    Agency finds possible cause of seaplane crash that killed 10

    SEATTLE — U.S. investigators said Monday they have found a potential cause of a seaplane crash that killed 10 people off an island in Washington state last month.

    The National Transportation Safety Board, the agency investigating the Sept. 4 crash off Whidbey Island, said it appeared a critical part that moved the plane’s horizontal tail stabilizer came apart, The Seattle Times reported.

    That part might have failed because a clamp nut unthreaded and rotated due to a missing or improperly installed lock ring, the investigators found.

    The failure of the component, called an actuator, during flight “would result in a free-floating horizontal stabilizer, allowing it to rotate uncontrollably … about its hinge, resulting in a possible loss of airplane control,” the NTSB said.

    The plane, a de Havilland Canada DHC-3 Otter turboprop operated by Renton-based Friday Harbor Seaplanes, crashed into Puget Sound, killing the pilot and all nine passengers. It was about half an hour into a flight to the Seattle suburb of Renton from Friday Harbor, a popular tourist destination in the San Juan Islands.

    The investigators said that when the wreckage was retrieved, the upper portion of the actuator was still attached to the horizontal stabilizer while the lower portion was attached to its mount in the fuselage.

    The most recent overhaul of the plane’s horizontal stabilizer actuator was completed April 21. The lock ring was not found with the wreckage, but several of the holes drilled in the clamp nut to accept the lock ring were damaged “such that they would not allow for the full insertion of the lock ring.”

    “At this time, the NTSB does not know whether the lock ring was installed before the airplane impacted the water or why the lock ring was not present during the airplane examination,” the agency said.

    The NTSB and the Transportation Safety Board of Canada have asked that the manufacturer draft instructions for all operators of DHC-3 aircraft to inspect the actuator to ensure that the lock ring is properly installed to prevent unthreading of the clamp nut.

    Witnesses who saw the plane nose dive into Mutiny Bay helped officials identify the crash site. Still, it took over a week and three types of sonar to locate what remained of the plane due to its depth and the current of the channel where the aircraft hit the water.

    Crews using remotely operated vessels and cranes recovered the majority of the plane’s wreckage from the sea floor more than 150 feet (46 meters) below the surface in late September.

    The victims included a civil rights activist, a business owner, a lawyer, an engineer and the founder of a winery and his family.

    Six bodies have been recovered. Those include the body of 29-year-old Gabby Hanna, which was recovered by witnesses the day of the crash, and five others found during recovery efforts.

    The U.S. is exporting more LNG to Europe as a result of Russia’s war in Ukraine and cuts made to natural gas supplies ahead of winter, but there has been a buildup of LNG vessels waiting to unload at ports with European infrastructure unable to handle the increased LNG shipments.

    60 LNG tankers have been idling or slowly sailing around northwest Europe, the Meditteranean, and the Iberian Peninsula, according to MarineTraffic. One is anchored at the Suez Canal. Eight LNG vessels that came from the U.S. are underway to Spain’s Huelva port.

    “The wave of LNG tankers has overwhelmed the ability of the European regasification facilities to unload the cargoes in a timely manner,” said Andrew Lipow, president of Lipow Oil Associates.

    These delays postpone the tankers’ return to the Gulf Coast of the United States to pick up the next load, according to Lipow, and as a result, natural gas inventories rise more than the market expected.

    The underlying infrastructure issue is a lack of European regasification capacity due to a shortage of regasification plants and pipelines connecting countries that have regasification facilities. As a result, the amount of LNG on the water — floating storage — increases and in turn drives down the price of natural gas.

    “European gas storage continues to rise and now exceeds 93%,” said Jacques Rousseau, managing director, global oil and gas for ClearView Energy Partners LLC.

    Rousseau said the increase in floating storage, with vessels needed to move capacity around the globe tied up for longer, has contributed to an approximate doubling in LNG tanker rates year over year.

    Energy experts tell CNBC they are keeping an eye on an EU LNG price cap. The cap was discussed last Thursday even as prices have come down. “The price cap potentially pushes traders out of the market which would impact future supply arriving in Europe,” Rousseau said.

    European gas prices had soared above 340 euros ($332.6) per megawatt hour in late August, but this week dipped below $100 for the first time since Russia cut supplies. Before the war, the price had been as low as 30 euros.

    Russia, which supplies a large portion of natural gas to Europe, cut gas supplies as a response to sanctions after the country’s war with Ukraine.

    Cash is king for sanctioned Russian, Venezuelan oligarchs

    MIAMI — It was a deal that brought together oligarchs from some of America’s top adversaries.

    “The key is the cash,” the oil broker wrote in a text message, offering a deep discount on Venezuelan crude shipments to an associate who claimed to be fronting for the owner of Russia’s biggest aluminum company. “As soon as you are ready with cash we can work.”

    The communication was included in a 49-page indictment unsealed Wednesday in New York federal court charging seven individuals with conspiring to purchase sensitive U.S. military technology, smuggle oil and launder tens of millions of dollars on behalf of wealthy Russian businessmen.

    The frank talk among co-defendants reads like a how-to guide on circumventing U.S. sanctions — complete with Hong Kong shell companies, bulk cash pick ups, phantom oil tankers and the use of cryptocurrency to cloak transactions that are illicit under U.S. law

    It also shines a light on how wealthy insiders from Russia and its ally Venezuela, both barred from the western financial system, are making common cause to protect their massive fortunes.

    At the center of the alleged conspiracy are two Russians: Yury Orekhov, who used to work for a publicly-traded aluminum company sanctioned by the U.S., and Artem Uss, the son of a wealthy governor allied with the Kremlin.

    The two are partners in a Hamburg, Germany-based company trading in industrial equipment and commodities. Prosecutors allege the company was a hub for skirting U.S. sanctions first imposed against Russian elites following the 2014 invasion of Crimea. Both were arrested, in Germany and Italy respectively, on U.S. charges including conspiracy to violate sanctions, money laundering and bank fraud.

    On the other end of the deal was Juan Fernando Serrano, the CEO of a commodities trading startup known as Treseus with offices in Dubai, Italy and his native Spain. His whereabouts are unknown.

    In electronic communications among the men last year, each side boasted of connections to powerful insiders.

    “This is our mother company,” Orehkov wrote to Serrano, pasting a link to the aluminum company’s website and a link to the owner’s Wikipedia page. “He is under sanctions as well. That’s why we (are) acting from this company.”

    Serrano, not to be outdone, responded that his partner was also sanctioned.

    “He is one of the influence people in Venezuela. Super close to the Vice President,” he wrote, posting a link showing search results for a Venezuelan lawyer and businessman who is currently wanted by the U.S. on money laundering and bribery charges.

    Neither alleged partner was charged in the case nor are they identified by name in the indictment. Additionally, it’s not clear what ties, if any, Serrano really has to the Venezuelan insider he cited.

    But the description of the Russian billionaire matches that of Oleg Deripaska, who was charged last month in a separate sanctions case in New York. Some of the proceeds he allegedly funneled to the U.S. were to support a Uzbekistani track and field Olympic athlete while she gave birth to their child in the U.S.

    Meanwhile, the Venezuelan is media magnate Raul Gorrin, according to someone close to U.S. law enforcement who spoke on condition of anonymity to discuss an ongoing investigation. Gorrin remains in Venezuela and is on the U.S. Immigration and Customs Enforcement’s most-wanted list for allegedly masterminding a scheme to siphon $1.2 billion from PDVSA, Venezuela’s state oil company.

    A U.S.-based attorney for Deripaska didn’t respond to requests for comment. Gorrin declined to comment but has rejected other criminal charges against him as politically motivated.

    While U.S. sanctions on Venezuelan oil apply only to Americans, many foreign entities and individuals with business in the U.S. stay away from transactions involving the OPEC nation for fear of being sanctioned themselves.

    For that same reason, Venezuela’s oil sells at a deep discount — about 40% less than the market price, according to the indictment. But such choice terms require some unorthodox maneuvering.

    For example, instead of instantly wiring funds through Western banks, payment has to take a more circuitous route.

    In one transaction this year cited in the indictment — the $33 million purchase of a tanker full of Venezuelan fuel oil — the alleged co-conspirators discussed channeling payments from a front company in Dubai, named Melissa Trade, to shell accounts in Hong Kong, Australia and England. To hide the transaction, documents were allegedly falsified to describe the cargo as “whole green peas” and “bulky paddy rice.”

    But as is often the case in clandestine transactions, cash appears to have been king.

    “Your people can go directly to PDVSA with one of my staff and pay directly to them. There are 550,000 barrels … to load on Monday,” Serrano wrote Orekhov in a November 2021 message.

    There was also discussion of dropping off millions in cash at a bank in Moscow, Evrofinance Mosnarbank, which is owned by PDVSA. It was a major conduit for trade with Russia until it too was hit with U.S. sanctions in 2019. The two defendants also contemplated a possible mirror transaction whereby cash delivered to a bank in Panama would be paid out the same day at a branch of the same unnamed institution in Caracas, Venezuela’s capital.

    But Orekhov’s preferred method of payment appears to be Tether, a cryptocurrency that purports to be pegged to more stable currencies like the U.S. dollar.

    “It’s quicker than telegraphic transfer,” Orekhov wrote regarding a planned purchase of 500,000 barrels of oil worth $17 million. “That’s why everyone does it now. It’s convenient, it’s quick.”

    It’s not just financial transactions that are a challenge however. Delivering the crude presents its own risk because most shipping companies and insurers won’t do business with Venezuela and other sanctioned entities. In recent years, the U.S. government has seized several tankers suspected of transporting Iranian fuel heading for Venezuela.

    To obscure the oil’s origins, Orekhov and Serrano discussed instructing the Vietnamese tanker they were using to turn off its mandatory tracking system to avoid being spotted while loading in “Disneyland” — a coded reference to Venezuela.

    While the vessel isn’t identified by name in the indictment, internal PDVSA shipping documents seen by The Associated Press show that it was the Melogy, a two-decade old tanker owned and operated by a Hanoi-based company called Thank Long Gas Co.

    Ship tracking data collected by Marine Traffic shows that the Melogy went “dark” on Dec. 31, 2021, as it was drifting empty off the coast of Venezuela near neighboring Trinidad & Tobago. Almost four months later, on April 18, it resumed transmissions, its hull now fully laden and steaming toward Asia.

    On June 9, the ship then transferred its cargo at sea to a floating storage ship, the Harmony Star, off the coast of Malaysia, satellite images show. That same vessel has been identified as being part of a wider oil smuggling network helping Iran, according to research by the United Against Nuclear Iran, a New York-based group the closely tracks crude shipments by sanctioned countries.

    BERLIN — Lawmakers from two of Germany’s governing parties on Thursday slammed plans for Chinese shipping company Cosco to take a major stake in the operator of the country’s biggest container terminal, warning that they pose a national security risk.

    Public broadcaster NDR reported that Chancellor Olaf Scholz has asked officials to find a compromise that would allow the investment to happen, after several ministries initially rejected it on the grounds that Cosco, already the port’s biggest customer, could get too much leverage.

    Neither the ministries nor Scholz’s office immediately responded to requests for comment. But lawmakers from the Green party and the Free Democrats, which formed a coalition last year with Scholz’ Social Democrats, criticized the plan.

    “Our critical infrastructure must not become a plaything for the geopolitical interests of others,” Green party lawmaker Marcel Emmerich said. Citing a past government decision by one of Scholz’s fellow Social Democrats to let Russia buy German natural gas storage facilities, he accused the chancellor of wanting to “flog off parts of the port of Hamburg to China, whatever it takes.”

    The pro-business Free Democrats likewise expressed opposition to the deal.

    “The Chinese Communist Party must not have access to our country’s critical infrastructure,” the party’s general secretary, Bijan Djir-Sarai, told German news agency dpa. “That would be a mistake and a risk.”

    “China is an importing trading partner but also a systemic rival,” he was quoted as saying. “We should act accordingly.”

    Another Free Democrat lawmaker, Reinhard Houben, told news portal t-online that the chancellery should respect the decision by six ministries opposing the sale.

    The government dispute over Germany’s stance toward Chinese investments comes days after Foreign Minister Annalena Baerbock said Berlin must avoid repeating with China the mistakes it made with Russia over recent years, leading to a dependence on Russian energy imports.

    German intelligence agencies also warned this week of China’s rising might and how it could become a risk for Germany, particularly because of the strong economic and scientific ties between the two countries.

    In a hearing with lawmakers, the head of Germany’s domestic intelligence agency, Thomas Haldenwang, made a comparison with the current geopolitical turmoil over the war in Ukraine, saying that “Russia is the storm, China is climate change.”

    PHOENIX — Arizona has refused the federal government’s demand to take down double-stacked shipping containers it placed to fill gaps in the wall along the U.S.-Mexico border, saying it won’t do so until the U.S. moves to construct a permanent barrier instead.

    The Arizona Department of Emergency and Military Affairs dug in its heels in an Oct. 18 letter to the U.S. Bureau of Reclamation, saying “the containers will remain in place until specific details regarding construction are provided.” It was signed by Allen Clark, the department’s director.

    A regional spokeswoman for the Bureau of Reclamation did not immediately respond to a request for comment on Arizona’s refusal in the most recent flap between the Biden administration and Republican-led border states over immigration policies.

    The federal agency told Arizona officials in a letter last week that the containers were unauthorized and violated U.S. law. The bureau also demanded that no new containers be placed, saying it wanted to prevent conflicts with two federal contracts already awarded and two more still pending to fill border wall gaps near the Morelos Dam in the Yuma, Arizona, area.

    Arizona Gov. Doug Ducey ordered installation of more than 100 double-stacked containers that were placed over the summer, saying he couldn’t wait for the U.S. Customs and Border Protection to award the contracts it had announced for the work.

    Migrants have continued to avoid the recently erected barriers by going around them, including through the Cocopah Indian Reservation. The Cocopah Indian Tribe has complained that Arizona acted against its wishes by placing 42 of the double stacks on its land.

    The border wall promoted by former President Donald Trump continues to be a potent issue for Republican politicians hoping to show their support for border security.

    President Joe Biden halted wall construction his first day in office, leaving billions of dollars of work unfinished but still under contract. The Biden administration has made a few exceptions for small projects at areas deemed unsafe for people to cross, including the gaps near Yuma.

    The Center for Biological Diversity raised a different objection to the shipping containers on Wednesday, filing a notice of intent to sue Ducey’s administration over what the environmental group said are plans to erect more shipping containers along the border. The group said the move will obstruct a critical jaguar and ocelot migration corridor.

    Ducey’s office said it could not comment because it had not received an official notice from the center.

    KUALA LUMPUR, Malaysia — The U.S. Federal Aviation Administration has upgraded Malaysia’s air safety rating to Category 1, allowing the country’s carriers to expand flights to the United States after a three-year hiatus, Transport Minister Wee Ka Siong said Saturday.

    Wee said the move will bolster tourism and economic growth in Malaysia, which opened up from pandemic shutdowns in April.

    “With the return to Category 1, our airlines can now mount new flights to the U.S. and have code sharing with American carriers. There is no more barrier now,” said Wee, who was in Montreal for an ICAO assembly. “This is good news after the COVID-19 pandemic.”

    Riad Asmat, CEO of low-cost carrier AirAsia Malaysia, said it was a “very good start.” He said AirAsia, currently the only Malaysian carrier that flies to the United States — from Kuala Lumpur to Honolulu — will seek opportunities to expand in the U.S.

    The FAA lowered Malaysia’s rating in November 2019 to Category 2 due to non-compliance with safety standards. The FAA identified deficiencies in areas including technical expertise, record keeping and inspection procedures.

    Under the FAA system, countries are listed either as Category 1, which meets International Civil Aviation Organization standards, or Category 2, which doesn’t meet standards.

    Wee told an online news conference that the downgrade prompted Malaysia to restructure its Civil Aviation Authority and make various efforts to strengthen its aviation workforce, documentation processes and inspection methods to ensure effective safety oversight.

    He said the FAA was satisfied the issues identified in 2019 had been rectified, but found 29 new problems in its December assessment. Those issues were swiftly rectified in the first half this year, he said, and the FAA has restored Malaysia’s Category 1 rating.

    Malaysia Airlines CEO Izham Ismail said the national carrier will resume flight plans with its partners, especially American Airlines, but didn’t elaborate.

    BANGKOK — Myanmar’s military government accused rebel forces in the eastern state of Kayah of firing at a passenger plane as it was preparing to land Friday, wounding a passenger who was hit by a bullet that penetrated the fuselage. Rebel groups denied the allegation.

    State television MRTV said the Myanmar National Airlines plane, carrying 63 passengers, was hit as it was about to land in Loikaw, the capital of the eastern state of Kayah, also known as Karenni.

    It said Maj. Gen. Zaw Min Tun, a spokesperson for Myanmar’s ruling military council, said the shooting was carried out by “terrorists” belonging to the Karenni National Progressive Party, an ethnic minority militia battling the government, and their allies in the People’s Defense Force, an armed pro-democracy group.

    “I want to say that this kind of attack on the passenger plane is a war crime,” he told MRTV by phone. “People and organizations who want peace need to condemn this issue all round.”

    MRTV said the bullet entered the plane’s lower fuselage as it was flying at an altitude of 3,500 feet about 4 miles (6.5 kilometers) north of the airport. It said the injured passenger was taken to a hospital.

    The state news agency released photos it said were of the bullet hole and the passenger being treated.

    Myanmar National Airlines’ office in Loikaw announced that all flights to the city were canceled indefinitely.

    Kayah state has experienced intense conflict between the military and local resistance groups since the army seized power last year, overthrowing the democratically elected government of Aung San Suu Kyi.

    The Feb. 1, 2021, takeover was met with peaceful nationwide protests, but after the army and police cracked down with lethal force on street demonstrators opposing military rule, thousands of civilians formed militia units as part of a People’s Defense Force to fight back.

    The PDF groups are allied with well-established armed ethnic minority groups such as the Karenni, the Karen and the Kachin which have been fighting the central government for more than half a century, seeking greater autonomy in border regions.

    Khu Daniel, a leader of the Karenni National Progressive Party, denied the government’s accusation and said his party had not ordered its armed wing, the Karenni Army, to shoot at civilians or passenger planes.

    “The military always blames other organizations for the shootings. Our armed wing didn’t shoot the plane this morning,” he told The Associated Press.

    Government spokesperson Zaw Min Tun said it has been providing security around the airport and accused the KNPP and PDF of creating chaos in Loikaw by firing artillery into the city and the area near the airport.

    Since the military seized power, there have been frequent clashes in Kayah between the army and local anti-government guerrillas near a base belonging to the government’s 54th Light Infantry Battalion, located south of the airport. State-run media reported last Christmas that the KNPP and PDF attacked a Myanmar National Airlines passenger plane with four 107mm rockets, which exploded about 2,000 meters (1.2 miles) east of the airport, injuring no one.

    The Karenni Nationalities Defense Force, another ethnic rebel group, earlier advised against traveling on Myanmar National Airlines because it is state-owned, so its revenues go to the military, and the army uses it to supply its forces.

    The information officer of the Karenni Nationalities Defense Force, who spoke on condition of anonymity to safeguard his personal security, called the government’s allegation about Friday’s shooting “nothing more than defamatory propaganda against the revolutionary forces by the Military Council.”

    “The runway and the area of the airfield are surrounded by infantry battalions and high security areas. So to say that PDFs attacked the plane is only an accusation,” he said.
