    Venice Canal assault victim files $5-million claim against the city of Los Angeles

    A woman who was attacked and sexually assaulted while out for a walk on the Venice Canals in April has filed a $5-million claim against the city of Los Angeles, charging that the government was derelict in its duty to provide safe streets and protect its citizens.

    Mary Klein, 55, who suffered a savage beating that left her with missing teeth and a blood clot in her brain, was attacked around 10:30 p.m. April 6 as she strolled through the upscale seaside neighborhood. Another woman, Sarah Alden, 53, was also attacked that night and later died.

    Police later arrested Anthony Francisco Jones, 29; he was charged with two counts of forcible rape, murder, attempted murder, mayhem, torture and sodomy by use of force. He pleaded not guilty to the charges.

    The Times does not normally identify victims of sexual assault, but Klein came forward to share her story, saying people should take it as a wake-up call that more social services are needed for people suffering from mental illness and more police protection is needed for everyone.

    “That’s why all this crime is happening — we’re ignoring the extreme mental health crisis going on in our streets,” she said this summer.

    In filing her claim, Klein said she is trying to drive home the point that the government must do more to protect its citizens. The attack on her, she said, has turned her into an activist for public safety.

    Los Angeles City officials could not immediately be reached for comment on the claim.

    Klein filmed herself walking up to Los Angeles City Hall on Friday to submit her claim, speaking into the camera as the government buildings loomed behind her. A claim against the city can be a precursor to a lawsuit.

    “There is a dereliction of duty by the government in Los Angeles, in California,” she says in her video. “A dereliction of duty to protect its citizens from the criminals and also to fund the police correctly.”

    “I have lifelong damages to my jaw, my brain, blood clotting in my brain, due to a transient attacking me on an un-patrolled street in Venice,” she said. The street, she said, “was dark, no lighting, a public street where numerous incidents of violent crime and murder have occurred, and still absolutely no police presence on the street.”

    “That’s not the police’s fault,” she said. “That’s the people who defund the police.”

    In an interview, she said she was appreciative of Los Angeles officials, including Mayor Karen Bass, the City Council and the Los Angeles Police Department. She said she supports Bass’s goal to expand the LAPD by 1,000 officers.

    “This is not about City Hall,” she said. “I see them doing a lot of work to help the community.” But the government as a whole must do more, she said.

He is the band director for students enrolled in music courses, but he is known school-wide for the costumes he wears while directing morning traffic.Over the years, Joiner has dressed up as Harry Potter, Waldo from “Where’s Waldo?,” Gru from “Despicable Me” and more.     Do you see yourself as more of a “trader” or a “hero?” Learn about these two distinct mindsets, and understand how balancing moral duty and economic ambition can lead to a more harmonious and sustainable future for humanity.


    The hero mindset vs. the trader mindset are two distinct ways people see their roles and responsibilities in a healthy society.

    Each one focuses on different values and priorities, but a balance of both is often needed for a society to function and flourish.

    Here’s an outline of what defines each mindset.

    Trader Mindset

    The trader mindset dominates our current culture. It places emphasis on individualism, material gain, and personal freedom. This mentality often asks, “What can life give me?” and is driven by the pursuit of happiness, pleasure, and profit.

    It’s especially characteristic of American life and contemporary Western thinking, where people tend to see their value only in terms of economic or material output: “What do you do for a living? How much money do you make? How big is your house?”

    Key attributes of the trader mindset include:

    • Rights-Oriented: The trader mindset focuses on personal rights and freedoms, operating on the principle of doing what one wants as long as it doesn’t harm others.
    • Materialism: The trader mindset is materialistic and money-driven, placing a high value on comfort, pleasure, and luxury.
    • Individualism: The trader mindset is competitive, individualistic, and often sees life as a series of transactions aimed at maximizing personal advantage rather than collective well-being.
    • Utilitarian Approach: They adopt a business-minded and utilitarian perspective, often focusing on what is pragmatic and realistic, rater than engaging in abstract and idealistic goals.
    • Status Climbing: Traders often strive for increased status, wealth, or power, engaging in frequent social comparison, and viewing most aspects of life as a social ladder to climb.

    The trader mindset is a product of liberal and Enlightenment philosophy, reflecting the values of individual rights and free market capitalism. It promotes a “mind your own business” attitude which emphasizes personal freedom and the pursuit of happiness, but can also lack a sense of social duty.

    In excess, the trader mindset can lead to negative behaviors such as excessive swindling, grifting, corruption, and fraudulent schemes. People become willing to seek material gain at any moral cost, believing that everyone is inherently greedy and selfish, thus creating a “dog eat dog” world.

    Hero Mindset

    The hero mindset is less common and in many ways it’s more needed in our current society.

    The heroic mindset is characterized by a focus on duty, sacrifice, and the greater good. Those with this mentality often ask, “What can I give to life?” rather than “What can life give me?” This approach emphasizes responsibilities over rights and prioritizes the well-being of others over personal gain.

    Key attributes of the hero mindset include:

    • Duties-Oriented: Heroes feel a strong sense of duty and responsibility toward others and society. They ask themselves how they can best serve their family, community, nation, or humanity as a whole.
    • Idealism: The hero mindset seeks higher ideals than just status or wealth, such as honor, loyalty, and devotion to a higher purpose, striving to do what is right at all costs, even if it means facing death.
    • Collectivism: The hero mindset is communitarian-minded, often emerging in contexts like the military, team sports, or tight-knit organizations where serving a greater whole is paramount.
    • Warrior Spirit: Heroes embrace challenges and are willing to sacrifice their comfort and security for the common good, embodying a warrior mindset that values moral and spiritual achievements over material ones. The hero isn’t afraid to ask, “What am I willing to die for?”
    • Leadership and Accountability: Heroes are willing to stand up and take charge when no one else will. This means assuming leadership roles and taking risks, as well as accepting blame and responsibility when things go wrong.

    In essence, the heroic mindset is about fighting for something greater than oneself.

    Heroes can take many different forms. It’s not only about sacrificing yourself on a battlefield or saving a child from a burning house. Being a hero can also mean dedicating your life to a social cause, being a leader in your local community, taking care of your family, or creating more beauty in the world through art or music.

    While the heroic mindset can lead to noble actions, in excess it can also result in zealotry, self-destructive martyrdom, or an inflexible approach to moral issues. Extreme idealism might push individuals to pursue their goals without considering practical consequences, potentially leading to conflict and alienation.

    Balancing the Mindsets

    Ultimately, both the hero and trader mindsets offer valuable insights into different motivations behind our behaviors and life choices. While the heroic mindset emphasizes sacrifice, duty, and the greater good, the trader mindset focuses on personal gain, freedom, and material success.

    A healthy and sustainable society needs both traders and heroes. A society run solely by traders may prioritize profit over moral values, leading to widespread corruption and a lack of social responsibility. On the other hand, a society with only a heroic mindset might struggle with practicality and flexibility, leading to social conflicts and unrest.

    Striking a balance between these mindsets can help us achieve a harmonious approach to personal fulfillment and social responsibility, creating a society that values both individual rights and communal well-being.

    The California Supreme Court is considering whether to grant a hearing for three elephants — Nolwazi, Amahle and Mabu — at the Fresno Chaffee Zoo. If granted, the hearing would determine whether these elephants are being unjustly detained, and whether they should be relocated to a sanctuary.

    Elephants are sensitive, intelligent beings who feel joy and sorrow, have meaningful projects and relationships and often walk many miles per day in the wild. As a result, they tend to suffer in captive environments like zoos. When their freedom is restricted, they have an increased risk of developing joint disorders and damaged tusks. They also are more likely to experience boredom, depression and aggression.

    Accordingly, the Nonhuman Rights Project, which submitted the petition, is urging the court to recognize that Nolwazi, Amahle and Mabu have a right to bodily liberty in a habeas corpus hearing, which can be used to determine whether their detention is lawful. Scholars in a wide range of fields, myself included, are submitting amicus letters to the court in support of the basic idea of elephant rights.

    Why is it necessary to recognize elephant rights? Why not simply rely on existing welfare protections to prevent cruelty? When elephants are seen as lacking rights, we can protect them as “property” or as a matter of public interest. But such protections leave elephants vulnerable when their “owners” and the public are insufficiently concerned about them. By recognizing elephant rights, we can safeguard against abuse and neglect even when welfare protections are inadequate.

    The idea of elephant rights is surprisingly minimal. When we say that elephants have rights, we are not necessarily saying that they have the same rights as us. (Among human beings, for example, infants have different rights than adults.) We also are not saying that they have duties. (Again, infants can have rights without duties.) Our claim is only that elephants can have rights that reflect their own interests and vulnerabilities.

    Additionally, recognizing that elephants have a right to liberty does not necessarily mean releasing them into the wild; elephants, like humans, may not always be able to live independently. Instead, it simply means granting elephants as much freedom as possible for them. In the case of Nolwazi, Amahle and Mabu, that means being released to a sanctuary accredited by the Global Federation of Animal Sanctuaries.

    Last year the Fresno Superior Court denied a similar petition for the elephants at the Fresno Chaffee Zoo because they are not being held in state custody, and the 5th District Court of Appeal denied a second petition. Now, the Nonhuman Rights Project is urging the California Supreme Court to decide that privately detained individuals, including elephants, can qualify for habeas relief too.

    This case is not the first of its kind. The New York Court of Appeals recently considered a similar petition involving Happy, an elephant at the Bronx Zoo. In 2021, the court granted a hearing on Happy’s habeas claim, marking the first time that the highest court in an English-speaking jurisdiction allowed such a hearing for a nonhuman animal. But the court ultimately sided with the zoo.

    Thus far, the rationalizations courts have used to reject elephant rights show little basis in logic or the law. For instance, the majority in the Happy case argued that you can have rights only if you have specific genes (why?) and only if you can have duties (again, what about infants?). They also suggested that you can access habeas relief only if you can live independently (once more: infants).

    The majority in the Happy case also expressed concern about a slippery slope: If an animal in a zoo has the right to liberty, what about animals in farms and labs? And if those animals have that right, how can society still function? Perhaps a decision with this much disruptive potential is best made by legislatures.

    However, as two dissenting judges noted, this buck-passing argument fails too. It might be ideal for legislatures to address this issue. But at present, few are willing to do so. In the meantime, the judiciary has a duty to assess each case before it on the merits. When a petitioner makes a credible allegation about an unjust detention, the relevant court should hear that case.

    Moreover, if courts fear a slippery slope, the solution is not to ignore rights violations. Yes, when violations occur in large numbers, addressing them all might be disruptive. But to look the other way because of the scale of the problem would be to treat injustice, perversely, as too big to fail. Courts should instead make narrow rulings about particular violations, leaving the rest for another day.

    To be sure, legislatures should address this issue too. Last month, Ojai became the first U.S. city to recognize legal rights for nonhuman animals when it passed an ordinance declaring that elephants have the right to liberty. Such legislation can work in tandem with, not replace, judicial attention to current unjust detentions.

    The California Supreme Court needs to address the elephants in the room. However the judges decide this case, they should not refuse to hear it on the grounds that Nolwazi, Amahle and Mabu lack rights. Elephants, like humans, merit legal consideration for their own sake. Humans have both a right and a duty to give them their day in court.
