  • Former Peabody police officer decertified by POST Commission

    [ad_1]

PEABODY — A former police officer’s law enforcement certification has been permanently revoked following an investigation by the Massachusetts Peace Officer Standards and Training Commission.

The commission, in a decision dated Dec. 18, found that Peabody police officer Gerald Fitzgerald Jr. included false information in a police report that led to a woman being arrested and wrongly charged with serious crimes in November 2023. Fitzgerald resigned from the department about a year later.

  • Gov. Jared Polis stops releasing prisoners who’ve spent decades behind bars for youthful crime

    [ad_1]

Gov. Jared Polis unilaterally stalled a specialized prison program aimed at rehabilitating and releasing people who have served decades behind bars for crimes they committed as juveniles and young adults, The Denver Post found.

Polis has not approved any of the program’s graduates for early release since 2023 — an about-face from the prior three years, during which the governor approved releases for all 17 such prisoners, according to records kept by the Colorado Department of Corrections.

The governor’s inaction has created a backlog of 11 prisoners who have completed the three-year program and have gone before the Colorado State Parole Board but are nevertheless still incarcerated, waiting for Polis to sign off on their freedom.

“The uncertainty of the situation is one of the scariest things I have ever gone through, because it pertains to the emotion of hope,” said prisoner Rory Atkins, 55, who was sentenced to life in prison with the possibility of parole for a murder he committed in 1988, when he was 18. “Many of us with long sentences in prison kind of accept that hope is painful. You learn to be fearful of having high hopes.”

Colorado lawmakers created the Juveniles and Young Adults Convicted as Adults Program, or JYACAP, in 2016 after the U.S. Supreme Court found that children are constitutionally different from adults and should not be automatically sentenced to life in prison without the possibility of parole. Lawmakers that year also changed Colorado law to prohibit such punishment.

Initially limited to juveniles, the program was expanded in 2021 to include prisoners who committed a crime when they were 20 or younger and who have served at least 20 years of their sentence. The prisoners must also meet a variety of other conditions to enter the three-year program, which focuses on building life skills and preparing for life outside of prison.

After prisoners finish the program, the governor — after receiving a recommendation from the parole board — must give the final approval for them to be released on early parole.

“For whatever reason, there was this dollop of mercy that was required (in the law),” said Ann Roan, a retired attorney who represented a program participant. “And for years it has worked well. … So to have the brakes put on it so suddenly, with no explanation whatsoever, has really upended everyone’s justified expectations.”

Shelby Wieman, a spokeswoman for Polis, said in a statement that the prisoners’ applications are still under review, that the governor “takes these decisions very seriously” and that the serious nature of prisoners’ crimes requires “careful deliberation.”

“The governor’s office has also previously expressed discomfort with the governor’s role in the process, and proposed legislative changes to this program in the past, which the legislature declined to address,” Wieman said, apparently referring to a failed 2024 bill that would have cut the governor out of the process and shifted full authority for early releases to the parole board.

“We look forward to continuing to explore potential improvements with legislators and stakeholders,” Wieman said.

She did not answer questions about what changed from the program’s first few years, when Polis routinely approved graduates’ releases.

‘Like we are being just dropped’

The governor’s inaction comes as he considers whether to commute the sentence for Tina Peters, the Mesa County clerk serving a nine-year prison sentence for crimes related to unauthorized access to state voting machines, and as he did not issue end-of-year pardons and sentence commutations for the first time in his tenure.

The state’s prisons are also nearly at capacity and are projected to run out of beds in the coming months.

“We feel like we are being just dropped,” said Rose Martinez, who is waiting for the release of her cousin, Daniel Reyes, 56. He is serving a life sentence with the possibility of parole for a 1987 homicide he committed during a robbery when he was 18.

Martinez has, over the last decade, watched her cousin yearn for release as his 2027 parole eligibility date has drawn closer.

“I’ll never forget the day he told me, ‘I can’t wait until I can be outside of these walls and I can actually lean up against a tree,’” she said. “That was probably five years ago.”

Reyes has been waiting for the governor’s sign-off since April, he said. Atkins’ wait began in July, when the parole board recommended his release, he said. Others in the program, like Raymond Gone, who killed a Denver police officer in 1995 when he was 16, have been waiting on the governor for more than a year, he said.

“What would I say to the critics who say the crime I was convicted of was so serious that I should finish my entire sentence? Honestly, I would agree with them, if all I knew was that I was convicted of such a horrible crime,” said Gone, now 47. “…I know I am responsible, I am the cause, for an unfathomable amount of trauma in so many people’s lives. There isn’t any amount of time I could spend in this place to make up for what I did.

“But the opportunity I have been given through JYACAP was only made available to me because of a Supreme Court ruling… someone way above me decided that my life was worth saving and should be given a second chance.”

Since 2017, 112 prisoners have applied to participate in the JYACAP program; 44 were accepted, according to the Department of Corrections. Prisoners were denied for poor behavior in prison, the nature of the crimes they committed, and for not meeting the program’s basic eligibility requirements.

Last year, 40-year-old Raul Gomez-Garcia, who killed a Denver police officer in 2005 when he was 19, was denied entry to the program after his application stirred outrage within the slain officer’s family and the police department.

None of the 17 people released after completing the program have had their parole revoked, said Alondra Gonzalez, a spokeswoman for the Department of Corrections. One participant had “subsequent involvement with the criminal justice system,” she said, but it did not prompt parole revocation. She did not answer follow-up questions about that participant.

“Nobody reoffends, because they’ve grown up,” said Roan, who previously represented Gone. “…Every one of us at some point has been 16, and a lot of us who have children have watched what it is to be 16 from that perspective, and I don’t think anyone would say that is who you are for the rest of your life.”

‘A program that he signed into law’

Phillip “Mike” Montoya went into the JYACAP program after he’d spent 26 years behind bars. He was convicted of murder and sentenced to life in prison after he participated in a 1993 gang shooting as a 16-year-old, although he did not actually fire the fatal shot.

He found the program to be too basic at times, with tedious instruction on very basic tasks like how to brush your teeth or how to use a spatula. The curriculum wasn’t tailored to each individual, he noted.

“If you go inside the prison at 16 years old and maybe you never done anything in your life prior, like cook for yourself, do your own laundry, go to a grocery store and buy your own food, then maybe you are going to need a lot more assistance,” he said. “But for someone like me, I pretty much had to raise myself. I had to raise my brother and sisters. So going into prison, even though I went in at such a young age, I had a lot of knowledge of the world.”

Still, he is quick to praise the program’s pathway to release and the second chance it gives people who have been imprisoned since they were teenagers. Montoya has been working as a barber since he got out in August 2023, about three years before his parole eligibility date. He ultimately served 30 years and two days.

He’s tried to advocate for the program’s other participants, he said, seeking out meetings with officials and stakeholders.

“The response has always been the same, that (Polis) doesn’t want to deal with it for political reasons,” he said. “…We’re talking about a program that he signed into law that he doesn’t believe in now.”

  • Man arrested after hit-and-run crash that killed woman crossing road near bus stop in Aurora

    [ad_1]

Aurora Police traffic investigators announced they have arrested a suspect after a woman was killed early Friday while trying to cross the road near a bus stop in a hit-and-run crash that forced the closure of Havana Street.

Police arrested Marcos Ortega-Lopez, 31, on suspicion of leaving the scene of a fatal crash, a felony, according to an agency posting on social media Friday afternoon.

But police haven’t located the vehicle involved — a 2007 blue Toyota Corolla (license plate CYXB39) with front-end damage — and appealed to the public for help via Aurora911, 303-627-3100 or @CrimeStoppersCO (720-913-STOP).

The crash occurred at about 5:15 a.m. near the intersection of Havana and East 4th Way. The woman was pronounced dead at the scene, Aurora Police Department spokesman Matt Longshore said.

“She was crossing the street, over Havana. It was a hit and run,” he said.

The police at first weren’t certain about the vehicle involved because of conflicting reports.

  • In Context: Mayor Jacob Frey’s comments about police and ICE

    [ad_1]

Minneapolis Mayor Jacob Frey made national headlines when he used an expletive to demand Immigration and Customs Enforcement leave the city after an ICE agent fatally shot a resident.

But he didn’t utter new statements saying he wants city police to “fight ICE.” Some social media posts mischaracterized comments Frey made during a Jan. 14 press conference.

In an X post that clipped 55 seconds of a 15-minute press conference, conservative influencer Mario Nawfal focused on six of Frey’s words.

“‘Fight ICE agents on the street’ is an insane thing to say out loud as a mayor,” Nawfal’s Jan. 15 post said before referencing Police Chief Brian O’Hara, who stood near Frey as he spoke.

“Watch the chief,” Nawfal’s post said. “You can literally see him dissociate in real time. The 1000 yard stare of someone calculating his pension and whether it’s worth it.”

Earlier that same day, President Donald Trump had threatened to use the Insurrection Act in the wake of protests, lawsuits and statements by Frey and other Minnesota politicians challenging ICE’s tactics.

Frey and O’Hara addressed the media Jan. 14 to share details about an ICE-involved shooting in north Minneapolis that evening, a week after another ICE agent fatally shot Renee Good.

But Frey’s full comments make it clear he was not calling for police to fight ICE. He was describing Minneapolis residents’ pleas for local officials to rebuff ICE and explaining why such a “fight” is not possible. Frey called for deescalation of violence and peace amid anti-ICE protests.

Here’s what he said. (The sentences in bold were among those social media posts referenced as well as moments when he called for peace.):

“What I can tell you for certain is that this is not sustainable. This is an impossible situation that our city is presently being put in and at the same time, we are trying to find a way forward, to keep people safe, to protect our neighbors, to maintain order. And we’re in a position right now where we have residents that are asking the very limited number of police officers that we have, to fight ICE agents on the street, to stand by their neighbors. We cannot be at a place right now in America where we have two governmental entities that are literally fighting one another.

“We cannot be at a place right now in America where we have two governmental entities that are literally fighting one another. Why are we put in this position? We’re put in this position because we have approximately 600 police officers in Minneapolis, far fewer that are able to work at any given time. And there are approximately 3,000 ICE agents in the area. Three thousand. The 600 police officers that we have are charged on any given day with investigating crime, stopping homicides from taking place, preventing carjackings. That’s the work of a police officer in a city. Meanwhile, we have ICE agents throughout our city and throughout our state who along with border control are creating chaos. This is not the path that we should be on right now in America.

“Thankfully there’s another path, and I want to talk to everybody who’s out there, even people who aren’t living in Minneapolis right now. Maybe you just put your kids to bed, maybe you’re cleaning up the dishes. I’m sure you love your family, there’s no doubt in my mind that you love your town. Imagine if that city or that town was suddenly invaded by thousands of federal agents that do not share the values that you hold dear. Imagine if your daily routines were disrupted. The local cafe that you eat at was shut down because they’re scared that their own family might get torn apart. Imagine if schools shut down and suddenly parents got to figure out what to do for daycare. This is not creating safety. It’s certainly not creating safety when a huge percentage of the shootings that have taken place so far this year in Minneapolis have been by ICE. So let’s be very clear. I have seen conduct from ICE that is disgusting and is intolerable. If it were your city, it would be unacceptable there too. And for anyone that is taking the bait tonight, stop, that is not helpful. Go home, we cannot counter Donald Trump’s chaos with our own brand of chaos.”

He also said he applauded peaceful protests, but said protesters who do not remain peaceful are “not helping the undocumented immigrants in our city.”

Minnesota has an estimated 130,000 unauthorized immigrants, according to 2023 data analyzed by the Pew Research Center; about 2% of the state population.

Frey has not called the Minneapolis police to fight ICE in any of his other recent public statements. Frey’s spokesperson Ally Peters told PolitiFact that Frey has consistently called for peace.

Minnesota, Minneapolis and St. Paul filed a lawsuit against the Trump administration Jan. 12, calling the surge of federal law enforcement into the state “unlawful violent conduct” and “excessive force.”

The lawsuit seeks a court order to halt the immigration crackdown. So far no temporary measures have been ordered, and the lawsuit is pending.

  • Two Portland Police Officers Injured In Hit-and-Run Crash In Southeast Portland – KXL

    [ad_1]

Two Portland police officers were treated for minor injuries early Tuesday after their patrol vehicle was struck by another car that fled the scene in Southeast Portland, authorities said.

The crash occurred at about 2:40 a.m. on Jan. 13, 2026, near Southeast 148th Avenue and Southeast Stark Street. Officers assigned to the Portland Police Bureau’s East Precinct were responding to a call with lights and sirens activated when another vehicle collided with their marked patrol car.

The impact caused significant damage to the passenger side of the police vehicle and deployed all airbags, police said. One officer was trapped inside the vehicle and could not exit until crews from Portland Fire & Rescue arrived and forced open the passenger-side door.

Both officers were taken to a local hospital with minor injuries and were later released.

Police said the other vehicle involved in the crash fled the scene. Investigators are searching for a dark-colored Chevrolet Suburban believed to have front-end damage, including damage to the front bumper.

“I am incredibly thankful that both officers are okay and were able to go home,” Portland Police Chief Bob Day said in a statement. “This could have been much worse, and we’re grateful for the quick response from our partner agencies.”

Anyone with information about the crash is asked to contact the Portland Police Bureau at [email protected] and reference case number 26-11604.

  • Ex-Navy SEAL planned to fire explosives at police at San Diego ‘No Kings’ rally

    [ad_1]

A former Navy SEAL with neo-Nazi beliefs faces up to 10 years in prison after he was convicted of transporting fireworks across state lines with the intent to injure law enforcement at a “No Kings” protest in San Diego, authorities said.

FBI agents found messages on Gregory Vandenberg’s phone indicating he was upset with President Trump because he believed the U.S. government is controlled by Israel and the Jewish people, according to the Department of Justice.

Vandenberg, 49, was planning on traveling from El Paso to San Diego to unleash harmful fireworks at a June 14 protest, prosecutors said.

Inside his car agents found T-shirts with a neo-Nazi symbol printed on them, a flag for the militant group the Caucasian Front, an Al Qaeda flag and a Latin message saying “Judea must be destroyed,” among other paraphernalia displaying anti-Israel and extremist beliefs, prosecutors said.

FBI agents said they found clothing in Gregory Vandenberg’s vehicle with anti-Israel slogans and neo-Nazi symbols.

(Office of the United States Attorney for the District of New Mexico)

On June 12, Vandenberg stopped at a travel center near Lordsburg, N.M., and purchased six large mortar fireworks as well as 72 M-150 firecrackers, which are designed to sound like gunfire. He repeatedly expressed his desire to use the fireworks to harm law enforcement at upcoming protests in California and urged the store clerk to join him, prosecutors said.

Vandenberg, who had no stable employment and lived in his car, told the clerk he had significant knowledge of explosives and prior special operations forces experience. He said he was not interested in the color or display of the fireworks, only in their explosive impact and ability to harm others. He even talked about the possibility of increasing their explosive impact by taping fireworks together.

He wore a T-shirt with the word “Amalek” on the front, which he said he designed specifically to mean “destroyer of Jews.” In the Torah, Amalek refers to descendants of Esau who are known as the Israelites’ sworn enemy. His home screen on his phone displayed a picture of the Taliban flag, prosecutors said.

A hat with the calligraphy of the Al Qaeda flag was among evidence.

A hat with the calligraphy of the Al Qaeda flag was among evidence.

He declined to provide his ID and then became paranoid, asking whether the store intended to track him and falsely saying that he was not from America, authorities said. Employees, shaken by the encounter, wrote down his license plate and contacted the police.

Federal agents tracked Vandenberg to Tucson, Ariz., where he was arrested on June 13 while sleeping in his car at the Davis-Monthan Air Force Base. He told agents he was traveling for work and visiting friends in Phoenix, despite being unemployed, prosecutors said.

After a five-day jury trial and around three hours of deliberation, a jury convicted him of transportation of explosives with intent to kill, injure or intimidate and attempted transportation of prohibited fireworks into California. He remains in custody awaiting sentencing.

Acting U.S. Atty. Ryan Ellison said in a statement that the verdict sends a message that attempts to use violence to express one’s political beliefs will be met with federal consequences.

“People in this country are free to hold their own beliefs and to express them peacefully,” Ellison said. “What they are not free to do is use explosives to threaten or terrorize others. Vandenberg intended to turn explosives into a tool of intimidation.”

  • Bystander injured as shots fired at Denver officers late Saturday

    [ad_1]

DENVER — At least one person was injured after shots were fired at Denver police officers Wednesday in the 1300 block of North Logan Street, police said.

The bystander suffered a gunshot wound to the leg. No officers were struck or injured.

The initial indication late Saturday night was that the situation unfolded after someone threw a rock at a patrol car during a traffic stop, according to police. Shots were then fired at officers, who did not return fire, according to the late-night update from DPD.

“A subject from the vehicle stop was the person grazed by the gunfire and transported to the hospital,” police said.

Police said the person who threw the rock was taken into custody.

The shooting prompted a large police response, a shelter-in-place order and extensive road closures in the area. A police helicopter assisted with the investigation.

Denver7’s Maggie Bryan spoke to a man who lives nearby, who described the chaotic scene.

“I went outside and immediately saw over a dozen police officers all with their weapons drawn on a certain apartment complex across the street,” Cody Westfall said. “I was approached by a police officer and told to go back inside because there were shots had been fired in my direction.”

Police have not said whether the shooting was targeted, but did say there was no indication the shooting was related to a demonstration earlier in the evening.

It was not clear just before midnight if the person who threw the rock was the same person who fired shots at officers, and police were still working to determine if other suspects were involved, the department told Denver7.

  • Report shows 80-year low in law enforcement deaths – WTOP News

Fewer names will need to be engraved this year into Northwest D.C.’s National Law Enforcement Officers Memorial.

The number of law enforcement professionals nationwide who died in 2025 is the lowest in 80 years, according to Bill Alexander, CEO of the National Law Enforcement Officers Memorial Fund.

“One death is too many, but 111 men and women died in the line of duty for calendar year 2025,” Alexander said. “The report is certainly encouraging, by virtue of the fact that it’s about a 25% drop from the deaths that we reported in 2024.”

The last time annual officer deaths were at a comparable level was in 1943, when 94 officers were killed in the line of duty.

Firearms-related deaths claimed the lives of 44 officers in 2025, a decrease of 15% from 2024: “It means some opposing party had a firearm and was using it with the intent and purpose to kill a police officer,” Alexander said. “There’s another word for that — murder.”

Alexander said improvements in technology is helping “the hundreds of men and women in uniform who are shot every single year.”

Bulletproof vests have “gotten better and lighter and more malleable, which leads to circumstances where officers are more likely to wear it because it is thinner and lighter, and has a greater stopping force.”

In addition, Alexander said more officers are receiving medical training and equipment.

“When an officer is shot, more likely than not the first person on the scene are going to be fellow officers, and they’re, in many cases, providing the first-tier first response,” Alexander said. “And I’m convinced that’s helping to save lives on that front.”
