    Microsoft, CrowdStrike IT outage hits global supply chain, with air freight facing days or weeks to recover

    The CrowdStrike software bug that crashed Microsoft operating systems and caused the largest IT outage in history caused disruptions at U.S. and global ports, with highly complex air freight systems suffering the heaviest hit, according to logistics experts, as global airlines grounded flights.

    “Planes and cargo are not where they are supposed to be and it will take days or even weeks to fully resolve,” Niall van de Wouw, chief air freight officer at supply chain consulting firm Xeneta, said in a statement shared with CNBC. “This is a reminder of how vulnerable our ocean and air supply chains are to IT failure.” 

    Thousands of flights were grounded or delayed at the world’s largest air freight hubs in Europe, Asia and North America.

    The new issue for the global supply chain comes amid a rise in global demand, with shipments up 13% year-over-year in June. Air freight supply has increased, but only by 3% year-on-year, already causing higher costs for shippers due to the limited capacity, according to Xeneta. “Shippers already had concerns about air freight capacity due to huge increases in demand in 2024, driven largely by the extraordinary growth in e-commerce goods being exported from China to Europe and the U.S.,” van de Wouw said. “Available capacity in the market is already limited so airlines are going to struggle to move cargo tomorrow that should have been moved today.

    Pete Buttigieg, U.S. Secretary of Transportation, told CNBC on Friday morning that what the government is watching for over the course of the day, as the issue has been identified, is “the kind of ripple or cascade effects as they get everything back in their networks back to normal.”

    “These systems, these flights, they run so tightly, so back to back that even after a root cause has been addressed you can still feel those impacts throughout the day,” Buttigieg said.

    He said the FAA’s operational systems, like air traffic control or most systems within the U.S. Department of Transportation, as well as major urban transit systems, such as New York City’s MTA, were operating though there could be “spot” issues throughout the day. But “as far as the airlines themselves we are going to definitely be expecting more there,” he said.

    FedEx said in a statement that it has activated contingency plans, but added that “potential delays are possible for package deliveries” expected Friday.

    UPS said in a statement that computer systems in the U.S. and Europe were affected, but its airline continues to operate effectively, and drivers are on the roads delivering for customers. “We are continuing to work to resolve all issues as quickly as possible; there may be some service delays,” UPS stated.

    Ports, freight rails, report some issues, but normal operations

    Most rails and ports were faring better after some early morning disruptions.

    Only one major U.S. freight railroad reported issues related to the IT outage, with Union Pacific confirming in an email to CNBC that it had varying levels of impact across its network.

    “Our backup protocols enable us to communicate with our teams and dispatchers. We are doing everything possible to keep freight moving, but there have been some processing delays in customer shipments as we address targeted areas impacted on our network. We will continue to keep our stakeholders updated as we address the outage over the next 24 hours,” Union Pacific said in the emailed statement.

    Other major freight operators, including CSX, Norfolk Southern and BNSF, a subsidiary of Berkshire Hathaway said their operations are not currently affected.

    Buttigieg said that at the ports, small issues can turn into a big issue, noting that even with ships and cranes operational, gates were affected, which meant the trucks couldn’t come in or out, which led to delays at certain ports, but they are “up and running and open for business today,” he added.

    The Port of Houston, the fifth-largest port in the U.S., said it experienced “major system outages” overnight, but said that all of its systems are now up and running with “minimal delay to operations.”

    The Port of Los Angeles, the nation’s largest port, confirmed to CNBC that one of its terminals, APM Terminals, was down temporarily, but came back up in the early morning. In an email to clients, APM, a subsidiary of Maersk, notified trucking clients that the port was “able to recover rather quickly,” and it restarted operations around 2 a.m. Any drivers not able to complete their pickups were told to contact the company’s import group so they could secure a new appointment to have a demurrage waiver for those containers.

    Mario Cordero, executive director of the Port of Long Beach, said there were minimal impacts to some of its terminals, but systems are up or in the process of being restored.

    The Port of New York and New Jersey reported a delay in the opening of two terminals, but within a few hours, the terminals were back up and running.

    “The Port Authority has been working closely with impacted terminal operators since the overnight hours, assisting in their recovery while also communicating updates through a multitude of channels to the port’s vast community of stakeholders,” said Bethann Rooney, port director at the Port Authority of New York and New Jersey. She said the port was able to initiate “a quick and efficient response to get cargo moving again.”

    All marine terminals were open by 8 a.m. The Port Authority agency was not impacted by the outage.

    Not all ports use systems that incorporate CrowdStrike software, with the Port of Savannah and the Port of Virginia both reporting “normal operations.”

    Emily Stausbøll, Xeneta senior shipping analyst, told CNBC that the IT outage has the potential to cause significant disruption at ports if ships are prevented from offloading and loading containers, and that can cascade through the supply chain.

    “There are also knock-on impacts across inland supply chains if truck and rail services are unable to pick up and drop off cargo at the port,” Stausbøll said.

    She noted that In May, Charleston Port on the U.S. East Coast shut for two days due to a software failure, which resulted in a port congestion increase of 200%. “Port congestion has been a major problem during 2024. While it is now easing, there is no slack in the system and any disruption will push the needle back into the red,” she said.

    Maritime intelligence company Kpler told CNBC early indications showed the global IT outage affecting operations at global ports including Poland’s Gdansk, and Dover, Felixstowe and Liverpool in the U.K.

    Rotterdam, the largest port in Europe, informed customers on its website of possible disruptions, but In an email to CNBC, a port spokesman said critical port operations of the Harbour Master Division and nautical service providers remain operational. “However, some companies in the port, including a container terminal, are experiencing issues due to the disruption and have adjusted their processes. They are working on a solution.”

    Matt Wright, senior freight analyst at Kpler, said the outage could lead to some delays at the affected ports, but with Microsoft and Crowdstrike reporting a fix being implemented, resumption of normal operations later today would mean it is unlikely to cause any significant backlog.

    Members of the International Longshore and Warehouse Union (ILWU) of Canada voted to ratify the second tentative agreement with West Coast port ownership, meaning an end to the uncertainty and trade congestion that has gripped the supply chain for weeks since dock workers first decided to strike.

    Rob Ashton, president of the ILWU, said 74.66% of members voted in favor of accepting the terms of the tentative agreement.

    The ILWU Canada and the British Columbia Maritime Employers Association (BCMEA) announced a revised second tentative deal last Sunday, with the agreement brokered by the Canada Industrial Relations Board, after union members rejected an original deal proposal. The country’s industrial relations board directed the union to vote no later than Friday.

    The new deal includes increases in wages, benefits, and training, according to an overnight statement by the BCMEA. No additional specifics were given.

    The original deal proposal which was rejected increased the compounded wage over four years by 19.2%, according to disclosures from the BCMEA, as well as a signing bonus of $1.48 an hour per employee, which tallied to approximately $3,000 per full-time worker. There was also an 18.5% increase in the retirement payout.

    The union argued that worker salaries were unsustainable against rising inflation, but the BCMEA countered that over the past 13 years, longshore wages have risen by 40%, ahead of inflation at 30%. The union said that the use of contract labor for maintenance work was another sticking point in the deal.

    The BCMEA said the ratification would provide “certainty and stability for the future of Canada’s West Coast ports.”

    “The BCMEA recognizes and regrets the profound repercussions this labor disruption has had on the national economy, workers, businesses and ultimately, all Canadians that depend on an efficient and reliable supply chain. All supply chain stakeholders must collaborate now to ensure we do not see disruptions like this ever again.”

    But, after a week of traveling and meeting shipping clients, Paul Brashier, vice president of drayage at ITS Logistics, told CNBC the reliability and reputation of the Canadian ports have created lasting damage.

    “We are happy that the ILWU has finally come to terms and agreed to a new contract,” said Brashier. “Unfortunately, this lack of government intervention and direction has forced cargo owners and shippers in our network to make the decision and permanently move their imports back to the U.S. port of entry on the West Coast.”

    Over the course of the 14-day strike, ocean carriers either pulled up anchor to divert the Canadian ports to stay on schedule and unload at U.S. ports. Some U.S. shippers reconsigned the destination of their containers to the U.S during that time. Other ocean carriers eventually went back to the Canadian ports and waited to unload both Canadian and U.S. freight.

    Canadian Labor Minister Seamus O’Regan tweeted acknowledgment of the supply chain damage the strikes caused and is now calling on federal officials to review how the disruption of this magnitude unfolded so it can be avoided in the future.

    Supply chain delays will last months

    It will take at least two months for the railroads to clear out the pileup of containers as a result of the 14 days of striking by dock workers. At the height of the strike, $12 billion in freight was stranded on the water. Some of that trade was diverted on vessels that called on ports on the U.S. West Coast.

    The Railway Association of Canada originally estimated that it would take three to five days, for every day the strike lasted, for networks and supply chains to recover. When the first strike ended on its 13th day, delays for rail containers were estimated at 39 to 66 days. After an additional day of work stoppage in the on-again, off-again strike, the congestion tally moved up to a range of 42 to 70 days.

    “Delays appear to be bearing out toward the mid-to-upper end of that range,” a Railway Association of Canada spokesperson recently told CNBC via email.

    Changes to vessel routes impact the profitability of railroads, including Canadian Pacific Kansas City and Canadian National Railway, since fewer containers can be unloaded at U.S. ports. This decrease in containers also impacts trucking companies. On the flip side, the extra containers coming into U.S. ports will add to the profitability of U.S. trucking companies and railroads BNSF, a subsidiary of Berkshire Hathaway, and Union Pacific. Over the long term, if Canadian trade is rerouted to the East Coast as a result of West Coast labor strife, that would also benefit Norfolk Southern and CSX.

    In the first two weeks of the strike, the flow of railroad trade from Canada to the U.S. was cut by 82%. Train trade has slowly recovered, with a 6.2% decrease being tabulated for the week ending July 29.

    The supply chain issues have already hit the bottom lines of railroad companies. Canadian Pacific Kansas City railroad’s chief marketing officer John Brooks told analysts on the company’s conference call last week the labor unrest will negatively impact the railroad’s revenue by $80 million. Brooks said the company is working to claw back those losses over the third and fourth quarters.

    Canadian National Railway announced it was running additional trains to help expedite the clearing out of the container congestion.

    The timing of this strike occurred during the peak shipping season, when back-to-school and holiday items are arriving for retailers.

    Ohio’s govenor said Friday evening that he wants Norfolk Southern to pay East Palestine residents for the long-term impacts the February 3 toxic train derailment may have caused on the community.

    The rail operator should pay residents selling their house the difference of what their home value used to be in comparison to what it’s worth now, nearly three months since the accident, Gov. Mike DeWine told CNN’s Jake Tapper. Norfolk Southern should also set up a fund specifically for impacts on residents that may arise in the future, including medical issues, that could be connected to the derailment, he added.

    Since the accident, officials have said tests showed the air and municipal water were safe and allowed residents to return to their homes after a brief evacuation order. But those living in East Palestine have for months expressed concerns and frustration about both the economic impacts the crash had on their community and health problems, including rashes and nausea, they worry are linked to the derailment.

    Norfolk Southern has vowed to help East Palestine fully recover and has said it will remain in the community for “as long as it takes.”

    DeWine said Friday he has met with Norfolk Southern CEO Alan Shaw and discussed those issues recently.

    “One of the things that I said to him is, if people sell their house and they do not get what that house was worth before the train wreck, I think you owe them the difference,” DeWine said. “I fully expect them to pay for that.”

    CNN reported on Friday about East Palestine residents who were concerned with their home values, including one woman whose home is just about a mile away from the derailment site and proved to be a “nightmare” to sell in the past few weeks.

    When asked for comment on that report, Norfolk Southern directed CNN to a statement from mid-March: “We are committed to working with the community to provide tailored protection for home sellers if their property loses value due to the impact of the derailment.”

    While the company has said it will work with the community to address concerns about losses in home values, details on the issue have been slow to materialize.

    “Everything we’ve asked (Norfolk Southern) to pay for so far, they’ve paid for,” DeWine said Friday. “And we expect them to continue to do that.”

    The governor said he also told Shaw he expects to see a fund set up “fairly quickly” for residents affected by the derailment, including those who may have health problems connected to the accident in the future.

    “(Residents) need to be reassured,” DeWine said. “I think that’s another thing that we can do to help assure the people in the community that we’re going to do everything and that we’re not going away.”

    Officials are continuing to conduct air, water and soil testing and have worked to set up a full-time clinic in the community in the aftermath to the derailment to address health concerns and to improve “the quality of life in the community,” the governor said.

    Bloated warehouse inventories are an expensive pressure eating away at the bottom line of many companies, and for many, the excess supply and associated costs of storage won’t abate this year, according to a new CNBC Supply Chain Survey.

    Just over one-third (36%) said they expect inventories to return to normal in the second half of this year, with an equal percentage expecting the gluts to last into 2024 — 21% saying a return to normal can occur in the first half of the year, and another 15% expecting normal activity by the first half of 2024. But uncertainty about inventory management is significant, with almost one-quarter (23%) of supply chain managers saying they are not sure when gluts will be worked off.

    “We don’t expect significant decreases in inventory levels within our network in 2023,” said Paul Harris, vice president of operations for WarehouseQuote. “Several of our manufacturing clients are experiencing dead/bloated inventory challenges due to over-ordering in the container grid-lock from prior quarters. A majority have elected to keep the inventory on hand and are opposed to liquidating.

    A total of 90 logistics managers representing the American Apparel and Footwear Association, ITS Logistics, WarehouseQuote, and the Council of Supply Chain Management Professionals, or CSCMP, participated in the survey between March 3-21 to provide information on their current inventories and the biggest inflationary pressures they are facing, and often passing on to the consumer.

    What’s sitting in warehouses, and what companies are doing about it

    Logistics experts tell CNBC that 20% of their excess inventory sitting in warehouses is not seasonable in product nature. Slightly more than half of survey participants said they would keep the items in warehouses. But a little over one-quarter (27%) said they are selling on the secondary market because inventories impact a company’s bottom line through elevated storage prices.

    Harris told CNBC many clients with perishable goods are selling them on secondary markets to avoid destroying products. “However, if a secondary market is not an option, they are forced to destroy the product,” he said. “If it’s a consumable, they are donating the goods to take tax deductions.”

    Investors are worried about the earnings and margin trends and expect Wall Street to revise estimates lower. The supply chain pressures will be among the factors that weigh on quarterly numbers.

    “Inventory carrying costs continue to rise, driven by inflationary pressures and late shipments,” said Mark Baxa, CEO of CSCMP. “This means that with every day that passes, three things are happening … growing sales risk, margin pressure, and D&O [deteriorated and/or obsolete].”

    Almost half surveyed said the biggest inflationary pressures they are paying are warehouse costs, followed by the “other” category, which includes rent and labor.

    ITS Logistics told CNBC that many clients across industries have been using ocean containers, rail containers and 53-foot trailers for storage because distribution centers were full.

    “These charges will start materializing in Q2 or Q3 financial results,” said Paul Brashier, vice president of drayage and intermodal at ITS Logistics.

    The survey found 50% of respondents saying the average length of time they are using ocean containers for storage is over four months.

    “We are seeing similar trends in our data and ecosystem,” Brashier said.

    More inflation costs going to the consumer

    Traditionally, warehousing costs and the associated labor costs are passed on to the consumer, increasing or sustaining the price of a product. Nearly half (44%) of survey respondents said they are passing on at least half of their increased costs, if not more, to consumers.

    “It’s clear that supply chain challenges and all their associated costs continue to stir inflationary pressures,” said Stephen Lamar, president and CEO of the American Apparel and Footwear Association. “Given ongoing inventory concerns and the fragile nature of our logistics system, there are other pressures and uncertainty.”

    His group is calling for West Coast port labor negotiations to be quickly finalized and for the government to “aggressively remove other cost pressures,” a reference to Section 301 tariffs on Chinese imports, which he said continue to make supply chains more expensive.

    Manufacturing orders and the economic outlook

    Recent data on manufacturing has shown a deterioration in the economy, with the ISM Manufacturing index in contraction level based on March data released this week. The U.S. services sector slipped closer to contraction in March, according to the ISM Services Index, with sharp declines in new orders, exports and price.

    Looking at the health of manufacturing orders for the next three months, 40% of logistics managers surveyed said they are not cutting orders, while a little under one-fifth (18%) said they are cutting orders by 30%.

    Inventory levels and consumer consumption are two factors influencing manufacturing orders.

    These orders help gauge China GDP as it reopens from its strict Covid protocols, since the country relies on manufacturing and trade for its economic growth.

    FreightWaves SONAR intelligence shows a slight uptick in ocean freight orders and recovery from the massive drop ahead of Lunar New Year, but the longer trend line remains a decrease in ocean bookings.

    The inventory glut is affecting trucking logistics in multiple ways. Not only are trucks moving fewer containers from the ports, they are also moving less from the warehouses to the retail stores. Data from Motive, which tracks trucking visits to North American distribution facilities for the top five retailers by volume, shows a drop in truck visits from warehouses.

    “The decline in visits to retail warehouses indicates weakness in consumer demand, but surprisingly may also be a sign of recovery in the supply chain,” said Shoaib Makani, founder and CEO of Motive. “With lead times to replenish inventory reduced from 2021 and 2022 highs, retailers are burning off existing inventories with the confidence that they will be able to replenish quickly.”

    Even with orders increasing, the inventory headwinds are a source of concern for logistics experts.

    “This survey confirms that we remain in an era of serious supply chain cost-to-serve challenges,” Baxa said. “Warehousing costs are contributing to these challenges that shippers are facing today and on the road ahead.”

    The Justice Department and the Environmental Protection Agency have filed a complaint against Norfolk Southern Corp. for unlawful discharge of pollutants and hazardous substances in the Feb. 3 train derailment in East Palestine, Ohio.

    The complaint seeks penalties and injunctive relief for the unlawful discharge of pollutants, oil and hazardous substances under the Clean Water Act, according to statements released by the Justice Department and the EPA. The Justice Department and EPA are also seeking a declaratory judgment on liability for past and future costs under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).

    stock has fallen 16.8% since the derailment near the Ohio-Pennsylvania border. The stock is up 0.3% Friday.

    “When a Norfolk Southern train derailed last month in East Palestine, Ohio, it released toxins into the air, soil, and water, endangering the health and safety of people in surrounding communities,” Attorney General Merrick Garland said in a statement. “With this complaint, the Justice Department and the EPA are acting to pursue justice for the residents of East Palestine and ensure that Norfolk Southern carries the financial burden for the harm it has caused and continues to inflict on the community.” 

    In a separate statement, EPA Administrator Michael Regan said: “No community should have to go through what East Palestine residents have faced. With today’s action, we are once more delivering on our commitment to ensure Norfolk Southern cleans up the mess they made and pays for the damage they have inflicted as we work to ensure this community can feel safe at home again.”

    Norfolk Southern has created a website, nsmakingitright.com, to track its progress in cleaning up the site.

    “Our job right now is to make progress every day cleaning up the site, assisting residents whose lives were impacted by the derailment, and investing in the future of East Palestine and the surrounding areas,” a spokesperson for Norfolk Southern told MarketWatch. “We are working with urgency, at the direction of the U.S. EPA, and making daily progress. That remains our focus and we’ll keep working until we make it right.”

    More than 9.4 million gallons of affected water have been recovered and transported off-site for final disposal, according to Norfolk Southern, along with 12,904 tons of waste soil that has been removed for proper disposal.

    The company has also flushed 5,200 feet of affected waterways and sampled more than 275 private drinking water wells, according to nsmakingitright.com.

    The suit from the Justice Department and the EPA comes just two weeks after Ohio Attorney General Dave Yost filed a 58-count civil lawsuit against Norfolk Southern over the derailment in East Palestine.

    No one was killed or injured in the Ohio derailment, but the incident has been described as a “PR nightmare” for Norfolk Southern and the rail industry. The derailed cars included 11 tank cars carrying hazardous materials that subsequently ignited, damaging an additional 12 railcars, according to the National Transportation Safety Board, and setting off concerns about the impact on air and water quality and dangers to health in the region.

    Earlier this month, Norfolk Southern CEO Alan Shaw was grilled by senators when he provided testimony on the disaster before the Senate Committee on Environment and Public Works.

    While safety was the primary focus of the hearing, Shaw was also pressed on Norfolk Southern’s stock buybacks and the company’s use of precision scheduled railroading, which focuses on the movement of individual train cars rather than whole trains.

    In his testimony, Shaw vowed to do “everything it takes” for the community affected by the derailment.

    Rail safety was thrust into the spotlight again this week with the derailment of a BNSF train carrying ethanol and corn syrup in Minnesota early Thursday. 

    Everstream Analytics, a supply-chain analytics company, has been researching train derailments involving Class I rail carriers between 2018 and 2023. A Class I carrier is defined as any carrier earning annual revenue greater than $943.9 million, according to the U.S. government’s Surface Transportation Board. Data show that derailments across rail companies increased considerably in the U.S. between 2021 and 2022, according to Everstream Analytics.

    The US Justice Department filed a civil lawsuit against Norfolk Southern Thursday, alleging violations of the Clean Water Act (CWA) and seeking damages over the train derailment and subsequent environmental disaster in East Palestine, Ohio, in February.

    The Norfolk Southern Railway Company and parent company Norfolk Southern Corporation are both named in the suit, court records show. The DOJ filed the lawsuit on behalf of the Environmental Protection Agency.

    The DOJ says the lawsuit seeks “injunctive relief, cost recovery, and civil penalties” for violations of the CWA, including discharges of pollutants and hazardous materials into waters, and under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).

    Norfolk Southern says its focus is on making “progress every day cleaning up the site, assisting residents whose lives were impacted by the derailment, and investing in the future of East Palestine and the surrounding areas,” according to a statement sent to CNN from the company’s spokesperson, Connor Spielmaker, on Friday.

    “We are working with urgency, at the direction of the US EPA, and making daily progress,” the statement said. “That remains our focus and we’ll keep working until we make it right.”

    On February 3, a Norfolk Southern train derailed, igniting a dayslong inferno, spewing poisonous fumes into the air, killing thousands of fish and leaving residents to wonder if it was safe to live in East Palestine, Ohio.

    The fiery derailment prompted fears of a catastrophic explosion of vinyl chloride – a highly flammable chemical linked to an increased risk of cancer. After a mandatory evacuation order, crews released vinyl chloride into a trench and burned it off – averting an explosion but spawning new health concerns.

    Officials said tests showed that the air and municipal water were safe and allowed residents to return home, but some have reported a variety of new health problems including rashes, nausea, bloody noses and trouble breathing.

    While studying the possible health impacts from the train derailment, seven US government investigators also briefly fell ill in early March, the US Centers for Disease Control and Prevention confirmed to CNN on Thursday.

    “Symptoms resolved for most team members later the same afternoon, and everyone resumed work on survey data collection within 24 hours. Impacted team members have not reported ongoing health effects,” a CDC spokesperson said in a statement.

    The train operator Norfolk Southern must handle and pay for all necessary cleanup, according to the Environmental Protection Agency. The company has sent some hazardous waste out of state – fueling more questions about safety.

    The DOJ isn’t the only one filing a lawsuit against the railroad. The state of Ohio also filed a 58-count federal lawsuit against the rail company on March 14, saying Norfolk Southern violated numerous state, federal and Ohio common laws and violated the state’s CERCLA act.

    Norfolk Southern has set up a new web page that summarizes community impact efforts. Spielmaker said it “provides a 7-day look ahead and is updated daily and outlines Norfolk Southern’s continued environmental remediation efforts in concert with state and federal authorities.”

    “When a Norfolk Southern train derailed last month in East Palestine, Ohio, it released toxins into the air, soil, and water, endangering the health and safety of people in surrounding communities,” Attorney General Merrick B. Garland said in a statement. “With this complaint, the Justice Department and the EPA are acting to pursue justice for the residents of East Palestine and ensure that Norfolk Southern carries the financial burden for the harm it has caused and continues to inflict on the community.”

    The Justice Department, citing annual company reports, alleges in the suit Norfolk Southern both increased operating income and dropped operating costs over the past four years, including making “reductions in spending to repair, service, and maintain locomotives and freight cars, perform train inspections, and pay engine crews and train crews.” The suit also alleges that these measures are a “focus” of the compensation of the company’s executives.

    The lawsuit claims when the train derailed and cars carrying hazardous materials were breached, the dispersion and subsequent combustion of those materials released toxic chemicals into the “air, soil, groundwater, and waterways.”

    The DOJ says seven local waterways including the Ohio River were contaminated as a result.

    The Ohio Department of Natural Resources reported “thousands of aquatic animals were killed in the five-mile span of waterway from the Site” to the confluence of two creeks the DOJ described as contaminated, the lawsuit says.

    DOJ is asking for $64,618 per day, per violation of the CWA and $55,808 per day or $2,232 per barrel of oil or unit of hazardous substance, per violation of the CWA – but it was not immediately clear from the suit how many days the DOJ considered the violation to be applicable.

    They’re also seeking a declaration of liability against the company for response costs; a mandated increase in safety precautions by Norfolk Southern when transporting hazardous materials; and for the railroad to “remedy, mitigate, and offset” the environmental damage and public health issues that have arisen as a result of the derailment, court documents show.

    In early March, Norfolk Southern CEO Alan Shaw told a US Senate hearing that the company would “clean the site safely, thoroughly, and with urgency.”

    Jim Stewart was getting ready to sell his home in East Palestine, Ohio, and retire. Then came the derailment of a Norfolk Southern train on February 3, releasing toxic chemicals into the air and nearby water, and he fears crashing the value of his home.

    He and his wife hoped to put their three-bedroom home on the market this spring, as prices were still high and inventory was low. Alternatively, they talked about his son’s family buying a house that was on the market down the street from Stewart.

    But even though state officials are saying the water is safe to drink, convincing potential homebuyers otherwise is an uphill battle.

    “Since the derailment, I lost all those options,” he said. “Who is going to buy contaminated land? The older people are willing to stay and live it out. The younger bunch, they are smarter. They’re thinking of their families. I wouldn’t want my grandchildren here. We don’t know if the ground is going to be good enough to grow grass. There are too many unknowns.”

    Stewart, 65, recently voiced his fury and sadness about what he lost to Norfolk Southern CEO Alan Shaw on a February 22 Town Hall about the derailment on CNN.

    “You burned me,” he told Shaw. “We were going to sell our house. Our value went phoom,” pointing his hands down.

    Shaw was asked point blank by another resident if Norfolk Southern was ready to buy Stewart’s house, he replied only, “we’re going to do what’s right for this community.” That wasn’t satisfactory for Stewart or many of the other participants at the Town Hall.

    “I lost everything now,” Stewart says he told Shaw.

    Stewart works as a manager at a commercial baking company.

    “I worked hard. I’m still working,” he says he told Shaw.I’m in the 44th year at my job. I wanted to get out. Now I’m just stuck.”

    Stewart fears he lost a tremendous amount of the value of his home, which he bought in 2016 for $85,000.

    The property was worth about $135,000 a month ago, according to an estimate from Zillow. Lack of transactions since then make a current estimate difficult.

    “I’ll never get that. I’ll be lucky to get what I paid for it, if that,” he said of the estimate. In addition, Stewart believes it would cost a lot to do the repairs and tests to ensure the home is safe.

    “At whose expense? That’s the biggest issue right now,” said Stewart. “At whose expense are we going to do things to make sure it’s okay?”

    Stewart isn’t the only one that was angry with Shaw and Norfolk Southern for the railroad’s refusal to offer to compensate the community for the property value that has been destroyed by the derailment.

    At Thursday’s Senate hearing on the crash, Sen. Ed Markey, a Massachusetts Democrat, asked Shaw four different times to commit to compensating homeowners, only to hear Shaw repeatedly reply, “Senator, I’m committed to do what’s right.”

    Markey said that wasn’t an acceptable answer.

    “Will you commit to insuring that these families, these innocent families do no lose their life savings in their homes and small businesses? The right thing to do is to say, ‘Yes we will.’” Markey told Shaw. “These families want to know long term are they just going to be left behind. Once the cameras move on, once the national attention dies down, where will these families be? I think they’re going to be in the crosshairs of the accountants of Norfolk Southern saying ‘We’re not going to pay full compensation.’”

    Paying the homeowners and businesses wouldn’t necessarily be difficult for Norfolk Southern.

    With a population of about 5,000 people, there are roughly 2,600 residential properties in East Palestine according to Attom, a property data provider. The average value of a property there in January of this year, prior to the derailment, was $146,000, according to Attom.

    Taken together, the value of all residential real estate in the town adds up to about $380 million, including single family homes and multi-family properties.

    Those values are only a fraction of the money that Norfolk Southern earns. Last year it reported a record operating income of $4.8 billion, and a net income of $3.3 billion, up about 9% from a year earlier. It had $456 million in cash on hand on its books as of December 31.

    It’s been returning much of that profit to shareholders, repurchasing $3.1 billion in shares last year and spending $1.2 billion on dividends. And it announced a 9% increase in dividends just days before the accident.

    A year ago its board approved a $10 billion share repurchase plan, and it had the authority to buy $7.5 billion of that remaining on the plan as of December 31.

    Asked by Sen. Jeff Merkley, an Oregon Democrat, at Thursday’s hearing, “Will you pledge to no more stock buybacks until a raft of safety measures have been completed to reduce the risk of derailments and crashes in the future,” Shaw again dodged the question by answering only with, “I will commit to continuing to invest in safety.”

    And the company also invests a great deal of money in lobbying, spending $1.8 billion on lobbying in 2022, according to OpenSecrets.org, which tracks lobbying and political contributions expenditures.

    Those lobbying expenses also came under attack by senators at the hearing, especially since Shaw would not commit to supporting the bipartisan bill introduced in the Senate since the derailment to improve railroad safety. Asked if he would support or oppose the legislation, Shaw wouldn’t endorse all of the provisions of the bill, but he responded “we are committed to the legislative intent to make rail safer.”

    A big payout probably isn’t what many in East Palestine are looking for, said Jim Warren, manager and co-owner of Kelly Warren and Associates Real Estate Solutions, in Boardman, which is about 15 miles away from East Palestine. They just want a home that’s safe to live in and to be made whole on its value, he said.

    “The people around here don’t want a lot,” he said. “We don’t chase the flashy items like other places in the world. We want to grow up, raise our kids, make a living, and have a nice place to live, that’s all we want.”

    This area, like the rest of the country, saw the real estate market heat up over the past few years with multiple offers on homes and properties selling over the asking price. But, Warren said, unlike other parts of the country the market stays fairly steady in this part of Ohio.

    “Our area doesn’t move up as much and it doesn’t move down as much,” he said. “We don’t have the big swings.”

    Warren’s firm currently has two listings in the town.

    “That’s no more nor less than usual,” he said. There are only ever about ten properties on the market there, he said.

    But, he added, “if your property is contaminated, that is a concern for yourself and for any buyer.”

    As with any real estate purchase, an appraisal and tests for safety would need to be done for homes in East Palestine. But like Stewart, Warren said it is not yet clear who will pay for the additional tests on water and ground contamination for that peace of mind.

    “For all we know, the county might cover it, or the EPA or Ohio state government. That remains to be seen,” he said.

    Overall, Warren said, he expects homes to continue to be bought and sold in East Palestine.

    “We don’t foresee the market tanking, we foresee steady growth,” he said. “After all the hype is gone, we are still living here. We’re going to have to figure it out because this is our home.”

    A Norfolk Southern conductor was killed Tuesday after being struck by a dump truck at a facility in Ohio, prompting a National Transportation Safety Board investigation of the railway’s safety culture due to the “number and significance” of recent accidents.

    The conductor, identified as 46-year-old Louis Shuster, was fatally injured early Tuesday morning at the Cleveland-Cliffs Cleveland Works property, the railroad said in a news release. It is the third incident involving the railroad in the state in just over a month.

    Shuster was struck when a dump truck carrying limestone collided with the front left side of the first car of the train. He was outside the car when he was struck, a Cleveland police spokesperson told CNN.

    Norfolk Southern is working with Ohio Gov. Mike DeWine, the Cleveland Police Department and Cleveland-Cliffs representatives to learn more, it said.

    The National Transportation Safety Board said on Twitter that it had sent crews to the scene.

    The NTSB said in a statement later that its safety culture probe encompasses multiple incidents and three deaths since December 2021, including the toxic East Palestine derailment and the employee killed earlier Tuesday. It is already investigating a October 28 derailment in Sandusky, Ohio.

    “The NTSB is concerned that several organizational factors may be involved in the accidents, including safety culture,” the board said in a statement. “The NTSB will conduct an in-depth investigation into the safety practices and culture of the company. At the same time, the company should not wait to improve safety and the NTSB urges it to do so immediately.”

    Norfolk Southern’s CEO is scheduled to testify before a Senate committee Thursday.

    “Norfolk Southern has been in touch with the conductor’s family and will do all it can to support them and his colleagues. We are grieving the loss of a colleague today. Our hearts go out to his loved ones during this extremely difficult time,” the railroad said.

    Shuster was member of the Brotherhood of Locomotive Engineers and Trainmen (BLET) and employed as a Norfolk Southern conductor, according to the union.

    “Lou was a passionate and dedicated union brother,” said Pat Redmond, Local Chairman of BLET Division 607. “He was always there for his coworkers. He was very active in helping veterans who worked on the railroad and veterans all across our community.”

    Shuster, a resident of Broadview Heights, Ohio, was president of BLET Division 607 in Cleveland. Shuster has a 16-year-old son and cared for his elderly parents, and was an Army veteran, the union said.

    “This was a tragic situation and it’s a devastating loss for the Shuster family as well as the members of this union,” said BLET National President Eddie Hall. “All railroad accidents are avoidable. This collision underscores the need for significant improvements in rail safety for both workers and the public.”

    Cleveland-Cliffs is a flat-rolled steel company, according to its website, and its Cleveland Works facility sits on the Cuyahoga River in Cleveland.

    CNN has reached out to Cleveland-Cliffs, Cleveland police and the Ohio governor’s office for more information.

    The conductor’s death comes as Norfolk Southern is facing criticism for two recent derailments in Ohio, including one in East Palestine last month that resulted in the release and burning of a toxic chemical that left nearby residents complaining of headaches, coughing and rashes they believe are tied to the fiery crash.

    As the railroad works with the Environmental Protection Agency to remediate the site, it announced a new six-point safety plan Monday designed to help prevent similar derailments in the future.

    And in Springfield, about 200 miles southwest of East Palestine, another Norfolk Southern freight train derailed Saturday.

    The crash knocked out power and the area and resulted in a temporary shelter-in-place order for homes within 1,000 feet of the scene. Crews later determined nothing had spilled from the derailed cars and there was no environmental harm.

    Casualties, including injuries and deaths, involving railroad employees are not uncommon, according to data from the Federal Railroad Administration, which shows there were more than 13,500 incidents involving on-duty employees across the industry in 2022, including 1,060 involving Norfolk Southern employees.

    Forty-two rail employees died while on duty last year, the administration said. Five of those individuals were Norfolk Southern employees.

    As federal investigators visit the site of another Norfolk Southern train derailment in Ohio, the company vowed new safety measures in response to its toxic train wreck that ravaged the town of East Palestine.

    Norfolk Southern will revamp its hot bearing detector network as part of a new six-point safety plan, the company announced Monday.

    “Hot bearing” or “hot box” detectors use infrared sensors to record the temperatures of railroad bearings as trains pass by. If they sense an overheated bearing, the detectors trigger an alarm, which notifies the train crew they should stop and inspect the rail car for a potential failure.

    After the February 3 toxic derailment in East Palestine, investigators discovered hot bearing sensors detected a wheel bearing heating up miles before it eventually failed – but didn’t alert the train’s crew until it was too late, according to a February 23 preliminary report by the National Transportation Safety Board.

    Currently, the average distance between detectors on the Norfolk Southern network is 13.9 miles. On Monday, the company announced it would examine every area where the distance between detectors is greater than 15 miles and would develop a plan to deploy additional detectors where needed.

    Norfolk Southern said other new safety measures would include:

    • Working with manufacturers of “multi-scan” hot bearing detectors, which are able to “scan a greater cross-section of a railcar’s bearings and wheels” to accelerate development and testing.

    • Adding 13 “acoustic bearing” detectors that analyze the acoustic signature of vibration inside the axle and would be able to identify potential problems that a visual inspection could not. These detectors would be added to “high-traffic” routes in Norfolk Southern’s core network.

    • Collaborating with Georgia Tech to advance safety inspection technology using “machine vision and algorithms powered by artificial intelligence to identify defects and needed repairs.”

    • Accelerating the installation of new inspection technology, including the use of high-resolution cameras stationed in strategic locations on its Premier Corridor, which is the train line that connects the Northeast and the Midwest and runs through East Palestine.

    About 200 miles southwest of East Palestine, NTSB investigators arrived Monday in Springfield Ohio – where a Norfolk Southern freight train derailed Saturday.

    Investigators will be “looking at the condition of the track, the mechanical condition of the train, operations, the position of the cars in the train, and signal and train control among other things,” the NTSB said in a statement. “They will also be collecting event recorder data, on-board image recorders, and will conduct interviews with the crew and other witnesses.”

    Investigators with the agency are expected to release a preliminary report in two to three weeks.

    The 212-car freight train was heading south through Clark County en route to Birmingham, Alabama, when 28 of its cars derailed – downing large power lines, knocking out power and temporarily prompting shelter-in-place orders for homes within 1,000 feet.

    Crews later determined there were no spills from the derailed cars, and authorities said there was no environmental harm.

    “There was no release of any chemical or any hazardous material to the soil, to the air, to the water,” Ohio Environmental Protection Agency Director Anne Vogel said Sunday.

    The cause of the derailment remains under investigation, Norfolk Southern said.

    Four of the derailed tank cars had previously been carrying diesel exhaust fluid and an additive commonly used in wastewater treatment, but they were empty when they derailed, Norfolk Southern General Manager of Operations Kraig Barner said.

    “There’s always a small residual amount left in the tanks,” Smith told CNN. “The derailed tank cars are not hazardous.”

    Those empty tankers carried residual product in “very minor amounts” that “dried very quickly,” Springfield Fire Assistant Chief Matt Smith said. He said his team checked the crash site and confirmed nothing had spilled onto the ground.

    But one car was carrying PVC pellets that affected the soil at the crash site, Vogel said. She said that the EPA “will be onsite ensuring that as cars are removed by Norfolk Southern that the soil is not impacted under the ground.”

    After the derailment, authorities sought to assure the community in Clark County that their air, water and soil are safe.

    “Since there have been no releases, we’re looking at clean air, clean soil and clean water for our residents,” Clark County Health Commissioner Charles Patterson said. “Technicians will continue to be on site to ensure that there isn’t any contamination that has been missed.”

    While the two recent train derailments in Ohio have made national news, data from the Federal Railroad Administration Office of Safety Analysis shows there have been at least 1,000 derailments in the United States each year during the past decade.

    The process of removing soil from under the tracks at the East Palestine derailment site started Saturday, the federal Environmental Protection Agency said. The agency had ordered Norfolk Southern to remediate the site, including the excavation of potentially contaminated soil.

    The work could take up to two months, depending on weather conditions and other unforeseen delays, the agency said. The EPA said nearby residents might notice additional odors during that time.

    Some 1,900 feet of rail has been fully removed from the crash site, and about one half of the contaminated soil beneath the removed line has been excavated, Ohio Gov. Mike DeWine’s office said Monday.

    About 3.2 million gallons of liquid waste and about 2,000 tons of solid waste have been removed, DeWine’s office said, citing the state’s EPA.

    While the soil work is underway, Norfolk Southern has agreed to provide financial assistance to residents for various necessities, including temporary lodging, travel, food and clothing, the EPA said.

    Impacts from the East Palestine derailment were also felt in other nearby communities in Pennsylvania, where Norfolk Southern has made an “initial agreement” to pay millions for damages there, officials said Monday.

    The railroad will establish a $1 million community relief fund to support local businesses and residents impacted by the crash in Beaver and Lawrence counties, a news release from Gov. Josh Shapiro’s office said.

    Norfolk Southern also agreed to pay $5 million to reimburse Pennsylvania fire departments that have to replace damaged or contaminated equipment after responding to the derailment, the release said. The agreement also includes money to cover some operating and response costs for Pennsylvania’s environmental protection, health and emergency management departments.

    These payments would be separate from other “applicable legal obligations” that may be imposed, the release said.

    Norfolk Southern earned a record $3.3 billion in net income last year, more than 400 times greater than the $7.4 million that Shapiro said the company agreed to pay to Pennsylvania communities.

    The company spent $4.2 billion on share repurchases and dividends to shareholders and has plans to repurchase another $7.5 billion in shares going forward, or more than 1,000 times the initial amount it has promised to Pennsylvania.

    The East Palestine derailment fueled outcry among residents who have reported headaches, coughing and other ailments after the fiery crash.

    The train was hauling the dangerous chemical vinyl chloride and other chemicals that are feared to have leaked into the surrounding ecosystem.

    Some employees who responded to the East Palestine crash site were not given proper protective equipment and have experienced migraines and nausea, the American Rail System Federation – a union for railroad workers – said in a letter last week.

    Norfolk Southern said it had not received any reports of injury or illness from employees involved in the initial response.

    “Norfolk Southern was on-scene immediately after the derailment and coordinated our response with hazardous material professionals,” the railroad said in a statement.

    The company also said “required PPE was utilized, all in addition to air monitoring that was established within an hour.”

    Hours after a 28-car Norfolk Southern train derailed Saturday in Springfield, Ohio — the third incident for the freight railroad in just over a month, including the toxic disaster in East Palestine, Ohio — internal emails show railroad officials making broad safety adjustments for rail cars.

    An internal Norfolk Southern email sent Sunday and obtained by CNBC with a time stamp approximately 11 hours after the latest derailment indicated that Norfolk Southern was planning to reduce train length in an effort to prevent future incidents. Sources tell CNBC the email was given to Norfolk Southern yard managers, who are union workers in charge of stacking the trains.

    A Norfolk Southern spokesman told CNBC that guidance has since been updated and the train carrier is now mandating that any trains over 10,000 feet use distributed power, meaning the trains would be powered from several locations across the length of the train, not just from the front. Distributed locomotives are wirelessly controlled from the leading locomotive in both power and braking as needed to assist in the management of in-train forces.

    Norfolk Southern told CNBC other railroad carriers currently have this safety practice in place.

    “At Norfolk Southern, the safety of our crews and the communities we serve comes first,” Connor Spielmaker, spokesman for Norfolk Southern, wrote via email. “Part of enhancing safety is continuously evaluating how we operate our network, and we have been examining immediate ways to move that goal forward. Today, as an interim step, we are ensuring all trains longer than 10,000 feet are operated with distributive power. We will build on this interim change to drive final policies that are appropriate for each segment of our railroad.”

    Norfolk Southern told CNBC it is actively reviewing all safety protocols to make sure trains are operating appropriately across the network.

    Still, Jeremy Ferguson, president of SMART-Transportation Division, the country’s largest rail union, said his workers are being told the railroad will limit train length.

    “I have seen Norfolk Southern documents to yardmasters [Monday] morning from the field that is telling us trains no longer than 10,000 feet regardless of distributed power,” said Ferguson. “The train that derailed on Saturday already had distributed power, so their comment to CNBC does not make sense. I will say it is a good move by Norfolk Southern to take the right steps in reducing the train lengths, because the trains are too long.”

    Train lengths have been a contentious issue for railroads and labor unions in negotiations. Railroads currently run on what’s called precision scheduled railroading, or PSR, which has led to much longer trains — as long as three miles.

    Trains are stacked based on the destination, not weight distribution, with stacking of the first destination at the head of the train and in sequence until the last drop-off.

    Railroads have redesigned train length in an effort to use fewer people and to move more cars with fewer locomotives, reducing costs and generating higher profits. But railroad unions and customers have raised safety and service concerns.

    The derailment in Springfield marks the third derailment since the Feb. 3 East Palestine train disaster, in which hazardous materials spilled.

    On Feb. 16, a 135-car Norfolk Southern train traveling from Detroit to Peru, Indiana, derailed approximately 14 miles outside the yard in Romulus, Michigan. According to the investigative report for that incident, the tonnage profile shows heavy cars at the head of the train, in the middle and in the rear, with empty cars scattered throughout.

    The derailment is still under investigation, but according to one on-site investigation report, human error is likely to be a large factor: An “engineer panicked and applied heavy dynamic braking which resulted in an emergency brake application and derailment.”

    The National Transportation Safety Board announced it is sending investigators to the Springfield site.

    A Norfolk Southern freight train derailed in the Springfield, Ohio, area Saturday afternoon, prompting a shelter-in-place order for nearby residents – just one month after the company’s toxic train wreck on the other side of the state in East Palestine.

    No injuries were reported Saturday and there was no hazmat situation at the crash site in Clark County, an Ohio State Highway Patrol spokesperson told CNN. The derailment happened around 5 p.m. ET and the road was closed on State Route 41, the spokesperson added.

    Twenty cars of the 212-car Norfolk Southern train derailed while headed south in the Springfield area, Norfolk Southern spokesperson Connor Spielmaker told CNN.

    “No hazardous materials are involved and there have been no reported injuries,” Spielmaker said. “Our teams are enroute to the site to begin cleanup operations.”

    The company is working to find out what the train was transporting, Spielmaker added, confirming it was not a passenger train.

    The Clark County Emergency Management Agency asked residents Saturday who were within 1,000 feet of the train derailment “to shelter-in-place out of an abundance of caution.”

    “We ask that all residents in need of travel to Ohio 41 find alternate routes. Local and state officials are on scene, including the Springfield Fire Rescue Division and the Springfield Police Department,” the agency said in a Facebook update.

    Clark County officials also said they were aware of power outages in the area due to downed power lines.

    US Transportation Secretary Pete Buttigieg said he has been briefed on the derailment and is sending Federal Railroad Administration officials to the scene.

    “I have been briefed by FRA leadership and spoke with Gov. DeWine to offer our support after the derailment today in Clark County, Ohio. No hazardous material release has been reported, but we will continue to monitor closely and FRA personnel are en route,” Buttigieg said in a tweet on Saturday.

    The derailment comes as crews were still working to clear the toxic wreck of another Norfolk Southern train that derailed on February 3 while carrying hazardous materials more than 200 miles away in East Palestine, Ohio.

    The East Palestine derailment fueled outcry among residents who have complained of symptoms, including headaches and coughing after the fiery crash. The train was hauling dangerous chemical vinyl chloride – which was released and burned to prevent a potentially deadly explosion – and other chemicals that are feared to have leaked into the surrounding ecosystem.

    Norfolk Southern has promised to fully clean up the wreck and vowed to invest in East Palestine.

    The derailment has put rail safety under the spotlight and raised questions about regulations surrounding the transport of hazardous materials. Data from the Federal Railroad Administration Office of Safety Analysis shows there have been at least 1,000 derailments in the United States each year during the past decade.

    The nation’s major freight railroads have long desired to have only one crew member, a lone engineer, in the cab of their locomotives. And that desire hasn’t changed despite the derailment of a Norfolk Southern train on February 3 that released toxic chemicals into the air, water and soil of East Palestine, Ohio, that is still being cleaned up.

    But that accident very well may have ended the railroad’s chances of getting that one-person crew goal.

    The rail safety legislation, introduced in Congress Wednesday with bipartisan support, would include a prohibition on single-person crews. There is no such existing law or federal regulation requiring both an engineer and a conductor to be on a train. Instead, it is only labor deals with the Brotherhood of Locomotive Engineers and the transportation division of the Sheet Metal, Air, Rail, Transportation union (SMART-TD), which represents the conductors, that require at least one member of each union in the locomotive’s cab.

    The Association of American Railroads confirmed that its position in favor of one-person crews has not changed. It believes it will be more efficient, and just as safe, to have engineers responding to problems with trains by driving along tracks in trucks rather than riding in the cab of the locomotive.

    “The position on crew size has not changed. Railroads have been clear that they support fact-driven policies that address the cause of this accident and enhance safety,” said an AAR statement. “As we continue to review this bill, it is clear it includes many of the same wish list items AAR and others have clearly said would not prevent a similar accident in the future, such as the… arbitrary crew size rule. Railroads look forward to working with all stakeholders to meaningfully advance real solutions.”

    Union Pacific said the opposition to a two-person crew mandate does not mean the railroads don’t care about safety.

    “No data shows a two-person crew confined to a cab is safer, and train crew size should continue to be determined through collective bargaining,” a statement from UP. “Proposed legislation limits our ability to compete in a business landscape where technology is rapidly changing the transportation industry.”

    CSX also said it believes the decision on crew size should be decided in collective bargaining, not through legislation, but said it is not currently pursuing a change in crew size. Negotiations between the railroads and unions is not due to start again until 2024, and the railroads historically have negotiated deals that apply across the industry. The other two major freight railroads – Norfolk Southern and Burlington Northern Santa Fe – did not responded to questions about the legislation. But the AAR is the trade group that lobbies on their behalf.

    The AAR’s statement did not address the question as to whether that rule is now more likely to pass. But Jeremy Ferguson, president of SMART-TD, said this accident has completely changed the chances of getting the two-person crew requirement written into US law.

    “Absolutely,” he said when asked in an interview with CNN Business if he thinks the provision will now pass. “When an incident like this happens, it brings all the issues to light, how unsafe the rail industry truly is. I didn’t think we had any chance before this. The railroads and AAR do a very good job of lobbying in DC. So generally it’s difficult to get people to vote for something like this rule. But sometimes it takes a disaster to drive home the point. Any time you turn the TV on, there’s still an issue. It’s not going away.”

    The senators, both Democrat and Republican, sponsoring the rail safety bill say they’re hopeful there is now bipartisan support to change the law.

    “Rail lobbyists have fought for years to protect their profits at the expense of communities like East Palestine,” said Sen. Sherrod Brown, the Ohio Democrat. “These commonsense bipartisan safety measures will finally hold big railroad companies accountable, make our railroads and the towns along them safer, and prevent future tragedies, so no community has to suffer like East Palestine again.”

    “Through this legislation, Congress has a real opportunity to ensure that what happened in East Palestine will never happen again,” said Sen. J.D. Vance, the Ohio Republican who is a co-sponsor. “We owe every American the peace of mind that their community is protected from a catastrophe of this kind.”

    If the law is changed due to the East Palestine derailment, it won’t be the first disaster that changed rules and laws governing trains. In 2013, a runaway Canadian freight train carrying tanker cars of oil crashed in Lac-Mégantic, Quebec, causing a massive fire that killed 47 people and destroyed 40 buildings in the town. Canada responded by changing its law to require two person crews on trains carrying hazardous materials.

    But calls to change the law in the United States because of that accident fell on deaf ears.

    The fact that there were three employees on the train that derailed in East Palestine — an engineer, a conductor and a trainee — did not prevent this accident from happening.

    The National Transportation Safety Board’s initial finding on the disaster was that a fire originally started when a rail car carrying plastic pellets was heated by a hot axle.

    After the fire started, the train passed three trackside detectors meant to determine if there is a problem causing overheating. But the first two did not signal a problem, even as the fire raised the temperature more than 100 degrees. The detectors are designed not to alert the crew until there is a 200-degree rise in the temperature detected. Finally the third detector registered a rise in temperature of more than 250 degrees, triggering an alarm in the locomotive’s cab.

    The NTSB said the engineer responded immediately to the alarm by applying the brakes in an attempt to stop the train, but the wheel bearing on the car that was on fire failed before he could bring the train to a halt, causing the derailment.

    Ferguson said that while the crew could not prevent this derailment from happening, there are an uncounted number of times that they detect a problem and prevent a derailment. He said not having the conductor on the train would miss many of those problems and cause many more derailments.

    “When a detector goes off, you stop the train and the conductor can walk back and check if there is an overheating axle and make an immediate decision,” Ferguson said. An engineer is not allowed to get out of the locomotive, even if it’s stopped. Only the conductor can check to see if what the problems is that triggered an alarm.

    But if the conductor is driving around in a truck, rather than riding in the cab of the locomotive, it could be an hour or more before the conductor gets there, and the axle might have cooled down. At that point, the conductor might have to send the train back on its way, according to Ferguson, even though the original problem tripping the heat detector — a faulty axle or bearing — is still a problem that could quickly cause a derailment.

    “So having a guy wandering around in the truck may cause a derailment,” said Ferguson.

    Beyond the problems of this kind, having a second person in the cab can just offer greater attention to detail during long train rides.

    “You’ve got two sets of ears and two set of eyes. It always helps,” Ferguson said.

    And it also helps in case of a medical emergency. In January, a CSX engineer suffered a heart attack while bringing a freight train into Savannah, Georgia, according to the engineers’ union. The conductor was able to recognize he was in distress, give him an aspirin and to call ahead to have an ambulance waiting for him in the rail yard.

    The engineer needed emergency bypass surgery, but survived the heart attack.

    “This happens more often than people realize,” Ferguson said. “It’s not necessarily always a heart attack. But having two people up there always pays dividend for the crew members themselves.”

    CSX confirmed the incident with one of its engineer having a heart attack occurred in January.

    “We commend the heroic actions of all CSX employees who render aid during any medical emergency,” said CSX’s statement.

    The fact that the current labor contracts require two crew members is little comfort to the engineers and conductors unions.

    They point out that under the Railway Labor Act, they can have a contract that is opposed by some or all of the rail unions imposed upon them by Congress, as happened this past December. While this current contract did keep the provision for two-person crews in place, that’s not necessarily going to be the case in all future contracts, even if the unions continue to make the issue a priority.

    Congress generally enacts what is recommended by a panel appointed by the president to propose a deal that hopefully both labor and management can accept. But it might have one or two provisions which are deal breakers for the unions, such as allowing single-person crews.

    “Given the wrong president, we could lose this in a hurry,” said Ferguson.

    The Federal Railroad Administration is also considering a rule that would require two-person crews. But Ferguson said getting the requirement written into law would be better than a simple regulation. An FRA regulation could be easier to change in a new administration than it would be to get a change in the law.

    Angry residents repeatedly interrupted a railroad company official at a contentious town hall in East Palestine, Ohio, on Thursday, with questions and concerns regarding cleanup efforts at the site of a toxic train derailment nearly one month ago.

    “We’re going to do the right thing, we’re going to clean up the site,” said Norfolk Southern representative Darrell Wilson as shouts were raised from those in attendance. “We’re going to test until we get all the contamination gone.”

    “No, you’re not!” one voice cried out.

    Norfolk Southern, the operator of the train that derailed on the evening of February 3, has faced continued criticism from residents in the area, some of whom report illnesses they believe stem from the crash.

    After the derailment, the dangerous chemical vinyl chloride was released and burned to prevent a potentially deadly explosion, and other chemicals of concern that were being transported are feared to have leaked into the surrounding ecosystem in Ohio and Pennsylvania – with potentially damaging health consequences. Crews involved in the cleanup have also reported medical symptoms, according to a letter on behalf of workers’ unions.

    During Thursday’s town hall, officials with the Environmental Protection Agency said Norfolk Southern’s plans to remediate the site were under consideration that night, and Mark Durno, Regional Response Coordinator for the EPA, told CNN’s Brenda Goodman that teams were poised to approve it.

    That paved the way for the process to begin on Friday morning. The EPA has ordered the freight rail company to fully clean up the site of the wreck.

    Remediation started Friday a quarter mile from the derailment site on the south track, video from CNN’s Miguel Marquez shows.

    The process will involve removing one side of the tracks, digging out the contaminated soil, conducting sampling, and then replacing the tracks. The same would then be done on the other side of the tracks.

    While work is being done on the south track, trains will continue to run on the north track where there are still tank cars that can’t be removed until they’re inspected, Wilson said.

    “The sooner they pick it up, the sooner they can get it out of town,” EPA Region 5 Administrator Debra Shore said at the town hall. “This is going to be a complicated, big project.”

    Officials are hoping to begin the process on the north side around March 28, with the entire process finishing by the end of April, Wilson said.

    Approximately 2.1 million gallons of liquid waste and approximately 1,400 tons of solid waste have already been removed from the derailment site, Ohio Gov. Mike DeWine’s office announced in a news release Thursday, citing the state’s EPA. The wastewater and solid waste have been transported to sites in Ohio and elsewhere, including Michigan, Indiana and Texas, according to the release.

    “We’re very sorry for what happened. We feel horrible about it,” Wilson said – which spurred an uproar from the crowd.

    Last week, Ohio Lt. Gov. Jon Husted had suggested the company should temporarily or permanently relocate residents who feel unsafe.

    “I think that the railroad should consider buying property of people who may not feel safe or would want to relocate as a result of the spill,” he told CNN on February 23. “This is the railroad’s responsibility, and it’s up to the government officials at the federal, state and local levels to hold them accountable and do right by the citizens of East Palestine.”

    In response to a resident’s question at the town hall meeting, Wilson said there has not been any talk about relocating residents.

    “This will be an evolving conversation that’s going to go on for quite a while,” he said, adding the company will continue to collect data to inform its decisions.

    This week, Norfolk Southern CEO Alan Shaw sold $448,000 worth of the company’s stock and Shaw personally set up a $445,000 scholarship fund for seniors at East Palestine High School that an unspecified number of students will be able to use to attend college or vocational schools.

    Norfolk Southern did not respond to request for comments about the stock sale, and whether Shaw plans to reduce or donate more of his salary in the wake of the accident.

    In addition to the site cleanup, the EPA is requiring Norfolk Southern to test directly for the presence of dioxins – compounds considered to have significant toxicity and can cause disease. The testing will be conducted with oversight by the agency, according to a statement released Thursday.

    The EPA will direct immediate cleanup of the area if dioxins are found at a level that poses any unacceptable risk to human health or the environment, according to the statement. The EPA will also require Norfolk Southern to conduct a background study to compare any dioxin levels around East Palestine to dioxin levels in other areas not impacted by the train derailment.

    The agency noted dioxins may be found in the environment as a result of common processes such as burning wood or coal, and they break down slowly, so the source of dioxins found in an area may be uncertain.

    The effort comes in direct response to concerns the EPA heard from East Palestine residents, the statement said.

    “This action builds on EPA’s bipartisan efforts alongside our local, state, and federal partners to earn the trust of this community and ensure all residents have the reassurances they need to feel safe at home once again,” EPA Administrator Michael Regan said.

    As of February 28, the EPA had collected at least 115 samples in the potentially impacted area, which include samples of air, soils, surface water, and sediments, the statement said.

    To date, EPA’s monitoring for indicator chemicals has suggested a low probability for release of dioxin from this incident, according to the statement.

    The aftermath of the toxic train wreck in Ohio keeps spreading to more states as scientists say tests in East Palestine unusually high levels of some chemicals.

    Indiana Gov. Eric Holcomb is the latest out-of-state official to say he was stunned to learn hazardous waste from the Norfolk Southern train derailment and subsequent release of toxic chemicals was headed to his state.

    “After learning third-hand that materials may be transported to our state yesterday, I directed my environmental director to reach out” to the US Environmental Protection Agency, Holcomb said in a written statement Tuesday.

    “The materials should go to the nearest facilities, not moved from the far eastern side of Ohio to the far western side of Indiana,” Holcomb said. “I want to know exactly what precautions will be taken in the transport and disposition of the materials.”

    After surprise shipments of hazardous waste to Texas and Michigan, the EPA approved two sites in Ohio to handle safe disposal of the waste.

    Another two sites – Heritage Environmental Services’ hazardous waste landfill in Roachdale, Indiana, and Ross Incineration Services in Grafton, Ohio – will receive contaminated waste starting Tuesday, EPA Region 5 Administrator Debra Shore said Monday. She said Indiana officials and state partners were notified before the EPA approved “the shipment of any waste from the derailment to their state or district.”

    But US EPA Administrator Michael Regan said the agency is developing measures to give authorities a “heads up” about incoming waste shipments and to keep Norfolk Southern accountable for the material it is moving.

    On the other side of Ohio, the Pennsylvania Department of Health is opening a health resource center in Beaver County so residents “can talk to public health experts, sign up to have their well water tested, and learn about available resources from professionals there to help,” Gov. Josh Shapiro tweeted Tuesday.

    Beaver County is just across the state border from East Palestine, Ohio – a village of 5,000 struggling to understand the full breadth of consequences from the February 3 toxic train wreck that burned for days and led to the release of the dangerous chemical vinyl chloride.

    A new data analysis suggests nine out of the dozens of chemicals that the EPA has been monitoring are higher than what normally would be found in East Palestine, according to scientists from Texas A&M and Carnegie Mellon universities.

    If the levels of some chemicals remain high, it could pose a problem for residents’ health over time, the scientists said. Temperature changes or high winds might stir up the chemicals and release them into the atmosphere.

    The chemical with the highest concentration found in East Palestine was a substance called acrolein, the data analysis said.

    Acrolein is used to control plants, algae, rodents and microorganisms. It is a clear liquid at room temperature and is toxic. It can cause inflammation and irritation of the skin, respiratory tract and mucous membranes, according to the US Centers for Disease Control and Prevention.

    “It’s not elevated to the point where it’s necessarily like an immediate ‘evacuate the building’ health concern,” said Albert Presto, an associate research professor of mechanical engineering at Carnegie Mellon’s Wilton E. Scott Institute for Energy Innovation, who is working on the university’s chemical monitoring effort in East Palestine.

    “But, you know, we don’t know necessarily what the long-term risk is or how long that concentration that causes that risk will persist.”

    Some East Palestine residents have reported rashes, headaches, nausea and bloody noses since the derailment and the February 6 controlled release and burning of vinyl chloride.

    During his third visit to the town Tuesday, the EPA chief said ongoing tests of the air and municipal water show both are safe – but urged anyone who is feeling “any kind of adverse health impacts” to seek medical attention.

    Regan returned to East Palestine to mark the opening of the “EPA’s community welcome center,” which will be open daily so “residents and business owners can stop in to get their questions answered, sign up for home air monitoring, and learn more about cleaning services.”

    “We’ve been testing the air from the very beginning, and the state has been testing the water,” Regan said.

    “Every chemical that was on that train and every byproduct from those chemicals have been tested or are part of our testing regimen,” he said. “So we believe firmly that our testing regimen is protective.”

    Still, the EPA is offering cleaning services – which will be reimbursed by Norfolk Southern – to any concerned resident in East Palestine.

    “There have been many residents here who have indicated that they worry about some residual, or some dust or some particles,” Regan said. “While we don’t believe that there are any adverse health impacts in homes or businesses as it relates to the derailment, this is an additional step we’re taking to alleviate concern and lower the angst.”

    Ohio officials have said East Palestine’s municipal water supply is safe to drink, citing multiple tests and the fact that the municipal water comes from five wells encased in steel deep underground.

    But health officials warn those using private well water should get it tested before using it. The Columbiana County Health District is posting test results online.

    Across the border in Pennsylvania, the state Department of Environmental Protection has collected samples from “nearly every private well” in the state within one mile of the derailment site, the governor said.

    The goal is to independently verify the safety of the water in Pennsylvania, Shapiro said.

    He reiterated that “Norfolk Southern will pay for the entire cost of the clean up,” including reimbursing Pennsylvania county fire departments for “equipment that was damaged or contaminated while responding to the derailment.”

    US Transporation Secretary Pete Buttigieg has called for Norfolk Southern and the rest of the freight rail industry to take a number of immediate actions, including committing to phase in safer tank cars by 2025.

    The Department of Transportation also wants Congress to take up legislation that would increase the maximum fines the DOT can issue to rail companies for violating safety regulations, Buttigieg said.

    He also called on the CEOs of major freight rail companies to “join a close-call reporting system that protects whistleblowers who spot issues that could lead to accidents,” Buttigieg told CNN on Tuesday.

    “We’re focusing on lessons learned when it comes to rail safety.”

    After a brief pause, shipments of contaminated liquid and soil from the toxic train derailment in East Palestine, Ohio, have resumed after cross-country concerns about where the hazardous waste is going.

    Officials with the Environmental Protection Agency previously said they have approved the shipment of contaminated waste to two EPA-certified sites in Ohio: Heritage Thermal Services in East Liverpool and Vickery Environmental in Vickery. Region 5 Administrator Debra Shore said Monday two more sites – one in Ohio and one in Indiana – will also receive waste from the derailment scene.

    The move came after officials in Texas and Michigan complained they didn’t get any warning that waste from the toxic crash site would be shipped to their states for disposal. The EPA ordered the train’s operator, Norfolk Southern, to stop the shipments Friday so that it could review the company’s disposal plans.

    Shore said she spoke with officials from Ohio and Indiana on Monday regarding the shipment of hazardous waste material to their towns.

    Questions about the disposal of toxic waste from the February 3 derailment have added to the controversy surrounding the crash that has also left residents of the town worried about potential long-term health effects.

    The mayor of East Liverpool, one of the Ohio towns set to incinerate the waste, expressed concerns about the process but said the EPA has assured him that everyone has been following necessary guidelines.

    “We have a 2-year-old daughter and of course that’s a concern,” Mayor Gregory T. Bricker said. “But, again, I think this is a state-of-the-art facility that can handle this type of waste.”

    So far, about 1.8 million gallons of liquid waste and 4,832 cubic yards of solid waste have been pulled from the derailment site, according to the office of Ohio Gov. Mike DeWine.

    EPA Administrator Michael Regan is expected to make his third trip to East Palestine on Tuesday to mark the grand opening of a new community center, Shore said.

    US Transportation Secretary Pete Buttigieg has given Norfolk Southern and other major rail companies a deadline of this week to say whether they will participate in the Confidential Close Call Reporting System – a voluntary program that allows workers to report safety hazards.

    “This common-sense program encourages employees to report safety hazards, including conditions that could lead to derailments, by protecting these workers from reprisal when they come forward,” Buttigieg wrote in a Monday letter to Norfolk Southern CEO Alan Shaw.

    The transportation secretary said “not one major freight rail company participates” in the Confidential Close Call Reporting System, also known as C3RS.

    “By refusing to take this commonsense step, you are sending an undesirable message about your level of commitment to the safety of your workers and the American communities where you operate,” Buttigieg wrote.

    “I am asking you to join the C3RS program now, even as our Department proceeds to take appropriate steps toward making this program mandatory.”

    Buttigieg first called for the change in a letter to railroads dated February 14, but is now going directly to rail CEOs and asking them to reply to the Department of Transportation “by the end of the week.”

    After that, Buttigieg said, he will “present the public with a summary of which companies have agreed to this important safety measure and which have refused.”

    The hazardous waste that has already been sent to Michigan and Texas is being processed, EPA regional administrator Debra Shore said Sunday.

    About 2 million gallons of firefighting water from the train derailment site were expected to be disposed in Harris County, Texas, with about half a million gallons already there, the county’s chief executive said last week.

    In Michigan, contaminated soil from the derailment site was taken to the US Ecology Wayne Disposal in Belleville, Michigan, US Rep. Debbie Dingell of Michigan said.

    Vickery Environmental will process overflow water from the crash scene, according to the Sandusky County Emergency Management Agency.

    The agency didn’t comment on how much water the facility has received so far, saying only that it has been receiving three to four loads per day, but according to Ohio officials, more than 94,000 gallons have been disposed of at the facility so far.

    Until Friday, Norfolk Southern had been “solely responsible” for disposing of waste from the train derailment, but waste disposal plans “will be subject to federal EPA review and approval moving forward,” Shore said.

    Every aspect of transporting and disposing of the hazardous waste “from the moment trucks and rail cars are loaded until the waste is safely disposed of” will be closely regulated and overseen by federal, state, and local governments, Shore said Sunday.

    After speaking to residents in East Palestine, Shore said “we owe it to the people of East Palestine to move it out of the community as quickly as possible.”

    “At the same time,” Shore added, “I know there are folks in other states who have concerns, legitimate concerns, about how this waste is being transported and how it will be disposed of. EPA will continue to work with our local, state, and federal partners to use our longstanding experience and expertise in these matters to ensure the health and safety, and support the East Palestine community and to hold Norfolk Southern accountable.”

    The fiery derailment and subsequent intentional release of vinyl chloride from train cars left East Palestine residents with anxiety about the safety of their air and water. Some have reported rashes, headaches, nausea and bloody noses.

    So far, tests of East Palestine’s public drinking have found “no indication of risk to East Palestine public water system customers” and “treated drinking water shows no detection of contaminants associated with the derailment,” the EPA said in a Sunday update.

    And air quality tests inside 578 East Palestine homes detected no contaminants linked to the derailment, the EPA said.

    But residents are still concerned, and federal teams are going door-to-door to conduct health surveys and provide informational flyers after President Joe Biden directed the move, a White House official told CNN.

    And new wells will be drilled this week “to determine if ground water immediately below the derailment site is contaminated,” DeWine’s office announced Sunday.

    Four wells have already been installed and up to three more will be drilled this week after the soil under the rails is completely excavated, officials said.

    “These monitoring wells will also support a better understanding of the direction and rate of the ground water flow in the area,” DeWine’s office said.

    As for the wreckage, all rail cars except the 11 held by investigators have been removed from the site of the derailment, Ohio Environmental Protection Agency Director Anne Vogel said Sunday.

    “This is so critically important to moving on to next steps. We can now excavate additional contaminated soil and began installing monitoring wells,” Vogel said.

    The Ohio EPA will oversee the installation of water monitoring wells at the site of the derailment that will measure contaminant levels in the groundwater below.

    While the crash was “100% preventable,” it appears the train’s crew didn’t do anything wrong leading up to the derailment, said Jennifer Homendy, chair of the National Transportation Safety Board.

    An NTSB preliminary report found one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, Homendy said last week. Video of the train before the crash showed what appeared to be an overheated wheel bearing, the report said.

    What caused the wheel bearing failure will be key to the investigation, Homendy added.

    The investigation will also look into the train’s wheelset and the bearing, the designs of tank cars and railcars, the maintenance procedures and practices, as well as the damage from the derailment, the NTSB report said.

    The Environmental Protection Agency has approved resuming shipments of contaminated liquid and soil out of East Palestine, Ohio, where a train carrying toxic chemicals derailed earlier this month.

    The EPA on Friday ordered the train’s operator, Norfolk Southern, to halt the shipments so that it could review the company’s plans for disposal, adding to the controversy surrounding the crash that has also left residents of the town worried about potential long-term health effects.

    That’s as officials in Texas and Michigan complained they didn’t receive any warning that hazardous waste from the crash would be shipped into their jurisdictions for disposal.

    Shipments now will be going to two EPA-certified facilities in Ohio, and Norfolk Southern will start shipments to these locations Monday, EPA regional administrator Debra Shore said at a news conference Sunday.

    “Some of the liquid wastes will be sent to a facility in Vickery, Ohio, where it will be disposed of in an underground injection well,” Shore said. “Norfolk Southern will also beghin shipping solid waste to the Heritage Incinerator in East Liverpool, Ohio.”

    Until Friday, Norfolk Southern was “solely responsible” for disposing of waste from the train derailment, Shore said Saturday, but waste disposal plans “will be subject to EPA review and approval moving forward.”

    All rail cars, except for those held by the National Transportation Safety Board (NTSB), have been removed from the site of the derailment, Ohio Environmental Protection Agency (EPA) Director Anne Vogel said in an update Sunday.

    The NTSB is currently holding 11 railcars as part of its investigation into the derailment, Ohio Gov. Mike DeWine said in a statement Sunday.

    “This is so critically important to moving on to next steps. We can now excavate additional contaminated soil and began installing monitoring wells,” Vogel said. The Ohio EPA will oversee the installation of water monitoring wells at the site of the derailment that will measure contaminant levels in the groundwater below.

    Every aspect of transporting and disposing of the hazardous waste material “from the moment trucks and rail cars are loaded until the waste is safely disposed of” will be closely regulated and overseen by federal, state, and local governments, Shore said Sunday.

    Shore detailed the federal, state, and local compliance requirements expected from Norfolk Southern.

    “These extensive requirements cover everything from waste labeling, packaging, and handling, as well as requirements for shipping documents that provide information about the wastes and where they’re going,” Shore said.

    The hazardous waste material previously sent to facilities in Michigan and Texas is now being processed at those facilities, Shore said.

    About 2 million gallons of firefighting water from the train derailment site were expected to be disposed in Harris County, Texas, with about half a million gallons already there, according to the county’s chief executive.

    Also, contaminated soil from the derailment site was being taken to the US Ecology Wayne Disposal in Belleville, Michigan, US Rep. Debbie Dingell of Michigan said Friday.

    The Michigan and Ohio facilities were, in fact, EPA approved sites, but they are not currently accepting any more shipments at this time, and the EPA is “exploring to see whether they have the capacity” to accept shipments in the future, Shore said.

    A spokesperson Gov. DeWine told CNN the governor was not briefed on where in the country the shipments would be sent. But this is typical, as the train company is responsible for the transport of material and the EPA is responsible for regulating that transport, DeWine spokesman Daniel Tierney said Saturday.

    The February 3 derailment of the Norfolk Southern train and subsequent intentional release of vinyl chloride it was hauling first forced East Palestine residents out of their homes, then left them with anxiety about health effects as reports of symptoms like rashes and headaches emerged after they returned.

    Officials have repeatedly sought to assure residents that continued air and water monitoring has found no concerns. The EPA reported last week that they have conducted indoor air testing at a total of 574 homes and detected no contaminants associated with the derailment.

    Federal teams in East Palestine have begun going door-to-door to check in with residents, conduct health surveys and provide informational flyers after President Joe Biden directed the move, a White House official told CNN.

    Also, a 19-person scientific team from the Centers for Disease Control and Prevention has been collecting information from residents about symptoms they have experienced since the derailment, said Jill Shugart, a senior environmental health specialist for the CDC.

    The EPA also installed “sentinel wells” near the city’s municipal well field to monitor contaminants in well water as part of the agency’s long-term early detection system “to protect the city for years to come,” Vogel, head of the Ohio EPA, said Saturday.

    In a Saturday update on the removal of contaminated waste, DeWine said 20 truckloads of hazardous solid waste had been hauled away from the Ohio derailment site. Fifteen of those truckloads were disposed of at a licensed hazardous waste treatment and disposal facility in Michigan and five truckloads were returned to East Palestine.

    About 102,000 gallons of liquid waste and 4,500 cubic yards of solid waste remained Saturday in storage on site in East Palestine – not including the five truckloads returned, according to DeWine. Additional solid and liquid wastes are being generated as the cleanup progresses, he added.

    Dingell told CNN on Saturday that neither she nor Michigan Gov. Gretchen Whitmer were aware of plans for toxic waste to be delivered to disposal sites in her district.

    “I called everybody,” Dingell said. “Nobody had really been given a heads up that they were coming here.”

    Across the country, Texas Chief Executive Lina Hidalgo expressed frustration that she first learned about the expected water shipments to her state from the news media – not from a government agency or Texas Molecular, the company hired to dispose of the water.

    She added that although there’s no legal requirement for her office to be notified, “it doesn’t quite seem right.”

    Hidalgo said Texas Molecular told her office Thursday that half a million gallons of the water was already in the county and the shipments began arriving around last Wednesday.

    On Thursday, Texas Molecular told CNN it had been hired to dispose of potentially dangerous water from the Ohio train derailment. The company said they had experts with more than four decades of experience in managing water safely and that all shipments, so far, had come by truck for the entire trip.

    Hidalgo’s office had been seeking information about the disposal, including the chemical composition of the firefighting water, the precautions that were being taken, and why Harris County was the chosen site, she said.

    According to a Thursday news release from Ohio Emergency Management Agency, more than 1.7 million gallons of contaminated liquid had been removed from the immediate site of the derailment. Of that, more than 1.1 million gallons of “contaminated liquid” from East Palestine had been transported off-site, with the majority going to Texas Molecular and the rest going to a facility in Vickery, Ohio.

    CNN asked the Ohio agency the location of the remaining 581,500 gallons which had been “removed” but not “hauled off-site” and has yet to receive a response.

    Regarding the causes of the accident, a National Transportation Safety Board preliminary report found that one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, said Jennifer Homendy, the chair of the safety board. So far, the investigation found the three crew members on board the train did not do anything wrong prior to the derailment, though the crash was “100% preventable,” she said.

    After federal officials released an initial report concluding that this month’s toxic train wreck in Ohio was completely preventable, investigators will begin examining procedures, practices and design prior to the derailment that has sparked long-term concerns among hundreds of frustrated residents.

    The National Transportation Safety Board on Thursday released its preliminary report on the investigation into the February 3 train crash in East Palestine, Ohio, where residents have been complaining about feeling sick after hazardous chemicals seeped into the air, water and soil.

    Ohio environmental officials made a civil referral this week asking the state attorney general’s office to begin “legal and/or equitable civil actions” against Norfolk Southern, which could result in a civil complaint if negotiations with the company were to fail.

    The NTSB report found that one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, according to Jennifer Homendy, the chair of the safety board. As the temperature of the bearing got hotter, the train passed by two wayside defect detectors that did not trigger an audible alarm message because the heat threshold was not met at that point, Homendy explained. A third detector eventually picked up the high temperature, but it was already too late by then.

    “This was 100% preventable. … There is no accident. Every single event that we investigate is preventable,” Homendy said during a news conference Thursday. “The NTSB has one goal, and that is safety and ensuring that this never happens again.”

    The next phase of the investigation will examine the train’s wheelset and bearing as well as the damage from the derailment, the NTSB report noted. The agency will also focus on the designs of tank cars and railcars along with maintenance procedures and practices.

    Plus, investigators will review the train operator’s use of wayside defect detectors and the company’s railcar inspection practices. More specifically, determining what caused the wheel bearing failure will be key to the investigation, Homendy said.

    On Friday, Homendy said on “CNN This Morning” that she’s concerned politics could cloud the investigation and prevent safety improvements. Former President Donald Trump visited the site of the train derailment on Wednesday where he criticized President Joe Biden’s administration’s handling of the railway disaster.

    “This is not a time for politics,” Homendy said. “There is a time for politics. It is not this.”

    On Thursday, Transportation Secretary Pete Buttigieg also visited the derailment site, and when asked how political figures like Trump could help, Buttigieg addressed the former president directly saying he could “express support for reversing the deregulation that happened on his watch.”

    Another key aspect of the investigation will focus on the response to the chemical disaster, particularly the manual detonations of tanks carrying toxic chemicals.

    Five of the 38 derailed train cars were carrying more than 115,000 gallons of vinyl chloride, according to the NTSB’s report. Exposure to high levels of vinyl chloride can increase cancer risk or cause death.

    Those five cars “continued to concern authorities because the temperature inside one tank car was still rising,” indicating a polymerization reaction which could have resulted in an explosion, the report said. To help prevent a potentially deadly blast of vinyl chloride, crews released the toxic chemical into a trench and burned it off on February 6 — three days after the derailment.

    Since then, some East Palestine residents have said they are experiencing headaches, dizziness, nausea and bloody noses — a host of health issues they say they did not have prior to the crash.

    At the same time, officials have been adamant in reassuring residents of the air’s safety and the municipal water supply.

    Around 2 million gallons of firefighting water from the train derailment site are expected to be disposed in Harris County, Texas, according to the county’s chief executive.

    Harris County Judge Lina Hidalgo said her office was told by Texas Molecular on Thursday that the shipments began arriving around last Wednesday, she said.

    Texas Molecular was hired to dispose of the potentially dangerous water from the train derailment, the company, which said it has more than four decades of experience in managing water safely, has told CNN.

    The company told Hidalgo’s office Thursday that half a million gallons was already in the county.

    Hidalgo expressed frustration that she first learned about the water shipments from the news media – not from a government agency or Texas Molecular,

    “It’s a very real problem we were told yesterday the materials were coming only to learn today they’ve been here for a week,” Hidalgo said.

    She added that although there’s no legal requirement for her office to be notified, “It doesn’t quite seem right.”

    Texas Molecular is receiving the water from trucks, but it’s unclear if trucks are used for the entire trip, Hidalgo said. The company told her office they’re receiving about 30 trucks of water a day, she said.

    CNN is seeking comment from Texas Molecular about how the water is being transported.

    Hidalgo said her office is looking for information about the disposal, including the chemical composition of the firefighting water, the precautions that are being taken, and why Harris County was the chosen site.

    “There’s nothing right now to tell me – to tell us – there’s going to be an accident in transport, that this is being done in such a way that is not compatible with the well, that there’s a nefarious reason why the water is coming here and not to a closer site,” Hidalgo said. “But it is our job to do basic due diligence on that information.”

    A total of 1.7 million gallons of contaminated liquid has been removed from the immediate site of the derailment, according to a Thursday news release from the Ohio Emergency Management Agency.

    More than 1.1 million gallons of “contaminated liquid” from East Palestine has been transported off-site so far, with the majority going to Texas Molecular and the rest going to a facility in Vickery, Ohio.

    CNN has asked the Ohio agency the location of the remaining 581,500 gallons which have been “removed” but not “hauled off-site.”

    Congresswoman Debbie Dingell of Michigan said she was “not given a heads up” that contaminated soil from East Palestine would be transported to the US Ecology Wayne Disposal in Belleville, Michigan.

    “We were not given a heads up on this reported action,” Dingell said in a press release on Friday, “Our priority is to always keep the people we represent safe.”

    Dingell said inquires to the EPA, Department of Transportation, Norfolk Southern, US Ecology, the state of Ohio and others involved are in the process.

    On Friday afternoon, Ohio Gov. Mike DeWine released an update on the removal of the contaminated site in East Palestine, saying that soil would be transported to Michigan.

    So far, 4,832 cubic yards of soil have been removed from the ground in East Palestine. Approximately six truckloads of that contaminated soil are on their way to the hazardous waste disposal facility in Michigan, according to a press release from DeWine.

    The 149-car train operated by Norfolk Southern on February 3 had three employees on board: a locomotive engineer, a conductor and a trainee who were all in the head end of the locomotive, Homendy told CNN’s Jake Tapper on Thursday.

    So far, the investigation found the crew did not do anything wrong prior to the derailment, though the crash was “100% preventable,” Homendy said.

    Video of the train before the derailment showed what appeared to be an overheated wheel bearing, according to the NTSB report. Footage showed sparks flying from underneath the train.

    NTSB investigators are now focusing on one train car’s wheel set and bearing to figure out what may have caused the overheating, Homendy said.

    “We have a lot of questions about that,” she said Friday, including the “thresholds and why they vary so much between railroads.”

    Ultimately, it’s the railroads that set the temperature thresholds for the detectors, Homendy said.

    Releasing publicly a probable cause or causes for the derailment could take 12 to 18 months, Homendy said during the news conference.

    “We are very deliberative. We are the gold standard when it comes to investigations globally, and we are methodical in our approach,” Homendy said. “But if we see a safety issue that we need to be addressed immediately, something systemic, we will not hesitate to issue an urgent safety recommendation.”

    In the meantime, here’s what the NTSB preliminary report found so far:

    • One wheel bearing’s temperature reached a “critical” level — 253 degrees Fahrenheit above the ambient temperature — and prompted an audible alarm that instructed “the crew to slow and stop the train to inspect a hot axle,” the report says.
    • The train’s engineer applied the train’s brakes and additional braking after the alert of an overheating axle, the report states. “During this deceleration, the wheel bearing failed,” Homendy explained. “Car 23 derailed, and the train initiated an emergency brake application and came to a stop.”

    Even after reading the preliminary NTSB report, Ohio Attorney General Dave Yost told “CNN This Morning” that there’s still a lot of facts he doesn’t know.

    Among his biggest questions are: “Had the train been shorter, had there been additional staff, could this have been averted? Based on the alerts that occurred, how long is the reaction time and how is that influenced by the size of the train?” Yost told CNN.

    The US Environmental Protection Agency has ordered Norfolk Southern to cover the full cost of cleaning up the aftermath of the train crash.

    “EPA has special authority for situations just like this where we can compel companies who inflict trauma and cause environmental and health damage to communities, like Norfolk Southern has done, to completely clean up the mess that they’ve caused and pay for it,” EPA administrator Michael Regan said.

    Norfolk Southern will be required to:

    • Provide a descriptive work plan on how they intend to clean up the water, soil and debris
    • Reimburse the EPA for providing residents a cleaning service of their homes and businesses
    • Show up to public meetings and explain their progress

    If the company does not follow the order, the EPA will step in to complete the duties, while fining Norfolk Southern up to $70,000 a day, Regan said Wednesday during a CNN town hall.

    “And the law gives us the authority to charge Norfolk Southern up to three times the amount that the cleanup will cost us,” he said.

    The company plans to take a series of measures moving forward to minimize the long-term impacts of chemicals on the land and groundwater, including ripping up the tracks where the train derailed and removing soil underneath, Norfolk Southern CEO Alan Shaw said.

    Shaw added his company is working with the Environmental Protection Agency on a “long-term remediation plan.”

    Yost, who received the referral from the Ohio EPA to initiate necessary legal civil actions against Norfolk Southern this week, told CNN any criminal referral in Ohio regarding the derailment would be a decision made by local prosecutors.

    “We’ve been in contact with the local county prosecutor, and … we may be assisting him, but at this point, he has not empaneled a grand jury, to my understanding,” he said Friday on “CNN This Morning.”

    Ohio environmental officials made a civil referral Tuesday asking Yost’s office to “initiate all necessary legal and/or equitable civil actions” and “seek appropriate penalties” against Norfolk Southern, according to a copy of the referral provided by the attorney general’s office.

    “I respectfully request that this referral result in the filing of a civil complaint in the appropriate court if efforts on your part to resolve this matter through negotiation fail,” Ohio Environmental Protection Agency Director Anne Vogel wrote in a letter to Yost.

    Vogel cited potential violations of state laws regarding air and water pollution and solid and hazardous waste.

    Expanding the definition of a high-hazard flammable train – a standard the derailed train did not meet, despite sparking a major fire – is among the changes NTSB advocated for in the past, Homendy said Friday.

    NTSB urged regulators to include in the classification “a broad array of flammable materials,” rather than focusing on crude oil, she said.

    Additionally, NTSB will look at whether vinyl chloride needs to be carried in more fortified cars, Homendy said.

    A fiery train wreck that released toxic materials in an Ohio town is raising new questions in the halls of the nation’s capital over the regulation of the rail industry and if stricter measures could have prevented the disaster.

    News of the East Palestine, Ohio, derailment – and its potential harmful effects on the environment and health of local residents – has propelled both Democrats and Republicans in Congress to press the Biden administration on whether there’s enough oversight to keep rail workers and communities near railroads safe. And the supervising agency broadly responsible for regulating rail safety, the Department of Transportation, is calling on Congress to make it easier to institute safety reforms.

    This rare, general bipartisan agreement about taking action in the wake of the derailment follows years of Republicans generally supporting deregulation of the rail industry, including with the broad rollback of transportation rules during the Trump administration.

    Unions, current and former regulatory officials, and members of Congress from both parties have signaled some optimism about the possibility that the Ohio disaster may mark a rare opportunity for Washington to get something done to enhance the rail industry’s safety standards. But what’s unclear is whether there’s enough momentum for both parties in Congress to propel the issue forward into tangible actions. Nor is it clear whether the rail industry’s strong lobbying efforts will pare down any proposed measures or play a hand in eliminating them altogether.

    Transportation Secretary Pete Buttigieg said in an interview with CNN on Tuesday that that he’s fed up with the rail industry’s pressure campaigns to diminish regulatory reforms.

    “I’ve had it,” he said. “We have had situation after situation where even modest, reasonable reform gets just a full court press.”

    “I do think if the railroads, like Norfolk Southern, are in a mode right now where they’re saying, ‘We’re going to do everything it takes and everything we can.’ Let’s give them a chance to show it,” Buttigieg later added. “But let’s be very clear, I’m not waiting for them to do this work. I’m just saying they have a chance to put their money where their mouth is.”

    Experts point out several areas of opportunity to enhance rail safety and hold rail companies further accountable: updating trains’ braking system, shortening the lengths of freight trains, further separating cars with hazardous material, requiring more crew member be on board, and increasing penalties.

    Many of these proposals, experts say, have been around for decades, and have oftentimes been diminished or entirely eliminated after rail lobbying efforts. Data compiled by the nonprofit OpenSecrets show that Norfolk Southern spent $1.8 million on federal lobbying last year.

    Norfolk Southern posted record profits from railway operations of $4.8 billion in 2022, up from its previous record of $4.45 billion in 2021. The company did not respond to questions Wednesday on whether it expects to change its share repurchase plans in the wake of the derailment.

    “Unfortunately, derailments like this are preventable and they become inevitable when there’s more risk in the system,” Sarah Feinberg, a former administrator of the Federal Railroad Administration during the Obama administration, told CNN. “The industry has fought tooth and nail against safety regulations, but I also think that’s typical of any industry.”

    Lobbying influence from the rail industry is “a big problem and they have a stranglehold on Congress, especially in the Senate,” Greg Hynes, national legislative director for the SMART Transportation Division union, told CNN.

    “It’s all about the bottom line and they adhere to the operating ratios that Wall Street is so hungry for, which includes lowering head counts – which includes fewer safety inspections, fewer brake tests, fewer people doing the job that they need to do,” he added.

    Buttigieg recently sent a letter Sunday to Norfolk Southern CEO Alan Shaw demanding accountability and calling for greater safety regulations. And DOT subsequently announced on Tuesday that it would take a three-pronged approach to enhance rail safety – push companies to voluntarily adopt additional safety measures, call on Congress to do more and bolster administration efforts to regulate the industry.

    Among other plans to advance existing efforts or deploy existing funding, DOT says it’s initiating focused safety inspections as well as pursuing additional federal rulemaking on high-hazard flammable trains and electronically controlled pneumatic brakes.

    DOT also says it’s working to advance a proposed rule that would require a minimum of two crew members for most railroad operations. Leadership for Norfolk Southern met with Buttigieg and other DOT officials and expressed concerns about the proposed rule. Among other issues, Norfolk Southern argues it will lead to significant labor costs

    Crucial to efforts to enhance rail safety, administration officials and rail experts say, is Congress’ ability to untie the executive branch’s hands.

    DOT is asking Congress to increase the maximum fines that can be issued to rail companies for violating safety regulations. And similar to its regulatory efforts announced Tuesday, DOT is calling on Congress to expand the rules “governing high-hazardous shipments, including high-hazard flammable trains, pushing past industry opposition” and follow through “on new bipartisan support to modernize braking regulations and increase the use of electronically controlled pneumatic brakes.”

    “The apparatus that exists was to allow safety regulators to write and finalize common sense safety regulations that will protect people – protect their homes, protect their water, protect their children, protect their health – it’s totally broken,” Feinberg said. “And the reason it’s totally broken is because the Congress and others – other administrations – will insert themselves into the process and take it over … from safety regulators and say, ‘I know better and I’m going to protect the industry from whatever you’re trying to force its hand on.’”

    The American Association of Railroads, an industry group, has said that “until NTSB has completed their investigation, AAR will not comment on potential policy changes in relation to this event as the cause and any underlying factors have not yet been fully determined.” The NTSB is set to release a preliminary report on the derailment investigation Thursday morning.

    Congressional committees are set to review the environmental and safety impacts of the East Palestine derailment. Although efforts to enhance regulatory oversight of the rail industry have generally broken along party lines, some Republicans and Democrats appear to be moving in the same direction.

    Senate Commerce Committee Chair Maria Cantwell, a Washington state Democrat, sent a letter last week to seven of the largest railroad company CEOs, inquiring about safety practices involved in rail transportation of hazardous materials. She’s also requested a joint staff-level briefing with the Environment and Public Works Committee, asking federal transportation and environmental agencies to appear, according to Politico.

    House Transportation and Infrastructure Committee Chair Sam Graves, a Missouri Republican, scheduled a bipartisan briefing for members of the committee last week, and there may be further briefings for committee and all House members to help keep them informed of the status and relevant issues, Graves’ office told CNN.

    Republican Sens. J.D. Vance of Ohio and Marco Rubio of Florida sent a letter to DOT requesting information about the administration’s regulatory oversight, questioning whether the three crew members on board the Norfolk Southern train that derailed were enough to staff the 149-car locomotive.

    Sen. Ted Cruz of Texas, the leading Republican on the Senate Commerce committee, last week tweeted that he fully agreed with Minnesota Democratic Rep. Ilhan Omar, who wrote, in part, “We need Congressional inquiry and direct action from [Buttigieg] to address this tragedy.”

    Republican candidates for president Nikki Haley and former President Donald Trump have criticized President Joe Biden for not visiting the site of the derailment, arguing that his trip to Ukraine and Poland this week shows he’s more focused on a foreign crisis than what’s happening at home – an increasingly frequent critique of the president and his administration.

    Trump – whose administration sidelined the pending rule to require freight trains to have at least two crew members – appeared in East Palestine on Wednesday alongside Vance.

    Rubio and Buttigieg, meanwhile, are in a spat – with the secretary suggesting the senator was previously parroting lines from the rail industry and Rubio calling for Buttigieg’s resignation.

    “Anybody who has seen fit to get on television and talk about this incident, talk about this issue, can do right by the people of East Palestine and everybody else who lives near a railroad,” Buttigieg told CNN. “Not just when it comes to this case, but when it comes to the future, by getting on the right side of this issue, and helping to raise – not lower – the bar of accountability for the railroad industry.”

    Biden on Wednesday posted on Instagram about his phone call with his EPA Administrator Michael Regan and officials from Ohio and Pennsylvania to discuss the East Palestine situation. He also accused the Trump administration of limiting the ability to strengthen rail safety measures and said some of his current Republican critics were trying to dismantle the EPA.

    “The Department of Transportation has made clear to rail companies that their pattern of resisting safety regulations has got to change,” the caption stated. “Congress should join us in implementing rail safety measures. But the Department of Transportation is limited in the rail safety measures they can implement. Why? For years, elected officials – including the last (administration) – have limited our ability to implement and strengthen rail safety measures.”

    Following repeated calls for Buttigieg to visit the Ohio site, the secretary said earlier this week that he intended to visit East Palestine when the time was right. And then on Wednesday, DOT announced that he would visit on Thursday.

    A DOT spokesperson said Buttigieg had planned to go when it was “appropriate and wouldn’t detract from the emergency response efforts. The Secretary is going now that the EPA has said it is moving out of the emergency response phase and transitioning to the long-term remediation phase.”
