    DEPEW, N.Y. (WIVB) – So far, no state-approved marijuana dispensaries have opened in Western New York.

    But, that will soon change. Herbal IQ, located on Transit Road in Depew plans to open Friday, July 21.

    You’ll be able to roll down Mary Jane Lane at Herbal IQ, which is mostly empty now, but we found some setting up being done Friday. Herbal IQ renovated a former pool hall on Transit Road and will sell New York State-approved marijuana products.

    A couple months ago, the operators of the business were granted a conditional adult-use marijuana retail dispensary license by the state. The chief operations officer says Mike Ortiz have been working hard for the past year for this moment.

    “Huge, obviously yes, but we have to maintain our composure we have to stay laser-focused and we have to focus on the task at hand to hit the goal right? That’s what we do so for right now we’re just going to stay focused and once we get past this we can start to enjoy what the culmination is of the last year’s process,” Ortiz said, “Over the next couple of days, we’ll finish the final stuff in here we’ll bring on our employees, get them trained and prepare for the opening.”

    In a momentous decision on Wednesday, July 12, Michigan’s Civil Service Commission (CSC) voted unanimously to lift a decades-old ban that had previously prevented state employees who tested positive for marijuana use from obtaining jobs within the state government. This historical move has been a cause for celebration among civil rights advocates and marijuana legalization supporters alike.

    According to data provided by the Office of the State Employer (OSE), 151 applicants for state jobs in Michigan tested positive for marijuana use in 2022 alone—a five-year high that doubled the numbers from the previous year. Since the legalization of recreational marijuana use in 2018, the state has recorded 351 pre-employment drug test failures. This year, out of the 83 failed pre-employment drug tests, a staggering 81 were due to marijuana.

    This change is not a blanket removal of all drug testing procedures for potential state employees. Certain government roles, including health workers, state police officers, and employees of the Michigan Department of Corrections, will still be required to pass marijuana tests. However, starting from October 1, office staff and applicants for positions that do not involve driving, operating heavy machinery, or handling hazardous materials will no longer be disqualified due to marijuana use.

    The historical Boston Tea Party motto of “no taxation without representation” took on a new meaning on Wednesday when a major marijuana company marked the 250th anniversary of the act of civil disobedience by protesting federal code that prohibits the cannabis industry from making key tax deductions like other traditional businesses.

    Dressed in colonial garb, executives and employees of the multi-state cannabis operator MariMed took to the Boston Harbor to raise attention to the Internal Revenue Service (IRS) code known as 280E. The stunt was a play on the December 1773 protest by early Bostonians over England’s monarchy raising the tax on tea, which involved pouring cases of the product into the sea.

    As Congress works to advance a bipartisan marijuana banking bill, which advocates hope will be scheduled for a Senate Banking Committee vote this month, the company is highlighting another specific part of federal law that makes it so cannabis businesses are subject to significantly higher effective tax rates.

    “Our protest was less about us and more to provide a voice for the entire industry,” MariMed CEO and President Jon Levine said in a press release. “Section 280E is unfair and hampers companies striving to make cannabis accessible for consumers and medical cannabis patients in all legal states. It should be repealed. Doing so would remove an obstacle to our mission to improve people’s lives every day through cannabis.”

    The Secret Service said Thursday in a closed-door Congressional hearing that before the cocaine discovery in the White House over the Fourth of July weekend, marijuana was also located on at least two occasions last year, according to a report.

    A spokesperson for the Secret Service told Fox News Digital that “small amounts of marijuana” was found inside the White House in July and September last year.

    “No one was arrested in these incidents because the weight of the marijuana confiscated did not meet the legal threshold for federal charges or D.C. misdemeanor criminal charges, as the District of Columbia had decriminalized possession,” the spokesperson said. “The marijuana was collected by officers and destroyed.”

    Although having less than two ounces of marijuana is not a crime in Washington D.C., possessing pot is still prohibited on federal properties like the White House.

    Rep. Lauren Boebert told the news outlet that the area in the West Wing where the cocaine was found “should have had video surveillance.”

    Traffic stop leads to seizure of over 17 pounds of marijuana – Medical Marijuana Program Connection

    Maria Yabar, 34, of Arlington, has been charged with possession with the intent to sell, give, or distribute more than five pounds of marijuana.

    The charge stems from a traffic stop that occurred on Sunday, July 9, shortly before 11:30 p.m. A Leesburg Police Officer on patrol observed an equipment violation on a 2011 Honda Accord which was being driving in the area of East Market Street and Catoctin Circle.

    The officer conducted a traffic stop and Maria Yabar was identified as the driver and sole occupant of the vehicle. Subsequent to an investigation officers recovered more than 17 pounds of marijuana and assorted marijuana products from the vehicle.

    The case pends court and Yabar remains free on a $10,000 secured bond.

    Despite CBD being legal in Indiana since March of 2018, the decision for White River Township Fire Department to change their policy to allow its staff to use CBD products has turned out to be quite controversial among Indiana’s firefighting industry. 

    The White River Township Fire Department runs like any other firehouse. Firefighters spend their time training, working on equipment around the firehouse and responding to emergencies. 

    But when they go home these firefighters are able to unwind from their long shift or treat side affects from their demanding job with CBD products.

    “We know that firefighters have problems sleeping and there is an emotional and a physical stress on our body and CBD is something that can help them,” said Jeremy Pell, chief of the White River Township Fire Department.

    This new policy change includes using CBD and delta-8 products in any form including oils, smoking it, baking it, any form of consumption.

    A Salvation Army hub in Bourke Street, in Melbourne’s CBD, could become home to a controversial second supervised injecting room, but the final decision is yet to be made.

    The Victorian government is understood to be considering housing the room out of the charity’s building, near the state parliament.

    It is the hub for its Melbourne Project 614, which supports people experiencing homelessness, mental health issues, alcohol and other drug addictions and social poverty.

    Salvation Army major Brendan Nottle said he has seen the impacts of drug overdoses and drug-related deaths first-hand across more than two decades working in the CBD.

    “I have said for many years we need a second supervised injecting room in the CBD because it will save lives,” he said in a statement on Wednesday.

    “Any proposed location is a matter for the Victorian government and I will leave it to them to get on with their work.”

    Former Victoria police commissioner Ken Lay delivered his report on drug-taking patterns in the city’s CBD to the mental health minister, Gabrielle Williams, at the end of June.

    The repeatedly delayed report is yet to be released, as Williams considers the government’s response.

    A medically supervised injecting room trial in the CBD has been under consideration for several years, after an initial site in North Richmond was opened in 2018.

    Chico police officer charged with furnishing marijuana to a minor – Paradise Post – Medical Marijuana Program Connection

    A Chico police officer has been charged in a criminal complaint with a felony for furnishing marijuana and a misdemeanor for contributing to the delinquency of a minor, according to a news release issued late Tuesday by Butte County District Attorney Mike Ramsey.

    Nicholas Lee Rush, 49, of the Chico Police Department is alleged to have provided marijuana and marijuana products to a 17-year-old family member, according to the news release.  Additionally, it is alleged the child was encouraged by Rush to provide some of the marijuana to the officer’s adult girlfriend.

    The allegations stem from an investigation into the officer’s cultivation of marijuana in his backyard, an activity that started in the summer of 2022, Ramsey said.

    Ramsey said Rush is not currently an active officer with the Chico Police.

    Ramsey said the Butte County Superior Court has issued Rush a notice to appear on Aug. 3 at 8:30 a.m. for his arraignment.

    Rush faces up to a maximum of five years in state prison.

    That’s enough to get on the 2024 ballot, but the group has to get approval from the Florida supreme court first. 

    “I think it’s going to be a tough fight, and I think it could go either way,” constitutional attorney Will Cooper said. “The key is the Supreme Court in Florida. They have a history of being very aggressive and striking down these initiatives relating to marijuana use in Florida.”

    Florida Attorney General Ashley Moody already announced intentions to fight the proposed constitutional amendment.

    In a statement, Moody’s communications director Kylie Mason said it’s essential Floridians know what they’re voting for.

    By now, Travis Kelce’s college origin story is well known. A two-star recruit coming out of high school, he enrolled at Cincinnati and played sparingly his freshman year before missing all of his sophomore season while serving a one-year suspension for failing a marijuana test. Previously splitting time as a little-used tight end and wildcat quarterback, Kelce returned and developed into a pro prospect at tight end, eventually getting drafted by the Chiefs in the third round in 2013.

    The rest, as they say, is history. But were it not for Kelce’s emphasis on playing tight end exclusively following his suspension, who knows how his playing career would have ended up. And, as it turns out, it was the one-year suspension that helped spur that decision.
