    PlayStation boss Jim Ryan is stepping down from the company, Sony announced Wednesday.

    The Sony Interactive Entertainment President and CEO will be retiring in March 2024 after 30 years in the PlayStation business.

    Sony Group Corporation president, COO and CFO Hiroki Totoki will assume the role of SIE chairman next month to “support” the transition, and will take over as interim CEO once Ryan retires.

    Ryan joined SIE in 1994 and was appointed CEO in 2019. He had previously held senior positions at the company including president of SIE Europe, head of global sales and marketing at SIE and deputy president of SIE.

    Ryan led the launch of the PlayStation 5, which the company said is PlayStation’s most successful platform.

    “I’ve found it increasingly difficult to reconcile living in Europe and working in North America,” Ryan said in a statement. “I will leave having been privileged to work on products that have touched millions of lives across the world.”

    The Atari home video game system took the late1970s and early 1980s by storm, complete with faux wood paneling and a classic joystick with a big red button. Rival systems eventually surpassed the video-game pioneer but its iconic status, and fans, remained.

    Atari has been working to rebuild a lot of goodwill among those fans and within the broader video game industry ever since its new CEO Wade Rosen came on board in 2021.

    With Rosen at the helm, the company is taking a closer look at its own history to chart its future, releasing remastered or reimagined versions of its classics like “Missile Commandand “Centipede,” producing the critically acclaimed “Atari 50” interactive documentary, and introducing its soon-to-be released retro console the Atari 2600+.

    “I think the 2600+ has legs because there’ll be new content, new games coming out but also additional ways to play these games and to make them accessible to larger communities,” Rosen told CNN. “Do I think these things are going to replace modern consoles? Absolutely not. There’s like no way that would happen, nor would they need to. They’re radically different things.”

    The retro console arrives in November at a $130 price point and in a more compact version. While it comes packaged with 10 games in a single cartridge, the console will also play new titles and work with original Atari 2600 and 7800 game cartridges.

    Atari is reimagining the classic

    According to Rosen, retro games complement the times and reimagined Atari titles like “Haunted House,” arriving in October, or new, original games like “Days of Doom,” available now, reflect a speedy, pick-up-and-play style characteristic of the early days of the hobby.

    For instance, the remastered “Haunted House” is an elaborate stealth game where players evade colorful ghosts and monsters – but it retains the exploration mechanics of its namesake that simply featured floating eyes roaming a dark, 2D maze.

    What people want in video games has changed radically, Rosen noted, explaining that these experiences “are designed for an age of complexity,” he said. “Back when we had simplicity, I wanted 200-hour games with huge quests and branching narratives and all these things, and now I’m like: ‘I can do a couple of those a year, but life doesn’t allow for it very much.’ “

    The company’s Atari Recharged line also takes classics like “Yar’s Revenge” and spruces them up for a modern audience. And its acquisition of Nightdive Studios earlier this year added new franchises to Atari’s stable of remasters like “Turok” and the upcoming “System Shock.”

    The recent “Atari 50” release actually did something different while mining nostalgia — it established the genre of the interactive video game documentary. The company looked at decades of its history, and invited viewers of the doc to become players.

    “As we come to view games as art, more and more, I think people want to understand all the pieces that went into that and all the history around it, but yet the medium is games so we probably should interact with it in a different way,” Rosen noted.

    While not in the company’s plans as yet, the Atari CEO also showed enthusiasm for a hypothetical handheld system that can play its retro games on the go like a Nintendo Switch.

    “I guess short answer, yeah, if there’d be an appetite for it. I’d worry the cartridges would be a little too big. That would be really fun,” he said.

    As the successor to Atari’s home console crown, Nintendo, pushes forward with its Switch system, and newer players like Microsoft’s Xbox and Sony’s PlayStation 5 traffic in blockbuster, Triple-A games this holiday season, the Atari 2600+ retro console (but not a handheld yet) will join the scrum. It’s set to launch November 17.

    Grant Stoner said that he has loved playing video games his entire life, and that his earliest memory is of playing Super Nintendo in his parents’ bedroom at roughly 3 years old.

    “Gaming, for me, has always been a social activity,” Stoner, a Pittsburgh native who has spinal muscular atrophy type 2, a neuromuscular disorder, told CNN. “Because I’ve never really, physically, been able to participate in schoolyard events or sporting events or what have you, so I would bond with family and classmates through gaming.”

    For people with disabilities, Stoner said gaming has served as a lifeline for forming friendships and community. But for years, he adds, the technology underpinning the gaming sector has been notoriously not inclusive.

    “Disabled people would have to be very innovative, and either design or create their own adaptive setups with like, different maybe 3D-printed objects or in my case, a Popsicle stick,” Stoner told CNN. He said his brother used to attach a Popsicle stick to the trigger of one of his gaming controllers to find a way for Stoner to keep playing even when he lost strength in his fingers.

    Stoner’s struggles are all too familiar for Paul Amadeus Lane, who told CNN he learned how to play games using his chin, lips and cheeks to push buttons on a controller after an accident left him quadriplegic and without finger mobility some 30 years ago.

    Lane also recalls how his social circle changed after his accident, and isolation crept in after he could no longer do things like play basketball or go for a drive.

    “Gaming can help with those social barriers out there, especially with social isolation,” Lane told CNN. “And put us in an environment where we can have some enjoyment without being judged because of our disability.”

    Lane said he remembers getting a call back in 2021 to help advise Sony with a “secret project,” and was overjoyed to find out the tech giant’s gaming arm was quietly working on creating a controller specifically for people with disabilities. Sony Interactive Entertainment is the maker of the wildly popular PlayStation consoles and a lineup of fan-favorite PlayStation games. Microsoft’s Xbox gaming unit released an Adaptive Controller for Xbox back in 2018 to much celebration from the disability community, but people with disabilities still found wide gaps trying to play games on PlayStation or Nintendo consoles.

    “I was really, really happy, because I didn’t think Sony would ever tackle something like this,” Lane told CNN.

    After years of tinkering and consulting with gamers who have disabilities like Lane, Sony Interactive Entertainment unveiled a first look at its Access controller for gamers with disabilities earlier this month. The Access controller is now available for pre-order and will be released on December 6, with a price tag of $89.99.

    The controller can be endlessly customized to meet the diverse needs of players with disabilities and Sony has the goal of helping these gamers play more comfortably for longer. The circular device can be configured with swappable button and stick caps to suit a range of mobility needs.

    In a Q&A posted on Sony’s PlayStation company blog, Alvin Daniel, the senior technical program manager for the Access controller, said the development team quickly learned that “no two people experience disability in exactly the same way.”

    Daniel said his team tapped the help of players and accessibility experts to build a controller that could be as inclusive as possible. With the help of players and accessibility experts, Daniel wrote, “we did a really deep dive to try to understand what it was we wanted to help solve. And this came down to a very interesting insight: instead of looking at conditions, or impediments, instead, look at the controller.”

    “Look at the standard controller as it exists today. And ask yourself the question, ‘What prevents someone from effectively interacting with a standard controller?’” he added.

    The result is a Sony-designed device that gamers can tailor to meet their individual needs, that gamers don’t have to hold in order to use and features buttons that are much easier to press. Lane, who is among the group of gamers who has been able to try out the unreleased controller, said he was especially excited for how it gave him the ability to play racing games again for the first time since his accident.

    “I wasn’t able to play racing games because of just the dexterity that you needed with your hands and just how fast things are moving,” Lane said. “And then when I was able to try out Gran Turismo, I was like, I can game and play racing games again!”

    “I haven’t driven in over 30 years,” he added. “It takes me back to when I was driving.”

    Stoner said he’s excited about the PlayStation Access controller, and especially encouraged that the price point is relatively low compared to other options on the market. And while he’s been heartened to see an industry-wide push toward inclusive innovation in gaming, he emphasized that there is still work to do.

    “The industry needs to understand that the Xbox controller, the PlayStation controller, while they’re great and while they’re very beneficial, they cannot help everyone,” he said. “This is not a perfect solution.”

    “We need to keep innovating around games – the software aspect and the hardware aspect – because nothing that we have currently is fully accessible to every disabled person,” he added. “I don’t know if it’ll ever happen, just because of how individualistic the disabled experience is, but currently, there’s always more work to be done and the industry needs to remember that.”

    Microsoft announced it has agreed to partnerships with Nvidia and Nintendo as it tries to convince European Union officials to approve its $69 billion purchase of Activision Blizzard — the company behind the popular game franchise Call of Duty.

    Microsoft President Brad Smith had a closed-door meeting Tuesday with EU regulators and competitors in Brussels to address concerns that its acquisition of Activision Blizzard could hurt competition in the video game industry. The deal has also come under scrutiny from regulators in the United States and the United Kingdom.

    said that it has entered into a 10-year partnership with Nvidia to bring Xbox PC games to Nvidia’s cloud gaming service. In a statement, the software giant said the partnership “resolves Nvidia’s concerns with Activision Blizzard. Nvidia therefore is offering its full support for regulatory approval of the acquisition.”

    Microsoft also revealed it has finalized a 10-year agreement to bring the latest version of “Call of Duty” to the Nintendo platform once the merger with Activision is completed.

    Smith told CNN’s Richard Quest on Tuesday that “a lot changed today because Microsoft has announced two agreements that together will bring Call of Duty, the game that everyone has been talking about, to 150 million more people on Nintendo devices and Nvidia’s cloud streaming services.” He went on to say these two deals address the concern that Call of Duty will be less available than it is today and will be more available instead due to these two binding agreements.

    “We’re really down to one principal company that is objecting to this deal, and that’s Sony, and we’ve made clear that we’re happy to enter a 10-year agreement with Sony and we’re prepared to enter regulatory obligations as well, whether it’s London or Brussels or Washington,” Smith said. “So, in addition to a contract, we’d have a duty under the law.”

    James Bond fans may be waiting on the next actor who will play the British spy onscreen, but a beloved Bond adventure of yore is making its return.

    “GoldenEye 007,” a classic first-person shooter made for Nintendo 64 in 1997, is being revived for Nintendo Switch and Xbox more than 25 years later. For fans who subscribe to additional content on both gaming systems, the game will be available on Friday.

    Based on the 1995 film “GoldenEye,” the game follows a block-like version of Pierce Brosnan’s 007 as he shoots his way through various locales, all while a synthy version of the signature Bond theme plays. The Xbox version has been “faithfully recreated and enhanced,” said one ad for the re-release, while the Switch game features an online multiplayer mode.

    “GoldenEye 007” was a hit upon its release: IGN gave it a 9.7/10 in 1997, praising its graphics as “superb.” Contemporary players used to the lifelike visuals of popular games like “The Last of Us” and “Red Dead Redemption” may beg to differ, but the game still holds a nostalgic appeal for fans who spent their youths lasering their way through surfaces using Bond’s watch. Not to mention, its soundtrack remains iconic.

    To access the game, Switch users will have to subscribe to its Online membership plus its expansion pack, which includes some Nintendo 64 games and downloadable content for popular games like “Mario Kart 8 Deluxe” and “Animal Crossing: New Horizons.” Xbox players must subscribe to Xbox Game Pass, a service that allows players to access hundreds of games from its server.

    The return of “GoldenEye 007,” often referred to as one of the greatest video games of all time, has been years in the making. The Verge reported last year that rights issues blocked developers from releasing it on newer consoles, including Xbox, since at least 2008. Undeterred N64 fans even attempted to remake the game themselves on several occasions, though the original rights holders usually shut them down. Now, Rare, the game’s original developer, has recreated it for Xbox with “a few modern touches,” while Nintendo is re-releasing the original on its Switch console.

    Fans of the popular first-person shooter game “Call of Duty” may soon have more options for where they can play it.

    Microsoft said late Tuesday it has reached a 10-year deal to bring the 19-year-old game franchise to Nintendo after its acquisition of Activision Blizzard, which makes the game, is completed. The deal is pending regulatory approval.

    The news came one day after Microsoft president Brad Smith wrote in a Wall Street Journal opinion piece that the Redmond, Washington-based company offered a 10-year contract for “Call of Duty” to work with Sony’s PlayStation console. (Microsoft reportedly made another offer earlier this year). Sony did not immediately respond to a request for comment.

    The Nintendo deal is the latest attempt by Microsoft to ease concerns that its blockbuster acquisition of the gaming giant could harm competition in the industry.

    Microsoft announced plans to acquire Activision Blizzard in January in a deal valued at nearly $70 billion, which would be one of the biggest ever in the tech industry. The move could boost Microsoft’s standing in the gaming industry, as its Xbox console trails behind Sony’s PlayStation and the Nintendo Switch.

    Microsoft head of gaming Phil Spencer announced the commitment with Nintendo in a tweet and said it will continue to offer “Call of Duty” on gaming platform Steam if the deal is completed. “Microsoft is committed to helping bring more games to more people – however they choose to play,” he said.

    The company’s decision to bring “Call of Duty” to Nintendo comes as Microsoft’s Activision deal faces regulatory scrutiny on both sides of the Atlantic. The US Federal Trade Commission reportedly plans to sue Microsoft to block the Activision acquisition.

    But Smith this week defended the strategy, saying a block of the deal would be “a huge mistake.”

    “It would hurt competition, consumers and thousands of game developers,” he wrote in the Wall Street Journal.

    He argued that Microsoft faces “huge challenges” in the gaming industry, and the potential acquisition of Activision Blizzard could allow Microsoft to compete against these companies “through innovation that would benefit consumers.”

    Microsoft also wants to offer the option for customers to subscribe to a cloud gaming service that lets them stream a variety of games on multiple devices for a “reasonable” fee, Smith said. The company is open to providing the same commitment to other platforms, which would be legally enforceable by regulators in the United States, the United Kingdom and the European Union.

    According to Eric Abbruzzese, an analyst at ABI Research, the effort to open up access to its games shows Microsoft is “scrambling” to overcome regulatory hurdles.

    “If the offer helps the deal finalize, then that is a huge win that flies under the radar with ‘Call of Duty’ in the headlines,” he said. “But offering a single entity for a limited time would not be enough to circumvent regulation, as it is temporary and narrow in scope.”

    “Call of Duty” is arguably the most popular game title today, so the impact to consumers is notable. As of 2020, the game had topped 250 million downloads worldwide, according to data from SensorTower, an analytics firm that tracks app downloads.

    “Nintendo is not a high priority for ‘Call of Duty,’ all things considered – it has done perfectly fine without being on Nintendo recently,” Abbruzzese added. “Keeping it on Steam for the PC market is significant though, and obviously if this offer convinces Sony to accept as well, that’s gigantic.”

    The European Union is taking a closer look at Microsoft’s proposed $68.7 billion purchase of video game giant Activision Blizzard, citing concerns the deal could hurt competition in the video game industry.

    A preliminary review of the deal found that Microsoft

    become the world’s third-largest video game publisher, controlling popular franchises such as “Call of Duty” and “World of Warcraft.”

    “Such foreclosure strategies could reduce competition in the markets for the distribution of console and PC video games, leading to higher prices, lower quality and less innovation for console game distributors, which may in turn be passed on to consumers,” the EU said.

    The deeper-level probe, which could run through March of next year, is also driven by fears the acquisition could consolidate power in Microsoft’s Windows operating system at the expense of competition, if Microsoft attempts to make its PC games exclusive to Windows.

    And, according to an EU press release, authorities are concerned the deal may allow Microsoft to concentrate power in its own cloud gaming service and prevent rival cloud services from gaining access to Activision

    In September, the United Kingdom announced it had opened a second-stage investigation into the proposed deal.

    “We’re continuing to work with the European Commission on next steps and to address any valid marketplace concerns,” a Microsoft spokesperson told CNN in a statement. “Sony, as the industry leader, says it is worried about Call of Duty, but we’ve said we are committed to making the same game available on the same day on both Xbox and PlayStation. We want people to have more access to games, not less.”

    Even by Facebook’s standards, 2021 was a rough year.

    A series of damning reports based on leaks from a whistleblower raised uncomfortable questions about Facebook’s impact on society; the company continued reeling from concerns about the use of its platform to organize the January 6 Capitol riot; and privacy changes from Apple threatened its core advertising business. Meanwhile, young users were flocking to TikTok.

    At a virtual reality event on October 28, 2021, CEO Mark Zuckerberg tried to turn the page. Zuckerberg announced that Facebook would change its name to Meta and go all in on building a future version of the internet called the “metaverse,” proving to all in the process that the company he launched in 2004 was more than just a social media business.

    One year and billions of dollars later, the so-called metaverse still feels years away, if it ever manifests at all. And the company formerly known as Facebook remains very much a social media business — one that is facing more financial pressure than when it announced the change.

    Meta’s Quest 2 consumer virtual-reality headset, released two years ago, is popular in its category but remains a niche product overall. Its newest headset, the much pricier $1,500 Quest Pro, is intended for enterprise customers and likely won’t move the needle with everyday consumers. And Meta’s flagship social VR app Horizon Worlds can feel like a ghost town (albeit a ghost town with laser tag).

    While some brands have since made measured bets on the metaverse, including by hiring “chief metaverse officers,” it’s not clear whether consumers actually want to work or play in it, or even know what the hard-to-define term means. The metaverse refers, generally, to a sort of virtual world that people can walk around in, as well as the idea of making the internet more ubiquitous and interconnected.

    Meanwhile, Meta’s core business is contracting as it confronts growing competition from TikTok and an advertising industry in retreat amid looming recession fears. The company this week reported its second-ever quarterly drop in revenue and saw profit cut in half from the prior year. It’s selling more ads but making less money on them, and user growth on its social media platforms is slowing. After hitting a $1 trillion market cap for the first time last summer, it’s now worth about a quarter of that, or less than Home Depot.

    “The business is not growing in 2022,” said Gil Luria, technology strategist at D.A. Davidson. “There is expectation that it will grow going forward, but that expectation may prove to be optimistic.”

    A bet that looked bold a year ago now looks borderline unhinged. Meta lost $9.4 billion in the first nine months of 2022 on its metaverse efforts and expects losses from the unit to “grow significantly year-over-year” in 2023. This has prompted even some of Meta’s supporters to urge it to rethink its strategy shift, and possibly slow it down. (It also prompted a tearful Jim Cramer, host of “Mad Money,” to apologize to viewers for trusting Meta’s management team and recommending that investors buy the stock.)

    “People are confused by what the metaverse even means. If the company were investing $1-2B per year into this project, then that confusion might not even be a problem. You would simply do R&D quietly and investors would focus on the core business,” Brad Gerstner, CEO of Altimeter Capital, a shareholder in Meta, wrote in an open letter to Zuckerberg this week. He urged Meta to “cap its metaverse investments to no more than $5B per year with more discrete targets and measures of success.”

    The current pace of spending, he added, “is super-sized and terrifying, even by Silicon Valley standards.”

    Meta did not respond to requests for comment on this story.

    Though the name change was just announced a year ago, the shift from Facebook to Meta has been years in the making. Zuckerberg has said in the past that it’s a long-term bet for the company — not an overnight transformation. It began with Facebook’s 2014 purchase of Oculus VR, and in the years since, the company has rolled out a series of headsets that are increasingly capable, affordable and portable.

    Meta’s latest headset, the Quest Pro, is its first effort at combining the immersiveness of VR with the real world. It can display text and fine details in VR, track your eyes and facial features to give you a sense of connection with other people in virtual spaces, and show you a view of the world around you in color while letting you interact with digital objects — all nods toward Meta’s goal of attracting more business users.

    It’s a far cry from the Oculus Rift headset available in 2016: That cost $599, but users also had to connect it to a powerful PC and use it with a sensor camera on a stand that tracked the headset. At first, that headset didn’t even come with tracked hand controllers; it initially shipped to customers with an Xbox controller and a small handheld remote.

    Although the headsets have improved dramatically, VR and AR are still nascent technologies searching for purpose and popularity. The VR headset market is still tiny compared to, say, an established gadget market like console video games. ABI Research expects 11.1 million VR headsets will ship out this year, about 70% of which it predicts will be Quest 2 headsets. That’s a drop from its estimate of 14.5 million headsets in 2021, of which Quest 2 headsets made up 85% of the total.

    There’s potential for these products, some technology experts say, including in the workplace, but in the near term its adoption by everyday users remains uncertain at best.

    “I’m not sure this is going to translate to end-user consumers any time soon,” said David Lindlbauer, an assistant professor at Carnegie Mellon University who leads the school’s Augmented Perception Lab. (Meta is sponsoring Lindlbauer’s research into developing advanced user interfaces for AR and VR.)

    For Zuckerberg, and Meta, that creates a unique challenge.

    Zuckerberg successfully pivoted Facebook’s operations once before from desktop to mobile devices shortly after taking the company public, a move that helped supercharge its advertising business and ensure its dominance for much of the next decade. But smartphones were already ubiquitous at that time; if anything Facebook was a bit late.

    Now, the company is trying to spearhead a new technology and hoping consumers will follow its lead.

    Meta has positioned the shift as a sort of existential imperative for the company. After Apple’s app tracking changes hurt Meta’s ability to target ads to its users, the company doesn’t want to rely on any outside hardware or app store in the future.

    But there’s a big difference between looking at a computer or smartphone display and wearing a headset. While Lindlbauer can imagine using a headset for perhaps an hour a day, alternating between immersive views in VR and digital imagery that mixes with the physical world, “I think we haven’t hit the sweet spot yet of something I want to wear all day,” he said.

    Meta is also facing an enormous challenge when it comes to showing off VR content that users like the looks of and want to use repeatedly. According to a recent report in The Wall Street Journal, internal documents show Horizon Worlds has fewer than 200,000 active monthly users, a rounding error for a company with 3.7 billion monthly active users across its various services. (A Meta spokesperson told the Journal that it’s “easy to be a cynic about the metaverse” but Meta thinks it is “the future of computing.”)

    “They’re starting with this idea that they want to build one big space like Horizon Worlds in which everybody’s just going to show up and start building stuff,” said Avi Bar-Zeev, founder of AR and VR consultancy RealityPrime and a former employee at Apple, Amazon and Microsoft, where he worked on the HoloLens VR headset. “There’s no virtual world that was ever successful building a canvas that people would just come and start painting.”

    Zuckerberg has personally received intense criticism for the way Meta envisions work and play interactions in virtual spaces after posting on Facebook an image of his blocky, cartoon-like avatar in Horizon Worlds — an image he later admitted was “pretty basic.”

    “As far as the quick-twitch, give-me-more public is concerned, the progress seen so far is a letdown,” said Janna Anderson, director of the Imagining the Internet Center at Elon University. “Meta is suffering tremendous ridicule in social media and in the overall public zeitgeist.”

    The Quest Pro’s face-tracking capabilities can help make avatars’ facial expressions look more realistic: Initially, users can access this tracking in Horizon Worlds and Horizon Workrooms, Meta said, as well as in several developers’ apps such as Painting VR and DJ app Tribe XR.

    But even with facial tracking, what users see when they pop in to Horizon Worlds — blocky, human-like avatars that exist only from the torso up, floating around a virtual plaza — will for now continue to contrast sharply with the image Zuckerberg portrayed during Meta’s Connect event on October 11 of his own full-body avatar.

    In the meantime, investors appear to be getting fed up with the investments in the metaverse at a time when the future of its core business is also deeply uncertain.

    “I think kind of summing up how investors are feeling right now is that there are just too many experimental bets versus proven bets on the core,” Jeffries analyst Brent Thill said on Meta’s earnings call this week.

    Zuckerberg, for his part, is defending the strategy shift. “I’d say that there’s a difference between something being experimental and not knowing how good it’s going to end up being,” he responded. Separately, he added: “I think people are going to look back decades from now and talk about the importance of the work that was done here.”

    The UK antitrust regulator has blocked Microsoft’s $69 billion purchase of Activision Blizzard, thwarting one of the tech industry’s biggest deals over concerns it will stifle competition in cloud gaming.

    The Competition and Markets Authority said in a statement Wednesday that it was worried the deal would lead to “reduced innovation and less choice for UK gamers over the years to come.”

    “even stronger” in cloud gaming, a market in which it already holds a 60%-70% share globally, the regulator added.

    Activision Blizzard is one of the world’s biggest video game developers, producing games such as “Call of Duty,” “World of Warcraft,” “Diablo” and “Overwatch.” Microsoft, which sells the Xbox gaming console, offers a video game subscription service called Xbox Game Pass, as well as a cloud-based video game streaming service.

    The deal to combine the businesses has been met with growing opposition by antitrust regulators worldwide. In December, the US Federal Trade Commission sued to block the takeover over similar competition concerns. A hearing is scheduled for August. The European Union is also evaluating the transaction

    Microsoft could seek to make Activision’s games exclusive to its own platforms and then increase the cost of a Game Pass subscription, the Competition and Markets Authority said.

    “The cloud allows UK gamers to avoid buying expensive gaming consoles and PCs and gives them much more flexibility and choice as to how they play. Allowing Microsoft to take such a strong position in the cloud gaming market just as it begins to grow rapidly would risk undermining the innovation that is crucial to the development of these opportunities,” it added.

    “The evidence available… indicates that, absent the merger, Activision would start providing games via cloud platforms in the foreseeable future.”

    Both companies plan to appeal the decision. “Alongside Microsoft, we can and will contest this decision, and we’ve already begun the work to appeal to the UK Competition Appeals Tribunal,” Activision Blizzard CEO Bobby Kotick said in a statement.

    Microsoft President Brad Smith added: “This decision appears to reflect a flawed understanding of the market and the way the relevant cloud technology actually works.”

    The Competition and Markets Authority, which launched an in-depth review of the blockbuster deal in September, said Microsoft’s proposed remedies to its concerns had “significant shortcomings.”

    “Their proposals… would have replaced competition with ineffective regulation in a new and dynamic market,” explained Martin Coleman, chair of the independent panel of experts conducting the investigation.

    “Microsoft already enjoys a powerful position and head start over other competitors in cloud gaming, and this deal would strengthen that advantage, giving it the ability to undermine new and innovative competitors,” Coleman continued. “Cloud gaming needs a free, competitive market to drive innovation and choice.”

    The UK cloud gaming market is expected to be worth up to £1 billion ($1.2 billion) by 2026, around 9% of the global market, according to the Competition and Markets Authority.

    Microsoft will pay $20 million to settle US government allegations that the tech giant violated children’s privacy by illegally collecting their personal information through its Xbox Live gaming service.

    According to the Federal Trade Commission, Microsoft broke the law by failing to tell parents about the full breadth of information it gathered from kids under the age of 13.

    That information, the FTC said in a lawsuit filed Monday, included the fact that children may share images of themselves in their account profiles, as well as video and audio recordings of themselves, their real names and logs of their activity on the platform.

    Microsoft also allegedly kept for years the personal information of millions of people, including children, who started creating accounts with Xbox Live but who never completed the sign-up process.

    “Even when a user indicated that they were under 13, they were also asked, until late 2021, to provide additional personal information including a phone number and to agree to Microsoft’s service agreement and advertising policy, which until 2019 included a pre-checked box allowing Microsoft to send promotional messages and to share user data with advertisers,” the FTC said in a release.

    In a statement, Microsoft said: “We recently entered into a settlement with the U.S. Federal Trade Commission (FTC) to update our account creation process and resolve a data retention glitch found in our system. We are committed to complying with the order.”

    Parental settings give adults some control over what their children’s accounts show to other users. For example, Xbox Live’s default settings restrict who children can interact with on the service, the FTC said. But other default settings, the agency alleged, allow kids to access third-party games and apps with minimal friction.

    Microsoft failed to sufficiently disclose to parents what information the company was collecting from kids and how it was being used, the FTC said, alleging violations of the Children’s Online Privacy Protection Act (COPPA).

    In agreeing to settle the claims, Microsoft committed to several additional measures beyond the financial penalty.

    Microsoft agreed to delete any personal information it collects from kids if they don’t complete the account registration process. It also agreed to tell third-party game publishers when a user may be a child, effectively putting the third-party publishers on notice to comply with COPPA in handling the user’s information.

    The settlement comes as the FTC has challenged Microsoft’s $69 billion acquisition of video game giant Activision-Blizzard, a proposed deal that would turn Microsoft into the world’s third-largest game publisher and give it control over popular franchises such as “Call of Duty” and “World of Warcraft.”

    US and UK officials have alleged that Microsoft’s acquisition could give it anti-competitive control over the games industry by being able to withhold titles from rival platforms, particularly in the nascent cloud gaming sector. To address the concerns, Microsoft has struck licensing deals with other companies to ensure their customers continue to have access to Activision games following the deal’s close.

    Those concessions have convinced the European Union to approve the deal, but litigation to block the deal involving US and UK regulators remains ongoing.

    A US judge late on Tuesday granted the Federal Trade Commission’s (FTC) request to temporarily block Microsoft Corp’s acquisition of video game maker Activision Blizzard and set a hearing next week.

    US District Judge Edward Davila scheduled a two-day evidentiary hearing on the FTC’s request for a preliminary injunction for June 22-23 in San Francisco. Without a court order, Microsoft could have closed on the $69 billion deal as early as Friday.

    The FTC, which enforces antitrust law, asked an administrative judge to block the transaction in early December. An evidential hearing in the administrative proceeding is set to begin Aug. 2.

    Based on the late-June hearing, the federal court will decide whether a preliminary injunction — which would last during the administrative review of the case — is necessary. The FTC sought the temporary block on Monday.

    Davila said the temporary restraining order issued on Tuesday “is necessary to maintain the status quo while the complaint is pending (and) preserve this court’s ability to order effective relief in the event it determines a preliminary injunction is warranted and preserve the FTC’s ability to obtain an effective permanent remedy in the event that it prevails in its pending administrative proceeding.”

    must submit legal arguments opposing a preliminary injunction by June 16; the FTC must reply on June 20.

    Activision, which said Monday the FTC decision to seek a federal court order was “a welcome update and one that accelerates the legal process,” declined to comment Tuesday.

    Microsoft said Tuesday “accelerating the legal process in the U.S will ultimately bring more choice and competition to the gaming market. A temporary restraining order makes sense until we can receive a decision from the court, which is moving swiftly.”

    The FTC declined to comment.

    Davila said the bar on closing will remain in place until at least five days after the court rules on the preliminary injunction request.

    The FTC has argued the transaction would give Microsoft’s video game console Xbox exclusive access to Activision games, leaving Nintendo consoles and Sony Group Corp’s PlayStation out in the cold.

    Microsoft’s bid to acquire the “Call of Duty” video game maker was approved by the EU in May, but British competition authorities blocked the takeover in April.

    Microsoft has said the deal would benefit gamers and gaming companies alike, and has offered to sign a legally binding consent decree with the FTC to provide “Call of Duty” games to rivals including Sony for a decade.

    The case reflects the muscular approach to antitrust enforcement taken by the administration of US President Joe Biden.

    The agreement could resolve long-standing complaints by Sony that the merger — which aims to make Microsoft the third-largest video game publisher in the world — threatens competition. Sony didn’t immediately respond to a request for comment.

    “We are pleased to announce that Microsoft and @PlayStation have signed a binding agreement to keep Call of Duty on PlayStation following the acquisition of Activision Blizzard,” said Phil Spencer, Microsoft’s Xbox head, in a tweet. “We look forward to a future where players globally have more choice to play their favorite games.”

    Sony had been among the loudest critics of the acquisition. Addressing the company’s concerns about the continued availability of “Call of Duty,” one of the industry’s most popular franchises, could help Microsoft overcome any remaining opposition to the deal and usher it to a conclusion.

    In response to competition concerns from regulators around the world, Microsoft had already signed multiyear licensing agreements with rival companies including Nintendo and Nvidia, among others, to ensure Microsoft would not be able to restrict Activision titles from users of those businesses’ platforms and consoles.

    On Sunday, Microsoft did not disclose the duration of the agreement with Sony.

    “From Day One of this acquisition, we’ve been committed to addressing the concerns of regulators, platform and game developers, and consumers,” said Microsoft President Brad Smith in a tweet. “Even after we cross the finish line for this deal’s approval, we will remain focused on ensuring that Call of Duty remains available on more platforms and for more consumers than ever before.”

    During a five-day hearing last month in federal court, Microsoft executives including CEO Satya Nadella testified properties such as “Call of Duty” would not be restricted from competitors following the deal’s close.

    Last week, US District Judge Jacqueline Scott Corley wrote in her opinion the US government had “not shown it is likely to succeed on its assertion the combined firm will probably pull Call of Duty from Sony PlayStation, or that its ownership of Activision content will substantially lessen competition in the video game library subscription and cloud gaming markets.”

    Microsoft faces a contractual deadline of July 18 to close the merger with Activision, though the companies could mutually seek to extend that time frame.

    Last week, Microsoft won two successive court victories when a federal district court and a US appeals court declined to temporarily block the merger from being consummated. The Federal Trade Commission had argued a preliminary injunction was necessary to prevent video game consumers from being immediately harmed by the deal, which regulators said would enable Microsoft to withhold “Call of Duty” and other popular titles from competing consoles and cloud gaming services.
