    A Lufthansa flight traveling from Texas to Germany was diverted to Virginia’s Washington Dulles International Airport on Wednesday evening because of turbulence that left some passengers injured, an airport spokesperson said.

    Lufthansa Flight 469, which took off from Austin, experienced “significant turbulence” and landed safely at Dulles, Metropolitan Washington Airports Authority spokesperson Michael Cabbage said.

    Seven people were transported to hospitals, Cabbage said.

    Brief but severe turbulence happened about 90 minutes after takeoff and resulted in minor injuries to some passengers, a statement given to CNN by a Lufthansa spokesperson reads.

    “This was so-called clear air turbulence, which can occur without visible weather phenomena or advance warning,” the statement reads.

    “The affected passengers were given initial care on board by the flight attendants trained for such cases. As the safety and well-being of passengers and crew members is the top priority at all times, the cockpit crew decided to make an alternate landing to (Dulles airport) after flying through the turbulence.”

    The crew of the Airbus A330 reported reported encountering the turbulence at an altitude of 37,000 feet over Tennessee, the Federal Aviation Administration told CNN.

    The flight landed at Dulles airport around 9:10 p.m., FAA spokesperson Ian Gregor said.

    The FAA will investigate the incident, Gregor said.

    The US intelligence community cannot link any cases of the mysterious ailment known as “Havana Syndrome” to a foreign adversary, ruling it unlikely that the unexplained illness was the result of a targeted campaign by an enemy of the US, according to a US intelligence assessment published on Wednesday.

    The latest conclusion comes years after the so-called syndrome first emerged and defies a theory that it could have been the result of a targeted campaign by an enemy of the US.

    The new assessment echoes an interim report from the CIA last year that found it unlikely that the “anomalous health incidents,” as they are formally known, were the caused by “a sustained worldwide campaign” by Russia or any other foreign actor.

    Wednesday’s assessment also goes further in finding that there is no credible evidence that a foreign adversary has a weapon or collection device that is capable of causing the mysterious incidents, US intelligence officials said.

    Officials also explained that the medical analysis has also evolved in a way that points away from adversarial involvement.

    “I can share with you that most IC agencies have now concluded that it is ‘very unlikely’ a foreign adversary is responsible for the reported AHIs. IC agencies have varying confidence levels because we still have gaps given the challenges collecting on foreign adversaries – as we do on many issues involving them,” said Director of National Intelligence Avril Haines.

    The mysterious illness first emerged in late 2016, when a cluster of diplomats stationed in the Cuban capital of Havana began reporting symptoms consistent with head trauma, including dizziness and extreme headaches. In subsequent years, there have been cases reported around the world, including clusters of at least 60 incidents in Bogota, Colombia and Vienna, Austria. There have been about 1,500 reported cases across the US government in 96 different counties including some cases reported this year, officials said Wednesday, but the number of reported incidents has dropped significantly in the last year.

    The assessment, the result of the work of seven intelligence agencies, draws on the immense resources of the US intelligence community, including a review of hundreds of incidents and a wide range of factors surrounding them, officials explained.

    Wednesday’s assessment, however, does not provide definitive answers on or what caused the ailment that has sickened hundreds of US government personnel and family members worldwide.

    There is no one explanation for these incidents. Instead, there are many different possible causes including environmental as well as social factors and preexisting medical conditions, officials said.

    The assessment is likely to lead to further frustration among those impacted who have chastised the US government for not taking the condition seriously enough or slow-rolling the investigation.

    “There is something counterintuitive to all of this. If doctors are diagnosing some of us with a qualified injury to the brain in the line of duty and we are not saying it was a foreign adversary, what was it from?” said one former CIA agency officer who experienced symptoms.

    The intelligence community workforce was notified of the assessment on Wednesday, officials said. Sufferers were notified in recent days that the assessment was coming and some received a call from CIA Director Bill Burns, one source said.

    In a statement, Burns said the assessment is “one of the largest and most intensive investigations in the Agency’s history,” stating that it “reflects more than two years of rigorous, painstaking collection, investigative work, and analysis by IC agencies, including CIA.”

    “I want to be absolutely clear: these findings do not call into question the experiences and real health issues that US Government personnel and their family members – including CIA’s own officers – have reported while serving our country,” he said.

    The investigative efforts were “extremely aggressive” and involved “a high degree of risk,” one official explained. Intelligence officers vigorously studied what happened in the hours, days and weeks surrounding the incidents, the official explained.

    In some instances they found malfunctioning HVAC systems, which can cause discomfort to humans, and in other cases there were computer mice that created surprising disruptions.

    “We weren’t finding what we expected to find,” said one of the US officials. “There is no one explanation for any of this.”

    There was also criminal activity that occurred around some of the incidents – such as the presence of weapons dealers. But when intelligence officials chased those leads – by looking into the criminals’ past, their family and their travels – they found no connection to the mysterious health incidents.

    Officials even considered extraterrestrials as a cause, but found no linkage, they said.

    Officials said that evidence pointed against foreign involvement, including citing “confusion” on the topic among key adversaries.

    On the whole, officials did not find evidence to validate one of their incoming assumptions that one or more state actor was causing the incidents, they explained.

    There is nothing to indicate that these incidents were the result of an insider attack, the officials said. The officials would not discuss if the US has a weapon that could have caused these incidents.

    The findings also follow a report from a panel of experts last year – including scientists inside and outside of government – that found that “pulsed electromagnetic energy” emitted by an external source could have “plausibly” caused the mysterious incidents. While the latest intelligence assessment doesn’t count out that possibility completely, it appears to cast doubt on it by concluding that no US adversary has the plausible weapon or mechanism that would be needed for that to happen.

    US officials said that one of the lessons learned from the investigation was that the US government needs to do a better job looking after the health and safety of the workforce.

    Over the last year, the CIA and the State Department began providing compensation to victims whose symptoms required at least a year of medical assistance. Compensation efforts are “separate and distinct” from the intelligence assessment and will continue to be implemented, officials said.

    Following the release of the assessment, administration officials were clear that support would continue.

    “We are going to continue to see to it that our colleagues who report these incidents are treated with respect and compassion, receive timely access to medical care and we’ll continue to process Havana Act payments based on the eligibility criteria that’s been spelled out in the law,” State Department spokesperson Ned Price said.

    However, the future of the US government’s probe into these incidents is a bit murky.

    Officials would not definitively say if the intelligence community’s task force devoted to this effort would stay up and running, but Haines said that the work “will and must endure.” The Pentagon also has a team of experts that continues to investigate the matter.

    Bipartisan lawmakers warned of the threat posed by the Chinese Communist Party on Tuesday during the first hearing of the House select committee on China, a rare demonstration of unity across the aisle in a Congress increasingly divided along partisan lines.

    The panel’s chairman, Republican Rep. Mike Gallagher of Wisconsin, described the stakes in sweeping and dire terms at the outset of the hearing, saying, “This is an existential struggle over what life will look like in the 21st century – and the most fundamental freedoms are at stake.”

    Rep. Raja Krishnamoorthi of Illinois, the panel’s top Democrat, argued that working across the aisle is critical for the US to counter the threat. “We must practice bipartisanship,” he said. “We must recognize that the CCP wants us to be fractious, partisan and prejudiced,” a reference to the Chinese Communist Party.

    Gallagher made a clear distinction between the Chinese government and its citizenry, saying, “We must constantly distinguish between the Chinese Communist Party and the Chinese people themselves, who have always been the party’s primary victims.”

    And Krishnamoorthi stressed the need to “avoid anti-Chinese or Asian stereotyping at all costs.”

    The hearing featured several high-profile witnesses, including former President Donald Trump’s national security adviser, H.R. McMaster, and China expert and former deputy national security adviser Matthew Pottinger.

    McMaster said the committee “can help determine the combinations of policies and legislation necessary to counter CCP aggression and rebuild America’s and the free world’s competitive advantages.”

    The hearing also featured compelling first-person testimony from Tong Yi, former secretary to one of China’s leading dissidents and human rights activist Wei Jingsheng.

    Tong described being interrogated by police at a detention center in Beijing about what Wei had said to US dignitaries. “They were truly afraid that the US might listen to Wei,” she said.

    Tong argued that the US must confront its own role in the development current state of affairs.

    “In the US, we need to face the fact that we have helped to feed the baby dragon of the CCP until it has grown into what it now is,” she said. “Since the 1990’s US companies have enriched themselves by exploiting cheap labor in China and have in the process also enriched the CCP,” she added.

    “I am a proud immigrant citizen of the US, and I want my country to do better,” Tong said.

    Ahead of the hearing, lawmakers on both sides of the aisle have worked to set a tone of cooperation for the panel.

    The US-China relationship has garnered heightened attention in the wake of the US shooting down a suspected Chinese surveillance balloon, an incident that took place in early February after the balloon had traveled across the continental US. China has denied the vehicle was used for spying, saying instead it was a research airship blown off course and accusing US of overreacting to the incident.

    McMaster was asked during the hearing what message China was sending to the US with the balloon. “I think the message is that we are intending to continue a broad range of surveillance activities. The balloon, I think, is in many ways a metaphor for the massive effort at espionage,” he said. “The balloon is important to look at but placing the balloon in context is perhaps most important.”

    In a display of unity across party lines, the House of Representatives voted to pass a resolution condemning China’s use of the suspected surveillance balloon. The measure passed unanimously with overwhelming bipartisan support by a vote of 419 to zero.

    President Joe Biden’s embattled pick to lead the Federal Aviation Administration is scheduled for his confirmation hearing before Congress on Wednesday morning amid a series of challenges for the agency.

    Phil Washington is expected to get grilled by senators on issues that have emerged since he was nominated last summer and explain why he’s qualified to lead an agency that urgently needs to address a slew of complex challenges.

    The hearing for Washington, whose lack of aviation experience and legal entanglements have raised concerns on Capitol Hill, comes after a year of the FAA operating without a permanent administrator. In that time, the agency has contended with several problems that have plagued travelers and the airline industry, such as recent near-collisions involving airliners, crucial staffing shortages and malfunctions of aging technology that have cause major air travel disruption.

    Washington, whose nomination was first announced by Biden nearly eight months ago, will appear before the Senate Committee on Commerce, Science, and Transportation Wednesday at 10 a.m. ET.

    Washington, the current CEO of the Denver International Airport, has held leadership roles at municipal transit organizations, including in Denver and Los Angeles, focused on bus and rail lines. He also led the Biden-Harris transition team for the Department of Transportation. Prior to his work in transportation, Washington served in the military for 24 years.

    While Washington has worked in transportation-related positions since 2000, he had no experience in the aviation industry prior to joining the Denver airport in 2021. Since his nomination last summer, Washington has faced questions about his limited experience and, in September, was named in a search warrant issued as part of a political corruption investigation in Los Angeles.

    According to a questionnaire given to the commerce committee ahead of Wednesday’s hearing, Washington wrote that though his name was mentioned in the search warrant along with several other names, no search was ever executed on him or his property, nor was he questioned about the matter.

    Washington’s name was also recently mentioned in a federal lawsuit filed earlier this month. Benjamin Juarez, a former parking director at the Denver Airport, alleges that the city permitted intolerable working conditions and that he faced ongoing threats to his job, Axios reported. Juarez’s attorney says he contacted Washington, who was leading the airport, at least twice for help and did not receive a response.

    Texas Republican Sen. Ted Cruz, the ranking Republican on the committee, has asserted that Washington failed to disclose his naming in the lawsuit involving his work at the Denver airport. Republicans have also questioned whether Washington, an Army veteran who left the military in 2000 after more than 20 years of service, would be statutorily considered a civilian – a requirement in order to serve as the FAA chief.

    If he’s not considered a civilian, he would need a waiver from Congress permitting him to lead the agency. And Republicans do not support granting Washington a waiver.

    A GOP aide on the Senate commerce committee told CNN that Cruz and Senate Republicans expect to raise all these issues – including his legal entanglements, his lack of experience, his management and his possible ineligibility – during Wednesday’s hearing.

    They’ll also focus on Washington’s efforts to incorporate diversity, equity, and inclusion in the vendor and contractor process as well as leading efforts “to make it harder and more expensive to drive in Los Angeles to force people to use mass transit instead in order to save mankind from climate change,” according to the aide. Specifically, the aide referenced Washington’s work to pursue a policy which charges drivers for using congested roadways during peak hours.

    Senate Majority Leader Chuck Schumer said in January that he would push to confirm Washington.

    “There is no doubt about it: it’s time to clear the runway for President Biden’s choice for FAA administrator, Phil Washington. With recent events, including airline troubles and last week’s tech problem, this agency needs a leader confirmed by the Senate immediately,” Schumer said in a statement following a computer system failure that triggered the delay of more than 12,000 flights. “I intend to break this logjam, work to hold a hearing for Mr. Washington, where he can detail his experience and answer questions and then work towards a speedy Senate confirmation.”

    The FAA is a sprawling and complex safety, regulatory and operational agency, tasked with regulatory oversight of all civilian aviation in the US.

    It’s been without a permanent administrator for about a year, when the Trump-nominated Stephen Dickson stepped down midway through his five-year term. Billy Nolen, the agency’s top safety official, was named acting director in April.

    The agency has a professed focus on safety, but agency leadership is ultimately responsible for steering its focus as its mission gets wider – with responsibilities expanding to include establishing the federal approach to private space launches and regulating drones – even as longstanding aspects of the aviation industry continue to grapple with major challenges.

    A failure of the 30-year-old NOTAM, or Notice to Air Missions, system led to the first nationwide airplane departure grounding since the 9/11 attacks, showcasing just one way aging industry technology is being stretched beyond its limits by increased volume. Now, the FAA is planning to dramatically accelerate replacing the safety system.

    Another FAA computer system failed earlier this year when it was overloaded, leading to delays in Florida. And the agency has struggled to modernize parts of air traffic control, with a 2021 Transportation Department Office of Inspection General report citing difficulties integrating the FAA’s multi-billion dollar Next Generation Air Transportation System project due to extended delays.

    There have been recent near-collisions on US runways, prompting federal safety investigators to open multiple inquiries. Air traffic control is staffed at the lowest level in decades, according to industry experts. And key roles at US airlines pared down amid the Covid-19 pandemic have not ramped up to meet current outsized travel demand.

    In February, Nolen, the acting chief, ordered a sweeping review of the agency in the wake of recent aviation safety incidents. That review is expected to include a major safety meeting this month.

    Another challenge is the FAA’s evolution in how it handles oversight following the Boeing 737 MAX crashes.

    Congress created reforms to the FAA’s oversight in a late 2020 law but critics say the agency has been slow to implement changes.

    A House Transportation committee investigation into 737 MAX certification found the model of oversight used then “creates inherent conflicts of interest that have jeopardized the safety of the flying public.” The report also concluded senior FAA officials overrode decisions of FAA experts.

    The agency is also still trying to resolve an 5G interference issue.

    The next generation of cell phone technology can interfere with devices on aircraft that determine how far above the ground the aircraft is – the radar or radio altimeter.

    FAA says it brought its concerns to the administration at the time when the Federal Communications Commission was developing plans to auction this portion of spectrum. But now the FAA is trying to play catch up while wireless carriers agreed to voluntarily pause rolling out their new tech around airports.

    The Biden administration is projecting confidence about the fate of President Joe Biden’s student loan cancellation program in a message to applicants, even in the face of skepticism from conservative Supreme Court justices in Tuesday’s high-stakes oral arguments.

    Education Secretary Miguel Cardona said in an email sent to millions of borrowers who applied for debt cancellation that the administration “mounted a powerful case” in support of Biden’s executive action.

    “Our Administration is confident in our legal authority to adopt this plan, and today made clear that opponents of the program lack standing to even bring their case to court,” Cardona wrote in the email update obtained by CNN.

    The email update to applicants reflects a position administration officials have maintained in the wake of the oral arguments. But it also implicitly lays out the administration’s view of the political dynamics of a move that has became an immediate partisan flashpoint. As applicants and administration officials alike settle in for what will likely be months of waiting for a final decision, the update sent to roughly 7 million people also provides a window into the reach the administration would have to frame the debate – and consequences – should the program be struck down.

    Cardona’s message comes as millions of borrowers remain in limbo as they await a Supreme Court decision on whether Biden’s action to cancel up to $20,000 in student loan debt will stand.

    White House officials, who closely monitored the oral arguments in two challenges, have maintained the position that they will ultimately prevail in the cases that challenge Biden’s authority to discharge millions of dollars in federally held loans. While they remain confident on the merits, sources continue to highlight the view inside the administration that the plaintiffs lack standing to bring the challenges – which would render the arguments over the authority itself moot.

    One source familiar told CNN that the White House remains confident that things will go their way, simply saying: “We’ll win.”

    A particular flashpoint in the hearing was the states’ arguments that the loan forgiveness program’s potential harms to MOHELA – the Missouri-created entity that services loans in the state – gives Missouri standing.

    Justice Amy Coney Barrett stood out among the conservatives for asking particularly pointed questions of the GOP states about their standing arguments, setting her apart as a potential pickup vote for the court’s three liberal members.

    “If MOHELA is an arm of the state, why didn’t you just strong-arm MOHELA and say you’ve got to pursue this suit,” Barrett asked Nebraska Solicitor General James Campbell.

    The question was one of several directed at Campbell, who represented the group of Republican-led states that argue the administration exceeded its authority, about the states’ standing claims.

    Another source familiar said that Barrett’s comments only raised optimism within the administration.

    But as several conservative justices leveled sharp questions related the government’s authority on the matter, Cardona’s update appeared intended to assuage overarching concerns.

    It also previewed a political contrast officials will likely elevate should Supreme Court strike down Biden’s actions – one White House officials have repeatedly pressed as the challenges have made their way through the courts.

    “While opponents of this program would deny relief to tens of millions of working- and middle-class Americans, we are fighting to deliver relief to borrowers who need support as they get back on their feet after the economic crisis caused by the pandemic,” Cardona wrote.

    Biden’s plan would cancel as much as $10,000 in federal student loan debt for people earning less than $125,000 a year, or less than $250,000 for married couples. Individuals on Pell Grants could see up to $20,000 forgiven. In all, more than 40 million federal borrowers would qualify for some level of debt cancelation, with roughly 20 million who would have their balance forgiven entirely.

    The Biden administration received 26 million applications for the program, which has been frozen as the court battles have played out, and more than 16 million applications had already been approved.

    Cardona reiterated that a pause on federal loan payments, which was implemented during the Trump administration in response to the pandemic and was set to restart at the same time cancellation was implemented, remain on hold as the Supreme Court deliberations play out.

    “While we await the Supreme Court’s decision, the pause on student loan payments remains in effect,” Cardona wrote. “Payments will resume 60 days after the Supreme Court announces its decision.”

    If the litigation is not resolved by June 30, payments are scheduled to resume 60 days after that date. If it has not made a decision or resolved the litigation by June 30, payments will resume 60 days after that.

    The Supreme Court’s decision is expected to come this summer.

    Air traffic controllers stopped a departing private jet from running into a JetBlue flight as it was coming in to land Monday night in Boston, according to the Federal Aviation Administration.

    The FAA says it is investigating the incident. This is the fifth close call involving a commercial airliner on a runway this year.

    The two planes involved in Monday night’s apparent close call at Boston Logan International Airport came within 565 feet (172 meters) of colliding, according to Flightradar24’s preliminary review of its data.

    Asked for comment on the Flightradar24 analysis, the agency told CNN, “The FAA will determine the closest proximity between the two aircraft as part of the investigation.”

    “According to a preliminary review, the pilot of a Learjet 60 took off without clearance while JetBlue Flight 206 was preparing to land on an intersecting runway,” the FAA said in a statement on Tuesday.

    “JetBlue 206, go around,” said the controller in Boston Logan’s tower, according to recordings archived by LiveATC.net.

    The FAA says its air traffic controller told the crew of the Learjet to “line up and wait” on Runway 9 as the JetBlue Embraer 190 approached the intersecting Runway 4 Right.

    “The Learjet pilot read back the instructions clearly but began a takeoff roll instead,” the FAA said in a statement. “The pilot of the JetBlue aircraft took evasive action and initiated a climb-out as the Learjet crossed the intersection.”

    The National Transportation Safety Board tells CNN it has not launched an investigation into the incident at Boston Logan, though it has investigated four other runway incursions involving commercial airliners at major US airports this year.

    On Friday, the agency announced it was investigating a possible “runway incursion” in Burbank, California, involving Mesa and SkyWest regional airliners.

    Three other incidents have occurred at Honolulu, Austin and New York’s JFK airport this year.

    Vaccine advisers to the US Food and Drug Administration narrowly voted Tuesday in favor of Pfizer’s RSV vaccine for adults over the age of 60, paving the way for approval of the first nation’s RSV vaccine, despite some safety concerns.

    The committee members voted 7-4, with one abstention, that there is adequate data to support the safety and effectiveness of Pfizer’s vaccine for the prevention of lower respiratory tract disease caused by respiratory syncytial virus among older adults.

    The FDA, which typically follows the independent committee’s recommendations, is scheduled to decide on approval of the vaccines by May, ahead of RSV’s typical winter surge. The US Centers for Disease Control and Prevention must then recommend the shot before it becomes available to the public.

    Pending those steps, Pfizer’s vaccine – along with GSK’s candidate shot, which will be voted on by the FDA advisory committee on Wednesday – would be the first approved RSV vaccines for adults 60 or older.

    RSV is a highly contagious virus that causes flu-like illness in people of all ages that increases in severity with age. It’s is responsible for an estimated 177,000 hospitalizations and 14,000 deaths per year among adults 65 or older, according to the CDC.

    The Pfizer vaccine was 66.7% effective at preventing moderated lower respiratory tract illness with two or more symptoms and 85.7% effective at preventing illness with three or more symptoms, according to an FDA briefing document.

    Although a majority of the committee voted in favor of the vaccine, some members expressed concerns about the vaccine’s “important potential risk: of Guillain-Barre syndrome. Two adults among the 20,000 vaccine recipients in Pfizer’s Phase 3 clinical trial developed symptoms consistent with the rare neurological disorder within nine days of receiving the shot.

    “It seems to me that one case is a red flag. Two cases is very concerning, and it’s concerning to me that Pfizer doesn’t think that there are any safety concerns,” said Dr. Marie Griffin, professor of health policy at Vanderbilt University Medical Center, who voted that the data demonstrated the vaccine was effective but not safe.

    The FDA has recommended that Pfizer conduct a safety study for further evaluation of Guillain-Barre and other immune-mediated demyelinating conditions after potential vaccine approval, and the company has agreed.

    Dr. Daniel Feikin, respiratory disease consultant, who voted that the vaccine was both safe and effective, said that post-marketing safety surveillance will be “critical.”

    Some of the vaccine advisers wanted to see more data on effectiveness against hospitalization or death, especially among high-risk people such as older adults or those with other health conditions.

    “I think the data does support the effectiveness of this vaccine. It’s just the population was underrepresented by people who could most benefit from the vaccine,” Griffin said.

    The available safety and efficacy data from Pfizer’s clinical trial is from the first of two RSV seasons. Some of the experts said that the vote is premature and that they would like to see more data.

    “I’m desperately eager to have a vaccine that works for RSV. This has been a terrible disease my whole career. I would love to see it. No doubt about it,” said Dr. Jay Portnoy, professor of pediatrics at the University of Missouri-Kansas City, who voted that the data demonstrated that the vaccine was safe but not effective.

    Portnoy says that waiting for a second season of data would provide more robust numbers and complete analysis.

    “It’s not an emergency use authorization. We can take the time to finish the studies and get the information we need before licensing this product going forward. So I remain a little bit skeptical, given the data that we have.”

    The aftermath of the toxic train wreck in Ohio keeps spreading to more states as scientists say tests in East Palestine unusually high levels of some chemicals.

    Indiana Gov. Eric Holcomb is the latest out-of-state official to say he was stunned to learn hazardous waste from the Norfolk Southern train derailment and subsequent release of toxic chemicals was headed to his state.

    “After learning third-hand that materials may be transported to our state yesterday, I directed my environmental director to reach out” to the US Environmental Protection Agency, Holcomb said in a written statement Tuesday.

    “The materials should go to the nearest facilities, not moved from the far eastern side of Ohio to the far western side of Indiana,” Holcomb said. “I want to know exactly what precautions will be taken in the transport and disposition of the materials.”

    After surprise shipments of hazardous waste to Texas and Michigan, the EPA approved two sites in Ohio to handle safe disposal of the waste.

    Another two sites – Heritage Environmental Services’ hazardous waste landfill in Roachdale, Indiana, and Ross Incineration Services in Grafton, Ohio – will receive contaminated waste starting Tuesday, EPA Region 5 Administrator Debra Shore said Monday. She said Indiana officials and state partners were notified before the EPA approved “the shipment of any waste from the derailment to their state or district.”

    But US EPA Administrator Michael Regan said the agency is developing measures to give authorities a “heads up” about incoming waste shipments and to keep Norfolk Southern accountable for the material it is moving.

    On the other side of Ohio, the Pennsylvania Department of Health is opening a health resource center in Beaver County so residents “can talk to public health experts, sign up to have their well water tested, and learn about available resources from professionals there to help,” Gov. Josh Shapiro tweeted Tuesday.

    Beaver County is just across the state border from East Palestine, Ohio – a village of 5,000 struggling to understand the full breadth of consequences from the February 3 toxic train wreck that burned for days and led to the release of the dangerous chemical vinyl chloride.

    A new data analysis suggests nine out of the dozens of chemicals that the EPA has been monitoring are higher than what normally would be found in East Palestine, according to scientists from Texas A&M and Carnegie Mellon universities.

    If the levels of some chemicals remain high, it could pose a problem for residents’ health over time, the scientists said. Temperature changes or high winds might stir up the chemicals and release them into the atmosphere.

    The chemical with the highest concentration found in East Palestine was a substance called acrolein, the data analysis said.

    Acrolein is used to control plants, algae, rodents and microorganisms. It is a clear liquid at room temperature and is toxic. It can cause inflammation and irritation of the skin, respiratory tract and mucous membranes, according to the US Centers for Disease Control and Prevention.

    “It’s not elevated to the point where it’s necessarily like an immediate ‘evacuate the building’ health concern,” said Albert Presto, an associate research professor of mechanical engineering at Carnegie Mellon’s Wilton E. Scott Institute for Energy Innovation, who is working on the university’s chemical monitoring effort in East Palestine.

    “But, you know, we don’t know necessarily what the long-term risk is or how long that concentration that causes that risk will persist.”

    Some East Palestine residents have reported rashes, headaches, nausea and bloody noses since the derailment and the February 6 controlled release and burning of vinyl chloride.

    During his third visit to the town Tuesday, the EPA chief said ongoing tests of the air and municipal water show both are safe – but urged anyone who is feeling “any kind of adverse health impacts” to seek medical attention.

    Regan returned to East Palestine to mark the opening of the “EPA’s community welcome center,” which will be open daily so “residents and business owners can stop in to get their questions answered, sign up for home air monitoring, and learn more about cleaning services.”

    “We’ve been testing the air from the very beginning, and the state has been testing the water,” Regan said.

    “Every chemical that was on that train and every byproduct from those chemicals have been tested or are part of our testing regimen,” he said. “So we believe firmly that our testing regimen is protective.”

    Still, the EPA is offering cleaning services – which will be reimbursed by Norfolk Southern – to any concerned resident in East Palestine.

    “There have been many residents here who have indicated that they worry about some residual, or some dust or some particles,” Regan said. “While we don’t believe that there are any adverse health impacts in homes or businesses as it relates to the derailment, this is an additional step we’re taking to alleviate concern and lower the angst.”

    Ohio officials have said East Palestine’s municipal water supply is safe to drink, citing multiple tests and the fact that the municipal water comes from five wells encased in steel deep underground.

    But health officials warn those using private well water should get it tested before using it. The Columbiana County Health District is posting test results online.

    Across the border in Pennsylvania, the state Department of Environmental Protection has collected samples from “nearly every private well” in the state within one mile of the derailment site, the governor said.

    The goal is to independently verify the safety of the water in Pennsylvania, Shapiro said.

    He reiterated that “Norfolk Southern will pay for the entire cost of the clean up,” including reimbursing Pennsylvania county fire departments for “equipment that was damaged or contaminated while responding to the derailment.”

    US Transporation Secretary Pete Buttigieg has called for Norfolk Southern and the rest of the freight rail industry to take a number of immediate actions, including committing to phase in safer tank cars by 2025.

    The Department of Transportation also wants Congress to take up legislation that would increase the maximum fines the DOT can issue to rail companies for violating safety regulations, Buttigieg said.

    He also called on the CEOs of major freight rail companies to “join a close-call reporting system that protects whistleblowers who spot issues that could lead to accidents,” Buttigieg told CNN on Tuesday.

    “We’re focusing on lessons learned when it comes to rail safety.”

    The nomination of former Los Angeles Mayor Eric Garcetti to be the next ambassador to India continues to be in limbo in the US Senate with a vote in the Senate Foreign Relations Committee now expected to be held next week.

    Sen. Bob Menendez, the chair of the Foreign Relations panel, told CNN on Tuesday that he expects to reschedule a vote for Garcetti’s nomination next week. The nomination was held over for one week out of a courtesy to Republicans this week.

    CNN reported last year that concerns over the nomination have centered around a former employee in Garcetti’s mayoral office who has accused him of ignoring alleged sexual harassment and bullying by one of his former senior aides. Garcetti has repeatedly denied the allegations that he ignored the alleged harassment.

    The former Los Angeles mayor’s nomination faces an uncertain future as it has continued to face headwinds, notably including from within the Democratic Party. If Senate Majority Leader Chuck Schumer was to put the nomination on the floor, it’s not a sure thing Garcetti would get the votes to be confirmed.

    Asked on Tuesday if Garcetti has the votes on the floor, Schumer said the first step is to see what happens in committee.

    Several Democrats still have concerns about the nomination, according to multiple sources. Most of those Democrats have tried to privately express their concerns to the White House and Garcetti, but the White House has stood by him.

    His office previously released a statement, saying, “As the Mayor has said repeatedly and under oath, he absolutely did not witness and was not aware of any sexual harassment … and if he were, he would have put a stop to it.”

    Garcetti’s nomination passed out of committee in the last Congress, but because it never came to the floor, the Biden administration had to renominate him and start the process over in the new Congress.

    Multiple Democrats are undecided about how they will vote on a measure that would overturn a rewriting of Washington, DC’s criminal code, which critics have argued is soft on violent criminals.

    The measure is expected to come up for a vote by next week and only needs a simple majority to pass. Sen. Joe Manchin, a Democrat from West Virginia, has said he will vote with Republicans on it.

    Congress, under DC’s Home Rule charter, is able to veto every law approved by either DC voters or government. If the repeal passes,it is likely to be the first bill that President Joe Biden will consider vetoing. Biden has said he opposes rescinding the DC crime measure but has not explicitly said if he will veto it.

    The question is whether Manchin will be alone in his vote. If he is, it would be the first time that Pennsylvania Democrat Sen. John Fetterman’s absence had an effect on a vote in the Senate because then the measure would only need 50 votes to pass. Fetterman has stepped away from the Senate for the time being to seek treatment for depression.

    Many Democrats oppose overriding the DC law. They argue local officials should make their own laws free of congressional interference and decry Republicans as hypocrites since they typically promote state and local rights. The law was passed after the city council overrode the veto of Mayor Muriel Bowser who, despite her opposition to the new law, opposes Congress overturning it.

    The DC Council had defended the measure in a letter last week, writing that “the District of Columbia has the right to self-govern as granted to us under the Home Rule Act.”

    “Any changes or amendments to the District’s local laws should be done by the elected representatives of the District of Columbia. As those representatives, we alone are accountable to the voters of the District of Columbia,” the letter continued, adding: “Just as Congress does not interfere in the local matters of other states, we compel you not to interfere in our matters.”

    Tennessee Republican Sen. Bill Hagerty, the chief sponsor of the legislation to repeal the local law called it a “common sense” approach in a city where many violent crimes are up. Politically, he compared it to the “defund the police” issue and said for centrist Democrats, “I don’t think that’s going to be very popular in their states and this falls right in that lane.”

    Sen. Jon Tester, one of those centrist Democrats who is up for reelection this cycle, told reporters he still has not decided if he would back the measure.

    “I hate to be a cop out for you guys all the time, but I do have to look at it. I just don’t know what it does yet,” Tester said Tuesday. “There is the issue of, you know, DC does what DC wants to do and let DC do what they do, but we do have some oversight.”

    Democratic Sens. Sherrod Brown of Ohio, Mark Kelly of Arizona and Gary Peters of Michigan also told CNN they have not made up their minds and are weighing the legislation.

    The measure passed out of the House with 31 Democratic votes.

    Much of what scientists know about chemical exposure comes from people’s contact with chemicals at work, Preston said, which generally means exposure for about eight hours a day. People now living in East Palestine are in constant contact with the chemicals, he said, and the impact of that kind of exposure on the human body is not fully understood.

    The EPA and local government officials have repeatedly said that their tests show the air quality in the area is safe and that the chemicals should dissipate. As of Sunday, officials have tested air in 578 homes, and they say chemical pollution levels have not exceeded residential air quality standards.

    EPA’s air monitoring data shows that levels of monitored chemicals “are below levels of concern for adverse health impacts from short-term exposures,” an agency spokesperson told CNN on Monday. “The long-term risks referenced by this analysis assume a lifetime of exposure, which is constant exposure over approximately 70 years. EPA does not anticipate levels of these chemicals will stay high for anywhere near that. We are committed to staying in East Palestine and will continue to monitor the air inside and outside of homes to ensure that these levels remain safe over time.”

    However, residents have reported rashes and trouble breathing, sometimes even in their own homes, Presto said.

    “When someone says to them then, ‘everything is fine everywhere,’ if I were that person, I wouldn’t believe that statement,” he said.

    So who’s right? The scientists say it’s not a black-and-white issue.

    “I think it’s important for the public to understand that all sides are right. No one’s lying to them,” said Dr. Ivan Rusyn, director of the Texas A&M University Superfund Research Center and part of the team that did the analysis. “It’s just that every time you’re sharing information, whether it’s Administrator of EPA Michael Regan or Governor [Mike] DeWine or someone from Ohio EPA, when they say certain things are ‘safe,’ they really need to explain what they mean.”

    Rusyn says the EPA and local officials need to do a better job of communicating with the public about the risk to residents when they are exposed to chemicals released in the crash.

    Communication struggles have been a consistent pattern over the years and over numerous environmental disasters, he said. Officials will often do a good job of collecting and releasing data but then fail to give the proper context that the public will understand.

    “That’s what I would like to encourage all parties to do rather than to point fingers,” Rusyn said. “The general public has to trust authorities. Cleanup is continuing. They are doing monitoring. We just need to do a better job communicating the results.”

    Government communication about residents’ real level of risk has been a significant source of frustration in East Palestine, Presto said.

    “People are furious. They feel like they’re getting this black-and-white answer – things are safe or not safe – when it’s not a black-and-white sort of situation,” Presto said.

    The EPA says it will continue to monitor the air quality in the area and in residents’ homes. It is also setting up a community center so residents and business owners can ask questions about agency activity there.

    The agency said it is collecting outdoor air samples for contaminants of concern, including vinyl chloride, a hard plastic resin used to make plastic products like pipes or packaging material that can be a cancer concern; n-butyl acrylate a clear liquid used to make resins and paint products that can cause eye, throat, nose and lung irritation or damage as well as a skin allergy; and ethylhexyl acrylate, another colorless liquid used to make paints, plastics and adhesives that can cause skin and eye irritation.

    The EPA also collected field measurements for hydrogen sulfide, benzene, hydrogen cyanide, hydrogen chloride, phosgene and particulate matter.

    Scientists from Texas A&M and Carnegie Mellon are monitoring the chemicals in the area using a mobile lab that they’ve used for the past decade to measure air pollution in real time in cities across the country. They expect to release data from their own tests in East Palestine on Tuesday.

    The mobile lab has extremely sensitive equipment that can measure pollution in the parts per trillion. Scientists would then be able to plot them on a graph to show, in real time, where the concentrations of chemicals may be and at what level, Presto said.

    Mobile lab workers will try to determine whether there are chemicals in the air that the EPA isn’t monitoring. They are also looking at pollution levels in places where the agency did not set up monitoring stations.

    “The situation has to be monitored, and the EPA should continue measurements, and they should also communicate to the general public as to what they’re seeing and put this into context of risk, rather than use the numbers and expect people to figure it out for themselves,” Rusyn said.

    A ransomware attack on the US Marshals Service has affected a computer system containing “law enforcement sensitive information,” including personal information belonging to targets of investigations, a US Marshals Service spokesperson said Monday evening.

    “The affected system contains law enforcement sensitive information, including returns from legal process, administrative information, and personally identifiable information pertaining to subjects of USMS investigations, third parties, and certain USMS employees,” spokesperson Drew Wade said in a statement.

    The Marshals Service, which handles federal prisoners across the US and pursues fugitives, discovered the hack and theft of data from its network on February 17. The service “disconnected the affected system, and the Department of Justice initiated a forensic investigation,” Wade said in the statement.

    The Justice Department subsequently determined it “constitutes a major incident,” according to the statement. A “major incident” is a hack that is significant enough that it requires a federal agency to notify Congress.

    A senior official familiar with the matter told CNN that no data related to the witness protection program was obtained during the incident.

    The Justice Department’s investigation into the incident is ongoing.

    NBC News first reported on the incident.

    It’s at least the second significant malicious cyber incident to affect US federal law enforcement agencies in February.

    The FBI had to move to contain malicious activity on part of its computer network earlier this month, CNN first reported at the time. FBI officials believe that incident involved an FBI computer system used in investigations of images of child sexual exploitation, two sources briefed on the matter told CNN.

    There was no immediate indication that the US Marshals Service and FBI cyber incidents were related.

    After a brief pause, shipments of contaminated liquid and soil from the toxic train derailment in East Palestine, Ohio, have resumed after cross-country concerns about where the hazardous waste is going.

    Officials with the Environmental Protection Agency previously said they have approved the shipment of contaminated waste to two EPA-certified sites in Ohio: Heritage Thermal Services in East Liverpool and Vickery Environmental in Vickery. Region 5 Administrator Debra Shore said Monday two more sites – one in Ohio and one in Indiana – will also receive waste from the derailment scene.

    The move came after officials in Texas and Michigan complained they didn’t get any warning that waste from the toxic crash site would be shipped to their states for disposal. The EPA ordered the train’s operator, Norfolk Southern, to stop the shipments Friday so that it could review the company’s disposal plans.

    Shore said she spoke with officials from Ohio and Indiana on Monday regarding the shipment of hazardous waste material to their towns.

    Questions about the disposal of toxic waste from the February 3 derailment have added to the controversy surrounding the crash that has also left residents of the town worried about potential long-term health effects.

    The mayor of East Liverpool, one of the Ohio towns set to incinerate the waste, expressed concerns about the process but said the EPA has assured him that everyone has been following necessary guidelines.

    “We have a 2-year-old daughter and of course that’s a concern,” Mayor Gregory T. Bricker said. “But, again, I think this is a state-of-the-art facility that can handle this type of waste.”

    So far, about 1.8 million gallons of liquid waste and 4,832 cubic yards of solid waste have been pulled from the derailment site, according to the office of Ohio Gov. Mike DeWine.

    EPA Administrator Michael Regan is expected to make his third trip to East Palestine on Tuesday to mark the grand opening of a new community center, Shore said.

    US Transportation Secretary Pete Buttigieg has given Norfolk Southern and other major rail companies a deadline of this week to say whether they will participate in the Confidential Close Call Reporting System – a voluntary program that allows workers to report safety hazards.

    “This common-sense program encourages employees to report safety hazards, including conditions that could lead to derailments, by protecting these workers from reprisal when they come forward,” Buttigieg wrote in a Monday letter to Norfolk Southern CEO Alan Shaw.

    The transportation secretary said “not one major freight rail company participates” in the Confidential Close Call Reporting System, also known as C3RS.

    “By refusing to take this commonsense step, you are sending an undesirable message about your level of commitment to the safety of your workers and the American communities where you operate,” Buttigieg wrote.

    “I am asking you to join the C3RS program now, even as our Department proceeds to take appropriate steps toward making this program mandatory.”

    Buttigieg first called for the change in a letter to railroads dated February 14, but is now going directly to rail CEOs and asking them to reply to the Department of Transportation “by the end of the week.”

    After that, Buttigieg said, he will “present the public with a summary of which companies have agreed to this important safety measure and which have refused.”

    The hazardous waste that has already been sent to Michigan and Texas is being processed, EPA regional administrator Debra Shore said Sunday.

    About 2 million gallons of firefighting water from the train derailment site were expected to be disposed in Harris County, Texas, with about half a million gallons already there, the county’s chief executive said last week.

    In Michigan, contaminated soil from the derailment site was taken to the US Ecology Wayne Disposal in Belleville, Michigan, US Rep. Debbie Dingell of Michigan said.

    Vickery Environmental will process overflow water from the crash scene, according to the Sandusky County Emergency Management Agency.

    The agency didn’t comment on how much water the facility has received so far, saying only that it has been receiving three to four loads per day, but according to Ohio officials, more than 94,000 gallons have been disposed of at the facility so far.

    Until Friday, Norfolk Southern had been “solely responsible” for disposing of waste from the train derailment, but waste disposal plans “will be subject to federal EPA review and approval moving forward,” Shore said.

    Every aspect of transporting and disposing of the hazardous waste “from the moment trucks and rail cars are loaded until the waste is safely disposed of” will be closely regulated and overseen by federal, state, and local governments, Shore said Sunday.

    After speaking to residents in East Palestine, Shore said “we owe it to the people of East Palestine to move it out of the community as quickly as possible.”

    “At the same time,” Shore added, “I know there are folks in other states who have concerns, legitimate concerns, about how this waste is being transported and how it will be disposed of. EPA will continue to work with our local, state, and federal partners to use our longstanding experience and expertise in these matters to ensure the health and safety, and support the East Palestine community and to hold Norfolk Southern accountable.”

    The fiery derailment and subsequent intentional release of vinyl chloride from train cars left East Palestine residents with anxiety about the safety of their air and water. Some have reported rashes, headaches, nausea and bloody noses.

    So far, tests of East Palestine’s public drinking have found “no indication of risk to East Palestine public water system customers” and “treated drinking water shows no detection of contaminants associated with the derailment,” the EPA said in a Sunday update.

    And air quality tests inside 578 East Palestine homes detected no contaminants linked to the derailment, the EPA said.

    But residents are still concerned, and federal teams are going door-to-door to conduct health surveys and provide informational flyers after President Joe Biden directed the move, a White House official told CNN.

    And new wells will be drilled this week “to determine if ground water immediately below the derailment site is contaminated,” DeWine’s office announced Sunday.

    Four wells have already been installed and up to three more will be drilled this week after the soil under the rails is completely excavated, officials said.

    “These monitoring wells will also support a better understanding of the direction and rate of the ground water flow in the area,” DeWine’s office said.

    As for the wreckage, all rail cars except the 11 held by investigators have been removed from the site of the derailment, Ohio Environmental Protection Agency Director Anne Vogel said Sunday.

    “This is so critically important to moving on to next steps. We can now excavate additional contaminated soil and began installing monitoring wells,” Vogel said.

    The Ohio EPA will oversee the installation of water monitoring wells at the site of the derailment that will measure contaminant levels in the groundwater below.

    While the crash was “100% preventable,” it appears the train’s crew didn’t do anything wrong leading up to the derailment, said Jennifer Homendy, chair of the National Transportation Safety Board.

    An NTSB preliminary report found one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, Homendy said last week. Video of the train before the crash showed what appeared to be an overheated wheel bearing, the report said.

    What caused the wheel bearing failure will be key to the investigation, Homendy added.

    The investigation will also look into the train’s wheelset and the bearing, the designs of tank cars and railcars, the maintenance procedures and practices, as well as the damage from the derailment, the NTSB report said.

    Michigan Rep. Elissa Slotkin is entering the race to replace retiring Democratic Sen. Debbie Stabenow, with a campaign launch video on her YouTube page and a US Senate campaign website up.

    The announcement makes Slotkin the first Democrat to officially declare a bid in what is likely to be among the most competitive and expensive Senate contests in 2024.

    In the three-minute-long video, Slotkin talks about growing up in Michigan, entering public service after 9/11 and going on to work for the CIA.

    “Look, we all know America is going through something right now. We seem to be living crisis to crisis. But there are certain things that should be really simple,” Slotkin says in the video. “This is why I’m running for the United States Senate. We need a new generation of leaders that thinks differently, works harder, and never forgets that we are public servants.”

    Slotkin won reelection to the US House in one of Michigan’s top battleground districts in 2022. According to her most recent FEC filing, Slotkin had about $130,000 in her campaign account at the end of 2022.

    Michigan’s Senate seat is crucial for Democrats. The party is defending 23 of the 34 Senate seats up for reelection next year, including three seats in states that backed former President Donald Trump by at least 8 points in 2020: West Virginia, Montana and Ohio. Besides Michigan, the party is also defending seats in other battleground states such as Arizona, Nevada, Pennsylvania and Wisconsin.

    Other potential candidates for the seat include Republican Reps. Bill Huizenga and John James, Democratic Rep. Debbie Dingell, and Democratic state Sen. Mallory McMorrow, who drew national attention last year in a floor speech pushing back against anti-LGBTQ attacks from a Republican colleague. James lost a closer-than-expected race to Stabenow in 2018 and then narrowly lost a bid for the state’s other Senate seat in 2020, before winning election to the House in November from a swing seat north of Detroit.

    Several other Democrats who have been considered potential candidates, such as Michigan Gov. Gretchen Whitmer, Transportation Secretary Pete Buttigieg and Rep. Dan Kildee, have said they are not running.

    GOP leaders are sending warnings that they want former President Donald Trump to play by the rules and put his party above his own interests as he embarks on a third campaign – that is, to behave in a way he rarely, if ever, has before.

    Republican National Committee Chair Ronna McDaniel gave the clearest sign yet on CNN’s “State of the Union” Sunday that 2024 GOP White House candidates will have to pledge to back the party’s presidential nominee if it isn’t them – or risk being banned from the debate stage.

    “I think it’s kind of a no-brainer, right?” McDaniel told Dana Bash, adding that formal criteria haven’t yet been established for the first debate in August. “If you’re going to be on the Republican National Committee debate stage asking voters to support you, you should say, ‘I’m going to support the voters and who they choose as the nominee,’” McDaniel added.

    The former president, who signed a loyalty pledge in 2015, responded with his typical hubris on Sunday, despite recent polling showing that enthusiasm for him among the GOP isn’t what it used to be. “President Trump will support the Republican nominee because it will be him,” a campaign spokesperson told CNN in response to McDaniel’s prediction there’d be a loyalty pledge required of candidates.

    Trump has already said that whether he would back someone other than himself as the 2024 Republican nominee would depend on who the candidate was. Given that he is attacking his potential primary rivals, especially high-flying Florida Gov. Ron DeSantis, the potential for new party splits is growing.

    Ever since Trump took control of the GOP with his 2016 nomination and victory, the party has almost always capitulated to his unruly instincts and crushing of rules and conventions – most notoriously appeasing his extremism during two impeachments. Many GOP lawmakers amplified his false claims of electoral fraud in the 2020 presidential election and whitewashed his role in the January 6, 2021, insurrection.

    Yet Trump’s intervention in last year’s midterm elections, when many of his election-denying acolytes lost in swing states and helped to quell a Republican red wave, highlighted how his own priorities may diverge from his party’s. Some Republican leaders blame Trump and the way he alienates more moderate, suburban voters for the party’s disappointing performances when they lost the House in 2018, the Senate and White House in 2020 and fell short of expectations in 2022, even though they flipped the House. As a result, some top GOP donors and opinion formers have argued that it’s time for the party to move on from a candidate who is radioactive with many voters and who could thwart their chances of defeating President Joe Biden in an expected reelection bid. It remains to be seen if this view is shared among Trump’s longtime base.

    Questions about whether Trump would support DeSantis as nominee – or anyone else who might beat him – stemmed from a radio interview with Hugh Hewitt earlier this month.

    “It would depend. I would give you the same answer I gave in 2016 during the debate. … It would have to depend on who the nominee was,” Trump said.

    It would be a nightmare scenario for the GOP if Trump were to lose the party’s nominating contest next year but spend the general election railing against the party’s presidential pick. Even small defections among Trump’s devoted grassroots political base could be critical in the kind of swing state races that decided the last two presidential elections.

    Trump acts as if he is entitled to his third consecutive spot at the top of the Republican Party’s presidential ticket. But that assumption will face a new test this week when DeSantis, whom Trump has already accused of disloyalty for considering a White House run, promotes and releases a new book in a rite of passage for potential presidential candidates.

    Trump has also lashed out at Nikki Haley, who served as his ambassador to the United Nations and has launched a 2024 bid rooted in calls for a new generation of American political leadership. Both Trump and Haley are scheduled to speak at this week’s Conservative Political Action Conference outside Washington, DC. DeSantis, meanwhile, is scheduled to attend events in Texas and California.

    While requiring debate candidates to sign a pledge to support the nominee would be a show of party unity and would, in effect, be an attempt to box Trump in, it would hardly be enforceable should the ex-president not win the nomination. Given that Trump already falsely claimed the 2020 general election, which he lost fair and square, was marred by voter fraud, it’s hardly far-fetched to believe he may trash any nomination process that he doesn’t win.

    But McDaniel said on CNN that she was sure that all the candidates would sign such a pledge, noting Trump had signed on in the 2016 race and raising the leverage that the party has in getting all of the candidates on board.

    “I think they all want to be on the debate stage. I think President Trump would like to be on the debate stage. That’s what he likes to do,” McDaniel told Bash.

    The RNC head, who just won her own contested reelection, also warned that the GOP has lost big races in the midterms “because of Republicans refusing to support other Republicans. And unless we fix this in our party, unless we start coming together, we will not win in 2024.”

    McDaniel may also have a problem beyond Trump, since some possible GOP 2024 contenders have warned that following his role in inciting a mob attack on Congress in one of the most damaging blows to US democracy in modern times, the ex-president is no longer fit to carry the party’s banner or for the presidency.

    Former Arkansas Gov. Asa Hutchinson said on CBS this month that Trump had “disqualified himself and should not serve our country again as a result of what happened” on January 6, 2021. But Hutchinson did not say whether he would decline to endorse Trump if he were the nominee. Another possible anti-Trump candidate, former Maryland Gov. Larry Hogan, suggested to Hewitt this month that he would support the ex-president if he was the party’s nominee but later said on Twitter, “Trump won’t commit to supporting the Republican nominee, and I won’t commit to supporting him.”

    One reason why the question of whether Trump would endorse a nominee other than himself in 2024 is so topical is because of some early signs that the former president might not have quite the hold on his party as he once did. His campaign hasn’t exactly caught fire since he launched it last fall. Some recent polls, while too far out from primary voting to be decisive, suggest that DeSantis is closely matched with Trump – even if other candidates like Haley and potential candidates like ex-Vice President Mike Pence trail in single figures.

    After his bumper reelection win in Florida in November, DeSantis is seen by some party figures as representative of Trump’s populist, cultural and “America First” principles without the indiscipline and scandal that follows the ex-president. The Florida governor has adopted Trump’s pugilistic partisan style, telling Fox News host Mark Levin on Sunday that he had made “the Democratic Party in our state, basically, a rotten carcass on the side of the street.”

    It remains a question, however, how DeSantis would stand up to Trump’s searing attacks on a debate stage. And many once vaunted candidates – like former Govs. Jeb Bush of Florida and Scott Walker of Wisconsin – have looked strong in theory, only to see their campaigns flame out when they hit the trail.

    Still, McDaniel’s message on Sunday shows the depth of party concern that an untamed Trump could again severely impair the Republican Party’s hopes of winning the White House and control of Congress.

    A series of House Republican committees are plotting to launch investigations into the toxic train disaster in East Palestine, Ohio, multiple committee aides told CNN.

    GOP lawmakers are vowing to use their oversight power to dig into what they describe as the Biden administration’s flawed response to the train wreck, which has left East Palestine’s residents afraid to use the city’s air and municipal water after a train carrying toxic chemicals derailed on February 3.

    They have also left the door open to holding hearings on the subject, including potentially bringing in Environmental Protection Agency Administrator Michael Regan and Transportation Secretary Pete Buttigieg to testify publicly, the aides said, though such decisions have not yet been made.

    The GOP’s increased urgency for oversight comes as several lawmakers have criticized President Joe Biden for not visiting East Palestine. Biden told reporters on Friday he has no plans to travel to the site of the derailment and defended his administration’s response to the wreck.

    The House committees on Transportation and Infrastructure, Energy and Commerce and Oversight are among the panels vowing to find answers to what happened, as well as hold the Biden administration and rail industry accountable for the fallout.

    Some GOP members of the committees are also discussing a potential field hearing in East Palestine, though no official plans have been made yet, sources familiar with the talks tell CNN.

    Axios first reported on the committees’ plans.

    The Energy and Commerce Committee has asked the EPA to appear before the panel’s Environment, Manufacturing & Critical Materials subcommittee chaired by GOP Rep. Bill Johnson, who represents East Palestine, a committee aide told CNN.

    Johnson and Energy and Commerce Chair Cathy McMorris Rodgers, a Washington state Republican, formally kicked off their probe on February 17, when they sent a letter to Regan demanding answers on a timeline of events relating to the train wreck, a list of the chemicals on board, materials relating to the EPA’s and local agencies’ response, as well as other information regarding the derailment.

    Johnson and McMorris Rodgers gave the EPA until March 3 to respond to their request.

    The Energy and Commerce Committee has asked for an all-members briefing, a committee briefing, as well as a hearing date from EPA officials. A source familiar told CNN they are still awaiting a response.

    The Transportation and Infrastructure Committee plans to “keep Members informed as facts come out,” committee spokesman Justin Harclerode told CNN. The committee is also closely watching the National Transportation Safety Board’s investigation into the incident.

    “The important thing is to learn exactly what happened, what factors played a role in the accident, and what factors did not. The Committee is staying engaged on this issue, but no one should jump to any conclusions or act without all the facts. Which is exactly what the NTSB is working to provide through their investigation,” Harclerode said.

    House Oversight Chairman James Comer, meanwhile, sent a letter to Buttigieg on Friday, in which he called the incident “an environmental and public health emergency that now threatens Americans across state lines.” The Kentucky Republican requested that Buttigieg turn over a series of documents relating to the derailment, including when the administration first learned of the incident and communications regarding the Pipeline and Hazardous Materials Safety Administration’s handling of materials in the derailment.

    “At this time, Chairman Comer is focused on acquiring the documents and information requested in his February 24 letter to Secretary Buttigieg,” Comer spokesman Austin Hacker told CNN.

    The US economy is confusing: Jobs are surging. Inflation has been cooling but still running relatively hot. Gas prices are on the rebound. Consumers keep spending, and their confidence is growing. But holiday sales were tepid. Corporate layoffs are mounting. Company earnings aren’t stellar. And mortgage rates are ticking higher.

    In a time when the economic data has delivered mixed messages or flat out busted expectations, economists’ predictions for the year ahead are growing increasingly opaque.

    The National Association for Business Economics’ latest survey, released Monday, shows a “significant divergence” among respondents about where they think the US economy is heading in 2023, the organization’s president said.

    “Estimates of inflation-adjusted gross domestic product or real GDP, inflation, labor market indicators, and interest rates are all widely diffused, likely reflecting a variety of opinions on the fate of the economy — ranging from recession to soft landing to robust growth,” Julia Coronado, NABE’s president, said in a statement.

    Nearly 60% of survey respondents said they believe the US had a more than 50% shot of entering a recession in the next 12 months.

    When such a recession would start was another matter: 28% said first quarter, 33% said second quarter, and 21% said third quarter.

    As the Federal Reserve’s battle against high inflation continues to loom large, economists anticipate that key inflation gauges will slow this year, landing around 2.7% to 3% in 2023 and inching closer to the 2% target by 2024.

    Creating some uncertainty among economists, however, is what the Fed might do during that time as well as the potential effect from external factors.

    “Panelists’ views are split regarding how high the Federal Reserve may raise interest rates, how long rates might stay at the peak, when cuts would begin, and what would signal the central bank’s actions on each of these fronts,” Dana M. Peterson, NABE Outlook Survey chair, and chief economist at the Conference Board, said in the report. “Respondents are also highly concerned but divided in their opinions regarding the consequences of other matters that might affect the US economy, including the impact of China’s reopening on global inflation and the looming debt ceiling.”

    In terms of the labor market, which remains strong and tight, panelists’ median projections for monthly payroll growth this year was 102,000, a significant upward revision from projections in December for 76,000 jobs per month.

    NABE economists said they expect unemployment to increase, but the majority doubt it’ll exceed 5%.

    On the housing front, they expect home prices and new home construction to continue to fall this year, projecting that housing starts could see their largest decline since 2009.

    But they don’t anticipate the downturn to swing into “bust” territory. A mere 2% of respondents said that a “housing market bust” was the greatest downside risk to the US economy in 2023.

    Instead 51% of respondents said the biggest downside risk was too much monetary tightening. Trailing far behind in second was the broadening of war in Ukraine, with 12%.

    That’s as officials in Texas and Michigan complained they didn’t receive any warning that hazardous waste from the crash would be shipped into their jurisdictions for disposal.

    Shipments now will be going to two EPA-certified facilities in Ohio, and Norfolk Southern will start shipments to these locations Monday, EPA regional administrator Debra Shore said at a news conference Sunday.

    “Some of the liquid wastes will be sent to a facility in Vickery, Ohio, where it will be disposed of in an underground injection well,” Shore said. “Norfolk Southern will also beghin shipping solid waste to the Heritage Incinerator in East Liverpool, Ohio.”

    Until Friday, Norfolk Southern was “solely responsible” for disposing of waste from the train derailment, Shore said Saturday, but waste disposal plans “will be subject to EPA review and approval moving forward.”

    All rail cars, except for those held by the National Transportation Safety Board (NTSB), have been removed from the site of the derailment, Ohio Environmental Protection Agency (EPA) Director Anne Vogel said in an update Sunday.

    The NTSB is currently holding 11 railcars as part of its investigation into the derailment, Ohio Gov. Mike DeWine said in a statement Sunday.

    “This is so critically important to moving on to next steps. We can now excavate additional contaminated soil and began installing monitoring wells,” Vogel said. The Ohio EPA will oversee the installation of water monitoring wells at the site of the derailment that will measure contaminant levels in the groundwater below.

    Every aspect of transporting and disposing of the hazardous waste material “from the moment trucks and rail cars are loaded until the waste is safely disposed of” will be closely regulated and overseen by federal, state, and local governments, Shore said Sunday.

    Shore detailed the federal, state, and local compliance requirements expected from Norfolk Southern.

    “These extensive requirements cover everything from waste labeling, packaging, and handling, as well as requirements for shipping documents that provide information about the wastes and where they’re going,” Shore said.

    The hazardous waste material previously sent to facilities in Michigan and Texas is now being processed at those facilities, Shore said.

    About 2 million gallons of firefighting water from the train derailment site were expected to be disposed in Harris County, Texas, with about half a million gallons already there, according to the county’s chief executive.

    Also, contaminated soil from the derailment site was being taken to the US Ecology Wayne Disposal in Belleville, Michigan, US Rep. Debbie Dingell of Michigan said Friday.

    The Michigan and Ohio facilities were, in fact, EPA approved sites, but they are not currently accepting any more shipments at this time, and the EPA is “exploring to see whether they have the capacity” to accept shipments in the future, Shore said.

    A spokesperson Gov. DeWine told CNN the governor was not briefed on where in the country the shipments would be sent. But this is typical, as the train company is responsible for the transport of material and the EPA is responsible for regulating that transport, DeWine spokesman Daniel Tierney said Saturday.

    The February 3 derailment of the Norfolk Southern train and subsequent intentional release of vinyl chloride it was hauling first forced East Palestine residents out of their homes, then left them with anxiety about health effects as reports of symptoms like rashes and headaches emerged after they returned.

    Officials have repeatedly sought to assure residents that continued air and water monitoring has found no concerns. The EPA reported last week that they have conducted indoor air testing at a total of 574 homes and detected no contaminants associated with the derailment.

    Federal teams in East Palestine have begun going door-to-door to check in with residents, conduct health surveys and provide informational flyers after President Joe Biden directed the move, a White House official told CNN.

    Also, a 19-person scientific team from the Centers for Disease Control and Prevention has been collecting information from residents about symptoms they have experienced since the derailment, said Jill Shugart, a senior environmental health specialist for the CDC.

    The EPA also installed “sentinel wells” near the city’s municipal well field to monitor contaminants in well water as part of the agency’s long-term early detection system “to protect the city for years to come,” Vogel, head of the Ohio EPA, said Saturday.

    In a Saturday update on the removal of contaminated waste, DeWine said 20 truckloads of hazardous solid waste had been hauled away from the Ohio derailment site. Fifteen of those truckloads were disposed of at a licensed hazardous waste treatment and disposal facility in Michigan and five truckloads were returned to East Palestine.

    About 102,000 gallons of liquid waste and 4,500 cubic yards of solid waste remained Saturday in storage on site in East Palestine – not including the five truckloads returned, according to DeWine. Additional solid and liquid wastes are being generated as the cleanup progresses, he added.

    Dingell told CNN on Saturday that neither she nor Michigan Gov. Gretchen Whitmer were aware of plans for toxic waste to be delivered to disposal sites in her district.

    “I called everybody,” Dingell said. “Nobody had really been given a heads up that they were coming here.”

    Across the country, Texas Chief Executive Lina Hidalgo expressed frustration that she first learned about the expected water shipments to her state from the news media – not from a government agency or Texas Molecular, the company hired to dispose of the water.

    She added that although there’s no legal requirement for her office to be notified, “it doesn’t quite seem right.”

    Hidalgo said Texas Molecular told her office Thursday that half a million gallons of the water was already in the county and the shipments began arriving around last Wednesday.

    On Thursday, Texas Molecular told CNN it had been hired to dispose of potentially dangerous water from the Ohio train derailment. The company said they had experts with more than four decades of experience in managing water safely and that all shipments, so far, had come by truck for the entire trip.

    Hidalgo’s office had been seeking information about the disposal, including the chemical composition of the firefighting water, the precautions that were being taken, and why Harris County was the chosen site, she said.

    According to a Thursday news release from Ohio Emergency Management Agency, more than 1.7 million gallons of contaminated liquid had been removed from the immediate site of the derailment. Of that, more than 1.1 million gallons of “contaminated liquid” from East Palestine had been transported off-site, with the majority going to Texas Molecular and the rest going to a facility in Vickery, Ohio.

    CNN asked the Ohio agency the location of the remaining 581,500 gallons which had been “removed” but not “hauled off-site” and has yet to receive a response.

    Regarding the causes of the accident, a National Transportation Safety Board preliminary report found that one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, said Jennifer Homendy, the chair of the safety board. So far, the investigation found the three crew members on board the train did not do anything wrong prior to the derailment, though the crash was “100% preventable,” she said.

    Arizona authorities targeting the Sinaloa drug cartel have seized narcotics estimated to be worth more than $13 million, including more than 4.5 million fentanyl pills, 3,100 pounds of methamphetamine and large quantities of heroin, cocaine and fentanyl powder, according to the Drug Enforcement Administration.

    In a news release, the agency said the seizure was the culmination of a three-year-long investigation during which 150 people had so far been charged.

    “The fentanyl seized represents more than 30 million potentially lethal doses,” the DEA said, announcing the seizure in partnership with the Tempe Police Department and Arizona Attorney General Kris Mayes.

    Authorities displayed some of the recovered narcotics at a joint news conference Thursday, attended by CNN affiliate KNXV.

    “The sample you see here today is staggering. There are over 4.5 million fentanyl pills, over 140 pounds of fentanyl powder, over 135 kilos of cocaine, over 3,000 pounds of methamphetamine, 35 kilos of heroin, 49 firearms and over $2 million in cash,” Interim Tempe Police Chief Josie Montenegro told reporters.

    Montenegro said the substances recovered “would be poisoning members of our community, including our youth and vulnerable population,” had the seizures not been made.

    “In addition, the dangers and crimes associated with illegal drugs would be plaguing our community,” Montenegro added.

    According to authorities, “numerous” people were taken into custody in the bust. At this time, authorities do not plan on releasing the names of those involved because it is a continuing investigation, according to Montenegro.

    Phoenix DEA Special Agent in Charge Cheri Oz said investigators are “laser-focused” on the Sinaloa cartel.

    “I want to be crystal clear, the drugs in this room and the drugs that are flooding Arizona every single day are sourced primarily by one evil as the Sinaloa drug cartel,” she said at the news conference. “We are laser-focused on the Sinaloa drug cartel and we will defeat them. We will not stop.”

    Oz also praised the efforts of DEA agents and other officers over the last three years. “Their hard work and tenacity is responsible for removing these deadly drugs before they poisoned our family, our friends and our neighborhoods,” she said.

    The country is struggling with a decades-long opioid epidemic in which fentanyl has become the most commonly used drug involved in overdoses.

    Pharmaceutical fentanyl is a synthetic opioid intended to help patients manage severe pain. It is 50 to 100 times more potent than morphine, and typically prescribed in the form of skin patches or lozenges. But most recent cases of fentanyl-related harm, overdose, and death in the United States are linked to illegally made fentanyl, according to the US Centers for Disease Control and Prevention.

    Deaths involving synthetic opioids increased by 22% in 2021, according to CDC data, and in 2022, there were about 181,806 nonfatal opioid overdoses recorded in the United States.
