    A man has been charged with driving while intoxicated, assaulting emergency personnel and other crimes following a one-car accident on Auburn Church Road in Garner overnight.

    According to the North Carolina Highway Patrol, Jose Antonio Hernandez Escobar assaulted two firefighters who responded to the scene after he crashed into a ditch on the side of the road.

    He was transported to WakeMed with minor injuries then booked at the Wake County jail, according to state troopers.

    A Raleigh man was arrested Thursday on a felony death by vehicle charge in a Dec. 1 crash.

    A Raleigh man faces multiple charges after he allegedly fatally struck a woman this month while driving impaired.

    Michael Kenneth Bielinski, 71, is charged with felony death by motor vehicle, driving while impaired and failure to maintain lane control in the Dec. 1 crash, court records show.

    After originally being charged with felony injury by vehicle, Bielinski was rearrested Thursday after a grand jury indicted him on a charge of felony death by vehicle.

    The State Highway Patrol responded to Countryview Lane near Yates Mill Pond Road in south Raleigh about 4:30 p.m. that day after a Toyota RAV4 struck a pedestrian, according to a search warrant in the case.

    Bielinski was driving the RAV4 west on Countryview Lane when it ran off the road to the right, striking 76-year-old Ann Patricia Swenson, the warrant states. Swenson was taken to WakeMed Raleigh with a brain bleed and died Dec. 12.

    Troopers investigated Bielinski on the scene after suspecting he was impaired, and he blew a 0.08 — the legal threshold for impairment — on a breath test at the Wake County Detention Center, according to the warrant.

    Bielinski previously pleaded guilty in June 2013 to reckless driving with wanton disregard in an April 25, 2013, incident in Cary, court records show. An open container violation against Bielinski was dismissed, and a sentence was not recorded in the case.

    Bielinski posted $400,000 secured bond. While he is out on bail, he may not consume any alcohol and will undergo continuous alcohol monitoring, court documents show. He is also not permitted to drive until further notice.

    Bielinski’s arraignment, where he’ll enter an initial plea, is set for Jan. 20.

  • Driver in deadly high-speed crash that killed fellow UNC student pleads guilty

    The driver involved in a January 2024 crash that killed University of North Carolina at Chapel Hill student Molly Rotunda has pleaded guilty. 

    WRAL News has reported extensively on the deadly single-car crash on Jan. 21, 2024, and the underage drinking that authorities say led up to it. The investigation into the surrounding incidents resulted in charges against 10 people, including UNC students, UNC football players and two North Carolina Central University students. Most of those were resolved earlier this year.

    WRAL News previously reported that search warrants explained a group of friends had been drinking at a football player’s birthday party at a bar on Franklin Street, and that sources told us, after leaving the bar, two of the friends’ cars were racing back to a Chapel Hill apartment complex.

    Nine of the 10 people charged faced misdemeanor charges only, primarily related to underage drinking or consumption of alcohol.

    The driver of the car in which Rotunda was riding, Flemeeja Brewer, was the only defendant facing felony charges, including involuntary manslaughter. Her case was resolved on Thursday, court records show. 

    Brewer pleaded guilty to felony death by vehicle, driving while impaired and speeding 124 mph in a 45 mph zone. She faced a maximum of 20 years in prison. A judge sentenced her to a minimum of just over 3 years in prison and a maximum of nearly 5 years. 

    Brewer’s driver’s license is permanently revoked and the court recommends she get substance abuse disorder treatment, as well as mental health counseling.

    SUGAR LAND, Texas (AP) — Former NFL running back Adrian Peterson remained jailed on Monday after being arrested a day earlier in a Houston suburb on charges of driving while intoxicated and unlawfully carrying a weapon, according to authorities.

    Peterson was taken into custody Sunday morning by the Sugar Land Police Department, said agency spokeswoman Alicia Alaniz. It’s the second DWI arrest in seven months for the 2012 NFL MVP and three-time league rushing champion.

    Alaniz declined to provide additional information about the circumstances surrounding Peterson’s arrest in Sugar Land, which is located just southwest of Houston.

    Peterson remained in the Fort Bend County Jail on Monday, according to the county’s sheriff’s office. Jail records did not list an attorney for Peterson who could speak on his behalf.

    The 40-year-old Peterson was a high school football star in East Texas and has lived in the Houston area. He played at Oklahoma before spending the first 10 years of his NFL career with Minnesota, which drafted him No. 7 overall in 2007.

    Peterson was arrested on suspicion of drunken driving in Minneapolis in April after appearing at an NFL draft party for Vikings fans.

    Peterson was pulled over for speeding before his arrest in Minnesota.

    Peterson is one of nine running backs to rush for 2,000 yards in a season. He had 2,097 yards for the Vikings in his MVP season of 2012 and finished with 14,918 yards and 120 touchdowns over 15 seasons. He played for six teams during his final five seasons.

    North Carolina Sen. Norman Sanderson was arrested and charged with driving while impaired on Saturday evening, according to Wake County records.

    Sanderson, 74, was also charged with having an open container of alcohol and failing to obey a traffic officer, the arrest warrant shows. He was arrested between Trinity and Edwards Mill Roads just after 9 p.m. His bond was set at $2,000, and he was released after posting bail at 10:42 p.m., court records show.

    “Last night, I made a regrettable mistake, and I take responsibility for my actions,” Sanderson said in a statement provided to The News & Observer from Senate Republican Caucus spokesperson Lauren Horsch. “I want to apologize to my constituents, my colleagues, and my family for letting them down. I commend the State Highway Patrol and the Wake County Sheriff’s Office for their professionalism during the incident.”

    Sanderson has also received citations for unsafe tires, a federal vehicle inspection violation and a “motor vehicle log book” violation in 2010, court records show.

    The Republican lawmaker represents part of eight eastern North Carolina counties, including Carteret, Chowan and Pamlico.

    RIVERHEAD, New York (WABC) — The suspected drunk driver who plowed into a Long Island nail salon, killing four people, is expected to appear in court Thursday.

    Prosecutors say Steven Schwally was the driver seen on surveillance video, whose car sped and flew into a nail salon in Deer Park.

    Schwally, 64, is expected to be in court at 9:30 a.m.

    He was indicted on four counts of second-degree murder among other charges.

    Prosecutors say Schwally’s speech was slurred, eyes were bloodshot and his breath smelled of alcohol at the time of his arrest in June.

    The marine veteran was arrested in 2013 for driving while intoxicated as well.

    Surveillance video captured terrifying the moments Schwally’s Chevy Traverse plowed through the front glass doors of the Hawaii Nail Spa as employees and customers sat inside on a Friday afternoon.

    Police say Schwally sped through a parking lot across the street before crashing his car into the store.

    The horrific scene turned into a growing memorial for the victims, nine people were hurt.

    Four people were killed, the owner of the salon who was known as Ken Chen, two employees, Yan Xu and Meizi Zhang, and 34-year-old off-duty NYPD Officer Emilia Rennack. She was there getting her nails done before a wedding.

    Schwally told police he had 18 beers the night before the crash but that he had stopped drinking at 4 a.m.

    He’s pleaded not guilty.

    GRANVILLE, N.Y. (NEWS10) -Helen Crawford was biking home from her job at Amazon when she was hit by a truck driven by Brian Hyatt of Vermont. The accident put Crawford in a coma and Granville Police charged Hyatt with a DWI.

    It was around 8 at night back on December 16, 2023. Helen Crawford’s family was waiting for her to get home from work when her mom received a message that she didn’t want to believe.

    “I was sitting here on the couch and somebody messaged me, “Your daughter was just hit by a drunk driver. You need to answer your door.” I’m like, no, not even funny,” described Joann Hackett.

    Helen was rushed to the hospital and her family says doctors were not sure if Helen would make it. The surgery she needed had a 1 in 100 chance of survival. But Helen overcame the odds and worked her way out of a coma. She is now beginning to write and talk again.

    “She was still up in Burlington and Harper was sitting next to her coloring. We look over and Helen picks up the colored pencil and just starts coloring. She wrote all of our names. She wrote his name, my name…,” said Joann.

    “One of the things she wrote was save me,” added Helen’s fiancee, Craig House.

    While Crawford goes through therapy, her family is looking to hold the driver who caused this accountable. They told NEWS10’s Anthony Krolikowski that Hyatt was supposed to appear in Granville Village Court.

    “To our knowledge, it’s been postponed twice. He did get charged with a felony DUI and I think there’s a couple of other charges. More charges are to be determined based on the outcome of Helen,” stated Helen’s stepfather, Fred Hackett.

    Helen’s parents and fiance are eager for her to return home one day. They pray for her recovery and that this does not happen to someone else.

    “Please don’t do it. Please. Think twice. Call somebody. Getting behind the wheel after you’ve had some drinks will be the worst decision of your life,” said Joann.

    FARMINGDALE, Long Island (WABC) — A driver has been charged with DWI and assault after a crash on Long Island.

    Police say Lauren Potter, 39, was drunk when she crashed a Mercedes into a parked car on Friday night just after 9:30.

    The impact was so intense, that both vehicles ended up inside a Chinese restaurant.

    It happened while customers were waiting for their food inside Great Wall Kitchen on Boundary Ave.

    One person was taken to the hospital. She is expected to be okay.
