  • Supreme Court justices sound skeptical of Trump’s tariffs

    The Supreme Court justices sounded skeptical Wednesday of President Trump’s claim that he has the power to set large tariffs on products coming from countries around the world.

    Most of the justices, both conservative and liberal, said Congress, not the president, had the power to impose taxes and tariffs. And they agreed Congress did not authorize tariffs in an emergency powers law adopted in 1977.

    It has “never before been used to justify tariffs, and no one had argued it before this case,” Chief Justice John G. Roberts Jr. told Trump’s top courtroom attorney. “The imposition of taxes on Americans … has always been a core power of Congress.”

    Solicitor Gen. D. John Sauer argued that tariffs involve the president’s power over foreign affairs. They are “regulatory tariffs, not taxes,” he said.

    Justices Sonia Sotomayor and Elena Kagan disagreed.

    Imposing a tariff “is a taxing power which is delegated by the Constitution to Congress,” Kagan said.

    Justice Neil M. Gorsuch said he too was skeptical of the claim the president had the power to impose taxes based on his belief that the nation faces a global emergency.

    If so, could a future president acting on his own impose a 50% tax on cars because of climate change? he asked.

    Gorsuch said the court has recently blocked far-reaching presidential regulations by Democratic presidents that went beyond an old and vague law, and the same may be called for here.

    Otherwise, presidents may feel free to take away the taxing power “from the people’s representatives,” he said.

    But Justices Brett M. Kavanaugh and Samuel A. Alito Jr. questioned the challenge to the president’s tariffs.

    Kavanaugh pointed to a round of tariffs imposed by President Nixon in 1971, and he said Congress later adopted its emergency powers act without clearly rejecting that authority.

    Justice Amy Coney Barrett said she was struggling to understand what Congress meant in the emergency powers law when it said the president may “regulate” importation.

    She agreed the law did not mention taxes and tariffs that would raise revenue, but some judges then saw it as allowing the authority to impose duties or tariffs.

    The tariffs case heard Wednesday is the first major challenge to Trump’s presidential power to be heard by the court. It is also a test of whether the court’s conservative majority is willing to set legal limits on Trump’s executive authority.

    Trump has touted these import taxes as crucial to reviving American manufacturing.

    But owners of small businesses, farmers and economists are among the critics who say the on-again, off-again import taxes are disrupting business and damaging the economy.

    Since Trump returned to the White House in January, the court’s six Republican appointees have voted repeatedly to set aside orders from judges who had temporarily blocked the president’s policies and initiatives.

    While they have not explained most of their temporary emergency rulings, the conservatives have said the president has broad executive authority over federal agencies and on matters of foreign affairs.

    Anti-abortion Conservatives’ First Target If Trump Returns

    The Supreme Court’s upcoming decision about the most common pharmaceutical used for medication abortions may be just the beginning of the political battle over the drug.

    Earlier this month, the Supreme Court agreed to hear an appeal of lower-court rulings that would severely reduce access to mifepristone. The Court’s acceptance of the case marked a crucial juncture in the legal maneuvering over the medication.

    But however the high court rules, pressure is mounting inside the GOP coalition for the next Republican president to broadly use executive authority at the Food and Drug Administration and the Justice Department to limit access to mifepristone and to reduce what abortion opponents call “chemical abortion.”

    “Chemical abortion will be front and center and presented front and center by the pro-life movement if there is a Republican president,” Kristan Hawkins, the president of Students for Life of America, told me. “There is going to be a lot of action we want to see taken.”

    The possibility of new executive-branch restrictions on abortion drugs, which are now used in a majority of all U.S. abortions, underscores the stakes over abortion in the 2024 presidential election. Even if Donald Trump or another Republican wins back the White House next year, they might not have enough votes in Congress to pass a nationwide ban on the practice. But through executive action, the next GOP president could unilaterally retrench access to mifepristone in every state, however the Supreme Court decides the current case. Multiple former FDA officials and advocates on both sides of the issue told me that through regulatory and legal actions by the FDA, the Justice Department, or both, the next Republican president could impose all the limits on access to mifepristone that anti-abortion groups are seeking in the lawsuit now before the high court.

    “The FDA is a highly regulated space, so there are a lot of hoops they would have to jump through,” Jeremy Sharp, the FDA’s deputy commissioner for policy planning, legislation, and analysis during part of Barack Obama’s second term, told me. “But if they got a commissioner in there that was ideologically motivated, and if they changed the staff leadership, then there’s a lot they could do before anybody could get in the way and stop them.”

    The growing Republican focus on using executive-branch authority against abortion access marks a new front in the broader political confrontation over reproductive rights. While Roe v. Wade was in place, the social conservative movement was focused overwhelmingly on trying to reverse the nationwide right to abortion and “wasn’t zoned in on this issue” of federal regulatory authority over abortion drugs, Hawkins noted.

    Medication abortion involves two drugs: mifepristone followed by misoprostol (which is also used to prevent stomach ulcers). From 2000 through 2022, almost 6 million women in the U.S. used mifepristone to end a pregnancy, according to the FDA. In all those cases of women using the drug, the agency has recorded only 32 deaths (including for reasons unrelated to the drug) and a little more than 1,000 hospitalizations. The risk of major complications has been less than half of 1 percent.

    Neither of the past two Republican presidents acted against the drugs administratively or even faced sustained pressure from social conservatives to do so. The FDA initially approved mifepristone for use in abortion during the final months of Bill Clinton’s presidency, in 2000. But during Republican President George W. Bush’s two terms, the FDA made no effort to rescind that approval.

    During Obama’s final year, the FDA significantly loosened the restrictions on usage of the drug. (Among other things, the agency reduced the number of physician visits required to obtain the drugs from three to one; increased from seven to 10 the number of weeks into a pregnancy the drugs could be used; and permitted other medical professionals besides physicians to prescribe the drugs if they received certification.) During Trump’s four years, the FDA did not move to undo any of those decisions.

    But the right’s focus on abortion drugs has significantly increased since Trump left office. According to Hawkins, one reason is that the COVID pandemic crystallized awareness of how many abortions are performed remotely with the drugs, rather than in medical settings. Even more important may have been the decision by the six GOP-appointed Supreme Court justices in 2022 to overturn Roe. By fulfilling the top goal of anti-abortion activists, that decision both freed them to concentrate on other issues and raised their ambitions.

    In one measure of that growing zeal, social conservative groups and Republican elected officials have pushed back much harder against Joe Biden’s attempts to expand access to mifepristone than they did against Obama’s moves. Under Biden, the FDA has eliminated the requirement for an in-person visit to obtain mifepristone; instead it allows patients to get a prescription for the drug through a telehealth visit and then receive it through the mail. The FDA under Biden has also allowed pharmacies that receive certification to dispense the drug.

    As I wrote earlier this year, the paradox is that Biden’s rules will be felt almost entirely in the states where abortion remains legal. Almost all red states have passed laws that still require medical professionals to be present when the drugs are administered, and, even though the FDA allows their use through 10 weeks of pregnancy, the drugs cannot be prescribed in violation of state time limits (or absolute bans) on abortion.

    Shortly after last November’s midterm election, an alliance of conservative groups sued in federal court to overturn not only Biden’s measures to ease access to the drug but also the changes approved in 2016 under Obama, and even the decision under Clinton in 2000 to approve the drug at all.

    In April 2023, Judge Matthew J. Kacsmaryk, a Trump appointee and abortion opponent, ruled almost entirely for the plaintiffs, striking down the Biden and Obama regulations and the FDA’s original approval of the drug. In August, a panel of three Republican-appointed judges on the Fifth Circuit Court of Appeals upheld Kacsmaryk’s ruling overturning the Obama and Biden regulatory changes. But the panel, by 2–1, ruled that it was too late to challenge the drug’s original approval.

    The Supreme Court along the way blocked the implementation of any of these rulings until it reached a final decision in the case, so mifepristone has remained available. In its announcement earlier this month, the Court agreed to hear appeals to the Fifth Circuit decision erasing the Obama and Biden administrations’ regulatory changes but declined to reconsider the circuit court’s upholding of mifepristone’s original approval. Those choices have raised hopes among abortion-rights activists that the Court appears inclined to reverse the lower court’s ruling and preserve the existing FDA rules. “We are very hopeful this is an indicator the Court is not inclined to rule broadly on medication abortion and they are concerned about the reasoning of the decisions [so far],” said Rabia Muqaddam, a senior staff attorney at the Center for Reproductive Rights, a group that supports legal abortion.

    But the legal process has shown that even a Supreme Court decision maintaining the current rules is unlikely to end the fight over mifepristone. The reason is that the proceedings have demonstrated much broader support in the GOP than previously for executive-branch action against the drug.

    For instance, 124 Republicans in the House of Representatives and 23 GOP senators have submitted a brief to the Supreme Court urging it to affirm the Fifth Circuit’s ruling overturning the Obama and Biden actions on mifepristone. “By approving and then deregulating chemical abortion drugs, the FDA failed to follow Congress’ statutorily prescribed drug approval process and subverted Congress’ critical public policy interests in upholding patient welfare,” the Republican legislators wrote. Republican attorneys general from 21 states submitted a brief with similar arguments in support of the decision reversing the Obama and Biden administrations’ regulatory actions.

    In another measure, a large majority of House Republicans voted last summer to reverse the FDA’s decisions under Biden that expanded access to the drugs. Though the legislation failed when about two dozen moderates voted against it, the predominant support in the GOP conference reflected the kind of political pressure the next Republican president could face to pursue the same goals through FDA regulatory action.

    Simultaneously, conservatives have signaled another line of attack they want the next GOP president to pursue against medication abortions. In late 2022, the Justice Department’s Office of Legal Counsel issued an opinion that the Postal Service could deliver the drugs without violating the 19th-century Comstock Act, which bars use of the mail “to corrupt the public morals.” That interpretation, the opinion argued, was in line with multiple decisions by federal courts spanning decades that the law barred the mailing of only materials used in illegal abortions.

    Conservatives are arguing that the next Republican administration should reverse that OLC ruling and declare that the Comstock Act bars the mailing of medications used in any abortions.

    The fact that both Kacsmaryk and Circuit Court Judge James Ho, also appointed by Trump, endorsed that view in their rulings on mifepristone this year offers one measure of the receptivity to this idea in conservative legal circles. As telling was a letter sent last spring by nine GOP senators to major drug-store chains warning that they could be held in violation of the Comstock Act not only if they ship abortion drugs to consumers but even if they use the mail or other freight carriers to deliver the drugs to their own stores.

    Trump and his leading rivals for the 2024 GOP nomination, Florida Governor Ron DeSantis and former South Carolina Governor Nikki Haley, have avoided explicit commitments to act against medication abortions. But all of these efforts are indications of the pressure they would face to do so if elected. Hawkins said that anti-abortion groups have chosen not to press the candidates for specific plans on regulatory steps against mifepristone but instead intend to closely monitor the views of potential appointments by the next GOP president, the same tactic signaled by the senators in their letter to drug-store chains. “It will make for probably the most contentious fight ever over who is nominated and confirmed” for the key positions at the FDA and other relevant agencies, Hawkins told me.

    Stephen Ostroff, who served as acting FDA commissioner under both Obama and Trump, told me that future Republican appointees would likely find more success in reconsidering the regulations governing access to mifepristone than in reopening the approval of the drug altogether this long after the original approval. Even reconsidering the access rules, he predicts, would likely ignite intense conflict between political appointees and career scientific staff.

    “I think it would be challenging for a commissioner to come in and push the scientific reviewers and other scientific staff to do things they don’t think are appropriate to do,” Ostroff told me. “You’d have to do a lot of housecleaning in order to be able to accomplish that.” But, he added, “I’m not saying it is impossible.”

    In fact, political appointees under presidents of both parties have at times overruled FDA decisions. Kathleen Sebelius, the Health and Human Services secretary for Obama, blocked an FDA ruling allowing the over-the-counter sale of emergency contraception to girls younger than 17; the Biden White House has delayed an FDA decision to ban the sale of menthol cigarettes, amid concerns about a possible backlash among Black voters.

    Many legal and regulatory experts closely following the issue believe that a Republican president’s first target would be the FDA’s decision to allow mifepristone to be prescribed remotely and shipped by mail or dispensed in pharmacies. To build support for action against mifepristone, a new FDA commissioner also might compel drug companies to launch new studies about the drug’s safety or require the agency’s staff to reexamine the evidence despite the minimal number of adverse consequences over the years, Sharp told me.

    Faced with continuing signs of voter backlash on efforts to restrict abortion, any Republican president might think twice before moving aggressively against mifepristone. And any future attempt to limit the drug—through either FDA regulations or a revised Justice Department opinion about the Comstock Act—would face an uncertain outcome at the Supreme Court, however the Court decides the current case. The one certainty for the next GOP president is that the pressure from social conservatives for new regulatory and legal action against mifepristone will be vastly greater than it was the most recent two times Republicans controlled the executive branch. “We want all the tools in the tool kit being used to protect mothers and children from these drugs,” Hawkins told me. Amid such demands, the gulf between the FDA’s future decisions about the drug under a Republican or Democratic president may become much wider than it has been since mifepristone first became available, more than two decades ago.

    Biden Lets Venezuelan Migrants Work

    President Joe Biden’s administration moved boldly yesterday to solve his most immediate immigration problem at the risk of creating a new target for Republicans who accuse him of surrendering control of the border.

    Yesterday, the Department of Homeland Security extended legal protections under a federal program called Temporary Protected Status (TPS) that will allow as many as 472,000 migrants from Venezuela to live and work legally in the United States for at least the next 18 months.

    With that decision, the administration aligned with the consensus among almost all the key players in the Democratic coalition about the most important thing Biden could do to help big Democratic-leaning cities facing an unprecedented flow of undocumented migrants, many of whom are from Venezuela.

    In a series of public statements over the past few months, Democratic mayors in New York, Chicago, Los Angeles, Philadelphia, and other major cities; Democrats in the House and Senate; organized labor leaders; and immigrant advocacy and civil-rights groups all urged Biden to take the step that the administration announced yesterday.

    Extending TPS protections to more migrants from Venezuela “is the strongest tool in the toolbox for the administration, and the most effective way of meeting the needs of both recently arrived immigrants and the concerns of state and local officials,” Angela Kelley, a former senior adviser to Homeland Security Secretary Alejandro Mayorkas, told me immediately after the decision was announced.

    Despite the panoramic pressure from across the Democratic coalition, the administration had been hesitant to pursue this approach. Inside the administration, as Greg Sargent of The Washington Post first reported, some feared that providing legal protection to more Venezuelans already here would simply encourage others from the country to come. With polls showing widespread disapproval of Biden’s handling of border security, and Republicans rallying behind an array of hard-line immigration policies, the president has also appeared deeply uncomfortable focusing any attention on these issues.

    But immigrant advocates watching the internal debate believe that the argument tipped because of changing conditions on the ground. The tide of migrants into Democratic-run cities has produced wrenching scenes of new arrivals sleeping in streets, homeless shelters, or police stations, and loud complaints about the impact on local budgets, especially from New York City Mayor Eric Adams. And that has created a situation where not acting to relieve the strain on these cities has become an even a greater political risk to Biden than acting.

    “No matter what, Republicans will accuse the administration of being for open borders,” Maria Cardona, a Democratic strategist working with immigrant-advocacy groups, told me. “That is going to happen anyway. So why not get the political benefit of a good policy that so many of our leaders are clamoring for and need for their cities?”

    Still, it was revealing that the administration paired the announcement about protecting more Venezuelan migrants through TPS with a variety of new proposals to toughen enforcement against undocumented migrants. That reflects the administration’s sensitivity to the relentless Republican accusation—which polls show has resonated with many voters—that Biden has lost control of the southern border.

    As Biden’s administration tries to set immigration policy, it has been forced to pick through a minefield of demands from its allies, attacks from Republicans, and lawsuits from all sides.

    Compounding all of these domestic challenges is a mass migration of millions of people fleeing crime, poverty, and political and social disorder in troubled countries throughout the Americas. In Venezuela alone, political and social chaos has driven more than 7 million residents to seek new homes elsewhere in the Americas, according to a United Nations estimate. “Venezuela is a displacement crisis approximately the size of Syria and Ukraine, but it gets, like, one one-thousandth of the attention,” Todd Schulte, the president and executive director of FWD.us, an immigration-advocacy group, told me. “It’s a huge situation.”

    Most of these displaced people from nations across Central and South America have sought to settle in neighboring countries, but enough have come to the U.S. to overwhelm the nation’s already strained asylum system. The system is so backlogged that experts say it typically takes four to six years for asylum seekers to have their cases adjudicated. If the time required to resolve an asylum case “slips into years, it does become a magnet,” encouraging migrants to come to the border because the law allows them to stay and work in the U.S. while their claims are adjudicated, says Muzaffar Chishti, a senior fellow at the Migration Policy Institute, a center-left think tank.

    Former President Donald Trump dealt with this pressure by severely restricting access to asylum. He adopted policies that required asylum seekers to remain in Mexico while their cases were decided; that barred anyone from claiming asylum if they did not first seek it from countries between their homeland and the U.S. border; and, in the case of the pandemic-era Title 42 rule, that turned away virtually all undocumented migrants as threats to public health.

    Fitfully, Biden has undone most of Trump’s approach. (The Migration Policy Institute calculates that the Biden administration has taken 109 separate administrative actions to reverse Trump policies.) And Biden and Mayorkas, with little fanfare, have implemented a robust suite of policies to expand routes for legal immigration, while announcing stiff penalties for those who try to enter the country illegally. “Our overall approach is to build lawful pathways for people to come to the United States, and to impose tougher consequences on those who choose not to use those pathways,” Mayorkas said when he announced the end of Trump’s Title 42 policy.

    Immigration advocates generally express confidence that over time this carrot-and-stick approach will stabilize the southern border, at least somewhat. But it hasn’t yet stanched the flow of new arrivals claiming asylum. Some of those asylum seekers have made their way on their own to cities beyond the border. At least 20,000 more have been bused to such places by Texas Governor Greg Abbott, hoping to produce exactly the sort of tensions in Democratic circles that have erupted in recent weeks.

    However they have arrived, this surge of asylum seekers has created enormous logistical and fiscal challenges in several of these cities. Adams has been the most insistent in demanding more help from the federal government. But he’s far from the only Democratic mayor who has been frustrated by the growing numbers and impatient for the Biden administration to provide more help.

    The top demand from mayors and other Democratic interests has been for Biden to use executive authority to allow more of the new arrivals to work. “There is one solution to this problem: It’s not green cards; it’s not citizenship. It’s work permits,” Philadelphia Mayor Jim Kenney told me earlier this week. “All these people need work. They wouldn’t be in [a] hotel, they wouldn’t be lying on streets, if they can go to work.”

    That answer seems especially obvious, Kenney continued, because “we have so many industries and so many areas of our commerce that need workers: hotels, restaurants. Let them go to work. [Then] they will get their own apartments, they will take care of their own kids.”

    The obstacle to this solution is that under federal law, asylum seekers cannot apply for authorization to work until 150 days after they filed their asylum claim, and the government cannot approve their request for at least another 30 days. In practice, it usually takes several months longer than that to receive approval. The Biden administration is working with cities to encourage asylum seekers to quickly file work applications, but the process cannot be streamlined much, immigration experts say. Work authorization through the asylum process “is just not designed to get people a work permit,” Todd Schulte said. “They are technically eligible, but the process is way too hard.”

    The inability to generate work permits for large numbers of people through the asylum process has spurred Democratic interest in using the Temporary Protected Status program as an alternative. It allows the federal government to authorize immigrants from countries facing natural disasters, civil war, or other kinds of political and social disorder to legally remain and work in the U.S. for up to 18 months at a time, and to renew those protections indefinitely. That status isn’t provided to everyone who has arrived from a particular country; it’s available only to people living in the U.S. as of the date the federal government grants the TPS designation. For instance, the TPS protection to legally stay in the U.S. is available to people from El Salvador only if they were here by February 2001, after two major earthquakes there.

    The program was not nearly as controversial as other elements of immigration law, at least until Trump took office. As part of his overall offensive against immigration, Trump sought to rescind TPS status for six countries, including Haiti, Honduras, and El Salvador. But Trump was mostly blocked by lawsuits and Biden has reversed all those decisions. Biden has also granted TPS status to migrants from several additional countries, including about 200,000 people who had arrived in the U.S. from Venezuela as of March 2021.

    The demand from Democrats has been that Biden extend that protection, in a move called “redesignation,” to migrants who have arrived from Venezuela since then. Many Democrats have urged him to also update the protections for people from Nicaragua and other countries: A coalition of big-city mayors wrote Biden this summer asking him to extend existing TPS protections or create new ones for 11 countries.

    Following all of Biden’s actions, more immigrants than ever are covered under TPS. But the administration never appeared likely to agree to anything as sweeping as the mayors requested. Yesterday, the administration agreed to extend TPS status only to migrants from Venezuela who had arrived in the U.S. as of July 31. It did not expand TPS protections for any other countries. Angela Kelley, now the chief policy adviser for the American Immigration Lawyers Association, said that providing more TPS coverage to any country beyond Venezuela would be “a bigger piece to chew than the administration is able to swallow now.”

    But advocates considered the decision to cover more Venezuelans under TPS the most important action the administration could take to stabilize the situation in New York and other cities. The reason is that so many of the latest arrivals come from there; one recent survey found that two-thirds of the migrants in New York City shelters arrived from that country. Even including this huge migrant population in TPS won’t allow them to instantly work. The administration will also need to streamline regulations that slow work authorization, experts say. But eventually, Kelley says, allowing more Venezuelans to legally work through TPS would “alleviate a lot of the pressure in New York” and other cities.

    Kerri Talbot, the executive director of the Immigration Hub, an advocacy group, points out the TPS program is actually a better fit for Venezuelans, because the regular asylum process requires applicants to demonstrate that they fear persecution because of their race, religion, or political opinion, which is not the fundamental problem in Venezuela. “Most of them do not have good cases for asylum,” she said of the new arrivals from Venezuela. “They need TPS, because that’s what TPS is designed for: Their country is not functional.”

    Biden’s authority to expand TPS to more Venezuelans is likely to stand up in court against the nearly inevitable legal challenges from Republicans. But extending legal protection to hundreds of thousands of Venezuelans still presents a tempting political target for the GOP. Conservatives such as Elizabeth Jacobs, the director of regulatory affairs and policy at the Center for Immigration Studies, have argued that providing work authorizations for more undocumented migrants would only exacerbate the long-term problem by encouraging more to follow them, in the hope of obtaining such permission as well.

    Immigration advocates note that multiple academic studies show that TPS protections have not in fact inspired a surge of further migrants from the affected countries. Some in the administration remain uncertain about this, but any worries about possibly creating more long-term problems at the border were clearly outweighed by more immediate challenges in New York and other cities.

    If Biden did nothing, he faced the prospect of escalating criticism from Adams and maybe other Democratic mayors and governors that would likely make its way next year into Republican ads denouncing the president’s record on immigration. That risk, many of those watching the debate believe, helped persuade the administration to accept the demands from so many of Biden’s allies to extend TPS to more undocumented migrants, at least from Venezuela. But that doesn’t mean he’ll be happy about this or any of the other difficult choices he faces at the border.
