    A series of House Republican committees are plotting to launch investigations into the toxic train disaster in East Palestine, Ohio, multiple committee aides told CNN.

    GOP lawmakers are vowing to use their oversight power to dig into what they describe as the Biden administration’s flawed response to the train wreck, which has left East Palestine’s residents afraid to use the city’s air and municipal water after a train carrying toxic chemicals derailed on February 3.

    They have also left the door open to holding hearings on the subject, including potentially bringing in Environmental Protection Agency Administrator Michael Regan and Transportation Secretary Pete Buttigieg to testify publicly, the aides said, though such decisions have not yet been made.

    The GOP’s increased urgency for oversight comes as several lawmakers have criticized President Joe Biden for not visiting East Palestine. Biden told reporters on Friday he has no plans to travel to the site of the derailment and defended his administration’s response to the wreck.

    The House committees on Transportation and Infrastructure, Energy and Commerce and Oversight are among the panels vowing to find answers to what happened, as well as hold the Biden administration and rail industry accountable for the fallout.

    Some GOP members of the committees are also discussing a potential field hearing in East Palestine, though no official plans have been made yet, sources familiar with the talks tell CNN.

    The Energy and Commerce Committee has asked the EPA to appear before the panel’s Environment, Manufacturing & Critical Materials subcommittee chaired by GOP Rep. Bill Johnson, who represents East Palestine, a committee aide told CNN.

    Johnson and Energy and Commerce Chair Cathy McMorris Rodgers, a Washington state Republican, formally kicked off their probe on February 17, when they sent a letter to Regan demanding answers on a timeline of events relating to the train wreck, a list of the chemicals on board, materials relating to the EPA’s and local agencies’ response, as well as other information regarding the derailment.

    Johnson and McMorris Rodgers gave the EPA until March 3 to respond to their request.

    The Energy and Commerce Committee has asked for an all-members briefing, a committee briefing, as well as a hearing date from EPA officials. A source familiar told CNN they are still awaiting a response.

    The Transportation and Infrastructure Committee plans to “keep Members informed as facts come out,” committee spokesman Justin Harclerode told CNN. The committee is also closely watching the National Transportation Safety Board’s investigation into the incident.

    “The important thing is to learn exactly what happened, what factors played a role in the accident, and what factors did not. The Committee is staying engaged on this issue, but no one should jump to any conclusions or act without all the facts. Which is exactly what the NTSB is working to provide through their investigation,” Harclerode said.

    House Oversight Chairman James Comer, meanwhile, sent a letter to Buttigieg on Friday, in which he called the incident “an environmental and public health emergency that now threatens Americans across state lines.” The Kentucky Republican requested that Buttigieg turn over a series of documents relating to the derailment, including when the administration first learned of the incident and communications regarding the Pipeline and Hazardous Materials Safety Administration’s handling of materials in the derailment.

    “At this time, Chairman Comer is focused on acquiring the documents and information requested in his February 24 letter to Secretary Buttigieg,” Comer spokesman Austin Hacker told CNN.

    The Environmental Protection Agency has approved resuming shipments of contaminated liquid and soil out of East Palestine, Ohio, where a train carrying toxic chemicals derailed earlier this month.

    The EPA on Friday ordered the train’s operator, Norfolk Southern, to halt the shipments so that it could review the company’s plans for disposal, adding to the controversy surrounding the crash that has also left residents of the town worried about potential long-term health effects.

    That’s as officials in Texas and Michigan complained they didn’t receive any warning that hazardous waste from the crash would be shipped into their jurisdictions for disposal.

    Shipments now will be going to two EPA-certified facilities in Ohio, and Norfolk Southern will start shipments to these locations Monday, EPA regional administrator Debra Shore said at a news conference Sunday.

    “Some of the liquid wastes will be sent to a facility in Vickery, Ohio, where it will be disposed of in an underground injection well,” Shore said. “Norfolk Southern will also beghin shipping solid waste to the Heritage Incinerator in East Liverpool, Ohio.”

    Until Friday, Norfolk Southern was “solely responsible” for disposing of waste from the train derailment, Shore said Saturday, but waste disposal plans “will be subject to EPA review and approval moving forward.”

    All rail cars, except for those held by the National Transportation Safety Board (NTSB), have been removed from the site of the derailment, Ohio Environmental Protection Agency (EPA) Director Anne Vogel said in an update Sunday.

    The NTSB is currently holding 11 railcars as part of its investigation into the derailment, Ohio Gov. Mike DeWine said in a statement Sunday.

    “This is so critically important to moving on to next steps. We can now excavate additional contaminated soil and began installing monitoring wells,” Vogel said. The Ohio EPA will oversee the installation of water monitoring wells at the site of the derailment that will measure contaminant levels in the groundwater below.

    Every aspect of transporting and disposing of the hazardous waste material “from the moment trucks and rail cars are loaded until the waste is safely disposed of” will be closely regulated and overseen by federal, state, and local governments, Shore said Sunday.

    Shore detailed the federal, state, and local compliance requirements expected from Norfolk Southern.

    “These extensive requirements cover everything from waste labeling, packaging, and handling, as well as requirements for shipping documents that provide information about the wastes and where they’re going,” Shore said.

    The hazardous waste material previously sent to facilities in Michigan and Texas is now being processed at those facilities, Shore said.

    About 2 million gallons of firefighting water from the train derailment site were expected to be disposed in Harris County, Texas, with about half a million gallons already there, according to the county’s chief executive.

    Also, contaminated soil from the derailment site was being taken to the US Ecology Wayne Disposal in Belleville, Michigan, US Rep. Debbie Dingell of Michigan said Friday.

    The Michigan and Ohio facilities were, in fact, EPA approved sites, but they are not currently accepting any more shipments at this time, and the EPA is “exploring to see whether they have the capacity” to accept shipments in the future, Shore said.

    A spokesperson Gov. DeWine told CNN the governor was not briefed on where in the country the shipments would be sent. But this is typical, as the train company is responsible for the transport of material and the EPA is responsible for regulating that transport, DeWine spokesman Daniel Tierney said Saturday.

    The February 3 derailment of the Norfolk Southern train and subsequent intentional release of vinyl chloride it was hauling first forced East Palestine residents out of their homes, then left them with anxiety about health effects as reports of symptoms like rashes and headaches emerged after they returned.

    Officials have repeatedly sought to assure residents that continued air and water monitoring has found no concerns. The EPA reported last week that they have conducted indoor air testing at a total of 574 homes and detected no contaminants associated with the derailment.

    Federal teams in East Palestine have begun going door-to-door to check in with residents, conduct health surveys and provide informational flyers after President Joe Biden directed the move, a White House official told CNN.

    Also, a 19-person scientific team from the Centers for Disease Control and Prevention has been collecting information from residents about symptoms they have experienced since the derailment, said Jill Shugart, a senior environmental health specialist for the CDC.

    The EPA also installed “sentinel wells” near the city’s municipal well field to monitor contaminants in well water as part of the agency’s long-term early detection system “to protect the city for years to come,” Vogel, head of the Ohio EPA, said Saturday.

    In a Saturday update on the removal of contaminated waste, DeWine said 20 truckloads of hazardous solid waste had been hauled away from the Ohio derailment site. Fifteen of those truckloads were disposed of at a licensed hazardous waste treatment and disposal facility in Michigan and five truckloads were returned to East Palestine.

    About 102,000 gallons of liquid waste and 4,500 cubic yards of solid waste remained Saturday in storage on site in East Palestine – not including the five truckloads returned, according to DeWine. Additional solid and liquid wastes are being generated as the cleanup progresses, he added.

    Dingell told CNN on Saturday that neither she nor Michigan Gov. Gretchen Whitmer were aware of plans for toxic waste to be delivered to disposal sites in her district.

    “I called everybody,” Dingell said. “Nobody had really been given a heads up that they were coming here.”

    Across the country, Texas Chief Executive Lina Hidalgo expressed frustration that she first learned about the expected water shipments to her state from the news media – not from a government agency or Texas Molecular, the company hired to dispose of the water.

    She added that although there’s no legal requirement for her office to be notified, “it doesn’t quite seem right.”

    Hidalgo said Texas Molecular told her office Thursday that half a million gallons of the water was already in the county and the shipments began arriving around last Wednesday.

    On Thursday, Texas Molecular told CNN it had been hired to dispose of potentially dangerous water from the Ohio train derailment. The company said they had experts with more than four decades of experience in managing water safely and that all shipments, so far, had come by truck for the entire trip.

    Hidalgo’s office had been seeking information about the disposal, including the chemical composition of the firefighting water, the precautions that were being taken, and why Harris County was the chosen site, she said.

    According to a Thursday news release from Ohio Emergency Management Agency, more than 1.7 million gallons of contaminated liquid had been removed from the immediate site of the derailment. Of that, more than 1.1 million gallons of “contaminated liquid” from East Palestine had been transported off-site, with the majority going to Texas Molecular and the rest going to a facility in Vickery, Ohio.

    CNN asked the Ohio agency the location of the remaining 581,500 gallons which had been “removed” but not “hauled off-site” and has yet to receive a response.

    Regarding the causes of the accident, a National Transportation Safety Board preliminary report found that one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, said Jennifer Homendy, the chair of the safety board. So far, the investigation found the three crew members on board the train did not do anything wrong prior to the derailment, though the crash was “100% preventable,” she said.

    After federal officials released an initial report concluding that this month’s toxic train wreck in Ohio was completely preventable, investigators will begin examining procedures, practices and design prior to the derailment that has sparked long-term concerns among hundreds of frustrated residents.

    The National Transportation Safety Board on Thursday released its preliminary report on the investigation into the February 3 train crash in East Palestine, Ohio, where residents have been complaining about feeling sick after hazardous chemicals seeped into the air, water and soil.

    Ohio environmental officials made a civil referral this week asking the state attorney general’s office to begin “legal and/or equitable civil actions” against Norfolk Southern, which could result in a civil complaint if negotiations with the company were to fail.

    The NTSB report found that one of the train’s cars carrying plastic pellets was heated by a hot axle that sparked the initial fire, according to Jennifer Homendy, the chair of the safety board. As the temperature of the bearing got hotter, the train passed by two wayside defect detectors that did not trigger an audible alarm message because the heat threshold was not met at that point, Homendy explained. A third detector eventually picked up the high temperature, but it was already too late by then.

    “This was 100% preventable. … There is no accident. Every single event that we investigate is preventable,” Homendy said during a news conference Thursday. “The NTSB has one goal, and that is safety and ensuring that this never happens again.”

    The next phase of the investigation will examine the train’s wheelset and bearing as well as the damage from the derailment, the NTSB report noted. The agency will also focus on the designs of tank cars and railcars along with maintenance procedures and practices.

    Plus, investigators will review the train operator’s use of wayside defect detectors and the company’s railcar inspection practices. More specifically, determining what caused the wheel bearing failure will be key to the investigation, Homendy said.

    On Friday, Homendy said on “CNN This Morning” that she’s concerned politics could cloud the investigation and prevent safety improvements. Former President Donald Trump visited the site of the train derailment on Wednesday where he criticized President Joe Biden’s administration’s handling of the railway disaster.

    “This is not a time for politics,” Homendy said. “There is a time for politics. It is not this.”

    On Thursday, Transportation Secretary Pete Buttigieg also visited the derailment site, and when asked how political figures like Trump could help, Buttigieg addressed the former president directly saying he could “express support for reversing the deregulation that happened on his watch.”

    Another key aspect of the investigation will focus on the response to the chemical disaster, particularly the manual detonations of tanks carrying toxic chemicals.

    Five of the 38 derailed train cars were carrying more than 115,000 gallons of vinyl chloride, according to the NTSB’s report. Exposure to high levels of vinyl chloride can increase cancer risk or cause death.

    Those five cars “continued to concern authorities because the temperature inside one tank car was still rising,” indicating a polymerization reaction which could have resulted in an explosion, the report said. To help prevent a potentially deadly blast of vinyl chloride, crews released the toxic chemical into a trench and burned it off on February 6 — three days after the derailment.

    Since then, some East Palestine residents have said they are experiencing headaches, dizziness, nausea and bloody noses — a host of health issues they say they did not have prior to the crash.

    At the same time, officials have been adamant in reassuring residents of the air’s safety and the municipal water supply.

    Around 2 million gallons of firefighting water from the train derailment site are expected to be disposed in Harris County, Texas, according to the county’s chief executive.

    Harris County Judge Lina Hidalgo said her office was told by Texas Molecular on Thursday that the shipments began arriving around last Wednesday, she said.

    Texas Molecular was hired to dispose of the potentially dangerous water from the train derailment, the company, which said it has more than four decades of experience in managing water safely, has told CNN.

    The company told Hidalgo’s office Thursday that half a million gallons was already in the county.

    Hidalgo expressed frustration that she first learned about the water shipments from the news media – not from a government agency or Texas Molecular,

    “It’s a very real problem we were told yesterday the materials were coming only to learn today they’ve been here for a week,” Hidalgo said.

    She added that although there’s no legal requirement for her office to be notified, “It doesn’t quite seem right.”

    Texas Molecular is receiving the water from trucks, but it’s unclear if trucks are used for the entire trip, Hidalgo said. The company told her office they’re receiving about 30 trucks of water a day, she said.

    CNN is seeking comment from Texas Molecular about how the water is being transported.

    Hidalgo said her office is looking for information about the disposal, including the chemical composition of the firefighting water, the precautions that are being taken, and why Harris County was the chosen site.

    “There’s nothing right now to tell me – to tell us – there’s going to be an accident in transport, that this is being done in such a way that is not compatible with the well, that there’s a nefarious reason why the water is coming here and not to a closer site,” Hidalgo said. “But it is our job to do basic due diligence on that information.”

    A total of 1.7 million gallons of contaminated liquid has been removed from the immediate site of the derailment, according to a Thursday news release from the Ohio Emergency Management Agency.

    More than 1.1 million gallons of “contaminated liquid” from East Palestine has been transported off-site so far, with the majority going to Texas Molecular and the rest going to a facility in Vickery, Ohio.

    CNN has asked the Ohio agency the location of the remaining 581,500 gallons which have been “removed” but not “hauled off-site.”

    Congresswoman Debbie Dingell of Michigan said she was “not given a heads up” that contaminated soil from East Palestine would be transported to the US Ecology Wayne Disposal in Belleville, Michigan.

    “We were not given a heads up on this reported action,” Dingell said in a press release on Friday, “Our priority is to always keep the people we represent safe.”

    Dingell said inquires to the EPA, Department of Transportation, Norfolk Southern, US Ecology, the state of Ohio and others involved are in the process.

    On Friday afternoon, Ohio Gov. Mike DeWine released an update on the removal of the contaminated site in East Palestine, saying that soil would be transported to Michigan.

    So far, 4,832 cubic yards of soil have been removed from the ground in East Palestine. Approximately six truckloads of that contaminated soil are on their way to the hazardous waste disposal facility in Michigan, according to a press release from DeWine.

    The 149-car train operated by Norfolk Southern on February 3 had three employees on board: a locomotive engineer, a conductor and a trainee who were all in the head end of the locomotive, Homendy told CNN’s Jake Tapper on Thursday.

    So far, the investigation found the crew did not do anything wrong prior to the derailment, though the crash was “100% preventable,” Homendy said.

    Video of the train before the derailment showed what appeared to be an overheated wheel bearing, according to the NTSB report. Footage showed sparks flying from underneath the train.

    NTSB investigators are now focusing on one train car’s wheel set and bearing to figure out what may have caused the overheating, Homendy said.

    “We have a lot of questions about that,” she said Friday, including the “thresholds and why they vary so much between railroads.”

    Ultimately, it’s the railroads that set the temperature thresholds for the detectors, Homendy said.

    Releasing publicly a probable cause or causes for the derailment could take 12 to 18 months, Homendy said during the news conference.

    “We are very deliberative. We are the gold standard when it comes to investigations globally, and we are methodical in our approach,” Homendy said. “But if we see a safety issue that we need to be addressed immediately, something systemic, we will not hesitate to issue an urgent safety recommendation.”

    In the meantime, here’s what the NTSB preliminary report found so far:

    • One wheel bearing’s temperature reached a “critical” level — 253 degrees Fahrenheit above the ambient temperature — and prompted an audible alarm that instructed “the crew to slow and stop the train to inspect a hot axle,” the report says.
    • The train’s engineer applied the train’s brakes and additional braking after the alert of an overheating axle, the report states. “During this deceleration, the wheel bearing failed,” Homendy explained. “Car 23 derailed, and the train initiated an emergency brake application and came to a stop.”

    Even after reading the preliminary NTSB report, Ohio Attorney General Dave Yost told “CNN This Morning” that there’s still a lot of facts he doesn’t know.

    Among his biggest questions are: “Had the train been shorter, had there been additional staff, could this have been averted? Based on the alerts that occurred, how long is the reaction time and how is that influenced by the size of the train?” Yost told CNN.

    The US Environmental Protection Agency has ordered Norfolk Southern to cover the full cost of cleaning up the aftermath of the train crash.

    “EPA has special authority for situations just like this where we can compel companies who inflict trauma and cause environmental and health damage to communities, like Norfolk Southern has done, to completely clean up the mess that they’ve caused and pay for it,” EPA administrator Michael Regan said.

    Norfolk Southern will be required to:

    • Provide a descriptive work plan on how they intend to clean up the water, soil and debris
    • Reimburse the EPA for providing residents a cleaning service of their homes and businesses
    • Show up to public meetings and explain their progress

    If the company does not follow the order, the EPA will step in to complete the duties, while fining Norfolk Southern up to $70,000 a day, Regan said Wednesday during a CNN town hall.

    “And the law gives us the authority to charge Norfolk Southern up to three times the amount that the cleanup will cost us,” he said.

    The company plans to take a series of measures moving forward to minimize the long-term impacts of chemicals on the land and groundwater, including ripping up the tracks where the train derailed and removing soil underneath, Norfolk Southern CEO Alan Shaw said.

    Shaw added his company is working with the Environmental Protection Agency on a “long-term remediation plan.”

    Yost, who received the referral from the Ohio EPA to initiate necessary legal civil actions against Norfolk Southern this week, told CNN any criminal referral in Ohio regarding the derailment would be a decision made by local prosecutors.

    “We’ve been in contact with the local county prosecutor, and … we may be assisting him, but at this point, he has not empaneled a grand jury, to my understanding,” he said Friday on “CNN This Morning.”

    Ohio environmental officials made a civil referral Tuesday asking Yost’s office to “initiate all necessary legal and/or equitable civil actions” and “seek appropriate penalties” against Norfolk Southern, according to a copy of the referral provided by the attorney general’s office.

    “I respectfully request that this referral result in the filing of a civil complaint in the appropriate court if efforts on your part to resolve this matter through negotiation fail,” Ohio Environmental Protection Agency Director Anne Vogel wrote in a letter to Yost.

    Vogel cited potential violations of state laws regarding air and water pollution and solid and hazardous waste.

    Expanding the definition of a high-hazard flammable train – a standard the derailed train did not meet, despite sparking a major fire – is among the changes NTSB advocated for in the past, Homendy said Friday.

    NTSB urged regulators to include in the classification “a broad array of flammable materials,” rather than focusing on crude oil, she said.

    Additionally, NTSB will look at whether vinyl chloride needs to be carried in more fortified cars, Homendy said.

    The US Environmental Protection Agency is ordering Norfolk Southern to handle and pay for all necessary cleanup after a train carrying toxic chemicals derailed in East Palestine, Ohio.

    The EPA announced its legally binding order Tuesday, 18 days after the freight train derailed. The disaster ignited a dayslong inferno, shot plumes of black smoke into the air and led to the intentional release of vinyl chloride to help avert a more catastrophic blast.

    Some residents have reported health problems, and about 3,500 fish have died in Ohio waterways since the wreck.

    “Norfolk Southern will pay for cleaning the mess that they created and the trauma that they inflicted on this community,” EPA Administrator Michael Regan said Tuesday.

    As part of the EPA’s legally binding order, Norfolk Southern will be required to:

    • Identify and clean up any contaminated soil and water resources,

    • Reimburse the EPA for cleaning services to be offered to residents and businesses to provide an additional layer of reassurance, which will be conducted by EPA staff and contractors,

    • Attend and participate in public meetings at the EPA’s request and post information online, and

    • Pay for the EPA’s costs for work performed under the order.

    The order will take effect Thursday. The EPA said it will exercise its strongest authority against the train’s operator under CERCLA – the Comprehensive Environmental Response, Compensation, and Liability Act.

    “In no way, shape or form will Norfolk Southern get off the hook for the mess that they created,” Regan said.

    If the rail company fails to meet the demands, the EPA said it will immediately step in, conduct the necessary work and then seek to compel Norfolk Southern to pay triple the cost.

    In response to the EPA’s announcement, Norfolk Southern said it has been working to clean up the site and will continue helping residents.

    “We recognize that we have a responsibility, and we have committed to doing what’s right for the residents of East Palestine,” Norfolk Southern said in a statement to CNN.

    “We have been paying for the clean-up activities to date and will continue to do so. We are committed to thoroughly and safely cleaning the site, and we are reimbursing residents for the disruption this has caused in their lives. We are investing in helping East Palestine thrive for the long-term, and we will continue to be in the community for as long as it takes. We are going to learn from this terrible accident and work with regulators and elected officials to improve railroad safety.”

    Hours before the EPA’s announcement, Regan and Gov. Mike DeWine visited an East Palestine home and tried to reassure residents that the municipal water supply is safe.

    They raised two glasses filled with water straight from the tap and toasted before drinking.

    The municipal water supply comes from five wells deep underground that are encased in steel, state officials have said. But residents with private well water should get that water tested before using it, since that water may be sourced closer to the ground’s surface.

    “State and local authorities will continue the water sampling efforts, and EPA will continue indoor air screenings to residents within the evacuation zone,” Regan said Tuesday.

    But “I recognize that no matter how much data we collect or provide, it will not be enough to completely reassure everybody,” the EPA chief said.

    “It may not be enough to restore the sense of safety and security that this community once had. But we’re going to work together, day by day, for as long as it takes to make sure that this community feels at home once again.”

    The soil under the railroad track at the site of the wreck is still contaminated, and the tracks need to be lifted to remove that soil, the director of Ohio’s Environmental Protection Agency said Tuesday.

    The governor acknowledged residents’ concerns about the contaminated soil and said 4,588 cubic yards of soil and 1.1 million gallons of contaminated water have been removed from East Palestine.

    “The railroad got the tracks back on and started running and the soil under the tracks had not been dealt with,” DeWine said. “The tracks will have to be taken up, and that soil will have to be removed.”

    To address the growing reports of rashes, headaches, nausea and other symptoms in East Palestine, the state opened a new health clinic for residents.

    The health clinic will have registered nurses, mental health specialists and – at times – a toxicologist, the Ohio Department of Health said.

    Medical teams from the US Centers for Diseases Control and Prevention and the US Department of Health are expected to arrive in the community as early as this week to help assess what dangers might remain.

    Authorities have repeatedly assured residents that the air and municipal water supply in the town are safe. Crews have checked hundreds of homes and have not detected any dangerous levels of contaminants, the EPA said.

    Still, life in East Palestine has been uprooted as residents question the findings and wonder whether it’s really safe to drink the water or breathe the air.

    “It will be important to monitor people’s health and the environment around the train derailment for some time to come since health impacts may not emerge until later,” said Dr. Erin Haynes, an environmental health scientist at the University of Kentucky.

    “We should never say we’re done looking at this community for potential exposures and health impacts.”

    Some waterways were contaminated after the crash, killing an estimated 3,500 fish. But officials have said they believe those contaminants have been contained.

    Norfolk Southern installed booms and dams to restrict the flow of contaminated water from Sulphur Run and Leslie Run – two streams where fish were found dead, the EPA said.

    “The spill did flow to the Ohio River during that initial slug, but the Ohio River is very large, and it’s a water body that’s able to dilute the pollutants pretty quickly,” Ohio Environmental Protection Agency official Tiffani Kavalec said last week.

    Kavalec said the agency is pretty confident that the “low levels” of contaminants that remain are not getting passed on to water customers.

    A series of pumps have been placed upstream to reroute Sulphur Run around the derailment site, Norfolk Southern said Monday.

    “Environmental teams are treating the impacted portions of Sulphur Run with booms, aeration, and carbon filtration units,” Norfolk Southern added. “Those teams are also working with stream experts to collect soil and groundwater samples to develop a comprehensive plan to address any contamination that remains in the stream banks and sediment.”

    Water intakes from the Ohio River that were shut off Sunday “as a precautionary measure” were reopened after sampling found “no detections of the specific chemicals from the train derailment,” the Greater Cincinnati Water Works and Northern Kentucky Water District said Monday.

    A third utility provider – Maysville utility in Kentucky – announced that it temporarily shut off water intakes from the Ohio River on Saturday, when the toxic chemicals released into the river from the derailment were expected to arrive at the water treatment intake in Kentucky, utility general manager Mark Julian said.

    Water measurements have been below the level of concern, Julian said, and Maysville took precautionary measures in temporarily shutting down their Ohio River intake valve due to the public concern.

    “The takeaway is that anyone along the Ohio River where the contaminants made their way can breathe a sigh of relief,” he said.

    Meanwhile, the majority of the hazardous rail cars remain at the crash site as investigators continue to probe the wreck. But about 15,000 pounds of contaminated soil and 1.1 million gallons of contaminated water have been removed from the scene, Norfolk Southern announced Monday.

    The contaminated soil became a point of contention last week after a public document sent to the EPA on February 10 did not list soil removal among completed cleanup activities. It is not yet known what significance or impact the soil that was not removed before the railroad reopened on February 8 will have had on the surrounding areas.

    As skepticism spreads about the safety of the air and water, some local businesses say they’ve seen fewer customers.

    “Everybody’s afraid … They don’t want to come in and drink the water,” Teresa Sprowls, a restaurant owner in East Palestine, told CNN affiliate WOIO.

    A stylist at a hair salon told WOIO there’s no doubt the salon lost business and that customers may be worried about what may be in the water washing their hair.

    “I know a lot of our businesses are already suffering greatly because people don’t want to come here,” local greenhouse owner Dianna Elzer told CNN affiliate WPXI.

    Her husband, Donald Elzer, echoed her concerns, saying, “It’s devastating. The longer it goes on, the worse it gets.”

    Dianna Elzer also worried about longer-term economic impacts to the community.

    “Our property values – who is going to want to buy a house here now?” she told WPXI. “It’s going to be a long struggle to get back to where we were.”

    As residents call for accountability from both Norfolk Southern and government officials, US Transportation Secretary Pete Buttigieg said he plans to visit East Palestine “when the time is right” – but did not announce a date.

    He did announce Monday new efforts by the Department of Transportation to improve rail safety.

    “We are accelerating and augmenting our ongoing lines of effort on rail regulation and inspection here at the US DOT, including further regulation on high hazard flammable trains and electronically controlled pneumatic brakes – rules that were clawed back under the previous administration – to the full extent of that we are allowed to under current law, and we will continue using resources from the Bipartisan Infrastructure Law to fund projects that improve rail safety,” Buttigieg said.

    A DOT news release said the agency will continue to press for the “Train Crew Staffing Rule,” which would require a minimum of two crew members during most railroad operations. Norfolk Southern has opposed the proposed rule.

    Norfolk Southern has committed millions of dollars’ worth of financial assistance to East Palestine, including $3.4 million in direct financial assistance to families and a $1 million community assistance fund, among other aid, the company said.

    Norfolk Southern CEO Alan Shaw posted an open letter telling East Palestine residents, “I hear you” and “we are here and will stay here for as long as it takes to ensure your safety and to help East Palestine recover and thrive.”

    “Together with local health officials,” Shaw said, “we have implemented a comprehensive testing program to ensure the safety of East Palestine’s water, air, and soil.”

    While officials have repeatedly sought to assure residents that the water and air in East Palestine, Ohio, are safe after the derailment of a train carrying hazardous materials earlier this month, anxiety has permeated the community amid reports of rashes, nausea and headaches.

    The state now plans to open a health clinic in East Palestine Tuesday for residents concerned about possible symptoms related to the derailment and the Biden administration announced it deployed experts to help assess what dangers remain in the area after Ohio Gov. Mike DeWine requested medical teams from the US Centers for Diseases Control and Prevention and the US Department of Health.

    It’s been over two weeks since a train carrying vinyl chloride derailed in the small community of less than 5,000 people, igniting a dayslong inferno and prompting crews to carry out detonations to the toxic chemical to prevent a potentially deadly explosion.

    The detonations unleashed a black cloud of smoke over the area, where a chemical stench lingered for days. While it was deemed safe for evacuated residents to return home on February 8, community members have questioned how safe their village is and the validity of the air and water tests.

    US Sen. Sherrod Brown said residents are “right to be skeptical.”

    “We think the water’s safe,” Brown told CNN, citing comments made by the administrators of the state and federal Environmental Protection Agencies. “But when you return to your home, you should be tested again for your water and your soil and your air, not to mention those that have their own wells.”

    Testing of air quality in more than 530 homes has shown no detection of contaminants, the US Environmental Protection Agency said Sunday.

    As for the water, no vinyl chloride has been detected in any down-gradient waterways near the train derailment, EPA official Tiffani Kavalec told CNN last week.

    And while some waterways in the area were contaminated – killing thousands of fish downstream – officials have said they believe those contaminants to be contained.

    After crews discovered the contaminated runoff on two surface water streams, Sulphur Run and Leslie Run, Norfolk Southern installed booms and dams to restrict the flow of contaminated water, according to the EPA.

    Still, despite the assurances from officials that the water is safe, some residents are too afraid to drink from their taps and the town has been distributing bottled water.

    Desiree Walker – a 19-year resident of the town who lives just 900 feet from the derailment site – told CNN affiliate WOIO that she refuses to let her children drink the water, fearing it could have long-term health effects.

    “There’s a big concern because they’re young. They’ve got their whole life ahead of them,” Walker said. “I don’t want this to impact them down the road. I want them to have a long, happy life.”

    Walker said her family is feeling symptoms, but doctors tell them they don’t know what to test for.

    “At nighttime especially is when we smell it the most,” she told the station. “Our throats are sore, we’re coughing a lot now. My son, his eyes matted shut.”

    As anger and frustration bubbled in the small town, hundreds of East Palestine residents attended a town hall last week to express concerns over air and water safety in their community.

    Residents reported a variety of issues – including rashes, sore throats, nausea and headaches – and shared worries that the symptoms could potentially be related to chemicals released after a train derailment.

    “Why are people getting sick if there’s nothing in the air or in the water,” one resident yelled during the gathering.

    Ayla Antoniazzi and her family returned to their house less than a mile from the crash site the day after evacuation orders were lifted. The mother made sure to air the house out and wash all the linen before bringing her children home.

    “But the next day when they woke up, they weren’t themselves,” Antoniazzi said. “My oldest had a rash on her face. The youngest did too but not as bad. The 2-year-old was holding her eye and complaining that her eye was hurting. She was very lethargic, so I took them back to my parents’ home.”

    The Ohio Department of Health’s clinic opening Tuesday is meant to help East Palestine recover from the incident, officials said. The clinic will have registered nurses, mental health specialists and, at times, a toxicologist, the agency said.

    “I heard you, the state heard you, and now the Ohio Department of Health and many of our partner agencies are providing this clinic, where people can come and discuss these vital issues with medical providers,” said the department’s director, Dr. Bruce Vanderhoff.

    The decision to conduct controlled detonations at the derailment site on February 6 has also fueled skepticism and questions about safety.

    Officials said the move was meant to avert an explosion at the site of the derailment by venting the toxic vinyl chloride gas and burning it in a pit, a move that shot up a thick plume of smoke over the town.

    Vinyl chloride – a man-made substance used to make PVC – can cause dizziness, sleepiness and headaches and has also been linked to an increased risk of cancer in the liver, brain, lungs and blood.

    The burning vinyl chloride gas could break down into compounds including hydrogen chloride and phosgene, a chemical weapon used during World War I as a choking agent, according to the US Environmental Protection Agency and CDC.

    After the detonation, crews checked the air for chemicals of concern, including phosgene and hydrogen chloride, as well as butyl acrylate, ethylene glycol monobutyl ether acetate, and 2-ethylhexyl acrylate, according to the EPA, and reported that the data was normal.

    Work now continues to clear the crash site.

    The train’s operator, Norfolk Southern, is “scrapping and removing rail cars at the derailment location, excavating contaminated areas, removing contaminated liquids from affected storm drains, and staging recovered waste for transportation to an approved disposal facility,” the EPA said Sunday.

    “Air monitoring and sampling will continue until removal of heavily contaminated soil in the derailment area is complete and odors subside in the community,” the agency said.

    US Transportation Secretary Pete Buttigieg sent a letter Sunday to Norfolk Southern CEO Alan Shaw, demanding accountability and calling for greater safety regulations.

    “The people of East Palestine cannot be forgotten, nor can their pain be simply considered the cost of doing business,” Buttigieg wrote to the railway’s chief executive.

    “You have previously indicated to me that you are committed to meeting your responsibilities to this community, but it is clear that area residents are not satisfied with the information, presence, and support they are getting from NorfolkSouthern in the aftermath and recovery,” Buttigieg added.

    Brown also pledged to hold the rail company accountable for the impacts on the community, saying in a news conference he would “make sure Norfolk Southern does what it says it’s going to do, what it’s promised.”

    “All the cleanup, all the drilling, all the testing, all the hotel stays, all of that is on Norfolk Southern. They caused it, there’s no question they caused it,” Brown said, adding the total cost could amount to either tens or hundreds of millions of dollars.

    Norfolk Southern’s CEO posted an open letter Saturday telling East Palestine residents, “I hear you” and “we are here and will stay here for as long as it takes to ensure your safety and to help East Palestine recover and thrive.”

    “Together with local health officials, we have implemented a comprehensive testing program to ensure the safety of East Palestine’s water, air, and soil,” Shaw said in the letter, adding that the company also started a $1 million fund “as a down payment on our commitment to help rebuild.”

    The Biden administration on Friday finalized a decision to reestablish Obama-era rules that require coal and oil-fired power plants to reduce toxic pollutants, including mercury and acid gas, that come out of their smokestacks.

    Mercury is a neurotoxin with several health impacts, including harmful effects on children’s brain development. And while the updated rule significantly benefits public health for communities around these kinds of power plants, it also has the effect of requiring plants to cut down on planet-warming pollution that comes from burning coal to generate electricity.

    President Joe Biden’s Environmental Protection Agency announced early last year that it intended to undo a Trump-era rollback of the 2012 mercury pollution rules, one of many Trump-era environmental decisions it has reversed.

    “This is a really good day for public health in this country,” EPA Deputy Administrator Janet McCabe told CNN. “We’re talking about mercury, arsenic, acid gases; these are dangerous pollutants that impact people’s health.”

    The EPA estimates the 2012 rule brought down mercury emissions from power plants by 86% by 2017, while acid gas emissions were reduced by 96%.

    McCabe said the EPA is currently working on its own, stronger mercury standard that it expects to propose “not too long from now” and finalize before the end of Biden’s first term.

    The Mercury and Air Toxics Standards rules are part of a larger tranche of regulations the agency is expected to roll out this spring that would cut down on coal-fired power plant pollution, including rules on proper disposal of coal ash.

    It also plans to release a much-anticipated rule that would regulate planet-warming pollution like carbon dioxide and methane. That rule is expected to be more limited than climate advocates desire, after the US Supreme Court limited the EPA’s ability to broadly regulate carbon pollution in a ruling last year.

    “We’re very mindful of the Supreme Court precedent,” McCabe told CNN. “We’ve been working very, very carefully to craft a rule that will be in the four corners of the direction that the Supreme Court has laid down.”

    McCabe said the agency will propose that rule “in the relatively near future,” but did not share specifics about what the rule would do to limit pollution.

    Many of the nation’s coal-fired power plants are aging and new ones are not being built – especially as it’s getting more expensive operate existing plans. If the EPA implements stronger federal regulations on mercury, coal ash and greenhouse gas emissions, it could have the impact of more utilities shuttering coal-fired plants, as many are already doing.

    The Biden administration said it has deployed federal medical experts to help assess what dangers remain at an Ohio village where a train carrying hazardous materials derailed this month, a ramp-up of federal support at the governor’s request as anxious residents point to signs of adverse effects.

    Ohio Gov. Mike DeWine on Thursday asked the US Centers for Disease Control and Prevention and the US Department of Health and Human Services to send teams to East Palestine, where the train derailed February 3 and sparked a dayslong blaze.

    “This request for medical experts includes, but is not limited to, physicians and behavioral health specialists,” DeWine wrote in a letter to the CDC. “Some community members have already seen physicians in the area but remain concerned about their condition and possible health effects – both short- and long-term.”

    The Biden administration approved the request and began deploying teams from both federal agencies in part for public health testing and assessments, White House press secretary Karine Jean-Pierre said Thursday.

    That is in addition to aid the Federal Emergency Management Agency is providing, according to Jean-Pierre, who noted Thursday that the train derailment situation is “much more expansive” than what FEMA can offer.

    The federal support boost to a community of some 5,000 people along the Ohio-Pennsylvania state line comes amid some residents’ growing concerns that some areas may not be safe to live in.

    An evacuation order that was in place for areas near the crash site was lifted February 8 after officials said air and water sample results led them to deem the area safe, officials said.

    But a chemical stench lingered in areas, with some residents saying the odor left them with headaches and pains in their throat. Plus, officials estimate thousands of fish were killed by contamination washing down streams and rivers.

    Further spurring residents’ questions about safety – some of which were expressed at an emotional community meeting Wednesday – were crews’ decision to conduct controlled detonations February 6 of some tanks carrying toxic chemicals to prevent a more dangerous explosion. Though a larger blast was averted, the detonations essentially released chemicals into the air, including vinyl chloride that at high levels could kill and increase cancer risk.

    On Thursday, the head of the federal Environmental Agency Administration visited East Palestine and vowed to use the agency’s enforcement authority to hold the train operator, Norfolk Southern, accountable.

    “I want the community to know that we hear you, we see you, and that we will get to the bottom of this,” EPA Administrator Michael S. Regan said Thursday during a news conference. “We are testing for all volatile organic chemicals. We’re testing for everything. We’re testing for everything that was on that train. So, we feel comfortable that we are casting a net wide enough to present a picture that will protect the community.”

    During the visit, Regan observed some of the ongoing remediation efforts following the hazardous train derailment. While the state EPA has the primary responsibility over the scene, Regan noted the federal arm is ready to provide aid when needed.

    Regan also noted that Norfolk Southern has signed a notice of accountability, acknowledging the company will be responsible for the cleanup.

    Meanwhile, another train operated by Norfolk Southern derailed Thursday morning in Michigan’s Van Buren Charter Township, and local officials said there was no evidence the area was exposed to hazardous materials.

    First responders arrived at the crash location around 8:30 a.m. and found around 30 rail cars had derailed. One of the overturned rail cars contained agricultural grain while the other overturned cars were empty, Van Buren Township Public Safety said.

    One rail car contained liquid chlorine, but it was not part of the overturned section and was removed from the scene, officials added.

    CNN has reached out to Norfolk Southern for comment on the train derailment in Michigan.

    Federal transportation investigators are working vigorously to determine what caused the 100-car freight train to crash in Ohio, the head of the National Transportation Safety Board said Thursday in a thread of tweets.

    “You have my personal commitment that the NTSB will CONTINUE to share all information publicly as soon as possible following our analysis,” board chairwoman Jennifer Homendy wrote. “Next: NTSB investigators will thoroughly examine the tank cars once decontaminated. As always, we’ll issue urgent safety recommendations as needed.”

    One of the elements under scrutiny is an apparent overheated wheel bearing seen on video before the derailment, the NTSB has said. The apparent overheating began at least 43 minutes before the train derailed, according to a CNN analysis of surveillance videos the network obtained.

    At around 8:12 p.m. on February 3, sparks from an apparent wheel bearing overheating were visible as the train passed through Salem, Ohio, two surveillance videos obtained by CNN show. Bright light and sparks are seen emanating from one of the rail cars.

    No sparks were seen in surveillance video taken 14 minutes earlier as the train passed through Alliance, Ohio.

    The train derailed in East Palestine around 8:55 p.m., about 43 minutes after the sparks were seen in Salem.

    It remains unclear what caused the overheating and whether it is linked to the derailment.

    Homendy, whose agency is responsible for investigating various transportation crashes from aviation to railways, implored the public on Twitter not to speculate about the cause of the crash.

    The train was carrying a range of toxic materials, including vinyl chloride, ethylene glycol monobutyl ether, ethylhexyl acrylate, isobutylene and butyl acrylate, the US Environmental Protection Agency has said.

    Of those, the vinyl chloride gas that caught fire could break down into compounds including hydrogen chloride and phosgene, a chemical weapon used during World War I as a choking agent, according to the EPA and the CDC. Vinyl chloride – a volatile organic compound, or VOC, and the most toxic chemical involved in the derailment – is known to cause cancer, attacking the liver, and can also affect the brain, Maria Doa of the Environmental Defense Fund told CNN.

    It’s the dangers these chemicals pose that has put East Palestine residents on edge over the past two weeks.

    During an intense community town hall meeting Wednesday in a high school gym, East Palestine Mayor Trent Conaway addressed the February 6 controlled detonations, saying the only option was to release the chemicals manually or risk greater danger to residents.

    “There (were) two options: We either detonate those tanks, or they detonate themselves,” Conaway told a group of reporters at Wednesday’s meeting.

    “Yes, harmful chemicals went into the air. I am truly sorry, but that is the only option we had. If we didn’t do that, then they were going to blow up, and we were going to have shrapnel all across this town.”

    Jami Cozza, an East Palestine resident who attended the meeting and was vocal about the issues her family have been facing since the train derailed, said she will not return home until it’s safe. Cozza told CNN she’s staying at a hotel paid for by the train company due to toxicity in her home cause by the derailment.

    Cozza explained the train company told her it was safe to return home after conducting air testing. However, she insisted the company run soil and water tests, and only then did a toxicologist deem her house unsafe.

    “Had I not used my voice, had I not thrown a fit, I would be sitting in that house right now, when they told me that it was safe,” Cozza said Thursday, adding she’s worried that not all residents are receiving the proper level of testing.

    Cozza noted the company has also offered to pay all of her moving expenses. “It’s not about the money. It’s about our house,” she said.

    Representatives of the train’s operator, Norfolk Southern, did not attend the community meeting Wednesday, citing safety concerns after it said employees were threatened, further escalating tensions.

    Despite the company’s absence, the mayor said the operator has been collaborating with local officials “tremendously.”

    Earlier this week, Norfolk Southern said it plans to create a $1 million charitable fund to support the East Palestine community.

    The company initially said it would make $1,000 payments to residents who lived within a mile of the spill evacuation zone. But the company has since decided to pay each resident in the entire 44413 ZIP code that money, a spokesman for the company told CNN.

    As of Tuesday evening, Norfolk Southern has distributed more than $1.5 million in direct financial assistance to more than 1,000 families and some businesses to cover costs related to the evacuation, the company said Wednesday in a news release.

    Those payments are in addition to the company’s offer to reimburse expenses related to residents evacuating during the incident, which includes the costs of hotels stays, food and more, company spokesperson Connor Spielmaker said.

    An overwhelming stench of chlorine filled the air this week where Nathen Velez and his wife had been raising their two children, quickly burning his throat and eyes.

    The odor has lingered nearly two weeks after a Norfolk Southern train carrying hazardous materials derailed near the Ohio-Pennsylvania line, igniting an inferno that burned for days and prompted evacuations in surrounding areas while crews managed detonations to release vinyl chloride, which can kill quickly at high levels and increase cancer risk.

    The stay-away order was lifted five days after the derailment, after air and water sample results led officials to deem the area safe, the East Palestine, Ohio, fire chief said at the time. Governors of both states that day said air quality samples had “consistently showed readings at points below safety screening levels for contaminants of concern” – but also advised private well users to opt for bottled water and offered free well testing.

    Now, a week after residents were allowed to return, bottled water should remain the rule until more test results are back, Ohio Gov. Mike DeWine told “CNN This Morning” on Wednesday, noting water in the first well tested “was fine.”

    Still, he said, “Don’t take a chance. Wait until you get the tests back.”

    As that warning echoes and other worrying signs emerge, many in East Palestine remain plagued with anxiety – and some refuse to return amid fears the water, air, soil and surfaces in the village of 5,000 are not safe from fallout from the freight wreck. Some, like Velez, even are spending small fortunes to try to keep their families safely away from the place they used to call home.

    Plaintiffs’ attorneys have invited residents to meet Wednesday afternoon to discuss the derailment’s impact ahead of an evening town hall meeting hosted by East Palestine officials.

    The 100-car freight train that derailed February 3 was carrying hazardous materials including vinyl chloride, ethylene glycol monobutyl ether, ethylhexyl acrylate, isobutylene and butyl acrylate, the US Environmental Protection Agency said. Of those, the vinyl chloride gas that caught fire could break down into compounds including hydrogen chloride and phosgene, a chemical weapon used during World War I as a choking agent, according to the EPA and US Centers for Disease Control and Prevention.

    Vinyl chloride – a volatile organic compound, or VOC, and the most toxic chemical involved in the derailment – is known to cause cancer, attacking the liver, and can also affect the brain, Maria Doa of the Environmental Defense Fund told CNN.

    Cleanup and monitoring of the site could take years, Kurt Kohler of the Ohio EPA’s Office of Emergency Response said February 8, vowing that after the emergency response, “Ohio EPA is going to remain involved through our other divisions that oversee the long-term cleanup of these kinds of spill.” The federal EPA, too, will “continue to do everything in our power to help protect the community,” Administrator Michael Regan said Tuesday.

    Norfolk Southern, the company that operated the train, said Wednesday it was creating a $1 million charitable fund to support East Palestine.

    “We are committed to East Palestine today and in the future,” Norfolk Southern President and CEO Alan Shaw said in a statement. “We will be judged by our actions. We are cleaning up the site in an environmentally responsible way, reimbursing residents affected by the derailment, and working with members of the community to identify what is needed to help East Palestine recover and thrive.”

    But that’s slim consolation to Ben Ratner, whose family worries about longer-term risks that environmental officials are only beginning to assess, he told CNN this week.

    The Ratner home, for instance, was tested and cleared for VOCs, he said. And so far, no chemical detections were identified in the air of 291 homes screened by the EPA for hazardous chemicals including vinyl chloride and hydrogen chloride, it said in a Monday news update, with schools and a library also screened and 181 more homes to go.

    But the Ratners – who played extras in a Netflix disaster film with eerie similarities to the derailment crisis – still are feeling “an ever-changing mix of emotions and feelings just right from the outset, just the amount of unknown that was there,” said Ben, who owns a cafe a few towns over and isn’t sure he still wants to open another in East Palestine.

    “It’s hard to make an investment in something like that or even feel good about paying our mortgage whenever there might not be any value to those things in the future,” he said. “That’s something tough to come to grips with.”

    The EPA, with the Ohio National Guard and a Norfolk Southern contractor, also has collected air samples – checking for vinyl chloride, hydrogen chloride, carbon monoxide, phosgene and other compounds – in the East Palestine community, it had said. Air monitoring results posted Tuesday at the EPA’s website include more than a dozen instruments, each with four types of measures – and each stating its “screening level” had not been exceeded.

    But when Velez returned Monday for a short visit to the neighborhood where his family has lived since 2014 to check his home and his business, he developed a nagging headache that, he said, stayed with him through the night – and left him with a nagging fear.

    “If it’s safe and habitable, then why does it hurt?” he told CNN. “Why does it hurt me to breathe?”

    Despite Velez’s experience, air quality does not appear to be the source of headaches and sore throats among people or deaths of animals such as cats and chickens in and around the derailment zone, Ohio Health Director Dr. Bruce Vanderhoff said Tuesday.

    “In terms of some of the symptoms of headache, et cetera, unfortunately volatile organic compounds share, with a host of other things, the ability to cause very common symptoms at the lower levels – so headache, eye irritation, nose irritation, et cetera,” he said. “I think that we have to look at the measured facts – and the measured facts include the fact that the air sampling in that area really is not pointing toward an air source for this.”

    “Anecdotes are challenging because they’re anecdotes,” Vanderhoff said. “Everything that we’ve gathered thus far is really pointing toward very low measurements, if at all.”

    As to odor, residents “in the area and tens of miles away may smell odors coming from the site,” Ohio EPA spokesperson James Lee told CNN on Wednesday. “This is because some of the substances involved have a low odor threshold. This means people may smell these contaminants at levels much lower than what is considered hazardous.”

    “If you experience symptoms, Columbiana County Health Department recommends calling your medical provider,” the EPA said.

    The Ratner family is limiting its water use because of unknown affects, Ben Ratner said. And Velez worries “every time we turn the water on or give my daughter a bath could potentially be hazardous,” he wrote on Facebook.

    Some waterways indeed have been contaminated – but the Ohio Environmental Protection Agency is confident contaminants are contained, said Tiffany Kavalec, the agency’s division chief of surface water.

    No vinyl chloride has been detected in any down-gradient waterways near the train derailment, she said Tuesday. But an estimated 3,500 fish across 12 species are estimated to have been killed by the derailment and spillage, said Mary Mertz, director of Ohio’s Department of Natural Resources.

    “Fire combustion chemicals” flowed to the Ohio River, “but the Ohio River is very large, and it’s a water body that’s able to dilute the pollutants pretty quickly,” Kavalec said. The chemicals are a “contaminant plume” the Ohio EPA and other agencies have tracked in real time and is believed to be moving about a mile an hour, she said.

    The “tracking allows for potential closing of drinking water intakes to allow the majority of the chemicals to pass. This strategy, along with drinking water treatment … are both effective at addressing these contaminants and helps ensure the safety of the drinking water supplies,” Kavalec said, adding they’re pretty confident “low levels” of contaminants that remain are not getting to customers.

    Even so, authorities strongly recommend people in the area drink bottled water, especially if their water is from a private source, such as a well.

    Velez also worries about unknown long-term effects of the burned train contents, he said.

    “My wife is a nurse and is not taking any chances exposing us and our two young children to whatever is now in our town,” he wrote on Facebook. “The risk and anxiety of trying to live in our own home again is not worth it.”

    Velez and his family have been Airbnb-hopping 30 minutes from their home since they evacuated, but rental options and their finances are running out, he said, and a friend set up a GoFundMe to help the family.

    “Unfortunately, many of us residents are stuck in the same situation and the sad truth is that there is no answer,” he wrote. “There is no viable solution other than to leave and pay a mortgage on a potentially worthless home.”

    Shaman Davi Kopenawa Yanomami furrowed his brow as he stared out at the skyscrapers and buildings looming through the window of his oak-panelled hotel room in New York City. “I’m here, in the city of stone, and mirrors and glass… but in my heart, I’m in mourning,” he told CNN.

    Davi has campaigned for Brazil’s Yanomami people, one of the largest relatively isolated indigenous groups in South America, for nearly 40 years – braving threats on his life for his activism. Last week, he was invited to Manhattan for the opening of a group exhibition of Yanomami artists and Brazilian photographer Claudia Andujar at cultural center The Shed, which counted among its guests United Nations Secretary-General António Guterres.

    Despite the glamour of the surroundings, Davi’s mind was more than 2,000 miles away, deep in the forests of Brazil, where a health crisis has gripped his people. “I’m in mourning…for my people, who I’ve lost,” he said, referring to recent images that emerged from the territory showing emaciated Yanomami adults and children, some with swollen bellies from hunger.

    Disease and malnutrition have torn through Yanomami villages over the last four years – a crisis that experts lay at the feet of the scores of illegal miners who have set up camp in their sprawling territory, spurred by the high price of gold.

    Yanomami children are dying at a disproportionate rate from preventable diseases, like malaria and malnutrition. At least 570 Yanomami children have died from preventable causes since 2018, Brazil’s health ministry told CNN.

    Fiona Watson, research and advocacy director at indigenous human rights group Survival International, said high malaria rates – spread by miners – have left many Yanomami adults too unwell to hunt or fish, as they rely entirely off the forest and rivers for food. “That means the food’s not coming in, hence you get so much malnutrition (that) has led to this terrible catastrophe,” she said.

    Their predicament is exacerbated by water pollution and environmental destruction from the mines, and sometimes violent encounters with the intruders. In January, Ariel Castro Alves, Lula’s National Secretary for the Rights of Children and Adolescents, said a federal government delegation were told in January that at least 30 Yanomami girls and teenagers had been abused and impregnated by miners.

    Government health workers, who might have mitigated the crisis, have been intimidated and even driven out of the area by miners who took over health facilities and airstrips, Junior Hekurari Yanomami, president of the Urihi Yanomami Association, told CNN.

    The emergency is the latest test for Brazil’s newly inaugurated President Luiz Inacio Lula da Silva, who has made environmental protection a priority for his term in office. In January, he launched a crackdown on illegal mines in Yanomami territory, and the country’s military, environmental agencies and police forces are currently sweeping through the area to clear it of miners.

    Lula’s administration has brought hope, says Davi, especially through his appointment of the country’s first minister for indigenous people, Sonia Guajajara.

    “But he’s going to need a lot of support,” the activist said of Brazil’s bitterly polarized political landscape.

    Yanomami territory, which spans the Brazilian states of Roraima and Amazonas, is supposed to be a protected reservation where mining is illegal. But miners have flooded the area over the last several years as gold prices boomed, stripping the natural environment and in some cases driving away vital health workers.

    While it is hard to get an accurate number of mines in the sprawling territory, which equals the size of Portugal, a report by Brazilian NGO Instituto Socioambiental (ISA), based on satellite imaging, found that mines on Yanomami land had risen from four in 2015 to 1,556 by the end of 2021.

    As hunter-agriculturalists, the Yanomami maintain a symbiotic relationship with their environment. Some 30,400 Yanomami live in the territory, and as they are largely isolated from the outside world, they are more vulnerable to common viruses. Exploitation and encroachment in the forest by extractive industries has proven to be fatal for the indigenous group and their traditional way of life.

    The building of the Trans Amazonian highway, started in the 1970s by the Brazilian military dictatorship who were keen to develop the Amazon basin, introduced measles, malaria and the flu that decimated Yanomami communities, said Watson.

    A goldrush in 1986 later saw an estimated 20% of the Yanomami community die in a seven-year period, according to Watson. Many of those miners were driven out in 1992, when the area was demarcated by the government of then-President Fernando Collor de Mello.

    Food is airdropped from a military transport aircraft to the Surucucu military base on January 26, which will be delivered to the Yanomami.

    Davi says he noticed a shift when former President Jair Bolsonaro was in power. Miners felt emboldened to enter the territory armed “with a lot of heavy equipment, the mechanised dredgers, and they were using petrol, mercury, and then they… used planes and small landing strips and helicopters,” Davi said.

    The arrival of new miners brought misery, said Davi, including reported threats and attacks against Yanomami communities. In May 2021, a half-hour shootout with miners left four dead, including two Yanomami children – a video of the incident showed women and children running for cover as a boat passed the riverbanks of their village.

    “It’s his fault. He let the illness of mining in,” Davi says of Bolsonaro.

    Bolsonaro has called accusations that he turned a blind eye to the Yanomami plight a “left-wing farce” on his official Telegram channel on January 21. Having visited the region before, he shared pictures of him with indigenous people on his Telegram account as well as government press releases from his presidency, including one saying the World Health Organization praised the vaccination rate of Brazil’s indigenous people under his government in 2021.

    During his term from 2019 to 2022, Bolsonaro signed an environmental protection decree to raise fines for illegal logging, fishing, burning, hunting, and deforestation. His administration also saw Brazil’s National Indian Foundation (FUNAI) – a government agency that oversees policies related to indigenous communities – invest $16 million in surveillance of indigenous lands to combat illegal activities there.

    However, the far-right leader also supported legislation to open indigenous protected areas to mining, reduced funding or dismantled agencies tasked with monitoring and enforcing environmental regulations, and repeatedly claimed that indigenous territories are “too big” – all of which emboldened trespassers, experts say.

    Brazil’s Supreme Court has ordered an investigation to determine whether the actions of the Bolsonaro government amounted to “genocide” of the Yanomami. Ahead of Lula’s meeting with President Joe Biden on Friday, he reiterated to CNN that Bolsonaro could be “punished” by courts for “the genocide against the Yanomami indigenous people.”

    On January 30, Brazil’s Ministry of Human Rights and Citizenship (MDHC) also released a report on alleging that its previous administration disregarded numerous alerts made about the Yanomami’s deteriorating situation.

    CNN has reached out to Damares Alves, who led MDHC at the time. When asked about the claims by a Brazilian reporter on February 1, Alves responded: “The Yanomami have been living in a calamitous situation for decades. It’s time for the people (the Senate) to change the union’s budget so that we can take better care of the Yanomami Indians. As for the accusations, I will only speak when cited by a court”.

    There has been momentum since Lula’s intervention in the territory. Speaking from Boa Vista in late January, Lula pledged to eliminate illegal mining, saying he was “shocked” by the Yanomami’s poor health.

    More than 1,000 unwell indigenous people have been evacuated from the Yanomami territory, and the Justice Ministry announced a major offensive against the miners, and closed the territory’s airspace as it tackles their supply routes.

    On Monday, Brazilian security forces began their enforcement operation to expel the miners, many of whom may have already left the area. Videos have emerged on social media of miners fleeing from the territory or imploring the government to help them leave the area. Last week, Justice Minister Flavio Dino said he expected 80% of the illegal miners to have left the first week of February.

    A miner, who was seen leaving the area, told Reuters that the Yanomami were desperate for food parcels dropped by Air Force planes. “The day the parcels arrived, they were gone,” Joao Batista Costa, 65, told Reuters, while holding up a food parcel.

    But resolving the crisis will be a long road, and Lula is likely to face resistance among parts of the sizeable number of Brazilians who support Bolsonaro’s policies. Nor are all politicians on a regional level as enthused about indigenous protections; Roraima state governor Antonio Denarium, a Bolsonaro ally, for example, appeared to downplay the Yanomami crisis in an interview to Folha de S. Paulo newspaper in January, saying it was time for them to adapt to urban living and “leave the bush.”

    In a later statement to CNN, Denarium’s office said the quotes were “taken out of context,” adding that “the desire for people’s lives to improve is the desire of anyone who values the dignity of indigenous or non-indigenous people.”

    For Davi, there has been little evidence that authorities valued Yanomami dignity in recent years.

    “We indigenous peoples are badly treated, as are our rivers, the animals – but it’s not just indigenous peoples who are dying, the city people are suffering as well,” Davi said from his hotel room. “These two worlds really need to come together in a big embrace and not let our world be ruined.”

    Officials continued on Sunday to monitor the environmental impact caused by a derailed train carrying hazardous materials late Friday in East Palestine, Ohio, a crash that led to a large inferno that continues to burn, evacuations, a shelter-in-place order and concerns about air quality.

    Trent Conaway, the mayor of East Palestine, assured residents the air and drinking water remain safe after the Norfolk Southern train crash. He said classes at East Palestine schools would be canceled Monday, as would city meetings.

    The train derailed in East Palestine, about 15 miles south of Youngstown, Friday evening, according to earlier comments by officials. Of the more than 100 cars, about 20 were carrying hazardous materials, according to the National Transportation Safety Board, which is investigating the incident.

    Ten of those cars derailed, including five that were carrying vinyl chloride, the NTSB said in a statement Saturday. The agency said so far it had “not confirmed vinyl chloride has been released other than from the pressure release devices.”

    While air and water quality remained stable Sunday, and officials have yet to see abnormal levels in screenings, “things can change at any moment,” said James Justice, an on-scene coordinator with the EPA’s Emergency Response.

    Authorities continue to monitor for a “long list” of chemicals, he said – not only those provided to authorities in a list from Norfolk Southern, but also those that can result from combustion.

    Officials issued a shelter-in-place order for the entire town of roughly 5,000 people, and an evacuation order was issued for the area within a mile radius of the train crash near James Street.

    Both restrictions remained in place Sunday, Conaway said at a news conference. Fire Chief Keith Drabkick told reporters at the news conference the scene remained volatile, preventing authorities from conducting on-scene operations. Crews will not be able to determine the full list of chemicals involved until the fires stops burning, Drabkick said.

    Officials urged residents to follow the shelter-in-place orders. On Saturday evening, one person was arrested for misconduct after approaching the scene and getting too close to the train, the mayor said.

    “Please stay home. I can’t reiterate it enough,” Conaway said. “Do not come to our town.”

    The Ohio EPA is monitoring water quality in local streams, which eventually feed into the Ohio River, a spokesperson said, but the agency does not anticipate contamination to East Palestine’s public water system, which draws from other sources.

    The agency installed containment dams in area streams and set up three aeration locations using high volume pumps to treat water and remove dissolved contaminants.

    In an email to CNN Sunday morning, a spokesperson for Norfolk Southern deferred all questions to the NTSB.

    President Joe Biden delivered a Thursday speech to hail economic progress during his administration and to attack congressional Republicans for their proposals on the economy and the social safety net.

    Some of Biden’s claims in the speech were false, misleading or lacking critical context, though others were correct. Here’s a breakdown of the 14 claims CNN fact-checked.

    Touting the bipartisan infrastructure law he signed in 2021, Biden said, “Last year, we funded 700,000 major construction projects – 700,000 all across America. From highways to airports to bridges to tunnels to broadband.”

    Facts First: Biden’s “700,000” figure is wildly inaccurate; it adds an extra two zeros to the correct figure Biden used in a speech last week and the White House has also used before: 7,000 projects. The White House acknowledged his misstatement later on Thursday by correcting the official transcript to say 7,000 rather than 700,000.

    Biden said, “Well, here’s the deal: I put a – we put a cap, and it’s now in effect – now in effect, as of January 1 – of $2,000 a year on prescription drug costs for seniors.”

    Facts First: Biden’s claims that this cap is now in effect and that it came into effect on January 1 are false. The $2,000 annual cap contained in the Inflation Reduction Act that Biden signed last year – on Medicare Part D enrollees’ out-of-pocket spending on covered prescription drugs – takes effect in 2025. The maximum may be higher than $2,000 in subsequent years, since it is tied to Medicare Part D’s per capita costs.

    Asked for comment, a White House official noted that other Inflation Reduction Act health care provisions that will save Americans money did indeed come into effect on January 1, 2023.

    Criticizing former President Donald Trump over his handling of the Covid-19 pandemic, Biden said, “Back then, only 3.5 million people had been – even had their first vaccination, because the other guy and the other team didn’t think it mattered a whole lot.”

    Facts First: Biden is free to criticize Trump’s vaccine rollout, but his “only 3.5 million” figure is misleading at best. As of the day Trump left office in January 2021, about 19 million people had received a first shot of a Covid-19 vaccine, according to figures published by the Centers for Disease Control and Prevention. The “3.5 million” figure Biden cited is, in reality, the number of people at the time who had received two shots to complete their primary vaccination series.

    Someone could perhaps try to argue that completing a primary series is what Biden meant by “had their first vaccination” – but he used a different term, “fully vaccinated,” to refer to the roughly 230 million people in that very same group today. His contrasting language made it sound like there are 230 million people with at least two shots today versus 3.5 million people with just one shot when he took office. That isn’t true.

    Biden said Republicans want to cut taxes for billionaires, “who pay virtually only 3% of their income now – 3%, they pay.”

    Facts First: Biden’s “3%” claim is incorrect. For the second time in less than a week, Biden inaccurately described a 2021 finding from economists in his administration that the wealthiest 400 billionaire families paid an average of 8.2% of their income in federal individual income taxes between 2010 and 2018; after CNN inquired about Biden’s “3%” claim on Thursday, the White House published a corrected official transcript that uses “8%” instead. Also, it’s important to note that even that 8% number is contested, since it is an alternative calculation that includes unrealized capital gains that are not treated as taxable income under federal law.

    “Biden’s numbers are way too low,” said Howard Gleckman, senior fellow at the Urban-Brookings Tax Policy Center at the Urban Institute think tank, though Gleckman also said we don’t know precisely what tax rates billionaires do pay. Gleckman wrote in an email: “In 2019, Berkeley economists Emmanuel Saez and Gabe Zucman estimated the top 400 households paid an average effective tax rate of about 23 percent in 2018. They got a lot of attention at the time because that rate was lower than the average rate of 24 percent for the bottom half of the income distribution. But it still was way more than 2 or 3, or even 8 percent.”

    Biden has cited the 8% statistic in various other speeches, but unlike the administration economists who came up with it, he tends not to explain that it doesn’t describe tax rates in a conventional way. And regardless, he said “3%” in this speech and “2%” in a speech last week.

    Biden cited a 2021 report from the Institute on Taxation and Economic Policy think tank that found that 55 of the country’s largest corporations had made $40 billion in profit in their previous fiscal year but not paid any federal corporate income taxes. Before touting the 15% alternative corporate minimum tax he signed into law in last year’s Inflation Reduction Act, Biden said, “The days are over when corporations are paying zero in federal taxes.”

    Facts First: Biden exaggerated. The new minimum tax will reduce the number of companies that don’t pay any federal taxes, but it’s not true that the days of companies paying zero are “over.” That’s because the minimum tax, on the “book income” companies report to investors, only applies to companies with at least $1 billion in average annual income. According to the Institute on Taxation and Economic Policy, only 14 of the companies on its 2021 list of 55 non-payers reported having US pre-tax income of at least $1 billion.

    In other words, there will clearly still be some large and profitable corporations paying no federal income tax even after the minimum tax takes effect this year. The exact number is not yet known.

    Matthew Gardner, a senior fellow at the Institute on Taxation and Economic Policy, told CNN in the fall that the new tax is “an important step forward from the status quo” and that it will raise substantial revenue, but he also said: “I wouldn’t want to assert that the minimum tax will end the phenomenon of zero-tax profitable corporations. A more accurate phrasing would be to say that the minimum tax will *help* ensure that *the most profitable* corporations pay at least some federal income tax.”

    There are lots of nuances to the tax; you can read more specifics here. Asked for comment on Thursday, a White House official told CNN: “The Inflation Reduction Act ensures the wealthiest corporations pay a 15% minimum tax, precisely the corporations the President focused on during the campaign and in office. The President’s full Made in America tax plan would ensure all corporations pay a 15% minimum tax, and the President has called on Congress to pass that plan.”

    Noting the big increase in the federal debt under Trump, Biden said that his administration has taken a “different path” and boasted: “As a result, the last two years – my administration – we cut the deficit by $1.7 trillion, the largest reduction in debt in American history.”

    Facts First: Biden’s boast leaves out important context. It is true that the federal deficit fell by a total of $1.7 trillion under Biden in the 2021 and 2022 fiscal years, including a record $1.4 trillion drop in 2022 – but it is highly questionable how much credit Biden deserves for this reduction. Biden did not mention that the primary reason the deficit fell so substantially was that it had skyrocketed to a record high under Trump in 2020 because of bipartisan emergency pandemic relief spending, then fell as expected as the spending expired as planned. Independent analysts say Biden’s own actions, including his laws and executive orders, have had the overall effect of adding to current and projected future deficits, not reducing those deficits.

    Dan White, senior director of economic research at Moody’s Analytics – an economics firm whose assessments Biden has repeatedly cited during his presidency – told CNN’s Matt Egan in October: “On net, the policies of the administration have increased the deficit, not reduced it.” The Committee for a Responsible Federal Budget, an advocacy group, wrote in September that Biden’s actions will add more than $4.8 trillion to deficits from 2021 through 2031, or $2.5 trillion if you don’t count the American Rescue Plan pandemic relief bill of 2021.

    National Economic Council director Brian Deese wrote on the White House website last week that the American Rescue Plan pandemic relief bill “facilitated a strong economic recovery and enabled the responsible wind-down of emergency spending programs,” thereby reducing the deficit; David Kelly, chief global strategist at J.P. Morgan Funds, told Egan in October that the Biden administration does deserve credit for the recovery that has pushed the deficit downward. And Deese correctly noted that Biden’s signature legislation, last year’s Inflation Reduction Act, is expected to bring down deficits by more than $200 billion over the next decade.

    Still, the deficit-reducing impact of that one bill is expected to be swamped by the deficit-increasing impact of various additional bills and policies Biden has approved.

    Biden said, “Wages are up, and they’re growing faster than inflation. Over the past six months, inflation has gone down every month and, God willing, will continue to do that.”

    Facts First: Biden’s claim that wages are up and growing faster than inflation is true if you start the calculation seven months ago; “real” wages, which take inflation into account, started rising in mid-2022 as inflation slowed. (Biden is right that inflation has declined, on an annual basis, every month for the last six months.) However, real wages are lower today than they were both a full year ago and at the beginning of Biden’s presidency in January 2021. That’s because inflation was so high in 2021 and the beginning of 2022.

    There are various ways to measure real wages. Real average hourly earnings declined 1.7% between December 2021 and December 2022, while real average weekly earnings (which factors in the number of hours people worked) declined 3.1% over that period.

    Biden said he was disappointed that the first bill passed by the new Republican majority in the House of Representatives “added $114 billion to the deficit.”

    Facts First: Biden is correct about how the bill would affect the deficit if it became law. He accurately cited an estimate from the government’s nonpartisan Congressional Budget Office.

    The bill would eliminate more than $71 billion of the $80 billion in additional funding for the Internal Revenue Service (IRS) that Biden signed into law in the Inflation Reduction Act. The Congressional Budget Office found that taking away this funding – some of which the Biden administration said will go toward increased audits of high-income individuals and large corporations – would result in a loss of nearly $186 billion in government revenue between 2023 and 2032, for a net increase to the deficit of about $114 billion.

    The Republican bill has no chance of becoming law under Biden, who has vowed to veto it in the highly unlikely event it got through the Democratic-controlled Senate.

    Biden said that “MAGA Republicans” in the House “want to impose a 30 percent national sales tax on everything from food, clothing, school supplies, housing, cars – a whole deal.” He said they want to do that because “they want to eliminate the income tax system.”

    Facts First: This is a fair description of the Republicans’ “FairTax” bill. The bill would eliminate federal income taxes, plus the payroll tax, capital gains tax and estate tax, and replace it with a national sales tax. The bill describes a rate of 23% on the “gross payments” on a product or service, but when the tax rate is described in the way consumers are used to sales taxes being described, it’s actually right around 30%, as a pro-FairTax website acknowledges.

    It is not clear how much support the bill currently has among the House Republican caucus. Notably, House Speaker Kevin McCarthy told CNN’s Manu Raju this week that he opposes the bill – though, while seeking right-wing votes for his bid for speaker in early January, he promised its supporters that it would be considered in committee. Biden wryly said in his speech, “The Republican speaker says he’s not so sure he’s for it.”

    Biden claimed the unemployment rate “is the lowest it’s been in 50 years.”

    Facts First: This is true. The unemployment rate was just below 3.5% in December, the lowest figure since 1969.

    The headline monthly rate, which is rounded to a single decimal place, was reported as 3.5% in December and also reported as 3.5% in three months of President Donald Trump’s tenure, in late 2019 and in early 2020. But if you look at more precise figures, December was indeed the lowest since 1969 – 3.47% – just below the figures for February 2020, January 2020 and September 2019.

    Biden said that the unemployment rates for Black and Hispanic Americans are “near record lows” and that the unemployment rate for people with disabilities is “the lowest ever recorded” and the “lowest ever in history.”

    Facts First: Biden’s claims are accurate, though it’s worth noting that the unemployment rate for people with disabilities has only been released by the government since 2008.

    The Black or African American unemployment rate was 5.7% in December, not far from the record low of 5.3% that was set in August 2019. (This data series goes back to 1972.) The rate was 9.2% in January 2021, the month Biden became president. The Hispanic or Latino unemployment rate was 4.1% in December, just above the record low of 4.0% that was set in September 2019. (This data series goes back to 1973.) The rate was 8.5% in January 2021.

    The unemployment rate for people with disabilities was 5.0% in December, the lowest since the beginning of the data series in 2008. The rate was 12.0% in January 2021.

    Biden said that fewer families are facing foreclosure than before the pandemic.

    Facts First: Biden is correct. According to a report published by the Federal Reserve Bank of New York, about 28,500 people had new foreclosure notations on their credit reports in the third quarter of 2022, the most recent quarter for which data is available; that was down from about 71,420 people with new foreclosure notations in the fourth quarter of 2019 and 74,860 people in the first quarter of 2020.

    Foreclosures plummeted in the second quarter of 2020 because of government moratoriums put in place because of the Covid-19 pandemic. Foreclosures spiked in 2022, relative to 2020-2021 levels, after the expiry of these moratoriums, but they remained very low by historical standards.

    Biden said, “More American families have health insurance today than any time in American history.”

    Facts First: Biden’s claim is accurate. An analysis provided to CNN by the Kaiser Family Foundation, which studies US health care, found that about 295 million US residents had health insurance in 2021, the highest on record – and Jennifer Tolbert, the foundation’s director for state health reform, told CNN this week that “I expect the number of people with insurance continued to increase in 2022.”

    Tolbert noted that the number of insured residents generally rises over time because of population growth, but she added that “it is not a given” that there will be an increase in the number of insured residents every year – the number declined slightly under Trump from 2018 to 2019, for example – and that “policy changes as well as economic factors also affect these numbers.”

    As CNN’s Tami Luhby has reported, sign-ups on the federal insurance exchange created by the Affordable Care Act, also known as Obamacare, have spiked nearly 50% under Biden. Biden’s 2021 American Rescue Plan pandemic relief law and then the 2022 Inflation Reduction Act temporarily boosted federal premium subsidies for exchange enrollees, and the Biden administration has also taken various other steps to get people to sign up on the exchanges. In addition, enrollment in Medicaid health insurance has increased significantly during the Covid-19 pandemic, in part because of a bipartisan 2020 law that temporarily prevented people from being disenrolled from the program.

    The percentage of residents without health insurance fell to an all-time low of 8.0% in the first quarter of 2022, according to an analysis published last summer by the federal government’s Department of Health and Human Services. That meant there were 26.4 million people without health insurance, down from 48.3 million in 2010, the year Obamacare was signed into law.

    Biden said, “And over the last two years, more than 10 million people have applied to start a small business. That’s more than any two years in all of recorded American history.”

    Facts First: This is true. There were about 5.4 million business applications in 2021, the highest since 2005 (the first year for which the federal government released this data for a full year), and about 5.1 million business applications in 2022. Not every application turns into a real business, but the number of “high-propensity” business applications – those deemed to have a high likelihood of turning into a business with a payroll – also hit a record in 2021 and saw its second-highest total in 2022.

    Trump’s last full year in office, 2020, also set a then-record for total and high-propensity applications. There are various reasons for the pandemic-era boom in entrepreneurship, which began after millions of Americans lost their jobs in early 2020. Among them: some newly unemployed workers seized the moment to start their own enterprises; Americans had extra money from stimulus bills signed by Trump and Biden; interest rates were particularly low until a series of rate hikes that began in the spring of 2022.

    Since winning a difficult battle to become speaker of the House of Representatives, Republican Kevin McCarthy has made public claims that are misleading, lacking any evidence or plain wrong.

    Here is a fact check of recent McCarthy comments about the debt ceiling, funding for the Internal Revenue Service, the FBI search of former President Donald Trump’s resort and residence in Florida, President Joe Biden’s stance on stoves and Democratic Rep. Adam Schiff.

    McCarthy’s office did not respond to a request for comment.

    McCarthy has cited the example of Rep. Nancy Pelosi, his Democratic predecessor as House speaker, while defending conservative Republicans’ insistence that any agreement to lift the federal debt ceiling must be paired with cuts to government spending – a trade-off McCarthy agreed to when he was trying to persuade conservatives to support his bid for speaker. Specifically, McCarthy has claimed that even Pelosi agreed to a spending cap as part of a deal to lift the debt ceiling under Trump.

    “When Nancy Pelosi was speaker, that’s what transpired. To get a debt ceiling, they also got a cap on spending for the next two years,” McCarthy told reporters at a press conference on January 12. When Fox host Maria Bartiromo told McCarthy in a January 15 interview that “they” would not agree to a spending cap, he responded, “Well Maria, I don’t believe that’s the case, because when Donald Trump was president and when Nancy Pelosi was speaker, that’s exactly what happened for them to get a debt ceiling lifted last time. They agreed to a spending cap.”

    Facts First: McCarthy’s claims are highly misleading. The deal Pelosi agreed to with the Trump administration in 2019 actually loosened spending caps that were already in place at the time because of a 2011 law. In other words, while congressional conservatives today want to use a debt ceiling deal to reduce government spending, the Pelosi deal allowed for billions in additional government spending above the pre-existing maximum. The two situations are nothing alike.

    Shai Akabas, director of economic policy at the Bipartisan Policy Center think tank, said when asked about the accuracy of McCarthy’s claims: “I’m going to steer clear of characterizing the Speaker’s remarks, but as an objective matter, the deal reached in 2019 increased the spending caps set by the Budget Control Act of 2011.”

    The 2019 deal, which was criticized by many congressional conservatives, also ensured that Budget Control Act’s caps on discretionary spending – which were created as a result of a 2011 debt ceiling deal between a Democratic president and a Republican speaker of the House – would not be extended past 2021. Spending caps vanishing is the opposite of McCarthy’s suggestion that the deal “got” a spending cap.

    Pelosi spokesperson Aaron Bennett said in an email that McCarthy is “trying to rewrite history.” Bennett said, “As Republicans in Congress and in the Administration noted at the time, in 2019, Speaker Pelosi and Democrats were eager to reach bipartisan agreement to raise the debt limit and, as part of the agreement, avert damaging funding cuts for defense and domestic programs.”

    In various statements since becoming speaker, McCarthy has boasted of how the first bill passed by the new Republican majority in the House “repealed 87,000 IRS agents” or “repealed funding for 87,000 new IRS agents.”

    Facts First: McCarthy’s claims are false. House Republicans did pass a bill that seeks to eliminate about $71 billion of the approximately $80 billion in additional Internal Revenue Service funding that Biden signed into law in last year’s Inflation Reduction Act – but that funding is not going to hire 87,000 “agents.” In addition, Biden has already made clear he would veto this new Republican bill even if the bill somehow made it through the Democratic-controlled Senate, so no funding has actually been “repealed.” It would be accurate for McCarthy to say House Republicans “voted to repeal” the funding, but the boast that they actually “repealed” something is inaccurate.

    CNN’s Katie Lobosco explains in detail here why the claim about “87,000 new IRS agents” is an exaggeration. The claim, which has become a common Republican talking point, has been fact-checked by numerous media outlets over more than five months, including The Washington Post in response to McCarthy remarks earlier this January.

    Here’s a summary. While Inflation Reduction Act funding may well allow for the hiring of tens of thousands of IRS employees, far from all of these employees will be IRS agents conducting audits and investigations. Many other employees will be hired for the non-agent roles, from customer service to information technology, that make up the vast majority of the IRS workforce. And a significant number of the hires are expected to fill the vacant posts left by retirements and other attrition, not take newly created positions.

    The IRS has not yet released a detailed breakdown of how it plans to use the funding provided by the Inflation Reduction Act, so it’s impossible to say precisely how many new “agents” will be hired. But it is already clear that the total won’t approach 87,000.

    In his interview with Fox’s Bartiromo on January 15, McCarthy criticized federal law enforcement for executing a search warrant at Trump’s Mar-a-Lago resort and residence in Florida, which the FBI says resulted in the recovery of more than 100 government documents marked as classified and hundreds of other government documents. Echoing a claim Trump has made, McCarthy said of the documents: “They knew it was there. They could have come and taken it any time they wanted.”

    Facts First: It is clearly not true that the authorities could somehow have come to Mar-a-Lago at any time, without conducting a formal search, and taken all of the presidential records they were seeking from Trump. By the time of the search, the federal government – first the National Archives and Records Administration and then the Justice Department – had been asking Trump for more than a year to return government records. Even when the Justice Department went beyond asking in May and served Trump’s team with a subpoena for the return of all documents with classification markings, Trump’s team returned only some of these documents. In June, a Trump lawyer signed a document certifying on behalf of Trump’s office that all of the documents had been returned, though that was not true.

    When FBI agents and a Justice Department attorney visited Mar-a-Lago without a search warrant on that June day to accept documents the Trump team was returning in response to the subpoena, a Trump lawyer “explicitly prohibited government personnel from opening or looking inside any of the boxes that remained in the storage room,” the department said in a court filing after the August search. In other words, according to the department, the government was not even allowed to poke around to see if there were government records still at Mar-a-Lago, let alone take those records.

    In the August court filing, the department pointedly called into question the extent to which the Trump team had cooperated: “That the FBI, in a matter of hours, recovered twice as many documents with classification markings as the ‘diligent search’ that the former President’s counsel and other representatives had weeks to perform calls into serious question the representations made in the June 3 certification and casts doubt on the extent of cooperation in this matter.”

    McCarthy wrote in a New York Post article published on January 12: “While President Joe Biden wants to control the kind of stove Americans can cook on, House Republicans are certainly cooking with gas.” He repeated the claim on Twitter the next morning.

    Facts First: There is no evidence for this claim; Biden has not expressed a desire to control the kind of stove Americans can cook on. McCarthy was baselessly attributing the comments of a single Biden appointee to Biden himself.

    It is true that a Biden appointee on the United States Consumer Product Safety Commission, Richard Trumka Jr., told Bloomberg earlier this month that gas stoves pose a “hidden hazard,” as they emit air pollutants, and said, “Any option is on the table. Products that can’t be made safe can be banned.” But the day before McCarthy’s article was published by the New York Post, White House press secretary Karine Jean-Pierre said at a press briefing: “The president does not support banning gas stoves. And the Consumer Product Safety Commission, which is independent, is not banning gas stoves.”

    To date, even the commission itself has not shown support for a ban on gas stoves or for any particular new regulations on gas stoves. Commission Chairman Alexander Hoehn-Saric said in a statement the day before McCarthy’s article was published: “I am not looking to ban gas stoves and the CPSC has no proceeding to do so.” Rather, he said, the commission is researching gas emissions in stoves, “exploring new ways to address health risks,” and strengthening voluntary safety standards – and will this spring ask the public “to provide us with information about gas stove emissions and potential solutions for reducing any associated risks.”

    Trumka told CNN’s Matt Egan that while every option remains on the table, any ban would apply only to new gas stoves, not the gas stoves already in people’s homes. And he noted that the Inflation Reduction Act makes people eligible for a rebate of up to $840 to voluntarily switch to an electric stove.

    Defending his plan to bar Democratic Rep. Adam Schiff from sitting on the House Intelligence Committee, a committee Schiff chaired during the Democratic majority from early 2019 to the beginning of this year, McCarthy criticized Schiff on January 12 over his handling of the first impeachment of Trump. Among other things, McCarthy said: “Adam Schiff openly lied to the American public. He told you he had proof. He told you he didn’t know the whistleblower.”

    Facts First: There is no evidence for McCarthy’s insinuation that Schiff lied when he said he didn’t know the anonymous whistleblower who came forward in 2019 with allegations – which were subsequently corroborated about how Trump had attempted to use the power of his office to pressure Ukrainian President Volodymyr Zelensky to investigate Biden, his looming rival in the 2020 election.

    Schiff said last week in a statement to CNN: “Kevin McCarthy continues to falsely assert I know the Ukraine whistleblower. Let me be clear – I have never met the whistleblower and the only thing I know about their identity is what I have read in press. McCarthy’s real objection is we proved the whistleblower’s claim to be true and impeached Donald Trump for withholding millions from Ukraine to extort its help with his campaign.” Schiff also made this comment to The Washington Post, which fact-checked the McCarthy claim last week, and has consistently said the same since late 2019.

    The New York Times reported in 2019 that, according to an unnamed official, a House Intelligence Committee aide who had been contacted by the whistleblower before the whistleblower filed a formal complaint did not inform Schiff of the person’s identity when conveying to Schiff “some” information about what the person had said. And Reuters reported in 2019 that a person familiar with the whistleblower’s contacts said the whistleblower hadn’t met or spoken with Schiff.

    McCarthy could have fairly repeated Republican criticism of a claim Schiff made in a 2019 television appearance about the committee’s communication with the whistleblower; Schiff said at the time “we have not spoken directly with the whistleblower” even though it soon emerged that the whistleblower had contacted the committee aide before filing the complaint. (A committee spokesperson said at the time that Schiff had been merely trying to say that the committee hadn’t heard actual testimony from the whistleblower, but that Schiff acknowledged his words “should have been more carefully phrased to make that distinction clear.”)

    Regardless, McCarthy didn’t argue here that Schiff had been misleading about the committee’s dealings with the whistleblower; he strongly suggested that Schiff lied in saying he didn’t know the whistleblower. That’s baseless. There has never been any indication that Schiff had a relationship with the whistleblower when he said he didn’t, nor that Schiff knew the whistleblower’s identity when he said he didn’t.

    Fish caught in the fresh waters of the nation’s streams and rivers and the Great Lakes contain dangerously high levels of PFOS, short for perfluorooctane sulfonic acid, a known synthetic toxin phased out by the federal government, according to a study of data from the US Environmental Protection Agency.

    The chemical PFOS is part of a family of manufactured additives known as perfluoroalkyl and polyfluoroalkyl substances, or PFAS, widely used since the 1950s to make consumer products nonstick and resistant to stains, water and grease damage.

    Called “forever chemicals” because they fail to break down easily in the environment, PFAS has leached into the nation’s drinking water via public water systems and private wells. The chemicals then accumulate in the bodies of fish, shellfish, livestock, dairy and game animals that people eat, experts say.

    “The levels of PFOS found in freshwater fish often exceeded an astounding 8,000 parts per trillion,” said study coauthor David Andrews, a senior scientist at Environmental Working Group, the nonprofit environmental health organization that analyzed the data.

    In comparison, the EPA has allowed only 70 parts per trillion of PFOS in the nation’s drinking water. Due to growing health concerns, in 2022 the EPA recommended the allowable level of PFOS in drinking water be lowered from 70 to 0.02 parts per trillion.

    “You’d have to drink an incredible amount of water — we estimate a month of contaminated water — to get the same exposure as you would from a single serving of freshwater fish,” Andrews said.

    “Consuming even a single (locally caught freshwater) fish per year can measurably and significantly change the levels of PFOS in your blood,” Andrews said.

    Chemicals in the PFAS family are linked to high cholesterol, cancer and various chronic diseases, as well as a limited antibody response to vaccines in both adults and children, according to a report by the National Academies of Sciences, Engineering, and Medicine.

    “This is an important paper,” said toxicologist Linda Birnbaum, former director of the National Institute for Environmental Health Sciences and the National Toxicology Program.

    “To find this level of contamination in fish across the country, even in areas not close to industry where you might expect heavy contamination, is very concerning. These chemicals are everywhere,” she said.

    It’s nearly impossible to avoid PFAS, experts say. Manufacturers add the chemicals to thousands of products, including nonstick cookware, mobile phones, carpeting, clothing, makeup, furniture and food packaging.

    A 2020 investigation found PFAS in the wrapping of many fast foods and “environmentally friendly” molded fiber bowls and containers.

    A 2021 study found PFAS in 52% of tested cosmetics, with the highest levels in waterproof mascara (82%), foundations (63%) and long-lasting lipstick (62%). Polytetrafluoroethylene, the coating on nonstick pans, was the most common additive.

    In fact, PFAS chemicals have been found in the blood serum of 98% of Americans, according to a 2019 report using data from the US Centers for Disease Control and Prevention’s National Health and Nutrition Examination Survey.

    “These chemicals are ubiquitous in the American environment. More than 2,800 communities in the US, including all 50 states and two territories, have documented PFAS contamination,” Dr. Ned Calonge, an associate professor of epidemiology at the Colorado School of Public Health and chair of the Academies committee that wrote the report, told CNN previously.

    Scientists at the Environmental Working Group used data from the EPA’s own monitoring programs — the National Rivers and Streams Assessment, which has been periodically testing stream conditions since 2008, and the Great Lakes Human Health Fish Fillet Tissue Study, which tests lake water every five years.

    “The analysis focused on EPA wild-caught fish in rivers, streams and throughout the Great Lakes from 2013 to 2015 as that was the latest data available,” Andrews said.

    The contamination was widespread, impacting “nearly every fish across the country,” he said. “I believe there was one sample without detected levels of PFOS.”

    The EWG created an interactive map of the results with details for each state. Fish caught near urban areas contained nearly three times more PFOS and overall PFAS than those caught in nonurban locations, the study found. The highest levels were found in fish from the Great Lakes.

    The analysis showed PFOS accounted for an average 74% of the contamination in the fish. The remaining 25% was a mixture of other PFAS known to be equally damaging to human health, Andrews said.

    CNN reached out to the EPA for comment but did not hear back before this story published.

    Based on the study’s findings, people who fish for sport might “strongly” consider releasing their catch instead of taking the fish home for a meal, Andrews said.

    Yet many people in lower socioeconomic groups, indigenous peoples and immigrants in the US rely eating freshly caught fish.

    “They need it for food or because it’s their culture,” Birnbaum said. “There are Native American tribes and Burmese immigrants and others who fish because this is who they are. This is key to their culture. And you can’t just tell them not to fish.”

    The predominant chemical in the fish, PFOS, and its sister perfluorooctanoic acid, or PFOA, are known as “long-chain” PFAS, made from an 8-carbon chain.

    Manufacturers agreed in the early 2000s to voluntarily stop using long-chain PFAS in US consumer products, although they can still be found in some imported items. Due to growing health concerns, the use of PFOS and PFOA in food packaging was phased out in 2016 by the US Food and Drug Administration.

    However, industry reworked the chemicals by making them into 4- and 6-carbon chains — today over 9,000 different PFAS exist, according to the CDC. Experts say these newer versions appear to have many of the same dangerous health effects as the 8-chain PFAS, leaving consumers and the environment still at risk.

    Many of these longer-chain PFAS can be stored for years in different organs in the human body, according to the National Academies report. Scientists are examining the impact of newer versions.

    “Some of these chemicals have half-lives in the range of five years,” National Academies report committee member Jane Hoppin, an environmental epidemiologist and director of the Center for Human Health and the Environment at North Carolina State University in Raleigh, told CNN previously.

    “Let’s say you have 10 nanograms of PFAS in your body right now. Even with no additional exposure, five years from now you would still have 5 nanograms,” she said. “Five years later, you would have 2.5 and then five years after that, you’d have one 1.25 nanograms. It would be about 25 years before all the PFAS leave your body.”

    That’s why it’s “no surprise” to find such high levels of PFOA in freshwater fish, said the director of environmental pediatrics at NYU Langone Health, Dr. Leonardo Trasande, who was not involved in the new study.

    “These truly are ‘forever chemicals,’” Trasande said. “This reinforces the reality that we need to get all PFAS out of consumer products and people’s lives.”

    At the Bhalswa landfill in northwest Delhi, a steady flow of jeeps zigzag up the trash heap to dump more garbage on a pile now over 62 meters (203 feet) high.

    Fires caused by heat and methane gas sporadically break out – the Delhi Fire Service Department has responded to 14 fires so far this year – and some deep beneath the pile can smolder for weeks or months, while men, women and children work nearby, sifting through the rubbish to find items to sell.

    Some of the 200,000 residents who live in Bhalswa say the area is uninhabitable, but they can’t afford to move and have no choice but to breathe the toxic air and bathe in its contaminated water.

    Bhalswa is not Delhi’s largest landfill. It’s about three meters lower than the biggest, Ghazipur, and both contribute to the country’s total output of methane gas.

    Methane is the second most abundant greenhouse gas after carbon dioxide, but a more potent contributor to the climate crisis because methane traps more heat. India creates more methane from landfill sites than any other country, according to GHGSat, which monitors methane via satellites.

    And India comes second only to China for total methane emissions, according to the International Energy Agency’s (IEA) Global Methane Tracker.

    As part of his “Clean India” initiative, Indian Prime Minister Narendra Modi has said efforts are being made to remove these mountains of garbage and convert them into green zones. That goal, if achieved, could relieve some of the suffering of those residents living in the shadows of these dump sites – and help the world lower its greenhouse gas emissions.

    India wants to lower its methane output, but it hasn’t joined the 130 countries who have signed up to the Global Methane Pledge, a pact to collectively cut global methane emissions by at least 30% from 2020 levels by 2030. Scientists estimate the reduction could cut global temperature rise by 0.2% – and help the world reach its target of keeping global warming under 1.5 degrees Celsius.

    India says it won’t join because most of its methane emissions come from farming – some 74% from farm animals and paddy fields versus less than 15% from landfill.

    In a statement last year, Minister of State for Ministry of Environment, Forest and Climate change Ashwini Choubey said pledging to reduce India’s total methane output could threaten the livelihood of farmers and affect India’s trade and economic prospects.

    But it’s also facing challenges in reducing methane from its steaming mounds of trash.

    When Narayan Choudhary, 72, moved to Bhalswa in 1982, he said it was a “beautiful place,” but that all changed 12 years later when the first rubbish began arriving at the local landfill.

    In the years since, the Bhalswa dump has grown nearly as tall as the historic Taj Mahal, becoming a landmark in its own right and an eyesore that towers over surrounding homes, affecting the health of people who live there.

    Choudhary suffers from chronic asthma. He said he nearly died when a large fire broke out at Bhalswa in April that burned for days. “I was in terrible shape. My face and nose were swollen. I was on my death bed,” he said.

    “Two years ago we protested … a lot of residents from this area protested (to get rid of the waste),” Choudhary said. “But the municipality didn’t cooperate with us. They assured us that things will get better in two years but here we are, with no relief.”

    The dump site exhausted its capacity in 2002, according to a 2020 report on India’s landfills from the Center for Science and Environment (CSE), a nonprofit research agency in New Delhi, but without government standardization in recycling systems and greater industry efforts to reduce plastic consumption and production, tonnes of garbage continue to arrive at the site daily.

    Bhalswa isn’t the only dump causing distress to residents nearby – it is one of three landfills in Delhi, overflowing with decaying waste and emitting toxic gases into the air.

    Across the country, there are more than 3,100 landfills. Ghazipur is the biggest in Delhi, standing at 65 meters (213 feet), and like Bhalswa, it surpassed its waste capacity in 2002 and currently produces huge amounts of methane.

    According to GHGSat, on a single day in March, more than two metric tons of methane gas leaked from the site every hour.

    “If sustained for a year, the methane leak from this landfill would have the same climate impact as annual emissions from 350,000 US cars,” said GHGSat CEO Stephane Germain.

    Methane emissions aren’t the only hazard that stem from landfills like Bhalswa and Ghazipur. Over decades, dangerous toxins have seeped into the ground, polluting the water supply for thousands of residents living nearby.

    In May, CNN commissioned two accredited labs to test the ground water around the Bhalswa landfill. And according to the results, ground water within at least a 500-meter (1,600-foot) radius around the waste site is contaminated.

    In the first lab report, levels of ammonia and sulphate were significantly higher than acceptable limits mandated by the Indian government.

    Results from the second lab report showed levels of total dissolved solids (TDS) – the amount of inorganic salts and organic matter dissolved in the water – detected in one of the samples was almost 19 times the acceptable limit, making it unsafe for human drinking.

    The Bureau of Indian Standards sets the acceptable limit of TDS at 500 milligrams/liter, a figure roughly seen as “good” by the World Health Organization (WHO). Anything over 900 mg/l is considered “poor” by the WHO, and over 1,200 mg/l is “unacceptable.”

    According to Richa Singh from the Center for Science and Environment (CSE), the TDS of water taken near the Bhalswa site was between 3,000 and 4,000 mg/l. “This water is not only unfit for drinking but also unfit for skin contact,” she said. “So it can’t be used for purposes like bathing or cleaning of the utensils or cleaning of the clothes.”

    Dr. Nitesh Rohatgi, the senior director of medical oncology at Fortis Memorial Research Institute, Gurugram, urged the government to study the health of the local population and compare it to other areas of the city, “so that in 15 to 20 years’ time, we are not looking back and regretting that we had a higher cancer incidence, higher health hazards, higher health issues and we didn’t look back and correct them in time.”

    Most people in Bhalswa rely on bottled water for drinking, but they use local water for other purposes – many say they have no choice.

    “The water we get is contaminated, but we have to helplessly store it and use it for washing utensils, bathing and at times drinking too,” said resident Sonia Bibi, whose legs are covered in a thick, red rash.

    Jwala Prashad, 87, who lives in a small hut in an alleyway near the landfill, said the pile of putrid trash had made his life “a living hell.”

    “The water we use is pale red in color. My skin burns after bathing,” he said, as he tried to soothe red gashes on his face and neck.

    “But I can’t afford to ever leave this place,” he added.

    More than 2,300 tonnes of Municipal Solid Waste arrive at Delhi’s largest dump in Ghazipur every day, according to a report released in July by a joint committee formed to find a way to reduce the number of fires at the site.

    That’s the bulk of the waste from the surrounding area – only 300 tonnes is processed and disposed of by other means, the report said. And less than 7% of legacy waste had been bio-mined, which involves excavating, treating and potentially reusing old rubbish.

    The Municipal Corporation of Delhi deploys drones every three months to monitor the size of the trash heap and is experimenting with ways to extract methane from the trash mountain, the report said.

    But too much rubbish is arriving every day to keep up. The committee said bio-mining had been “slow and tardy” and it was “highly unlikely” the East Delhi Municipal Corporation (which has now merged with North and South Delhi Municipal Corporations) would achieve its target of “flattening the garbage mountain” by 2024.

    “No effective plans to reduce the height of the garbage mountain have been made,” the report said. Furthermore, “it should have proposed a long time ago that future dumping of garbage in them would pollute the groundwater systems,” the report added.

    CNN sent a series of questions along with the data from the water testing questionnaire to India’s Environment and Health Ministries. There has been no response from the ministries.

    In a 2019 report, the Indian government recommended ways to improve the country’s solid waste management, including formalizing the recycling sector and installing more compost plants in the country.

    While some improvements have been made, such as better door-to-door garbage collection and processing of waste, Delhi’s landfills continue to accumulate waste.

    In October, the National Green Tribunal fined the state government more than $100 million for failing to dispose of more than 30 million metric tonnes of waste across its three landfill sites.

    “The problem is Delhi doesn’t have a concrete solid waste action plan in place,” said Singh from the CSE. “So we are talking here about dump site remediation and the treatment of legacy waste, but imagine the fresh waste which is generated on a regular basis. All of that is getting dumped everyday into these landfills.”

    “(So) let’s say you are treating 1,000 tons of legacy (waste) and then you are dumping 2,000 tons of fresh waste every day it will become a vicious cycle. It will be a never ending process,” Singh said.

    “Management of legacy waste, of course, is mandated by the government and is very, very important. But you just can’t start the process without having an alternative facility of fresh waste. So that’s the biggest challenge.”

    The UK has greenlit a controversial plan to open the country’s first new coal mine in three decades, a little more than a year after the nation tried to convince the world to ditch coal at the COP26 climate talks in Glasgow.

    Michael Gove, the UK housing and communities secretary, on Wednesday approved the plan to open the Whitehaven coal mine in Cumbria, a county in northwestern England that is home to the World Heritage-listed Lake District.

    The controversial mine is expected to create more than 500 jobs. But the environmental trade-off is steep: The UK Climate Change Committee (CCC), an independent group that advises the government, has estimated the mine and the coal it will produce will emit around 9 million tons of planet-warming emissions every year.

    Supporters of the mine argue the project will create jobs and secure the fossil fuel for British steelmaking; however, 85% of the coal mined is due to be exported.

    The CCC has criticized the decision. Committee chairman Lord Deben said in a statement: “Phasing out coal use is the clearest requirement of the global effort towards Net Zero. We condemn, therefore, the Secretary of State’s decision to consent to a new deep coal mine in Cumbria, contrary to our previous advice. This decision grows global emissions and undermines UK efforts to achieve Net Zero.”

    The mine’s approval was also met with fierce criticism from scientists and environmentalists.

    “A new coal mine in Cumbria makes no sense environmentally or economically,” said Paul Ekins, Professor of Resources and Environmental Policy at the UCL Institute for Sustainable Resources, in a statement. “It will add to global CO2 emissions, as the new supply will not replace other coal but divert it elsewhere, and it will become stranded in the 2030s as the steel industry globally moves away from coal.”

    Ekins also said that the mine’s approval “trashes the UK’s reputation as a global leader on climate action and opens it up to well justified charges of hypocrisy – telling other countries to ditch coal while not doing so itself.”

    The government initially approved the project, but then put it on hold after a wave of protests, including a 10-day hunger strike by two teenage activists.

    It came under intense pressure to reject the plan in 2021, the year it hosted the COP26 talks in Glasgow.

    Alok Sharma, the COP26 President and a lawmaker for the governing Conservative Party, campaigned against the mine.

    “Opening a new coal mine will not only be a backward step for UK climate action but also damage the UK’s hard-won international reputation, through our COP26 Presidency, as a leader in the global fight against climate change,” he said ahead of the announcement on Wednesday.

    The decision comes a little more than a year after the conference, and after lengthy discussions between the UK government, local authorities and the public.

    The Cumbria County Council had also approved the plan three times, but it backtracked its decision last February and called for a planning inquiry, effectively shifting the decision to the national government.

    The Whitehaven mine, also known as the Woodhouse Colliery, is scheduled to operate until 2049, which is just a year before the UK’s self-imposed deadline to slash greenhouse gas emissions to net zero (emitting as little greenhouse gas as possible, and offsetting any emissions that cannot be avoided).

    According to the International Energy Agency, investment into new fossil fuels infrastructure must stop immediately if the world wants any chance of achieving net zero by 2050. The latest climate science shows that achieving net zero by mid-century is necessary to keep temperatures from rising well above 1.5 degrees Celsius, compared with pre-industrial times. Beyond that threshold, the world will face climate crisis impacts that could take millennia to correct, or could be irreversible altogether.

    Climate activists have protested against the project, while West Cumbria Mining, which is developing the mine, said the project would bring hundreds of new jobs into a struggling region. Its opponents argue these jobs may not be secure, given the huge momentum in Europe to phase out coal.

    “Opening a coal mine in Cumbria is investing in 1850s technology and does not look forward to the 2030s low carbon local energy future,” Stuart Haszeldine, a professor at the School of GeoSciences at the University of Edinburgh, said in a statement.

    The Environmental Protection Agency proposed a plan to remake the way car-obsessed Americans live, using public safety rules to accelerate the shift from internal combustion to electric vehicles.

    Just a fraction of the current auto market is EVs, but under standards announced by the EPA Wednesday, up to two-thirds of new vehicles sold in the US would be zero-emission or plug-in hybrid within a decade.

    The rules, which are not yet final, would use authority under the Clean Air Act to force auto companies to cut pollution and slash vehicle emissions by more than half. They would phase in with model year 2027 vehicles and be fully implemented by 2032. Read CNN’s full report.

    While ambitious, the goals are not unprecedented. They put the federal government on track to catch up with state governments, led by California, that want to stop allowing the sale of internal combustion vehicles by 2035.     There is a very big legal question mark looming behind California’s action and the EPA’s effort, which still has a public comment and revision period.

    The current Supreme Court, dominated by conservative justices, has already shown its scorn for EPA rulemaking and its indifference to addressing climate change. Last year, the court nixed the Biden administration’s plan to curb emissions from existing power plants.

    I asked CNN climate reporter Ella Nilsen for her takeaways from the EPA announcement. She offered these key points:

    The standards are ambitious, but doable

    If enacted, the newly proposed EPA emissions standards would be one of the Biden administration’s most aggressive climate-change policies yet – moving the US auto market decisively toward electric vehicles in the next decade.

    However, multiple experts said the standards are doable, and even lag slightly behind the California standards, which will completely phase out the sale of gas-powered cars by 2035 to usher in electric vehicles. The US is also following countries including the EU and China, which are moving more aggressively toward electric vehicles.

    ► Charging infrastructure and consumer incentives could be tricky

    This new proposed rule won’t happen overnight; it would be gradually phased in over the next decade. At the same time, the US needs to build up a network of electric charging stations in addition to the ubiquitous gas station. Federal officials have also talked about needing to incentivize more Americans to buy EVs by bringing the cost down, with federal tax credits.

    However, the new $7,500 tax credits (passed last year by Democrats in the Inflation Reduction Act) are incredibly complex due to manufacturing requirements. The credits could actually shrink the eligible number of cars that qualify (however, leased vehicles have more leeway under the new system). Regardless, it will take years for the EV infrastructure, incentives and supply to fall into place to make electric vehicles available to most Americans.

    This is a big deal for US climate policy

    This rule will impact the US economy, but it’s also major climate policy. The proposed EPA tailpipe standards would cut planet-warming pollution from US cars in half. Combined with the agency’s medium and heavy-duty vehicles standard, the proposals could cut nearly 10 billion tons of CO2 emissions by 2055.

    Given Americans’ reliance on cars, transportation is a big part of overall US emissions – it accounts for nearly 30% of all greenhouse gas emissions in the US, according to the EPA. Cutting down on tailpipe pollution from gas-powered cars and trucks is a big part of decarbonizing the US.

    While the federal government and key states are all in on moving toward EVs, and auto companies are spending big to get competitive in the market, Americans generally are not yet completely embracing the idea.

    Just 4% of Americans currently own an EV, and a scant 12% are seriously considering buying one, according to a Gallup poll released Wednesday. Less than half, 43%, say they would consider buying an EV in the future, and a sizable 41% are completely closed off to the idea.

    The expected partisan breakdown applies to those figures. Most of the interest in EVs is among Democrats. Most of the staunch opposition is among Republicans. Younger Americans and those making $100,000 and above are also more interested in buying an EV in the future.

    There are also key regional disparities. In the West, where states are already working to phase in EVs, only 28% say they would not buy an EV. Compare that to half of Southerners who would not consider buying an EV.

    A majority of the country is skeptical that EVs will even have an effect on the climate, according to the poll, with 61% saying EVs will help address climate change only a little or not at all.

    In a separate AP-NORC poll released this week, the most-cited major reasons for not wanting to purchase an EV – out of eight offered in the poll – were expense (60% said they cost too much) and convenience (50% said there aren’t enough charging stations available).

    Access and affordability should be addressed as inventory increases, writes CNN’s Peter Valdes-Dapena, who covers the auto industry. A decade from now, charging should be quicker and easier, EV ranges should be longer and prices should be at or below the cost of an internal combustion vehicle. Read his full report.

    Rather than fighting the rules, as the fossil fuel industry is sure to do, the auto industry is already investing heavily in EVs, responding to tougher regulation already imposed around the world and by California, which moved to ban the sale of new gas and diesel powered vehicles by 2035.

    California actually took the lead on pushing for EVs in the years when the Trump administration was dialing back on federal climate policy. Other states, like Oregon, Washington and Minnesota, have tied their standards to California’s.

    Valdes-Dapena notes that car companies with loyal customer bases are slowly making the switch. He writes:

    Currently, Toyota offers only one electric model in the United States, the BZ4X SUV, but more are planned. Honda, another Japanese brand with a loyal following, offers no EVs currently but the company is gearing up factories in Ohio to build future EV models. Honda expects to offer its first EV next year. General Motors also has a number of EV models coming in the next year or two.

    He also notes that GM has pledged to sell only electric passenger vehicles by 2035.

    And no, this does not mean internal combustion vehicles will be banned. They will still make up the vast majority of vehicles on the road in a decade even if this rule is finalized and withstands challenges in court. But it would represent a tectonic shift.

    West Virginia political observers were not surprised when Sen. Joe Manchin appeared on Fox News on Monday to make a stunning threat: He could be persuaded to vote to repeal his own bill, the Inflation Reduction Act, if the Biden administration pushed him far enough.

    The conservative Democratic senator reiterated this to CNN, saying he would “look for every opportunity to repeal my own bill” if the administration continued to use the IRA to steer the US quickly towards the clean energy transition and away from fossil fuels.

    The IRA, passed and signed into law last year, was a sweeping $750 billion bill that lowered prescription drug costs, raised taxes on large corporations, and invested $370 billion into new tax credits for cleaner energy. Even though Manchin carved out space for fossil fuels, the bill represents by far the biggest climate investment in US history.

    From the start, Manchin has insisted the IRA was an “energy security bill,” rather than a clean-energy bill. Still, experts said he must be sensitive to the idea that he ushered in what ended up being the nation’s largest climate law, given he represents West Virginia – a state where coal and natural gas reign supreme.

    Manchin’s repeal threat “was probably good politics,” West Virginia University political science professor Sam Workman told CNN. If he decides to seek reelection in 2024, the 75-year-old senator will face his toughest political fight yet, as popular West Virginia Republican Gov. Jim Justice jumped into the race this week.

    Justice’s bid for the seat “doesn’t change anything at all,” Manchin told CNN. But political experts from his home state see a man who is gearing up for a fight.

    Since delivering President Joe Biden one of his biggest legislative wins with the IRA last summer, Manchin has spent the last few months on a rampage against the administration, homing in on what he calls its “radical climate agenda.” Manchin has voted against Biden’s nominees for high-ranking administration positions, bashed new rules from the Environmental Protection Agency and Treasury Department and clashed with members of the president’s cabinet at Senate hearings.

    Manchin’s appearance on Fox to slam Biden and threaten to repeal the law he had an outsized role in writing “is a pretty good indicator to me that he’s running,” said John Kilwein, chair of West Virginia University’s political science department.

    Manchin has been silent on whether he’ll run for reelection, but as Justice announced his candidacy, Manchin expressed confidence. “Make no mistake, I will win any race I enter,” he said in a statement.

    The Democrat beat his Republican challenger by just three percentage points in 2018. And though Justice still must get through a primary against Republican Rep. Alex Mooney, the governor is already backed by Senate Republicans’ electoral arm and many in the state think he will present a serious challenge to Manchin.

    “Justice is a likable candidate – he takes that ‘aw shucks’ thing to the next level,” Kilwein said. “This is going to be [Manchin’s] toughest fight, but I think anyone who thinks this is going to be a piece of cake is wrong. I don’t think he’s going to be easy to beat.”

    Manchin is “in danger” politically, his Democratic colleague Sen. Richard Blumenthal of Connecticut told CNN.

    “Joe Manchin is the last remaining statewide elected Democrat [in West Virginia], and we want [him] back in the United States Senate,” Blumenthal said, adding Manchin was a “pillar of strength to Democrats in the last session.”

    Justice made little mention of Manchin during his official campaign launch but came out swinging against Biden and his agenda. On Friday, Justice told Fox News that Manchin “would be a formidable opponent” if he runs for reelection, but added that he’s “done some things that have really alienated an awful lot of West Virginians.”

    There is no denying that West Virginia is incredibly conservative; the state went nearly 40 percentage points for Trump in the 2020 election. But even with those fundamentals, political experts said Manchin has had tremendous staying power through retail politics and argue he can deliver for the state while standing up to Biden.

    “His whole appeal is a retail appeal; every blueberry festival, huckleberry festival, Joe Manchin’s there,” former West Virginia political science professor Patrick Hickey told CNN. “He’s a really smart and talented politician. He gets all the benefits that come from supporting (the IRA), but the next time he’s in West Virginia, he’ll be in a diner telling voters how terrible Biden is.”

    Behind the political rhetoric, the Inflation Reduction Act’s energy provisions could be a windfall for West Virginia, and Manchin is walking a tightrope in his messaging around the law.

    Despite blasting the Biden administration, Manchin has spent the past few months at home touting the benefits of the IRA and jobs it is already bringing to the state.

    Several major clean energy companies have invested hundreds of millions of dollars to build new manufacturing plants in the state: a battery factory, a new industrial facility totally powered by renewable energy, and a plant to make electric school buses.

    “The way Manchin talked about those, he’s crediting the IRA and saying, ‘see, these are the good things that have happened,’” said Angie Rosser, executive director of environmental group West Virginia Rivers. “Those are hundreds of jobs reaching into the thousands, which for our small state is a big, big deal.”

    Rosser and others pointed out that Manchin designed the IRA specifically to deliver money to West Virginia, designing tax credits to incentivize more manufacturing in coal country and funding to help these communities during the transition to clean energy.

    Morgan King, a staff member of West Virginia Rivers, has been traveling across the state recently to talk to local officials about how they can apply for federal IRA funding. The response has been overwhelmingly positive, King told CNN.

    “We’ve spoken with people of all parties,” she said. “People don’t care [about] the politics of how this bill was created so long as this funding can make it into their communities. West Virginia is set to disproportionately benefit from this bill more than any other state.”

    Manchin has been at odds with the Biden administration on several fronts, but the administration’s climate policies and implementation of the Inflation Reduction Act seem to have struck a particular nerve – and Republicans have continued to heavily criticize the law.

    A political ad from Republican dark money group One Nation is already circulating in the state, claiming that the IRA would kill 100,000 jobs in West Virginia.

    “The notion that this is just a climate bill … it is damaging here in the state because we’re pretty far to the right on these issues, especially energy issues,” Workman said. “When you sell something as a climate bill, given the economic context here and our history, it’s somewhat harder for people to see indirect benefits like jobs.”

    Manchin recently voted alongside Republicans on Congressional Review Act bills to undo EPA emissions rules for heavy-duty trucks as well as a climate-focused Labor Department rule (Biden has already vetoed one and promised to veto the other). In March, Manchin tanked top Interior Department nominee Laura Daniel-Davis, claiming she wasn’t upholding a part of the IRA that mandates offshore oil drilling in certain federal waters.

    The dynamic has put Senate Democrats in a tough spot. Democrats have a slightly expanded Senate majority after the midterms, but the continued absence of California Sen. Dianne Feinstein, who has been away from Washington as she recovers from shingles, has made for nailbiter votes.

    “He’s one of the most independent US senators out there,” Democratic Sen. Brian Schatz of Hawaii told CNN. “When he is frustrated, he’s not going to be shy about it. And right now, he’s obviously extremely frustrated with the administration, and that has to get sorted.”

    Manchin has also spent the last few months lobbing a steady stream of blistering statements aimed at Biden’s agencies. When the Environmental Protection Agency proposed strong new vehicle emissions regulations intended to push the US auto market towards electric vehicles in the next decade, Manchin said the agency was “lying to Americans” and called the regulations “radical” and “dangerous.”

    And when the Treasury Department issued guidance on IRA’s new EV tax credits – which were written by Manchin – the senator called it “horrific” and said it “completely ignores the intent” of his law.

    Some of his Democratic colleagues have panned his comments about repealing the IRA.

    “Maybe he should run for president,” Democratic Sen. Martin Heinrich of New Mexico told CNN. “He’s got one job; the president’s got another. The IRA is working.”

    The US Environmental Protection Agency is preparing to release strict new proposed federal emissions standards for light-duty vehicles that, if implemented, would move the US car market decisively toward electric vehicles over the next decade.

    The EPA is considering emissions standards that could make up to two-thirds of new passenger vehicles sold in the US electric by 2032, according to a source familiar with the proposal.

    If implemented, the new greenhouse gas performance standards would start for light-duty vehicles that are model year 2027 and gradually increase through model year 2032.

    By 2032, the rules would ensure that 64% to 67% of all new-car sales in the US would be electric vehicles, according to the source.

    The EPA’s proposal, which was first reported by The New York Times, comes after California air regulators voted last year to ban the sale of new gasoline-powered cars by 2035 and set interim targets to phase these cars out.

    EPA spokesperson Tim Carroll did not comment on the specifics of the proposal but said the agency is working on developing new standards “to accelerate the transition to a zero-emissions transportation future, protecting people and the planet,” as directed by a previous executive order from President Joe Biden.

    “Once the interagency review process is completed, the proposals will be signed, published in the Federal Register, and made available for public review and comment,” Carroll said.

    The new rules could come as soon as Wednesday.

    The EPA proposal is a monumental step toward zero-emissions vehicles, coming as the US tries to keep up with other countries racing toward EV adoption, one expert told CNN.

    “I believe it’s pretty doable,” said Margo Oge, chair of the International Council on Clean Transportation and a former Obama EPA official. “The industry is there. Europe is ahead of the US, China is ahead of Europe, and these companies are global companies.”

    Oge noted that in the US, California is already proposing 70% new zero-emissions vehicle sales by 2030 and other states are planning to adopt California’s rules – meaning much of the US car industry will be transitioning ahead of any proposed federal rule.

    Still, the EPA’s proposal takes a different approach from California’s policy. Whereas California is mandating car companies sell a certain percentage of electric vehicles, the EPA would gradually raise greenhouse gas emissions standards to increasingly stringent levels from 2027 to 2032, pushing the industry toward electric vehicles to meet those high standards.

    The EPA rule would ensure that the rest of the country and the US car industry would follow California’s lead, Oge said.

    Biden has made electrifying the cars that Americans drive a key part of his climate goals. In 2021, the president set a new target that half of all vehicles sold in the US by 2030 would be battery electric, fuel-cell electric or plug-in hybrid.

    The US Treasury Department is set to release rules for new federal electric vehicle tax credits on April 18. While these tax credits are complex and could take time for consumers to take full advantage of, experts hope they will help accelerate the transition to EVs in the US.

    “Given the industry, the [Inflation Reduction Act] and what companies are doing globally, I just don’t see this number as being out of reach,” Oge said.

    The proposed EPA rules will go through a lengthy public comment process and could be changed before they are finalized.
