    Will the Human Rights Movement Survive the Gaza War?

    The U.S. — a passionate backer of civilian protections in Ukraine — has struggled to find the right way to address these claims while still standing by its long-time partner. The bombing has been “indiscriminate,” says President Joe Biden, but perhaps it will improve tomorrow. Killing more than 10,000 women and children in two months is not “genocide,” argues White House spokesperson John Kirby, but Hamas’ brutal Oct. 7 attacks were.

    If human rights are fundamentally a matter of world consensus, then what does it tell us that the United States threatens to cast a second veto against a United Nations Security Council resolution begging for a humanitarian suspension of fighting?

    What does it mean when a supposed champion of human rights seems to jettison them when it becomes inconvenient? For that matter, why should Israel care about human rights when it perceives its fight as existential?

    Kenneth Roth has a unique perspective on these questions. Roth, considered by many to be a dean of the human rights movement, spent nearly three decades as the executive director of Human Rights Watch before stepping down last year to become a visiting professor at Princeton University.

    Under his leadership, HRW drew flak for, among other things, declaring Israel’s occupation of Palestinian territories to be apartheid, all while documenting in meticulous detail abuses committed by Palestinian groups, including Hamas.

    RS spoke with Roth to get his thoughts on human rights at a time of crisis. The following conversation has been edited for length and clarity.

    Responsible Statecraft (RS): How would you rate the Biden administration’s handling of the Gaza crisis from a human rights perspective?

    Roth: The Biden administration has been far too deferential to the Israeli Government, despite the pretty clear commission of war crimes in Gaza. And while the administration has pushed to ameliorate some of those war crimes — by pressing for humanitarian access, by urging greater attention to avoiding civilian casualties — that rhetorical push has not been backed by the use of the leverage that the administration has that might have really put pressure on the Israeli government to stop, whether that would be withholding or conditioning ongoing arm sales or military assistance, or even allowing a Security Council resolution to go forward.

    RS: What would a better approach look like?

    Roth: The initial problem was that Biden pretty unconditionally wrapped himself in the Israeli government’s response to the horrible October 7 attacks by Hamas. If you look at his initial comments, while there were caveats written in about the need to respect humanitarian law, there was no emotional punch behind them.

    It was pretty clear that Biden simply stood with Israel and was giving it a green light to proceed with its military response to Hamas without much effort, at least during the first few weeks, to ensure that that response really did comply with humanitarian law. So, I think the Israeli government got the message that the references to humanitarian law were necessary for certain audiences, but that the administration’s heart was not in them.

    RS: Would a more forceful form of messaging at the start have led to different results?

    Roth: Obviously, it’s hard to know the counterfactual. But the U.S. government, which has the greatest leverage of any external actor, didn’t really use that leverage to ensure that its periodic rhetorical commitment to the need to respect humanitarian law was matched by its much more forceful embrace of the Israeli military response to Hamas.

    RS: I’ve seen some reporting that the State Department has done internal inquiries as to whether U.S. officials could be legally complicit if Israel is found to have committed war crimes in Gaza. Do you have any thoughts on that question?

    Roth: Well, they could be. Biden’s references to the Israeli military conducting indiscriminate bombing were clearly not just a verbal slip. It probably reflected the internal conversations that the administration has. The second one even seems to have been somewhat deliberate.

    And the significance of that is that indiscriminate bombardment is a war crime. As any administration lawyer would know, continuing to provide weapons to a force that is engaged in war crimes can make the sender guilty of aiding and abetting war crimes.

    That is not some crazy, wacko theory. That was the basis on which former Liberian President Charles Taylor was convicted by an internationally backed tribunal, the so-called Special Court for Sierra Leone, for providing weapons to the Sierra Leonean rebel group known as the Revolutionary United Front, a group that was notorious for chopping off the limbs of its victims.

    Because Taylor kept providing arms in return for the RUF’s diamonds while he knew the RUF was committing these war crimes, this internationally-backed tribunal found him guilty of aiding and abetting, convicted him, and sentenced him to 50 years in prison, which he is currently serving in a British prison.

    RS: My next question is a little tricky, but I’m curious how you approach it. Israel claims that this war is a fight for its very survival. Why should a country that views itself as being in that position care about respecting human rights?

    Roth: Well, I think the question is why should it care about adhering to international humanitarian law and protocols. It’s worth noting that humanitarian law was not drafted by a bunch of human rights activists and peaceniks. This was drafted by the world’s leading militaries. It was designed for war, for situations where governments often feel that they are existentially at risk, and these were the limits that the world’s leading militaries imposed on themselves. Israel has signed on to these standards, and it claims to abide by them. It has many capable lawyers who could be applying them. It just isn’t applying them.

    It probably requires a certain psychological analysis to figure out why, but some of the signals being sent from the top indicate a willingness to disregard the requirements of humanitarian law. When you have Defense Minister Galant referring to the residents of Gaza as “human animals,” when you have Netanyahu invoking the biblical story of Amalek in which there’s a divine injunction to not spare the men, women, children, or animals, these are not-so-subtle signals that the top political and military leadership in Israel doesn’t care that much about civilian casualties. This has seemed to have manifested itself in the indiscriminate and disproportionate attacks that the Israeli military has carried out in Gaza.

    RS: It seems to me that focusing on war crimes or potential war crimes can sometimes lead to really bad policy outcomes. In this case, Israel is really spotlighting Hamas’ alleged war crimes. You think back to the war in Iraq, where there was a lot of highlighting of Saddam’s alleged war crimes. How can advocacy for human rights avoid supporting unfettered militarism?

    Roth: First, I think it’s important to note that war crimes by one side do not justify war crimes by the other. If a warring party could cite the other side’s war crimes, you would quickly have no more Geneva Conventions because allegations of war crimes are often made in the passions of conflict. The fact that some people have committed war crimes — in this case, both sides — doesn’t justify that others resort to criminal conduct. Now, in terms of military action, few people contest that Israel had every right to respond to Hamas’ military attack. It was an extraordinarily lethal military attack. It was ruthless, with widespread murder, rape, abduction, and indiscriminate bombardment. So with an attack of that sort, no one should be surprised that the Israeli government responds. The only real question was, will it respond consistent with humanitarian law? Or would it flout that law?

    RS: What does all this mean — especially the fact of the U.S. seemingly taking a step back in advocacy for the protection of human rights — what does all this mean for the state of human rights today?

    Roth: It is harmful because the U.S. government is such a powerful voice, and when it does seem to make an exception in its human rights advocacy for a close ally like Israel, it discredits the U.S. as a voice for human rights around the world. Now, I should say this is not the only instance of inconsistency on the part of Washington. We’re seeing it as well as the Biden administration tries to build alliances to oppose Russia’s invasion of Ukraine or to contain China. So while the administration has spoken numerous times about its fundamental commitment to human rights, it’s been a very inconsistent commitment. And that inconsistency is probably most visible in the Middle East, which has been essentially a black hole in the administration’s human rights policy. It’s very difficult to be so permissive of human rights violations in one region of the world and have a whole lot of credibility on human rights in other parts of the world.

    This means that one of those powerful voices we have has weakened itself. It’s not the first time that has happened. Under Trump, the U.S. essentially abandoned any pretense of enforcing human rights. Prior administrations have had comparable inconsistencies. The U.S. still has been able to be a useful voice for human rights, despite these inconsistencies, in some cases, but it is a much weaker voice than if it had really been principled and consistent.

    RS: How do you see the future of the push to get states to protect human rights? Are we in a moment of crisis that galvanizes change?

    Roth: If you look at the various efforts to uphold human rights, they’ve been quite vigorous in certain cases. There has been a very strong response to Russian war crimes in Ukraine, complete with multiple General Assembly resolutions, the Human Rights Council standing up a commission of inquiry, the International Criminal Court launching an immediate investigation and actually charging Putin and one of his aides with war crimes.

    A place where it’s been weaker has been, say, China’s crimes against humanity against the Uyghurs and other Turkic Muslims in Xinjiang, where we came within two votes of putting on the agenda a discussion of then-UN High Commissioner for Human Rights Michelle Bachelet’s very strong report on what she called possible crimes against humanity. But we didn’t even get that agenda item, so that’s a place where the world has been much weaker.

    But there’s been greater mobilization, greater willingness to speak out on a range of other situations, whether that be Myanmar or Iran, Saudi abuses in Yemen for a time, Sudan, Ethiopia for a time, Venezuela, Nicaragua. So the idea that because there’s this black hole in U.S. human rights policy, therefore nothing can get done, that’s just not true. A lot gets done, but the defense of human rights is weaker because the U.S. has been an inconsistent supporter of the effort.

    Israel needs a new government committed to peace and a cabinet that champions reconciliation. Perpetual war plays into the hands of Hamas. It placates Jewish hardliners who oppose the national aspirations of Palestinians. War also serves Netanyahu by distracting voters and delaying accountability for his government’s intelligence failures on October 7.

    It took up to ten hours for the Israeli Defense Forces (IDF) to react to Hamas’ invasion. Known for its security and intelligence services, Israel was caught flat-footed. Panicked residents of kibbutzim cowered in safe rooms, while 1,200 Israelis were killed, butchered in their homes and on the grounds of the Nova Music Festival. Hundreds were taken hostage by Hamas, gang-raped and turned into sexual slaves. One hundred and thirty remain in captivity.

    It is impossible to reconcile Israel’s objectives. Israel cannot eradicate Hamas and free hostages captive in the subterranean world of Gaza’s tunnel network. Secretary of Defense Lloyd Austin just visited Jerusalem to discuss priorities and scaling back Israel’s offensive.

    In the fog of war, the IDF killed three Israeli hostages last week displaying a white flag and speaking in Hebrew. Shooting people, even Hamas members who surrender, violates the laws of war and Israel’s military code. Exhausted and trigger happy, the incident is under investigation. The Israeli army chief of staff and the intelligence chief issued apologies. Netanyahu prevaricated, delaying his meeting with hostage families.

    The incident caused outrage across Israel, raising questions about Israel’s conduct of the war. The Hamas Ministry of Health claims that 20,000 Palestinian civilians have died as a result of IDF activities. Hostage families are demanding an investigation.

    There is a growing clamor to bring the hostages home. Hostage families are also demanding a plan to end the war. They have generally been supportive of Netanyahu’s response, but they are wavering. They believe that continued action in Gaza risks the lives of the remaining 130 hostages. The bungled operation has brought Israeli institutions – the IDF, Shin Bet and Mossad – into disrepute.

    Even President Joe Biden, Israel’s biggest backer, criticized the IDF for its “indiscriminate bombing.” France, Germany and Britain are also fed up and have demanded a “sustainable ceasefire.”

    Netanyahu said there will be a time and place for an inquiry into the Hamas attack and Israel’s response. He believes that the longer it takes for an inquiry, the more the passions of hostage families will be mollified.

    Israel’s slow grinding war with Hamas must stop. Israel was justified in launching a reprisal after October 7, especially as details of the brutality came to light. Two months later, the IDF seems to be flailing about. Israel has been characterized as the aggressor and has lost the moral high ground. For sure, Israel has every right to defend itself. But what started as calculated counterterrorism now seems more like rage and revenge.

    Can Hamas even be defeated? Hamas is more than an organization. It is a movement. For every Hamas terrorist that Israel kills, more Palestinian militants are waiting in the wings.

    It’s time for a new approach. An interim government overseen by the Palestinian Authority should be established and make plans for an eventual Palestinian state living side-by-side at peace with Israel.

    Indiscriminate bombing is counterproductive. A more surgical approach would differentiate between Hamas and Gazans, addressing claims of collective punishment.

    Internationally mediated talks would ensue when the hostages are freed. Palestinians need a national horizon to separate themselves from the clutches of Hamas.

    Israeli elections would likely repudiate Netanyahu and lead to the creation of a peace cabinet, putting Israel back on track as a democracy that respects minority rights and values good neighborly relations.

    It is unimaginable that Netanyahu can survive his putrid performance. Prosecutors are waiting to charge Netanyahu with corruption. Israelis can debate the details of government formation for months, but polling suggests that regime change is something that Israelis agree on now.

    An unprecedented 93% of the population in Gaza is facing crisis levels of hunger, with insufficient food and high levels of malnutrition.

    At least 1 in 4 households are facing “catastrophic conditions”: experiencing an extreme lack of food and starvation and having resorted to selling off their possessions and other extreme measures to afford a simple meal. Starvation, destitution and death are evident.

    The World Food Programme warns that these levels of acute food insecurity are unprecedented in recent history and that Gaza risks famine.

    Shaza Moghraby, Spokesperson for the UN World Food Programme (WFP) said: “I have been exposed to many IPC reports on various countries throughout my time at WFP and I have never seen anything like this before. The levels of acute food insecurity are unprecedented in terms of seriousness, speed of deterioration and complexity.”

    Gaza risks famine. The population falling into the “catastrophe” classification of food security in Gaza or IPC Level 5 is more than four times higher than the total number of people currently facing similar conditions worldwide (577,000 compared to 129,000 respectively).

    “We need an immediate humanitarian ceasefire, the opening of all border crossings and the resumption of commercial cargo to provide relief, put an end to the suffering and avert the very serious threat of famine. We cannot wait for famine to be declared before we act,” she said.

    On recent missions to north Gaza, WHO staff say that every single person they spoke to in Gaza is hungry. Wherever they went, including hospitals and emergency wards, people asked them for food.

    “We move around Gaza delivering medical supplies and people rush to our trucks hoping it’s food,” they said, calling it “an indicator of the desperation.”

    Meanwhile, in a new report released this week, Human Rights Watch (HRW) accused the Israeli government of using “starvation of civilians as a method of warfare in the occupied Gaza Strip, which is a war crime.”

    “Israeli forces are deliberately blocking the delivery of water, food, and fuel, while willfully impeding humanitarian assistance, apparently razing agricultural areas, and depriving the civilian population of objects indispensable to their survival”.

    Since Hamas-led fighters attacked Israel on October 7, 2023, high-ranking Israeli officials, including Defense Minister Yoav Gallant, National Security Minister Itamar Ben-Gvir and Energy Minister Israel Kat have made public statements expressing their aim to deprive civilians in Gaza of food, water and fuel – statements reflecting a policy being carried out by Israeli forces, HRW said.

    Other Israeli officials have publicly stated that humanitarian aid to Gaza would be conditioned either on the release of hostages unlawfully held by Hamas or Hamas’ destruction.

    “For over two months, Israel has been depriving Gaza’s population of food and water, a policy spurred on or endorsed by high-ranking Israeli officials and reflecting an intent to starve civilians as a method of warfare,” said Omar Shakir, Israel and Palestine director at Human Rights Watch.

    “World leaders should be speaking out against this abhorrent war crime, which has devastating effects on Gaza’s population.”

    Human Rights Watch interviewed 11 displaced Palestinians in Gaza between November 24 and December 4. They described their profound hardships in securing basic necessities. “We had no food, no electricity, no internet, nothing at all,” said one man who had left northern Gaza. “We don’t know how we survived.”

    Abby Maxman, President and CEO of Oxfam America said the shocking figures describing the high levels of starvation in Gaza are a direct, damning, and predictable consequence of Israel’s policy choices – and President Biden’s unconditional support and diplomatic approach.

    “Anyone paying attention cannot be surprised by these figures after more than two months of complete siege, denial of humanitarian aid, and destruction of residential neighborhoods, bakeries, mills, farms, and other infrastructure essential for food and water production,” she said.

    “Israel has the right to defend its people from attacks, but it does not have the right to use starvation as a weapon of war to collectively punish an entire civilian population in reprisal. That is a war crime.”

    “The US government has repeatedly given Israel diplomatic cover, but now must urgently change course and put politics aside to prioritize the lives of civilians”, said Maxman.

    “ As humanitarians, we know no amount of aid can meaningfully address this spiraling crisis without an end to the bombing and siege, but it is unconscionable to deny it to Palestinian families who are starving”.

    She argued the Biden administration must use all of its influence to achieve an immediate ceasefire to stop the bloodshed, allow for the safe return of hostages to Israel, and allow aid and commercial goods in, “so we can save lives now.”

    “The US cannot continue to stand by and allow Palestinians to be starved to death.”

    According to WHO, Gaza is also experiencing soaring rates of infectious diseases. Over 100, 000 cases of diarrhoea have been reported since mid-October. Half of these are among young children under the age of 5 years, case numbers that are 25 times what was reported before the conflict.

    Over 150 000 cases of upper respiratory infection, and numerous cases of meningitis, skin rashes, scabies, lice and chickenpox have been reported. Hepatitis is also suspected as many people present with the tell-tale signs of jaundice.

    “While a healthy body can more easily fight off these diseases, a wasted and weakened body will struggle. Hunger weakens the body’s defences and opens the door to disease,” WHO warned.

    Meanwhile, HRW said international humanitarian law, or the laws of war, prohibits the starvation of civilians as a method of warfare. The Rome Statute of the International Criminal Court (ICC) provides that intentionally starving civilians by “depriving them of objects indispensable to their survival, including willfully impeding relief supplies” is a war crime.

    Criminal intent does not require the attacker’s admission but can also be inferred from the totality of the circumstances of the military campaign.

    In addition, Israel’s continuing blockade of Gaza, as well as its more than 16-year closure, amounts to collective punishment of the civilian population, a war crime. As the occupying power in Gaza under the Fourth Geneva Convention, Israel has the duty to ensure that the civilian population gets food and medical supplies.

    Israel has stated its intention to indefinitely maintain a military presence within at least parts of the Gaza Strip, and rejects any role for the Palestinian Authority (PA) in the governance of the Gaza Strip. The US has indicated it would like to see Israel withdraw to the 1967 boundary and supports replacing Hamas rule with that of the PA, which it believes to be in Israel’s best interest.

    Washington would like to resume bilateral Israeli-Palestinian negotiations under US supervision, and has paid lip service to a two-state settlement. Israel has repeatedly and emphatically rejected both proposals.

    Neither these nor other disagreements resulting from the current crisis have resulted in any reduction of US military, political, or diplomatic support for Israel, which remains total and unconditional. In other words, US-Israeli tensions have the political significance of a loving couple deciding whether to dine on steak or sushi for their next date.

    It has been widely reported, for years, that Biden and his key lieutenants detest Netanyahu, and intensely so. If so, the Israeli prime minister must be thinking: “With enemies like these, who needs friends?”.

    The US is not only complicit in Israel’s genocide, it is a full and active partner. For it to propose a “humanitarian pause” under present conditions, which in addition to the continuous, relentless bombing include measures intended to produce starvation, dehydration, and epidemic disease is tantamount to advocating for a Khmer Rouge coffee break.

    A meaningless and diversionary charade if ever there was one.

    If the Biden administration does take action to enforce international law during the current crisis it won’t be against Israel, but rather against Yemen for interfering with global shipping. Israeli impunity might as well be incorporated into the US constitution.

    The performance of the UN Secretariat also leaves much to be desired. It has been extremely slow off the mark, hesitant to a fault, and excessively deferential to the US and Israel. It’s head of Political and Peacekeeping Affairs, Rosemary DiCarlo, has been enveloped in an impenetrable invisibility cloak.

    For his part Secretary-General Guterres has been condemning Hamas in the strongest possible terms on an almost daily basis since 7 October but has yet to explicitly condemn Israel for anything.

    Candidates for Guterres’s censure would include the mass killings of thousands of children; a medieval siege designed to produce widespread starvation, dehydration, and epidemic disease; an unprecedented campaign to destroy an entire territory’s health sector; the bombing of UN facilities sheltering civilians fleeing hostilities, and a record number of UN staff killed in a conflict, often together with their families.

    Among senior officials only Martin Griffiths, the UN’s Under-Secretary General for Humanitarian Affairs and Emergency Relief Coordinator, the World Health Organization Director-General Tedros Ghebreyesus, and to a lesser extent Philippe Lazzarini, Commissioner-General of UNRWA, have defied the echo chamber and been more explicit in framing the atrocities in the Gaza Strip.

    To his credit, Guterres on 6 December invoked Article 99 of the UN Charter, thereby identifying the crisis as not only a humanitarian emergency but also a threat to the maintenance of international peace and security.

    Its significance notwithstanding, history will question why Guterres dithered for two months when it came to calling out Israel for its ferocious onslaught on Gaza before suddenly reaching for his heaviest weapon.

    Rather than using the stature and authority of his office during the crucial months of October and November to call for an immediate and comprehensive cessation of hostilities and accountability for all who have violated the laws of war or international humanitarian law, he instead chose to advocate for a vaguely-defined “humanitarian ceasefire”.

    For Guterres, the Gaza Crisis constitutes a low point in an already unremarkable and frankly mediocre tenure. There’s a reason morale at the UN is disintegrating.

    One does not require the benefit of hindsight to conclude that Guterres would have done better to align himself with the overwhelming majority of UN member states, who on 12 December, in numerous speeches from the floor, once again spoke out against the horrors of this war and called for it to end forthwith.

    In a report last month—comparing Israeli bombings with US attacks in Middle East conflicts—the New York Times pointed out that the aerial bombs used by American forces against the Islamic State (ISIS) in urban areas in Mosul, Iraq and Raqqa, Syria were 500-pound weapons.

    But, in contrast, “Israel’s liberal use of very large weapons in dense urban areas” included American-made 2,000-pound bombs that flattened buildings, houses and an apartment tower in Gaza while killing thousands of Palestinians.

    “It’s beyond anything that I’ve seen in my career” Marc Garlasco, a former intelligence analyst at the Pentagon, was quoted as saying.

    Which triggers two questions: would Israel have survived without the $130 billion in weapons and military assistance provided by the US since Israel’s creation in 1948. And should Israel be charged with war crimes, along with US, the primary arms supplier to Israel?

    But both scenarios are not likely to happen. Any such attempts in the Security Council—either against the US or Israel will be vetoed by the Americans—as it happened last week on a resolution for cease-fire in Gaza.

    The resolution suffered a US veto (even though it had the support of 13 of the 15 members in the Security Council, with one abstention by UK.

    According to a December 1 report in the Wall Street Journal, the U.S. last week provided Israel with additional 2,000-Pound bombs for the Gaza War.

    The U.S. has provided Israel with large bunker buster bombs, among tens of thousands of other weapons and artillery shells, to help dislodge Hamas from Gaza, U.S. officials were quoted as saying.

    The surge of arms, including roughly 15,000 bombs and 57,000 artillery shells, began shortly after the Oct. 7 attack and has continued in recent days, the officials said. The U.S. hasn’t previously disclosed the total number of weapons it sent to Israel nor the transfer of 100 BLU-109, 2,000-pound bunker buster bombs.

    After sending massive bombs, artillery shells, U.S. also urged Israel to limit civilian casualties: a warning ignored by Israel.

    According to Wikipedia, the Mark 84 or BLU-117 is a 2,000 pounds (907 kg) American general-purpose bomb. It is the largest of the Mark 80 series of weapons. Entering service during the Vietnam War, it became a commonly used US heavy unguided bomb (due to the amount of high-explosive content packed inside) to be dropped.

    Norman Solomon, Executive Director, Institute for Public Accuracy and National Director, RootsAction.org, told IPS military aid from the U.S. government has been essential for Israel to maintain itself as an expansionist country during the last several decades.

    “That assistance has enabled Israel to systematically crush the human rights of Palestinian people while continuing to violate international law with occupations of Gaza and the West Bank. Israel has used its military might to, in effect, sadistically turn Gaza’s residents into abused prisoners,” he said.

    He pointed out that much of the strength of the Israeli armed forces has been due to Washington’s extraordinary quantities of support with military aid. Recent events have underscored how the U.S. government is willing to step up military assistance with massive amounts of weaponry and other war material while Israel continues to slaughter civilians in Gaza.

    “The wanton and purposeful killings of more than 15,000 civilians during the last two months are war crimes that deserve unequivocal condemnation and prosecution. What’s more, the U.S. government is more than complicit – it is an accomplice in these crimes against humanity. The same standards that should emphatically condemn Hamas’ murders of civilians on October 7 should also emphatically condemn Israel’s murders of civilians since then,” said Solomon, author, “War Made Invisible: How America Hides the Human Toll of Its Military Machine.”

    In recent days, a pair of developments involving the United States government have underscored its direct complicity in the ongoing mass murder by Israel in Gaza.

    On December 8, the U.S. vetoed a U.N. Security Council resolution for a ceasefire. The next day, the Biden administration disclosed that it is bypassing Congress to sell 13,000 rounds of tank ammunition to Israel. Overall, in Washington, bipartisan zeal is persisting to actively support the slaughter of Palestinian civilians in Gaza.

    “Propaganda efforts to equate calls for a single standard of human decency with antisemitism are specious and demagogic”.

    “Like a growing number of other Jewish Americans, I reject any and all efforts to equate Judaism with the state of Israel. The government of Israel continues to be engaged in large-scale war crimes, with the support of the U.S. government. They should be unequivocally denounced and opposed,” declared Solomon.

    Dr Ramzy Baroud, author, a syndicated columnist, editor of Palestine Chronicle & a Senior Research Fellow at Center for Islam and Global Affairs (CIGA), told IPS a long-term narrative has served to explain Washington’s relationship with Tel Aviv: that the former is the latter’s benefactor and main backer, whether financially, military or politically.

    “The latest war on Gaza and the direct US involvement in this war are forcing us to rethink our perception of the US-Israeli relationship”, he said.

    “If we list everything that Washington has done to help Israel in carrying out and sustain its ongoing genocide in Gaza, we would need many hours explaining the degree of US involvement”.

    This includes the immediate blank check signed by Washington to justify any Israeli response to the October 7 operation, the dispatching of aircraft carriers, of hundreds of military airplanes, along with seemingly endless financial and other forms of support.

    So, this is no longer about a certain, fixed amount of money that Washington sends to Tel Aviv. It is also about 2,000 pounds bombs with the full knowledge of how and when these bombs would be used, with intelligence information as to where these bombs would be dropped, and the full political backing in justifying the devastating outcome once the bombs are dropped, he argued.

    “In other words, Washington is a direct partner in the Israeli war on Gaza. This realization shall have direct consequences, not only to US reputation in the Middle East, but in the short and even long-term US-Middle East strategies, including its military presence in Iraq, Syria, and elsewhere.”

    Palestinians, and millions around them, understand that they are also fighting a war against the US. They are not wrong, he said.

    Meanwhile, according to a breaking story in the New York Times last week, the US State Department is pushing through a government sale to Israel of 13,000 rounds of tank ammunition, bypassing a congressional review process that is generally required for arms sales to foreign nations.

    The State Department notified congressional committees at 11 p.m. last Friday that it was moving ahead with the sale, valued at more than $106 million, even though Congress had not finished an informal review of a larger order from Israel for tank rounds.

    The department invoked an emergency provision in the Arms Export Control Act, the State Department official and a congressional official told The New York Times. Both spoke on the condition of anonymity because of the sensitivities over the sales. The arms shipment has been put on an expedited track, and Congress has no power to stop it.

    The Defense Department posted a notification of the sale before noon on Saturday. It said Secretary of State Antony J. Blinken had informed Congress on Friday that “an emergency exists that requires the immediate sale.”

    It is the first time that the State Department had invoked the emergency provision for an arms shipment to the Middle East since May 2019, when Secretary of State Mike Pompeo approved weapons sales to Saudi Arabia and the United Arab Emirates, a move that was criticized by lawmakers and some career officials inside the State Department, according to the Times.

    The State Department has used the emergency provision at least two times since 2022 to rush arms to Ukraine for its defense against Russia’s invasion.

    But in the case of the Israel-Gaza war, there has been growing condemnation in the United States and abroad of the way Israel is carrying out its offensive. The State Department’s decision to bypass Congress appeared to reflect an awareness of some Democratic lawmakers’ criticism of the Biden administration for supplying arms to Israel with no conditions or scrutiny, the Times said.

    Across the Gaza Strip, almost the entire population – 1.9 million people – have been displaced. Nearly two in three homes are now damaged or destroyed. Amid relentless air, land and sea attacks, thousands of families are forced to relocate from one perilous zone to another.

    Today, more than 750,000 people are crowded into just 133 shelters. Tens of thousands live on the streets of southern Gaza, where, under bombardment, they are forced to improvise basic shelters from whatever they can get hold of.

    The winter rains have arrived and so have infectious diseases, just as public health services have been utterly paralysed. Many of my own NRC staff members now live on the streets. One of them does so with her two-month-old baby.

    Our colleagues in Gaza ask themselves a simple question: how is it that these atrocities are beamed across the world for all to witness, and yet so little is done to stop them?

    Countries supporting Israel with arms must understand that these civilian deaths will be a permanent stain on their reputation. They must demand an immediate ceasefire in Israel and Gaza. Only a cessation of hostilities will allow us to ensure effective relief to the two million who now require it.

    Severe restrictions on aid access have aggravated the situation, leading to starvation among Gaza’s population, intensifying an already dire humanitarian crisis. We have been forced to halt nearly all of our aid operations due to the bombardment, the chaos, and the panic.

    There must be accountability for those responsible for the killings, the torture, and the atrocities committed in Israel on October 7th.

    The killing of thousands of innocent children and women, the siege on an entire civilian population, and the trapping of bombarded civilians behind closed borders in Gaza are also crimes under international law.

    There must also be accountability for this, from political and military leaders as well as those who provided arms and support. This military campaign can in no way be described as ‘self-defense.’

    We again demand that all hostages are immediately and unconditionally released. Neither the lives of innocent children, women or men, nor the ability of aid workers to access the vulnerable, should be used as bargaining chips.

    The situation in Gaza is a total failure of our shared humanity. The killing must stop.

    But since the resumption of hostilities in Gaza on 1 December, 700 Palestinians have reportedly been killed in addition to the 15,500 already killed. Israeli military operations have expanded into southern Gaza, forcing tens of thousands of others into increasingly compressed spaces, desperate to find food, water, shelter and safety.

    Nowhere is safe in Gaza and there is nowhere left to go.

    The conditions required to deliver aid to the people of Gaza do not exist. If possible, an even more hellish scenario is about to unfold, one in which humanitarian operations may not be able to respond.

    What we see today are shelters with no capacity, a health system on its knees, a lack of clean drinking water, no proper sanitation and poor nutrition for people already mentally and physically exhausted: a textbook formula for epidemics and a public health disaster.

    The quantities of relief supplies and fuel allowed in are utterly insufficient. Despite the enormous efforts of the Egyptian and Palestinian Red Crescent Societies, UN agencies and other partners, the use of only the Rafah crossing – meant for pedestrians – to bring in trucks of goods does not work.

    Humanitarian operations cannot be kept on a drip feed of fuel. It is the foundation of social services and our operations; including for hospitals, desalination plants, clean drinking water and sanitation.

    Space for the humanitarian response allowed inside Gaza is constantly shrinking. The two most important routes – the coastal road and Salahaddin road – are now cut off to our teams and trucks, hindering our ability to help people wherever they are.

    The UN and NGOs alone cannot support a population of 2.2 million. Commercial and public sectors must be allowed to bring supplies into Gaza to restock markets. This must include fuel in a manner which ensures Israel’s security.

    Announcements of establishing so-called safe zones and tented cities without assurances that people will be able to move freely and that assistance can be delivered where there is need are alarming. These zones cannot be safe nor humanitarian when unilaterally declared.

    The UN stands ready to work with all parties to expand the number of UN-managed safe shelters and to deliver assistance where it is needed.

    Under Prime Minister Netanyahu’s leadership, Israel-Jordan relations have hit a new low. Sadly, after 30 years of peace, there is deep sullenness and disappointment between the two countries. The aspiration for strategic partnership has fallen short, except for security collaboration. Jordan’s King Abdallah and Netanyahu do not see eye-to-eye on many issues.

    The King views Netanyahu as particularly responsible for the deterioration of the relationship between the two countries. Of specific concern to Jordan is the Israeli government’s brutal treatment of the Palestinians in the West Bank, its worries about any change in its status as the guardian of the holy Muslim shrines (Haram al-Sharif), and its concerns over the limits of the bilateral economic relations.

    What has added significant insult to the already injured relationship is the tragically inadvertent carnage and destruction being inflicted on the Palestinians in Gaza as a result of the Israel-Hamas war.

    For Jordan, the future resolution to the Palestinian conflict is the most contentious because whatever happens to the Palestinians, especially in the West Bank, has a direct and indirect impact on Jordan’s security, economy, and demographics due to its proximity and also because half of the population is of Palestinian origin.

    Netanyahu made hardly any effort to address King Abdallah’s justifiable worries about the rapidly deteriorating security conditions in the West Bank. Since the Israel-Hamas war began on October 7th, nearly 220 Palestinians have been killed in the West Bank as of this writing, and there is no sign that the violence will abate any time soon.

    Indeed, the absurdity here is that given that Jordan has been at peace with Israel since 1995, its proximity to Israel, and its mutual concerns over the region’s stability, the need for full cooperation on intelligence sharing, commercial ties, and national security become ever more critical.

    But then, Netanyahu has taken Jordan for granted when, in fact, Amman remained faithful to its collaborative efforts with Israel and continues to play a critical role in monitoring and securing the approximately 300-mile-long border with Israel to prevent the smuggling of weapons and infiltration of terrorists into Israel proper and the West Bank.

    The Israel-Hamas war has enormously changed the political dynamic of the Jordanian-Israeli relationship. Although Jordan expressed sympathy toward the Israelis for the unimaginable butchery that Hamas inflicted on innocent Israeli civilians, Israel’s invasion of Gaza and the horrendous destruction and death have enraged the Jordanians to a level unseen between the two countries since they signed a peace treaty in 1994.

    More than 50 percent of the Jordanian population are of Palestinian origin and have a strong affinity to their brethren wherever they reside. The death of more than 14,000 Palestinians in Gaza, including nearly 6,000 children and 4,000 women, caused an unparalleled stir in Jordan, damning Israel and demanding an immediate end to the hostilities. In fact, out of sympathy and solidarity, many Jordanian youth have chosen to adopt “Hamas ideology.”

    The UN Jordanian delegation presented a resolution to the United Nations General Assembly (UNGA) calling for an “immediate, permanent, and sustainable humanitarian truce leading to a cessation of hostilities,” which was adopted by 120 countries. On November 1st, Jordan’s Foreign Minister Ayman Al-Safadi recalled Jordan’s Ambassador to Israel, saying that his decision was an “expression of Jordan’s rejection and condemnation of the raging war in Gaza, which is killing innocent people and causing an unprecedented human catastrophe.”

    Jordan considers the forced evacuation and displacement of Palestinians in Gaza as equivalent to a war against civilians that will fundamentally shake the bilateral Israeli-Jordanian relations, mainly because Jordan has the largest Palestinian refugee population of any other country, which makes it extraordinarily sympathetic and sensitive to the Palestinian cause.

    Of particular concern to the Jordanian government is that the Netanyahu government is determined to deny the Palestinians the right to statehood, which will have a significant impact on Jordan domestically. What worries the Hashemite Kingdom is that some ministers in the current Israeli government are resuscitating the notion that Jordan is Palestine by their actions in the West Bank.

    Although Netanyahu knows how sensitive the Jordanian government is about this momentous issue, he has done nothing to assuage the Jordanians’ growing anxieties that the West Bank Palestinians will be entirely pushed into Jordan.

    Amman can play a significant regional diplomatic role in stemming the escalation of the conflict, especially in the West Bank, before it spins out of control. Jordan, the most stable country with moderate political leadership in a region reddened with violent conflicts, has and continues to serve along with Israel as the cornerstone of the US-Middle East security partnership, which both countries must guard with zeal.

    There are several necessary measures that the Israeli government must take to alleviate and mend past and present Jordanian grievances and restore and further improve their bilateral relationship, which would best serve their national interests.

    First, given Jordan’s direct and indirect involvement with the Palestinians, Israel must not ignore Jordan’s concerns over the violent clashes between the Israeli settlers and security forces and the Palestinians. Recently, the increasing violence in the West Bank compelled Jordan to strengthen its border security to prevent the escalation of violence from spilling over into its territory.

    Nevertheless, it could precipitate an influx of Palestinians into Jordan, which Amman wants to avoid. Israel must restate in an unmistakable tone that it respects Jordan’s sovereignty, and any resolution to the Israeli-Palestinian conflict will be separate and apart from and would not infringe in any way on Jordan’s independence, which Israel recognizes.

    Second, Israel must commit to continuing water and gas supplies to Jordan without interruption. This is critical for restoring Jordan’s confidence in any Israeli government, which has been dangerously eroding under Netanyahu. The “Blue and Green Prosperity” project, financed by the UAE and signed in August 2023, enables the exchange of Israeli desalinated water for Jordanian solar energy. This is a significant project for Jordan and must be guarded and fully implemented under any circumstance.

    Third, although the collaborative security ties and intelligence sharing between Jordan and Israel remain close, the Israeli government must ensure their security collaboration stays intact and robust. Israel must also carefully address Jordan’s unique security needs given the continuing regional tension and the threats of extremist militant groups, as well as its concerns over Iranian threats, which Israel shares. Amman needs to feel assured that Israel has Jordan’s back.

    Fourth, Israel must assure Jordan that under no circumstances would it seek or facilitate any change in the custodianship and the administrative responsibility of Jordan over the Muslim holy shrines (Haram al-Sharif) in Jerusalem. From the Jordanian perspective, the current arrangement gives it a strategic basis that allows it to have a say in any future agreement with the Palestinians in connection with Jerusalem. Although Saudi Arabia aspires to assume that role, Israel should honor its agreement with the Hashemite Kingdom from the time Israel annexed East Jerusalem in 1967.

    Fifth, Israel ought to strengthen its economic ties with Jordan by expanding the import-export of goods and services, encouraging Israelis to invest in Jordan, especially in the technological sector, and increasing tourism once the Israel-Hamas war comes to an end and the anti-Israeli Jordanian public sentiment subsides.

    The current Netanyahu or any future Israeli government must stop short of nothing to safeguard its ties and constantly improve its relations with Jordan—Israel’s most important Arab ally, partner for peace, and its closest neighbor. Since they have a strong mutual national security interest and strategic alliance, Israel should work hand-in-hand with Jordan in the search for a resolution to the Israeli-Palestinian conflict because it will directly affect Jordan’s national interest on every front.

    To be sure, given the Israel-Hamas war, which makes it impossible nor desirable to restore the status quo ante, it is now more urgent than any time before for Israel and Jordan to mitigate their differences, strengthen their strategic alliance, and find common ground on how to resolve the Israeli-Palestinian conflict.

    There are also numerous accounts of sexual violence during the attacks that must be vigorously investigated and prosecuted. Gender-based violence must be condemned. Anytime. Anywhere.

    According to the de facto authorities, more than 14,000 people have been killed since the start of the Israeli military operations in Gaza. Tens of thousands of Palestinians have also been injured, with many more missing. In Gaza, more than two-thirds of those killed are reported to be children and women.

    In a matter of weeks, a far greater number of children have been killed by Israeli military operations in Gaza than the total number of children killed during any individual year, by any party to a conflict since I have been Secretary-General – as clearly indicated in the annual reports on Children and Armed Conflict that I have submitted to the Council.

    Over the past few days, the people of the Occupied Palestine Territory and Israel have finally seen a glimmer of hope and humanity in so much darkness.
    It is deeply moving to see civilians finally having a respite from the bombardments, families reunited, and lifesaving aid increasing.

    Resolution 2712 “demands that all parties comply with their obligations under international law, including international humanitarian law, notably with regard to the protection of civilians, especially children.”

    It is clear that before the pause, we witnessed serious violations. Beyond the many civilians killed and wounded that I spoke of, eighty percent of Gaza’s people have now been forced from their homes.

    This growing population is being pushed towards an ever-smaller area of southern Gaza. And, of course, nowhere is safe in Gaza. Meanwhile, an estimated 45 percent of all homes in Gaza have been damaged or destroyed.

    The nature and scale of death and destruction are characteristic of the use of wide-area explosive weapons in populated areas, with a significant impact on civilians.

    At the same time, rocket attacks on population centres in Israel by Hamas and other groups have continued – along with allegations of the use of human shields This is also inconsistent with international humanitarian law obligations.

    I want to stress the inviolability of United Nations facilities which today are sheltering more than one million civilians seeking protection under the UN flag.

    UNRWA shares the coordinates of all its facilities across the Gaza Strip with all parties to the conflict. The agency has verified 104 incidents that have impacted 82 UNRWA installations – 24 of which happened since the adoption of the resolution.

    A total of 218 internally displaced people sheltering in UNRWA schools have reportedly been killed and at least 894 injured. In addition, it is with immense sadness and pain that I report that since the beginning of the hostilities, 111 members of our UN family have been killed in Gaza.

    This represents the largest loss of personnel in the history of our organization. Let me put it plainly: Civilians – including United Nations personnel – must be protected.

    Civilian objects – including hospitals – must be protected.

    UN facilities must not be hit. International humanitarian law must be respected by all parties to the conflict at all times.

    Security Council resolution 2712 calls “for urgent and extended humanitarian pauses and corridors throughout the Gaza Strip …to enable …full, rapid, safe, and unhindered humanitarian access.”

    I welcome the arrangement reached by Israel and Hamas – with the assistance of the governments of Qatar, Egypt and the United States. We are working to maximize the positive potential of this arrangement on the humanitarian situation in Gaza.

    The pause has enabled us to enhance the delivery of aid into and across Gaza. For example, for the first time since 7 October, an inter-agency convoy delivered food, water, medical supplies, and shelter items to northern Gaza – specifically to four UNRWA shelters in Jabalia camp.

    Prior to this, minimal or no assistance had reached these locations – even as tens of thousands of people had crowded there for shelter. Also, for the first time, supplies of cooking gas entered Gaza where people waited in lines that extended for two kilometres.

    In the south, where the needs are dire, UN agencies and partners have increased both the amount of aid delivered, and the number of locations reached.

    I express my appreciation to the Government of Egypt for their contribution in making this assistance possible. But the level of aid to Palestinians in Gaza remains completely inadequate to meet the huge needs of more than two million people.

    And although the total volume of fuel allowed into Gaza has also increased, it remains utterly insufficient to sustain basic operations. Civilians in Gaza need a continuous flow of life-saving humanitarian aid and fuel into and across the area.

    Safe and unimpeded humanitarian access to all those in need is critical. Humanitarian partners carried out several medical evacuations from north to south Gaza, including to transport dozens of premature babies as well as spinal and dialysis patients from Shifa and Al-Ahli Anglican hospitals.

    Several critically ill patients have also been evacuated for treatment in Egypt. Hospitals across Gaza lack the basic supplies, staff and fuel to deliver primary health care at the scale needed, let alone safely treat urgent cases.

    The medical system has broken down under the heavy caseload, acute shortages, and the impact of hostilities.

    Security Council resolution 2712 calls for “the immediate and unconditional release of all hostages held by Hamas and other groups.” The arrangement announced on 22 November has so far led to the release, over 5 days, of 60 hostages – 29 women, 31 children – held by Hamas and other groups since 7 October.

    Outside the arrangement during the same period, another 21 hostages were released.
    This is a welcome start. But as I have been saying from day one, all hostages must be released immediately and unconditionally.

    Until then, they must be treated humanely and the International Committee of the Red Cross must be allowed to visit them. The arrangement also saw the release of 180 Palestinian prisoners and detainees from Israeli jails, mostly women and children.

    Security Council resolution 2712 “calls on all parties to refrain from depriving the civilian population in the Gaza Strip of basic services and humanitarian assistance indispensable to their survival, consistent with international humanitarian law.”

    Much, much more is required to begin to address human needs in Gaza. Water and electricity services must be fully restored. Food systems have collapsed and hunger is spreading, particularly in the north.

    Sanitary conditions in shelters are appalling, with few toilets and sewage flooding, posing a serious threat to public health. Children, pregnant women, older people and those with weakened immune systems are at greatest risk.

    Gaza needs an immediate and sustained increase in humanitarian aid including food, water, fuel, blankets, medicines and healthcare supplies. It is important to recognize that the Rafah border crossing does not have enough capacity, especially taking into account the slow pace of security procedures.

    That is why we have been urging the opening of other crossings, including Kerem Shalom, and the streamlining of inspection mechanisms to allow for the necessary increase of lifesaving aid.

    But humanitarian aid alone will not be sufficient. We also need the private sector to bring in critical basic commodities to replenish completely depleted shops in Gaza.

    Finally, Security Council Resolution 2712 “underscores the importance of coordination, humanitarian notification, and deconfliction mechanisms, to protect all medical and humanitarian staff, vehicles, including ambulances, humanitarian sites, and critical infrastructure, including UN facilities.”

    A humanitarian notification system is now in place, and is being constantly reviewed and enhanced, including through plans for additional civil-military experts to support coordination.

    I welcome the adoption of resolution 2712 – but its implementation by the parties matters most. In accordance with the resolution, I will revert to the President of the Security Council with a set of options on effectively monitoring the implementation of the resolution.

    I have already established a working group composed of the Department of Political and Peacebuilding Affairs, the Department of Peace Operations, the Office for the Coordination of Humanitarian Affairs, and the Office of Legal Affairs to urgently prepare proposals in this regard.

    So far it is clear that implementation has been only partial at best, and is woefully insufficient. Ultimately, we know that the measure of success will not be the number of trucks dispatched or the tons of supplies delivered – as important as these are.

    Success will be measured in lives that are saved, suffering that is ended, and hope and dignity that is restored. The people of Gaza are in the midst of an epic humanitarian catastrophe before the eyes of the world.

    We must not look away. Intense negotiations are taking place to prolong the truce – which we strongly welcome — but we believe we need a true humanitarian ceasefire.

    And we must ensure the people of the region finally have a horizon of hope – by moving in a determined and irreversible way toward establishing a two-State solution, on the basis of United Nations resolutions and international law, with Israel and Palestine living side-by-side in peace and security.

    Failure will condemn Palestinians, Israelis, the region and the world, to a never-ending cycle of death and destruction.

    Like the Palestinians, Afghans have experienced the cruelty of armed conflict and occupation for decades. They know the painful cost of the endless wars waged by those who so casually destroy innocent lives in exchange for more power, revenge, or, as in the case of America’s post-9/11 response to Afghanistan, delusion that war can somehow defeat terrorism. In 2015, a U.S. gunship fired hundreds of shells into an M.S.F. trauma hospital in Kunduz, in northeastern Afghanistan because it had intelligence that Taliban fighters were based at the same location.

    Like Al Shifa Hospital’s S.O.S., those M.S.F. staff who survived the initial shelling desperately called military authorities in the area to call off the attack. Shelling continued for nearly an hour, and by the time it stopped, 34 men, women, children, patients, nurses, doctors, and M.S.F. support staff were killed, and dozens more seriously injured. Another casualty of the attack was the community. Before the hospital was destroyed, it had served as a lifeline for civilians wounded by the war raging around them but also as the only specialized surgical hospital in the region. It took six years for the hospital to reopen.

    Between 2001 and the day U.S. Forces chaotically left Afghanistan twenty years later, nearly 50,000 Afghan civilians were killed as a direct result of the U.S. and Coalition military occupation. Brown University’s The Cost of War Project and other independent sources, such as the Uppsala Conflict Data Program, have determined that the scope of direct and indirect deaths through injury, malnutrition, poor water sanitation, infectious disease, pregnancy and birth-related risks, and cancers left untreated as a result of destroyed public services and infrastructure. The U.S. led post 9-11 total civilian death toll in Afghanistan, Pakistan, Iraq, Yemen, Syria and Libya was an unfathomable 4 million people and a staggering 40 million people displaced by the fighting.

    Despite the lingering scars of war and the dire humanitarian crisis facing Afghans today, the hearts of Afghans are with Gazans and with all those citizens of the world from Washington DC to London, Mexico City to Istanbul, who are crying out for a cease-fire and sense of humanity to prevail amidst world leaders. This heartbreaking, cruel moment transcends borders.

    The collective punishment of the Palestinian people by Israel in retaliation for the actions of Hamas, with the unconditional diplomatic backing and financial and military support of the United States and many European nations, is now a collective pain felt across the world, irrespective of nationality, religion, ethnicity, or class.

    When President Biden visited Israel on 18 October, he said, “I caution this: While you feel rage, don’t be consumed by it…After 9/11, we were enraged in the United States. And while we sought justice and got justice, we also made mistakes.” Instead, Washington, the U.K., and E.U. leaders have wasted precious time and lives arguing for humanitarian pauses while giving Israel the green light to continue its slaughter of civilians throughout the Gaza Strip.

    The scope of the human catastrophe so far could have been prevented had President Biden backed up his advice to Israel with immediate humanitarian action for the Palestinian people and support through the several law enforcement and diplomatic options at Israel’s disposal to expedite the release of the 240 Israeli hostages and reinforce Israel’s border security from further Hamas attacks.

    In the face of such inhumanity, President Biden’s ultimate mistake now would be continuing to ignore his advice to Israel. As Yonatan Zeigen, the son of 74 Vivian Silver, a lifelong peace activist, murdered by Hamas at Kibbutz Be’eri on October 7th, said this week, “Israel won’t cure our dead babies by killing more babies.”

    It has been 12 brutal days and nights since those in power ignored the S.O.S. by the director of Al-Shifa Hospital. The I.D.F. forces stormed the hospital soon after the director’s urgent humanitarian appeal to the world. All of Al Shifa’s 22 intensive care patients have died, and another 30 patients, including three premature babies, have also died. Mohammed Abu Salmiya made another call to the world. This time, he said Al Shifa was “no longer a hospital but a graveyard” and reminded world leaders that civilians and civilian infrastructure such as hospitals are protected by international law and, if not the law, then by one’s sense of decency and humanity. So far, the response to Al Shifa’s Director from Washington and some E.U. members continues to be a surge in lethal military aid to Israel.

    The four-day humanitarian pause Qatar just announced needs to be reinforced by American and European demands on Israel for a definitive end to hostilities. The devastation of lives and infrastructure in Gaza is so vast and traumatic that a humanitarian pause immediately followed by a resumption of attacks on civilians by Israel and retaliations by Hamas will only lead to an abyss of more suffering for both Palestinians and Israelis and escalate the risk for a broader regional war.

    If only Western leaders, starting with President Biden, had as much courage as the director, staff, and patients of Al Shifa Hospital and the loved ones of those killed at Kibbutz Be’eri on 7 October.

    Unlike in Afghanistan, the time to stop the war is now, not after twenty years.

    “Under international humanitarian laws and the Safe Schools Declaration, civilians—in particular children, schools, and school personnel—must be protected. What we are seeing in this conflict are bombs pounding the most densely populated area on earth, schools and other civilian infrastructures being attacked, and an entire population being trapped in the most dire conditions, with no safe place to flee to. Surviving children are maimed, orphaned, or have lost close and extended family. Horrors of unimaginable proportion are unfolding before our eyes,” Yasmine Sherif, Executive Director of Education Cannot Wait, the UN global fund for education in emergencies and protracted crises, tells IPS.

    “No child can or should have to be prepared for what is happening in Gaza. Children and adolescents are hurting and traumatized. According to UNRWA, initial assessments in October showed that at least 91 percent of children are demonstrating signs of acute stress and trauma and are in need of Mental Health and Psychosocial Support (MHPSS).”

    According to the UN, children account for nearly half of the population in Gaza. More than 625,000 students and 22,564 teachers have been affected as attacks continue. At least 86 percent of school buildings are either being used as shelters for the displaced population, catering for up to four times their capacity, or have been destroyed.

    Camilla Lodi, Norwegian Refugee Council’s (NRC) Global Psychosocial Support Head of the Better Learning Programme, told IPS the impact of war on children was devastating.

    “When children experience conflict, war, and displacement, they go through personal, ongoing life threats—constantly witnessing violence and its effects. Prolonged exposure to such traumatic events increases the risk of complications in processing trauma. When the fighting stops, the journey to recovery starts for children and adults who have gone through high levels of stress and trauma. Mental Health and Psychosocial Support (MHPSS) is not a luxury but a necessity. It helps regain a sense of normalcy,” she said.

    “NRC works specifically on a psychosocial support program within broader education in emergency interventions. Simply, children cannot learn unless they feel well and safe. MHPSS is an essential, necessary, and mandatory intervention that should be embedded in every education in emergency programs. The Better Learning Programme (BLP) is NRC’s signature non-specialized classroom-based psychosocial support intervention that helps restore learning capacities for children that have gone through trauma and high levels of stress.”

    The program has been at the forefront of providing immediate and long-term critical care and psychosocial support for more than a decade, investing in children’s futures in 33 countries, such as Ukraine, Sudan, and Palestine. Lodi stresses that MHPSS is critical in crises and emergencies.

    Sherif stresses that as homes and schools lie in ruin in this high-level stress cycle, surviving children are at risk of severe lifelong mental health problems. A life of debilitating chronic anxiety, depression, and various degrees of trauma now beckons for more than 224 million children and adolescents in conflict and crises globally. She adds that Education Cannot Wait, which supports education programs for children in over 40 countries affected by emergencies and protracted crises, has included MHPSS as a core component of all its country-level investments since 2020. This includes support for the NRC’s Better Learning Programme.

    “ECW has prioritized MHPSS to protect and promote students’ and teachers’ well-being, as mental health is the foundation of learning. We have a target to invest at least 10 percent of our resources for mental health and psychosocial support services,” says Sherif.

    ECW recently announced a $10 million 12-month grant in support of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) and UNICEF to provide children in Gaza with life-saving mental health and psychosocial support.

    “For Gaza specifically, it is a humanitarian catastrophe defined by a relentless cycle of violence. Past research within the Better Learning Programme found that 1093 students (6–17 years of age) who sought help for nightmares and sleep disturbances reported recurrent traumatic nightmares on average 4.57 nights per week, with an average duration of 2.82 years,” Lodi says.

    “We always talk about the cost of inaction. Neglecting MHPSS can result in five significant risks, notably the perpetuation of cycles of violence and trauma. As a conflict concludes, the suffering and psychological impact on children commence and, if left unaddressed, can endure throughout their lives. This neglect also results in the loss of educational and developmental milestones, increasing susceptibility to mental health disorders. Additionally, the diminishing sense of community connectedness, a stabilizer for peace, is compromised. There is also an economic fallout, as increased healthcare costs and long-term productivity losses contribute to a substantial financial and economic impact.”

    Lodi stresses that no child should pay the price of adults’ conflict and that a ceasefire is urgent to help re-establish a sense of safety and predictability and for children to resume recreational play and education activities in a safe environment, which will allow a safe break for their body in “emergency, flight mode.”

    “The catastrophic humanitarian situation in Gaza cannot continue. All parties must respect the UN Charter, international humanitarian law, and universal human rights. I join my colleagues in the United Nations’ call for an immediate humanitarian ceasefire now,” says Sherif.

    If soul-shattering human suffering is not halted and safety restored, Sherif says our moral standing as an international community will be questioned by the young generation today and for generations to come. How can we make promises to children in crisis during this World Children’s Day, whose theme is For Every Child, Every Right? Children everywhere in the world, including more than 224 million crisis-affected children, deserve every right and promise delivered despite, and especially because, of their hardships.

    According to the Congressional Research Service (CRS), the US has provided more foreign assistance to Israel since World War II than to any other country.

    The Stockholm International Peace Research Institute (SIPRI) documented that the United States supplied 79 percent of all weapons transferred to Israel from 2018-2022.

    No one else was even close – the next closest suppliers were Germany with 20 percent and Italy with just 0.2 percent.

    A Fact Sheet released October 2023, by the US State Department’s Bureau of Political-Military Affairs, provides a detailed official breakdown on the unrestrained American security assistance to Israel.

    Steadfast support for Israel’s security has been a cornerstone of American foreign policy for every U.S. Administration since the presidency of Harry S. Truman.

    Since Israel’s founding in 1948, the State Department said, the United States has provided Israel with over $130 billion in bilateral assistance focused on addressing new and complex security threats, bridging Israel’s capability gaps through security assistance and cooperation, increasing interoperability through joint exercises, and helping Israel maintain its Qualitative Military Edge (QME).

    This assistance, says the State Department, has helped transform the Israel Defense Forces (IDF) into “one of the world’s most capable, effective militaries and turned the Israeli military industry and technology sector into one of the largest exporters of military capabilities worldwide.”

    In the current war, Israel’s overwhelming fire power has resulted in the killings of thousands of Palestinian civilians in Gaza and the destruction of entire cities—mostly with US supplied weapons.

    Dr. Natalie J. Goldring, a Visiting Professor of the Practice in the Sanford School of Public Policy at Duke University, told IPS the October 7 Hamas attacks were horrendous acts and should be condemned as such.

    “Even so, the Israeli responses to those attacks have been indiscriminate – intentionally so,” she said.

    Two days after the Hamas attacks, Israeli defense minister Yoav Gallant declared that Israel would carry out a “complete siege” of Gaza, including blocking the supply of water, food, and fuel, while also stopping the supply of electricity. And Israeli forces have done so, she pointed out.

    “The US government bears a special responsibility for the continuing Israeli attacks. It has supplied Israel with massive quantities of military aid and weaponry, and Israel has ignored US restrictions on the use of those weapons”.

    This supply of weapons and ammunition allows the Israeli military to continue its indiscriminate attacks in Gaza,” said Dr Goldring, who also represents the Acronym Institute at the United Nations, on conventional weapons and arms trade issues.

    “A key first step in reducing the human cost of this war is for the US government to call for an immediate ceasefire. The US government should also halt supplies of weapons and ammunition to Israel, whether from the US itself or from prepositioned stocks elsewhere.”

    Since 1983, the United States and Israel have met regularly via the Joint Political-Military Group (JPMG) to promote shared policies, address common threats and concerns, and identify new areas for security cooperation.

    According to the State Department, Israel is the leading global recipient of Title 22 U.S. security assistance under the Foreign Military Financing (FMF) program. This has been formalized by a 10-year (2019-2028) Memorandum of Understanding (MOU).

    Consistent with the MOU, the United States annually provides $3.3 billion in FMF and $500 million for cooperative programs for missile defense. Since FY 2009, the United States has provided Israel with $3.4 billion in funding for missile defense, including $1.3 billion for Iron Dome support starting in FY 2011.

    Through FMF, the United States provides Israel with access to some of the most advanced military equipment in the world, including the F-35 Stealth fighter aircraft.

    Israel is eligible for Cash Flow Financing and is authorized to use its annual FMF allocation to procure defense articles, services, and training through the Foreign Military Sales (FMS) system, Direct Commercial Contract agreements – which are FMF-funded Direct Commercial Sales procurements – and through Off Shore Procurement (OSP).

    Via OSP the current MOU allows Israel to spend a portion of its FMF on Israeli-origin rather than U.S.-origin defense articles. This was 25 percent in FY 2019 but is set to phase-out and decrease to zero in FY 2028.

    Elaborating further Dr Goldring said: “Unfortunately, the situation in Gaza bears similarities to the documented uses of US weapons by the Saudi-led coalition in attacks on civilians in Yemen”

    She said: “Our response should be the same in both cases. These countries have failed to honor the conditions of US weapons transfers, and should be ineligible for further transfers until they are in compliance.”

    “US arms transfer decision-making gives too much weight to the judgment of government officials and politicians who frequently fail to consider the full human costs of these transfers,” she argued.

    “Earlier this year, the Biden Administration released a new Conventional Arms Transfer policy. They claimed that arms transfers would not be approved when their analysis concluded that “it is more likely than not” that the arms transferred would be used to commit or facilitate the commission of serious violations of international humanitarian or human rights law.”

    The actions of the Israeli and Saudi militaries are examples of ways in which this standard is not being met, declared Dr Goldring.

    As of October 2023, the United States has 599 active Foreign Military Sales (FMS) cases, valued at $23.8 billion, with Israel. FMS cases notified to Congress are listed here; priority initiatives include: F-35 Joint Strike Fighter Aircraft; CH-53K Heavy Lift Helicopters; KC-46A Aerial Refueling Tankers; and precision-guided munitions.

    From FY 2018 through FY 2022, the U.S. has also authorized the permanent export of over $5.7billion in defense articles to Israel via the Direct Commercial Sales (DCS) process.

    The top categories of DCS to Israel were XIX-Toxicological Agents, including Chemical Agents, Biological Agents, and Associated Equipment (this includes detection equipment ((f)), vaccines ((g)-(h)) and modeling software ((i)); IV- Launch Vehicles, Guided Missiles, Ballistic Missiles, Rockets, Torpedoes, Bombs, and Mines; and VII- Aircraft.

    Since 1992, the United States has provided Israel with $6.6 billion worth of equipment under the Excess Defense Articles program, including weapons, spare parts, weapons, and simulators.

    U.S. European Command also maintains in Israel the U.S. War Reserve Stockpile, which can be used to boost Israeli defenses in the case of a significant military emergency.

    In addition to security assistance and arms sales, the United States participates in a variety of exchanges with Israel, including military exercises like Juniper Oak and Juniper Falcon, as well as joint research, and weapons development.

    The United States and Israel have signed multiple bilateral defense cooperation agreements, to include: a Mutual Defense Assistance Agreement (1952); a General Security of Information Agreement (1982); a Mutual Logistics Support Agreement (1991); and a Status of Forces Agreement (1994), according to the State Department.

    Since 2011, the United States has also invested more than $8 million in Conventional Weapons Destruction programs in the West Bank to improve regional and human security through the survey and clearance of undisputed minefields.

    Following years of negotiations with the Palestinians and Israelis, humanitarian mine action activities began in April 2014 – this represents the first humanitarian clearance of landmine contamination in nearly five decades.

    Israel has also been designated as a U.S. Major Non-NATO Ally under U.S. law. This status provides foreign partners with certain benefits in the areas of defense trade and security cooperation and is a powerful symbol of their close relationship with the United States.

    In Gaza, more than 11,000 civilians have been killed since early October. Children are perishing at an average rate of 10 deaths per hour. The ongoing slaughter by Israeli forces — supported by huge military aid from the United States — follows Hamas’s atrocities on Oct. 7 in Israel, where the latest estimate of the death toll is 1,200 including at least 846 civilians in addition to some 200 hostages.

    But numbers don’t get us very far in human terms. And news accounts have limited capacities to connect with real emotions.

    That’s where poetry can go far beyond where journalism fails. A few words from a poet might chip away at the frozen blocks that support illegitimate power. And we might gain strength from the clarity that a few lines can bring.

    Stanley Kunitz wrote:

    In a murderous time
    the heart breaks and breaks
    and lives by breaking.
    It is necessary to go
    through dark and deeper dark
    and not to turn.

    “In a dark time,” Theodore Roethke wrote, “the eye begins to see.”

    Bob Dylan wrote lines that could now be heard as addressing Prime Minister Benjamin Netanyahu and President Biden:

    You fasten all the triggers
    For the others to fire
    Then you sit back and watch
    When the death count gets higher
    You hide in your mansion
    While the young people’s blood
    Flows out of their bodies
    And is buried in the mud

    June Jordan wrote:

    I was born a Black woman

    In the United States, far away from the carnage, viewers and listeners and readers can easily prefer not to truly see that “their” government is helping Israel to keep killing thousands upon thousands of Palestinian children and other civilians. “I call it cruel and maybe the root of all cruelty / to know what occurs but not recognize the fact,” a poem by William Stafford says.

    After more than a month of fighting, the reported numbers of deaths are evolving and being constantly revised and updated as the war has continued.

    The estimated numbers of deaths between 7 October and 13 November provide a preliminary assessment of the extent of the death toll for Israelis and Palestinians in the Gaza Strip as well as for others (Table 1).

    According to the Israeli officials, the revised number of Israeli deaths – with about 70 percent of them having been identified as civilians – resulting from the Hamas attack in southern Israel is estimated at approximately 1,200.

    Those killed in Israel on 7 October also include some foreigners and dual nationals. At least 31 U.S. citizens, 39 French citizens and 34 Thai citizens were killed during the attacks, according to authorities in those countries. The Israeli military has also reported that 1,500 Hamas fighters were killed during the 7 October attack.

    On the 7 October attack, Israeli authorities have reported that more than 240 individuals from more than 40 countries, including young children and the elderly, were taken hostage and believed to be held by Hamas and other Palestinian armed groups in Gaza.

    An estimated 20 hostages are reported to have subsequently died as a result of the conflict. In addition to those estimated deaths, at least 46 Israeli soldiers are reported to have been killed in combat since the ground invasion began.

    With a total population of approximately 9.8 million, the Israeli death rate resulting from the current Israel-Hamas conflict is approximately 13 deaths per 100,000 population.

    In response to the 7 October Hamas attack, the death toll in the Gaza Strip from Israeli military operations is estimated as of 13 November at 11,240 Palestinians with an estimated 4,630 being children, according to health officials in Gaza.

    However, the number of deaths in the Gaza Strip could even be higher than being cited, given its dense confines and with approximately 2,700 people reported missing.

    With an estimated total population of 2.2 million in the Gaza Strip, the Palestinian death rate for the population of Gaza due to the Israeli-Hamas conflict is approximately 510 deaths per 100,000 population.

    Besides the Israeli and Palestinian deaths in Israel and Gaza since 7 October, others have been killed. Nearly 200 Palestinians in the West Bank are reported to have been killed amid an increase in Israeli military raids and incursions.

    Also, 101 employees of the United Nations have been killed since the Israeli-Hamas war began, according to the United Nations Palestinian refugee agency (UNRWA). The agency stressed that it is the deadliest conflict ever for the United Nations in such a short period of time.

    In addition, at least 42 journalists and media workers reporting on the conflict have been killed.

    The various estimated numbers of deaths resulting from the Israel-Hamas conflict that are presented above continue to be revised and updated. After the current Israel-Hamas hostilities have concluded, a comprehensive assessment will be necessary to provide a more accurate and detailed picture of those who have died as a result of the conflict.

    Tragically, the death toll resulting from the Israel-Hamas conflict is already too high. As some have remarked, far too many have been killed and far too many have suffered from this current round of fighting. Also importantly, as many around the world are urging, the time for Israelis and Palestinians to negotiate “???????“ ,“????”, or a “peace” solution is now.

    What Is Israel’s End-Game in Gaza?

    As the Israel-Hamas war grinds on, the international call for a ceasefire or at a minimum a pause in the fighting for a couple of days to allow for the delivery of badly needed necessities is absolutely essential at this juncture. It is glaringly evident that there is growing international sympathy towards the Palestinians, given the magnitude of destruction and loss of life.

    This humanitarian crisis of such incredible scale is overshadowing the unconscionable slaughter of 1,400 people in Israel and the kidnapping of 248 others. Sadly though, although Israel has the right to self-defense, the campaign to eradicate Hamas is increasingly resembling a war of revenge and retribution. It has caused tremendous destruction and human suffering.

    After only four weeks, nearly 11,000 in Gaza are dead, one-third of them children under the age of 18, there is a horrifying scarcity of food, medicine, water, and fuel, and nearly half the population is now internally displaced.

    This calamity is unfolding in front of our eyes and must stop, even temporarily, to help save the lives of many of the tens of thousands who are wounded, bury the dead, and avert wide-spread starvation. And even though a temporary cessation of hostilities benefits Hamas, it is still worth undertaking not only to alleviate the horrifying suffering of the entire population in Gaza, but also to open a window for negotiating the release of as many hostages as possible, especially all women and children, in exchange for the pause in fighting.

    Whereas Israel’s stated goal from the onset was and still justifiably is the destruction of Hamas, Israel has not offered as yet any clear exit strategy nor endgame. Once Hamas is completely defeated, which is still a tall order, Israel with the support of the US and Saudi Arabia in particular will have to offer a sound alternative that meets the Palestinians’ aspiration and render Hamas irrelevant.

    President Biden should demand that Prime Minister Netanyahu and his military brass develop, in coordination with the US, a clear exit strategy and an end-game consistent with Israel’s, the Palestinians’, and the US’ national interests.

    The protests that have taken place across major cities in the US over the weekend, including Washington, DC, are arguably some of the biggest that we’ve seen in a long time. These calls for a ceasefire or a pause in the fighting for humanitarian reasons are exerting pressure on Biden to change his near-unconditional support of Israel’s war efforts, which he can no longer ignore. This is particularly important because the US’ unwavering support of Israel makes the Biden administration complicit to the unfolding tragedy, which is intensely criticized from the ranks of leading Democrats as well.

    What should be the end game? I believe there are three possible scenarios, two of which are impractical in a sense that they will not lead to a permanent solution to the Israeli-Palestinian conflict.

    Israeli control over Gaza

    First, Netanyahu is claiming that he wants to maintain security over Gaza, but he’s not saying who will govern and administer the Strip. Does he want to reoccupy all of Gaza or just the northern half, which may explain why he wanted the Palestinians to head south. President Biden is very correct to suggest that the reoccupation of Gaza, be that in part or in full, will be nothing short of a disaster for Israel and will only guarantee the prolongation of the Israeli-Palestinian conflict.

    Moreover, it should be emphasized here that given Israel’s experience in the occupied West Bank, maintaining security was only marginally successful at best as evidenced by the continuing violence between Israeli forces and Palestinians, which has been increasingly escalating.

    Netanyahu is a fool to assume that he can maintain control over Gaza by establishing a security apparatus when the Hamas-affiliated militants in Gaza will subject the Israeli forces to terrorist attacks that will exact a heavy toll in blood and treasure. The violence in the West Bank will pale in comparison to what Hamas’ militants in Gaza will still be capable of doing against Israeli forces without an end in sight.

    Resettling Palestinians in Egypt

    The second option, which Netanyahu has been exploring with Egypt, would allow the settling of a few hundred thousand Palestinians in the Sinai; Egypt would assume administrative responsibility in Gaza while Israel maintains security. Egyptian President Sisi flatly rejected any future involvement with the Palestinians in Gaza, other than facilitating through the Rafah crossing the passage of people for justifiable reasons as well as the transfer of goods.

    The Egyptian government considers Hamas a branch of the Muslim Brotherhood, which is outlawed in Egypt. For this reason, Egypt has also blockaded Gaza to prevent the infiltration of Hamas militants into the country.

    Moreover, Egypt has troubles of its own. The economy is in a dire situation, and its concerns over security are mounting. Egypt simply does not want to add more to its domestic problems. Thus, they are not interested in any solution that will burden them with the Palestinians. That said, President Sisi was clear that regardless of how this war ends, a framework for a solution to the Israeli-Palestinian conflict must be established, otherwise it will be only a question of time when this war will invite another.

    Transitional period for Gaza with UN supervision

    The third option may well be more viable as it would entail a transitional period whereby the United Nations would assume responsibility. Administratively, as is well known, UNWRA has been on the ground for decades, providing aid and development services, including education, healthcare, microfinance, and job training.

    Although it has not been involved in the running of Gaza itself, UNWRA is very familiar with the scene in Gaza. It is familiar with the population’s needs, the prevailing socio-economic conditions, and the day-to-day problems Gazans face. UNWRA is in the best possible position to assume greater responsibility under a modified and expanded mandate, provided that it receives the manpower and the funding necessary.

    In conjunction with UNWRA’s added administrative responsibilities, it will be necessary to establish a peacekeeping force to be in charge of security. This force ought to be comprised exclusively of the Arab states that are at peace with Israel, namely the United Arab Emirates, Saudi Arabia, Jordan, Bahrain, and Morocco, as well as Egypt.

    It should be made clear that although post-Hamas the West Bank and Gaza should be governed by the Palestinian Authority (PA), this should not and in fact cannot happen for at least a year to 18 months following the establishment of a UN administrative authority in Gaza.

    During this period, the Palestinians in both the West Bank and Gaza would prepare themselves politically for a new election. The current PA is corrupt to the bone; President Abbas is rejected and despised by the majority of Palestinians and must go. Only a new, fresh, and uncorrupt newly-elected leadership that enjoys the confidence of the people can succeed.

    On the Israeli side, no one should hold their breath waiting for Netanyahu and his gang of zealous coalition partners to agree on anything that even resembles an independent Palestinian state. Once the war ends, Netanyahu will face an inquiry about the unprecedented disaster that took place under his watch and he will have to resign or be ousted. Here too, a new government will have to be established in Israel which must commit itself from the onset to a two-state solution.

    Once the above two prerequisites are in place, the UN administrative authority will then relinquish its role and responsibility to the PA.

    The Arab states should condition their commitment to provide a peacekeeping force upon Israel’s acceptance of a two-state solution. That is, once such a peacekeeping force is created, the process of peacebuilding ought to commence in earnest toward that end. Any interim solution must be used only as a vehicle toward a final resolution, otherwise it would serve as nothing less than a respite from waiting for another disaster to unfold.

    The role of the US and Saudi Arabia

    Saudi Arabia and the US can play a major, in fact indispensable, role in this regard: The US has and continues to be the ultimate guarantor of Israel’s national security, and President Biden has done more than any of his predecessors in this regard and demonstrated that in the most unambiguous way by his unflagging support of Israel.

    He must make it very clear (and is in a position to do so) to Netanyahu or his successor that the US’ unwavering support bears considerable political cost to America both domestically as well as internationally. Many countries around the world view the US as complicit to the unfolding horror in Gaza. President Biden must put in place a framework for a two-state solution, which he has been advocating for many decades.

    The negotiating peace process will certainly take more than year to complete. 2024 is an election year in the US, but regardless of who the next president might be, Biden will have to stick to the plans because another Israeli-Palestinian conflagration will inescapably involve the US. It’s time for the US to put its foot down, no longer give Israel carte blanche to do as it pleases, and condition further support, financial and military, to genuine efforts to negotiate in good faith and reach a peace agreement.

    Saudi Arabia can complement the US initiative with its own most significant role by seizing on the breakdown in the Israeli-Palestinian relations and offering an unprecedented breakthrough to bring an end to the conflict. The Saudis should make it clear that once the war ends, they will be ready to normalize relations with Israel on the condition that a new Israeli government agree to a two-state solution and negotiate continuously until an agreement is reached.

    This war must end, leaving Hamas dramatically weakened and in disarray. But Hamas’ ultimate defeat will not be on the battlefield, it will be by creating an alternative to Hamas’ governance from which the Palestinians will greatly benefit. That contrast ought to be made clearly and immediately to demonstrate to the Palestinians that Hamas was not only the enemy of Israel but the enemy of ordinary Palestinians. Yes, all Palestinians in Gaza want to live in peace and prosper but were deprived of living a normal life because of Hamas’ violent resistance to Israel, squandering every resource to fight Israel while leaving the people despairing and hopeless.

    Israel should not prolong this tragic war by even one unnecessary day. Indeed, if this war lasts another month or two, it is almost certain that 20,000 to 30,000 Palestinians, mostly innocent civilians, and scores of Israeli soldiers will be killed. The continuation of the terrifying death and destruction in Gaza along with Israeli losses will only deepen the hate, enmity, and distrust between Israel and the Palestinians and make a solution to the conflict ever more intractable.

    Every Israeli should ask him/herself the painful question: do we want to memorialize the death of 1,400 innocent Israelis butchered by Hamas by killing, however inadvertently, 20,000 Palestinians? Is that how the Israeli victims should be commemorated? This is something that every Israeli needs to think about.

    Yes, Israel can and will win every battle against Hamas, but it will lose the war unless a peace process between Israel and the Palestinians begins once the war comes to an end, under the auspices of the US and Saudi Arabia, which must lead to a two-state solution.

    A new report from UNDP and the UN Economic and Social Commission for West Asia (ESCWA) has projected the fallout of Palestine’s socioeconomic development as the conflict in Gaza enters its second month. Titled The Gaza War: Expected Socioeconomic Impacts on the State of Palestine, the joint report warns that the loss of life and infrastructure because of the conflict and military siege will have long- and short-term consequences on the entire state and will see a serious regression in development that would take years for the state to recover from. 

    Since October 7, military operations in the Gaza Strip have caused dramatic downward trajectories in the state’s economy, public infrastructure, and development.

    Rola Dashti, the Executive Secretary for UN-ESCWA, remarked on the “unprecedented deprivation of resources” since the conflict escalated. In a press briefing, she warned that this deprivation of resources, including public services, health, utilities, and freedom of movement, are emblematic of multidimensional poverty.

    Over 45 percent of housing has been destroyed by bombardments; 35,000 housing units have been totally destroyed, and 212,000 units have been partially damaged. Over 40 percent of education facilities have been destroyed, which has left over 625,000 students with no access to education.

    The report estimates that Palestine’s GDP is expected to decline by 4.2 percent within the first month of the war. A further loss of GDP is expected by 8-12 percent if the war continues into the second and third months. The poverty level is also expected to rise to 20-45 percent. These projections were predicted for the duration of the war, going on up to three months. As the economic value is largely centralized in the Gaza Strip and the West Bank, it will have a ripple effect across the region. Unemployment in Gaza was already an issue, with a rate of 46 percent, compared to 13 percent at the West Bank. Yet, since the start of the war, around 390,000 jobs have been lost. The continued military involvement has already caused disruptions to trade and the agriculture and tourism sectors.

    Other effects of the war, such as a reduction in trade and investments, will only further add to the overall insecurity of the State. There is also the risk that investors will take a more cautious approach when the region displays such volatility. The impact on neighboring countries would be to redirect resources from development to expanding security.

    Hospitals have been contending with repeated attacks since the start of the war while keeping operations going as supplies dwindle. Sixteen out of the 35 hospitals in Gaza have been forced to suspend their operations due to fuel shortages. This included Al-Awda Hospital in northern Gaza, the only hospital that was providing maternal health services, where 80 percent of its patients were women and children. On Wednesday night, a spokesperson announced that the hospital would be forced to close down operations due to fuel shortages.

    The threat to their safety and disruptions to education, healthcare, housing, and employment have already forcibly displaced over 1.5 million people in Palestine in just one month. The number of fatalities in this current conflict has now exceeded 10,000, including 4,104 children. It stands in stark contrast to the death toll during the major conflict in 2014, which capped at 2251. As Dashti told reporters, “There are faces behind these staggering numbers.”

    Assistant Secretary-General and Director of the Regional Bureau for the Arab States for UNDP Abdallah Al Dadari mourns the loss in overall human development. These compounding losses and setbacks will “bring back to 2005, in terms of development”, he said.

    Should a ceasefire be put into effect, even immediately, the time for recovery will be long and complex. Al Dadari remarked that rebuilding the lost infrastructure would be a challenge. He added that efforts toward a “top-down reconstruction” that did not include the participation and consideration of the Palestinian people would have “structural deformities” shortly thereafter. Many of the facilities, including hospitals, support centers, and schools, were established and supported by humanitarian organizations, such as UNRWA. Palestine is dependent on these facilities and on humanitarian assistance.

    The UN report concludes that post-war recovery efforts should take a different approach, one that will not only deal with the immediate humanitarian and economic needs of the affected civilians through funding. The root causes of the conflict and the tensions in the region must be addressed, Dashti said. With a guarantee from all involved parties, is there a possibility for what the UN calls sustainable peace?

    Such minor tactical discord does little to chip away at the solid bedrock alliance between the two countries, which are most of the way through a 10-year deal that guarantees $38 billion in U.S. military aid to Israel. And now, as the carnage in Gaza continues, Washington is rushing to provide extra military assistance worth $14 billion.

    Days ago, In These Times reported that the Biden administration is seeking congressional permission “to unilaterally blanket-approve the future sale of military equipment and weapons — like ballistic missiles and artillery ammunition — to Israel without notifying Congress.” And so, “the Israeli government would be able to purchase up to $3.5 billion in military articles and services in complete secrecy.”

    While Israeli forces were using weapons provided by the United States to slaughter Palestinian civilians, resupply flights were landing in Israel courtesy of U.S. taxpayers. Air & Space Forces Magazine published a photo showing “U.S. Air Force Airmen and Israeli military members unload cargo from a U.S. Air Force C-17 Globemaster III on a ramp at Nevatim Base, Israel.”

    Pictures taken on Oct. 24 show that the military cargo went from Travis Air Force Base in California to Ramstein Air Base in Germany to Israel. Overall, the magazine reported, “the Air Force’s airlift fleet has been steadily working to deliver essential munitions, armored vehicles, and aid to Israel.” And so, the apartheid country is receiving a huge boost to assist with the killing.

    The horrific atrocities committed by Hamas on Oct. 7 have opened the door to protracted horrific atrocities by Israel with key assistance from the United States.

    Oxfam America has issued a briefing paper decrying the Pentagon’s plans to ship tens of thousands of 155mm artillery shells to the Israeli military. The organization noted that “Israel’s use of this munition in past conflicts demonstrates that its use would be virtually assured to be indiscriminate, unlawful, and devastating to civilians in Gaza.”

    Oxfam added: “There are no known scenarios in which 155mm artillery shells could be used in Israel’s ground operation in Gaza in compliance with international humanitarian law.”

    During the last several weeks, “international humanitarian law” has been a common phrase coming from President Biden while expressing support for Israel’s military actions. It’s an Orwellian absurdity, as if saying the words is sufficient while constantly helping Israel to violate international humanitarian law in numerous ways.

    “Israeli forces have used white phosphorus, a chemical that ignites when in contact with oxygen, causing horrific and severe burns, on densely populated neighborhoods,” Human Rights Watch senior legal adviser Clive Baldwin wrote in late October. “White phosphorus can burn down to the bone, and burns to 10 percent of the human body are often fatal.”

    Baldwin added: “Israel has also engaged in the collective punishment of Gaza’s population through cutting off food, water, electricity, and fuel. This is a war crime, as is willfully blocking humanitarian relief from reaching civilians in need.”

    At the end of last week, the Win Without War organization noted that “senior administration officials are increasingly alarmed by how the Israeli government is conducting its military operations in Gaza, as well as the reputational repercussions of the Biden administration’s support for a collective punishment strategy that clearly violates international law. Many worry that the U.S. will be blamed for the Israeli military’s indiscriminate attacks on civilians, particularly women and children.”

    News reporting now tells us that Biden and Secretary of State Antony Blinken want a bit of a course correction. For them, the steady large-scale killing of Palestinian civilians became concerning when it became a PR problem.

    Dressed up in an inexhaustible supply of euphemistic rhetoric and double-talk, such immoral policies are stunning to see in real time. And, for many people in Gaza, literally breathtaking.

    Now, guided by political calculus, the White House is trying to persuade Israel’s prime minister to titrate the lethal doses of bombing Gaza. But as Netanyahu has made clear in recent days, Israel is going to do whatever it wants, despite pleas from its patron.

    While, in effect, it largely functions in the Middle East as part of the U.S. war machine, Israel has its own agenda. Yet the two governments are locked into shared, long-term, overarching strategic interests in the Middle East that have absolutely no use for human rights except as rhetorical window-dressing.

    Biden made that clear last year when he fist-bumped the de facto ruler of oil-rich Saudi Arabia, a dictatorship that — with major U.S. assistance — has led an eight-year war on Yemen costing nearly 400,000 lives.

    The war machine needs constant oiling from news media. That requires ongoing maintenance of the doublethink assumption that when Israel terrorizes and kills people from the air, the Israeli Defense Force is fighting “terrorism” without engaging in it.

    Another helpful notion in recent weeks has been the presumption that — while Hamas puts out “propaganda” — Israel does not. And so, on Nov. 2, the PBS NewsHour’s foreign affairs correspondent Nick Schifrin reported on what he called “Hamas propaganda videos.”

    Fair enough. Except that it would be virtually impossible for mainstream U.S. news media to also matter-of-factly refer to public output from the Israeli government as “propaganda.” (I asked Schifrin for comment, but my several emails and texts went unanswered.)

    Whatever differences might surface from time to time, the United States and Israel remain enmeshed. To the power elite in Washington, the bilateral alliance is vastly more important than the lives of Palestinian people. And it’s unlikely that the U.S. government will really confront Israel over its open-ended killing spree in Gaza.

    Consider this: Just weeks before beginning her second stint as House speaker in January 2019, Rep. Nancy Pelosi was recorded on video at a forum sponsored by the Israeli American Council as she declared: “I have said to people when they ask me — if this Capitol crumbled to the ground, the one thing that would remain is our commitment to our aid, I don’t even call it aid — our cooperation — with Israel. That’s fundamental to who we are.”

    Even making allowances for bizarre hyperbole, Pelosi’s statement is revealing of the kind of mentality that continues to hold sway in official Washington. It won’t change without a huge grassroots movement that refuses to go away.

    Against this backdrop, a leading human rights organization, is appealing to Israel’s key allies—including the US, UK, Canada and Germany—to suspend military assistance and arms sales to Israel “so long as its forces commit widespread, serious abuses amounting to war crimes against Palestinian civilians with impunity”.

    Iran and other governments, says Human Rights Watch (HRW), should also cease providing arms to Palestinian armed groups, including Hamas and Islamic Jihad, so long as they systematically commit attacks amounting to war crimes against Israeli civilians.

    But the killings by the Israelis far outnumber the killings by Hamas, according to conservative estimates. Since October 7, about 1,400 Israelis and other nationals have been killed, and more than 10,000 Palestinians,40 percent of them children.

    “Civilians are being punished and killed at a scale unprecedented in recent history in Israel and Palestine,” said Bruno Stagno, chief advocacy officer at Human Rights Watch. “The United States, Iran and other governments risk being complicit in grave abuses if they continue to provide military assistance to known violators.”

    Kenneth Roth, the former executive director of HRW, was quoted as saying Israel dropping several large bombs in the middle of a densely populated refugee camp was completely and predictably going to lead to a significant and disproportionate loss of civilian lives and therefore a war crime.

    Describing Israel’s military “as part of the US war machine”, Norman Solomon, national director of RootsAction.org and executive director of the Institute for Public Accuracy, told IPS the solid bedrock alliance between Israel and the US has ensured the continuation of a 10-year deal that guarantees $38 billion in U.S. military aid to Israel.

    And now, as the carnage in Gaza continues, he pointed out, Washington is rushing to provide extra military assistance worth $14 billion.

    During the last several weeks, he said, “international humanitarian law” has been a common phrase coming from President Biden while expressing support for Israel’s military actions.

    It’s an Orwellian absurdity, as if saying the words is sufficient, while constantly helping Israel to violate international humanitarian law in numerous ways, declared Solomon.

    HRW said future military transfers to Israel in the face of ongoing serious violations of the laws of war risk making the United States, the United Kingdom, Canada, and Germany complicit in these abuses if they knowingly and significantly contribute to them. Providing weapons to Palestinian armed groups, given their continuing unlawful attacks, risks making Iran complicit in those violations.

    US President Joseph R. Biden has requested US$14.3 billion for further arms to Israel in addition to the $3.8 billion in US military aid Israel receives annually.

    On November 2, the US House of Representatives passed a bill that would provide that military aid to Israel. Since October 7, the United States has either transferred or announced it is planning to transfer Small Diameter Bombs, Joint Direct Attack Munition (JDAM) guidance kits, 155mm artillery shells, and a million rounds of ammunition, among other weapons.

    The United Kingdom has licensed the sale of GBP£442 million worth of arms ($539 million) to Israeli forces since 2015, including aircraft, bombs, and ammunition. Canada exported CDN$47 million ($33 million) in 2021 and 2022. Germany issued licenses for €862 million ($916 million) in arms sales to Israel between 2015 and 2019, according to HRW.

    Hamas leadership publicly said in January 2022 that it received at least US$70 million in military assistance from Iran, but did not specify during what period of time this support was provided.

    “How many more civilian lives must be lost, how much more must civilians suffer as a result of war crimes before countries supplying weapons to Israel and Palestinian armed groups pull the plug and avoid complicity in these atrocities?” Stagno said.

    The United Nations, once described the deaths and destruction in the eight-year-old civil war in Yemen as “the world’s worst humanitarian disaster”.

    The killings of mostly civilians have been estimated at over 100,000, with accusations of war crimes against a coalition led by Saudi Arabia and the United Arab Emirates (UAE), whose primary arms supplier is the US.

    And now, the killings of Palestinians in Gaza have come back to haunt the Americans in a new war zone. But still, the US is unlikely to be hauled before the International Criminal Court (ICC)., nor was it charged for human rights abuses, torture, and war crimes committed in Afghanistan and Iraq in a bygone era.

    “If U.S. officials don’t care about Palestinian civilians facing atrocities using U.S. weapons, perhaps they will care a bit more about their own individual criminal liability for aiding Israel in carrying out these atrocities,” said Sarah Leah Whitson, executive director of Democracy for the Arab World Now (DAWN), an American non-profit organization that advocates democracy and human rights in the Middle East.

    “The American people never signed up to help Israel commit war crimes against defenseless civilians with taxpayer funded bombs and artillery,” she noted.

    Last month, Josh Paul, a longstanding official at the State Department’s political-military bureau resigned because of what he said was immoral US support and lethal aid for Israel’s bombings in Gaza.

    According to the State Department, Israel has been designated as a Major Non-NATO Ally under U.S. law. This status provides foreign partners with certain benefits in the areas of defense trade and security cooperation and is a powerful symbol of their close relationship with the United States.

    Consistent with statutory requirements, it is the policy of the United States to help Israel preserve its Qualitative Military Edge (QME), or its ability to counter and defeat any credible conventional military threat from any individual state or possible coalition of states or from non-state actors, while sustaining minimal damages and casualties.

    This requires a quadrennial report to Congress, for arms transfers that are required to be Congressionally notified, and a determination that individual arms transfers to the region will not adversely affect Israel’s QME.

    Strengthening their military relationship further, the United States and Israel have signed multiple bilateral defense cooperation agreements, including: a Mutual Defense Assistance Agreement (1952); a General Security of Information Agreement (1982); a Mutual Logistics Support Agreement (1991); and a Status of Forces Agreement (1994).

    Where Do We Go Once the Israel-Hamas War Ends? – Part I

    None of the above approaches nor several others to reach a peace agreement have worked. The failures to reach an agreement are fundamentally attributed to the fact that both sides claim exclusive ownership to the entire land from the Mediterranean to the Jordan River, albeit they blame each other for failing to make the necessary concessions to reach a peace agreement.

    While the prospect of a two-state solution was viable following the 1993 Oslo Accords, the outlook for such a solution became progressively dimmer as Israel moved to the right-of-center. Prime Minister Netanyahu, who was bent on sabotaging the Oslo Accords when he served as prime minister between 1996 and 1999, and has been in power for most of the past 15 years, made it clear repeatedly that there will be no Palestinian state under his watch.

    The idea of a two-state solution was steadily losing traction in Israel, the occupation of the West Bank was normalized, and a de facto apartheid state was created, which became a way of life for most Israelis and Palestinians.

    The changing dynamic of the conflict

    It is well known in conflict resolution that sometimes it takes a major breakdown that precipitates an extraordinary crisis to change the dynamic of a conflict. The shockingly unexpected and devastating Yom Kippur War in 1973, which subsequently led to a peace agreement between Egypt and Israel, offers a potent example.

    As such, it made it simply impossible to return to the status quo ante. Indeed, neither Israel nor the Palestinians, including Hamas, will be the same following this most heinous and unprecedented massacre and Israel’s retaliation that has already exacted (as of this writing) more than 8,700 Palestinian casualties—not to speak of the unimaginable death and destruction that will occur as Israel undertakes its ground invasion of Gaza.

    This unfolding horror should have been expected because of what was happening on the ground in the West Bank and Gaza over the past few years, especially in the last 10 months since the formation of the most extremist right-wing coalition government in Israel’s history (as I pointed out in my article published on October 3, 2022). Indeed, it did not take a prophet to augur what would happen next.

    The increasingly violent flareups in the West Bank have been claiming hundreds of Palestinian lives, mostly under the age of 30, each year (so far this year over 300 West Bank Palestinians have already been killed, as of the time of writing, over 100 since October 7 alone). The frequent night raids, evictions, incarcerations, demolition of houses, and gross human rights abuses became the norm.

    Despair, depression, and hopelessness swept much of the Palestinian population, akin to the gathering of a ferocious storm that successive Israeli governments led by Netanyahu chose to brush off. Moreover, it is the psychological dimension of the conflict that has now come into full display, exposing decades-old mental and emotional trauma the Palestinians have been experiencing to which the wright-wing Israelis were oblivious and which was bound to manifest in an unprecedented way.

    The Palestinians’ resentment and hatred of Israel were intensifying. Since the new government could not formally annex Palestinians territories, it has resorted to intimidation and harassment of the Palestinians under the watchful eye of the criminal Minister of National Security Itamar Ben-Gvir, who gave the settlers free reign to rampage Palestinian communities in order to ‘encourage’ them to leave.

    The Netanyahu government’s intent to slowly annex much of the West Bank became abundantly clear. Needless to say, none of the above can justify under any circumstances Hamas’ heinous attack on Israeli civilians. Hamas must pay for it dearly, and pay they will.

    But such unthinkable carnage happened because of the perilous “strategy” that successive Israeli governments pursued that enabled Hamas and prevented the establishment of an independent Palestinian state. This also explains why Netanyahu consistently refused to negotiate with any prospective unity government between the PA and Hamas.

    The creation of Hamas

    Israel created Hamas to counter balance the secular national Palestine Liberation Organization (PLO) movement led by Yasser Arafat, which was intended to divide the Palestinians into two camps and prevent the creation of a Palestinian state. The creation of Hamas by Israel, which has been confirmed by many top Israeli military and civilian officials over a number of years, is unquestionable.

    Former Brig. Gen. Yitzhak Segev, who was the Israeli military governor in Gaza in the early 1980s, told a New York Times reporter that he had helped finance Hamas as a “counterweight” to the secularists and leftists of the Palestine Liberation Organization (PLO) and the Fatah party, led by Yasser Arafat, stating “The Israeli Government gave me a budget and the military government gives to the mosques.” And among many others, Avner Cohen, a former Israeli religious affairs official who worked in Gaza for more than two decades, told the Wall Street Journal in 2009 that “Hamas, to my great regret, is Israel’s creation.”

    In a 2015 interview, Bezalel Smotrich, the current finance minister who is also in charge of Coordination of Government Activities in the Territories (COGAT), stated “The Palestinian Authority is a burden, and Hamas is an asset” . And in an article published in the New York Times on October 18, 2023, entitled “Netanyahu Led Us to Catastrophe. He Must Go.,” author Gershom Gorenberg stated that “Bringing Gaza back under the Palestinian Authority was apparently never part of the prime minister’s agenda. Hamas was the enemy and, in a bizarre twist, an ally against the threat of diplomacy, a two-state solution and peace.”

    Indeed, no Israeli prime minister has pursued this disastrous policy of divide and conquer more vigorously than Netanyahu. Although he maintained the blockade over Gaza, he allowed the flow of hundreds of millions of dollars from Qatar and other countries into Hamas’ coffers, knowing full well that more than 50 percent of these funds were used by Hamas to buy and manufacture weapons, including tens of thousands of rockets, and build a massive network of tunnels with command and control while readying itself for the next war.

    Gorenberg further stated that “In 2019, for instance, Netanyahu explained why he allowed the Hamas regime in Gaza to be propped up with cash from Qatar rather than have it depend on a financial umbilical cord to the West Bank. He told Likud lawmakers that ’whoever is against a Palestinian state should be for’ the Qatari funding…” Yuval Diskin, head of Shin Bet from 2005-2011, stated in January 2013 that “If we look at it over the years, one of the main people contributing to Hamas’s strengthening has been Bibi Netanyahu, since his first term as prime minister.”

    And in a more telling statement from someone who has been deeply immersed in Israeli politics and governance, Ehud Barak stated in August 2019, “His strategy is to keep Hamas alive and kicking… even at the price of abandoning the citizens … in order to weaken the PA in Ramallah…”

    Netanyahu’s ill-fated “strategy” was an illusion. He believed that he could control the monster that he nurtured over the years, which instead came back to slaughter hundreds of innocent Israelis who have been relying on their government for protection and were tragically let down.

    They have been betrayed by a prime minister who has been fixated on bolstering Israel’s security in the West Bank while weakening the security of the southern front along the Gaza border. And while Netanyahu was sparing no efforts to ‘reform’ the judiciary, Hamas was planning, training, acquiring weapons, and perfecting the technique to wage an assault against Israel more daring than anyone could have possibly imagined.

    It all happened under Netanyahu’s watch. And worse yet, how is it possible that the world’s most renowned intelligence agency, Israel’s Mossad, failed to detect the planning of an attack of such magnitude that it took perhaps more than a year to prepare? And why did Netanyahu ignore the warning of Egypt’s Intelligence Minister General Abbas Kamel, who personally called Netanyahu and warned him that Hamas was likely to do “something unusual, a terrible operation” only 10 days before the attack?

    I do not suggest or even imply that Netanyahu knew what was going to happen but chose to ignore it, but rather that he was simply dismissive of what Hamas is capable of and believed that he had a good handle on what was happening in Gaza. He was preoccupied with passing legislation that would subordinate the Supreme Court and the appointment of judges to elected politicians, which would have destroyed Israel’s democracy and allowed him to assume authoritarian powers, to which he badly aspired.

    Although the Palestinians on the whole, be they in the West Bank or Gaza, are innocent civilians, the extremists among them have committed many egregious acts of violence against Israel. The Palestinian leaders missed many opportunities to make peace, and made countless mistakes that aggravated their own situation.

    Moreover, by threatening Israel’s very existence, extremist groups such as Hamas and Islamic Jihad allowed successive Israeli governments to make a strong case against the Palestinians by portraying them as an irredeemable mortal enemy that poses the greatest danger to Israel’s national security and hence, the Palestinians cannot be a party to peace.

    With these perspectives established by the Israeli government, maintaining the occupation became the state policy, however unsustainable it has been deemed by any keen and informed observer.

    What’s next

    That said, once the war is over and the dust settles, a growing majority on both sides will come to recognize one irreversible fact. Co-existence is not one of many options, it is the only option, be that under conditions of peace or perpetual violent enmity. The two-state solution has come back to the table, as it has always been the only viable option. Both sides must now face this bittersweet reality.

    The question is what will happen now that Israel and Hamas are engaged in fierce fighting on the ground that will surely exact an immense toll on both sides. I maintain that whether Israel limits its ground invasion of Gaza to its northern part, or continues its targeted bombing of Hamas’s encampments while seeking to decapitate as many of its leaders as possible, or simply stops the fighting, which is unlikely, and focuses on releasing the over 240 hostages, nothing will change in any substantial way the irreversible new paradigm that has bitterly awakened both sides to their miserable, unsustainable status quo.

    To be sure, what option the Israeli government will choose to bring an end to the conflict will only define the length of time that that might take, the extent of difficulties in the negotiation, the modalities of the negotiating process, the level of public and international pressure to find a solution, and the likely intermittent violence. But none of these issues will change the fundamental point of departure that point to the endgame of a two-state solution, regardless of how many more hurdles might be encountered.

    The Rajapaksa regime refused permission and launched a campaign of lies against her. “Informed sources said that Pillay had initially informed of her desire to offer a floral tribute to the late LTTE terrorist leader Vellupillai Prabhakaran,” The Daily News wrote.

    The Rajapaksas dubbed the final Eelam War a humanitarian offensive with zero-civilian casualties. Acknowledging civilian Tamil deaths was equated with playing the Tiger game. Mourning was a crime, criticising Lankan forces treachery, and referring to the root causes of the conflict justifying Tiger-atrocities. In this us-vs.-them universe, Ms. Pillay’s condemnation of the LTTE as a ‘murderous organisation’ counted for nothing.

    Ms. Pillay, like UN agencies and humanitarian organisations, based her stance on International Humanitarian Law (IHL). IHL is premised on the concept of jus in bello, just conduct of war, which includes principles such as non-combatant immunity and proportionality. The Rajapaksas practiced the antithesis of IHL.

    As Prof. Rajan Hoole wrote, “From 2006, the government began to do what would have been unthinkable after 1987. Intense shelling and deliberate displacement of Tamil populations became integral to its military strategy… (Himal – February 2009). Before launching the final offensive, the Rajapaksas ordered all UN agencies, INGOs, and media to leave the war-zone.

    During the 2014 Gaza War, a pro-Netanyahu columnist in The Jerusalem Post urged the Israeli PM to learn from Lanka’s example of ‘resolute use of military force’ and give Hamas ‘the thrashing it deserves’ https://www.jpost.com/Opinion/Fundamentally-Freund-Defeating-terrorists-From-Sri-Lanka-to-Gaza-371428).

    Today Israel is waging a total war in Gaza, a war that has killed more than 3000 children so far (one child killed every 15 minutes). According to Save the Children, more children have been killed in Gaza in three weeks than in global conflicts annually in the last 4 years (2985 children 2022, 2515 in 2021, and 2674 in 2020). Oxfam has accused Israel of using starvation as a weapon of war. The UN is warning of hunger and desperation in Gaza leading to societal collapse.

    How many Palestinian children must die for Israel to feel safe, or the West to say enough?

    The targeting of Israeli civilians by Hamas was an act of barbarism. Israel’s retaliatory war against the entire population of Gaza is no less barbaric. As Karim Khan, a prosecutor at the International Criminal Court said, “Whether a child is born Jewish in Israel or is a Christian or Muslim in Gaza – they’re children and we should have that sense of humanity – that legal, ethical, and moral responsibility to do right by them.”

    For Hamas and their supporters, Israeli children are not children. For Israel and its Western backers, Palestinian children are not children. Hamas committed war crimes. Israel is committing war crimes. And the West, the self-appointed guardians of International Humanitarian Law, is enabling Israel to go on committing war crimes. US Secretary of State Anthony Blinken has descended so low as to ask Qatar to ‘moderate Al Jazeera’s coverage’ of Israel’s air strikes against Gaza, according to a Guardian report.

    The repercussions of this abandonment of jus in bello are likely to be both global and long-lasting. The world could regress to a time when anything was permissible in and during war. The UN and international humanitarian organisations could become totally irrelevant. The credibility of a legal system depends on its fair application. When laws are applied selectively, they lose legitimacy. One law for friends and another for foes results in jungle for all.

    By permitting, indeed helping, Israel to violate IHL, the US and the West are opening the door to a world of complete lawlessness and injustice. They are not ending terrorism but birthing it, in ever more gruesome forms.

    Allied powers did nothing to impede the Holocaust. Dresden which had no military value, was fire-bombed while railway lines to Auschwitz were not. From that civilisational failure was born the cry, Never Again. But as a Jewish protestor at the anti-war demonstration near the Capitol building said, “Never again means never again for anyone.”

    The world needs impartial application of IHL to Israel and Hamas, to Russia and Ukraine. The failure to do so will push humanity back to an age when life for most humans was solitary, nasty, and brutish.

    Marriages made in Hell

    Conception was the name given to Benjamin Netanyahu’s decades-old policy of using Hamas to divide and weaken Palestinians. Addressing Likud party Knesset members in March 2019, he explained his rationale for favouring Hamas and permitting Qatar to fund it. “Whoever opposes a Palestinian state must approve the delivery of funds to Gaza because maintaining the difference between the PA in the West Bank and Hamas in Gaza will prevent the establishment of a Palestinian state.”

    Hamas, an acronym for Harakat al-Muqawama al-Islamiyya (Islamic Resistance Movement) does not accept Israel’s right to existence and wants to install an Islamic Caliphate in all Palestinian lands. Such an organisation would be the best excuse for Israel right’s own plans for a theocratic and non-pluralist Greater Israel.

    As retired general Yair Golan pointed out, Netanyahu “created a situation in which, so long as the Palestinian Authority was weak, he could create the overall perception that the best thing to do was to annex West Bank. We weakened the very institution that we could have worked with, and strengthened Hamas” (The New Yorker – 28.10.2023). In pursuant of this, weapons were reportedly taken away from the Gaza border and given to settlers in West Bank.

    Mr. Netanyahu’s Conception indirectly enabled Hamas’ October 7th attack just as his war will turn the Arab world into a breeding ground for Hamas. As Palestinian philosopher Sari Nusseibeh said, “It is a mistake to think that Hamas is an alien being – it is part of the national tapestry. It grows bigger or smaller depending on other factors. You can eliminate the guys running Hamas now, but you cannot eliminate it entirely. It will stay as a way of thinking, as an idea so long as there is a Palestinian-Israeli conflict” (ibid).

    Had the Oslo Accords worked, had there been an independent democratic Palestinian state, Hamas could have been marginalised. The Accord’s monumental failure, and the resultant disillusionment in peaceful solutions (not to mention Fatah’s incompetent and corrupt practices in West Bank) helped Hamas thrive. As Hamas founder Sheik Ahmad Yassen once said, “When oppression increases people start looking for God.”

    The plan to ethnic-cleanse West Bank piecemeal, using low intensity violence by Israeli settlers and the Israeli army, continues, empowered by Western indifference. As human rights lawyer Raja Shehadeh wrote, even such a quotidian activity like olive picking has been politicised by expansionist settlers who attack Palestinian olive-pickers, preventing them from reaching their lands and sometimes stealing the harvest.

    In the West Bank village of Deir Istiya, those returning home from harvesting olives found notices under car windshield-wipers telling them to wait for the Great Nakba – to leave or be forcefully evicted, Israeli columnist Hagar Shezaf wrote in Haaretz on October 27th.

    The pursuit of Greater Israel is a threat to Palestinian Christians as well. Settler expansionists want a Jewish state in which Christians will have little or no space. In 2012, extremist settlers attacked the Trappist Monastery in Latroun, setting its door on fire and writing anti-Christian graffiti such as Jesus is a monkey on its walls. Jerusalem’s Monastery of the Cross too has been attacked.

    Again in 2012, Israel politician Michael Ben Ari tore a copy of the New Testament in the Knesset and threw it into a rubbish bin after denouncing it as an abhorrent book. A second legislator wanted bible to be burnt. Neither was officially sanctioned.

    As Father Pierbatista Pizzaballa, Custodian of the Holy Land, pointed out, “Israel has failed to address the practice of some ultra-Orthodox Jewish schools that it is a doctrinal obligation to abuse anyone in Holy Orders they encounter in public” (https://www.telegraph.co.uk/news/religion/9529123/Vatican-official-says-Israel-fostering-intolerance-of-Christianity.html).

    In Sri Lanka too, political monks, extremist politicians, and retired military officers have stepped up their campaign to incite ethnic/religious tensions. Now that Kurundi has been neutralised by the government, these motley combos have shifted focus to Batticaloa. They are abusing even Buddha statues, using them as weapons of war and markers of territorial possession. Omalpe Sobitha thero, a bit-actor in the drama, asked, “If you can’t keep a Buddhist statue in places like Batticaloa, has a separate country come into being?”

    The main actor in the unfolding Diwulpathana teledrama, the infamous Ampitiye Sumanarathana thero, set out a clear warning. “The country is angry and awake… They are ready to reply the President, Rasamannikam, Senthil Thondaman. The entire Sinhala nation is ready to reply to all of them anytime… I don’t know who sired Ranil Wickremesinghe. I don’t know if Tamil people have traditional properties in this Sri Lanka… There is a history going back beyond 2500 years for these properties… These are traditional properties of Sinhalese…

    When Mahinda Rajapaksa became the president and the war ended, these people got back their rights… They lost their rights when Maithripala became the president, and regained them again when Gotabaya became the president and lost them again when Gotabaya was driven out. It’s after Ranil Wickremesinghe came to power that politicians like Shanakyam shout like this…” The monks and lay cohorts are acting with total impunity while the government looks away and the Opposition evades the issue. The moderate centre is unoccupied territory while the two antipodes are teeming with actual and would be owners.

    Rational Resistance

    When a policeman shot dead unarmed teenager Michael Brown in Ferguson, USA, in 2014, mass protests erupted. Confronted by policemen armed as if for war, some demonstrators drew comparisons between themselves and the Gazans. Many Palestinians responded by tweeting practical advice (for instance, Mariam Barghouti from West Bank tweeted, “Always make sure to run against the wind/to keep calm when you are tear gassed, the pain will pass, don’t rub your eyes.”) When an American social-media user objected to the Ferguson-Gaza comparison, another responded, “I don’t think anyone is trying to compare Ferguson to Gaza; the point is solidarity and justice.”

    Now also, the point is solidarity and justice, with Gazans and all Palestinians, with hostages, and the Israelis who lost their loved ones, with Palestinian journalist Wael Al-Dahdouh whose wife, daughter, and son were killed in Israeli bombings, and with the mother of Shani Louk, the German-Israeli tattoo artist murdered by Hamas. For solidarity with Palestinians to grown into a moral and political force, resistance needs to move out of the violent theocratic paradigm represented by Hamas. The locus should be not Islamic or Arab but global.

    What is at issue is not the right to violent resistance but the efficacy of that path. Arab and Islamic leaders might breathe fire, but they are not even going to suspend diplomatic relations with Israel, let alone wage war against Israel, not even if every inch of Gaza is flattened and every Gazan perish under the rubble. The only way out is to do what national liberation movements did in the old days, from Vietnam to South Africa: gain and occupy the moral highground.

    The repugnancy of Israel’s policies and actions cannot be showcased, if resistance to Israel is dominated by Hamas and its equally repugnant brand of violence. Just as it is possible to support Israel’s right to existence without supporting the Greater Israel project, it is possible to resist Israel occupation and expansion without descending to the depth of barbarism. To find that radically moderate path all Palestine has to do is to reach back to its own history.

    As Palestinian cleric Munib Younan, Bishop emeritus of the Lutheran Church in Jordan and the Holy Land pointed out last month, “We have lived with the Jews all the time. Jews were persecuted in Europe. Never in Palestine. Anti-Semitism is a European construct.” Tolerating anti-Semitism, even in the face of the murderous attacks by Israel, is morally wrong and strategically counter-productive. Had Tamil struggle not succumbed to extremism, had the LTTE not targeted Sinhala and Muslim civilians and Tamil critics, it wouldn’t have gone down to utter defeat.

    Last week, hundreds of mostly Jewish demonstrators, members of Jewish Voice for Peace NY, took over the main hall of the Grand Central Station, protesting against the bombing of Gaza, shouting that Palestinians will be free. The sentiment of one of the young demonstrators provides a glimpse of a path out of the looming jungle of violent lawlessness: Mourn the dead. Fight like hell for the living.
