  • Woman Shot By Border Patrol Officer In Portland Gets Probation For Illegal Entry – KXL

    PORTLAND, OR – The woman shot in the chest by a Border Patrol officer during a traffic stop in Portland earlier this month pleaded guilty Thursday to illegally entering the United States and was sentenced to a year of probation.

    Yorlenys Betzabeth Zambrano-Contreras, 32, appeared by video from an immigration detention center in Tacoma, Washington, for a hearing in federal court in Portland. Under a negotiated agreement, she will remain out of custody in Oregon while on probation.

    Zambrano-Contreras pleaded guilty to improper entry by an alien, a misdemeanor. The case was initially filed in Texas, but she waived her right to appear there for prosecution.

    Her defense attorney, Conor Huseby, said Zambrano-Contreras crossed the border in 2023 while seeking a better life for herself and her child amid long delays at ports of entry. Speaking through a Spanish-language interpreter, Zambrano-Contreras told the judge she had no place to live or work and crossed with a large group of people without inspection.

    Prosecutors said Zambrano-Contreras entered the U.S. from Mexico in September 2023 near the Paso Del Norte port of entry in Texas. She was detained by Border Patrol, then released due to lack of space and ordered to report to immigration authorities in Portland, which she did not do. Her immigration court hearing is scheduled for June 1, 2028.

    U.S. Magistrate Judge Stacie F. Beckerman ordered Zambrano-Contreras to undergo location monitoring during probation and comply with an initial nightly curfew. She was also barred from areas where prostitution occurs and warned she could be arrested if she violates probation conditions.

    Zambrano-Contreras was wounded Jan. 8 while sitting in the front passenger seat of a red Toyota Tacoma that was stopped by Border Patrol officers in a Southeast Portland medical office parking lot. Authorities say the driver, Luis David Niño-Moncada, rammed a federal vehicle and struck an officer with the truck. An officer then fired two shots into the vehicle, wounding both the driver and Zambrano-Contreras.

    Niño-Moncada, 33, later drove to an apartment complex and called 911. He has pleaded not guilty to aggravated assault of a federal officer and damaging federal property and remains in custody.

    Federal officials have alleged Zambrano-Contreras was the target of the stop and linked to a prostitution ring tied to the Venezuelan Tren de Aragua gang, but she has not been charged in connection with any prostitution activity or prior shooting. She is expected to be a witness in the case against Niño-Moncada.

  • Elderly woman tells bank employees she was kidnapped, ordered to withdraw large sum of cash

    Two people were arrested after an older woman told bank employees in Ceres, California, that she had been kidnapped and was ordered to withdraw a large amount of money, according to police. Wells Fargo employees reported the incident to police on Thursday. Police responded and immediately arrested a woman who police later learned identified herself with a false name. Police said that 33-year-old Nicholas Payton, who is a felon on probation, was also involved in the kidnapping. He fled the area before police arrived but was arrested a block away.Officers said they found a loaded rifle without a serial number in Payton’s backpack. Both suspects were booked on kidnapping, elder abuse charges and conspiracy to commit a crime charges. Payton was also booked for being a prohibited person in possession of a firearm, a prohibited person in possession of ammunition, carrying a loaded firearm in public, carrying a firearm while in possession of a controlled substance, and possession of an unserialized firearm.The victim was reunited with her family.Police said Saturday that they later learned with the help of the Stanislaus County Sheriff’s Office and fingerprint analysis that one of the suspect’s real names was Stephanie Maghoney.   • Woman sentenced to probation in fatal crash in Preble County

    Sep. 18—A West Alexandria woman was sentenced to probation in a Preble County crash that killed a man last year.

    What was she sentenced to?

    —Elizabeth Ward, 29, was sentenced to two years of probation, according to a representative from Eaton Municipal Court.

    —Her driver’s license was suspended for two years, with at least six months without driving privileges.

    What was she convicted of?

    —She was convicted of one count of vehicular manslaughter.

    —One count each of operating a vehicle while under the influence and failure to control were dismissed, according to court records.

    What was she accused of?

    —On Sept. 17, 2024, Ward was driving a 2021 Kia Sorento on U.S. 35 East in Washington Twp. when she hit a trailer parked on the side of the road, according to a crash report.

    —Richard B. Laycock, 59, of West Alexandria, was standing near the driver’s side of a 2001 Chevrolet Silverado. He reportedly stopped on the side of the road to secure items on a trailer.

    —Ward hit the back of the trailer, and the impact threw Laycock approximately 20 yards.

    —Laycock was pronounced dead at the scene.

    —His 21-year-old daughter was with him at the time of the crash. Medics transported her to the hospital with minor injuries.

    —Ward was also taken to the hospital for non-life-threatening injuries.

  • North Andover officer who was shot to be under house arrest

    SALEM, Mass. — An off-duty North Andover police officer who was shot in her home by a colleague serving a restraining order will be released to the custody of her mother and stepfather under GPS-monitored home confinement as she awaits trial.

    Kelsey Fitzsimmons, 28, of North Andover pleaded not guilty Thursday following her arraignment on a charge of assault by means of a dangerous weapon in Essex County Superior Court.

    Woman gets probation for fatal stabbing during weed-induced psychosis

    A Thousand Oaks woman who faced the prospect of life in prison if convicted of the stabbing death of a man she was dating was sentenced Tuesday to two years probation and 100 hours of community service after arguing that she was on a cannabis-induced psychosis during the killing.

    Authorities responded to a Thousand Oaks apartment on May 27, 2018, and found that Bryn Spejcher, 32, had stabbed Chad O’Melia, 26, dozens of times, then turned the knife on herself and her dog. She was arrested on suspicion of murder and charged with that offense.

    But in an extraordinary turn of events last year, a prosecutor’s medical expert agreed with a defense expert for Spejcher that the behavior was the result of cannabis-induced psychosis, which she suffered after taking hits from the victim’s bong.

    The expert conducted what prosecutors characterized as tests that showed she was not exaggerating or faking her behavior that day. Prosecutors opted to reduce the charge to involuntary manslaughter with a series of enhancements.

    That decision came after psychologist Kris Mohandie, a consultant for law enforcement, examined Spejcher, her interviews with law enforcement and police body-camera footage and produced a 37-page report that concluded she had lost touch with reality due to highly potent marijuana.

    After four hours of deliberation, a jury in December found her guilty of involuntary manslaughter — a charge that can carry a four-year prison sentence.

    Ventura County Superior Court Judge David Worley, however, opted to sentence her to 100 hours of community service in the form of educating others on marijuana-induced psychosis and two years of formal probation.

    Spejcher had been dating O’Melia for a couple of weeks when she went to the apartment. Shortly after taking a second hit from a bong, Spejcher began “hearing and seeing things that weren’t there” and believing she was dead, and that she had to stab O’Melia in order to bring herself back to life, according to the district attorney’s office.

    In her closing statement, Spejcher told the judge, “I wish I could go back in time and prevent this tragedy from happening.

    “I wish I had known more about the dangers of marijuana,” she added. “Had I known, I would never have smoked it that night or at all.”

    Her attorney Michael Goldstein lauded the ruling.

    “Today, Ventura Superior Court Judge did the right thing and imposed a sentence that was fair and accurately reflected Ms. Spejcher’s conduct and recognized that it was the contents of the marijuana she was given that was the sole cause of her psychotic breakdown,” he said. “It was clear that she had no control of her faculties and never intended to cause any harm. All of the medical experts agreed, including the expert called by the district attorney’s office.”

She was charged with two misdemeanors, one count of DUI and one count of hit and run. But on Thursday, Shannon received nothing more than a slap on the wrist from the judge for her actions as the judge dismissed the charge of hit-and-run with property damage.

    She then was sentenced to three years of probation and 40 hours of community service. Shannon also was required to complete a nine-month alcohol program. One day after her sentencing, the Bravolebrity made an appearance at BravoCon for the Real Housewives of Orange County panel – where she opened up about the incident. And Shannon seemed to be very remorseful! She told the audience on Friday:

    “It’s been a tough six weeks but I will tell you that I made a terrible mistake and — I don’t want to cry. I’m incredibly grateful that I didn’t hurt anyone. I, on my own, just completed a 28-day behavioral wellness program with an alcohol component and I have been able to focus on elements of my life that were unhealthy and toxic and I believe that today, I’m going in a good and positive direction.”

    Shannon then went on to say she took “inventory of my life” following the arrest. In fact, it sounds like she now agrees with her castmates about having a drinking problem. The television personality said she realized she was “absolutely” drinking way too much lately.

    A mother of eight children is accused of abducting her children, taking them from their foster care facilities, and then fleeing across five states until police caught up with her in a small town in northern California.

    Trista Fullerton, 36, allegedly violated a court order of custody for the eight children, as well as the terms of her probation for a domestic violence conviction, when she took the kids from the town of Rogers, Ark., and fled across the country while Arkansas police tried to reach her, according to court records.

    Her father told police that Fullerton planned on heading to Arizona “to start a new life,” according to a warrant for her arrest. Instead, Fullerton was found in Anderson, Calif. — 150 miles north of Sacramento — where police said they spotted her and six of her children in a pickup truck filled with trash after someone reported that Fullerton was “displaying bizarre behavior.”

    According to an arrest warrant affidavit obtained by The Times, police from Rogers began trying to contact Fullerton on Oct. 17, after receiving a report that she had “interfered with court ordered custody of eight children.”

    Rogers Police officials declined to provide additional details on the case, including who made the initial report. A spokesperson for the department said the case is still under investigation.

    According to the affidavit, police reached out to Fullerton’s father, David Fullerton, on Oct. 18, and he told police that his daughter had told him about taking the children to Arizona. Police learned the following day that she and the children were in California, according to the affidavit.

    Police had made contact with her and the children in Redding, about 15 miles north of Anderson, but she and the children were not detained because there was no warrant.

    Rogers Police filed an arrest warrant Oct. 20, and the next day, police in Anderson, Calif., spotted her and six of her children in a Dodge pickup with Arkansas plates, according to a statement from the Anderson Police Department.

    Two of her other children were located at a nearby home in Cottonwood, according to the statement, and they were taken into custody by Shasta County Children and Family Services.

    Fullerton was booked at Shasta County Jail and is being held without bail, according to jail records. She is expected to appear in court Thursday.

    David Fullerton, said during a brief call with a reporter that his daughter had made a “mistake” and is “innocent.”

    “My daughter stands a chance, you know,” he said. “She made a mistake. She went across the line taking her babies but she didn’t know she wasn’t supposed to.”

    Court records indicate that Fullerton was on probation at the time of her arrest in Anderson. Records also show that she had been involved in at least two instances of domestic violence, twice violating court orders to stay away from the victim. In one incident, she was accused of punching the father of one of her children in the face.

    Fullerton pleaded guilty to domestic violence on July 12, 2022 in Arkansas, after she “hit the father of her child in the face, causing physical injury” in June 2021.

    The victim is only identified in the court documents as a 40-year-old Hispanic male.

    In a court record dated Aug. 9, 2021, Fullerton indicated she had seven children at the time, ages 15, 14, 11, 7, 3, 4, and 5 months.

    She also pleaded guilty to another case of domestic battery for a Feb. 5, 2020, incident in which she “punched her boyfriend in the head multiple times and scratched his face, causing redness and bleeding on his face,” according to court records.

    Fullerton pleaded guilty to both incidents, and was sentenced to two years of probation, court records show. The terms of her probation, however, required that she not drink alcohol, not break the law and not leave the state of Arkansas without the approval of her probation officer.

    The agreement stipulated that if she violated the terms of her probation, she could face a sentence of 12 years in jail.

    On Wednesday, prosecutors requested her probation be rescinded and a $50,000 warrant was issued for her arrest.

    Prosecutors said the case is currently being reviewed and it was unclear what, if any, new charge might be filed.

    Theranos founder and former chief executive Elizabeth Holmes was sentenced to 135 months, or over 11 years, in prison, putting an endpoint on the unraveling of a onetime vigorously hyped Silicon Valley startup that collapsed under allegations of fraud.

    The sentence, handed down from U.S. District Judge Edward Davila, came after Holmes was convicted in January of defrauding investors in the blood-testing company, which purported to have technology that could identify diseases from a pinprick of blood from the tip of a finger.

    Prior to the sentencing, Holmes had sought more lenient treatment, while prosecutors aimed for more. Holmes had requested up to 18 months in prison, along with home confinement and community service, according to The Wall Street Journal. Prosecutors sought 15 years in prison, a three-year supervised release and restitution of $800 million, the Journal said.

    Holmes had until April 27 to surrender, and 14 days to appeal the conviction, according to the Journal. Her lawyers said they would seek permission to keep her out of prison on bail, pending appeal, the Journal said.

    Founded in 2003, Theranos’ value over the years ballooned to $9 billion. But the company’s pitch of simple-to-use blood-testing technology — which attracted the likes of the Walton and Murdoch families, along with former U.S. Secretary of State Henry Kissinger — began to fall apart in 2015, after reporting from the Wall Street Journal raised questions about the claims’ veracity.

    The Securities and Exchange Commission in 2018 charged Holmes and former president Ramesh “Sunny” Balwani with what the agency called “massive fraud,” leading Holmes to give up control of the company. Criminal charges, and the company’s dissolution, followed later that year.
