Brighton man charged with vehicular homicide in DUI crash on I-76 that killed his daughter

A Brighton man has been charged with vehicular homicide and child abuse resulting in death in a Commerce City crash that killed his daughter last week, according to a news release from the Adams County District Attorney’s Office.

Aaron Aguirre-Garay, 40, was driving his truck on Interstate 76 on Feb. 12 when he crashed into a fence, injuring himself and killing his daughter, according to an arrest affidavit from the Commerce City Police Department.

Aguirre-Garay was charged with child abuse causing death, vehicular homicide – reckless and vehicular homicide – DUI in the crash, according to the district attorney’s office release. The affidavit and the release do not specify how old the girl was.

Multiple witnesses saw Aguirre-Garay driving on a dirt shoulder off the road before his truck veered toward a fence, possibly because of a popped tire, according to the report. One witness saw the white truck swerve several times before the crash. Another person who went over to the vehicle after the crash spoke to Aguirre-Garay and said he smelled like alcohol. Witnesses found the girl lying on the ground outside the truck.

In an interview with police, Aguirre-Garay slurred his speech and smelled of alcohol as he told officers he didn’t know what happened in the crash, adding that he believed someone rear-ended his truck, according to the affidavit. He said he didn’t remember if his daughter was wearing her seat belt.

Aguirre-Garay told police he had been drinking earlier that day but didn’t clarify exactly how many alcoholic beverages he consumed, with his answers ranging from two to four cans of beer. He denied a field sobriety test and a blood alcohol test, the affidavit stated.

When police contacted the girl’s mother, she said she had just spoken to her daughter, who said at the time she “was done with practice.” The girl was attending a “league program practice” at Regis University, according to the report.

Aguirre-Garay, who was released from Adams County Jail on a $100,000 bail, will appear for a preliminary hearing at 9 a.m. March 9 in Adams County District Court.

Semitruck crash on westbound Interstate 76 Monday ruptures saddle tank, leaking 100 gallons of diesel

ARVADA, Colo. — A semitruck crash on westbound Interstate 76 Monday morning ruptured its saddle tank, leaking 100 gallons of diesel onto the highway, according to Colorado State Patrol (CSP).

This was a multi-car crash, involving two other vehicles in addition to the semitruck, according to the Jefferson County Sheriff’s Office. The people involved sustained minor injuries.

I-76 westbound is closed at Federal Boulevard due to safety concerns, between Sheridan Boulevard and Interstate 70, according to the Colorado Department of Transportation. CDOT is trying to divert traffic onto Sheridan Boulevard, CSP said.

Denver7 Traffic Expert Jayson Luber recommended morning commuters not get on westbound I-76 west of Interstate 25, as it appears all lanes of westbound I-76 are blocked west of Sheridan. Even first responders are stuck in the traffic jam, Luber observed.

Luber advised drivers use Pecos Street, Federal, Sheridan or Wadsworth Boulevards instead to get to Interstate 70 west.

CSP is investigating what led up to the crash.

82-year-old woman dies in Brighton motorcycle crash on I-76

A motorcyclist died Thursday after hitting the center barrier on Interstate 76 near Eagle Boulevard on Thursday afternoon.

The 82-year-old driver was traveling eastbound on the interstate at about 1:50 p.m. Thursday when she hit the center barrier for unknown reasons, according to Brighton police. She was ejected from the motorcycle, which then rolled over the cable barrier and into the westbound lanes of the interstate. The motorcycle struck another vehicle, though the driver of that vehicle did not sustain any injuries.

The motorcyclist was taken to a nearby hospital, where she died shortly after.

The identity of the motorcyclist is being withheld until next of kin can be notified, according to the news release from the Brighton Police Department. The department’s traffic safety unit does not believe drugs, alcohol or speed played a role in the crash.

No injuries after plane makes emergency landing on I-76 in Colorado

DENVER — A small private plane made an emergency landing on Interstate 76 outside of Brush in northeastern Colorado Saturday.

According to the Colorado State Patrol, no injuries were reported, and there was no visible damage to the aircraft or roadway.

The plane landed on the westbound lanes of the interstate near mile marker 101 around 2:30 p.m.

It’s unknown what caused the pilot to put the plane down on the highway, which was closed for about two hours while the aircraft was removed.

Westbound I-76 near Commerce City to close for weekend bridge repairs

Westbound Interstate 76 under the Dahlia Street bridge in Commerce City and the bridge itself will close this weekend for construction, according to the Colorado Department of Transportation.

From 10 p.m. on Friday to 5 a.m. on Monday, westbound I-76 at exit 9 and Dahlia Street over the interstate will be closed for repair work, according to a CDOT news release.
The repair work to the bridge is necessary because its girders — the metal beams that support its structure — were severely damaged in March when a tractor-trailer towing construction equipment hit its outer edge. Plans to repair the bridge started later that month.

This weekend, the following detours are in effect:

Westbound I-76 traffic will use the exit 9 off-ramp to West U.S. 6/South U.S. 85, continue south to 74th Avenue/Colorado 224, turn west and continue to the westbound I-76 on-ramp.

Northbound Dahlia Street traffic will detour east on 74th Avenue/Colorado 224, turn north on U.S. 6/U.S. 85 to join eastbound I-76, exit at 88th Avenue and go west.

Southbound Dahlia Street traffic will detour west on the I-76 Frontage Road, turn east on 74th Avenue/Colorado 224 and continue to Dahlia Street.

Once this weekend’s work is completed, there will be ongoing single-lane closures overnight on I-76, CDOT officials said. The lane will be closed from 7 p.m. to 5 a.m. during the week, and from 8 p.m. to 7 a.m. on the weekend. Northbound Dahlia Street over I-76 will continue to be closed until the project is completed.

CDOT officials expect construction to wrap up in mid-July.

Denver weather: Possible rain Monday evening, high fire danger across plains

Rain is expected in Denver on Monday, but high fire danger persists throughout the plains and Palmer Divide while heavy snow is possible in the mountains, according to the National Weather Service.

Denverites can expect breezy, sunny weather with a high of 74 degrees and wind gusts as high as 34 miles per hour on Monday. A 20 percent chance of showers after 3 p.m. increases to 60 percent with gusts as high as 37 miles per hour before 9 p.m. Monday night will hit a low of 48 with a chance of showers and thunderstorms before 9 p.m. and after midnight and a chance of showers between 9 p.m. and midnight.

Temperatures will continue to drop Tuesday and cloudy, breezy weather is expected. A high of 68 degrees with wind gusts around 38 miles per hour and a 50 percent chance of showers before noon Tuesday drops to 44 degrees that night with wind gusts decreasing to 31 miles per hour.

Warm, dry and windy weather will create critical fire weather conditions across much of the Colorado eastern plains Monday afternoon and evening with strong winds and low humidity increasing fire danger south of Interstate 76.

A red flag warning is in effect from noon to 8 p.m. Monday for the Palmer Divide and plains southeast of Interstate 76. Southwest winds with gusts up to 45 miles per hour and humidity as low as seven percent will create favorable conditions for rapid fire spread. Wind gusts may reach 50 miles per hour in Lincoln County.

Higher humidity levels decrease fire weather conditions north of Denver and throughout the mountains. A winter storm warning from 3 p.m. Monday to 3 p.m. Tuesday is in place for Rocky Mountain National Park, the Medicine Bow Range, the Mountains of Summit County, the Mosquito Range and the Indian Peaks. Total snow accumulation between 8 and 18 inches with and wind gusts as high as 60 miles per hour is expected.

Heaviest snow is expected to hit the northern Front Range mountains, while wind gusts will be strongest over the southern Front Range. Roads will likely become slick and blowing snow will reduce visibility.

A winter weather advisory is also in effect from 3 p.m. Monday to 3 p.m. Tuesday for the Park Range and Rabbit Ears Pass. Snow accumulation will be between 6 and 12 inches with wind gusts as high as 40 miles per hour, according to the National Weather Service.
