    Sonia Sotomayor Should Retire Now

    On Election Day in 2006, Justice Antonin Scalia was 70 years old and had been serving on the Supreme Court for 20 years. That year would have been an opportune time for him to retire—Republicans held the White House and the Senate, and they could have confirmed a young conservative justice who likely would have held the seat for decades to come. Instead, he tried to stay on the Court until the next time a Republican president would have a clear shot to nominate and confirm a conservative successor.

    He didn’t make it—he died unexpectedly in February 2016, at the age of 79, while Barack Obama was president. Conservatives nevertheless engineered some good fortune: There was divided control of government, and then–Senate Majority Leader Mitch McConnell refused to even hold confirmation hearings for Merrick Garland, Obama’s nominee to the seat. Donald Trump won that fall’s election and named Neil Gorsuch to the seat that McConnell had held open.

    But imagine for a moment that Hillary Clinton had won the 2016 election, as many expected. By running a few points stronger, she might have taken Democratic candidates across the finish line in close races in Pennsylvania and Missouri, resulting in Democratic control of the Senate. In that scenario, Clinton would have named a liberal successor to Scalia—more liberal than Garland—and conservatives would have lost control of the Court, all because of Scalia’s failure to retire at the opportune moment.

    Justice Sonia Sotomayor will turn 70 in June. If she retires this year, President Joe Biden will nominate a young and reliably liberal judge to replace her. Republicans do not control the Senate floor and cannot force the seat to be held open like they did when Scalia died. Confirmation of the new justice will be a slam dunk, and liberals will have successfully shored up one of their seats on the Court—playing the kind of defense that is smart and prudent when your only hope of controlling the Court again relies on both the timing of the death or retirement of conservative judges and not losing your grip on the three seats you already hold.

    But if Sotomayor does not retire this year, we don’t know when she will next be able to retire with a likely liberal replacement. It’s possible that Democrats will retain the presidency and the Senate in this year’s elections, in which case the insurance created by a Sotomayor retirement won’t have been necessary. But if Democrats lose the presidency or the Senate this fall—or both—she’ll need to stay on the bench until the party once again controls them. That could be just a few years, or it could be longer. Democrats have previously had to wait as long as 14 years (1995 to 2009). In other words, if Sotomayor doesn’t retire this year, she’ll be making a bet that she will remain fit to serve until possibly age 78 or even 82 or 84—and she’ll be forcing the whole Democratic Party to make that high-stakes bet with her.

    If Democrats lose the bet, the Court’s 6–3 conservative majority will turn into a 7–2 majority at some point within the next decade. If they win the bet, what do they win? They win the opportunity to read dissents written by Sotomayor instead of some other liberal justice. This is obviously an insane trade. Democrats talk a lot about the importance of the Court and the damage that has been done since it has swung in a more conservative direction, most obviously including the end of constitutional protections for abortion rights. So why aren’t Democrats demanding Sotomayor’s retirement?

    Well, they are whispering about it. Politico reported in January:

    Some Democrats close to the Biden administration and high-profile lawyers with past White House experience spoke to West Wing Playbook on condition of anonymity about their support for Sotomayor’s retirement. But none would go on the record about it. They worried that publicly calling for the first Latina justice to step down would appear gauche or insensitive. Privately, they say Sotomayor has provided an important liberal voice on the court, even as they concede that it would be smart for the party if she stepped down before the 2024 election.

    This is incredibly gutless. You’re worried about putting control of the Court completely out of reach for more than a generation, but because she is Latina, you can’t hurry along an official who’s putting your entire policy project at risk? If this is how the Democratic Party operates, it deserves to lose.

    The cowardice in speaking up about Sotomayor—a diabetic who has in some instances traveled with a medic—is part of a broader insanity in the way that the Democratic Party thinks about diversity and representation. Representation is supposed to be important because the presence of different sorts of people in positions of power helps ensure that the interests and preferences of various communities are taken into account when making policy. But in practice, Democratic Party actions regarding diversity tend to be taken for the benefit of officials rather than demographic groups. What’s more important for ordinary Latina women who support Democrats—that there not be one more vote against abortion rights on the Supreme Court, or that Sotomayor is personally there to write dissenting opinions? The answer is obvious, unless you work in Democratic politics for a living, in which case it apparently becomes a difficult call.

    I thought Democrats had learned a lesson from the Ruth Bader Ginsburg episode about the importance of playing defense on a Court where you don’t hold the majority. Building a cult of personality around one particular justice served to reinforce the idea that it was reasonable for her to stay on the bench far into old age, and her unfortunate choice to do so ultimately led to Amy Coney Barrett’s appointment and a string of conservative policy victories. All liberals have to show for this stubbornness is a bunch of dissents and kitsch home decor. In 2021, it seemed that liberals had indeed learned their lesson—not only was there a well-organized effort to hound the elderly Stephen Breyer out of office, but the effort was quite rude. (I’m not sure screaming “Retire, bitch” at Stephen Breyer was strictly necessary, but I wasn’t bothered by it either—he was a big boy, and he could take it.) But I guess maybe the lesson was learned only for instances where the justice in question is a white man.

    One obvious response to this argument is that the president is also old—much older, indeed, than Sonia Sotomayor. I am aware, and I consider this to be a serious problem. But Democrats are unlikely to find a way to replace Biden with a younger candidate who enhances their odds of winning the election. The Sotomayor situation is different. Her age problem can be dealt with very simply by her retiring and the president picking a candidate to replace her who is young and broadly acceptable (maybe even exciting) to Democratic Party insiders. And if Democrats want to increase the odds of getting there, they should be saying in public that she should step down. In order to do that, they’ll have to get over their fear of being called racist or sexist or ageist.

    President Joe Biden’s embattled pick to lead the Federal Aviation Administration is scheduled for his confirmation hearing before Congress on Wednesday morning amid a series of challenges for the agency.

    Phil Washington is expected to get grilled by senators on issues that have emerged since he was nominated last summer and explain why he’s qualified to lead an agency that urgently needs to address a slew of complex challenges.

    The hearing for Washington, whose lack of aviation experience and legal entanglements have raised concerns on Capitol Hill, comes after a year of the FAA operating without a permanent administrator. In that time, the agency has contended with several problems that have plagued travelers and the airline industry, such as recent near-collisions involving airliners, crucial staffing shortages and malfunctions of aging technology that have cause major air travel disruption.

    Washington, whose nomination was first announced by Biden nearly eight months ago, will appear before the Senate Committee on Commerce, Science, and Transportation Wednesday at 10 a.m. ET.

    Washington, the current CEO of the Denver International Airport, has held leadership roles at municipal transit organizations, including in Denver and Los Angeles, focused on bus and rail lines. He also led the Biden-Harris transition team for the Department of Transportation. Prior to his work in transportation, Washington served in the military for 24 years.

    While Washington has worked in transportation-related positions since 2000, he had no experience in the aviation industry prior to joining the Denver airport in 2021. Since his nomination last summer, Washington has faced questions about his limited experience and, in September, was named in a search warrant issued as part of a political corruption investigation in Los Angeles.

    According to a questionnaire given to the commerce committee ahead of Wednesday’s hearing, Washington wrote that though his name was mentioned in the search warrant along with several other names, no search was ever executed on him or his property, nor was he questioned about the matter.

    Washington’s name was also recently mentioned in a federal lawsuit filed earlier this month. Benjamin Juarez, a former parking director at the Denver Airport, alleges that the city permitted intolerable working conditions and that he faced ongoing threats to his job, Axios reported. Juarez’s attorney says he contacted Washington, who was leading the airport, at least twice for help and did not receive a response.

    Texas Republican Sen. Ted Cruz, the ranking Republican on the committee, has asserted that Washington failed to disclose his naming in the lawsuit involving his work at the Denver airport. Republicans have also questioned whether Washington, an Army veteran who left the military in 2000 after more than 20 years of service, would be statutorily considered a civilian – a requirement in order to serve as the FAA chief.

    If he’s not considered a civilian, he would need a waiver from Congress permitting him to lead the agency. And Republicans do not support granting Washington a waiver.

    A GOP aide on the Senate commerce committee told CNN that Cruz and Senate Republicans expect to raise all these issues – including his legal entanglements, his lack of experience, his management and his possible ineligibility – during Wednesday’s hearing.

    They’ll also focus on Washington’s efforts to incorporate diversity, equity, and inclusion in the vendor and contractor process as well as leading efforts “to make it harder and more expensive to drive in Los Angeles to force people to use mass transit instead in order to save mankind from climate change,” according to the aide. Specifically, the aide referenced Washington’s work to pursue a policy which charges drivers for using congested roadways during peak hours.

    Senate Majority Leader Chuck Schumer said in January that he would push to confirm Washington.

    “There is no doubt about it: it’s time to clear the runway for President Biden’s choice for FAA administrator, Phil Washington. With recent events, including airline troubles and last week’s tech problem, this agency needs a leader confirmed by the Senate immediately,” Schumer said in a statement following a computer system failure that triggered the delay of more than 12,000 flights. “I intend to break this logjam, work to hold a hearing for Mr. Washington, where he can detail his experience and answer questions and then work towards a speedy Senate confirmation.”

    The FAA is a sprawling and complex safety, regulatory and operational agency, tasked with regulatory oversight of all civilian aviation in the US.

    It’s been without a permanent administrator for about a year, when the Trump-nominated Stephen Dickson stepped down midway through his five-year term. Billy Nolen, the agency’s top safety official, was named acting director in April.

    The agency has a professed focus on safety, but agency leadership is ultimately responsible for steering its focus as its mission gets wider – with responsibilities expanding to include establishing the federal approach to private space launches and regulating drones – even as longstanding aspects of the aviation industry continue to grapple with major challenges.

    A failure of the 30-year-old NOTAM, or Notice to Air Missions, system led to the first nationwide airplane departure grounding since the 9/11 attacks, showcasing just one way aging industry technology is being stretched beyond its limits by increased volume. Now, the FAA is planning to dramatically accelerate replacing the safety system.

    Another FAA computer system failed earlier this year when it was overloaded, leading to delays in Florida. And the agency has struggled to modernize parts of air traffic control, with a 2021 Transportation Department Office of Inspection General report citing difficulties integrating the FAA’s multi-billion dollar Next Generation Air Transportation System project due to extended delays.

    There have been recent near-collisions on US runways, prompting federal safety investigators to open multiple inquiries. Air traffic control is staffed at the lowest level in decades, according to industry experts. And key roles at US airlines pared down amid the Covid-19 pandemic have not ramped up to meet current outsized travel demand.

    In February, Nolen, the acting chief, ordered a sweeping review of the agency in the wake of recent aviation safety incidents. That review is expected to include a major safety meeting this month.

    Another challenge is the FAA’s evolution in how it handles oversight following the Boeing 737 MAX crashes.

    Congress created reforms to the FAA’s oversight in a late 2020 law but critics say the agency has been slow to implement changes.

    A House Transportation committee investigation into 737 MAX certification found the model of oversight used then “creates inherent conflicts of interest that have jeopardized the safety of the flying public.” The report also concluded senior FAA officials overrode decisions of FAA experts.

    The agency is also still trying to resolve an 5G interference issue.

    The next generation of cell phone technology can interfere with devices on aircraft that determine how far above the ground the aircraft is – the radar or radio altimeter.

    FAA says it brought its concerns to the administration at the time when the Federal Communications Commission was developing plans to auction this portion of spectrum. But now the FAA is trying to play catch up while wireless carriers agreed to voluntarily pause rolling out their new tech around airports.

    LONDON — An American woman who fled the U.K. claiming diplomatic immunity after she was involved in a fatal traffic accident has appeared in a British court via videolink — an apparent breakthrough in the long-deadlocked case.

    Anne Sacoolas, 45, was accompanied by her lawyer during the 6-minute hearing Thursday at Westminster Magistrates Court in London, speaking only to confirm her name. The court granted her unconditional bail and scheduled the next hearing for Oct. 27.

    Sacoolas was charged with causing death by dangerous driving after an August 2019 accident in which 19-year-old Harry Dunn was killed when his motorcycle collided with a car outside RAF Croughton, an air base in eastern England that is used by U.S. forces.

    Sacoolas and her husband, who had been a U.S. intelligence officer at the air base, returned to America days after the accident. The U.S. government invoked diplomatic immunity on her behalf, prompting an outcry in Britain.

    Dunn’s family has met with politicians in the U.K. and the U.S. to demand that Sacoolas face justice in a British court. But American authorities rejected Britain’s extradition request.

    President Joe Biden’s pick to be the next labor secretary, Julie Su, has yet to secure the support of key Democrats ahead of her nomination hearing on Thursday, suggesting she faces an uphill battle to confirmation by the Senate.

    The tepid reception among some members of the president’s own party is part of a broader issue that’s emerged in recent months for the Biden administration. Despite a narrow majority in the Senate, Democrats have with more recent frequency failed to sign off on high-profile Biden appointees – torpedoing Phil Washington’s nomination to lead the Federal Aviation Administration as well as Gigi Sohn’s nomination to the Federal Communications Commission. If Su does not secure enough support from the Senate, she would be the highest-ranking Biden nominee so far to fail to be confirmed.

    In the 51-49 Democratic-controlled Senate, more than two liberal defections could tank the nomination. And if California Sen. Dianne Feinstein, who has been away from Congress while recovering from shingles for the past two months, or another Democratic senator is absent, the path would narrow ever more.

    Senate Majority Leader Chuck Schumer has called on the chamber to confirm Biden’s labor nominee, and on Tuesday afternoon, Su was on Capitol Hill meeting with Democratic Majority Whip Dick Durbin. But two Democratic senators up for reelection in red states, Montana Sen. Jon Tester and West Virginia Sen. Joe Manchin, are not ready to throw their support behind her yet. It’s also not clear how Arizona independent Sen. Kyrsten Sinema, who left the Democratic Party last year but kept her committee assignments with the majority, will vote.

    Tester, who says he plans to meet with Su following Thursday’s hearing, told reporters on Tuesday that he remains “very ambivalent,” adding, “I voted for her before. I don’t have a problem with her right now.”

    “I have no comment,” Manchin told CNN three times when asked about Su.

    Hannah Hurley, a spokesperson for Sinema’s office, told CNN that the senator “does not preview her votes.”

    Su was narrowly confirmed to be the deputy secretary of labor in 2021, receiving unanimous support at the time from Senate Democrats and no support from Republicans. In March, when then-Labor Secretary Marty Walsh departed the administration, Su was appointed acting secretary of the agency.

    Sen. Bill Cassidy, the ranking member on the Senate Health, Education, Labor, and Pensions Committee, which will oversee Su’s confirmation hearing, has suggested that Su lacks the bona fides to handle labor negotiations.

    “Setting his politics aside, no one could say Marty Walsh didn’t have significant experience in negotiations and managing organizations,” Cassidy, a Louisiana Republican, said in a statement Monday. “With 150 labor contracts expiring this year, the potential of replacing him with someone who has no direct experience handling labor disputes should be concerning.”

    Prior to joining the Biden administration, Su was the secretary for the California Labor and Workforce Development Agency and the state’s labor commissioner. Su has gained critics over her time in leadership in California as well as her support for A.B. 5, a California law that aims to reclassify certain gig workers as regular employees.

    She faced scrutiny for California’s handling of unemployment benefits during the Covid-19 pandemic, particularly her oversight of the state’s Employment Development Department. During the pandemic, the department delayed approving unemployment benefits and paid out billions on fraudulent claims. Su has said EDD’s systems were not prepared for the number of unemployment claims made.

    Su will emphasize the importance of American small businesses during the hearing Thursday, according to an excerpt of her prepared opening remarks provided to CNN by a source familiar with the nomination process, telling committee members that she has “seen first-hand the strength and creativity of American workers and business owners.”

    “While I was growing up, my family also saw opportunity and their shot at the middle class in the form of small businesses. They owned a dry cleaning and laundromat business, and then a franchise pizza restaurant,” Su is expected to say. “For years, my dad would work his day job and then head right to the pizza shop, returning home after 10 pm, often with leftover pizza for our school lunches the next day. I know small business owners are the engines of our economy, because I watched it every day.”

    The high-stakes nomination has pushed outside groups to lodge broad public efforts to lobby for and against Su’s leadership.

    One outside group called “Stand Against Su” has launched a public ad campaign lobbying against the nominee, calling her a “fiery critic of capitalism” and citing her past actions in California. Provisions she has supported, they argue, have made it more difficult for independent contractors and franchisees to operate in California.

    The AFL-CIO, the nation’s largest labor federation, is leading a new campaign in support of Su, Director of Public Affairs Ray Zaccaro confirmed to CNN. The campaign, led by AFL-CIO President Liz Shuler, will include a six-figure digital ad buy targeting Arizona and other states, as well as Washington, DC. The federation is also committing resources and mobilizing the 60 affiliate unions nationally as part of the effort. Punchbowl News first reported on the federation’s campaign launch.

    The White House continues to stand by Su, pointing to Senate Democrats’ past unanimous support during her last confirmation proceedings.

    A White House official told CNN Su was part of the efforts to avert a rail shutdown last year, and that she has met with senators from both sides of the aisle during the nomination process. They further pointed out that she’s offered to meet with every member of the Senate HELP Committee.

    “We’re looking forward to the hearing coming up on Thursday and feel confident … about Julie’s confirmation process. … She has a proven track record she can stand on proudly,” White House press secretary Karine Jean-Pierre told reporters on Tuesday. “The president is proud to have nominated her.”
