  • Wrongfully convicted man to get $19-million settlement from Baldwin Park

    [ad_1]

A wrongfully convicted man who spent more than 30 years behind bars will receive $19.1 million as part of a settlement with the city of Baldwin Park, officials said.

Daniel Saldana, 56, was convicted in connection to a 1989 drive-by shooting outside a Baldwin Park high school football game that left two students injured. But for years Saldana maintained he was innocent, insisting he wasn’t at the shooting.

Saldana was was freed from prison in 2023 after a judge declared him factually innocent and, on Friday, the Baldwin Park City Council agreed to pay $19.1 million to settle a wrongful conviction federal lawsuit.

Attorneys for Saldana argued in the lawsuit it was the “egregious misconduct” of a Baldwin Park detective that led to the wrongful conviction in 1990.

Saldana could not be reached for comment, but his attorneys released a statement blaming the wrongful conviction on a Baldwin Park detective.

“Mr. Saldana’s wrongful conviction resulted from the egregious misconduct of a Baldwin Park detective who systematically fabricated evidence and pressured witnesses throughout a fundamentally flawed investigation,” said Amelia Green, one of Saldana’s attorneys.

The case against Saldana began to unravel when one of the codefendants, Raul Vidal, told the state parole board in 2017 that Saldana was not present at the shooting.

A deputy district attorney had been present at Vidal’s parole hearing, but the testimony didn’t spark a review of the case at the time. It was not until 2023 that the state’s parole board turned over transcripts of the hearing to the Los Angeles County District Attorney’s Conviction Integrity Unit.

The district attorney’s office then moved to have Saldana’s conviction overturned, and a judge found him factually innocent in May 2023.

In February 2024, Saldana and his attorneys filed a suit against the city and former Baldwin Park Police Detective Michael Donovan, alleging the former detective coerced witnesses and falsified reports to get Saldana convicted.

Donovan allegedly pressured a teen witness to testify that Saldana was the second shooter in the incident, although the teen originally testified there had been only one shooter, according to the lawsuit.

In a statement, the city of Baldwin Park confirmed the settlement and said the incident did not involve any current city employees.

“The city sincerely hopes Mr. Saldana can now move forward in his new life,” the statement read.

  • Three men convicted in drive-by killing of 13-year-old girl in Union County

    [ad_1]

Three of the four men on trial in the drive-by shooting death of a 13-year-old Union County girl were found guilty by a jury of first-degree murder and sentenced to life in prison Thursday.

Jamari McClain, Darius Roland, and Jamerik Garmon were sentenced, without the possibility of parole, for fatally shooting Bay’Asia “Loyalti” Allah near her family’s home in Monroe on July 24, 2021.

A Union County District Attorney’s Office press release said Garmon was also sentenced to a consecutive 17 to 30 months in prison on a charge of possession of a firearm by convicted felon.

The fourth man, Jamari Crowder, was found not guilty, according to court documents. Charlotte Observer news partner WSOC reported he was “just along for the ride,” sitting in the third row of an SUV when the shooting occurred. He was released after the trial.

Another man, Javon Robinson, was charged with first-degree murder but has not yet been tried, WSOC reported. Robinson testified in this case, the outlet reported.

“This was a shocking and senseless murder,” District Attorney Trey Robison said in the press release. “This child was minding her own business when she was shot by these callous men who had no regard whatsoever of who they might hit.”

The girl was outside at a picnic table near her family’s apartment with friends when the men drove by and started shooting, the press release said. But Loyalti was not their intended target.

They had an AR-15, two semiautomatic handguns with extended magazines, ski masks and a backpack with extra ammunition at the time of the shooting, the press release said. But they traveled to Charlotte afterward to hide, and “destroyed multiple pieces of evidence.”

Tina Sykes-Mosley, founder of the group Mothers Advocating for Real Change and Unwavering Support, said she was happy with the verdict.

The nonprofit, named after her son, Marcus, who was killed in Burlington in 2020, supports families who have lost loved ones to homicide. Sykes-Mosley and volunteers from the nonprofit supported Loyalti’s mother throughout the trial.

The nonprofit also advocates for legislation to strengthen sentences and deny bail for people charged with murder. Sykes-Mosley, who previously raised concerns that courts do too much to protect defendants, credited Judge Robert Stuart Albright’s handling of the trial.

“This judge here was all for justice, was all for the truth, and I greatly appreciated him not blocking truth,” she said.

A man was sentenced to more than 28 years in prison for his role in a fatal drive-by shooting in Austin, Minnesota, in 2023.

A jury convicted Cham Obang Oman in July of aiding and abetting second-degree murder and two counts of attempted murder following a two-week trial. He was sentenced to 338 months on Thursday.

Oman drove a car from which his codefendant fired over 20 rounds, killing Gumdel Gilo and injuring two others. Oman bought an extended magazine for the man who fired the gun.

The man who fired was convicted of murder and sentenced in February to 37 1/2 years in prison. Another man who was in the car with Oman was sentenced in July.

“Cham Oman aided and abetted a horrific crime, and now he will be paying the price for it,” said Attorney General Keith Ellison. “I am grateful to the members of law enforcement who investigated this heinous act, and I am pleased my office was able to convict Oman for his part in it.”

Ellison’s office prosecuted Oman after Mower County Attorney Kristen Nelsen referred the case to him.

  • Drive-by shooting in Fremont leaves 2 people dead

    [ad_1]

A drive-by shooting in Fremont late Friday left two people dead, police said on Saturday morning.

Around 11:12 p.m., police responded to reports of a shooting on the 6000 block of Stevenson Boulevard.

According to police, two people were in a large parking lot when someone in a vehicle approached them. An occupant of the vehicle then opened fire and struck them.

Police said one person died at the scene, and another victim died at the hospital.

The police department initially reported there was a third victim in the hospital. However, in an updated news release issued Saturday afternoon, police stated that there is no third victim.

“It’s very shocking, very hard to hear,” said Carlo Figueroa, a swimming instructor at the Hippo Swim Club located a few doors down from the banquet hall. “The most shocking part to me is that [the shooting happened] right outside the place that I come [to work] every day.”

Figueroa described the area as normally quiet.

“It’s crazy to me. This area has always been very safe, a lot of nice people around here,” he said.

Another Fremont resident, Rex, said the violence was unexpected.

“Definitely terrible, shocking news. I’d never expect this would happen here. Fremont, in general, is a quiet, safe place, especially here. Never expect someone would drive by and randomly kill. That’s really, really terrible.”

Police released portions of radio traffic between a 911 dispatcher and responding officers. One officer reported, “about 100 people still inside the building. Negative injuries inside.”

While nearby businesses told CBS News Bay Area the gathering may have been a wedding reception, police have not confirmed the nature of the event. Witnesses said the parking lot was full, with many people attending.

The owner of the banquet hall, Jamal Saddiqi, declined to comment. When approached by CBS News Bay Area in front of the business, he shut the door without answering questions.

This is not the first time violence has erupted at the Royal Palace Banquet Hall. In May 2017, a wedding with an estimated 900 guests ended in multiple fights. Police said at the time, about 70 people were involved, and one man was beaten so badly he was left in a coma.

Figueroa said Friday’s shooting has left him uneasy. “I pray for the families of the victims. It’s a sad thing to hear and I really hope that the victims can rest peacefully,” he said.

Police said they are investigating and canvassing the area for witnesses and any potential security footage.

As of Saturday, no arrests had been made. Fremont police are asking anyone with information to contact them. It is the city’s third and fourth homicide this year, police said.
