  • Suspect killed in police shooting as Sacramento officers respond to bank robbery, officials say

    A man died after he was shot by Sacramento officers who were responding to a bank robbery on Thursday, the law enforcement agency said. Sgt. Dan Wiseman of the Sacramento Police Department said officers responded to the bank robbery just before 4:30 p.m. near the intersection of Response Road and Heritage Lane. The suspect, a man in his 30s or 40s, was armed. When officers arrived, the suspect ran from the bank, and officers gave chase.Two officers discharged their firearms, hitting the suspect at least once, Wiseman said.   • Alleged assault of anti-ICE protester under investigation by Sacramento PD

    (FOX40.COM) — Police are investigating after a man said he was assaulted while protesting ICE in downtown Sacramento.

    Scott Stauffer told FOX40 that a group of “MAGA” supporters showed up around 3 p.m. Saturday when he was protesting alongside a few others outside the John E. Moss Federal Building, which houses the Sacramento Immigration Court and has faced criticism from local leaders over its use as an ICE detention facility.

    “They show up [with] 20 trucks, take up this whole road,” Stauffer said. “I don’t know what they got upset over.”

    At first, a few people broke Stauffer’s car windshield, he said. When he fought back, Stauffer said the group then beat him with baseball bats and metal implements, wrestled him to the ground and “bear sprayed” him. A video (warning: graphic content and language) posted to social media by 916 Today shows Stauffer being beaten by a group of at least six people while the street is blocked by a large number of vehicles, many of which flew American flags.

    “I got hit with the bat a couple times in the ribs,” Stauffer said. “Other than that, I’m sore from wrestling… No busted mouth; I didn’t go to the hospital. Just the ribs [are] sore.”

    Stauffer believes there was “intent” behind the alleged assault: “You don’t come out that deep and just cruise around.”

    The Sacramento Police Department told FOX40 that officers responded to the alleged assault on the 500 block of N St just before 3:30 p.m. on Saturday, but the suspects had already fled. The department said officers have investigated and are “actively conducting follow-up.”

    “The Sacramento Police Department continues to monitor demonstrations and responds to them as necessary,” the department said in a statement. “While we support and protect individuals’ First Amendment rights to lawfully protest, the safety of everyone involved remains our priority. Acts of physical assault will not be tolerated.”

    Stauffer told FOX40 he grew up in Los Angeles and has traveled to various cities for protests and rallies. He’s been in Sacramento for the past month, he said, to support friends and family and show his opposition to U.S. Immigration and Customs Enforcement — “we want to get ICE out.”

    “We’re tired of people being separated from families,” Stauffer said. “We’re tired of all the horrible stuff that’s going on.”

    A GoFundMe has already raised nearly $6,000 to help Stauffer, who called the community support “overwhelming.”

    Despite what happened, Stauffer returned to the Moss Federal Building on Monday — despite fear that incidents like the alleged assault will continue.

    “This is where we are. It’s happening. People are being attacked daily in different cities, all the time,” he said. “It’s not a fear of, ‘Is it going to happen?’ It’s the fear of, ‘How far are they willing to take it?’”

    Sacramento police have let go 41 retired officers who were working part-time after a CalPERS audit found compliance issues with their employment conditions.These reserve officers, known as retired annuitants, were often considered extra help and included individuals brought in on an interim basis to fill vacancies or prevent emergencies.The audit found that one officer returned to work only 30 days after retirement, instead of the required 60 days. In another instance, some officers did not submit the required documentation showing they had not received unemployment insurance prior to their return to work.Dustin Smith, the president of the Sacramento Police Officers Association, said the audit marked the end of decades of service for dozens of officers. “For most of them, it’s just heart-wrenching because this is a big part of who you are and what you do in life,” Smith said. “We have 40-year employees that have given their life, their heart and soul to this community, that are all basically with a phone call, were told, ‘I’m sorry, we have to let you go.’”Smith said the reserve officers would generally help with things like cold case investigations, jail intake, and special events. He said losing them will hurt—especially amid a staff shortage.“There’s going to be more police officers pulled off the streets, trapped in a place like jail, doing basic admin work instead of coming back out to handle calls for service. So, call response times and all the things we talk about routinely to help the community are going to go down again,” Smith said.     A Sacramento man suspected of shooting into the ABC10 television station on Friday has been arrested, police said. Anibal Hernandezsantana, 64, was arrested at a residence in the 5400 block of Carlson Drive in River Park, police said early Saturday. He was being booked into the Sacramento County Main Jail on charges that include assault with a deadly weapon, shooting into an occupied building and negligent discharge of a firearm. KCRA 3 saw police activity at the River Park Apartments around 6:15 p.m. on Friday, which included several police cars and a SWAT team. A witness at the scene reported seeing a man being tackled and then taken into custody. Asked for comment at the time, police called their presence a planned operation. A person was in the lobby at the time of the shooting, but not physically harmed, the station said.     KCRA 3 saw police activity at the River Park Apartments around 6:15 p.m. on Friday, which included several police cars and a SWAT team. A witness at the scene reported seeing a man being tackled and then taken into custody. Asked for comment at the time, police called their presence a planned operation.

    Earlier Friday, police said they responded to reports of shots being fired at the ABC10 building at 400 Broadway after 1:30 p.m. No one was injured in the shooting despite the building being occupied.

    Three bullet holes were seen in one of the building’s windows. A person was in the lobby at the time of the shooting, but not physically harmed, the station said.

    There were protests outside of the station on Friday morning, but none were active at the time of the shooting, police told KCRA 3.

    Tegna, which owns ABC10, issued the following statement: “We can confirm that shots were fired into our station at KXTV earlier today. While details are still limited, importantly all of our employees are safe and unharmed. We are fully cooperating with law enforcement and have taken additional measures to ensure the continued safety of our employees.”

    Gov. Gavin Newsom’s office said he had been briefed on the shooting.

    “While no injuries have been reported, any act of violence toward journalists is an attack on our democracy itself and must be condemned in the strongest terms,” the governor’s office shared in a post on X. “We stand with reporters and staff who work every day to keep communities informed and safe!”

    Sacramento police thanked the FBI for providing resources in its investigation. They asked anyone with information to contact them.

    A Riverside County lawmaker accused of driving drunk after a car crash, but cleared by a blood test, took the first step Monday toward suing the Sacramento Police Department, saying officers had tarnished her reputation.

    After Sen. Sabrina Cervantes (D-Riverside) was broadsided by an SUV near the Capitol in May, Sacramento police interviewed the 37-year-old lawmaker for hours at a Kaiser Permanente hospital before citing her on suspicion of driving under the influence. Prosecutors declined to file charges after the toxicology results of a blood test revealed no “measurable amount of alcohol or drugs.”

    In an 11-page filing Monday, Cervantes alleged that officers had retaliated against her over a bill that would sharply curtail how police can store data gathered by automated license plate readers, a proposal opposed by more than a dozen law enforcement agencies.

    The filing also alleges that the police treated Cervantes, who is gay and Latina, differently than the white woman driver who ran a stop sign and broadsided her car.

    “This is not only about what happened to me — it’s about accountability,” Cervantes said in a prepared statement. “No Californian should be falsely arrested, defamed, or retaliated against because of who they are or what they stand for.”

    Cervantes, a first-year state senator, has said since the crash that she did nothing wrong. She represents the 31st Senate District, which covers portions of Riverside and San Bernardino counties, and chairs the Senate elections committee.

    Cervantes’ lawyer, James Quadra, said the Sacramento police had tried to “destroy the reputation of an exemplary member of the state Senate,” and that the department’s “egregious misconduct” includes false arrest, intentional infliction of emotional distress and defamation.

    A representative for the Sacramento Police Department declined to comment, citing pending litigation.

    After news broke of the crash, the Sacramento Police Department told reporters that they had “observed objective signs of intoxication” after speaking to Cervantes at the hospital. She said in her filing that the police had asked her to conduct a test gauging her eyes’ reaction to stimulus, a “less accurate and subjective test” than the blood test she requested.

    The toxicology screen had “completely exonerated” Cervantes, the filing said, but the police department had already “released false information to the press claiming that Senator Cervantes had driven while under the influence of drugs.”

    The filing alleges that one police officer turned off his body camera for about five minutes while answering a call on his cell phone. The filing also said that the department failed to produce body camera footage from a sergeant who also came to the hospital.

    Natomas businesses were hit by burglars again early Saturday morning. It’s a crime that has become too frequent in the Sacramento neighborhood.Marcie Sabey owns Max Muscle Nutrition on Natomas Crossing Drive, one of the businesses targeted during a recent string of break-ins. “Saw all my glass had shattered, and all three panels of my windows back there,” said Sabey. The burglary left Sabey with a financial loss of more than $30,000 and a shattered sense of safety. “You always are wondering when the next time it’s going to happen will be,” said Sabey. “It’s a huge hit outside of just financially, you know—mentally, emotionally.”This was the first time her store was burglarized but Sabey said nearby businesses have been hit several times in the last year. “We want more police presence,” said Sabey. “We don’t feel safe.” Misty Alafranji is councilmember Lisa Kaplan’s Chief of Staff. We do not take the decision to close stores lightly. Our relationship with our customers is deeply personal, and we are honored to have been their Third Place.”Frequent customers Daniele Barker and Richard Clutter, who both live in Sacramento, were shocked to see a sign on the Starbucks door Friday that said, “Sorry we missed you,” followed by, “This store is permanently closed. We look forward to welcoming you at another location.”“We were trying to come and get an iced coffee because this is a great location for us when we’re down here,” Barker said. “We come down here at least twice, maybe three times a week… I’m sad to see them close.While the specific cause of the closure is still a mystery, Clutter said he has an idea why it shut down. Clutter said he was unhoused at one point, but he added that what he has seen the unhoused do in the DOCO area likely affected Starbucks and still impacts other businesses in the area.
