    About two months after the last federal government shutdown ended, another funding lapse looms — this one caused by a battle between Republicans and Democrats over funding for immigration enforcement.

    Lawmakers in both parties worked collaboratively in recent weeks to extend government funding, trying to avoid any snags that could cause a new impasse after the record 43-day shutdown in fall 2025.

    Six of 12 funding bills passed both chambers and were signed by President Donald Trump in November and January. Agencies covered by these bills now have up-to-date funding streams and are not at risk of shutting down.

    Agencies funded by the other six bills, however, are now at risk of a shutdown. The fight centers around the Department of Homeland Security, but other affected funding in the bill involves defense; financial services; labor, health and human services and education; state and foreign operations; and transportation and housing and urban development.

    The House on Jan. 22 approved measures to extend funding for these remaining six bills, sending them to the Senate. (Bills like this that consolidate several spending measures are nicknamed a “minibus” — a play on “omnibus,” which typically consolidates all or nearly all 12 regular spending bills.)

    Most observers expected the Senate to quickly send the legislation to the president for his signature. That changed Jan. 24, when federal immigration enforcement agents fatally shot Alex Pretti in Minneapolis.

    Pretti’s shooting happened on a weekend just before the Senate was to consider the spending bill. It inflamed existing political tensions, drawing widespread criticism of DHS’s tactics and imperiling the department’s funding, which totals $64.4 billion. 

    Senate Democrats, responding to voters’ concerns about immigration enforcement tactics in Minneapolis, said they would not approve DHS funding without an agreement to curb certain immigration enforcement policies.

    Senate Minority Leader Chuck Schumer, D-N.Y., laid out several elements he said were needed to secure Democratic support: Ending “roving patrols”; improving coordination with state and local law enforcement; implementing a standard code of conduct and independent investigations to enforce adherence to it; requiring agents to wear body cameras; and requiring agents not to wear masks.

    Negotiators from both parties in the Senate met this week to try to reach an agreement that would free up the spending bill for a vote. Late on Jan. 29, news reports said lawmakers struck a deal that would give negotiators time to reach a more permanent agreement, following a relatively short shutdown.

    A shutdown is likely, but its duration remains in question

    A government shutdown seems likely, but it could be brief — and therefore have a more limited impact on the public.

    The reason a shutdown is all but inevitable is the Senate cannot simply strip out the Homeland Security portions of the bill, approve the rest in a vote, and send the portions approved by both chambers to the president for his signature. Instead, the entire bill needs to be passed in both chambers before moving to the president.

    The deal announced Jan. 29 would tee up a vote to approve new spending for agencies other than homeland security, along with a measure that would extend homeland security funding for two weeks. Lawmakers would continue to negotiate immigration enforcement policies. 

    Any measure that passes the Senate would have to be passed in the House next. The House is not in session until the week of Feb. 2. 

    The best-case scenario is that the portion of the government covered by the pending bill would shut down over the weekend and into early the following week. Weekend shutdowns are generally less problematic because most government employees aren’t working; areas unaffected by a spending lapse would include agriculture, commerce, justice, science, energy and water development, the interior, the legislative branch, military construction and veterans affairs.

    Still, challenges could remain: House members from either party could be unhappy with what the Senate passed and could vote against a new Senate bill, preventing it from passing and effectively extending the shutdown.

    Safe States and 164 national, state, and local partners oppose the drastic cuts proposed to health programs by the House Appropriations Committee and call for maintaining investments in injury and violence prevention.

    Safe States and 164 medical, public health, non-profit, and research organizations representing the Injury and Violence Prevention Network and allied organizations strongly oppose the proposed $1.8 billion in cuts to the Centers for Disease Control and Prevention (CDC), including zeroing out of funding for the CDC’s National Center for Injury Prevention and Control (NCIPC), and call upon Congress to prioritize health by rejecting the House Labor, Health and Human Services, Education and Related Agencies (Labor-HHS) Appropriations proposed funding bill for fiscal year 2025.

    Injuries and violence remain critical public health threats facing the United States. According to the CDC, in the first half of life, more Americans die from violence and injuries — such as motor vehicle crashes, falls, suicides, homicides, or opioid overdoses — than from any other cause, including cancer, HIV, or the flu. Yet, with support, injuries and violence are predictable and preventable.

    The House Appropriations Subcommittee on Labor-HHS FY 2025 proposed funding measure calls for drastic cuts and restructuring of major health agencies, including a 22 percent cut to the CDC. The proposal would eliminate the CDC’s NCIPC, cutting $761 million in critical programs such as firearm injury and mortality research, suicide prevention, adverse childhood experiences (ACEs) prevention, opioid overdose prevention, and so much more, will devastate communities.

    According to Safe States Executive Director Richard Hamburg, “Investing in public health prevention programs is an essential role of government. While unintentional injuries alone are the leading cause of death for 1-44 year olds, the financial toll of injuries and violence in the US is $4.2 trillion. The return on investment for programs like traumatic brain injury screenings, youth suicide prevention programs, elder fall prevention, and transportation safety is significant.”

    Now is the time to build upon current investments rather than erase progress through deep funding cuts to programs fundamental to creating healthier lives and communities. Robust investment in the CDC and its diverse array of programming is vital to America’s health and well-being. The Injury Center provides distinct primary prevention programming, research, and evaluation that is not duplicative to programs across other agencies, and the proposed cuts would effectively undo decades of progress toward a safe and healthy future. “The proposed evisceration of the CDC’s Injury Center is short-sighted, with real-life consequences,” said Hamburg.

    On Tuesday, the Supreme Court began hearing oral arguments in a case that will determine the fate of the Consumer Financial Protection Bureau.

    The case was brought on by the Community Financial Services Association of America, a trade group representing payday lenders.

    The group scored a victory last year in a case it brought before the US Court of Appeals for the Fifth Circuit, in New Orleans. The three-judge panel ruled the CFPB’s funding violates the Constitution’s Appropriations Clause and separation of powers. The Supreme Court will have the final say on that, however.

    The consumer watchdog agency was created after the 2008 financial crisis by way of the Dodd-Frank Wall Street Reform and Consumer Protection Act. The agency was the brainchild of Democratic Sen. Elizabeth Warren. She began advocating for it in 2007 when she was a Harvard Law School professor.

    The broad purpose of the CFPB is to protect consumers from financial abuses and to serve as the central agency for consumer financial protection authorities.

    Prior to the CFPB’s formation, “[c]onsumer financial protection had not been the primary focus of any federal agency, and no agency had effective tools to set the rules for and oversee the whole market,” the agency said on its site.

    The CFPB is funded by the Federal Reserve in an effort to keep the agency independent from political pressure. It also means that the agency doesn’t depend on Congressional appropriations funds.

    While there are critics of the agency’s current structure and funding, it has saved consumers money, made it easier for them to seek redress and to get better clarity and more tailored responses from companies when they have a problem with their accounts, loans or credit reports.

    “Today virtually all financial transactions for residential real estate in the United States depend upon compliance with the CFPB’s rules, and consumers rely on the rights and protections provided by those rules,” the Mortgage Bankers Association, the National Association of Homebuilders and the National Association of Realtors said in an amicus brief to the Supreme Court.

    For instance, the CFPB recently ordered Bank of America to pay $100 million to customers and $90 million in penalties saying that the nation’s second-largest bank harmed consumers by double-dipping on fees, withholding credit card rewards and opening fake accounts.

    The CFPB also took action against Wells Fargo after the agency found the bank had been engaging in multiple abusive and unlawful consumer practices across several financial products between 2011 and 2022 — from auto loans to mortgage loans to bank accounts.

    The agency ordered the bank to pay a $1.7 billion civil penalty in addition to more than $2 billion to compensate consumers.

    The Supreme Court’s decision, which likely won’t be announced until the spring of 2024, has far-reaching implications.

    If the Supreme Court finds the CFPB’s funding structure unconstitutional, it could shutter the agency and invalidate all of its prior rulings.

    “Without those rules substantial uncertainty would arise as to how to undertake mortgage transactions in accordance with federal law,” the associations said in their joint brief. “The housing market could descend into chaos, to the detriment of all mortgage borrowers,” they added.

    It could also call into question the constitutionality of other government agencies like the Federal Reserve and the Federal Deposit Insurance Corporation that also aren’t funded by Congressional appropriations.

    “We are confident in the constitutionality of the statute that created the CFPB within the Federal Reserve System and provides its funding,” Sam Gilford, a spokesperson for the CFPB, told CNN in a statement. “We will continue to carry out the vital work Congress has charged us to perform.”

    There’s also a way for the Supreme Court to change the CFPB’s funding structure in a way that wouldn’t invalidate prior rulings, said Joseph Lynyak III, a partner at the law firm of Dorsey & Whitney and a regulatory reform expert.

    “This result would be far more probable rather than voiding the last decade of the CFPB’s activity,” he added.

    From listening to the case on Tuesday, though, Lynyak believes the Supreme Court will rule that the CFPB’s funding structure is constitutional.

    “As we have argued from the outset, the CFPB’s unique funding mechanism lacks any contemporary or historical precedent,” said Noel Francisco, a lawyer arguing on behalf of those challenging the constitutionality of the CFPB’s funding structure.

    He added that it “improperly shields the agency from congressional oversight and accountability, and unconstitutionally strips Congress of its power of the purse under the Appropriations Clause of the Constitution.

    But both Republican and Democratic-appointed justices told Francisco on Tuesday they could not understand the crux of his argument.

    “I’m at a total loss,” said Justice Sonia Sotomayor. Echoing her remarks, Justice Amy Coney Barrett said, “we’re all struggling to figure out what’s the standard that you would use.”

    House Speaker Kevin McCarthy privately outlined to members a new GOP plan to keep the government open on Wednesday after a marathon two-and-a-half-hour GOP conference meeting.

    The California Republican later told reporters that Republican negotiators made “tremendous progress as an entire conference,” following days of GOP infighting and less than two weeks before a government funding deadline.

    “We are very close,” McCarthy said Wednesday evening when asked specifically what progress had been made on the GOP short-term bill. “I feel like just got a little more movement to go there,” he added of the new GOP plan. When asked specifically about the topline numbers, he wouldn’t get into details but said: “We’re in a good place.”

    The plan, as outlined by the speaker, would keep the government open for 30 days at $1.471 trillion spending levels, a commission to address the debt and a border security package. Separately, they also agreed to move year-long funding bills at a $1.526 trillion level. That level is below the bipartisan agreement that the speaker reached with the White House to raise the national debt limit.

    The levels are also far lower than what senators from both parties and the White House are willing to accept, meaning it’s unclear how such a deal would avert a government shutdown. With just 10 days left to fund the government, the new plan sets up a standoff with the Senate over how to keep the government open.

    As part of the deal, Republicans now believe they have the votes to move forward on the yearlong spending bill that five conservative hardliners scuttled just Tuesday.

    GOP Rep. Mike Garcia of California said after Wednesday evening’s conference meeting there is now “a little more clarity” on the path forward.

    “We have a little more clarity as to a potential plan moving forward,” Garcia said, adding, “We are still negotiating that final number and trying to figure out exactly what we can do.”

    Some of the people that were previously opposed now signaled they are supportive. Reps. Ralph Norman of South Carolina and Ken Buck of Colorado indicated they will flip to a yes on the rule and will vote to advance the Department of Defense bill Thursday after the speaker came down to the spending levels that Norman had been demanding.

    “Sounds like we’ve got the votes for the rule,” Garcia said, pointing to Buck and Norman as having committed to changing to a “Yes.”

    With McCarthy’s extremely thin margin in the chamber – and Democrats so far united against the GOP proposal – Republican leadership has been negotiating for days to try to win over enough GOP support to pass their legislation.

    When asked about struggling to make progress earlier Wednesday, McCarthy repeated his favorite line, insisting he will never back down from a challenge no matter how messy.

    “I wouldn’t quit the first time I went for the vote for speaker,” McCarthy said, a reference to how he was voted speaker only after 15 rounds and days of voting in January. “The one thing if you haven’t learned anything about me yet, I will never quit.”

    However, an additional potential complicating factor emerged Wednesday night with former President Donald Trump, the front-runner for the 2024 Republican nomination, coming out in opposition to a short-term funding bill as he called on lawmakers to defund the DOJ and the investigations into him.

    McCarthy and his GOP leadership team have been trying to sell the House Republican Conference on unifying behind a plan to fund the government, brokered between the House Freedom Caucus and the more moderate Main Street Caucus over the weekend. But that proposed legislation encountered immediate opposition from more than a dozen far-right Republican lawmakers who wanted deeper spending cuts attached.

    Amid that impasse with conservatives, moderates in the bipartisan House Problem Solver’s Caucus are close to finalizing their own framework on a short-term spending bill that would fund the government for several months at current levels and include Ukraine aid and disaster assistance, according to two sources. Even with Democratic support, that plan would still likely face major challenges – not the least of which is how it would get to the floor before the government runs out of money.

    There are already signs that this alternative plan could face its own strong headwinds – not just with Republicans but with Democrats. Rep. Pramila Jayapal, a progressive Democrat from Washington state, told CNN on “Inside Politics” that she wants a “clean” continuing resolution of funds, a sign that progressives may not back some of the border security provisions that the Problem Solvers Caucus members are eyeing.

    House Democratic leader Hakeem Jeffries met with the House Problem Solvers Caucus earlier Wednesday, and said afterward that they need a bipartisan agreement in line with what was already negotiated in the debt ceiling package.

    “We need to find a bipartisan agreement consistent with what was previously reached,” he said.

    House GOP leadership announced Wednesday night that the House will be in and voting on Friday and Saturday, making official what was expected as the majority struggled to reach an agreement all week.

    The House is expected to pass a rule for the defense appropriations bill Thursday. Assuming the rule passes, the House will then start consideration of the defense bill with final passage expected Friday.

    The thinking would then be to pass the new GOP stopgap plan on Saturday, which is expected to be a full day.

    Members were advised on Tuesday to keep their schedules flexible as weekend votes were possible. Members filtering in and out of Whip Emmer’s office the past two days are insistent that they are making progress, but Rep. Kelly Armstrong of North Dakota told CNN earlier Wednesday that while they are getting closer, they are not close yet.

    Rep. Garrett Graves from Louisiana, who has been in the room for negotiations, had echoed that schedule change and projected Friday and Saturday work.

    “I think we’re going to be here this weekend,” he said.

    When pressed on what exactly they’d be up to and if they’d be able to vote by Saturday, Graves said, “Well, we won’t be having Mardi Gras parties,” indicating they’d be voting.

    Rep. Steve Womack, a Republican from Arkansas who sits on the House Appropriations Committee, lambasted the hardliners, calling it a “breach of duty.”

    “We’ve got a handful of people that are holding the rest of the conference, the majority of our conference kind of held hostage right now and in turn, holding up America,” he told CNN.

    Womack also said this will likely extend into the weekend and that “either it’s gonna be good or it’s gonna be bad.”

    GOP hardliners in the House are eager to play a game of chicken over the end-of-the-month deadline to fund federal agencies, seeking to force the White House and Senate to make a choice: Accept a slew of conservative priorities or risk a debilitating government shutdown.

    And caught in the middle, once again, is Speaker Kevin McCarthy.

    In a private conference call last week, McCarthy urged his colleagues to back a short-term spending deal to avoid an October 1 shutdown and instead focus their energy on the larger funding fight later in the fall, sources on the call told CNN. His argument: The year-long spending bills to fund federal agencies would be better suited to enact cuts and policy changes they have demanded, including on hot-button issues like border security and immigration policy.

    And, he argued, if they spend too much time squabbling among themselves, they’ll end up getting jammed by senators in both parties and forced to accept higher spending levels than they’d like.

    “It’s a great place to have a very strong fight and to hold our ground,” McCarthy told his colleagues, according to a person on the call, referring to having an immigration fight on the bill to fund the Department of Homeland Security – not on short-term funding legislation that the far-right House Freedom Caucus is pushing to use as a bargaining chip.

    As the Senate returns this week after its August recess, and the House reconvenes next week, the two chambers have little time to resolve major differences over funding the government. The two sides are hundreds of billions of dollars apart after McCarthy backed away from a previous deal he cut with the White House and later agreed to pursue deeper cuts demanded by his right-flank.

    Now, the two sides will have to work together to punt the fight until potentially early December and pass a short-term funding bill – all as Congress faces other key end-of-the-month deadlines, such as an extension of federal aviation programs, and as a potential impeachment inquiry against President Joe Biden looms in the House.

    None of it will be that easy.

    The White House and senators from both parties want to tie the short-term funding bill to $24 billion in aid to Ukraine and with another $16 billion in much-needed funds for communities ravaged by a spate of natural disasters. But a contingent of vocal House conservatives are furiously opposed to quickly passing more aid to Ukraine – while GOP sources said McCarthy privately voiced displeasure at the White House for formally unveiling its funding request during the congressional recess and not briefing lawmakers.

    Moreover, to pass legislation in the House by a majority vote, the chamber must first approve a rule – a procedural vote that is typically only supported by the majority party and opposed by the minority party. Yet several hard-right conservatives told CNN they are prepared to take down the rule over the spending bill if their demands aren’t met.

    That would leave McCarthy with a choice: Either side with conservative hardliners and set up a major clash with the White House or cut a deal with Democrats and pass the spending bill by a two-thirds majority, a threshold that would allow them to approve the bill without having to adopt a rule first but could force McCarthy to give more concessions to Democrats.

    But if he works with Democrats to circumvent his far-right, McCarthy risks enraging the very members who have threatened to push for a vote to oust him from the speakership.

    GOP Rep. Mike Simpson of Idaho, who leads one of the appropriations subcommittees, acknowledged that they’ll need Democratic support for both a short-term spending patch and for any longer-term bills to fund the government – which he said could put McCarthy in a predicament.

    “The challenge for McCarthy, and I’ll be real honest with you, is that if he works with the Democrats, obviously, the Democrats are not going to do it for free. They want something. So, it’s going to be a compromise – one of those really bad words in Washington for some reason,” Simpson told CNN. “Then you’re going to find a resolution introduced on the floor to vacate the chair.”

    One GOP lawmaker acknowledged there have been conversations among conservative hardliners about using a “motion to vacate” – a procedural tool that forces a floor vote to oust the speaker – to gain leverage in the funding fight, if they feel like McCarthy isn’t sticking to his spending promises or gives too much away to Democrats.

    A few on the right, who were furious with McCarthy over his bipartisan debt ceiling deal, briefly floated the idea of triggering a motion to vacate this summer, but then dialed back their threat when it became clear there wasn’t much support for the move.

    McCarthy allies say the hard-liners are playing with fire.

    GOP Rep. Don Bacon, who represents a Nebraska swing district won by Biden, said of the right’s hardline approach to spending: “It’s not realistic.”

    “This theory that you gotta have 100% (of what you want), and if you don’t get 100, you’ll take zero – it’s not that the way it works,” he added. “And it’s not good for the country.”

    Part of the McCarthy strategy to get conservative hardliners on board is to channel their energy on other matters that won’t lead to an end-of-the-month shutdown.

    In recent weeks, McCarthy has tried to use the right’s desire to investigate and impeach Biden as part of his argument against a shutdown, warning that their probes into the administration would have to come to a halt if the government were to shut down.

    Meanwhile, the House will consider its homeland spending bill on the floor the week they return from recess, giving the right a fresh opportunity to offer amendments and shape their party’s border policy — and train their focus away from the must-pass short-term extension.

    Democrats are already trying to pin the blame on any shutdown on the House GOP.

    “When the Senate returns next week, our focus will be on funding the government and preventing House Republican extremists from forcing a government shutdown,” Senate Majority Leader Chuck Schumer said in a letter to his colleagues on Friday.

    How McCarthy deals with the immediate spending demands remains to be seen, including whether he’ll agree to pair the short-term spending bill with any aid to Ukraine.

    While Senate GOP Leader Mitch McConnell is a staunch advocate for Ukraine aid, McCarthy has been more circumspect amid loud calls from his right-flank against pouring more money into the war-torn country.

    And as he toured Maui on Saturday, McCarthy acknowledged the need for more disaster relief aid, though it’s unclear if he will separate that package from Ukraine funding — even as the White House and senators in both parties want them to move together.

    Rep. Kevin Hern of Oklahoma, leader of the conservative Republican Study Committee, told CNN that disaster relief and Ukraine “need to be separated.”

    “The president needs to come forward, or the speaker, leadership of the Republican Party, the Democrat Party need to come together to share with the American people what we’re doing, what’s the outcome of this?” Hern said.

    Simpson said of tying Ukraine aid to the short-term spending bill: “That’s a tougher sell. Particularly in our conference.”

    But advocates of more Ukraine aid say that the longer that Congress waits, the more difficult it will be to approve money needed to deter Russian aggression and the brutality of Vladimir Putin’s war.

    “I think we need to get that done because we’re not going to get it done next year, right?” said Sen. Tammy Duckworth, an Illinois Democrat. “Once you get truly into the presidential cycle, everything gets that much more difficult.”

    Hard-line conservatives are already threatening to make McCarthy’s calculus more complicated if he cuts a short-term spending deal with Democrats. Several of them are already threatening to oppose any rule if the bill falls short of their demands – a tactic that they have employed this Congress to bring the House to a halt. It would take just five Republicans to take down a rule, assuming all Democrats vote against it as they typically do.

    Rep. Ralph Norman – who serves on the House Rules Committee, where such a procedural step would originate – told CNN he hasn’t made up his mind yet on the rule.

    But the South Carolina Republican said he has concerns about the supplemental request for Ukraine aid, which he said needs to be offset, as well as top-line funding levels for their remaining spending bills.

    “There is no appetite for getting our financial house in order by anyone of either party,” he said.

    Rep. Matt Gaetz of Florida, another hardliner, also hinted that he may vote against both the short-term spending bill and the rule, but when asked for clarification by CNN, he said: “I’m on a very different decision calculus than this.”

    Gaetz didn’t respond to a follow-up question about what he meant, but later posted on social media a long list of grievances he has with GOP leadership – including on spending issues – and ended his post with: “We are going to have to seize the initiative and make some changes.”

    Some have made their demands directly known to GOP leaders, including Virginia Rep. Bob Good, who said on last week’s conference call that lawmakers shouldn’t fear a potential shutdown, according to a source on the call.

    Other Republicans made clear they want no part of a shutdown – something California Rep. Darrell Issa said is “not constructive.”

    “We will get there,” Issa said of funding the government. “Now if we get there earlier without a shutdown, the American people are better served.”

    When asked how the next few months will shake out, Simpson had some words of warning: “I tell people: buckle up. It’s going to be crazy for September, October, November, December,” Simpson said. “The next four months are going to be wild.”

    With government funding slated to run out September 30, the leaders of the bipartisan House Problem Solvers Caucus told CNN on Sunday that “all options are on the table” to force a vote on their alternative stopgap plan to avert a shutdown.

    There is no consensus plan to keep the government funded, and persistent opposition by a bloc of conservatives to House GOP leadership’s agenda has made any effort to pass a stopgap bill in the House a major challenge.

    While the caucus leaders, Reps. Brian Fitzpatrick and Josh Gottheimer, said they hope House Speaker Kevin McCarthy puts the measure on the floor, they said they have spoken with the parliamentarian about other avenues and raised the possibility of using a discharge petition – an arcane procedural step – to force a vote.

    The procedural tool can be used to force a floor vote, but only if a majority of House members sign on in support. Discharge petitions rarely succeed because of how high the threshold is to clear.

    “We’re going to do whatever it takes to get that bill on the floor. … A discharge petition is one of several options, and a group of us met with the parliamentarian this past week to discuss all the options we have to force a vote on our bill,” Fitzpatrick, a Pennsylvania Republican, told CNN’s Dana Bash on “State of the Union.”

    Gottheimer, a New Jersey Democrat, added: “I think our plan is reasonable. And it deals with the extremes and … instead of burning the place down as, Speaker McCarthy said of the far right, it actually provides a reasonable, commonsense solution working with people like Brian Fitzpatrick who want to get things done.”

    The caucus last week endorsed a potential backup plan if House Republicans are unable to pass their stopgap bill alone. The bill would fund the government through January 11 and include Ukraine aid, disaster response and border security provisions.

    “This is a decision the speaker is gonna have to make. He can bring that reasonable bill to the floor that we’ve proposed, and I guarantee you’re gonna get Democrats (and) Republicans coming together to support it and we can keep the lights on,” Gottheimer said.

    McCarthy, who is under pressure and has faced threats of an ouster, said Saturday he still lacks support from a handful of GOP hardliners to put a stopgap measure on the floor, making a shutdown likely.

    Rep. Tim Burchett, one of the holdouts, told CNN on Sunday he is still a “no” on passing a stopgap funding bill.

    “No, ma’am,” the Tennessee Republican told Bash. “I think it’s completely blowing away our duties. We have a duty to pass a budget.”

    He also said he would strongly consider support for ousting McCarthy if the California Republican cuts a deal with Democrats to keep the government open.

    “That would be something I’d look strongly at, ma’am, if we do away with our duty that we said we’re going to do,” Burchett said.

    McCarthy has been hoping the momentum of a handful of appropriations bills, which will head to the House floor this week, would bring some of those holdouts into the fold. But Burchett’s comments Sunday are the latest indication that hope may be in vain.

    “We’re sticking to our guns and all of a sudden we’re the bad guys because we want to balance our budget,” Burchett said.

    Another holdout, Rep. Matt Gaetz of Florida, said Sunday that McCarthy is in “breach” of promises he made regarding government spending when elected speaker.

    “We should have separate single-subject spending bills. Kevin McCarthy promised that in January, he is in breach of that promise, so I’m not here to hold the government hostage, I’m here to hold Kevin McCarthy to his word,” Gaetz said on Fox News’ “Sunday Morning Futures.”

    Gaetz added it would be fine if some departments shut down for a few days if it meant measures such as the Homeland Security appropriations bill passed first.

    “If, you know, the (departments) of Labor and Education have to shut down for a few days as we get their appropriations in line, that’s certainly not something that is optimal, but I think it’s better than continuing on the current path we are to America’s financial ruin,” Gaetz said.

    The holdouts’ comments come as the White House urges Republicans to find a solution, warning that a government shutdown could threaten crucial federal programs.

    “Funding the government is one of the most basic responsibilities of Congress, and it’s time for Republicans to start doing the job America elected them to do,” President Joe Biden said Sunday at an event held by the Congressional Black Caucus Foundation.

    Speaking on Sunday to CNN’s Bash, Transportation Secretary Pete Buttigieg called on House Republicans to “come to their senses and keep the government running.”

    “This is something that can and should be prevented,” Buttigieg said on “State of the Union.” He echoed Biden administration talking points, saying Republicans should hold up their end of the agreement made this year during debt ceiling negotiations.

    The White House has warned of massive disruptions to air travel if the government shuts down, as tens of thousands of air traffic controllers and Transportation Security Administration personnel will have to work without pay.

    “They’re under enough stress as it is doing that job without having to come into work with the added stress of not receiving a paycheck,” Buttigieg said of air traffic controllers.

    He added, “The American people don’t want to shutdown. From what I can tell, the Senate is ready to go. The administration is ready to go. House Republicans need to come to their senses and keep the government running.”

    President Joe Biden on Thursday signed a $1.7 trillion federal spending bill that includes a number of administration priorities and officially avoids a government shutdown, ending what he called a “year of historic progress.”

    “It’ll invest in medical research, safety, veteran health care, disaster recovery, (Violence Against Women Act) funding – and gets crucial assistance to Ukraine,” Biden wrote in a tweet.

    He added: “Looking forward to more in 2023.”

    Biden signed the bill while vacationing on St. Croix in the US Virgin Islands. The bill was flown to him for signing, the White House said.

    “The White House received the bill from Congress late afternoon on Wednesday. The bill was delivered to the President for his signature by White House staff on a regularly scheduled commercial flight,” a White House official told pool reporters.

    It’s at least the second time this year that an important bill has been flown to Biden for his signature. While on a trip to Asia in May, a bill authorizing about $40 billion in aid to Ukraine was carried by a staffer who was already scheduled to travel to the region. Biden signed the bill while overseas.

    The spending bill represents the final opportunity for Biden and Democrats to put their imprint on government spending before Republicans assume the majority in the House next week. It caps a remarkably productive two years legislatively for Biden, including a Covid-19 relief package, infrastructure bill and a China competitiveness measure.

    The legislation includes $772.5 billion for nondefense discretionary programs and $858 billion in defense funding, according to a bill summary from Democratic Sen. Patrick Leahy, chair of the Senate Committee on Appropriations. That represents an increase in spending in both areas for fiscal year 2023.

    The sweeping package includes roughly $45 billion in emergency assistance to Ukraine and NATO allies, an overhaul of the electoral vote-counting law, protections for pregnant workers, an enhancement to retirement savings rules and a ban on TikTok on federal devices.

    It also will provide a boost in spending for disaster aid, college access, child care, mental health and food assistance, more support for the military and veterans and additional funds for the US Capitol Police, according to Leahy’s summary and one from Sen. Richard Shelby of Alabama, the top Republican on the Senate Appropriations Committee. And the legislation contains several major Medicaid provisions, notably one that could disenroll up to 19 million people from the nation’s health insurance program for low-income Americans.

    However, the bill, which runs more than 4,000 pages, left out several measures that some lawmakers had fought to include. An expansion of the child tax credit, as well as multiple other corporate and individual tax breaks, did not make it into the final bill. Neither did legislation to allow cannabis companies to bank their cash reserves – known as the Safe Banking Act – or a bill to help Afghan evacuees in the US gain lawful permanent residency. And the spending package did not include a White House request for roughly $10 billion in additional funding for Covid-19 response.

    The spending bill, which will keep the government operating through September – the end of the fiscal year, is the product of lengthy negotiations between top congressional Democrats and Republicans.

    Congress originally passed a continuing resolution on September 30 to temporarily fund the government in fiscal year 2023, which began October 1.

    The spending bill is the product of lengthy negotiations between top congressional Democrats and Republicans. Lawmakers reached a “bipartisan, bicameral framework” last week following a dispute between the two parties over how much money should be spent on non-defense domestic priorities. They worked through the weekend to craft the legislation.

    The Senate is expected to vote first to approve the deal this week and then send it to the House for approval before government funding runs out on December 23. The bill would keep the government operating through September, the end of the fiscal year.

    Congress originally passed a continuing resolution on September 30 to temporarily fund the government in fiscal year 2023, which began October 1.

    More aid for Ukraine: The spending bill would provide roughly $45 billion to help support Ukraine’s efforts to defend itself against Russia’s attack.

    About $9 billion of the funding would go to Ukraine’s military to pay for a variety of things including training, weapons, logistics support and salaries. Nearly $12 billion would be used to replenish US stocks of equipment sent to Ukraine through presidential drawdown authority.

    Also, it would provide $13 billion for economic support to the Ukrainian government.

    Other funds would address humanitarian and infrastructure needs, as well as support European Command operations.

    Emergency disaster assistance: The bill would appropriate more than $38 billion in emergency funding to help Americans in the west and southeast affected by recent natural disasters, including tornadoes, hurricanes, flooding and wildfires. It would aid farmers, provide economic development assistance for communities, repair and reconstruct federal facilities and direct money to the Federal Emergency Management Agency’s Disaster Relief Fund, among other initiatives.

    Overhaul of the electoral vote counting law: A provision in the legislation aims at making it harder to overturn a certified presidential election, in a direct response to the January 6 attack on the US Capitol.

    The changes would overhaul the 1887 Electoral Count Act, which then-President Donald Trump tried to use to overturn the 2020 election.

    The legislation would clarify the vice president’s role while overseeing the certification of the electoral result to be completely ceremonial. It also would create a set of stipulations designed to make it harder for there to be any confusion over the accurate slate of electors from each state.

    Higher maximum Pell grant awards: The bill would increase the maximum Pell grant award by $500 to $7,395 for the coming school year. This would be the largest boost since the 2009-2010 school year. About 7 million students, many from lower-income families, receive Pell grants every year to help them afford college.

    Increased support for the military and veterans: The package would fund a 4.6% pay raise for troops and a 22.4% increase in support for Veteran Administration medical care, which provides health services for 7.3 million veterans.

    It would include nearly $53 billion to address higher inflation and $2.7 billion – a 25% increase – to support critical services and housing assistance for veterans and their families.

    The bill also would allocate $5 billion for the Cost of War Toxic Exposures Fund, which provides additional funding to implement the landmark PACT Act that expands eligibility for health care services and benefits to veterans with conditions related to toxic exposure during their service.

    Beefing up nutrition assistance: The legislation would establish a permanent nationwide Summer EBT program, starting in the summer of 2024, according to Share Our Strength, an anti-hunger advocacy group. It would provide families whose children are eligible for free or reduced-price school meal with a $40 grocery benefit per child per month, indexed to inflation.

    It would also change the rules governing summer meals programs in rural areas. Children would be able to take home or receive delivery of up to 10 days worth of meals, rather than have to consume the food at a specific site and time.

    The bill would also help families who have had their food stamp benefits stolen since October 1 through what’s known as “SNAP skimming.” It would provide them with retroactive federal reimbursement of the funds, which criminals steal by attaching devices to point-of-sale machines or PIN pads to get card numbers and other information from electronic benefits transfer cards.

    More money for child care: The legislation would provide $8 billion for the Child Care and Development Block Grant, a 30% increase in funding. The grant gives financial assistance to low-income families to afford child care.

    Also, Head Start would receive nearly $12 billion, an 8.6% boost. The program helps young children from low-income families prepare for school.

    Help to pay utility bills: The bill would provide $5 billion for the Low Income Home Energy Assistance Program. Combined with the $1 billion contained in the earlier continuing resolution, this would be the largest regular appropriation for the program, according to the National Energy Assistance Directors Association. Home heating and cooling costs – and the applications for federal aid in paying the bills – have soared this year.

    Enhance retirement savings: The bill contains new retirement rules that could make it easier for Americans to accumulate retirement savings – and less costly to withdraw them. Among other things, the provisions would allow penalty-free withdrawals for some emergency expenses, let employers offer matching retirement contributions for a worker’s student loan payments and increase how much older workers may save in employer retirement plans.

    More support for the environment: The package would provide an additional $576 million for the Environmental Protection Agency, bringing its funding up to $10.1 billion. It would increase support for enforcement and compliance, as well as clean air, water and toxic chemical programs, after years of flat funding.

    It also would boost funding for the National Park Service by 6.4%, restoring 500 of the 3,000 staff positions lost over the past decade. This would be intended to help the agency handle substantial increases in visitation.

    Plus, the legislation would provide an additional 14% in funding for wildland firefighting.

    Additional funding for the US Capitol Police: The bill would provide an additional $132 million for the Capitol Police for a total of nearly $735 million. It would allow the department to hire up to 137 sworn officers and 123 support and civilian personnel, bringing the force to a projected level of 2,126 sworn officers and 567 civilians.

    It would also give $2 million to provide off-campus security for lawmakers in response to evolving and growing threats.

    Investments in homelessness prevention and affordable housing: The legislation would provide $3.6 billion for homeless assistance grants, a 13% increase. It would serve more than 1 million people experiencing homelessness.

    The package also would funnel nearly $6.4 billion to the Community Development Block Grant formula program and related local economic and community development projects that benefit low- and moderate income areas and people, an increase of almost $1.6 billion.

    Plus, it would provide $1.5 billion for the HOME Investment Partnerships Program, which would lead to the construction of nearly 10,000 new rental and homebuyer units and maintain the record investment from the last fiscal year.

    Increased health care funding: The package would provide more money for National Institutes of Health, the Centers for Disease Control and Prevention and the Assistant Secretary for Preparedness and Response. The funds are intended to speed the development of new therapies, diagnostics and preventive measures, beef up public health activities and strengthen the nation’s biosecurity by accelerating development of medical countermeasures for pandemic threats and fortifying stockpiles and supply chains for drugs, masks and other supplies.

    More resources for children’s mental health and for substance abuse: The bill would provide more funds to increase access to mental health services for children and schools. It also would invest more money to address the opioid epidemic and substance use disorder.

    Tiktok ban from federal devices: The legislation would ban TikTok, the Chinese-owned short-form video app, from federal government devices.

    Some lawmakers have raised bipartisan concerns that China’s national security laws could force TikTok – or its parent, ByteDance – to hand over the personal data of its US users. Recently, a wave of states led by Republican governors have introduced state-level restrictions on the use of TikTok on government-owned devices.

    Enhanced child tax credit: A coalition of Democratic lawmakers and consumer advocates pushed hard to extend at least one provision of the enhanced child tax credit, which was in effect last year thanks to the Democrats’ $1.9 trillion American Rescue Plan. Their priority was to make the credit more refundable so more of the lowest-income families can qualify. Nearly 19 million kids won’t receive the full $2,000 benefit this year because their parents earn too little, according to a Tax Policy Center estimate.

    New cannabis banking rules: Lawmakers considered including a provision in the spending bill that would make it easier for licensed cannabis businesses to accept credit cards – but it was left out of the legislation. Known as the Safe Banking Act, which previously passed the House, the provision would prohibit federal regulators from taking punitive measures against banks for providing services to legitimate cannabis businesses.

    Even though 47 states have legalized some form of marijuana, cannabis remains illegal on the federal level. That means financial institutions providing banking services to cannabis businesses are subject to criminal prosecution – leaving many legal growers and sellers locked out of the banking system.

    FBI headquarters: There was also no final resolution on where the new FBI headquarters will be located, a major point of contention as lawmakers from Maryland – namely House Majority Leader Steny Hoyer – pushed to bring the law enforcement agency into their state. In a deal worked through by Senate Majority Leader Chuck Schumer, the General Services Administration would be required to conduct “separate and detailed consultations” with Maryland and Virginia representatives about potential sites in each of the states, according to a Senate Democratic aide.

    While congressional leaders continue to negotiate a spending deal, the federal government has begun the process of preparing for a potential shutdown, participating in the mandatory but standard process of releasing shutdown guidance to agencies ahead of this Friday’s funding deadline.

    Lawmakers on both sides currently acknowledge they are going to need to pass a week-long stopgap measure to give themselves more time for talks, and officials have emphasized that there is no real likelihood of a government shutdown, but the standard procedure laying out the steps toward bringing non-essential government functions to a halt is underway.

    “One week prior to the expiration of appropriations bills, regardless of whether the enactment of appropriations appears imminent, OMB will communicate with agency senior officials to remind agencies of their responsibilities to review and update orderly shutdown plans, and will share a draft communication template to notify employees of the status of appropriations,” a budget circular document from the Office of Management and Budget states.

    That standard guidance was circulated last Friday, marking seven days before a shutdown could occur absent congressional action.

    Every department and agency has its own set of plans and procedures. Those plans include information on how many employees would get furloughed, which employees are essential and would work without pay (for example, air traffic controllers, Secret Service agents, US Centers for Disease Control and Prevention laboratory staff), how long it would take to wind down operations in the hours before a shutdown, and which activities would come to a halt.

    It’s not the first time the government has been on the brink of a shutdown, and it has happened on multiple occasions. Recently, the government shut down for 35 days, a record length, from December 2018 to January 2019 amid a congressional stalemate over funding for then-President Donald Trump’s border wall. The government also shut down for three days over deadlock during the Trump administration in January 2018. And in 2013, then-President Barack Obama presided over a 16-day partial government shutdown caused by a dispute over the Affordable Care Act and other budget disagreements.

    Lawmakers face a Friday at midnight deadline when government funding is set to expire – and the House and Senate will likely have to pass a short-term extension to avert a shutdown at the end of the week, which would give negotiators more time to try to secure a broader full-year funding deal.

    The other major legislative item lawmakers are working to wrap up before the end of the year is the National Defense Authorization Act, the massive annual must-pass defense policy bill. The NDAA is expected to get a vote in the Senate this week and be approved with bipartisan support.

    The House has already approved the measure so once the Senate votes to pass it, the bill can go to President Joe Biden to be signed into law.

    The approaching deadline had members of Congress and their staffers from both parties, as well as Biden administration officials, continuing to slog through negotiations over the weekend to try to get to an agreement on a spending package.

    “This is the time of the year when there’s no weekends for folks who work on appropriations,” one administration official closely involved in the talks told CNN.

    Over the weekend, both Democrats and Republicans were sharing with one another their “bottom lines” on various fronts, and the White House remained publicly optimistic that an agreement could be reached on an omnibus: “There is absolutely still a path and time for a deal.”

    But if Biden administration officials are still keeping their eyes on the ball on Congress ultimately reaching a deal on a government spending deal, there is also real recognition that lawmakers will need an extra few days – perhaps even a week – of cushion to buy themselves more time. That would be achieved through passing a short-term stop-gap measure called a continuing resolution, or a CR.

    Particularly with that in mind, administration officials also continue to maintain that they do not see any real likelihood of a government shutdown.

    Congressional aides acknowledged to CNN that the weekend talks went better than days prior, which is why Democrats have announced they will not introduce their own Democratic-only omnibus plan on Monday. Republicans on Capitol Hill had been reading a threat for Democrats to introduce their own bills as a messaging exercise that would only further divide negotiators, and by avoiding that messaging exercise, Republicans see a sign that Democrats are serious about trying to get to yes.

    For now, a bipartisan deal on government funding remains elusive. Lawmakers have not yet been able to reach a negotiated agreement for a comprehensive, full-year funding package – known on Capitol Hill as an omnibus – amid a dispute between the two parties over how much money should be spent on non-defense, domestic priorities. Sen. Richard Shelby of Alabama, the ranking Republican member on the Senate Appropriations Committee, has told reporters the two sides are roughly $26 billion apart.

    Republicans are critical of recent domestic spending by Democrats and argue that measures Democrats have passed while they have been in control both chambers of Congress, like the $1.9 trillion pandemic relief bill and the sweeping health care and climate bill, are wasteful and will worsen inflation. Democrats counter by saying those measures were necessary to help the country recover from the devastating impact of the pandemic as well as to tackle other critical priorities. And Democrats said that money to respond to Covid, health care and climate should not mean there should be less money next year for government operations and non-defense, domestic spending.

    The impasse over a broader funding deal is likely to force both sides to agree to pass a short-term funding extension – known as a continuing resolution, or CR – before the fast-approaching Friday deadline on Friday.

    The key question will be how long such an extension would last. It could be as short as one week, a timeframe that would keep the pressure dialed up for lawmakers to reach a broader deal, while still allowing more time for negotiations. Or it could extend the shutdown deadline into the next Congress, which will convene on January 3, and when Republicans take control of the House.

    That change in majority in the House would dramatically alter the dynamic for negotiations and likely make it far harder to reach a broader funding deal. Lawmakers could pass a full-year CR if it looks like a bipartisan funding deal can’t be reached, but leaders in both parties hope to avoid that scenario since it would keep spending flat for the Pentagon as well as domestic priorities.

    Senate GOP leader Mitch McConnell laid out the GOP position in remarks on the Senate floor Thursday. “Our commander-in-chief and his party have spent huge sums on domestic priorities outside the normal appropriations process without a penny for the Defense Department. Obviously, we won’t allow them to now hijack the government funding process, too, and take our troops hostage for even more liberal spending,” McConnell said.

    Senate Appropriations Committee Chairman Patrick Leahy, a Vermont Democrat, outlined the argument for his party in his own floor remarks on Thursday. Republicans, Leahy said, are “demanding steep cuts to programs the American people rely on.”

    Referring to Democratic-passed legislation that Republicans have criticized, Leahy said, “Those bills were meant to get us out of the pandemic, get the nation healthy, and get our economy back on track, and I believe they are accomplishing that goal. They were not meant to fund the basic functions of the American government in fiscal year 2023.”

    While lawmakers continue to negotiate, the federal government has begun the process of preparing for a potential shutdown, participating in the mandatory but standard process of releasing shutdown guidance to agencies ahead of Friday’s funding deadline.

    Officials have emphasized that there is no real likelihood of a government shutdown, but the standard procedure laying out the steps toward bringing non-essential government functions to a halt is underway.

    “One week prior to the expiration of appropriations bills, regardless of whether the enactment of appropriations appears imminent, OMB will communicate with agency senior officials to remind agencies of their responsibilities to review and update orderly shutdown plans, and will share a draft communication template to notify employees of the status of appropriations,” a document from the Office of Management and Budget stated.

    That standard guidance was circulated last Friday, marking seven days before a shutdown could occur absent Congressional action.

    Every department and agency has its own set of plans and procedures. Those plans include information on how many employees would get furloughed, what employees are essential and would work without pay (for example, air traffic controllers, Secret Service agents, US Centers for Disease Control and Prevention laboratory staff), how long it would take to wind down operations in the hours before a shutdown, and what activities would come to a halt.

    A packed legislative to-do list awaits Congress when it returns to session after the midterms – and Democrats, who currently control both chambers, will face a ticking clock to enact key priorities if Republicans win back the House or manage to flip the Senate in the upcoming elections.

    Senate Majority Leader Chuck Schumer has predicted an “extremely busy” lame duck session – the period of time after the midterms and before a new Congress begins in January.

    “We still have much to do and many important bills to consider,” Schumer said in remarks on the Senate floor at the end of September. “Members should be prepared for an extremely, underline extremely, busy agenda in the last two months of this Congress.”

    The jam-packed agenda for the lame-duck session includes: Funding the government to avert a shutdown before the end of the calendar year, passage of the National Defense Authorization Act, or NDAA, the annual must-pass legislation that sets the policy agenda and authorizes funding for the Department of Defense, as well as a vote in the Senate to protect same-sex marriage and the potential consideration of other key pieces of legislation.

    Democrats are still limited in what they can achieve, however, given their narrow majorities in both chambers. With a 50-50 partisan split in the Senate, Democrats lack the votes to overcome the filibuster’s 60-vote threshold – and do not have the votes to abolish the filibuster. As a result, major priorities for liberal voters – like the passage of legislation protecting access to abortion after the Supreme Court overturned Roe v. Wade – will still remain out of reach for the party for the foreseeable future.

    Government funding is the most pressing priority that lawmakers will confront during the lame duck. The current deadline for the expiration of funding is December 16 after the House and Senate passed an extension to avert a shutdown at the end of September.

    Since the funding bill is viewed as must-pass legislation it will likely become a magnet for other priorities that lawmakers may try to tack on to ride along with it. It’s possible that further aid for Ukraine could come up as Ukraine continues to counter Russia’s invasion of the country. While that funding has bipartisan support, some conservatives are balking at the pricey contributions to Ukraine and may scrutinize more closely additional requests from the administration, a dynamic that is dividing Republicans on this key issue.

    Democrats also want more funding for pandemic response, but Republicans have pushed back on that request.

    One issue that may come up during the government funding effort is money for the Department of Justice investigation into the January 6, 2021, attack on the Capitol.

    A House Democratic aide told CNN that final fiscal year 2023 funding levels have yet to be determined. Justice Department needs and resources are part of this ongoing conversation, but under the leadership of Rep. Matt Cartwright, chairman of the House Appropriations subcommittee on commerce, justice, science, and related agencies, the House bill included $34 million that would allow DOJ to fund these prosecutions without reducing their efforts in other areas.

    House Appropriations Committee Chairwoman Rosa DeLauro told CNN in a statement, “I look forward to working with my colleagues on the House and Senate appropriations committees and passing a final 2023 spending package by the December 16th deadline.”

    Meanwhile, the Senate has begun work on the NDAA, and is expected to pass the massive piece of legislation during the lame duck. Consideration of the wide-ranging bill could spark debate and a push for amendments over a variety of topics.

    Republican Sen. Chuck Grassley of Iowa has called for punishing OPEC for its production cut by passing legislation that would hold foreign oil producers accountable for colluding to fix prices – and the senator has said he believes the measure can pass as an amendment to the NDAA. The legislation would clear the way for the Justice Department to sue Saudi Arabia and other OPEC nations for antitrust violations.

    Senate Democrats will also continue confirming judges to the federal bench nominated by President Joe Biden, a key priority for the party.

    A Senate vote to protect same-sex marriage is also on tap for the lame-duck session. In mid-September, the chamber punted on a vote until after the November midterm elections as negotiators asked for more time to lock down support – a move that could make it more likely the bill will ultimately pass the chamber.

    The bipartisan group of senators working on the bill said in a statement at the time, “We’ve asked Leader Schumer for additional time and we appreciate he has agreed. We are confident that when our legislation comes to the Senate floor for a vote, we will have the bipartisan support to pass the bill.” The bill would need at least 10 Republican votes to overcome a filibuster.

    Schumer has vowed to hold a vote on the bill, but the exact timing has not yet been locked in. Democrats have pushed for the vote after the Supreme Court overturned Roe v. Wade, sparking fears that the court could take aim at same-sex marriage in the future.

    The Senate could take up legislation during the lame duck in response to the January 6, 2021, attack by a mob of pro-Trump supporters attempting to overturn the results of the 2020 presidential election.

    Over the summer, a bipartisan group of senators reached a deal to make it harder to overturn a certified presidential election. The proposal would still need, however, to be approved by both chambers. Notably, the Senate proposal has the backing of Senate Minority Leader Mitch McConnell, a Kentucky Republican.

    “I strongly support the modest changes that our colleagues in the working group have fleshed out after literally months of detailed discussions,” McConnell said at the end of September. “I’ll proudly support the legislation, provided that nothing more than technical changes are made to its current form.”

    If the bill passes the Senate, it would also need to clear the House, which in September, passed its own version of legislation to make it harder to overturn a certified presidential election in the future by proposing changes to the Electoral Count Act.

    Passing a bill to to restrict lawmakers from trading stocks is a priority for a number of moderate House Democrats – who may continue to push for the issue to be taken up during the lame duck, though whether there will be a vote is still to be determined and other pressing must-pass items like government funding could crowd out the issue. The House did not vote on a proposal prior to the midterm elections.

    “It’s a complicated issue, as you can imagine, as a new rule for members they have to follow, and their families as I understand, so I think it deserves careful study to make sure if we do something, we do it right,” House Majority Leader Steny Hoyer told CNN last month.

    Meanwhile, it’s not yet clear when exactly the nation will run up against the debt limit and it appears unlikely for now that Congress will act to resolve the issue during the lame-duck session, especially as other must-pass bills compete for floor time. But political battle lines are already being drawn and maneuvering is underway in Washington over the contentious and high-stakes issue.

    A group of House Democrats recently sent a letter to House Speaker Nancy Pelosi and Schumer calling for legislation to “permanently undo the threat posed by the debt limit” during the post-election lame-duck session. The letter, led by Pennsylvania Rep. Brendan Boyle, was signed by several prominent House Democrats, including Caucus Chair Hakeem Jeffries of New York.

    Biden on Friday gave a window into how he’s preparing for a looming political showdown over the debt ceiling, stating unequivocally that he will not relent to Republican lawmakers threatening to send the nation into default if he doesn’t meet their demands, but adding that he doesn’t support efforts from within his own party to abolish the debt limit entirely.

    WASHINGTON (AP) — A veteran senator’s objections over Egypt’s human rights record, including its holding of an estimated 60,000 political prisoners, have compelled the Biden administration to trim a symbolically significant $75 million off its planned annual military aid to that country.

    Senate Appropriations Chairman Patrick Leahy, the senator responsible, said in a statement Monday it was important that U.S. administrations not allow other policy interests to override congressionally mandated attention to Egypt’s poor human rights record, “because the situation facing political prisoners in Egypt is deplorable.”

    The U.S. gives more than $1 billion in military aid annually to Egypt, which it views as a regionally important ally to the U.S. and Israel. That’s despite President Abdel Fattah el-Sissi’s record on human rights, including what rights groups say is the killing, imprisonment and torture of critics of the Egyptian government.

    Congress in recent years has made the U.S. payment of $300 million of that aid contingent on Egypt’s government showing progress on rights, although the State Department can and often does overrule that requirement. Congress’s conditioning of some of Egypt’s security aid makes for an annual public test of U.S. administrations’ balancing of strategic interests and human rights.

    The Biden administration said last month it planned to give a portion, $170 million, of that $300 million. It cited Egypt’s release of 500 political prisoners. Rights advocates, and family members of imprisoned activists, called Egypt’s releases a token.

    Leahy objected to the administration’s decision, urging State to either clarify its standards on the matter or give the money as scholarships to Egyptian students or as military aid to Ukraine, Leahy spokesman David Carle said. The funding remained at an impasse until it hit a Sept. 30 spending deadline, and expired.

    Egyptian news organization Mada Masr first reported the partial block of funding by a senator it did not identify. Reuters first reported it was Leahy.

    In a statement Monday, the State Department said “we will continue to consult closely with Congress as we engage on human rights with the Egyptian government and seek tangible steps to address the concerns shared by the administration and the Congress.”

    Key Senate Democrats are calling for next year’s funding for the Supreme Court to be conditioned on the creation of an ethics code for the justices.

    Sen. Chris Van Hollen, a Maryland Democrat who leads the appropriations subcommittee charged with writing the annual funding bill for the judiciary, has expressed support for the idea, but doing so will ultimately need the backing of GOP lawmakers, and the top Republican on the subcommittee is signaling opposition to the proposal.

    Van Hollen is weighing in as 15 other members of the Democratic caucus – including Sen. Sheldon Whitehouse, a Rhode Island Democrat who chairs the Senate Judiciary subcommittee that oversees the federal bench – are proposing language to be attached to next year’s funding bill that would require the Supreme Court to adopt more transparent processes for recusals and for investigating ethics allegations lodged against the justices.

    They did so in a new letter, obtained by CNN, to Van Hollen and Tennessee Sen. Bill Hagerty, who is the top Republican on the appropriations subcommittee with jurisdiction over the judiciary.

    “It is unacceptable that the Supreme Court has exempted itself from the accountability that applies to all other members of our federal courts, and I believe Congress should act to remedy this problem,” Van Hollen said in a statement shared with CNN Monday. His comments were first reported by The Washington Post.

    Democrats’ interest in leveraging the funding Congress appropriates to the high court is the latest volley in the debate over whether a stronger code of conduct is needed at the Supreme Court, which is not beholden to many of the ethics procedures imposed on lower court judges.

    Van Hollen noted that including an ethics code requirement in the annual appropriations bill will require bipartisan support given the current make-up of Congress, but said he didn’t “see any reason why ensuring that the Supreme Court establish a code of ethics should be a partisan issue.”

    A spokesperson for Hagerty said that an ethics code is a “policy question that is separate from the funding levels for Supreme Court operations and security.”

    “Moreover, Senator Hagerty strongly believes in preserving the independence of the Judicial Branch from political interference intended to force the Court to change its rulings or policies,” the spokesperson said in a statement Monday evening. “Threats to hold the personal security of the justices and their families hostage in exchange for favored policies are no different from court-packing proposals or protests outside the homes of Justices.”

    Some Republicans in the House have indicated openness in the past to pushing for an ethics code for the justices, but congressional GOP leaders have defended conservative justices in the face of claims that they had run afoul of ethical norms.

    The new letter from the Democrats pointed to recent reports that have raised questions about potential conflicts-of-interests issues with the political activities of Justice Clarence Thomas’ spouse, and about an alleged well-financed, secret campaign seeking to influence the high court’s conservatives.

    “The Supreme Court has the tools and authority it needs to develop and implement these changes, including adopting a code of conduct, creating fairer and more transparent recusal rules, and setting up procedures – based on longstanding procedures in the lower courts – to receive and investigate complaints of judicial misconduct,” the letter said. “The only obstacle keeping the Court from adopting these reforms is the Court’s own unwillingness to see them through.”

    They argued that the annual funding bill should withhold $10 million of the Supreme Court’s funding unless the justices adopted an ethics code. The Supreme Court is asking for nearly $151 million in the coming appropriations process for 2024.

    The ethics language the new letter is proposing for the annual appropriations legislation would create more concrete standards for when a justice must disqualify him or herself from a case, as well as a system “for receiving and investigating complaints alleging violations of such public code of ethics or other misconduct by justices of the Court.”

    Currently, justices decide for themselves whether they must recuse themselves from a case. It is unclear what procedures, if any, the Supreme Court uses to review ethics allegations brought against the justices.

    In the past, Chief Justice John Roberts has written that the justices have taken the steps necessary to maintain transparency and the public’s trust.

    “I have complete confidence in the capability of my colleagues to determine when recusal is warranted,” he wrote in a 2011 year-end report. His 2021 report stressed the need for the judicial branch to have “institutional independence,” while implying that the federal bench could be trusted to police itself without the interference of Congress.

    With the Democrats’ new letter to the appropriators, the senators countered that “Congress has broad authority to compel the Supreme Court to institute these reforms, which would join other requirements already legislatively mandated.”

    “And Congress’s appropriations power is one tool for achieving these changes,” the Democrats’ letter said, while citing DC Circuit cases where judges – including Republican appointees – asserted that Congress could use the power of the purse to pressure the Executive Branch to make certain changes.

    The Supreme Court’s press office did not immediately respond to CNN’s inquiry about the funding bill proposal.

    House Republican leadership came into power on a pro-police, tough-on-crime message. Four months later, that position is in limbo.

    The internal differences emerged soon after Republicans took control of the House. In January, an effort to pass a resolution expressing support for law enforcement agencies, which was meant to serve as a messaging tool, fell apart. The House GOP’s behind-the-scenes disagreements reflect growing divisions inside the conference over whether to defund or restrict the Department of Justice and FBI. The contentious political issue is returning to center stage as CNN has learned that some House Republicans are actively sketching out ways to limit certain federal law enforcement programs through the appropriations process.

    The sponsor of the January resolution, GOP Rep. Ken Buck of Colorado, a former federal prosecutor, wanted to offer broad support for all levels of law enforcement. But a faction of hard-line members, led by House Judiciary Chair Jim Jordan of Ohio, wanted to restrict it only to state and local authorities, multiple sources told CNN.

    “The language that they wanted to incorporate was not something that I could agree to,” said Buck.

    Describing the diverging viewpoints over the issue within the House GOP conference, a separate source familiar with the negotiations in January told CNN, “We were starting a big oversight of the FBI, we didn’t want to lock ourselves in here,” referring to the Judiciary committee’s effort to investigate the FBI.

    Conversations with more than a dozen lawmakers since the January dust up reveal that a growing number of House Republicans are proposing ways to act on calls made by former President Donald Trump to crack down on federal law enforcement. Support started building after Trump’s Mar-a-Lago home was searched by the FBI in August 2022, as part of an investigation into the handling of presidential documents, including classified documents. And that support to act on the calls was super-charged by Trump’s indictment by the Manhattan District Attorney at the end of March.

    This comes as Jordan and the “weaponization” subcommittee he leads have waged a protracted campaign against the DOJ and FBI, and as House Judiciary Republicans are considering recommending various budget cuts to DOJ through the Appropriations process, a source familiar with the plans tells CNN.

    One of the cuts House Judiciary Republicans are exploring, which could be proposed as its own legislation or part of a broader House spending package, includes restricting funding to specific DOJ departments that refuse to respond to oversight requests, a source familiar with the discussions tells CNN.

    Other proposals include reigning in the ability for DOJ to give out grants, and clawing back civil asset forfeiture funds obtained through a program that allows the federal government to coordinate with state and local officials to seize cash, drugs, guns and other assets from suspects before they have been convicted of a crime, the source added.

    CNN has also obtained multiple letters sent by House Republicans to the House Committee on Appropriations that outline specific cuts that could be made to DOJ.

    DOJ declined to comment. CNN has reached out to the FBI.

    Democrats, meanwhile, are painting any Republicans who voice support for defunding federal law enforcement as hypocritical, just as Republicans were once framing Democrats as the party that wanted to defund the police. Senate Majority Leader Chuck Schumer, a New York Democrat, has said he will introduce a measure condemning Trump’s calls to defund the DOJ, seeking to create a political liability for Republicans.

    Calls to defund, restructure or decentralize federal law enforcement vary across the House Republican conference, both in degree and specificity. With many moderate Republicans still balking at the idea, and since the conference has yet to reveal its budget, it is unclear if any of these proposals have broad support.

    Some lawmakers on the far right such as Reps. Marjorie Taylor Greene of Georgia, Matt Gaetz of Florida and Paul Gosar of Arizona, have carried Trump’s mantel in calling for a full defund of the FBI.

    GOP Rep. Andy Biggs of Arizona, who floated the idea of defunding the FBI and DOJ at the Conservative Political Action Conference last year, told CNN, “I would suggest that we look internally at a line item by line-item basis in those two areas, DOJ and FBI, and make them justify everything. Start it out at a 0 basis.”

    Buck, meanwhile told CNN, “I will not support any drastic cut in appropriations.”

    While Jordan said he wanted to support rank-and-file agents at the FBI, he said vaguely “everything should be on the table” when asked what parts of federal law enforcement need to be cut and referenced a since withdrawn memo from an FBI field office focusing on extremism in the Catholic Church as an example of the kind of actions he believes need to change. Jordan has often argued, without much specificity, the best way to hold DOJ and FBI accountable is through “the power of the purse.”

    Some House Republicans, however, are more specific about how to restrict certain activities or restructure certain components.

    Rep. Warren Davidson of Ohio, who acknowledged the role Trump has had in swaying members on this issue, told CNN he believes the problem “has less to do with funding and more to do with structure,” and floated an idea of using US Marshals to take over a lot of FBI’s current responsibilities, with “an entirely different law enforcement entity” taking over the bureau’s international aspects.

    Rep. Chip Roy of Texas, who serves on the Judiciary Committee, told CNN he does not believe the FBI needs a new headquarters and said he would like federal law enforcement to focus less on domestic terrorism.

    “I would like to take it back at a minimum to pre-9/11 to focus on crime and working with local and state jurisdictions to combat crime and not be so much dwelling on the domestic terrorism bit, which they exploited in ways that I don’t think is particularly beneficial,” he said.

    Roy was also one of 12 Republicans to send a letter, obtained by CNN, to the Committee on Appropriations in March requesting Congress “prohibit funding” for DOJ to enforce the FACE Act, which protects individuals obtaining an abortion as well as religious freedom.

    Twenty-eight House Republicans sent a separate March letter to the Appropriations subpanel that oversees DOJ funding, which was reviewed by CNN, calling for appropriators to prohibit the federal government from taking “any discriminatory action” against an individual who has the “sincerely held religious belief, or moral conviction that marriage is, or should be recognized as, a union of one man and one woman.”

    Another effort led by Rep. Jim Banks of Indiana to defund “woke programs” and initiatives across the federal government has included letters to each of the 12 House Appropriations subcommittees in March, and calls for no more funding to certain programs within DOJ that target diversity, equity, inclusion and climate.

    Multiple Republicans told CNN that they are looking to Jordan’s “weaponization” subcommittee to outline cuts for the Committee on Appropriations to carry out.

    Rep. Byron Donalds of Florida said the “weaponization” subcommittee must “identify and isolate” what types of cuts to the DOJ and FBI need to be made for GOP appropriators to then “take a scalpel and cut them out.”

    GOP Rep. Darrell Issa, who serves on Jordan’s weaponization subcommittee, said the subpanel’s job is to “expose” parts of the DOJ and FBI he believes to be hurting freedom of speech for appropriators to take up.

    “I think at a minimum, no funds may be used to do ‘X’ are likely to be either in the bill or in amendments, where we specifically deny them certain activities,” the California Republican said. “However, you know, nobody that I know of is talking about defunding these organizations, but defunding programs.”

    Another weaponization committee member, Rep. Dan Bishop, acknowledged to CNN that details of what should be defunded, restructured or decentralized still need to be worked out. But the North Carolina Republican said he intends to see reforms take effect “if I do nothing else in Congress.”

    “The FBI and the Department of Justice obviously require very substantial reform. Precisely what that is, we’ll see,” Bishop said.

    Republicans on the Appropriations committee receiving these requests also present a spectrum of opinions.

    Rep. Andrew Clyde of Georgia, who sits on the specific subcommittee that oversees DOJ’s budget, told CNN, “It seems like that one of the few things that three letter agencies listen to is their budget.”

    Another one of those appropriators, Rep. Steve Womack of Arkansas – who said he saw some “shortcomings” from DOJ and FBI leadership, but offered support to rank-and-file agents – acknowledged of his Republican colleagues on the right, “I will tell you, I know there are members of our conference that would like a pound of flesh.”

    Despite increasing pressure, Appropriations Committee member GOP Rep. Dave Joyce of Ohio said that while things will “take a haircut” as the result of the House GOP’s proposal on the debt ceiling, “in reality, I don’t think there is ever going to be a blanket defund.”

    Looking at the process from across the aisle, the top Democrat on Jordan’s select subcommittee, Del. Stacey Plaskett of the US Virgin Islands, told CNN she is worried about the groundwork Republicans on the subcommittee are laying.

    “I am concerned about them trying to outline through their conspiracy theories and others going down their rabbit holes that they are making an argument that the FBI is an enemy of the state,” she said. “I’m concerned about they’re trying to fracture rule of law here in the country.”

    McCarthy and hardliners reach tentative agreement to resume House floor business | CNN Politics

    Hardline conservatives have agreed to end their blockade of the House floor while they continue discussions with House Speaker Kevin McCarthy about future spending decisions and a new “power-sharing agreement,” according to multiple members leaving the speaker’s office.

    Conservatives who had voted against a procedural vote in retaliation for how GOP leadership handled the debt ceiling deal now say they are willing to support the procedural vote, after they received new commitments from McCarthy about how the California Republican plans to operate going forward, though they said the exact details are still being worked out and did not say whether they would ever be made public or put into a written statement.

    “I think you’re gonna see an agreement to move forward in the next day or two on moving the legislation we wanted to move last week,” said Rep. Bob Good, a Virginia Republican who has repeatedly criticized McCarthy.

    Rep. Ralph Norman, a South Carolina Republican, said of the nearly hourlong meeting in McCarthy’s office: “We aired our issues. We want to see this move forward as a body.”

    Norman said one of the things McCarthy agreed to was to involve conservatives more directly in future decision making.

    A group of hardline conservatives have held up legislative action in the GOP-led House for nearly a week in protest of the deal McCarthy struck with President Joe Biden to raise the nation’s borrowing limit last month. Conservatives wanted the debt ceiling deal to cut more federal spending than it did, and several far-right members of McCarthy’s conference accused him of reneging on commitments he made to them in private in order to win the speakership in January.

    McCarthy told the hardliners Monday that he wouldn’t have cut the debt ceiling deal had he known it would “divide us,” according to a GOP source familiar with the meeting.

    But McCarthy knew at the time that not all his members were going to be on board with the deal, with many of them publicly expressing their concerns with the direction of the talks.

    One of the concessions McCarthy agreed to as part of Monday’s developments was an ironclad commitment to bring a pistol brace bill from GOP Rep. Andrew Clyde of Georgia to the floor. Leadership has agreed to incorporate the bill, which would block a new Bureau of Alcohol, Tobacco, Firearms and Explosives rule on pistol braces, into an upcoming procedural vote.

    That vote, which is slated for Tuesday, will now combine a rule for the pistol brace bill with a rule for a gas stoves bill as well as a bill to rein in the administration’s regulatory powers.

    GOP Rep. Matt Gaetz of Florida said, “The power-sharing agreement that we entered into in January with McCarthy … it has to be renegotiated, so what happened on this debt ceiling bill never happens again.”

    Specifically, Gaetz said the hardliners want more tools to put more “downward pressure on spending,” and want a return to fiscal 2022 spending levels.

    House Appropriations Chairwoman Kay Granger announced Monday night that her panel will take up spending bills that would roll back funding to the levels demanded by the hardliners, a move that could ease tensions between the group and McCarthy while generating backlash from the White House and Senate Democrats.

    Gaetz said that while they’re willing to end their stand against the procedural vote this week, he warned that they’re willing to oppose future procedural votes if they don’t get their way.

    “If there’s not a renegotiated power sharing agreement then perhaps we’ll be here next week,” he said.

    House Freedom Caucus Chairman Scott Perry of Pennsylvania confirmed they’ve reached a “framework for moving forward” but did not provide details.

    Rep. Dusty Johnson of South Dakota, leaving McCarthy’s office, said they have a path forward now but said there will be no votes in the House tonight, as they had previously planned.
