    WASHINGTON — The company that makes Jack Daniel’s is howling mad over a squeaking dog toy that parodies the whiskey’s signature bottle. Now, the liquor company is barking at the door of the Supreme Court.

    Jack Daniel’s has asked the justices to hear its case against the manufacturer of the plastic Bad Spaniels toy. The high court could say as soon as Monday whether the justices will agree. A number of major companies from the makers of Campbell Soup to outdoor brand Patagonia and jeans maker Levi Strauss have urged the justices to take what they say is an important case for trademark law.

    The toy that has Jack Daniel’s so doggone mad mimics the square shape of its whisky bottle as well as its black-and-white label and amber-colored liquor while adding what it calls “poop humor.” While the original bottle has the words “Old No. 7 brand” and “Tennessee Sour Mash Whiskey,” the parody proclaims: “The Old No. 2 on Your Tennessee Carpet.” Instead of the original’s note that it is 40% alcohol by volume, the parody says it’s “43% Poo by Vol.” and “100% Smelly.”

    The back of the toy, which retails for about $13 to $20, says in small font “this product is not affiliated with Jack Daniel Distillery.”

    The toy’s maker says Jack Daniel’s can’t take a joke. “It is ironic that America’s leading distiller of whiskey both lacks a sense of humor and does not recognize when it — and everyone else — has had enough,” lawyers for Arizona-based VIP Products wrote the high court. They told the justices that Jack Daniel’s has “waged war” against the company for “having the temerity to produce a pun-filled parody” of its bottle.

    But Jack Daniel’s lead attorney, Lisa Blatt, made no bones about the company’s position in her filing.

    “To be sure, everyone likes a good joke. But VIP’s profit-motivated ‘joke’ confuses consumers by taking advantage of Jack Daniel’s hard-earned goodwill,” she wrote for the Louisville, Kentucky-based Brown-Forman Corp., Jack Daniel’s parent company.

    Blatt wrote that a lower court decision provides “near-blanket protection” to humorous trademark infringement. And she said it has “broad and dangerous consequences,” pointing to children who were hospitalized after eating marijuana-infused products that mimicked candy packaging.

    If VIP Products is allowed to confuse consumers with dog toys, “other funny infringers can do the same with juice boxes or marijuana-infused candy,” Blatt wrote.

    The toy is part of a line of VIP Products called Silly Squeakers that mimic liquor, beer, wine and soda bottles. They include Mountain Drool, which parodies Mountain Dew, and Heini Sniff’n, which parodies Heineken. A court in 2008 barred the company from selling its Budweiser parody, ButtWiper.

    After the company began selling its Bad Spaniels toy in 2014, Jack Daniel’s told the company to stop, but VIP went to court to be allowed to continue to sell its product. Jack Daniel’s won the first round in court but lost an appeal. The case reached the Supreme Court at an earlier stage, but the justices didn’t bite.

    Bad Spaniels isn’t the only parody puppy toy to draw the ire of the brand it imitated. Luxury bag maker Louis Vuitton sued the makers of Chewy Vuiton over their plush purse dog toys. In 2007 a federal appeals court sided with the chew toy’s manufacturers, Nevada-based Haute Diggity Dog. Louis Vuitton didn’t appeal to the Supreme Court.

    The holidays are the perfect time to wrangle up your family and friends, and give back. After all, we have all been blessed with so much – it’s important to give back at this time of the year. And with so many local charities and organizations looking for some helping hands, it couldn’t be easier to play Santa’s little helper this season. 

    Every year, A Canadians Cooking (who does some of our amazing recipes) prints one piece of merch and donates 100% of all the profits to charities. This year they are printing bandanas and donating all the profits to animal rescues. The profits will be divided between Humane Canada, Rosies Animal Adoption, and sauvetage lapins errants. The bandanas are selling for $12 each with the option to round up to $15. The bandanas are printed by a local small business, so the purchasing and work was also given to a local business. Sales will be taking place until January 8th. Also, prizes may be won with each purchase at the end of the initiative. 

    Elves Filling Shelves is a local West Island initiative started by a family who wanted to help a few other less-fortunate families in their community. “A few” has grown into a lot, and they will be helping more than 50 families this holiday season with food donations, gifts, clothing, and more. They match donor families with families in need and provide a shopping list of things that they need. They also accept donations. It’s a great way to get your own family involved in choosing the items, plus kids really identify with the fact that they are helping someone their own age. We did it last year and it was a tremendous experience.

    The Montreal Toy Tea collects toys for children and teens who are staying in battered women’s shelters across the city during the holidays. While in the past this was an in-person event, the last several years it has been virtual. For the 31st edition, they’re back to hosting, and this year it takes place on December 7th at the Royal Montreal Regiment. Children from various schools will perform, snacks and tea will be served, and volunteers will be on-hand to collect the new toys attendees are invited to bring.

    When it comes to nostalgia, McDonald’s customers sure are lovin’ it. 

    The burger chain brought back its Halloween pails on Tuesday, which haven’t been offered in the U.S. since 2016. The plastic trick-or-treat buckets decorated to look like a ghost, a goblin or a jack-o’-lantern (aka McBoo, McGoblin and McPunk’n, respectively) quickly began trending among real-time Google searches on Tuesday. 

    But the appetite for these Halloween buckets is nothing compared to the recent McDonald’s

    collaboration with streetwear company Cactus Plant Flea Market, which dished out a $12-$13 box (better known as the “adult Happy Meal”) that featured a food combo and a collectible figurine targeted toward the grownups who grew up on Happy Meals.

    They sold out quickly, and now some enterprising fast food lovers are hawking the adult Happy Meal toys over online resale sites for thousands of dollars.

    So what’s the appeal? Nostalgia, nostalgia, nostalgia. “Everyone remembers their first Happy Meal as a kid … and the can’t-sit-still feeling as you dug in to see what was inside,” McDonald’s wrote in a press release. “And now, we’re reimagining that experience in a whole new way — this time, for adults.”

    The limited-edition Cactus Plant Flea Market Box at McDonald’s rolled out on Oct. 3, feeding the inner child of the average customer by offering a choice of a Big Mac or 10-piece chicken nuggets main dish, french fries and a soft drink, as well as one of four “toys” featuring redesigned McDonald’s mascots like the Grimace, the Hamburgler and Birdie, as well as a new “Cactus Buddy!” figure (yes, the exclamation point is part of his name.)

    The Cactus Plant Flea Market boxes sold out in many places on the same day that they came out. Some McDonald’s employees took to Reddit and TikTok to share how much they were not lovin’ it — which was reminiscent of the hatred many Starbucks

    employees felt toward the viral unicorn frappuccino in 2017

    And now, both the toys and the boxes have become near impossible to come by — unless you’re willing to cough up a lot of cash. A medium Cactus Plant Flea Market Box costs about $12, with large box closer to $13 — and one New Jersey mom noted that in her area, a Big Mac combo with fries and a drink runs under $10, so she spent $3 basically get the collectible toy.

    But one eBay listing offering three of the collectible Cactus Plant Flea Market, still unwrapped and in their original packaging, is asking for a whopping $300,000.

    The sold-out Cactus Plant Flea Market Boxes, aka McDonald’s “adult Happy Meals,” are popping up on resale sites for thousands of dollars.

    Another listing on the fashion marketplace Grailed, which is marked as an “authenticated” post, features the “Cactus Buddy!” figure for the asking price of $39,999 (10% off of the original $44,444 price tag.) 

    The sold-out Cactus Plant Flea Market Boxes, aka McDonald’s “adult Happy Meals,” are popping up on resale sites for thousands of dollars.

    But there are dozens of other listings for the individual toys and boxes on resale sites such as eBay and Facebook Marketplace in the much more palatable $10-$30 range, or bundles with all four collectible figurines running between $60-$70

    McDonald’s was not immediately available for comment, but a rep told Axios that, “The hype for the Cactus Plant Flea Market Box was so real that some of our restaurants have sold out of the limited-edition experience.” They added that, “We’re thrilled by the excitement we’re seeing.”

    The official McDonald’s Twitter account has also been fielding queries from disappointed potential customers who haven’t been able to get their hands on any of the adult Happy Meals, apologizing that this was only a limited time offer. 

    Time will tell if more “adult Happy Meals” will be offered in the future. There’s clearly a customer base hungry for more. 

    This isn’t McDonald’s first viral sensation, of course. The fast food giant has also scored success with celebrity collaborations featuring K-Pop sensation BTS, or singing diva Mariah Carey — which also reportedly sold out.

    My son is very anxious. I think even if he hadn’t been born with autism this would have been the case, as his family tree is ripe with worriers, shall we say. All that aside, over the years I’ve learned that change is hard for him, harder than for most kids. He needs a little more time to process things than other children due to some sensory processing issues very conducive with autism,  and transitioning from one activity to another has been challenging for him. He, and his father and I, have learned over the years how to help him in this regard, to make change less stressful, less unknown.

    Parents, has you experienced difficulty with transitions with your special needs children? This week is the return to routine, with many children going back to school after Spring Break and parents going back to work.  It can be challenging to get used to school structure after a week of being at home with a different kind of structure or return. Here are some tools that have helped me help my son with transitions, back to school being one of them:

     4 Ways to Help Special Needs Kids With Transitions:

    1)    Talking prep work: Talk to your child about what will be happening, one, two or a few hours in advance, depending how much notice they need before they move from one activity to another. My son used to need to know two days in advance, now one day to a few hours is fine. Of course, it also depends what we are talking about. Spring Break, we plan a few days in advance. A big family wedding and what will happen I read up to two to three weeks in advance.

    2)    Use a Social Story: Depending on how well your child communicates, a short story written in simple language describing what will be occurring. http://carolgraysocialstories.com/.  It demystifies some of the unknown and helps them have a concrete grasp of what to expect. You laminate it, or put it in a folder if they need to carry it with them, and they have the events of the day in schedule form. I put it up on the fridge to read too.

    3)    Pictograms: Yes, even stick figures work! I’m no Renoir or any kind of artist when it comes to drawing, but little diagrams to go with the story can help them have a visual to go with the story if you want to join them together. You can also print out some great ones on sites like Pinterest and use this as a tool alone too.

    4)    Tool box to handle anxiety: I have learned that giving my son tools to cope with his anxiety, tools that he chooses, is what sometimes works best too. He chose a little “kit” in three rooms in our home, squeeze toys, thera-putty, stuffed animals or figurines, his trampoline, fitness ball or rocking chair. I will gently remind him to use it when he’s feeling stressed and to use it to best articulate his feelings to himself and to me.

    I think as long as you tell your child that being anxious about change is part of being human and give them tools to learn to handle it, you and they will be able to get through many stressful transitions together successfully.

    We experiment with a lot of crafts in our household, especially the messy ones in summertime (the backyard becomes our craft room). So this year, instead of wasting smaller canvases and umpteen pieces of paper, we decided to keep adding to one bigger summer canvas.

    Here are some of the crafts we’ve done on this year’s summer canvas:

    – Egg shell painting. OK, so this takes some planning, but I try and salvage some egg shells, which we clean, fill with paint, and seal with a small piece of tissue paper or tape. Then we thrown the eggs at the canvas and watch them crack, break, smash, splatter, and more.

    – Water gun painting. We watered down some paint and then filled one of our water guns with the coloured water, then we shot it at our canvas. Just remember to empty the water pistol when you’re done (or you’ll have kids battling with paint-filled guns!).

    – Bubble painting. Add some food colouring to standard bubbles and then get blowing. When the coloured bubbled hit the canvas and break, they leave the coolest little circular blobs!

    – Pompom art. I put different coloured washable paints in a muffin tin and then armed the bean with different pompoms, which he soaked in paint and then threw at the canvas. The sound and effects were cool (SPLAT!).

    – Blow art. Put a blob of paint on a canvas or piece of paper and then, using a straw, blow the paint. Watch how it moves and travels across the surface. Decorate your blobs afterwards to look like monsters, aliens, or anything you can imagine!

    Specimen USNM 555000, also known as “the Nation’s T. rex,” was discovered on federal land in 1988 by Montana rancher Kathy Wankel. A team of paleontologists from the Museum of the Rockies in Bozeman, Montana, led by paleontologist Jack Horner, excavated the fossil from 1989 to 1990. It was then transferred to the Museum of the Rockies by the U.S. Army Corps of Engineers for preparation and eventual housing at the Smithsonian National Museum of Natural History, where it resides today. It is one of the largest and most complete T. rex specimens ever discovered, with 80–85 percent of the skeleton recovered.

    In partnership with the Smithsonian Institute, Master Replicas Group has created an extremely accurate polystone resin replica of the USNM 555000 skull fossil through the use of advanced 3D-scanning technology. This process enabled MRG to capture all of the detail of the original specimen and present it to collectors, dinosaur enthusiasts, and educators in the form of this amazing 1/10th scale replica.
