    Rather than waiting until next week for the discharge position to officially take effect, Johnson is moving to hold the vote this week. He indicated the legislation will be brought to the House floor under a procedure that requires a two-thirds majority.

    “I think it’s going to be an important vote to continue to show the transparency that we’ve delivered,” House Republican leader Steve Scalise, R-La., said Monday night.

    House Democrats celebrated the vote as a rare win for the minority.

  • The Epstein files and Congress: What happens next?

    A House push to release files related to convicted sex offender Jeffrey Epstein cleared a significant hurdle Nov. 12, as Democrats and a handful of Republicans reached 218 signatures to force a floor vote on a bill to release the files within 30 days. 

    There’s still a long road ahead.

    Republican leaders aligned with President Donald Trump’s wishes by stalling Democrat-backed legislation to release the files. Trump, a onetime friend of Epstein, has faced persistent questions about what the files may show about the two men’s history.

    Bill sponsors Reps. Thomas Massie, R-Ky., and Ro Khanna, D-Calif., used an arcane procedural tactic called a discharge petition to secure floor consideration. The move came over the objections from Speaker Mike Johnson, R-La., and other Republican leaders. Johnson has argued that the House Oversight and Government Reform Committee’s ongoing effort is sufficient. The committee has released tranches of emails and other documents related to Epstein, most recently on Nov. 12, a release that included emails from Epstein that discussed Trump.

    For weeks, the discharge effort was stuck at 217 votes — one short of the required 218 — but supporters reached the magic number Nov. 12 when newly elected Rep. Adelita Grijalva, D-Ariz., was sworn in 50 days after being elected, the longest delay in recent history. 

    Grijalva signed the petition shortly after her swearing-in, making the discharge official. Massie and three other Republican members — Marjorie Taylor Greene of Georgia, Lauren Boebert of Colorado and Nancy Mace of South Carolina — joined all Democrats in signing it. 

    Though Johnson could have delayed it further, he said he would bring the measure for a vote the week of Nov. 17.

    Trump opposes further releases of Epstein material, writing on Truth Social Nov. 12 that Republicans should focus only on opening up the government, which was still shut down because of a funding impasse. “There should be no deflections to Epstein or anything else,” his post said.

    Here’s a guide to what happens next with this legislation and what’s at stake.

    Who was Epstein?

    Epstein hobnobbed with powerful people and received lenient treatment by the criminal justice system until the Miami Herald published an extensive investigation into his case in 2018.

    In 2005, Palm Beach police began investigating Epstein after reports that a 14-year-old girl was molested at his mansion. A grand jury indicted Epstein in 2006 on a single count of prostitution and he was arrested. The FBI launched an investigation and was prepared to bring an indictment, but in 2008 Epstein pleaded to one state count of soliciting prostitution and one state count of soliciting prostitution from someone under the age of 18. He served about a year in jail, largely on work release. 

    The Miami Herald investigation found federal prosecutors and Epstein’s lawyers covered up the scope of Epstein’s crimes. 

    In July 2019, Epstein was arrested on federal charges for recruiting dozens of underage girls to his New York City mansion and Palm Beach estate from 2002 to 2005 to engage in sex acts for money. He was found dead in his Manhattan jail cell Aug. 10, 2019, and investigators concluded he died by suicide.

    What are the Epstein files?

    The Trump administration has given conflicting information about what’s in the Epstein files.

    In February, Attorney General Pam Bondi released what she called the “first phase” of the declassified Epstein files, including flight logs, an evidence list and a redacted list of contacts. Bondi said the Justice Department would release more case files after redacting victims’ names.

    When Fox News host John Roberts asked Bondi in February whether her department would release a list of Epstein’s clients, she said, “It’s sitting on my desk right now to review.”

    But in a July memo, the Justice Department said there was “no incriminating ‘client list.’” 

    “There was also no credible evidence found that Epstein blackmailed prominent individuals as part of his actions,” the memo said. “We did not uncover evidence that could predicate an investigation against uncharged third parties.”

    What would the legislation do?

    The Massie-Khanna bill, titled the Epstein Files Transparency Act, requires that no later than 30 days after the bill’s enactment, the attorney general shall release “all unclassified records, documents, communications, and investigative materials” held by the Justice Department, the FBI and federal prosecutors’ offices relating to Epstein and his partner Ghislaine Maxwell, who was sentenced to 20 years in prison for sexual exploitation and abuse of minor girls over the course of a decade.

    These materials would include flight logs and travel records related to Epstein, documents related to people and companies connected to Epstein, prosecution documents and internal Justice Department communications about Epstein-related cases and material related to his death in custody. 

    Under the legislation, documents containing victims’ identifiable information may be withheld or redacted. So would materials depicting child sex abuse, death or injury, or materials that would jeopardize an ongoing federal investigation, or prosecution or that would endanger national security. However, “embarrassment, reputational harm, or political sensitivity” cannot be invoked to withhold material, the legislation says.

    What are the bill’s prospects for House passage?

    The steepest hurdle in the House was securing the 218th signature.

    With that achieved, Khanna said he expects dozens more Republicans to vote for the bill than the four who signed on to the discharge petition, The Hill reported

    What happens if the bill passes the House?

    If the legislation clears the House, it would head to the Senate. It would need 60 Senate votes to proceed to final consideration, meaning at least 13 Republicans would have to join all 47 Democrats and Democratic-aligned independents to advance. That’s a challenging obstacle.

    “It is treated the same as any other bill, solely subject to the discretion of the majority leadership,” Donald Wolfensberger, a former staff director of the House Rules Committee, said.

    In July, reporters asked Senate Majority Leader John Thune, R-S.D., whether any Senate Republicans supported forcing more Epstein file disclosure. He said he was “not hearing” much desire within his conference to push the issue.

    Thune said that when the House petition was still gathering signatures, and a successful House vote — especially with strong Republican support — could change that Senate calculus. But even if the Senate were to pass the legislation, the measure would face its stiffest test with Trump, who could veto the bill.

    Overriding a presidential veto would require a two-thirds vote of both chambers, which would require substantial Republican support in opposition to their own party’s leader.

    How much new material could come from the law’s enactment?

    If the measure became law, Trump could still find ways to neuter its impact.

    “The implementation of its provisions would still rely on Justice Department compliance,” a department that Trump has asserted significant control over, said Stanley Brand, a longtime Washington, D.C., attorney who serves as distinguished fellow at Penn State Dickinson Law.

    The Justice Department could argue to withhold certain documents, and resolving legal challenges to those decisions could put document releases at a standstill, Brand said.

    “Complex questions of standing and federal court jurisdiction to entertain such a suit would undoubtedly stall resolution,” he said.

    Dave Aronberg, a Democratic former state attorney of Palm Beach County, Florida, said he expects the Justice Department to have “wiggle room” with the exceptions included in the legislation. 

    Still, he said, it would “take a lot of creativity to withhold documents relating to President Trump.”

  • What Happens After Congress Votes on the Epstein-Files Bill

    This afternoon, Mike Johnson finally administered the oath of office to new Arizona Democratic congresswoman Adelita Grijalva. The Speaker held off this moment for well over a month under the guise of not wanting to do serious business while the government was shut down (the House wasn’t technically in recess, and Johnson had sworn in Republicans at similar moments earlier this year).

    Grijalva won the seat vacated by her father’s death in a September 23 special election. Her delayed swearing-in was generally understood to have been attributable to her pledge to become the 218th signatory on a discharge petition to force a House vote on the Epstein Files Transparency Act, a piece of legislation co-sponsored by Republican Thomas Massie and Democrat Ro Khanna that the White House would love to consign to the bottom of the sea. It would force the release of whatever the Justice Department has on the late sexual predator and his associates.

    Grijalva has now signed the petition, and last-minute efforts by Trump himself to get one or more of the four Republicans on the petition to withdraw their names failed. So this triggers a process that Johnson can only do so much to delay. Politico explains:

    The completion of the discharge petition, a rarely used mechanism to sidestep the majority party leadership, will trigger a countdown for the bill to hit the House floor. It will still take seven legislative days for the petition to ripen, after which Johnson will have two legislative days to schedule a vote. Senior Republican and Democratic aides estimate a floor vote will come the first week of December, after the Thanksgiving recess.

    Actually, Johnson has already indicated he’ll put the bill on the floor next week, not taking the extra time that would push the vote into December.

    The Speaker may be able to play some games in how the House votes on the Epstein-files bill via his control of the Rules Committee, which will deal with possible amendments and all sorts of timing issues. But the whole point of a discharge petition is to tie leadership’s hands, which is why it’s used so rarely.

    If it passes, it would create some interesting issues in the Senate, which will be soon be setting up some sort of vote on extending Obamacare premium subsidies, as promised by John Thune as part of the deal to reopen the federal government. High drama on two issues in the same time frame will be a moment of political peril for Republicans. They will likely display some of their most unpopular prejudices: indifference to the plight of Americans facing much higher health-care costs and a protective attitude toward Donald Trump and his possible implication with really bad stuff in the Epstein files.

    It’s unclear what the Senate would do with the Epstein Files bill. Administration allies could filibuster it and block it with 41 votes, though that would be a bit ironic given Trump’s own recent attacks on the filibuster itself. Still, even if both chambers pass the legislation, Trump would have to sign it, which isn’t happening.

    As votes are teed up in House or Senate, there will be competitive leaks of Epstein-files material by each party (such as the Epstein emails mentioning Trump that House Oversight Committee Democrats released today) either showing there’s smoke and fire or that it’s all a nothingburger. The White House and its congressional allies cannot be too heavy-handed in dismissing demands for more disclosure given the longtime importance of Epstein in various MAGA conspiracy theories. And even if Republicans can minimize disclosure, it’s not going to be helpful to their midterm election prospects to have these issues being broadly and actively discussed in 2026. So they will likely handle the Massie-Khanna bill with fire tongs and try to dispose of it as quickly as they can.

    On his first full day back in Washington, House Speaker Mike Johnson sat for hours in a closed-door interview with six women who say they were abused by the late Jeffrey Epstein.Johnson’s presence in the room on the first day of a frenetically busy September on Capitol Hill underscores how significant the issue of Epstein’s past crimes has become within the GOP.Within days, House Republicans are expected to take their first major floor votes on forcing President Donald Trump’s administration to release more records related to the case. And Johnson — like his members — is under intense pressure to meet the base’s demands for transparency without going against the wishes of the president, whose inner circle has attempted to quiet this summer’s political firestorm over Epstein.“The fact that Mike Johnson sat there for two and a half hours — we’re serious about this,” House Oversight Chairman James Comer told reporters after leaving the meeting Tuesday. “We’re going to do everything we can to make this right.”Johnson himself told reporters the testimonials he heard were “heartbreaking and infuriating” and said “there were tears in the room. There was outrage.”Five weeks ago, Johnson and his leadership team had hoped that sending lawmakers home early to their districts for their August recess would defuse tension around the issue. The women were told if they went to police that Epstein had powerful friends, that person said.If the bipartisan Epstein resolution does pass the House, its fate is unclear in the Senate. But it would be an extraordinary move by a GOP-controlled Congress to take against a president of its own party.To prevent such an escalation, Johnson and the White House are attempting to sell their GOP members on an alternative path.     On his first full day back in Washington, House Speaker Mike Johnson sat for hours in a closed-door interview with six women who say they were abused by the late Jeffrey Epstein.

    Johnson’s presence in the room on the first day of a frenetically busy September on Capitol Hill underscores how significant the issue of Epstein’s past crimes has become within the GOP.

    Within days, House Republicans are expected to take their first major floor votes on forcing President Donald Trump’s administration to release more records related to the case. And Johnson — like his members — is under intense pressure to meet the base’s demands for transparency without going against the wishes of the president, whose inner circle has attempted to quiet this summer’s political firestorm over Epstein.

    “The fact that Mike Johnson sat there for two and a half hours — we’re serious about this,” House Oversight Chairman James Comer told reporters after leaving the meeting Tuesday. “We’re going to do everything we can to make this right.”

    Johnson himself told reporters the testimonials he heard were “heartbreaking and infuriating” and said “there were tears in the room. There was outrage.”

    Five weeks ago, Johnson and his leadership team had hoped that sending lawmakers home early to their districts for their August recess would defuse tension around the issue. But the return of Congress to Washington showed that the pressure on GOP leaders has only continued to build.

    That pressure on Republicans will dramatically increase on Wednesday, when Rep. Thomas Massie and his Democratic counterpart in the effort, Rep. Ro Khanna of California, will hold a press conference in which some of Epstein’s survivors are expected to speak publicly for the first time.

    Massie and Khanna are leading a push to force the full House to vote on a resolution that would require Trump’s Justice Department to turn over all documents related to Epstein or his crimes. Under their maneuver, known as a discharge petition, Massie would need just five more Republicans to force the bill to the floor since every Democrat is expected to sign on.

    So far, two other Republicans have signaled they’ll support it: Rep. Marjorie Taylor Greene of Georgia and Rep. Lauren Boebert of Colorado. Other Republicans who have supported the bill itself — including Reps. Anna Paulina Luna of Florida, Eli Crane of Arizona and Tim Burchett of Tennessee — were either noncommittal or suggested they would not support the discharge petition when asked by CNN on Tuesday.

    The House Oversight Committee has been leading an investigation into Epstein after some Republicans joined with Democrats to compel a subpoena to the Justice Department for records. The panel on Tuesday night released more than 33,000 pages related to the case – all of the subpoenaed documents the panel had obtained earlier this summer.

    But the public release of information has not stopped the push for more transparency that has ratcheted up the pressure on Johnson. Massie and Democrats said nearly all of those documents had already been made public as part of various court cases and that it did not alter their push for their own Epstein measure.

    As part of its investigation, the Oversight Committee hosted a meeting on Tuesday with several survivors who are planning to speak at Wednesday’s press conference. In that closed-door meeting, several of them shared chilling stories of abuse. GOP Rep. Nancy Mace, one of the lawmakers in the room who has spoken out about being raped at age 16, left the meeting in tears.

    Inside the room, one survivor said the women had been told by Epstein that they were disposable and threatened against coming forward, according to a person in the room who spoke on the condition of anonymity to discuss a private meeting. The women were told if they went to police that Epstein had powerful friends, that person said.

    If the bipartisan Epstein resolution does pass the House, its fate is unclear in the Senate. But it would be an extraordinary move by a GOP-controlled Congress to take against a president of its own party.

    To prevent such an escalation, Johnson and the White House are attempting to sell their GOP members on an alternative path. They have backed a non-binding resolution that encourages the Oversight Committee’s investigation. And Johnson stressed the importance of the work of that panel, in part by sitting in on one of the sessions himself.

    “I sat by him in our meeting and listened to his compassion for these survivors. I listened to his questions,” Greene said of Johnson as she left the meeting. “I’ve listened to some of his plans that he has going forward. I do think he’s doing a great job there.”

    How Moderate Republicans Became an Endangered Species

    Early this summer, the federal government will, in all likelihood, exhaust the “extraordinary measures” it is now employing to keep paying the nation’s bills. As the country careens toward that fiscal abyss, Congress will face a now-familiar stalemate: Republicans will refuse to raise the debt ceiling unless Democrats agree to cut spending. Democrats will balk. Markets will slide—perhaps precipitously—and the economy will swiftly turn south.

    When that moment arrives, the most important people in Washington won’t be those who work in the White House, or even the party leaders who occupy the Capitol’s most palatial offices. They will be the House Republicans who sit closest to the political center: the so-called moderates. The GOP’s majority is narrow enough that any five Republicans could dash Speaker Kevin McCarthy’s plan to demand a ransom for the debt ceiling. They will have to decide whether to stand with him or join with Democrats to avert a first-ever default on the nation’s debt.

    “Those guys will be called on to save the day,” says former Representative Charlie Dent, a Pennsylvania Republican who, until his retirement in 2018, was one of the House’s most prominent moderates.

    Dent is talking about Republicans such as Representative Don Bacon of Nebraska, whose Omaha district voted for Joe Biden over Donald Trump in 2020. Bacon is a leader of the faction of Republicans hoping to serve as a counterweight to the House Freedom Caucus and the far-right hard-liners who extracted all manner of concessions from McCarthy earlier this month in exchange for allowing him to become speaker. During the four days of voting that McCarthy endured, Bacon regularly held court with reporters outside the House chamber, castigating the holdouts as the “chaos caucus” and comparing them to the Taliban.

    Bacon, a 59-year-old former Air Force commander first elected in 2016, styles himself as a pragmatist and a realist, and he is keenly aware of the sway that he and other like-minded Republicans could have. Indeed, he and his allies have already blocked two bills backed by some on the far right—including a measure to replace the federal income tax with a 30 percent sales tax—from coming up for a vote. But don’t call him a moderate. “I’d rather be called a conservative who gets things done,” Bacon told me.

    In rejecting the moderate label, Bacon is no different than the other 221 Republicans now serving in the House, virtually all of whom describe themselves as some version of conservative. As the party has moved to the right, so, too, has its leftmost flank. The decline of the GOP moderate is a story more than two decades in the making, but it carries particular significance at a moment when centrist lawmakers could wield so much power. If they choose to use it. If they exist at all anymore.


    Two years ago, Bacon picked up the discarded flag of a dormant GOP group called the Main Street Caucus. The caucus is the House extension of the Republican Main Street Partnership, a political organization founded 25 years ago by then-Representative Amo Houghton of New York. The original Main Street Partnership was explicitly, and proudly, moderate; Houghton called himself a “militant moderate,” and the group’s aim was to “serve as a voice for centrist Republicans,” as well as to soften the GOP’s harsh rhetoric and policies on abortion, gay rights, and the environment, among other issues.

    The Partnership remains active—it spent $25 million in support of Republican candidates last year—but it has rebranded itself to stay relevant in today’s GOP. Searching through its website history on the Internet Archive, I found that the Partnership dropped the words moderate and centrist from its mission statement sometime in the fall of 2011, shortly after the last new Republican House majority forced a confrontation over the debt ceiling with a Democratic president. They’ve since been replaced by more generic descriptors, such as common sense and pragmatic.

    “We used to be called moderate. We are not moderate,” says Sarah Chamberlain, the Partnership’s CEO and a former aide to Houghton (who retired from Congress in 2004 and died in 2020). Its members now identify as “pragmatic conservatives.” “The entity from day one has the same name, but it looks very different,” Chamberlain told me.

    The Main Street Caucus isn’t the only congressional group whose members once might have identified as moderate. Others include the Republican Governance Group (formerly known as the Tuesday Group) and the bipartisan Problem Solvers Caucus. A couple dozen Republicans, including Bacon, are members of all three groups. But they each eschew the word, in part, Bacon explained to me, because in primaries “it’s used as a cudgel.”

    Another reason is they are simply more conservative than their predecessors. As Republicans who embraced the moderate label, including Dent, have left Congress over the past 20 years, the Republicans replacing them have moved ever further from the political center. Many of the original members of the Tuesday Group and the Main Street Partnership, for example, backed abortion rights; Dent, who left the House five years ago, told me he believed he was either the last, or one of the last, House Republicans to hold that position.

    Earlier this month, the Main Street Caucus—the largest of the three groups, with about 60 members—elected as its chair a Republican even more conservative than Bacon, Representative Dusty Johnson of South Dakota. When I spoke with him by phone, Johnson eagerly volunteered that both he and the group’s new vice chair, Representative Stephanie Bice of Oklahoma, earned higher ratings than the average House Republican on the scorecard kept by Heritage Action, the conservative activist group that has warred with GOP moderates for years. “We are members who overwhelmingly want to deliver policy wins—conservative policy wins,” Johnson told me.


    The big question now is whether the GOP’s self-identified pragmatists will stand up to—or simply behind—the party leadership in the fiscal battles to come. During the speakership fight, Johnson, Bacon, and other pragmatists served as McCarthy’s protective guard, staring down the GOP holdouts by declaring that they would vote for no one other than McCarthy. Yet, with only a few complaints, they largely blessed the concessions the new speaker made to empower the far right at his own expense.

    Bacon assured me that he and his fellow pragmatists will use the leverage they have, noting the two bills that they had already prevented from coming for a vote. On the debt-ceiling debate, however, many of the deal-seeking Republicans are sounding like McCarthy, who has said the president must endorse spending cuts in order to lift the borrowing limit. “We’re not going to raise the debt ceiling until we have some additional fiscal responsibility returned to spending in this town,” Johnson told me. He put the onus on Biden and the Democrats to negotiate, equating their refusal to do so with “choosing the path of legislative terrorism.” Other members of the Main Street Caucus struck a slightly more malleable tone. “We have to be aggressive on spending, and it’s something I ran for Congress on, so I’m comfortable with that,” Representative Kelly Armstrong of North Dakota told me. “But we also have to continue to be able to govern.”

    The primary mechanism that the pragmatic Republicans could use to bypass McCarthy is a discharge petition, which would force a vote on increasing the debt limit. Given the GOP’s narrow lead in the House, only five Republicans would need to join Democrats to get the requisite support. (One GOP leader of the Problem Solvers Caucus, Representative Brian Fitzpatrick of Pennsylvania, mentioned this as a possibility when the hard-liners were blocking McCarthy’s path to speaker.) “It would be very difficult for me to sign a discharge petition against leadership,” Armstrong told me. “I would never say never, but I would be very, very skeptical that I would ever sign that.” Yet in the next breath, Armstrong suggested that if the stock market were crashing, that could change his mind: “I’m not cratering every senior in my district’s 401(k). I’m not doing it.”

    A discharge petition is an imperfect vehicle for resolving a debt-ceiling crisis; because of the House’s procedural rules, gathering signatures would have to begin weeks or even months in advance. In 2015, Dent helped lead a bipartisan coalition in using a discharge petition to go around the GOP leadership to pass legislation reviving the Export-Import Bank, a federal credit agency that conservatives wanted to let die. Then-Speaker John Boehner had already announced his departure, having been ushered into retirement by a far-right revolt. “Ordinarily, the speaker would be pretty upset about it. I can assure you he was not,” Dent recalled.

    A dozen years ago, it was Boehner leading a House GOP majority bent on securing spending cuts in exchange for lifting the debt ceiling. After several rounds of negotiations failed—including an attempted “grand bargain” on taxes and entitlement programs with then-President Barack Obama—Congress agreed to form a “super committee” to put in place budget caps that became known as sequestration. (Congress would later prevent many of these caps from being put in place.)

    Dent predicted that Republicans would win few if any concessions from Democrats for raising the borrowing limit this time around. “You’re going to get something close to a clean debt-ceiling bill,” he told me. Perhaps Biden will agree to form a fiscal commission to propose possible spending cuts, Washington’s favorite face-saving punt. A fig leaf, in other words. Bacon told me he’s hoping for something more, such as a commitment to keep increases in federal spending below inflation. “I’d like to see more than a fig leaf. I’d like to at least see some underwear on.”

    What’s all but certain is that a significant chunk of the House Republican conference won’t go for that kind of deal. Republicans told me that they doubt the party could pass any debt-ceiling increase on its own, and many conservatives might reject any deal that McCarthy could get Democrats to endorse, if he can get Democrats to negotiate at all. That will put the pressure once again on the GOP’s pragmatists, the Republicans who pass for moderate in 2023 but won’t dare use that word. If and when the debt crisis comes, they could well be the ones deciding between, well, moderation and default.
