  • Herndon man pleads guilty to manslaughter in 2024 shooting of teenage boy – WTOP News

A Herndon, Virginia, man has been found guilty in the shooting death of a 14-year-old boy in March 2024.

A Herndon, Virginia, man pleaded guilty Monday in the shooting death of a 14-year-old boy in March 2024.

Fairfax County Commonwealth’s Attorney Steve Descano said Ismael Cruz Delcid, now 20, faced charges of voluntary manslaughter in the case.

Cruz Delcid was sitting in a car in a parking lot on Coppermine Road on March 20, 2024, when he saw two teenage acquaintances, according to prosecutors. He spoke with them, and when the conversation escalated, Cruz Delcid shot the teenage boy, later identified as Michai Malave, twice.

Malave was taken to the hospital, where he later died. The other teenager was not hurt in the shooting.

Fairfax County Public Schools Superintendent Michelle Reid, at the time, described Malave as a “student in good standing” at Westfield High in Chantilly.

Police said Cruz Delcid then ran into the woods, where he got rid of the gun and his clothing, then took public transportation and a rideshare to his girlfriend’s home. He turned himself in to police the next day.

He was charged with second-degree murder and later pleaded guilty to voluntary manslaughter.

“My heart breaks for the victim’s family,” Descano said in a statement. “His parents deserved the chance to see him graduate high school and pursue his dreams. He had his whole life ahead of him, and I hope that this conviction allows everyone who knew him to continue healing from this terrible loss.”

In June, Cruz Delcid’s trial resulted in a mistrial due to a hung jury.

Cruz Delcid is expected to return to court Jan. 9 for sentencing and faces up to 10 years in prison.

Prolific local Chinese chef Peter Chang opens his 12th D.C.-area restaurant on Sept. 28 in Herndon, Virginia.

The Peter Chang Herndon is in the Arrowbrook Shopping Center at 2322 Silver Arrow Way.

Like others recently opened in Gaithersburg, Maryland, and Crystal City, the Herndon location will feature a tapas-style menu, with smaller, shareable plates, which is a departure from the traditional banquet-style menus at Peter Chang’s other locations.

The Peter Chang Gaithersburg location opened in April. Peter Chang’s NiHao, a more casual sit-in and takeout restaurant highlighting small plate versions of his Szechuan dishes, opened in May. It was a partnership between Chang, his daughter Lydia Change and D.C. restaurateur Erik Bruner-Yang, whose other spots include Maketto, and Brothers and Sisters.

The new Herndon location will be open seven days a week for lunch and dinner. In addition to the Chinese tapas menu, it will include signature Peter Chang dishes like steamed BBQ pork bao, popcorn chicken broiled branzino, scallion pancakes and dan dan noodles.

    Here is the Herndon menu.

Peter Chang came to the U.S. more than 30 years ago as head chef for the Chinese Embassy in D.C. The first Peter Chang restaurant opened in Charlottesville in 2011 Chang’s Dupont Circle location was added to the Michelin Guide last year, and he was a 2022 James Beard Award Finalist for Outstanding Chef.

  • Au pair charged in killing a man in a Fairfax Co. double homicide seeks dismissal of key evidence in trial – WTOP News

Au pair charged in killing a man in a Fairfax Co. double homicide seeks dismissal of key evidence in trial – WTOP News

Days after a husband was charged in the double homicide of his wife and another man inside a Fairfax County, Virginia, house, the au pair, who was also charged with shooting the man, is asking to get a key evidence thrown out.

Days after a husband was charged in the double homicide of his wife and another man inside a Fairfax County house, their Brazilian au pair, who was also charged with shooting the man, is asking to get key evidence from the case thrown out.

A motion to suppress certain evidence was detailed in a lengthy hearing Thursday in Fairfax County Circuit Court before Judge Penney S. Azcarate.

Attorneys for 23-year-old Juliana Peres Magalhaes argued that on the day of the killings in February 2023, police essentially did not make it clear enough to Peres Magalhaes that she did not have to go to police headquarters or talk to detectives.

Peres Magalhaes’ defense attorneys showed police body camera footage of an officer’s interactions with her outside the home where 37-year-old Christine Banfield and 39-year-old Joseph Ryan were found dead inside.

Christine Banfield was stabbed to death, and Ryan was shot to death inside the home in the 13200 block of Stable Brook Way.

At that time, Peres Magalhaes was not under arrest. When she asked the officer if she had to go to police headquarters, his response was, “It’s imperative for your safety.”

Prosecutors said there was no overt act of authority by police, and Peres Magalhaes got into a police cruiser voluntarily. Initially, according to court testimony, Peres Magalhaes and the Banfields’ 4-year-old daughter were taken to what’s called a “soft room,” where police questioned her for about 90 minutes. After that, Peres Magalhaes was taken to a police interrogation room and questioned for over seven hours.

Peres Magalhaes was not arrested and charged until 8 months later.

Attorneys representing Peres Magalhaes at the hearing Thursday said she was unlawfully seized, and evidence in the case — including her cellphone, Apple watch, clothing, photos and a hand swab taken that day — should be thrown out. They also argued that anything she told police should be excluded from trial.

Banfield was arrested and charged earlier this week with aggravated murder. A hearing was also held in his case on Thursday, where the same judge set a trial date of Feb. 3.

Banfield’s attorney, John Carroll, said he has not filed any motions in the case yet, and is expecting eight terabytes of discovery evidence from the Commonwealth Attorney’s office.

The judge will rule on the motions and make a decision about a request for cameras in the courtroom next Thursday.

Prosecutors have alleged that someone used Christine Banfield’s laptop to make an account on an adult fetish website. Ryan had responded to the profile and went to the home with the intention of having “rough sex” with Christine Banfield. Prosecutors haven’t said who they believe created the account.

Peres Magalhaes initially told detectives she saw Ryan holding a knife to the throat of Christine Banfield, who was nude, inside the master bedroom.

Police said Brendan Banfield, a criminal investigative division agent for the IRS, shot Ryan near his right eyebrow with his IRS-issued service weapon. After shooting Ryan, Peres Magalhaes said Brendan Banfield told her to get a gun from a safe in the bathroom of the master bedroom. She then fired a shot at Ryan, which struck him in the chest, and “devastated his heart,” according to the medical examiner who testified at a December 2023 hearing.

  • Husband charged in double homicide inside Fairfax Co. home in alleged plot with au pair – WTOP News

Husband charged in double homicide inside Fairfax Co. home in alleged plot with au pair – WTOP News

Brendan Banfield has been charged with murder in both killings, nearly a year after the couple’s au pair was charged with shooting the man to death.

Inside a Fairfax County, Virginia, house, a woman was stabbed to death and a man fatally shot in February 2023 in a complicated double homicide involving an alleged affair and a fetish website. Now, her husband is being charged with murder in both of their killings, nearly a year after the couple’s au pair was charged with shooting the man to death.

In February 2023, Christine Banfield, 37, was found inside her bedroom, suffering from stab wounds, alongside 39-year-old Joseph Ryan, who was shot and killed, police said.

During Brendan Banfield’s first court appearance Tuesday morning, a judge read out his charges and he was taken back to holding.

He was indicted on multiple charges of aggravated murder and the use of a firearm in the commission of a felony, more than 570 days after police said he killed his wife and Ryan, Fairfax County officials said in a news conference Monday.

Fairfax County Commonwealth’s Attorney Steve Descano and police Chief Kevin Davis announced Brendan Banfield’s arrest on Monday, but neither offered many details about the evidence that led to the new charges, citing concerns about compromising the criminal investigation or prejudicing a future jury.

“This much is clear — we have evidence to now allege that Christine Banfield’s life was unlawfully taken and Joseph Ryan’s life was unlawfully taken,” Davis said.

Descano did say “new information” uncovered by Fairfax officers “was very instrumental in giving today’s indictment.”

At the time of the killings, Brendan and Christine Banfield were married and living in a Herndon house with their 4-year-old daughter and 22-year-old au pair Juliana Peres Magalhaes.

Police said Brendan Banfield was involved in a “romantic relationship” with Peres Magalhaes — who denied allegations the two were having an affair immediately after the shooting and the stabbing.

Back in October 2023, Peres Magalhaes was charged with second-degree murder and use of a firearm in the commission of a felony in Ryan’s killing. She was not charged in 37-year-old Christine Banfield’s death. Her trial in Ryan’s death is scheduled in November, The Associated Press reported.

Brendan Banfield is expected to appearance in court next on Thursday for a hearing to schedule a trial.

He’s being held at the county’s adult detention center, the same facility where Peres Magalhaes has been in custody as she awaits trial, police said.

Fairfax County police executed a search warrant at the Banfields’ house on Monday, Davis said.

“This isn’t over. We’re not spiking the football, we’re not celebrating,” Davis said. “We’re still in the midst of this journey within our criminal justice system.”

What happened inside the Banfields’ house?

Prosecutors have alleged that someone used Christine Banfield’s laptop to make an account on an adult fetish website. Ryan had responded to the profile and went to the home with the intention of having “rough sex” with Christine Banfield.

Prosecutors haven’t said who they believe created the account.

At an earlier hearing, Peres Magalhaes’ defense attorney, Ryan Campbell, argued that the evidence showed that Christine Banfield established the adult website account, and also purchased tickets for Peres Magalhaes to take the couple’s 4-year-old daughter to the National Zoo in D.C. during her alleged assignation with Ryan.

At the December 2023 hearing, Campbell said it was difficult for him to accept that somebody other than Christine Banfield would be going on her computer to lure Ryan for months.

After the incident, Peres Magalhaes told detectives she saw Ryan holding a knife to the throat of Christine Banfield, who was nude, inside the master bedroom.

Peres Magalhaes called 911 around 7:45 a.m., but the call was disconnected. Around 15 minutes later, she called 911 again and gave the phone to Banfield, who told the dispatcher he had just shot a man who was stabbing his wife.

Both guns and a knife were recovered by law enforcement at the scene, Davis said.

What was the relationship between Brendan and Juliana?

Prosecutors said that Peres Magalhaes visited a shooting range in Ashburn with Brendan Banfield a few months before the double homicide.

Brendan Banfield returned to purchase a Glock on Jan. 28, 2023, which prosecutors said was the weapon that Peres Magalhaes retrieved from a bathroom safe and used to shoot Ryan.

In the months between the shootings and Peres Magalhaes’ arrest, prosecutors said photo and text evidence showed the two had been engaging in an affair.

Campbell, the attorney, has repeatedly objected to the relevance of the alleged relationship between his client and Brendan Banfield.

“The purchase of the weapon before the incident is the relevance,” the judge said in April, who later described the court proceedings as, “the government … playing two potential defendants against each other.”

  • Herndon police give ‘all clear’ after evacuating neighborhood, saying ‘alarming’ chemicals found during arrest were legal – WTOP News

Herndon police give ‘all clear’ after evacuating neighborhood, saying ‘alarming’ chemicals found during arrest were legal – WTOP News

Herndon, Virginia, police announced Friday night that residents of the evacuated homes in the Herndon Station Square neighborhood would be allowed to return to their homes after finding the “alarming” chemical substances found in the home of a wanted man were, in fact, legal to possess.

Herndon, Virginia, police announced Friday night that residents of the evacuated homes in the Herndon Station Square neighborhood would be allowed to return to their homes after finding the “alarming” chemical substances found in the home of a wanted man were, in fact, legal to possess.

Around 11:30 a.m. Friday morning, police were called to the 200 block of Herndon Station Square to execute a search warrant on behalf of a Pennsylvania county police department in the home of a man. The man, later identified as 44-year-old Steven Timothy Kyle, was wanted on multiple counts of criminal mischief, stalking and harassment by the Central Bucks Regional Police Department.

In collaboration with the Fairfax County Police Department bomb squad and ATF Washington, police evacuated at least 20 nearby homes after they discovered “chemical substances and other evidence that raised alarm,” Herndon police said in a post on X.

“While officers from the Herndon Police Department and investigators were searching the house, they found some chemicals and other substances that caused them some alarm,” said Herndon police Capt. Steve Pihonak during a news conference Friday evening.

Pihonak later recanted this statement, saying that “they’ve determined none of those chemicals are illegal to posses.” He added that multiple firearms were taken from Kyle’s home.

“It wasn’t like in the typical homeowner’s garage where they would have … paint over here and this and that. It was definitely suspicious in nature, to how he had these in the home,” he said.

The W&OD Trail is closed between Grace and Center streets. Grace Street will be closed until further notice between Haley Place and Park Avenue. The Herndon Fortnightly Library and Boulevard, as well as the Herndon Harbor Adult Day Health Care Center, are also closed until further notice.

“We’re still combing through details. It is going to be a long process. It’s going to be a meticulous, slow process,” he added.

WTOP’s Scott Gelman reported live from the scene where residents of the 20 homes have been displaced. He said police are working with the county’s emergency management department to find accommodations as they assume residents will not be able to stay the night in their homes Friday.

Ready Fairfax, the county’s department of emergency management and security, announced residents will be staying at a makeshift shelter at the Sully Community Center and transportation will be provided for those who need it.

“We anticipate that we will be there overnight, so anyone who needs sheltering can come anytime throughout the night,” said Courtney Arroyo, community engagement manager of Ready Fairfax.

  • Fairfax Co. au pair charged in fetish website killing visited gun range with victim’s husband, prosecutors say – WTOP News

Fairfax Co. au pair charged in fetish website killing visited gun range with victim’s husband, prosecutors say – WTOP News

Prosecutors said that the au pair charged in the fatal shooting of a man inside a Fairfax County house visited a shooting range with the husband of the woman who was also stabbed to death inside the Virginia home.

Prosecutors say that the au pair charged with fatally shooting a man inside a Fairfax County house where a woman was also stabbed to death last year visited a shooting range with the woman’s husband just a few months before the bizarre double slaying.

District Court Judge Michael Lindner on Monday found that there is enough evidence and the case can go forward against Juliana Peres Magalhaes, who is accused of firing the shot that killed 39-year-old Joseph Ryan in February 2023. She is facing charges of second-degree murder and use of a firearm in the commission of a felony.

In making his decision Monday, the judge said he didn’t have to consider motive because based on the evidence, prosecutors demonstrated probable cause.

Ryan and Christine Banfield, 37, were killed inside the home on Stable Brook Way in the Hattontown neighborhood of Herndon on Feb. 24, 2023. Nobody has been charged in Christine Banfield’s death.

Prosecutors introduced business records that showed husband Brendan Banfield and Peres Magalhaes visited the Silver Eagle shooting range in Ashburn, Virginia, in the weeks before Christine Banfield and Ryan were killed.

Range records showed that Brendan Banfield and Peres Magalhaes were at the range two months before the shooting. He then returned on Jan. 28, 2023, and bought a Glock. Prosecutors said the serial number from the receipt matched the serial number of a gun recovered at the scene.

Subpoenaed to testify in court on Monday, Brendan Banfield took the Fifth when asked whether he returned to the shop and purchased a Glock, which prosecutors said was the weapon that Peres Magalhaes retrieved from a bathroom gun safe and used to shoot Ryan.

Eric Clingan, with the Fairfax County Commonwealth’s Attorney’s Office, said the gun was used to “eliminate the only living witness.”

During the preliminary hearing on Monday, Brendan Banfield refused to answer questions from prosecutors that alluded to an affair with Peres Magalhaes.

Peres Magalhaes’ defense attorney Ryan Campbell repeatedly objected to the relevance of the alleged relationship between his client and the husband.

“The purchase of the weapon before the incident is the relevance,” the judge said, who later described the court proceedings as, “The government may be playing two potential defendants against each other.”

    Fetish website

Last December during a bond hearing, prosecutors revealed new evidence that could explain how Ryan found himself at the Banfield home on the day of the killings.

Prosecutors said that someone had used Christine Banfield’s laptop to create an account on an adult fetish website. Ryan responded to the user’s profile, and he arrived at the home with the intention of having “rough sex” with Christine Banfield.

Prosecutors have not said who created the account.

At the December hearing, Campbell, Peres Magalhaes’ lawyer, said the defense theory “seems like the easiest to accept — that Joe Ryan communicated with Christine Banfield through a BDSM website.”

Speaking during that December hearing, Campbell said it was difficult for him to accept that somebody other than Christine Banfield would be going on her computer to lure Ryan for months.

At that earlier hearing, Campbell argued that the evidence showed that Christine Banfield established the adult website account, and also purchased tickets for Peres Magalhaes to take the couple’s 4-year-old daughter to the National Zoo in D.C. during her alleged assignation with Ryan.

Ryan and Christine Banfield’s relationship was not discussed in the hearing on Monday, but prosecutors have alleged that Brendan Banfield and Peres Magalhaes were having an affair.

“The defendant and her armed, law enforcement lover did not stand by and patiently wait to shoot Joe until after he was finished stabbing Christine several times. That’s just not believable. This is a story was made up to cover a murder,” prosecutors said during the December bond hearing.

Brendan Banfield has not been charged in either killing.

What happened inside the Banfields’ Herndon house

A Fairfax County detective who interviewed Peres Magalhaes said that she told him she observed Ryan with a knife to the throat of Christine Banfield, who was nude.

According to police and prosecutors, Brendan Banfield shot Ryan near his right eyebrow with his IRS-issued service weapon. Brendan Banfield is a criminal investigative division agent for the IRS.

After Brendan Banfield wounded Ryan, Peres Magalhaes said he told her to get a gun from a safe in the bathroom of the master bedroom. She then fired a shot at Ryan, which struck him in the chest, and devastated his heart, according to the medical examiner who testified during Monday’s hearing.

Immediately after the shootings, Peres Magalhaes denied having a romantic relationship with Brendan Banfield.

However, in the months between the shootings and her arrest, prosecutors said photo and text evidence showed the two had been engaging in an affair.

Campbell objected to Fairfax County senior assistant commonwealth’s attorney Eric Clingan’s attempts to probe Brendan Banfield about his relationship with Peres Magalhaes.

Before Brandon Banfield took the stand on Monday, his defense attorney David Hall told the judge that his client intended to plead the Fifth to avoid self-incrimination.

However, Judge Lindner said prosecutors were entitled to ask questions, and he would determine whether each specific question put Brendan Banfield at risk of self-incrimination.

Banfield declined to answer any questions about his relationship with Peres Magalhaes. At one point, he refused to say whether he was married to Christine Banfield on the day she was killed.

Peres Magalhaes is due in Fairfax County Circuit Court on Tuesday morning, to appeal an earlier District Court judge ruling that denied her bond before trial.
