  • 1. What Colorado Birth Injury Lawyers Want Parents to Know

    While every soon-to-be parent hopes for a smooth, uneventful pregnancy, labor, and delivery, birth trauma and injury can be all too common.

    The birth process — which results in about 6-8 birth injuries per 1,000 live births in the U.S. — can leave mothers and babies alike with physical and emotional injury during a time that should feel celebratory. That aftermath can be confusing, lonely, and incredibly stressful, especially if parents are left wondering whether medical negligence contributed to their child’s injury or death.

    While nothing can reverse a birth injury, the medical malpractice attorneys at Burg Simpson are deeply experienced in securing justice and compensation for families that experience this traumatic event — and are ready to arm parents with the facts and resources they need to face a birth injury case.

    What Is a Birth Injury?

    A birth injury generally starts with a medical complication in pregnancy or birth, said Burg Simpson Attorney Marc Johnson.

    Johnson, who has practiced medical malpractice and birth injury law for more than 15 years, said that natural complications like gestational diabetes, maternal blood pressure concerns, or an issue during labor and delivery can lead to birth injuries, which occur when medical providers don’t respond appropriately to the complication.

    Johnson and Scott Eldredge — a birth injury attorney since the late 80s — commonly see birth injuries after a fetus’ heart rate decompensates during labor. While this situation can be handled through quick intervention and delivery, injury can happen if care providers don’t act quickly enough.

    Birth injuries can also occur if medical professionals don’t appropriately resuscitate a baby who is experiencing difficulty after birth, the attorneys said. Other injuries include:

    • Kernicterus – This condition can cause cerebral palsy if a baby with rising levels of bilirubin, also known as jaundice, is not appropriately managed post-birth.
    • Inadequate glucose monitoring – If a healthcare team does not keep an active eye on a baby’s glucose levels, that baby can suffer a brain injury.
    • Shoulder dystocia – This event occurs when a baby gets caught in the birth canal and their head is delivered, but their shoulder is not. When a doctor pulls on the baby, they can damage the infant’s brachial plexus nerve, causing lasting physical injury.

    Of course, mothers can experience injuries, too. Johnson recalled a case in which a mother’s blood pressure was too high before she gave birth. While blood pressure can return to normal after birth, hers did not. Medical providers did not properly monitor the mother’s postpartum blood pressure, and she experienced a catastrophic stroke, Johnson said.

    How Do I Protect Against Birth Injuries?

    While there’s nothing you can do to fully prevent a birth injury, Eldredge and Johnson recommend that parents not hesitate to advocate for their baby if they suspect something is going wrong during pregnancy, labor, or delivery.

    “A lot of times, people will defer to the nursing staff, defer to the doctors,” Johnson said. “Parents, and particularly mothers, have an intuition that they should follow. That’s there for a reason. And even if their concerns are determined to be not of consequence to the mother or to the child, it’s still worth bringing it up.”

    Expectant parents can also research their medical providers ahead of labor and delivery using Colorado’s Department of Regulatory Agencies website, which allows users to look up physicians, their education, and any legal or administrative action taken against them. While getting sued once doesn’t mean a doctor is bad at their job, a pattern of successful litigation against them may be something to consider.

    ”Unfortunately, both Scott (Eldredge) and I have seen multiple cases against the same providers with different patients — there are some bad apples out there,” Johnson said. “And one way that you can try to protect yourself against that is to go on the Department of Regulatory Agency’s website and look up that historical information.”

    How Should I Approach Birth Injury Claims in Colorado?

    If you are concerned about a potential birth injury, it’s important that you reach out to a qualified legal professional as soon as possible.

    While the aftermath of birth injuries is overwhelming and stressful, Eldredge emphasized that it’s critical to retain a birth injury attorney quickly so you don’t lose critical memories or details to time.

    “Sooner is better than later,” he said. “The sooner [clients] reach out, the clearer their memories will be, and the quicker we can begin to evaluate the case.”

    When Eldredge and Johnson receive an inquiry, they arrange a detailed conversation with the prospective client, gathering all the information they can while it’s fresh. A client’s memories and experience help in the preparation of any case, so it’s vital that a prospective client creates a record of everything they remember from the birth.

    “In the shoulder dystocia cases that we’ve handled successfully, the parent’s recitation of what happened during the delivery is very important,” Eldredge said. “Did the doctor encourage them to stop pushing? Did it look like the doctor was straining as they were trying to pull the baby out?”

    Though it’s crucial to retain an attorney quickly, it’s equally essential to hire someone who’s well-versed in Colorado medical malpractice law and regularly takes on birth injury cases. Johnson and Eldredge have more than 50 years of combined medical malpractice experience, and they also regularly stay up to date on medical literature and new advances in clinical care.

    “Most lawyers don’t go to court. Of the lawyers that go to court, most lawyers don’t do personal injury litigation,” Eldredge said. “Most lawyers that do personal injury litigation don’t do medical malpractice litigation, and most lawyers that do medical malpractice litigation don’t handle birth injury cases because they’re the most difficult, they’re the most time-consuming, they’re the most expensive cases, and it’s why families should find a firm that has handled this type of litigation for over 35 years.”

    What Regulations and Caps Does Colorado Have on Birth Injury Claims?

    Colorado statutes give parents two years from the point at which they knew or should have known about medical malpractice to file a claim on their own behalf, while a claim filed for a child may be viable for up to two years after the child turns 18.

    That window for a child’s claim is lengthy for good reason. Though a child’s injuries are sometimes apparent immediately after birth, it can take a few years for observation and testing to confirm the extent of cognitive injuries.

    Johnson once handled a case in which his Burg Simpson team followed a client’s child for years, ensuring they had the information they needed to fully understand the extent of the child’s injuries and future medical needs. That allowed Burg Simpson to engage the numerous experts needed to forecast every need and expense an injured child is likely to encounter for the rest of their life.

    While this timeline can feel lengthy, the birth injury team at Burg Simpson recognizes the importance of spending the time and resources necessary to build the strongest case.

    “When you file a case, you get one opportunity to recover damages,” said Johnson, who noted that the foundation developed in this particular claim allowed his team to resolve the case with the help of a mediator and fund a Trust set up to cover the child’s lifetime care needs.

    Unfortunately, even if attorneys win a favorable outcome for a birth injury client, Colorado caps a victim’s damages. The state has a relatively low cap on non-economic damages (which include pain, suffering, and loss of enjoyment of life) for victims who suffer a birth injury or the loss of a child to medical malpractice.

    “I think birth injuries are among the most egregious examples of why those caps are completely inappropriate and don’t adequately compensate the citizens of our state,” Johnson said.

    Though Colorado has a $1 million cap on economic damages, a judge can exceed that limit if they find there’s a valid basis to do so.

    “We often are able to recover significant amounts of money for the families of these birth-injured children, way in excess of the million-dollar cap, because the injuries are so severe and the future needs are so high,” Eldredge said.

  • My Fall Bulb Master Guide (for Spring Blooming Flowers) – Garden Therapy

    You get a tulip, you get a hyacinth, you get a crocus! Yes, folks, fall bulb planting season is upon us. It’s singlehandedly one of the best things you can do this time of year for your future self. Plant fall bulbs now, and they’ll be one of the first blooms to welcome you next spring.

    While others may be mourning the loss of summer, I’m over here buzzing about it being fall bulb season. Come September, the displays are full of tons of brilliant bulbs you can plant now for the spring.

    One minute I’m shopping for garlic, the next thing you know, I’m leaving with $100 worth of flower bulbs to plant that weekend.

    Fall bulbs and spring flowering bulbs are the same thing. One refers to when you plant it, and the other to when they flower.

    It can be hard to think about next season’s garden when you’re still enjoying the last of this year’s harvest and blooms, but just a little work now will bring you so much joy next winter.

    I’ve got plenty to say about fall bulbs, so let me dive in with all my planting tips. And make sure you read to the end for a can’t miss fall bulb giveaway!

    What is a Flower Bulb?

    We refer to most as “bulbs,” but some are also corms and tubers. For instance, crocus grow from corms while summer favourites like dahlias and begonias grow from tubers. Their appearance varies slightly, but for the sake of the article, I’ll refer to everything as a bulb! The care is fairly similar for each.

    Bulbs are special in that they hold all the food the flower needs to thrive. If you’ve ever seen a package with bulbs already sprouting, that’s why,

    Some bulbs are designed for annual planting, others for perennial or naturalizing. Annuals often are bred to be very showy, either in size or colour. Because of how much work it takes for the bulb to produce such a flower, it often won’t bloom again.

    Perennials are bred for multiple-year flowering. They can remain in the ground all year round, becoming part of your garden bed plantings.

    Naturalized bulbs are meant to multiply and spread. They can work in mass on their own or be part of a bed with other plants. They also work wonderfully in lawns.

    When Should I Plant Fall Bulbs?

    When you should plant fall bulbs will vary greatly depending on where you live. They must be planted in the fall and before the first hard frost. This gives the bulb a chance to develop some root systems and settle in before winter.

    This can be anywhere from September to December, depending on your climate. When in doubt, the package will tell you everything you need to know about when and how to plant the particular bulb.

    Ideally, you want to plant them shortly after bringing them home. Most online retailers won’t ship the bulbs to you until they’re ready to plant in your hardiness zone. In the store, they’ll have them a little earlier. You can store them for a little while if necessary, keeping the bulbs between 10°-15°C.

    For individual plantings, I use an auger drill attachment to help speed things up.

    How to Plant Fall Bulbs

    Again, the instructions will vary depending on the bulb you’re growing. Each bulb should be planted at different depths, and the sun and water conditions may vary slightly. My instructions below are a good rule of thumb for all bulbs, corms, and tubers.

    Good drainage is a universal rule to follow. Bulbs will rot if sitting in any kind of water, so avoid any wet sections in your garden.

    Most bulbs thrive in full or partial sun. Since these bulbs bloom in spring, they might enjoy more sunlight than you may think because the trees and shrubs haven’t leafed out yet.

    When planting, you can plant them individually or in mass by digging trenches. Typically, smaller plants, like crocus, do well in mass while larger bulbs, such as alliums, work best with individual plantings. I like to work in compost to help improve drainage.

    Generally, larger bulbs (2+ inches across) should be planted 6-8 inches deep, and smaller bulbs (1 inch or less) are planted 3-4 inches deep. Depth can change depending on your climate. For our mild winters, that depth is plenty in my garden. It’s best to refer to the package for the exact planting range. Warmer climates can handle the shallowest depth, where colder climates will want to use the maximum of the range.

    Plant the bulbs with the pointy side facing up. Place, don’t push the bulb in. Cover with soil and then water generously if the soil isn’t already wet or you’re planting in dry conditions. Add a layer of mulch to help insulate the soil and stop it from drying out.

    Caring for Fall Bulbs

    Once they’ve been planted, there’s very little work that needs to go into caring for your fall bulbs. They’ll be fine in the winter, sheltered under the cover of snow until they’re ready to emerge in the spring.

    Many bulbs will actually naturalize or be perennials in the garden, returning year after year to bring you spring joy. Some bulbs, such as tulips and hyacinths, will bloom abundantly in their first couple of years and slowly taper off.

    In the spring, you can snip faded flowers, but it’s important you leave the foliage until it turns completely yellow. The bulbs need time to charge and gather nutrients through the foliage to return the following year.

    Planting Bulbs in Pots

    Yes, fall bulbs can also be planted in pots! This is a great option for those with a small space or who want to decorate their patio or balcony. I make a container every fall for my front door, and it’s always such a delight come springtime.

    For successful bulb containers, you have to make sure the pot is deep enough and has good drainage. Use fresh soil when planting.

    You can see exactly how I layer my bulbs, including tulips, daffodils, and crocus. The top layer will bloom first while the ones below make their way up the soil.

    In containers, you can pack the bulbs closer than you would in a garden bed. I also like to top mine off with fall annuals, so it looks good in the fall while the bulbs are resting.

    You may need to water your containers periodically, especially if they’re under protection from the outside.

    Tulips

    Daffodils

    Alliums

    Alliums have long been one of my spring favourites, particularly the giant balls known as Globmaster alliums. As part of the onion family, you can truly grow some wacky and wonderful alliums.

    Crocus

    The true herald of spring is not the robin, but the crocus flowers. I often see these flowers blooming even when there is snow or frost still on the ground. They’re great for mass plantings in garden beds and are a go-to for bulb lawns and naturalizing.

    Specialty Bulbs

    Naturalizing Bulbs

    Naturalizing is a gardener’s dream. This is when the bulbs produce more bulbs on their own, naturally multiplying their numbers each subsequent year. I’ve done tons of work naturalizing bulbs in my front lawn. You can find all my tips for naturalizing garden beds and lawns here!

    Fall Bulb FAQ

    Can I plant flower bulbs among trees, shrubs, and perennials?

    Yes, and it’s a great way to bring some beauty before the perennials leaf out and everything else isn’t blooming yet. It can be difficult to plant in these areas as the soil is hard and there are root systems to navigate. You’re more likely to individually plant them. An auger drill attachment can help, though you should make the hole as small as possible.

    It should be noted that the success rate may be lower as the bulbs are competing with these large root systems for nutrients. You can read about my experience planting on my sidewalk strip under oak trees in this post.

    How do I stop squirrels from digging up my bulbs?

    Squirrels and other small mammals are attracted to the fresh soil after you’ve planted a bulb. You want to try to cover up any indication of fresh soil. Mulch can help hide this.

    You also want to remove anything that may be attracting them to the area, such as garbage, compost, or bird feeders.

    If you’re really concerned, you can place a hard wire over the top of the bulbs.

    Personally, I plant with the knowledge that some of my bulbs may be dug up. It seems only fair they get a few bulbs too!

    Is it better to plant flower bulbs earlier or later in the fall?

    Earlier is usually better, but it depends on your climate. The planting should be done before the hard frost to allow the bulb to establish a root system. However, if you’re experiencing a warm fall, you may want to wait later to avoid hot conditions.

    Should I fertilize flower bulbs?

    I don’t fertilize much in my garden, as I work hard to feed my soil by adding layers of compost and leaf mulch every year. Only if you have poor soil conditions, you may want to fertilize. This is especially helpful if you have perennial bulbs and want them to bloom prolifically the following year. Fertilize after the bulbs have finished flowering in the spring.

  • $330 billion worth of homes sit for over 60 days as inventory surges

    As inventory surges nationally, more than $330 billion worth of homes have lingered on the market for 60 days or longer, according to Redfin research.

    As demand wanes due to rising housing costs and economic uncertainty, the total value of homes for sale has reached a staggering $698 billion—up 20.3% from last year—highlighting a growing imbalance between sellers and buyers.

    According to a Redfin analysis:

    • Housing supply is at a 5-year high.
    • Homes are remaining on the market longer.
    • Home buying demand is declining, with 34% more sellers than buyers. At no other time since 2013 have sellers outnumbered buyers to this extent.
    • Home prices are increasing.

    “House hunters are only purchasing if they absolutely need to and even serious buyers are backing out of contracts more frequently,” said Matt Purdy, a Redfin Premier agent in Denver.

    60 days on market

    Zillow estimated that the median time a typical home spent on the market nationally in July was 60 days, the longest for any July since the company began tracking the data.

    Buyers may hesitate to purchase homes that have been on the market for 60 days or more, said Mckinze Casey with LIV Sotheby’s International Realty.

    “If it’s on market for 60 days, buyers tend to wonder what’s what’s wrong with it,” she said.

    Nick Painz, office manager at REMAX Alliance, said when listings stay on market for more than 60 days, it’s usually “due to price, location, or condition.”

    “Since location can’t be changed, the only proactive options are to improve the condition of the property or make a pricing adjustment,” he said.

    Because sellers get frustrated when their homes don’t sell quickly, real estate agents need to help set their expectations.

    “If sellers don’t want to sit on the market for a long time, they should make sure their agent understands local absorption rates so they know where to price,” Painz said.

    Sellers give up

    After failing to find a buyer at the price they think they deserve, more sellers are pulling their listings off the market, according to Realtor.com.

    In May, delistings nationwide increased by 47% compared to the previous year, indicating that sellers are more inclined to wait rather than negotiate. Year-to-date, delistings have risen by 35% compared to the same period in 2024.

    Before delisting, sellers may need to consider reducing their price or relaunching the listing with updated photography, Casey said.

    How Zillow’s new climate risk data helps Colorado home buyers

    As wildfires and hail damage continue to increase home insurance rates in Colorado, around 90% of prospective homebuyers in the West consider at least one climate risk factor when purchasing a home.

    In late September, Zillow incorporated climate risk data from First Street Foundation, a nonprofit that assesses climate risk, into for-sale property listings across the U.S.

    This new feature gives home shoppers insights into five key risks: flood, wildfire, wind, heat, and air quality. The listings now include risk scores, interactive maps, and information about insurance requirements.

    “Climate risks are now a critical factor in home-buying decisions,” said Skylar Olsen, chief economist at Zillow. “Healthy markets are ones where buyers and sellers have access to all relevant data for their decisions. As concerns about flooding, extreme temperatures and wildfires grow — and what that might mean for future insurance costs — this tool also helps agents inform their clients in discussing climate risk, insurance and long-term affordability.”

    Increasing risk

    An August Zillow analysis found that more new home listings nationally show significant climate risk compared to those listed five years ago. This trend applies to all five climate risk categories.

    For example, about 17% of new listings in August showed significant wildfire risk.

    Rising premiums

    Climate-related weather damage is driving up insurance rates across the U.S. According to an analysis from Insurify, a digital insurance agent that provides real-time quotes from more than 100 insurers, homeowners in 15 states, including Colorado, can expect continued weather-related rate hikes and declining competition from insurance companies.

    According to Insurify’s research, Colorado has the second-highest property damage losses to hail, at $151 million annually. The state also has over 321,000 homes at risk of wildfire, with reconstruction estimated at $141 billion.

    Frequent and severe hailstorms and increasing wildfire risks drive up home insurance premiums in Colorado. At $4,186, the state’s average premium is among the highest nationally.

    In 2022, 76% of insurers scaled back in high-risk areas, resulting in higher premiums and fewer choices.

    Chase Gardner, Insurify data insights manager, said insurance companies struggle because natural disaster claims exceed premium increases. That’s led some states, like Florida, to create state-run insurance programs for high-risk homeowners.

    State legislators passed the Colorado Fair Access to Insurance Requirements (FAIR) Plan in 2023. This property insurance program is expected to launch in 2025 and cover individuals and businesses in areas prone to natural disasters or other risks that cannot get traditional insurance.

    To qualify for the FAIR Plan, homeowners must receive multiple denial letters from insurers and take steps to reduce wildfire risk. FAIR Plan policies typically offer less coverage at a higher cost and are designed as a last resort until people find alternative coverage.

    Getting the best deal

    Gardner said homeowners can take steps to lower their insurance costs. He recommends shopping and comparing policies to get the best rate.

    “Different companies calculate the risk differently, so you might find one that will give you a lower rate,” Gardner said. “It’s always good to check around.”
