    Police in Massachusetts are calling on the public’s help in locating a suspect who allegedly struck a state trooper while fleeing Encore Boston Harbor.

    Located across the Mystic River from Boston in Everett, Massachusetts State Police responded to an incident at the resort operated by Wynn Resorts early Friday morning after a report came in that a person was carrying a weapon on the casino floor. Upon being approached by casino security, the individual allegedly fled, prompting state troopers stationed at the casino to give chase.

    The suspect was reportedly able to get to his vehicle, where he drove off at a high rate of speed. As he exited the casino’s premises, police say he struck a state trooper with his vehicle’s side-view mirror.

    The troopers involved in the Friday incident are assigned to the state’s Gaming Enforcement Unit. The GEU, a division of the Massachusetts State Police, works with the Massachusetts Gaming Commission’s Investigations and Enforcement Bureau to investigate all possible criminal activity occurring at Encore Boston Harbor, MGM Springfield, and Plainridge Park Casino.

    The Massachusetts State Police have not yet commented on the Encore Boston Harbor incident. Boston 25, which broke the story, reported that state officials said only that the suspected carrying of a weapon is what led to casino security approaching the person who fled.

    As of this time, there is no word on what sort of weapon was allegedly involved, most critically, whether it was a firearm. Massachusetts does have a concealed carry law, though out-of-state licenses do not apply. The commonwealth is considered among the nation’s most restrictive states when it comes to firearms possession.

    Massachusetts law prohibits any person from possessing a firearm within or upon the premises of a gaming establishment.

    If the gaming licensee learns that an individual possesses a firearm … the gaming licensee must immediately notify an official within the on-site office of the IEB, and the individual violating the policy shall be removed from the premises of the gaming establishment by officers assigned to the Gaming Enforcement Unit,” Massachusetts’ Internal Control for Gaming reads. “Thereafter, the gaming licensee shall promptly, and in any event no later than 48 hours of such removal, or violation of the policy, notify the Chief of the Gaming Enforcement Division of the Massachusetts Attorney General’s Office.”

    Exceptions to the regulation include on-duty Massachusetts State Police troopers, local law enforcement officers assigned to the casino, IEB officials, and federal law enforcement officials.

    Crime Impact

    Crime studies commissioned by the Massachusetts Gaming Commission have concluded that Encore Boston Harbor has had a negligible to “limited impact on crime in the region.” The $2.6 billion integrated resort opened in June 2019.

    Crime rates in Everett today are in line with the rates the city experienced in 2019. However, there has been a slight increase in certain public safety issues, including intoxicated driving.

  • Olympic Pipeline Resumes Operation After Leak Discovery – KXL

    EVERETT, WA – The Olympic Pipeline has partially restarted and has reportedly resumed moving fuel from Washington refineries to Portland. It was shut down due to a leak near Everett.

    There are two pipelines and the smaller, 16-inch, line was tested and not leaking. A leak was found in the larger 20-inch line, and authorities said a plan was being developed to repair the leak.

    The leak was first discovered on the outskirts of Everett earlier this month, after someone reported seeing an oil slick in a drainage ditch.

    Officials still have not said how much fuel spilled, but they do say there have no negative impacts to wildlife reported, so far.

  • Olympic Pipeline: Crews working nonstop to repair Everett, WA leak

    Crews are working around the clock to repair a leak in the Olympic Pipeline that has stopped jet fuel delivery to Seattle-Tacoma International Airport. Right now, there is no timeline for the fix, and Governor Bob Ferguson issued an emergency declaration.

    SEA Airport possible impacts

    Gov. Ferguson’s office has said if things aren’t fixed by Saturday, the airport could be significantly impacted. BP, which operates the pipeline, told FOX 13 that crews are doing 24-hour excavation operations and are working closely with federal, state, tribal and local authorities. The pipeline leak is just east of Everett.

    “We have come a long way since the 90s, and I think you know, when you look at the recent failures of the Olympic Pipeline, they could have been a lot worse then, and they weren’t,” said Bill Caram, executive director of the Pipeline Safety Trust.

    The Pipeline Safety Trust is a watchdog organization that formed after the Olympic Pipeline explosion in Bellingham in June of 1999. That explosion killed three boys. When Caram heard about the recent leak, he was instantly reminded of what happened 26 years ago.

    “After the ’99 spill, a lot of work went into this pipeline to make sure that something like that would never happen again,” Caram said. He adds, there have been significant improvements in safety since then, but more still needs to be done.

    “We still have a significant pipeline failure somewhere in America almost every day,” Caram said. “Despite all of that, we still are losing, you know, 10 to 12 lives each year somewhere across the country due to pipeline failure.”

    The Department of Ecology shared these photos; one showed a boom placed in the ditch to soak up the fuel. The 400-mile pipeline transports gasoline, diesel and jet fuel to places like SEA Airport. As of Friday, the airport says, there were no impacts to flights.

    FOX 13 reached out to Delta Air Lines. In a statement, the company said it is closely “monitoring the fuel supply, and there are no operational impacts at this time.” Alaska Airlines also said it is working to mitigate potential impacts from the Olympic Pipeline fuel leak, and is also not currently experiencing any impacts. At Pipeline Safety Trust, its concern is elsewhere.

    “We’re much more concerned about, you know, if this were to contaminate water sources,” Caram said. Right now, the Department of Ecology says there is currently no concern about the leak reaching the Snohomish River.

    Between 2005 and 2023, there was only one significant problem on this pipeline, but since then, there have been four. 

    “To me, it’s just a hint that maybe some, you know, mismanagement or under maintenance, is starting to catch up with this pipeline, and I hope that’s not true, but it does give me pause,” Caram said.

    The cause and source of the spill is still under investigation. Officials are still working to determine how big the leak really is. They also say there is no ETA as to when it will all be cleaned up, and when the pipeline will reopen.

  • Olympic Pipeline shutdown: Jet fuel leak in Everett, WA could impact SEA Airport

    Work is underway to repair a pipeline that delivers jet fuel to Seattle-Tacoma International Airport after a leak prompted it to be shut down.

    Timeline:

    The Olympic Pipeline fuel leak was reported on Nov. 11 in an agricultural field several miles east of Everett. Now, over a week later, a 24-hour effort is underway to excavate, contain, clean and repair the leak. There is no timeline for when the pipeline will resume delivering fuel.

    Washington Governor Bob Feruguson issued an emergency declaration to ensure adequate fuel is delivered to Sea-Tac Airport during the pipeline shutdown. The governor’s office said airport operations would be “significantly affected” if it doesn’t start back up by Saturday.

    No flights at SEA Airport have been affected yet. However, in anticipation, Gov. Ferguson waived the number of hours jet fuel tanker operators can drive while ensuring safe-driving measures remain in place.

    The pipeline temporarily restarted on Sunday, Nov. 16, after a successful leak test. Fuel deliveries resumed to the airport, but the pipeline was shut down again on Monday due to additional leakage at the response site.

    The Olympic Pipeline transports refined petroleum products to sites in Seattle, SeaTac, Tacoma, Vancouver, and Portland. The system consists of two pipelines, including a 20-inch pipeline and a 16-inch pipeline. The 16-inch pipeline is the one that leaked.

    What they’re saying:

    The Washington State Department of Ecology issued the following statement regarding the fuel leak response:

    “Our cleanup includes using a vacuum truck and adsorbent materials, along with cleaning up contaminated soil. Responders are still determining the amount spilled.”

    Alaska Airlines also released a statement regarding possible impacts at Sea-Tac International Airport:

    “We are working to mitigate a potential impact from the Olympic Pipeline fuel leak. We are not currently experiencing any disruption to our operation at Seattle-Tacoma International Airport.

    “To ensure our scheduled service is maintained without significant disruption, we are preparing contingency plans, which include fuel management strategies such as tankering in fuel on inbound flights to Seattle, assessing tech stop options along certain routes to conserve fuel, and maintaining and expanding our trucking operation to bring in additional fuel supply.

    “We remain in close communication with Olympic Pipeline, refineries, and our airport partners and will communicate if we begin to see operational impacts.”

    SEA Airport says multiple airlines have been working on contingency plans if the pipeline shutdown persists.

  • 17-year-old arrested after group smashes into The Kushery cannabis shop in Everett, WA

    A teen has been arrested after he was accused of being part of a group involved in a smash-and-grab burglary at a cannabis shop in Everett.

    The crime was caught on security video at a neighboring business. The group led law enforcement on a chase following the break-in.

    The backstory:

    Security video shows the moment thieves smashed into The Kushery cannabis shop. 

    Early Sunday, two cars appeared in the video first. The driver in one of the vehicles first pushed a cement bollard out of the way, then rammed the storefront, triggering an alarm. 

    At one point, the group appeared to jump out of the getaway car and tried to run into the store, but there was one more secure barrier that the car had not punched through inside the store. The driver had to reset, ramming the entrance again, before the group could run into the store. 

    Law enforcement was on the scene, just as video showed the group jumping back into a getaway car and speeding away as they gave chase. 

    What they’re saying:

    Regular customer Tina Littlefield says it was disappointing to hear about the theft. 

    “I really support local businesses, this is a local business, so I hate to see anything bad happen,” Littlefield said.

    Mill Creek Police and the Snohomish County Sheriff’s Office say officers and deputies pursued the group in what they now believe was a stolen Kia Optima.  

    The pursuit ran from the cannabis shop south to the Maltby area where law enforcement used spike strips to damage the car’s tires near 180th and SR 9. The driver eventually crashed into a ditch.

    “I don’t know what possesses people to even think about doing stuff like that. It’s not something I would have ever done, even at 17,” said Littlefield.

    Law enforcement said six people dressed in masks, gloves and hooded jackets ran from the car.  

    “My only comment was, ‘I hope they caught them and prevent them from committing further crime,’” said Littlefield. 

    A King County Sheriff’s Office K-9 unit helped to track the group east to a large property where the 17-year-old was located and taken into custody.  

    “I hope that people just think things through a little more, like I said, with local businesses it’s hard enough to keep going,” said Littlefield.

  • Suspects sought in Everett Halloween hit-and-run

    Snohomish County deputies are asking for the public’s help to identify the masked driver responsible for hitting a man on Halloween, and then driving away.

    The backstory:

    The crash happened Halloween night on 58th Avenue Southeast in Everett, in a neighborhood near Larimers Corner.

    Surveillance photos captured the suspect’s truck, which allegedly hit and ran over a 47-year-old man before fleeing the scene.

    Another victim reportedly held onto the truck bed and was dragged down the road, suffering minor injuries.

    The Snohomish County Sheriff’s Office says the same car and people inside were later captured wearing masks and stealing bowls of candy left out on porches.

    Deputies believe the car is a dark red Ford F-150, possibly a 2015 model or newer.

  • Everett mayoral race: Cassie Franklin leads Scott Murphy

    Incumbent Cassie Franklin is currently leading the Everett mayoral race over challenger Scott Murphy, though many votes have yet to be counted.

    As of 8 p.m. Tuesday, Franklin has received 52.45% (6,970) of the vote, with Murphy trailing with 47.1% (6,259).

    Franklin is running for another term after having served eight years as Everett’s mayor. Her top priority is public safety, highlighting accomplishments like a reduction in crime, hiring more police officers, and expanding youth safety initiatives.

    Franklin is also dedicating resources towards reducing homelessness in the city, saying there’s been a drastic expansion of shelter beds and increase in available resources since she’s taken office.

    The incumbent leads in the general election after losing in the primary by less than 100 votes, with Murphy coming away with 35.3% of the vote to Franklin’s 34.9%.

    Ballots will continue to be tallied until election results in Snohomish County are certified on Nov. 25.

  • Election night in Mass.: Voters choose new leaders in city races

    Tuesday was a busy election night across Massachusetts.

    While there were no statewide races on the ballot, city’s and towns made decisions about leadership.

    In Everett, voters ousted a long-term incumbent in Mayor Carlo DeMaria, who has been in office since 2008, electing City Councilor Robert Van Campen.

    “Tonight, in a resounding voice — you see these numbers? — They affirm they’re ready for change, they’re ready to write a new chapter,” the mayor-elect said.

    The race for mayor in Boston may be a foregone conclusion, but there are big races for City Council being settled on Tuesday.

    In an interview last week, Van Campen cited an audit finding DeMaria received $180,000 more than he should have in longevity payments as a catalyst for his campaign.

    Asked to explain what type of change he intended to bring, Van Campen said, “Bringing greater transparency and accountability at City Hall. I want to look at school overcrowding.”

    In Boston, Mayor Michelle Wu, running unopposed since Josh Kraft dropped out after placing a distant second in September’s preliminary race, spoke Tuesday night about her upcoming second term.

    “When we say Boston doesn’t back down, what we mean is Boston always shows up,” she said.

    While the results were still being counted Tuesday night, incumbents had leads in city council races, including in the citywide at-large race.

    District 7 was an open race after former City Councilor Tania Fernandes Anderson resigned following her guilty plea to federal fraud charges. Miniard Culpepper declared victory Tuesday over Said Ahmed.

    “I think this district is a heartbeat of the city, and how this district goes, I think, will determine how this city goes,” Culpepper told NBC10 Boston.

    Fernandes Anderson resigned in July, and councilors had asked state lawmakers to allow for an early swear-in of the November election’s winner. That bill is still stalled on Beacon Hill.

    “I may not have the council office, I might not have the council staff, but running the campaign, I didn’t have that, and I still met with folks,” said Culpepper.

    Two sitting at-large councilors — Ruthzee Louijeune and Henry Santana — joined Wu on stage. Along with Erin Murphy and Julia Mejia, the incumbents occupy the top four spots with the votes still being counted.

    “I love this city, and I’m ready to give it all, continue to give it my all,” Santana said.

    All these election totals are preliminary, final results will be tallied and certified by city and state election officials.

    Elsewhere in Massachusetts, Lawrence Mayor Brian DePeña was reelected to a second term. And Somerville voters elected Jake Wilson over Willie Burnley Jr. after both placed ahead of Mayor Katjana Ballantyne, knocking her out in September’s primary.

  • Workers killed in Everett crane collapse mourned by friends, as mayor speculates on cause

    The mayor in Everett, Massachusetts, is sharing more about the tragic crane collapse that left two people dead on Friday afternoon.

    Mayor Carlo DeMaria tells NBC10 Boston that Larriston Lake is one of the two workers who was killed when a crane collapsed on him at the former Exxon Mobile Corporation terminal on the Mystic River.

    “Now, seeing the photos of them and seeing them that day as well is not sitting really good with me,” DeMaria said.

    Lake’s friends are mourning his death, as well.

    Roy White says he’s beyond devastated after losing a friend that he saw as a big brother.

    “He was just the type of guy that if you were going through something hard, he could give you advice. He was a leader, he never complained, he was never negative. He was just positive, loving and he would do anything for his family,” White said.

    Lake was a father of four. White says he spoke with his wife after the deadly construction accident.

    “His wife had called me last night, just crying and bawling about how the last time he heard him he was giving his daughter a kiss before he went to work and she was just crying about how she didn’t get to hear him one more time on her lunch break,” White said. “It’s horrible.“

    A crane toppled over into the water Friday, killing two people.

    DeMaria says the Occupational Safety and Health Administration isn’t on site investigating because of the ongoing government shutdown. But at this point, he says it seems a cable snapped.

    “That’s what we’re being told,” the mayor said. “I’m hearing also that the crane might’ve been possibly in the water for a long time, for a while. Anything in water for a long time, especially salt water, could affect the cable and corroding the cable.”

    Both men, one in his 20s and the other in his 40s, died doing the jobs that provided for their families.

    “For him to be missing and lost and taken out of this world for such an accident, just a random accident, is horrible,” White said.

    The Coast Guard is leading the investigation, which continues.

  • Mental health eval ordered for suspected WA USPS shooter

    A postal worker shot in the face in Everett is now at risk of losing his eye. Blake Kuhlman, the suspect accused of pulling the trigger, is an Amazon delivery driver. 

    Kuhlman is charged with first-degree assault. He and his defense attorney were present for a hearing on Friday at Snohomish County Superior Court. They were scheduled for an arraignment on the charge, but his attorney requested a pause.

    “Before we proceed any further, I did have some concerns about Mr. Kuhlman’s mental health,” Kuhlman’s attorney told the court. “After reviewing the probable cause statement and discussing the situation with Mr. Kuhlman, I felt it was necessary to let the court know and ask to enter a 10.77 evaluation prior to proceeding with the arraignment.”

    “I find it proper to have Mr. Kuhlman evaluated for competency to stand trial before proceeding with arraignment,” said Judge Anna Alexander.

    Amazon delivery driver shoots U.S. postal worker

    The backstory:

    On October 3, Kuhlman was delivering packages for Amazon at an apartment complex in Everett. Court documents said underneath his uniform, Kuhlman was wearing a ballistic plate-carrier vest. He was also armed with a large knife and two handguns.

    The documents said Kuhlman was in the apartment building’s mail room while Anthony Santoro was delivering mail for the United States Postal Service (USPS). Officials with Everett Police Department said the two men got into an argument, then Kuhlman allegedly pulled out a gun and shot Santoro in the face.

    Santoro was rushed to Harborview Medical Center for surgery. His loved ones started an online fundraiser to help with medical and recovery expenses. The fundraiser said Santoro is at risk of losing his eye, and there is “no guarantee” he will regain his vision.

    While Santoro continues recovering, detectives are investigating a motive in the shooting.

    Dig deeper:

    Court records said Kuhlman allegedly “admitted” to detectives that he shot Santoro, but claimed he acted in self-defense. Kuhlman claimed Santoro cornered him, lunged at him, and tried to tackle him.

    According to the documents, the shooting suspect allegedly told detectives that, “he was being cyberstalked by the mafia and projected suspicions that this USPS worker may have been a mafia assassin.”

    The records stated Kuhlman further claimed he submitted more than 100 tips to the FBI over his concerns about his phone being hacked and stalking. Documents also said Kuhlman was wearing the ballistic plate-carrier vest because he claimed he was previously shot at while on the job, but said he never reported it to police due to lack of evidence.

    Kuhlman was booked into the Snohomish County Jail. His bail was set at $1 million. 

    His next court hearing is scheduled for October 24, after the mental health evaluation. A judge will review the evaluation results before moving forward with the case.

    Police arrested a delivery driver accused of shooting a U.S. postal worker in the face in Everett on Friday.

    Officers were called to reports of a shooting around 12:50 p.m. at the West Mall Place Apartments, located on W Mall Dr just north of Hwy 99.

    They found the victim, a USPS postal worker, suffering from a gunshot wound.

    Postal Inspector John Wiegand confirmed the incident happened as the carrier was delivering mail at the complex.

    “At that time, he was confronted by another individual, and then a small altercation took place where the carrier was unfortunately shot in the face,” Wiegand said. “At this time, he is alive. He’s down at Harborview, making the next steps medically.”

    He says the motive behind the confrontation is still under investigation.

    It appears there may have been some kind of verbal altercation,” Wiegand said. 

    Local perspective:

    However, he says there’s no doubt this is a devastating incident for the postal and local communities.

    “A lot of postal carriers are well known to the people that they deliver to, they’re out here everyday doing a service to the community.,” Wiegand said. “I don’t know this specific mail carrier, but, absolutely they’ve been around for a long time, they’re well known, well liked so this is devastating to the community, the community at large, everyone.. Mail carriers are just out here trying to do their jobs and get that package to the next person so, this is a pretty big one for the postal service itself.”

    Neighbors say the victim has been their regular mail carrier for several years.

    “He’s a cool dude. Hard-working, down to earth, funny, just a regular guy. Somebody you say hello to, and he loved his old school cars. He’s like a friend to me,” Jelani Jones, a nearby resident, said.

    He says violence is rare in this community.

    “The police station is literally 10 steps away from where this happened,” Jones said. “It’s not like we’re in a bad part of town. You have your casual homeless people walking through, but other than that, there’s not too much violence or anything like this going on.”

    Police are still investigating the incident; this story will be updated as information becomes available.

  • FAA restores Boeing’s ability to certify Max jets more than 6 years after deadly crashes

    Boeing is getting back the ability to perform final safety inspections on 737 Max jetliners and certify them for flight more than six years after crashes of the then-new model killed 346 people, the Federal Aviation Administration said Friday.

    The FAA said it decided to restore the aerospace company’s authorization to issue airworthiness certificates for Max and 787 Dreamliner passenger planes starting Monday following “a thorough review of Boeing’s ongoing production quality.”

    Federal regulators took full control over 737 Max approvals in 2019, after the second of two crashes that were later blamed on a new software system Boeing developed for the aircraft. The FAA ended the company’s right to self-certify Dreamliners in 2022, citing ongoing production quality issues.

    Going forward, Boeing and FAA inspectors will take weekly turns performing the safety checks that are required before aircraft are cleared for delivery and declared safe to fly. The FAA said the arrangement will free up more of its inspectors to conduct “rigorous” quality checks on the production line at Boeing plants.

    The Associated Press sent emailed requests Friday to Boeing for comment.

    The company’s stock price was up about 4% in afternoon trading, as the FAA announcement coincided with news about Boeing securing two more orders from foreign airlines.

    Turkey’s flag carrier, Turkish Airlines, said Friday that it planned to buy 75 Dreamliners and wants to eventually buy up to 150 more 737 Max jets. Boeing said the Max purchase would be the largest single order for its best-selling aircraft, if the deal is finalized.

    Norwegian Group, the aviation company that operates Norwegian Air Shuttle and regional airline Widerøe, also placed an order for 30 Boeing 737 Max 8 planes, Boeing said Friday.

    Since President Donald Trump’s return to the White House this year, his administration has made Boeing a focus of its plans to revive U.S. manufacturing. A number of international airlines have signed sales agreements with Boeing in recent months.

    Some Boeing critics have questioned how meaningfully the company has reformed its culture and processes to ensure the passenger planes it produces are safe.

    The FAA announced earlier this month that it was seeking $3.1 million in fines from Boeing over alleged safety violations between September 2023 and February 2024, including a blowout of a paneled-over exit door on a 737 Max during an Alaska Airlines flight.

    After the January 2024 Alaska Airlines incident, the FAA capped Boeing’s production of Max jets to 38 per month. In practice, the production rate fell well below that ceiling last year as the company contended with investigations and a machinists’ strike that idled factories for almost eight weeks.

    The company said in July that it reached the monthly cap in the second quarter and would eventually seek the FAA’s permission to increase production.

    The FAA said in a Friday statement that if Boeing requests an increase, “onsite FAA safety inspectors will conduct extensive planning and reviews with Boeing to determine if they can safely produce more airplanes.”

    The city of Everett has a two-mile sandy beach just a few feet from its coastline, and this weekend is your last chance to ferry there this summer.

    Jetty Island

    Jetty Island is a man-made island that got its start as a way to stabilize the shoreline, protect against erosion, and control water flow back in the 1800s.

    Now, the island is a destination for tens of thousands of visitors every year.

    “It’s beautiful, it’s pristine sandy beaches,” said Kate Anderson with the Port of Everett. “You just feel like you’re in a total different place than the city of Everett.”

    What to expect

    On the island, expect warmer waters, the chance to see wildlife or even kiteboarders. However, do not expect many amenities.

    There is no electricity or plumbing, and the only structure on the island is the seasonal floating restroom. Also, there are no trash cans, so visitors are asked to bring their own bags to collect their garbage.

    Jetty Island

    From July 5 to August 31, people can reserve round-trip ferry rides on Wednesdays through Sundays. 

    The ferry departs from Jetty Landing with its first voyage at 10 a.m. and its last boats leave the island at 5:45 p.m. on Wednesday, Thursday, and Sunday and 6:45 p.m. on Friday and Saturday.

    Rides are available by reservation only and cost $3 on Wednesday and Thursday, and $5 on Friday, Saturday, and Sunday.

    While the ferry has a limited operating schedule in the summer, the island is open year-round. You just have to find your own way to get there.

    Know before you go

    • Do not bring pets, alcohol or glass containers
    • Children under 12 must be accompanied by an adult
    • Build campfires ONLY in designated areas
    • No lifeguards — swim ONLY on the west shore at your own risk
    • No overnight camping
    • Jetty Island does have a specialty wheelchair on-site which functions well in the sandy environment.
    • The number of strollers, carts, and other wheeled items on the ferry is restricted due to safety concerns. Five will be allowed to and from the island and admittance will be on a first-come, first-served basis. Wheelchairs and other ADA mobility devices or aids are not restricted by this policy.

    Lawmaker says tougher child protection laws in Washington could help save kids like Ariel Garcia in the future

    A lawmaker says the death of 4-year-old Everett boy Ariel Garcia might have been prevented were it not for a change in legislation that makes it easier for parents with drug abuse issues to keep custody of a child.

    Representative Travis Couture, (R) District 35, says that legislation that was introduced this session would have put measures in place to better protect kids, but much of it did not pass.  

    On March 28, the search for Ariel Garcia ended in tragedy. His mother is now behind bars, accused of stabbing him around 16 times. Detectives say his grandmother had been trying to get custody of the 4-year-old, telling court officials in an audio recording that her daughter had been using drugs and alcohol. 

    Republican Rep. Travis Couture believes stronger child protection laws might have helped Ariel. 

    “We don’t want instances like what we saw with this case with little Ariel where, you know, he’s murdered, he’s dumped like garbage on the side of I-5, like his life didn’t matter,” said Couture, a representative from the 35th District. 

    Couture feels the problem started in 2021 when the legislature passed the Keeping Families Together Act or House Bill 1227, making it more difficult for DCYF to remove juveniles from a home if the parents are addicted to drugs. The goal was to keep families together and reduce racial injustice. The law now states that the child needs to be at risk of imminent physical harm before caseworkers get involved.

    Couture proposed a rebuttable presumption bill last session, that would have classified hard drug abuse as imminent harm while allowing parents to respond in court.  

    “What we would have been able to do is more easily remove kids from those dangerous situations,” he said. 

    Instead, he said lawmakers passed a “watered-down” bill and only addressed fentanyl. 

    “What that bill did is only for fentanyl and nothing else, no other drugs,” he said. 

    Couture says his bill might have also helped with an intervention in the case of Jordan Sorensen, a Port Townsend man who admitted that he hid his infant’s body in the bushes in January.  

    Couture says the death of children like Ariel could continue to rise without changes. 

     “The mother had been involved with CPS before, was known to use drugs, had something like my bill been in place, that death might have been prevented,” said Couture. 

    He plans to work on legislation before the next session to attempt to strengthen child protection laws and could pre-file in December.

    The mother of a boy who was found dead repeatedly lied to police and stabbed her son over 16 times, according to court documents.

    Janet Garcia, 27, is charged with first-degree and second-degree murder, as well as assault of a child.

    Police say Garcia used a sharp force object to kill her son, Ariel, and attempted to flee south.

    Court documents state that police were initially called to an apartment that Janet and Ariel had been staying at, where the homeowners noticed a large amount of blood on the floor.

    Police arrived at the apartment and cut out the carpeting, where they found the blood had seeped into the carpet padding and onto the subflooring, leading them to believe a serious injury had occurred.

    Police say Ariel’s grandmother won emergency custody over him just days prior to him going missing.

    In a text message conversation between Janet and another woman, Janet said Ariel fell, and he took him to the hospital.

    It was later revealed that Janet was in a group home in Ridgefield, where police later contacted her.

    Court documents state that Janet’s story was filled with inconsistencies, first saying that Ariel fell from his bed, but later said that he jumped and fell.

    Janet also told police that she tried checking Ariel into two hospitals, but later left him at a friend’s house, though she couldn’t remember the house, court docs say.

    Police said they noticed what appeared to be blood on Janet’s clothes, including spots on the back of her shirt and small droplet marks on her shoes.

    The FBI used Janet’s phone to track her movements, which led them to an area south of I-5 and north of 47th Avenue SW near Joint Base Lewis-McChord.

    After a short time, agents discovered Ariel’s body wrapped in a blanket in the area. Police said there were around 16 sharp-force wounds to the front of his body, as well as a cluster of wounds to his upper back.

    Janet Garcia will be in court Monday at 1 p.m.

    Everett police are asking the public’s help to be on the lookout for a 4-year-old boy who was last seen Wednesday morning. 

    Police said 4-year-old Ariel Garcia was last seen at about 7 a.m. in an apartment near 4800 Vesper Drive.

    Ariel is described as 3 foot 1 inch tall, weighs about 37 pounds and has brown hair and brown eyes. 

    According to investigators, Ariel’s disappearance may be “under suspicious circumstances after” after he left the location with a family member and may be in danger. According to the Washington State Patrol, his mother has been located but Ariel’s whereabouts are unknown at this time.

    Police are talking with his mother and family. 

    An Endangered Missing Person Alert has been issued by WSP. 

    Anyone who sees Ariel is asked to call 911.

    Washington State Patrol Trooper Kelsey Harding said crews are working to clear the crash scenes. 

    Officials with the Washington State Department of Transportation said the backups are about 6 miles long.

    Drivers are advised to take alternate routes.

    Memorial service for fallen Trooper Gadd scheduled for Tuesday

    The Washington State Patrol (WSP) announced the memorial service for fallen Trooper Christopher M. Gadd will be on Tuesday, March 12. 

    In a news release, WSP said the event will be at the Angel of the Winds Arena in Everett. 

    The service will be open to the public with a ceremonial procession preceding the memorial.

    WSP said it would release more details about the procession and service in the coming days.

    Gadd, 27, was struck and killed by a suspected DUI driver on I-5 in Marysville on Saturday.

    Probable cause documents said the man accused, Raul Benitez Santana, had bloodshot eyes and admitted to drinking and smoking weed before driving.

    U.S. Immigration and Customs Enforcement said Seattle Enforcement and Removal Operations placed an immigration detainer with the Snohomish County Jail for Benitez Santana, who is a citizen of Mexico.

    ICE issues immigration detainers against non-citizens who have been arrested for criminal activity and taken into custody by state or local law enforcement. It’s a request from ICE to state or local law enforcement agencies to notify ICE as early as possible before a removable non-citizen is released.

    Gadd had been with WSP for two and a half years, starting back on Sept. 16, 2021. 

    The Washington State Patrol Memorial Foundation was created for Gadd’s family and there are multiple ways to make donations.

    The foundation said 100% of the donations received will be given directly to the family.
