, the bacteria may be suddenly vulnerable to antibiotics again.

    “We don’t think phages are ever going to entirely replace antibiotics, but they will be a good adjunct to antibiotics. And in fact, they can even make antibiotics work better,” Strathdee said.

    In San Diego, Strathdee and Schooley opened the Center for Innovative Phage Applications and Therapeutics, or IPATH, in 2018, where they treat or counsel patients suffering from multidrug-resistant infections. The center’s success rate is high, with 82% of patients undergoing phage therapy experiencing a clinically successful outcome, according to its website.

    Schooley is running a clinical trial using phages to treat patients with cystic fibrosis who constantly battle Pseudomonas aeruginosa, a drug-resistant bacteria that was also responsible for the recent illness and deaths connected to contaminated eye drops manufactured in India.

    And a memoir the couple published in 2019 — “The Perfect Predator: A Scientist’s Race to Save Her Husband From a Deadly Superbug” — is also spreading the word about these “perfect predators” to what may soon be the next generation of phage hunters.

    How naturally occurring viruses could help treat superbug infections

    “I am getting increasingly contacted by students, some as young as 12,” Strathdee said. “There’s a girl in San Francisco who begged her mother to read this book and now she’s doing a science project on phage-antibiotic synergy, and she’s in eighth grade. That thrills me.”

    Strathdee is quick to acknowledge the many people who helped save her husband’s life. But those who were along for the ride told CNN that she and Patterson made the difference.

    “I think it was a historical accident that could have only happened to Steffanie and Tom,” Young said. “They were at UC San Diego, which is one of the premier universities in the country. They worked with a brilliant infectious disease doctor who said, ‘Yes,’ to phage therapy when most physicians would’ve said, ‘Hell, no, I won’t do that.’

    “And then there is Steffanie’s passion and energy — it’s hard to explain until she’s focused it on you. It was like a spiderweb; she was in the middle and pulled on strings,” Young added. “It was just meant to be because of her, I think.”

    The University of California Is Reversing Course on Its ‘Data Science’ Admissions Standard

    A University of California academic-governance panel has voted to undo a controversial admissions standard that professors fear is not preparing students for college-level math, just as it is on the cusp of being written into statewide policy for high schools.

    On Friday, a systemwide faculty committee that oversees admission policies voted to stop high-school data-science courses from counting toward the UC’s math requirement, according to an email obtained by The Chronicle. Since this policy was adopted in 2020, faculty members across California have expressed concern that the UC system is rubber-stamping courses that bill themselves as “data science” but that do not impart the algebra needed to major in data science or other science, engineering, math, and technology majors, as The Chronicle reported last week.

    The governance panel — called the Board of Admissions and Relations with Schools (Boars) — seems to have delivered a major setback to these popular courses. “Introduction to Data Science” is taught at some 165 high schools across California, claims to have been taken by 42,200 students to date, and was developed at the University of California at Los Angeles by Robert L. Gould, a statistics instructor.

    Another course, “Explorations in Data Science,” is taught at more than 105 schools in the state and has been taken by more than 160,000 students, according to Jo Boaler, a Stanford professor of mathematics education who helped develop the course at Youcubed, a Stanford research center. Gould and Boaler have said that their classes teach the useful skill of crunching real-world data, and engage students who might otherwise drop out of math and won’t need calculus in their careers.

    But on Friday, Boars, which consists of representatives from each UC campus, voted unanimously to drop data science from its math admissions standards, two people who were present told The Chronicle.

    “Those courses, especially ‘Introduction to Data Science’ and Youcubed, should not have been approved as an advanced math course or a replacement for algebra II,” said one attendee, who requested anonymity to discuss the confidential deliberations. They said that none of the members tried to defend the policy.

    The UC director of undergraduate admissions confirmed the vote in an internal email obtained by The Chronicle. She also wrote that Boars will establish an advisory group this fall “to address definitions of ‘advanced math.’”

    The vote throws into question California’s math framework, which gives guidance to the state’s K-12 schools about how to teach math. After being in the works for three contentious years, the third and latest version was released on June 26. It currently encourages high schools to consider offering data science — and cites the UC’s data-science policy as evidence that the UC system will “value a range of mathematics courses as pathways to college.”

    The California Board of Education is scheduled to vote on the framework on Wednesday morning. In a public comment submitted late last week, Barbara Knowlton, the Boars chair, indicated that her group was having “significant discussion” about whether the currently approved data-science courses would continue to count.

    As of Tuesday afternoon, the Boars vote to ditch the policy had not been announced. On Monday night, Knowlton told members that she did not think that the group had the authority to implement the vote. “I do not think we have the power to do this,” she wrote in an email obtained by The Chronicle.

    Neither Knowlton nor a spokesperson for the UC president’s office returned requests for comment by publication time.

    A spokeswoman for California’s Board of Education said it was aware of the panel’s vote. “Given the decision, the Board would consider amendments to the framework during deliberations on Wednesday to ensure framework language is correctly aligned with the UC system,” the spokeswoman, Janet Weeks, said by email.

    Traditionally, the UC system requires applicants to take at least three years of high-school math, including algebra II. Its current troubles began in 2020, when it expanded its definition of acceptable advanced-math courses.

    In May of that year, an advisory group of mathematicians and statisticians, convened by the UC administration, recommended allowing data science and other courses to count toward the math requirement. One of the advisers was Gould, the UCLA statistician who’d led the development of “Introduction to Data Science.” That October, the Boars members unanimously adopted the proposal.

    At the time, Gould called the decision “a great relief.” “There are enough old guards out there in the UC math system that a serious challenge to revising the policy was a real possibility,” he wrote to colleagues on October 3, 2020, in an email obtained by a private citizen through a public-records request. “In fact, in our ad-hoc committee, some of the mathematicians expressed concerns that some colleague[s] would not be happy with the change.”

    He also raised the question of whether Boars could revise the policy or whether the UC Academic Senate needed to vote to make it official (which, to date, it has not). “I believe that the plan is to move ahead as if BOARS has the right, and see if it is challenged, since the attempts at researching this were ambiguous,” Gould wrote.

    Reached for comment on Tuesday, Gould said by email that Boars “has always had that right as far as I know.” He said that his message from 2020 was “expressing my ignorance of what happens once the ad-hoc committee makes its recommendation.”

    He also said that it was not a conflict of interest for him to serve on a committee that recommended green-lighting courses like his. “It worries me when decisions are made about statistics courses without input from statisticians, just as it would worry me if a decision were made about a geometry course and only statisticians were on the committee,” he wrote. “So it seems appropriate to me that a faculty member who writes statistics and data science curriculum would be asked to weigh in with his experiences.” He said that he has been paid for the courses through grants proposed by him and awarded to UCLA, as well as by an external funding agency for work related to the grants.

    When it unveiled the policy, Boars said that data-science classes must still “build upon” concepts from algebra II and be designed for juniors and seniors. But “Introduction to Data Science” and “Explorations in Data Science,” which are both UC-approved, teach only concepts from algebra II that overlap with statistics, and “Introduction to Data Science” can be taken in the first half of high school, according to critics who call the curricula more akin to “data literacy.” Skipping or delaying algebra II, they say, threatens the likelihood that college freshmen, including those from underrepresented backgrounds, will enter calculus-ready, as quantitative majors across the UC system require. (Ryan King, a UC spokesperson, previously told The Chronicle that “many” applicants are still taking algebra II in addition to courses like data science.)

    Hundreds of professors in California have signed an open letter that protests promoting data science as an alternative to algebra II. And over the past year, Boars and UC leadership have been fielding concerns from representatives on behalf of the Berkeley, Santa Cruz, and Irvine campuses; Riverside’s math department; Santa Barbara’s computer science, mechanical engineering, and physics departments; and a group of Black UC faculty in STEM fields. California State University’s Academic Senate also sent in resolutions passed earlier this year. It called “Introduction to Data Science” “inadequate preparation for college and career readiness” and also said that it would no longer automatically accept UC-approved advanced-math courses, as it had traditionally done.

    As recently as May, the UC system was promoting the Youcubed data-science course to high-school administrators.

    Gould, who has defended his course as “considerably more complex and ‘advanced’ than algebra II,” said that he was disappointed to learn of the Boars vote.

    “I fear that a pathway to college for the many who fail Algebra II or who know that they are not interested in STEM might have been shut,” he wrote.

    A spokesman for Boaler, who helped create “Explorations in Data Science,” did not return a request for comment by publication time.

    This Professor Criticized Diversity Statements. Did It Cost Him a Job Offer?

    A psychologist spoke out this week about what critics see as a job offer gone awry over an ideological spat about diversity statements.

    Yoel Inbar, an associate professor at the University of Toronto, was up for a job at the University of California at Los Angeles. But the psychology department there decided not to proceed after more than 60 graduate students in the department signed an open letter urging the university not to hire him.

    At issue, the students wrote, were Inbar’s comments on his podcast expressing skepticism about the use of diversity statements in hiring, as well as about other efforts intended to make the academy more inclusive.

    In the letter, which circulated on Twitter, the students wrote that Inbar’s hiring “would threaten ongoing efforts to protect and uplift individuals of marginalized backgrounds” and that Inbar “prioritizes advocating for those he classifies as political minorities in academia” over fostering inclusivity. In a meeting with graduate students, the letter continues, Inbar’s answers to questions about diversity, equity, and inclusion were in some cases “outright disconcerting.” (Inbar shared his account on a podcast episode released on Tuesday, and spoke with The Chronicle on Wednesday.)

    Days after the letter came out, the psychology-department chair emailed Inbar to say she wouldn’t be extending him a job offer, following the recommendation of an ad hoc committee.

    “There is no doubt that unusual events occurred surrounding your visit,” Annette L. Stanton wrote to Inbar, who shared a copy of the email with The Chronicle. “After much consideration and consultation, I believe that following the department’s standard process spanning more than two decades is the right way to go. That said, I’m disappointed with the outcome.” (Stanton told The Chronicle on Wednesday that she was in a meeting and not immediately available for comment; the three members of the ad hoc committee did not return requests for comment. Efforts to reach several of the graduate-student signatories on Wednesday were also unsuccessful.)

    While the students’ concerns extended to a broader critique of Inbar’s sensitivity to DEI issues, his comments about diversity statements were what initially gave them pause, and what has dominated the debate online.

    The situation illustrates how diversity statements have become a live wire nationally, with several university systems and states banning their use in hiring over concerns about their legality or potential use as a “political litmus test.” One professor sued the University of California system last month, saying a requirement that he submit a diversity statement for consideration for a job in the Santa Cruz campus’s psychology department violated his First Amendment rights. (The professor, John D. Haltigan, coincidentally, was formerly employed at the University of Toronto, but left because his grant funding had run out.)

    The Inbar case is also rich with drama: A scholar of moral judgments and the psychology of political affiliation is questioned — publicly, by graduate students — about his own commitment to the DEI values they hold dear. Much of the story has played out in podcast episodes Inbar recorded nearly five years apart: one in which he posed questions about the utility of diversity statements in hiring, and another, released this week, in which he shares his view of what happened at UCLA.

    “It’s funny because from a research perspective, I understand a lot of what’s going on here,” Inbar, who co-authored a 2012 paper in which he asked psychology professors whether they would discriminate in hiring based on a candidate’s political views, told The Chronicle. “I understand how people feel that they have to protect a certain set of moral values and that they don’t want people around who threaten them. I would just say, often those moral instincts can mislead us into rushing to judgment.”

    What Happened?

    Behind the scenes, Inbar’s potential hiring had rocked the department.

    A group of graduate students had emailed the department’s entire faculty to argue against it, Stanton wrote in a February email to the department explaining the situation. (Stanton forwarded that note to Inbar, who shared it with The Chronicle.) Airing such grievances publicly, Stanton wrote, marked “a significant and problematic departure from our typical searches.”

    Then there was the matter of the podcast Inbar co-hosts, Two Psychologists Four Beers, which was repeatedly cited by the graduate students in their open letter opposing Inbar’s hiring. Because the podcast episodes weren’t part of Inbar’s formal application materials, Stanton and other administrators asked UCLA’s Office of Equity, Diversity, and Inclusion whether the search committee was allowed to mention them in interviewing Inbar, according to emails reviewed by The Chronicle. No, the UCLA office said: The search committee’s interview questions had to be limited to a candidate’s submitted materials, though other faculty members could bring up other topics.

    So members of the department’s diversity-issues committee instead asked Inbar about the podcast material, which Stanton wrote in the email was “consistent with their standard process this year of being free to ask follow-up questions of candidates, as long as the restrictions all faculty follow during interviews aren’t violated.”

    The goals are good, but I don’t know if the diversity statements necessarily accomplish the goals.

    The story began, Inbar said Tuesday on the podcast Very Bad Wizards, when his partner received a job offer from the UCLA psychology department. When she inquired about the possibility of bringing Inbar on as a partner hire, the department was receptive, Inbar said. During a campus visit in late January, faculty members seemed enthusiastic about him as a candidate.

    But he told the hosts of Very Bad Wizards that his meeting with the diversity-issues committee was one of several “strange things” that happened while he was on campus. At the end of the meeting, in which the committee asked standard questions about his approach to diversity in his teaching and research, Inbar said he had been asked about a December 2018 episode of Two Psychologists Four Beers.

    In that episode, Inbar said that diversity statements “sort of seem like administrator virtue-signaling,” questioned how they would be used in a hiring process, and suggested “it’s not clear that they lead to better outcomes for underrepresented groups.”

    The committee asked: Was he prepared to defend those comments now?

    “To be honest, I wasn’t, because this episode is like, four and a half years old,” Inbar said on Very Bad Wizards. But he explained his current stance: “The very short version is, I think that the goals are good, but I don’t know if the diversity statements necessarily accomplish the goals.” (One host of Very Bad Wizards, David A. Pizarro, a professor of psychology at Cornell University, said he’d let Inbar’s comments on the podcast speak for themselves.)

    The UCLA faculty members “seemed satisfied” with Inbar’s answer, he said. “Then one of them said, kind of almost apologetically, ‘Well, you know, we have some very passionate graduate students here, which is great, but what would you say to them if they were upset about this?’” Inbar said he didn’t know what he’d say beyond explaining his views, as he had to the committee.

    Then Inbar met with some of the graduate students. Both parties recalled the meeting as unusual. The students wrote in their letter that Inbar had told them that his “work does not really deal with identity,” which they found problematic. Inbar studies morality and political ideology, the students wrote, so “it was deeply troubling to hear that he does not believe identity (i.e., individual background as it pertains to race, gender, sexuality, class, or ability) has bearing on these research questions.”

    But Inbar said the graduate students had never asked him directly about the podcast episodes mentioned in their letter. “To be honest, it wasn’t entirely clear what they were getting at” in the meeting, Inbar told The Chronicle; if they had asked more-direct questions about, for instance, his approach to mentoring students from diverse backgrounds, he said he could have answered them.

    The department’s graduate students didn’t all share the same view of the matter. A handful of students drafted a response to the first letter, defending the nuance of Inbar’s comments and calling for further conversation among themselves. Inbar shared a copy of that letter with The Chronicle.

    ‘Just Stay Out of It’

    Stanton, the department chair, told faculty members that she had tried to play the situation by the book, according to the emails shared with The Chronicle. As is standard procedure for potential partner hires, Stanton convened an ad hoc committee to make a recommendation on whether to hire Inbar. The members of that committee — Benjamin R. Karney, Carolyn Parkinson, and Hal E. Hershfield — opted not to recommend Inbar’s hiring.

    Whether to give a candidate a green light rests entirely with that committee, Stanton wrote in an email. But because of the unusual circumstances in Inbar’s case, she said she’d considered a few alternatives — a “do-over” interview or a faculty vote on Inbar’s case, for example — before ultimately deciding to let the committee’s decision stand.

    She did, however, ask the committee to write an internal report explaining its decision, which she described as an unusual step.

    Inbar told The Chronicle that the report had not been shared with him. Meanwhile, the Foundation for Individual Rights and Expression has requested from UCLA documents related to Inbar’s case, including the committee’s report; the university denied that request in March and an appeal this month. Alex Morey, director of campus rights advocacy at FIRE, told The Chronicle that her organization is preparing a second appeal, arguing that the records are a matter of public interest.

    They can hold faculty to viewpoint-neutral type of criteria, … but they can’t say, ‘If you don’t pledge allegiance to our particular view on diversity, you can’t have a job.’

    “What we suspect may be happening here is that because Professor Inbar allegedly did not parrot the correct views on DEI and some students objected to that, he may have been discriminated against because of his views in the hiring process,” Morey said. That’s not allowed at a public university, she said: “They can hold faculty to viewpoint-neutral type of criteria, objective standards, but they can’t say, ‘If you don’t pledge allegiance to our particular view on diversity, you can’t have a job.’”

    On Tuesday, during the Very Bad Wizards episode, Inbar said the graduate students who opposed his hiring had missed the nuance in his remarks about diversity statements.

    “You can pull out selective quotes that make me sound like I’m a rabid anti-diversity-statement person, which I’m really not,” Inbar said. His main concern is with their effectiveness, he said: “What you want is somebody who’s going to be able to teach and to mentor people from diverse backgrounds. But what you get is somebody writing about what they believe, and perhaps what they’ve done to demonstrate that.”

    In their open letter, the students also contested Inbar’s comments in a more-recent Two Psychologists episode about how the Society for Personality and Social Psychology, the field’s professional organization, uses DEI criteria to evaluate submissions. He also took a public stance against Georgia’s anti-abortion law. Inbar said on Two Psychologists that, while he considers himself “pro-choice,” he believed it wasn’t the organization’s place to take sides: “When we align ourselves with a political side or faction, it’s bad for our science.”

    To the students, Inbar’s remarks about the professional society were more evidence he wouldn’t be a good fit. “Time and time again in these episodes, he fails to reflect on how these issues structurally affect marginalized individuals,” they wrote.

    Meanwhile, Inbar is not asking for sympathy. His partner received a one-year extension of her job offer from UCLA, which he told The Chronicle was “spectacular,” and the couple may consider moving to Los Angeles if Inbar can find a job in the area. “I don’t want people to cry over this for me,” he said on Very Bad Wizards.

    In the past, he added, he’s urged faculty members to speak up about potentially controversial topics they believe in. His recent experience has changed his mind.

    “Is there a cost to opening your mouth about this stuff? Absolutely, there is,” he said. “Would I advise a junior person to take any sort of heterodox position on this publicly? Absolutely not, because you only need to piss off a few people. It just takes one or two to sink you. Just stay out of it.”

    A 21-year-old former student at the University of California, Davis, has been arrested in connection with three stabbings that occurred near the campus within the span of five days, leaving two people dead and the community in fear, the city’s police chief said Thursday.

    Carlos Dominguez, 21, was arrested on two counts of homicide and one count of attempted murder, Davis Police Chief Darren Pytel said during a Thursday news conference.

    “At this point we believe that all three (stabbings) are connected and we have evidence and information that they are and have one person responsible,” the chief said, linking the three attacks for the first time.

    The latest attack happened Monday night near campus and left a woman in critical condition. Just days before, stabbings at two different parks near campus claimed the lives of UC Davis senior Karim Abou Najm on Saturday and 50-year-old David Breaux on Thursday.

    Dominguez was a third-year student at the university until April 25, when he was “separated for academic reasons,” UC Davis said in a news release.

    He was initially taken into custody Wednesday for possessing a large knife and was placed under arrest earlier on Thursday in connection to the stabbings, Pytel said.

    The university is working with law enforcement to “provide access to any and all information as part of the investigation,” its news release said.

    Police are conducting a search warrant at a house where Dominguez lived with several roommates and where it appears he had been in between the stabbings, Pytel said. The roommates have been interviewed, he added.

    Officials believe Dominguez is from Oakland, but they are still working to learn more, Pytel said. He is being held at the Yolo County Jail while the district attorney reviews the investigation to determine any final charging decisions, the chief said.

    About 15 people called police Wednesday afternoon to report someone matching the suspect description from the third attack near Sycamore Park, where the second stabbing occurred, Pytel said.

    One of the callers followed the individual and led law enforcement officers directly to him, the chief said.

    The suspect was wearing the same clothing described by a witness to the third attack and appeared to have “some physical evidence on him that might be part of the investigation,” Pytel said.

    In his backpack, law enforcement found “a large knife that was consistent with the one we were looking for based on evidence from the first homicide,” which led to his arrest, the chief added.

    Detectives interviewed Dominguez for “many hours” following the arrest, Pytel said. He described Dominguez’s demeanor as “reserved.”

    The suspect was “compliant during the entire process,” the chief said, adding that the motive remains under investigation. He did not offer further details on what Dominguez said to police.

    Pytel said the evidence collected included “blood evidence and fibers and other types of trace evidence.”

    The days leading up to Dominguez’s arrest saw the college community on edge, with officials ramping up security measures and urging students to be ultra-vigilant.

    Police patrols on campus and around the city increased, classes were rescheduled or went virtual and the university expanded its Safe Rides program, which provides students with transportation to other campus locations or within the city from 8 p.m. – two hours earlier than its previous starting time – until 3 a.m.

    Elaine Lu, a recent graduate of UC Davis, was visiting campus earlier this week and said the town had always felt safe – until these attacks.

    “This kind of thing never happened before. After this murder, everyone is going to be so intimidated about it. I hope the school can improve their safety,” Lu told CNN Tuesday.

    What Does a Healthy Campus Actually Look Like? A New Study Offers Ideas.

    Small campus interventions — like adding hydration stations and making healthy foods more visible — can make a big difference in how students, faculty, and staff feel about well-being at their college, according to a new study.

    Conducted at the University of California at Riverside, the study examined how health factors into university policy and how health-promotion programs contribute to campus culture. UC-Riverside is part of the Healthy Campus Network, an alliance of the UC system’s 10 institutions that’s focused on improving physical and mental health on each campus.

    Eighteen focus groups of UC-Riverside students, faculty, and staff participated in the study in 2018, 2019, and 2020. As part of the research, Healthy Campus created some new health interventions and sought to raise awareness of existing efforts.

    Participants were increasingly aware of health-promotion efforts on campus as the study progressed, according to the focus groups. In the last two years of the study, participants talked more about broader, institution-wide health policies, rather than specific programs.

    Faculty and staff reported feeling left out of campus health services, researchers said. They could name many resources available to students, like the food pantry and recreation center, but they were unaware of what was available to employees. Those perceptions improved by the end of the study.

    “There was this lack of, I would say, care about this other population of communities that exist on campus,” said Evelyn Vázquez, one of the authors of the paper. Vázquez is an assistant researcher in the department of social medicine, population, and public health at UC-Riverside’s School of Medicine.

    Julie Chobdee, another one of the authors, said the infrastructure built as a part of the Healthy Campus project made them a hub for faculty and staff wellness on campus. Chobdee is now associate director of the employee health and well-being program at the University of Southern California’s WorkWell Center.

    Additionally, first-generation students were sharing their increased knowledge of health services with their families, helping them to access mental-health care and more, Vázquez said.

    The study also found that small environmental changes, like refurbishing stairwells and putting up nonsmoking signage, improved people’s perceptions of how committed their university was to health promotion.

    One staff member praised stairwell improvements like better lighting and fresh paint, as well as signs encouraging people to take the stairs instead of the elevator. And even if someone needed to take the elevator on a given day, the staff member said, there were posters offering brief instructions on deep breathing.

    Two staff members said their offices had added wellness activities into their training programs, citing that integration as evidence of a top-down commitment to better health. Walking meetings were also identified as a positive step.

    Seeing campus leaders participate in health-promotion activities demonstrated that well-being was a genuine priority for the university, according to those interviewed.

    Faculty members, meanwhile, could help students by doing something as simple as providing a link to mental-health services, said Ann Marie Cheney, another author of the paper and lead designer of the study.

    Cheney, an associate professor in the department of social medicine, population, and public health at Riverside’s medical school, said her research made clear that students viewed faculty as access points for other services on campus, even if faculty did not consider the well-being of students as part of their role.

    Cheney and Chobdee were formerly co-leaders of Healthy Campus at UC-Riverside, which involved nine subcommittees of students, faculty, and staff, overseen by a large advisory board. Chobdee hopes to build a similar program in her role at USC. Cheney and Vázquez have both transitioned out of the project.

    Despite the positive findings from the study, Healthy Campus is in a period of flux, Cheney said. UC leaders have not been able to find a new crop of people who have a strong vision for the project and can bring together campus stakeholders, she said.

    Cheney said more investment from university leadership would have helped the team plan a sustainable future. When she was involved, it was volunteer work, she said. She hopes the study can “spark a light” and garner more attention from the university’s administration.

    Overall, the study shows that empowerment is key to creating a healthy campus community, Cheney said.

    “Why I think Healthy Campus was so successful at our university is because we identified grass-roots leaders who were interested in creating healthier environments, and we supported their ideas,” she said.

    After the rulings are handed down in sexual-misconduct lawsuits against colleges, a second legal battle quietly begins.

    Determining who pays the legal fees and settlements — which, in the most sweeping cases, can total hundreds of millions of dollars — often leads to behind-the-scenes squabbles as colleges and their insurance carriers parse general liability policies.

    That tension is playing out between Baylor University and Lexington Insurance Company, which sued in January to stop covering claims against the university in a vast sexual-assault scandal.

    In higher education, insurers and institutions have typically been a united front: Colleges pay premiums, carriers pay up after a crisis. Now, cracks in the relationship are forming, especially as more sexual-misconduct lawsuits are lodged and settlements grow larger. Insurance companies and colleges are increasingly concerned about risk — both financial and reputational.

    In response, many insurers are simply walking away from higher-education coverage. Those that remain are taking precautions to avoid the financial fallout of sexual misconduct, putting the burden of legal fees and payouts more squarely on the shoulders of colleges.

    The Penn State Effect

    The tipping point came in the case of the former assistant football coach Jerry Sandusky at Pennsylvania State University, which led to one of the first public rifts between a college and its insurer.

    The abuses perpetrated by Sandusky involved hundreds of victims over the more than four decades he was employed by Penn State. Thirty-two victims sued the university for damages, and settled for $93 million, as reported by PennLive.

    But neither Penn State nor its then-insurance company, Pennsylvania Manufacturers’ Association Insurance, wanted to pay.

    In 2016, after a three-year court case, a judge ruled on the “interpretation” of the contracts between PMA and Penn State — in essence, how the university’s insurance policies could be triggered by claims of sexual misconduct, and if the policies applied to Sandusky-related claims.

    Complicating the case was that, as is typical, Penn State’s insurance policies often changed year-to-year, and many victims were abused by Sandusky multiple times over several years. The judge’s opinion stated that claims made by each victim would trigger the policy of the year when the first incident of abuse occurred.

    But for some years, the university’s insurance coverage didn’t apply in certain situations — letting PMA off the hook. Penn State’s insurance policies in the mid-1990s, for example, did not cover sexual abuse or molestation. After 1998, PMA did not need to cover Penn State because the policies no longer applied when university officials first learned about Sandusky’s abuse and did not act to prevent it. And, beginning in 2005, only one claim related to Sandusky could be filed each year, according to the policies.

    While the public does not know how much of the multimillion-dollar settlement was paid by Penn State or PMA, the case touched off a new era in higher-ed insurance, said Kyle D. Logue, a professor at the University of Michigan Law School who’s an expert in insurance law.

    As a result, general liability policies are narrowing to exclude sexual abuse, said Logue. This pattern is common in insurance, he said: As insurers realize that certain risks are extremely large, or largely under the control of the institution that’s being insured, exclusions are added to protect against that risk.

    Sexual-misconduct coverage in general liability policies might only be approved if the colleges meet certain requirements. United Educators, an insurance company that works exclusively with schools and colleges, requires applicants to have policies in place on sexual-misconduct prevention and ways to report and investigate incidents. Other insurers simply no longer offer sexual-misconduct coverage.

    Claiming Otherwise

    With Penn State in recent memory, Lexington Insurance is following a similar playbook at Baylor and hoping to pre-emptively steer clear of a big payout. The pending sexual-misconduct lawsuit brought by 15 former students alleges that the plaintiffs were sexually assaulted by other students and staff members between 2004 and 2017 and that the university didn’t act to protect them.

    At Baylor, as at Penn State, the insurance policies were triggered for the year an incident occurred; a policy from 2014, for example, was triggered by a claim filed two years later.

    Filed on January 10, Lexington’s lawsuit alleges that Baylor’s policies didn’t cover sexual misconduct between 2012 and 2016, when the majority of the alleged sexual abuse occurred. For the remaining alleged assaults, the sexual abuse does not meet the definition of an “occurrence” — namely, an accident — because the university may have failed to prevent the incident under the federal gender-equity law known as Title IX, Lexington argues.

    (A spokesperson for Baylor University said the university “continues to work with Lexington regarding previous claims” but switched insurers for its general liability coverage “a few years ago.”)

    Amid such high-profile scandals, many insurers want to minimize their risks, opting for a different approach known as a claims-based policy. Under that system, when universities file claims with their insurer, that triggers the current year’s policy, which often no longer covers sexual abuse — no matter what year the misconduct occurred.

    “The shift to claims-made policies provides more general protection for the insurer than the specific exclusion does,” said Logue, in an email response to The Chronicle.

    United Educators maintained its occurrence-based coverage because it is “preferable for our members,” according to a spokesperson.

    Striking Out on Their Own

    As outside insurance companies become more wary of higher ed, many colleges are joining the ranks of corporations and creating a new structure to insure their risks.

    That new structure — known as a captive insurance company — is a separate legal entity, but the university is involved in its main operations, including creating policies and managing claims. Yale University, the University of California system, Rutgers University, and the University of Minnesota are among the colleges that self-insure with captive insurance companies.

    Michigan State University created such a company, called Lysander Series, after settling a lawsuit with the 300-plus victims of Larry Nassar, the former university sports doctor who abused women and girls under the guise of performing medical treatment. According to reporting from The Wall Street Journal, Michigan State rejected a policy with reduced coverage from its longstanding insurer, United Educators, and created Lysander instead.

    In 2019, at the time of its creation, a Michigan State spokesperson told the Journal that the policy from Lysander Series “broadly excludes insurer liability for sexual misconduct.” A United Educators spokesperson said the company does not “publicly disclose member or insurance policy details.”

    MSU also took to court its 13 former insurers to cover the $500-million settlement with Nassar’s victims. As of last September, Michigan State had recouped around $100 million, according to the Lansing State Journal. In November, a judge found that the American Physicians Assurance Corporation was not obligated to pay $31 million for costs related to the Nassar case under a 2000-2001 insurance policy.

    Sealing the Cracks

    The Nassar case was “one of the worst of the worst,” said Bryan Elie, vice president for underwriting at United Educators.

    But the conflicts in college insurance are only going to increase as more victims come forward about abusive behavior and sexual-misconduct lawsuits proliferate, experts say.

    In 2014 a report compiled by United Educators of publicly available cases involving sexual misconduct listed one case that topped $1 million. In 2022 that number jumped to five. Settlements within the University of California system and at the University of Southern California topped $615 million and $852 million, respectively.

    “Those trends have just been growing and growing,” said Kimberly Pacelli, a partner at the Title IX consulting firm TNG.

    Invariably, while conducting trainings for colleges’ Title IX coordinators, Pacelli notices that administrators realize the nature of their work is inherently risk management.

    “We always recommend that [Title IX coordinators] interface with their finance and administration folks to really understand who’s their insurer and what the insurance covers,” said Pacelli.

    Meanwhile, insurers are getting more invested in training colleges on Title IX policies to further minimize their risk. “From our perspective, our goal is to help the institution,” said Elie. He added: “Don’t let a serial predator take root.”

    I’m one of just five Black women in history to win the NCAA individual all-around title in gymnastics. It was a tremendous accomplishment which, when I won it two decades ago, left me elated.

    But it was a particular kind of joy, tinged with the frustration often felt by the Black athlete who excels in a sport where they are one of only a very few.

    I grew up in the sport in the 1980s. I took my first gymnastics class at the age of 3 and finished my final competition at the age of 22. Throughout all of my years training in the sport, I was often the lone brown face in a gym filled with tumbling, somersaulting, hand-standing kids.

    Before accepting a full ride sports scholarship to UCLA, I was an elite gymnast, a member of the National Team for USA Gymnastics (USAG). As a Black gymnast growing up, being one of few was normal. And as I progressed up the ranks, the sport seemed only to get whiter.

    Even during my four years at UCLA, an urban school with a sizable Black population, I was the only Black female gymnast on my team. In 2001, the year I won my NCAA title, I could probably count the other Black women gymnasts at top-ranked schools we competed against on one hand.

    But I’ve noticed something different about gymnasts today, and perhaps you have, as well. There are more Black and brown athletes in the sport than ever before. And they are turning out to be a force to be reckoned with.

    This year marks 20 years since my last gymnastics competition, and a lot has changed in the sport — but perhaps nothing so much as the dramatic increase in racial and ethnic diversity. The change has been nothing short of astonishing — especially at last summer’s stunning National Championships, when African American women swept the podium.

    I’d been involved in gymnastics my entire life, and I never saw it coming. The diversity — and the excellence — exhibited by the top-performing women of color in the sport has been something to behold.

    There’s Simone Biles who, of course, needs no introduction. She’s a global icon who has earned seven Olympic medals and 25 world championship medals — more than anyone else in gymnastics — and is regarded as the GOAT in our sport. Some have even argued that she is the greatest athlete of all time, period. Before Biles, there was Gabby Douglas, who was crowned the 2012 Olympic all-around champion, becoming the first Black gymnast to capture that title.

    To be honest, it’s hard to name all the women of color who have made it to the top ranks of the sport since I stopped competing. Laurie Hernandez, who is Puerto Rican, was the youngest gymnast to earn gold in Rio 2016. Jordan Chiles helped Team USA secure the gold at last year’s world championships. And there’s Sunisa Lee, a Hmong American who became the first Asian American to win the Olympic all-around title. The list goes on and on.

    The standouts of color at the collegiate level have been no less impressive. Florida Gator Trinity Thomas holds a breathtaking record of perfection. UCLA’s Chae Campbell, Chiles and freshman standout Selena Harris continue to grab headlines in our sport, as does Jordan Rucker of the University of Utah and Haleigh Bryant of Louisiana State University — and, astonishingly, too many others to name.

    These women of color are setting new records and breaking the internet with performances of exceptional style and athleticism. I can’t think of another major sport that has seen its ranks change so dramatically. Swimming? Golf? Tennis? No, not really. These predominantly White sports have seen a relative few breakthrough athletes of color, but overall the complexion of the sports haven’t changed much.

    Over the years, structural racism has powerfully shaped access, opportunity and identity — all of which help explain why gymnastics was so White in the first place. The long arm of economic inequality touches every facet of life, including sport.

    Sports where Black people have been represented have traditionally been those accessible through schools, such as football, basketball and track and field. Gymnastics is a very expensive sport, costing thousands of dollars and requiring long, intense training hours. High-quality instruction is only accessible in private clubs and at elite training facilities that are few and far between. Growing up, my family fundraised furiously, did extra jobs at my gymnastics club, and housed visiting gymnasts to offset the unreachable high cost of tuition.

    There is no magic that has “created” gymnasts of color in the past decade. There have always been strong, talented Black and brown girls capable of excelling in the sport. Many of the first Black women in the sport, like Diane Dunham and Wendy Hilliard, simply were not acknowledged because our society has for so long refused to value or validate Black women. Instead, the sport favored a Nadia Comaneci-style waif, thin and childlike. That doubtless kept a lot of women who looked like me on the sidelines. Elite gymnastics did not always see them or make space for them.

    Luckily for me, there were always exceptions, and these women became my inspirations. Betty Okino and Dominique Dawes were the trailblazers in my day. I watched them represent Team USA with their brown bodies and Black girl hair and I knew it was a little more possible for me.

    I vividly remember being 16 years old laying belly down on the green shag carpet in my living room in Tacoma, Washington, captivated as UCLA — and even more significantly for me, Stella Umeh — clinched its first-ever NCAA Title.

    On the floor, Umeh was Black, full-bodied and fierce; her hair was a close shave; the music for her floor routine was rhythmic and pulsating. She was unlike any gymnast I had ever seen. I attended UCLA after Umeh had graduated, but walked confidently and fully in her footsteps, not simply because she too was a Black woman, but because she remade the mold.

    Earlier this month, I had the opportunity to attend the NCAA Metroplex Challenge gymnastics competition with my 11-year-old daughter and her gymnastics team. There were multiple Black gymnasts competing for every school on the floor.

    As a developmental psychologist who studies youth identity development, I couldn’t ignore the significance of the moment. I couldn’t fail to register the awe in their eyes as they watched their possible future selves from their front row seats, a real image of who they may become. In short, identity and representation matter. How many Black girls even enter the sport in the future will be influenced by what they see as attainable or impossible.

    Meanwhile, the breakthroughs in gymnastics just keep coming: This year, Fisk University is the first HBCU to have an NCAA gymnastics team — an entire team of Black and brown girls doing gymnastics. It’s radical. It’s transformative. And as Black History Month draws to a close, it’s a reminder of what is possible.

    The University of California Police Department has opened an investigation after a human skeleton was found on the UC Berkeley campus, officials say.

    UC Berkeley police were alerted to the skeleton Tuesday, according to a statement shared with CNN. The “skeletonized” human remains were found “in a building which has not been occupied for many years” on the school’s Clark Kerr Campus, about a mile from the main campus.

    “It is not clear how many years they have been there,” police said in the statement. “There are no outstanding cases of missing individuals from the campus community.”

    The Alameda County Coroner’s Office has also opened an investigation into the remains, according to the statement. The cause of death has not yet been determined.

    “We understand that there are many questions and we anticipate that the coroner’s report will provide additional information,” said police. “We do not anticipate this investigation will disrupt resident activities at the Clark Kerr Campus.”

    The University of California, Berkeley enrolled 30,853 undergraduates and 11,666 graduate students as of fall 2018, according to its website. The university describes its Clark Kerr residential hall complex as “a mini-neighborhood with Spanish mission-style architecture, tree-lined courtyards and access to nature and hiking trails.”

    The University of California system reached a tentative agreement with striking graduate students late Friday that, if ratified, could bring an end to a monthlong strike that has paralyzed the 10-campus system.

    One of the two bargaining units representing the striking workers, UAW 2865, wrote on Twitter that the tentative agreement includes raises of up to 80 percent for the lowest-paid workers. The strike will continue, it said, until the union’s members ratify the deal.

    The university’s statement said it would provide minimum salary scales for academic student workers, including TAs and graduate-student researchers, as well as multiyear pay raises, paid dependent access to university health care, and enhanced paid family leave. If approved, the contracts would be in effect through May 31, 2025.

    By October 1, 2024, the minimum nine-month salary for TAs working about 20 hours a week would be $34,000, the university said of the agreement. Currently, the lowest-paid workers earn $23,000. The rates would be slightly higher at the Berkeley, San Francisco, and UCLA campuses, where housing prices are especially high.

    The UC strike, which began November 14, started with four bargaining units representing 48,000 graduate students, postdocs, and researchers. It’s created a chaotic end of semester with many professors saying they would be either unable or unwilling to submit final grades, even with extended deadlines. Some said they would forego grading to support striking workers, while others said that without readers or TAs, they couldn’t handle the volume.

    Postdocs and researchers were back at work this week after overwhelmingly approving new contracts that included higher wages, paid family leave, and transit benefits. The academic workers who remained on strike agreed to continue negotiating with the university through an outside mediator, Sacramento Mayor Darrell Steinberg.

    In a statement, the university system’s president, Michael V. Drake, thanked negotiators “for coming together in a spirit of compromise to reach this tentative agreement. This is a positive step forward for the university and for our students, and I am grateful for the progress we have made together,” he said.

    “These agreements will place our graduate student employees among the best supported in public higher education,” Drake said.

    In a statement, UAW President Ray Curry said the tentative agreements include “major pay increases and expanded benefits which will improve the quality of life for all members of the bargaining unit.” He added that “Our members stood up to show the university that academic workers are vital to UC’s success. They deserve nothing less than a contract that reflects the important role they play and the reality of working in cities with extremely high costs of living.”

    Professors nationwide are currently immersed in an end-of-term ritual: grading. At the University of California, however, fall grades have been thrown into disarray as a strike involving teaching assistants reached its one-month mark.

    Many professors say they are forgoing the submission of final grades, either out of solidarity with striking workers, or because they simply can’t grade hundreds of assignments without the help of readers and TAs — even with grading deadlines extended through the holidays.

    Several faculty members told The Chronicle that communication from administrators — on a campus- and system-wide level — has been vague and unrealistic, with messages repeatedly stressing the obligation to maintain “continuity of instruction.“

    “It’s a mess,” said Paul V.A. Fine, a professor in the integrative biology department at UC-Berkeley. “I’m surprised that the administration hasn’t been taken more to task by this, because I feel like they’re letting us all down.”

    Instruction he received from his department for administering finals and grades, Fine said, was essentially reduced to a general directive: “Follow your conscience.”

    UC officials say they’re trying to mitigate the impacts of the strike. Berkeley lecturers are being offered additional pay for picking up extra grading work at the end of the term, according to a university spokesperson.

    At Berkeley, grading has been extended to December 31; other UC campuses are taking a similar approach. But Fine is frustrated. “Even if you extend the grade deadline, [then] what? You’re supposed to just do that instead of enjoying a holiday break? Forget that. That’s ridiculous,” he said.

    Despite the strike, Fine continued teaching his undergraduate course on the ecosystems of California. Typically a graduate student works alongside him as an instructor and is responsible for half of the course’s grading. The course’s enrollment is small enough — 22 students — that he could complete grading by the deadline. But he said he won’t turn in grades until the strike is over, in solidarity with the graduate students.

    “Although I am doing my job because I care a lot about my undergraduates’ education, I’m not going to do extra work,” Fine said.

    Adding to the turmoil are questions about next term, which starts in a couple of weeks. Some classes don’t have teaching assistants assigned to them yet. On Wednesday, the UC-Davis Academic Senate sent out guidance suggesting that professors could do some of their winter-term teaching asynchronously and continue with modified instruction for up to two weeks after the strike ends.

    ‘At a Breaking Point’

    The strike, which began November 14, initially involved four bargaining units made up of 48,000 UC graduate students, postdocs, and researchers.

    Last week, postdocs and researchers overwhelmingly approved new contracts with the university system that secured wage increases, transit benefits, and paid family leave. They ended their strike on Monday. University officials and the union representing the remaining academic workers have agreed to continue negotiations through a third-party mediator.

    “We remain committed to securing a fair and reasonable contract with the union that honors the hard work of our valued graduate student employees,” Letitia Silas, executive director of systemwide labor relations, said in a statement. “With the help of a neutral mediator, we hope to secure that agreement quickly.”

    In the meantime, UC campuses have been scrambling to find solutions to the chaos — including paying lecturers to grade assignments.

    The union that represents lecturers across the UC system, UC-AFT, released a cease-and-desist letter alleging that Berkeley’s offer interferes with lecturers’ right to refuse to pick up struck work under California law. The letter states that the union is aware of similar plans on “several other campuses.”

    When asked if UC-Irvine was extending similar offers to their faculty, a university spokesperson said that deans and department chairs “have been advised to consider a range of approaches to support continuity of instruction,” which may include tapping lecturers to help. The Chronicle did not receive responses from the other UC campuses on Wednesday.

    They have to figure out a way to solve this strike in a way that doesn’t harm students and also doesn’t try to exploit other vulnerable workers.

    Unlike tenured professors, lecturers have a no-strike clause in their contracts. While some faculty members opted out of teaching their courses in solidarity after the strike began, lecturers had to continue.

    Joanna Reed, a continuing lecturer in the sociology department at Berkeley, kept teaching, though she said lecture attendance “absolutely plunged” after the strike started. But she has told her students to expect a delay in getting their grades. (Reed is married to Fine.)

    Reed would usually have eight readers to do the vast majority of grading for her two undergraduate lecture classes, for which the combined enrollment is over 300. It would be physically impossible, she said, to grade hundreds of assignments before the end of the month.

    Still, she’s pushing ahead with the work she’d usually do at the end of the semester: preparing rubrics and answer keys, dealing with plagiarism issues, and getting the gradebook cleaned up. She’ll submit final grades after the strike ends and the graduate students can resume their work.

    As Reed sees it, refusing to grade final assignments, which is considered struck work, is a way she can show solidarity with graduate students while continuing to fulfill her contractual obligations as a lecturer.

    A lecturer at UCLA, who asked to remain anonymous because he fears speaking out could put his job at risk, said he feels pressure — both from the university and from students — to submit final grades.

    But the lecturer, who teaches two courses with 300 students total, said it’ll be impossible for him to release accurate grades at the end of the semester. The lecturer has hundreds of essays from the semester ungraded — work that is partly done by the lecturer’s team of TAs. That’s not including the finals the classes completed last week. It doesn’t help, he said, that guidance from the administration on finals and grading arrived in the last week of classes after he had already put together plans for his final.

    Although the deadline to turn in grades has been extended to January 2, he doesn’t plan to release grades.

    “Those of us who don’t have job security, like me, are just at a breaking point,” he said.

    Uncertainty Abounds

    Many faculty members say they are torn between wanting to respect the picket line and feeling an obligation to their undergraduate students.

    Catherine Liu, a professor of film and media studies at UC-Irvine, said she won’t file final grades with the registrar until the strike is resolved. But she plans to evaluate her students’ work and share grades with them directly. At 39 students, her class is small, and she doesn’t depend on a TA to help with grading. At UC-Irvine, the deadline to submit grades was extended to January 19.

    Debates about obligation are complicated by questions about how withholding grades may impact undergraduates — including student athletes, veterans, students on financial aid, and graduating students seeking jobs. Some campuses have stressed that these students will not be affected if grades are not submitted. On other campuses, the possible implications remain unclear to faculty, and some are making arrangements for students in vulnerable situations.

    At Berkeley, Reed said, some graduate students in her department have said they will work with professors to make sure students with a documented need receive grades. But Reed said the burden shouldn’t fall on instructors to protect students.

    “The university created this situation with their unfair labor practices. So in my mind, it’s their problem to solve,” Reed said. “They have to figure out a way to solve this strike in a way that doesn’t harm students and also doesn’t try to exploit other vulnerable workers.”

    And if the graduate-student strike continues into 2023, professors will have to figure out what to do about the next term.

    This is a question that we’re all asking ourselves this week: What do we do in January?

    With uncertainty about whether TAs will be on the job in January, UC-Davis instructors will be allowed to switch lab hours and discussion sections, normally taught by TAs, to asynchronous instruction, according to the Academic Senate’s guidance. Instructors must maintain the same amount of instructional time with students in a course.

    The university “will allow these course adjustments to remain in place for up to two weeks after the end of the strike, at which point courses must return to their normal instructional modes,” the guidance states.

    “I have a feeling that this is going to make a lot of faculty pretty unhappy,” said Stacy Fahrenthold, an associate professor of history at UC-Davis. “The implicit language in this policy is that faculty will be responsible for taking on not only the grading but also the instructional duties of their TAs if they remain on strike.”

    Fahrenthold, who is scheduled to teach two undergraduate courses with a combined enrollment of 150 in the winter term, said she won’t be opting into the asynchronous option. “I see it as an attempt to break the strike or remediate its impacts,” she said. As for what next quarter will look like for her courses, she said that’s an open question.

    “There’s about 450 faculty who are actively on sympathy strike,” she said. “And I think this is a question that we’re all asking ourselves this week: What do we do in January?”

    ‘An Extraordinarily Hostile Move’: New School Threatens to Withhold Pay in Adjunct Strike

    Nearly 1,800 part-time faculty members at the New School, who have been on strike since November 16 for better pay and working conditions, remained out of work and on the picket lines on Wednesday even as the university said it would start withholding their pay. Meanwhile, the university, which faces a threatened lawsuit by angry parents, has demanded that all full-time faculty members, many of whom sympathize with the strikers, prove they’re working.

    Part-time workers make up more than 80 percent of the teaching faculty at the private liberal-arts university in New York City’s Greenwich Village. The workers contend that their real wages have declined, given inflation, since their last raise. Adjunct professors earn $5,753 for a three-credit course. The university says that covers 45 hours of scheduled teaching, including “course-related work.” But officials of the United Auto Workers Local 7902, a union representing the instructors, say that encompasses about 135 hours of work, including such out-of-class duties as preparing for lessons, grading assignments, and advising students.

    The university has said the union demands would push the university into financial crisis and could lead to tuition increases. Both sides were scheduled for another round of bargaining late Wednesday.

    The striking workers are among the rapidly growing ranks of contingent or adjunct faculty members nationwide, who are often forced to cobble together six or more courses a semester or live on food stamps in order to cover their basic living costs. Classes are often assigned just weeks before the semester, making planning difficult.

    The New School strike comes at a time when academic workers on the opposite coast — nearly 48,000 graduate students, postdocs, and researchers across the University of California system — were withholding work in what has been billed as the largest higher-education strike in American history. Postdocs and academic researchers there reached a settlement with the university last week that includes significant pay raises, but the money would come mostly from grants that principal investigators bring in.

    The New School, a progressive university started in 1919, houses five schools and colleges, including the Parsons School of Design and the New School for Social Research.

    A ‘Last, Best, and Final Offer’

    In a phone call late Wednesday, the New School’s president, Dwight A. McBride, said he understands that people are upset about not being paid. “What gets lost in the discussion is that for three weeks, we have paid our striking employees, and we’ve done that in the hopes that we might come to a deal quickly,” he said. “But we have to divert those funds to grading … and the possibility of hiring new faculty in the spring if this drags on.”

    McBride assured about 1,000 parents during a Zoom call on Saturday that the university was doing all it could to resolve the standoff. He told them the union had rejected the school’s “last, best, and final offer” of an 18-percent pay raise over five years and better access to subsidized health care. Union representatives countered that they’d been flexible in the negotiations, cutting their wage demands in half.

    Meanwhile, a group representing more than 1,500 parents has threatened to file a class-action lawsuit against the university and to withhold tuition payments unless the dispute is resolved. The school, a lawyer for the parents wrote, “refuses to use tuition monies already received — in many cases close to $80,000 per year per student — to provide adequate compensation and benefits to the faculty charged with providing our clients’ children with their education.”

    In a message posted on Tuesday, university leaders reiterated why they’d decided to stop paying faculty members who weren’t teaching, and assured students and their families that they’d be able to complete the semester. The statement was signed by President McBride; the university’s provost, Renée T. White; and its executive vice president for business and operations, Tokumbo Shobowale.

    Students, they said, would receive grades “in an educationally responsible manner” so they could progress in their academic studies and not risk losing financial-aid eligibility, visa status, or their ability to graduate.

    Starting this week, all full-time faculty members, many of whom have pledged to support the striking workers by not crossing picket lines, must fill out weekly “work certification” forms that attest they’re working. That move prompted a backlash on social media.

    Paulo L. dos Santos, an associate professor of economics, said in an interview on Wednesday that the new requirement amounts to “a serious escalation that poisons the atmosphere and ultimately boils down to an effort to coerce faculty back into the classroom.”

    Faculty members at the New School, he said, “are particularly motivated by a sense of identity and mission, by notions of egalitarianism and social justice and bold, if not radical, change. To see the administration’s approach to this dispute is thoroughly demoralizing.”

    In an email to the faculty on Wednesday that was shared with The Chronicle, the university’s vice president for human resources, Sonya Williams, wrote that the required certification forms will allow faculty members to demonstrate that they’re fulfilling their teaching, research, and service responsibilities. It will also, she wrote, assure the university’s accreditors that it’s continuing to deliver its curriculum “even if, in a moment of protest, that delivery looks different in mode, platform, or format than usual.”

    In a message to the community last week, White, the provost, said the university was at a crossroads. “We have faced a period of tumult and discord that feels to me like the fabric of our university has been torn apart, but hopefully not irreparably,” she wrote. “This is an opportunity for us to be courageous in building a vision of the New School that works for everyone: all part-time and full-time faculty, students, and staff.”

    The university’s leadership, she wrote, is committed to working with the community to develop “creative solutions that bring equity and repair trust.”

    New School leaders said, in the negotiation updates posted on the university’s website, that they understood that withholding pay, including contributions to health-insurance and retirement benefits, would cause frustration and anger. “As we enter the fourth week of disruptions, we must use our resources carefully to ensure that our students’ academic needs are met,” they wrote.

    The union’s proposed compensation package would cost the university more than $200 million over the course of the five-year contract, university officials wrote. For perspective, they wrote that the amount is nearly 50 percent of the university’s annual operating budget of around $460 million.

    Tactics of ‘Corporate Behemoths’

    The union’s president, Zoe Carey, a doctoral candidate in sociology and part-time instructor, said in a blog post on Tuesday that many workers would be boycotting university events to protest the administration’s latest moves.

    “The threat to strip workers of wages and health insurance is an extraordinarily hostile move, throwing almost the entirety of the university’s faculty into significant financial insecurity,” she wrote. The school also threatened to withhold pay from faculty members and graduate-student workers who refuse to cross picket lines, she said.

    “By threatening the livelihoods of those joining the strike in solidarity, the university is pitting its workers against each other, while stoking the fears of our students — these tactics are typical of corporate behemoths, not purportedly progressive institutions, as the New School claims to be,” Carey wrote. She urged faculty members to ignore the work-certification forms they’ve been told to fill out.

    Jerzy Gwiazdowski, a part-time faculty member and member of the union’s bargaining team, said in an interview on Wednesday that the union had made significant compromises in its demands and that none of them would create a financial hardship for the university.

    He said he understands why many parents and students are upset. “I’m angry, too,” he said. “This strike never should have happened. The university did everything in its power to drag this on as long as possible. They’re using students as pawns” to try to get the faculty to return to work, he said. Faculty members want to finish the semester with their students, “but we need to be paid fairly to do it — we need to pay our rent and be compensated for the many hours we spend working outside the classroom.”

    Gwiazdowski, who teaches in the School of Drama, said he picks up gigs and takes other jobs in the arts to make ends meet. When his classes were moved to Zoom during the Covid outbreaks, “I would hop in a truck and deliver beer” around Manhattan, Brooklyn, and Queens, he said.

    Asked about concerns that adjuncts couldn’t afford to live on their pay, McBride said no one doubts that living in New York is expensive. “But if you’re working part time in any job, you can’t expect that part-time wages are going to be sufficient alone to pay your living expenses,” he said. In addition to wages, part-timers at the New School receive health and retirement benefits that adjuncts at many other campuses lack, the president said.

    Sanjay G. Reddy, an associate professor of economics, argued in a blog post on Tuesday that the university’s approach “threatens to bring about the very financial crisis that it claims to forestall, by causing a precipitous collapse in student enrollments.”

    The university has taken issue with Reddy’s assertions that the university’s finances are opaque, its administration bloated, and many of its investment decisions ill planned, as “misleading or incorrect.”

    Controversy erupted last week when the university sent hiring managers an email seeking “temporary progress reviewers” to grade students’ work. The reviewers would need a master’s degree and teaching experience, but wouldn’t have to be subject experts, the email said. Three days later, the university described the email as an unapproved message that had been sent out by mistake.

    Inside a campus coffee shop at the University of California at Los Angeles, students were hunched over laptops on white plastic tables, armed with cups of coffee. The students didn’t react to the cries and chants happening outside, largely drowned out by chatter and music streaming through AirPods. Finals were coming up, and students were starting to cram.

    Steps away from the cafe, a group of 50 UCLA workers and faculty members walked in circles and carried picket signs around the university’s iconic inverted stone fountain. Around 1 p.m., they resumed their chants — calls for higher wages and better benefits.

    A three-week-long strike by graduate students, postdocs, and researchers has profoundly disrupted life at one of the nation’s most prominent university systems. Now finals are here, and with no teaching assistants on the job, there’s widespread confusion among students and professors on how to proceed.

    Students and professors say the campus feels emptier than usual. Since Thanksgiving, some have left entirely and not returned, due to modified and canceled classes and exams. Those who have stayed stuck around for a reason: Their classes are forging ahead.

    With the end of the term approaching, faculty members say they’re struggling to fulfill obligations to their undergraduate students. Undergraduate students are concerned with how the strike will impact their grades — and wondering whether they’ll even get grades in the end. All are worried about how long the strike will last.

    The UC system reached a tentative agreement with postdocs and academic researchers this week, agreeing to wage increases that the union says reflect the cost of living in one of the most expensive states in the country. But graduate students are still negotiating, and postdocs and researchers are continuing to strike with them.

    The university has repeatedly emphasized that it expects faculty members to meet teaching and research responsibilities and ensure the continuity of instruction for students. A Wednesday letter from the UC system’s provost suggested alternate ways that faculty can show support for the strike. Colleges often respond to striking instructors by criticizing how work stoppages harm undergraduates’ learning.

    People across the UC system have different perspectives on the strike and whom to blame for the ensuing chaos. But just about everyone feels conflicted in one way or another.

    Peyton Quijano, a third-year biology major at UC-Santa Cruz, says she’s caught between wanting to support her TAs and being frustrated by yet another disruption to her studies. She says she understands why the strike has to happen. She’s also paying for her education and wants to get the most out of it.

    “I just didn’t think the strike was going to go on this long,” Quijano said.

    At UCLA, life hasn’t stopped. It’s just slowed way down.

    Grading has been backed up, particularly for large lecture classes. Some students have had finals canceled or made optional. Other courses are operating as usual — save for the echoes of strike chants seeping into classrooms.

    A spokesperson for UCLA didn’t respond to a question about how many classes had been canceled or affected by the strike.

    Students who have returned to campus are there because their instruction is continuing — either modified or business as usual. By midafternoon on Thursday, nearly every desk was full inside UCLA’s main library.

    Dylan Winward, a first-year student at UCLA, said one of his finals was made optional only five days before his exam was set to take place.

    Over the last three weeks, Winward and his friends had been completing lectures and assignments from The Hill, a student hub for dorms, dining, and student services on UCLA’s campus. Winward and many of his friends said on Thursday that they were returning to the main campus for the first time since the strike began.

    Although students said they sympathize with the TAs and others who are on strike, some are also concerned about grades. “I’ll be really upset if I put in all this work for finals and get nothing back,” said first-year student Sydney Roberts.

    It feels a lot like when we were taking classes during the pandemic.

    Jacob Castaneda, a third-year political science student who transferred to UCLA this semester, said his course load hasn’t been impacted. His final exams and essays are proceeding as usual. For his three lecture classes, each of which typically have TA-led discussions, his professors have committed to getting grades in on time.

    For Mauve Spillard, a fourth-year comparative literature student, one of her professors who usually works with a TA has said grades will be turned in late.

    Trent Brown, a first-year American literature undergraduate student, hasn’t had any classes or finals canceled since the strike began. But Brown is worried that delayed grading could affect students trying to apply for honors or other programs.

    At UC-Santa Cruz, Quijano said her classes were canceled or moved online during the first two weeks of the strike; by late last week, some were back to in-person. She said her professors respect the cause of the striking workers, but they said they need to continue lessons for students to be able to complete the course.

    But Quijano is struggling to get answers to her questions about the material without the help of TAs, and her labs have been canceled. Instead of conducting her own experiments, she has to write a paper based on a photo of the results she would have gotten.

    “It feels a lot like when we were taking classes during the pandemic,” she said.

    Much like during the pandemic, faculty members have had to make contingency plans.

    Anna J. Markowitz, an assistant professor of education at UCLA, spent the weekend before the strike recording videos of lectures for her undergraduate Introduction to Quantitative Methods class. The next day, she stopped teaching.

    Markowitz’s classes enroll 40 students, and she works with two graduate students. One of them runs the coding lab portion of Markowitz’s undergraduate course and grades all student assignments — work that has now been left ungraded. Markowitz said she will not submit grades or hold a formal final during the strike. For students who want to test their knowledge, she will release an optional exam, but it will not be graded.

    I couldn’t look my students in the face and not fully support their right to strike.

    As a graduate student at Georgetown University more than a decade ago, Markowitz said she earned the same wage as her graduate students make now: $25,000 for a three-quarter academic year. They are paid for part-time work capped at 20 hours a week, she said, but many graduate students work more.

    “Knowing what my students make and knowing how bad I’ve been feeling about that for a long time, I couldn’t look my students in the face and not fully support their right to strike,” Markowitz said of her decision to not cross the picket line.

    Markowitz is among 1,000 faculty who have pledged not to teach or submit grades until the strike ends. For some professors, it’s an act of solidarity. Others say that without the help of teaching assistants, it would be impossible to complete grading for classes with hundreds of students — no matter their personal positions on the strike.

    David Shorter, a professor of world arts and cultures at UCLA, stopped teaching in solidarity with the graduate-student employees. He’s still holding listening sessions for his students, many of whom aren’t receiving clear directives from their professors or the university about how to exist amid the strike, he said.

    Shorter is teaching three classes this quarter and doesn’t know how he’ll grade 300 papers before the end of the term, even if the deadline to submit grades is extended to January. He’d usually have the help of six TAs.

    He stopped teaching his classes, one of which is an 80-person lecture, when the strike began. Nearly 25 percent of his students haven’t even returned to campus since Thanksgiving. And a lot of courses for the next term, he said, don’t even have TAs assigned yet.

    While Shorter’s classrooms sat empty, a 300-person life sciences lecture at UCLA was nearly full on Thursday. Students were wrapped up in last-day-of-class chatter as the professor continued to make announcements about review sessions, about practice-exam questions, about their final — yes, there would be a final.

    The professor went around the room as students were tasked with answering a practice question. Murmuring picked up among the students. They graphed their guesses and checked their responses with one another. The strike hadn’t changed much for these students, beyond canceling their TA-led discussion sections.

    The Academic Senate at UCLA has released guidance suggesting that professors could shorten final exams or make them multiple choice, to ease the grading burden.

    There have been a handful of incidents where strikers have interrupted midterm exams, said Winward, the first-year student; he reported on them for the campus newspaper, the Daily Bruin. He said some students are concerned about such disruptions happening again during finals week.

    The University of California system views its graduate students like most colleges do: Their employment is “strictly part time,” and campus policy prevents them from working more than 20 hours per week. Meeting some of the students’ demands, university officials say, would cause an “unprecedented” and “unpredictable” financial impact.

    The university has proposed paying TAs between $25,000 and $31,000 per year, and graduate-student researchers between $28,000 and $47,000 per year, for part-time work — which officials say would make UC graduate students the highest compensated among public institutions in the Association of American Universities. The union has called for a minimum salary of $54,000.

    Another sticking point is housing costs. University officials have stressed that UC-owned housing for graduate students is already 20 to 25 percent below market rates. Tying raises to housing costs, as the union has called for, could cost hundreds of millions of dollars annually, according to the university.

    UC officials said they had reached agreements with other employee unions in the past year, demonstrating their “flexibility and a genuine willingness to compromise.” The university has proposed working with a private mediator to resolve differences, which the union doesn’t support.

    Meanwhile, on most campuses, the deadline to submit final grades this fall has been extended — but only by a few days. And there’s little consistency across campuses.

    Faculty members are also struggling to figure out what legal rights they have to participate in a sympathy strike.

    A Wednesday letter from Michael T. Brown, the UC-system provost, stated that if faculty members choose not to hold classes or submit grades during the strike, the “university in turn may withhold their compensation.” If faculty members participate in a “partial strike,” where they don’t submit grades but continue to do research, they could also risk disciplinary action.

    The letter said that faculty have the responsibility to maintain course and curricular requirements, including “the timely awarding and submission of grades.” The Council of UC Faculty Associations called the letter “misleading.”

    For some faculty members, the university is making a frustrating, if not impossible, ask — especially after the pandemic left them feeling burned out and exhausted.

    “Most of us are confused, if not stressed, because we just spent three years being very agile for our employers due to COVID,” Shorter said. “And now the expectation is that we would spend our holiday breaks or winter breaks grading hundreds of papers for a situation we did not create.”

    The faculty associations’ council also released a Google form for professors to fill out if they expect not to be able to submit final grades without the help of TAs. As of Friday, the group said the total number of expected missing grades was 23,000.

    Bernard Remollino, a graduate-student researcher and teaching assistant at UCLA, said what’s happening across UC campuses now sends a critical message: The university works because of its academic student workers. The question of when their work will proceed is up to the UC system, he said.

    “We’re eager to get back to work,” Remollino said. “We just want to make sure we are living and working in dignified conditions. And that’s it.”
