    Serbia’s Suspicious Election

    Civil society has cried foul about irregularities in the parliamentary election, but particularly the municipal election in the capital, Belgrade. In recent times Belgrade has been a hotbed of anti-government protests. That’s one of the reasons it’s suspicious that the ruling Serbian Progressive Party (SNS) came first in the city election.

    Allegations are that the SNS had ruling party supporters from outside Belgrade temporarily register as city residents so they could cast votes. On election day, civil society observers documented large-scale movements of people into Belgrade, from regions where municipal elections weren’t being held and from Bosnia and Herzegovina and Montenegro. Civil society documented irregularities at 14 per cent of Belgrade voting stations. Many in civil society believe this made the crucial difference in stopping the opposition winning.

    The main opposition coalition, Serbia Against Violence (SPN), which made gains but finished second, has rejected the results. It’s calling for a rerun, with proper safeguards to prevent any repeat of irregularities.

    Thousands have taken to the streets of Belgrade to protest about electoral manipulation, rejecting the violation of the most basic principle of democracy – that the people being governed have the right to elect their representatives.

    A history of violations

    The SNS has held power since 2012. It blends economic neoliberalism with social conservatism and populism, and has presided over declining respect for civic space and media freedoms. In recent years, Serbian environmental activists have been subjected to physical attacks. President Aleksandar Vu?i? attempted to ban the 2022 EuroPride LGBTQI+ rights march. Journalists have faced public vilification, intimidation and harassment. Far-right nationalist and anti-rights groups have flourished and also target LGBTQI+ people, civil society and journalists.

    The SNS has a history of electoral irregularities. The December 2023 vote was a snap election, called just over a year and a half since the previous vote in April 2022, which re-elected Vu?i? as president. In 2022, the Organization for Security and Co-operation in Europe (OSCE) pointed to an ‘uneven playing field’, characterised by close ties between major media outlets and the government, misuse of public resources, irregularities in campaign financing and pressure on public sector staff to support the SNS.

    These same problems were seen in December 2023. Again, the OSCE concluded there’d been systemic SNS advantages. Civil society observers found evidence of vote buying, political pressure on voters, breaches of voting security and pressure on election observers. During the campaign, civil society groups were vilified, opposition officials were subjected to physical and verbal attacks and opposition rallies were prevented.

    But the ruling party has denied everything. It’s slurred civil society for calling out irregularities, accusing activists of trying to destabilise Serbia.

    Backdrop of protests

    The latest vote was called following months of protests against the government. These were sparked by anger at two mass shootings in May 2023 in which 17 people were killed.

    The shootings focused attention on the high number of weapons still in circulation after the wars that followed the break-up of Yugoslavia and the growing normalisation of violence, including by the government and its supporters.

    Protesters accused state media of promoting violence and called for leadership changes. They also demanded political resignations, including of education minister Branko Ruži?, who disgracefully tried to blame the killings on ‘western values’ before being forced to quit. Prime Minister Ana Brnabi? blamed foreign intelligence services for fuelling protests. State media poured abuse on protesters.

    These might have seemed odd circumstances for the SNS to call elections. But election campaigns have historically played to Vu?i?’s strengths as a campaigner and give him some powerful levers, with normal government activities on hold and the machinery of the state and associated media at his disposal.

    Only this time it seems the SNS didn’t think all its advantages would be quite enough and, in Belgrade at least, upped its electoral manipulation to the point where it became hard to ignore.

    East and west

    There’s little pressure from Serbia’s partners to both east and west. Its far-right and socially conservative forces are staunchly pro-Russia, drawing on ideas of a greater Slavic identity. Russian connections run deep. In the last census, 85 per cent of people identified themselves as affiliated with the Serbian Orthodox Church, strongly in the sway of its Russian counterpart, in turn closely integrated with Russia’s repressive machinery.

    The Serbian government relies on Russian support to prevent international recognition of Kosovo. Russian officials were only too happy to characterise post-election protests as western attempts at unrest, while Prime Minister Brnabi? thanked Russian intelligence services for providing information on planned opposition activities.

    But states that sit between the EU and Russia are being lured on both sides. Serbia is an EU membership candidate. The EU wants to keep it onside and stop it drifting closer to Russia, so EU states have offered little criticism.

    Serbia keeps performing its balancing act, gravitating towards Russia while doing just enough to keep in with the EU. In the 2022 UN resolution on Russia’s invasion of Ukraine, it voted to condemn Russia’s aggression and suspend it from the Human Rights Council. But it’s resisted calls to impose sanctions on Russia and in 2022 signed a deal with Russia to consult on foreign policy issues.

    The European Parliament is at least prepared to voice concerns. In a recent debate, many of its members pointed to irregularities and its observation mission noted problems including media bias, phantom voters and vilification of election observers.

    Other EU institutions should acknowledge what happened in Belgrade. They should raise concerns about electoral manipulation and defend democracy in Serbia. To do so, they need to support and work with civil society. An independent and enabled civil society will bring much-needed scrutiny and accountability. This must be non-negotiable for the EU.

    Bangladesh: Election with a Foregone Conclusion

    The BNP’s boycott was far from the only issue. A blatant campaign of pre-election intimidation saw government critics, activists and protesters subjected to threats, violence and arrests.

    At the government’s urging, court cases against opposition members were accelerated so they’d be locked away before the election, resulting in a reported 800-plus convictions between September and December 2023. It’s alleged that torture and ill-treatment were used against opposition activists to force confessions. There have been reports of deaths in police custody.

    Police banned protests, and when a rare mass opposition protest went ahead on 28 October police used rubber bullets, teargas and stun grenades. Following the protest, thousands more opposition supporters were detained on fabricated charges. As well as violence from the notorious Rapid Action Battalion (RAB) – an elite unit notorious for excessive and lethal force – and other elements of the police force, opposition supporters faced attacks by Awami League supporters. Journalists have also been smeared, attacked and harassed, including when covering protests.

    As a direct result of the ruling party’s pre-election crackdown, in December 2023 Bangladesh’s civic space rating was downgraded to closed by the CIVICUS Monitor, the collaborative research project that tracks the health of civic space in every country. This places Bangladesh among the world’s worst human rights offenders, including China, Iran and Russia.

    Civil society’s concerns were echoed in November 2023 by UN human rights experts who expressed alarm at political violence, arrests, mass detention, judicial harassment, excessive force and internet restrictions.

    All-out assault

    Such is the severity of the closure of Bangladesh’s civic space that many of the strongest dissenting voices now come from those in exile. But even speaking out from outside Bangladesh doesn’t ensure safety. As a way of putting pressure on exiled activists, the authorities are harassing their families.

    Activists aren’t safe even at the UN. A civil society discussion in the wings of the UN Human Rights Council in November was disrupted by government supporters, with Adilur Rahman Khan, a leader of the Bangladeshi human rights organisation Odhikar, subjected to verbal attacks.

    Khan is currently on bail while appealing against a two-year jail sentence imposed on him and another Odhikar leader in retaliation for their work to document extrajudicial killings. Following the session in Geneva, Khan was further vilified in online news sites and accused of presenting false information.

    Others are coming under attack. Hasina and her government have made much of their economic record, with Bangladesh now one of the world’s biggest garment producers. But that success is largely based on low wages. Like many countries, Bangladesh is currently experiencing high inflation, and garment workers’ recent efforts to improve their situation have been met with repression.

    Workers protested in October and November 2023 after a government-appointed panel raised the minimum wage for garment sector workers to a far lower level than they’d demanded. Up to 25,000 people took part in protests, forcing at least 100 factories to close. They were met with police violence. At least two people were killed and many more were injured.

    Seemingly no one is safe. Nobel laureate Muhammad Yunus, who founded the Grameen Bank that has enabled millions to access small loans, was recently convicted of labour law offences in a trial his supporters denounced as politically motivated. Yunus has long been a target for criticism and threats from the ruling party.

    Democracy in name only

    The quality of Bangladesh’s elections has dramatically declined since the Awami League returned to power in the last reasonably free and fair election in 2008. Each election since has been characterised by serious irregularities and pre-voting crackdowns as the incumbents have done everything they could to hold onto power.

    But this time, while the Awami League victory was as huge as ever, turnout was down. It was almost half its 2018 level, at only 41.8 per cent, and even that figure may be inflated. The lack of participation reflected a widespread understanding that the Awami League’s victory was a foregone conclusion: many Awami League supporters didn’t feel they needed to vote, and many opposition backers had no one to vote for.

    People knew that many supposedly independent candidates were in reality Awami League supporters running as a pseudo-opposition to offer some appearance of electoral competition. The party that came second is also allied with the ruling party. All electoral credibility and legitimacy are now strained past breaking point.

    The government has faced predictably no pressure to abide by democratic rules from key allies such as China and India, although the once-supportive US government has shifted its position in recent years, imposing sanctions on some RAB leaders and threatening to withhold visas for Bangladeshis deemed to have undermined the electoral process.

    If the economic situation deteriorates further, discontent is sure to grow, and with other spaces blocked, protests and their violent repression will surely follow. International partners must urge the Bangladeshi government to find a way to avoid this. More violence and intensifying authoritarianism can’t be the way forward. Instead Bangladesh should be urged to start the journey back towards democracy.

    COP28: Climate Summit in Closed Civic Space

    In short, there’s a lot at stake as the world heads into its next climate summit.

    But there’s a big problem: COP28, the latest in the annual series of conferences of parties (COP) to the UN Framework Convention on Climate Change, will be held in the United Arab Emirates (UAE). This is a country with closed civic space, where dissent is criminalised and activists are routinely detained. It’s also a fossil fuel power bent on continuing extraction.

    At multilateral summits where climate change decisions are made, it’s vital that civil society is able to mobilise to demand greater ambition, hold states and fossil fuel companies and financiers to account and ensure the views of people most affected by climate change are heard. But that can’t happen in conditions of closed civic space.

    Concerning signs

    In September, the UAE was added to the CIVICUS Monitor Watchlist, which highlights countries experiencing significant declines in respect for civic freedoms. Civic space in the UAE has long been closed: no dissent against the government or advocacy for human rights is allowed, and those who try to speak out risk criminalisation. In 2022, a Cybercrime Law introduced even stronger restrictions on online expression.

    There’s widespread torture in jails and detention centres and at least 58 prisoners of conscience have been held in prison despite having completed their sentences. Many of them were part of a group known as the UAE 94, jailed for the crime of calling for democracy. Among the ranks of those incarcerated is Ahmed Mansoor, sentenced to 10 years in jail in 2018 for his work documenting the human rights situation, and held in solitary confinement for over five years and counting.

    Ahead of COP28, civil society has worked to highlight the absurdity of holding such a vital summit in closed civic space conditions. Domestic civil society is unable to influence COP28 and its preparatory process, and it’s hard to see how civil society, both domestic and international, will be able to express itself freely during the summit.

    Civil society is demanding that the UAE government demonstrate that it’s prepared to respect human rights, including by releasing political prisoners – something it’s so far failed to budge on.

    An ominous sign came when the UAE hosted a climate and health summit in April. Participants were reportedly instructed not to criticise the government, corporations, individuals or Islam, and not to protest while in the UAE.

    Civic space restrictions aren’t the only indication the UAE isn’t taking COP28 seriously. The president of the summit, Sultan Ahmed Al Jaber, also happens to be head of the state’s fossil fuel corporation ADNOC, the world’s 11th-biggest oil and gas producer. It’s like putting an arms manufacturer in charge of peace talks. Multiple other ADNOC staff members have roles in the summit. ADNOC is currently talking up its investments in renewable energies, all while planning one of the biggest expansions of oil and gas extraction of any fossil fuel corporation.

    Instead of real action, all the signs are that the regime is instrumentalising its hosting of COP28 to try to launder its reputation, as indicated by its hiring of expensive international lobbying firms. An array of fake social media accounts were created to praise the UAE as host and defend it from criticism. A leaked list of key COP28 talking points prepared by the host made no mention of fossil fuels.

    A summit that should be about tackling the climate crisis – and quickly – is instead being used to greenwash the image of the host government – something easiest achieved if civil society is kept at arm’s length.

    Fossil fuel lobby to the fore

    With civil society excluded, the voices of those actively standing in the way of climate action will continue to dominate negotiations. That’s what happened at COP27, also held in the closed civic space of Egypt, where 636 fossil fuel lobbyists took part – and left happy. Like every summit before it, its final statement made no commitment to reduce oil and gas use.

    The only way to change this is to open the doors to civil society. Civil society has consistently sounded the alarm and raised public awareness of the need for climate action. It’s the source of practical solutions to cut emissions and adapt to climate impacts. It urges more ambitious commitments and more funding, including for the loss and damage caused by climate change. It defends communities against environmentally destructive impacts, resists extraction and promotes sustainability. It pressures states and the private sector to stop approving and financing further extraction and to transition more urgently to more renewable energies and more sustainable practices. These are the voices that must be heard if the cycle of runaway climate change is to be stopped.

    COPs should be held in countries that offer an enabling civic space that allows strong domestic mobilisation, and summit hosts should be expected to abide by high standards when it comes to domestic and international access and participation. That should be part of the deal hosts make in return for the global prestige that comes with hosting high-level events. Civil society’s exclusion mustn’t be allowed to happen again.

    Senegal: Democracy in the Balance?

    Political conflict

    Recent protests have revolved around the populist opposition politician Ousmane Sonko. Sonko came third in the 2019 presidential election and has grown to be the biggest thorn in President Macky Sall’s side. He’s won support from many young people who see the political elite as corrupt, out of touch and unwilling to tackle major social and economic problems such as the country’s high youth unemployment. He’s also been the subject of a recent criminal conviction that his supporters insist is politically motivated.

    On 1 June, Sonko was sentenced to two years in jail for ‘corrupting youth’. This resulted from his arrest on rape charges in March 2021. Although he was cleared of the most serious charges – something women’s rights advocates have expressed concern about – his conviction likely makes him ineligible to stand in the next presidential election.

    Sonko’s arrest in March 2021 triggered protests in which 14 people died. His conviction set off a second wave of protests. Sonko was arrested again on 28 July on protest-related charges, including insurrection. A few days later, the government dissolved his party, Pastef. It’s the first such ban since Senegal achieved independence in 1960.

    All of this gave fresh impetus to Sonko’s supporters, who accuse the government of instrumentalising the judiciary and criminal justice system to stop a credible political threat.

    Repressive reaction

    The latest wave of protests saw instances of violence, including stone-throwing, tyre burning and looting. The state responded with lethal force. According to civil society estimates, since March 2021 over 30 people have been killed, more than 600 injured and over 700 detained.

    In response to the recent protests, the army was deployed in the capital, Dakar. Live ammunition was used and armed people dressed in civilian clothes, evidently embedded with security forces, violently attacked protesters.

    Journalists were harassed and arrested while covering protests. Recent years have seen a rise in verbal and physical attacks on journalists, along with legal action to try to silence them. Several journalists were arrested in relation to their reporting on Sonko’s prosecution. Investigative journalist Pape Alé Niang has been jailed three times in less than one year.

    The government also limited internet access and TV coverage. TV station Walf TV was suspended over its protest coverage. On 1 June, social media access was restricted and on 4 June mobile internet was shut down for several days. In August, TikTok access was blocked. Restrictions harmed both freedom of expression and livelihoods, since many small traders rely on mobile data for transactions.

    Third-term tussle

    A major driver of protests and Sonko’s campaign was speculation that Sall might be tempted to seek a third presidential term. The constitution appeared to be clear on the two-term limit, but Sall’s supporters claimed constitutional amendments in 2016 had reset the count. Thousands mobilised in Dakar on 12 May, organised by a coalition of over 170 civil society groups and opposition parties, to demand that Sall respect the two-term limit.

    On 3 July, Sall finally announced that he wasn’t running again. But it hasn’t ended suspicion that the ruling Alliance for the Republic (APR) party will go to any lengths stay in power, including using the state’s levers to weaken the opposition.

    There’s precedent here: ahead of the Sall’s re-election in 2019, two prominent opposition politicians who might have presented a serious challenge were excluded. In both cases, barely weeks before the election the Constitutional Council ruled them ineligible due to prior convictions on corruption charges that were widely believed to have been politically motivated.

    That Sonko and Pastef might have stood a chance in 2024 was suggested by the results of votes in 2022. In local elections, the APR lost control of Dakar and Sonko was elected mayor of Ziguinchor city. And then in parliamentary elections, the APR lost 43 of its 125 seats and Pastef finished second, claiming 56 seats, leaving no party with a majority.

    Reputation on the line

    Senegal long enjoyed an international reputation for being a relatively stable and democratic country in a region that’s experienced numerous democratic setbacks. With West African countries such as Burkina Faso, Guinea, Mali and now Niger under military control, and others like Togo holding deeply flawed elections, Senegal stood out. It’s held several free elections with changes of power.

    The country’s active and youthful civil society and relatively free media have played a huge part in sustaining democracy. When President Abdoulaye Wade sought an unconstitutional third term in 2012, social movements mobilised. The Y’en a marre (‘I’m fed up’) movement got out the youth vote to oust Wade in favour of Sall. Wade himself rode a similar youth wave in 2000. So Sall and his party are surely aware of the power of social movements and the youth vote.

    A small step forward was taken recently when parliament voted to allow the two opposition candidates who’d been blocked in 2019 to stand in 2024. But the government needs to do much more to show its commitment to democratic rules.

    Upholding protest rights would be a good start. The repeated use of violence and detention of protesters points to a systemic problem. No one has been held to account for killings and other rights violations. It’s high time for accountability.

    Media freedoms need to be respected and people detained for exercising their civic freedoms must be released. For Senegal to live up to its reputation, Sall should strive to enter history as the president who kept democracy alive – not the one who buried it.

    Nepals Same-Sex Marriage Breakthrough

    Nepal will therefore become the second country in Asia, after Taiwan, to recognise the right of all couples to marry. It’s little surprise that, as in many countries that have achieved marriage equality, it’s civil society that’s making the change happen, having brought the decisive court case.

    Civil society’s breakthrough

    Each year brings further important steps forward on two crucial fronts: decriminalisation of same-sex relations in the many countries where they’re still criminalised and recognition of marriage equality in countries that have made more progress.

    Only last month a landmark was achieved in Estonia, which became the first post-Soviet state to legalise same-sex marriage. Now Nepal should become the 36th country in the world where LGBTQI+ people can marry, and the ninth this decade.

    In Nepal, these efforts built on an earlier legal breakthrough, when in 2007 the Supreme Court ruled that the government must take measures to guarantee equal rights and end discrimination against LGBTQI+ people. This too was the result of a legal petition filed by several LGBQTI+ rights organisations following the country’s transition from a monarchy to a democratic republic. LGBTQI+ people had been as active as anyone else in demanding democracy but LGBTQI+ rights weren’t immediately recognised in the new Nepal.

    The 2007 ruling unlocked significant progress: laws that banned gay sex were repealed that year. In 2015, Nepal’s new constitution recognised the fundamental rights of LGBQTI+ people and forbade discrimination. The court also recognised a third gender – a longstanding identity in the cultures of Nepal and other South Asian countries – and the right to have it registered on official documents.

    Nepali schools now offer comprehensive sexuality education to students aged 13 to 15, which includes discussion of LGBTQI+ issues. This came as a result of a campaign by the Blue Diamond Society, a civil society organisation that has led the fight for LGBTQI+ rights in Nepal since 2001.

    As further rights were recognised, continuing marriage discrimination increasingly stood out. A bill to legalise it was drafted soon after the 2007 ruling, consistent with the court’s order to guarantee equal rights, but not much happened after that. It fell on civil society to hold the government to account.

    There are still challenges ahead. As yet, the government hasn’t responded to the court ruling, which suggests it’s hardly in a hurry to legislate. That means people’s rights remain vulnerable to administrative resistance, leading to uneven enforcement. On 13 July, for instance, the Kathmandu District Court rejected an application from a male couple to register their marriage.

    Anti-rights backlash

    Litigation has become the key means by which civil society wins change on LGBTQI+ rights, as reflected by a recent string of decriminalisation rulings in Caribbean countries. This strategy has the potential to bring legal and policy changes that are ahead of social attitudes. That’s been the case in Nepal, where there’s still stigma, social bias and discrimination, and in Nepal’s often fractious politics, some politicians seek to capitalise on that.

    Globally, progress towards the recognition of LGBTQI+ rights is a much stronger trend than regression. But steps forward are inevitably followed by an anti-rights backlash, combined with politically opportunistic efforts to mobilise anti-LGBQTI+ sentiment.

    This backlash is seen in the USA, from which emanates most of the funding that enables anti-rights campaigning around the world, as well as in European countries, including Hungary, Spain and Turkey.

    But it’s felt most strongly in global south countries, where forces opposing LGBTQI+ rights spread disinformation that these are some kind of western imposition. This is apparent in several countries in Africa – such as Kenya, Nigeria and Uganda – and Asia – including Indonesia, where a new criminal code effectively criminalises same-sex activity, and Malaysia, where politicians profit from vilifying LGBTQI+ people.

    That’s why positive moves in Africa and Asia are so valuable: they offer hope to embattled LGBTQI+ people not just domestically but around the world.

    Progress in Nepal should particularly give heart to activists in India, where the Supreme Court is currently considering a case demanding the recognition of same-sex marriage, and Japan, where attempts to win court judgments have encountered setbacks. The good news should also resonate in Thailand, a country with a relatively progressive reputation on LGBTQI+ rights but where same-sex marriage still isn’t allowed.

    Shifting attitudes

    Evidence from the countries that have adopted marriage equality shows that public attitudes to same-sex marriage tend to shift in the wake of legal change. In the countries that introduced it in the early years of this century, it now has majority support.

    That’s also the case in Taiwan, which legalised same-sex marriage in 2019. And there, changing social attitudes have gone hand-in-hand with further reforms: in January, the government recognised same-sex marriages of Taiwanese people with foreign partners. In May, same-sex couples were given full adoption rights.

    When it comes to changing social attitudes in Nepal, the annual roster of Pride events – the main Nepali Pride Parade held each June, a trans parade in December and an LGBQTI+ women’s rally that marks International Women’s Day each March – will remain vital spaces to make LGBTQI+ people more visible and assert their right to exist in public space.

    Nepali civil society will hope that by the next Pride event, the law will have changed. But they’ll do more than hope. They’ll keep campaigning until the law is changed – and after that, they’ll stay alert to backlash and keep pushing back against discrimination.

    Eswatini: Election with No Democracy on the Horizon

    A long history of repression

    There’ll be some notable absentees at the next election. At least two members of parliament (MPs) certainly won’t be running again: Mthandeni Dube and Mduduzi Bacede Mabuza were convicted of terrorism and murder in June. Their real crime was to do what Swazi MPs aren’t supposed to do: during protests for democracy that broke out in 2021, they dared call for political reform and a constitutional monarchy.

    Dube and Mabuza could face up to 20 years in jail. In detention they were beaten and denied access to medical and legal help. They were found guilty by judges appointed and controlled by the king. In Eswatini, the judiciary is regularly used to harass and criminalise those who stand up to Mswati’s power: people such as trade union leader Sticks Nkambule, subject to contempt of court charges for his role in organising a stay-at-home strike demanding the release of Dube and Mabuza. Other activists face terrorism charges.

    But not every crime is so zealously prosecuted. In January, human rights lawyer Thulani Maseko was shot dead by unidentified assailants. Maseko was chair of the Multi-Stakeholder Forum, a network that brings together civil society groups, political parties, businesses and others to urge a peaceful transition to democracy. He’d previously spent 14 months in jail for criticising Eswatini’s lack of judicial independence. He was also Dube and Mabuza’s lawyer. There’s been little evident investigation of his killing.

    There’s plenty more blood on the king’s hands. The 2021 democracy protests were initially triggered by the killing of law student Thabani Nkomonye. At least 46 people are estimated to have been killed in the ensuing protests. Security forces reportedly fired indiscriminately at protesters; leaked footage revealed that the king ordered them to shoot to kill.

    In some areas security forces went house to house, dragging young people out for beatings. Hospitals were overwhelmed with the injured. People who survived shootings weren’t allowed to keep the bullets extracted from them, since this would have constituted evidence. Some bodies were reportedly burned to try to conceal the state’s crimes. When a second wave of protest arose in September 2021, led by schoolchildren, Mswati sent the army into schools, and then closed schools and imposed a nationwide protest ban. Hundreds of protesters and opposition supporters were jailed. A dusk-to-dawn curfew was enforced with the army on the streets and an internet shutdown imposed.

    To this day, no one has been held accountable for the killings. There’s also been zero movement towards reform.

    Farce of an election forthcoming

    Following the intervention of the Southern African Development Community (SADC), the king agreed to hold a national dialogue. But two years on, that hasn’t happened. Instead he held a Sibaya – a traditional gathering in which he was the only person allowed to speak.

    Now the election is going ahead without any constructive dialogue or reform. The chances of reform-minded potential MPs winning significant representation are slimmer than ever. To do so, they’d have to navigate a two-round process that is exclusionary by design, with candidates first needing to win approval at the chiefdom level. No party affiliations are allowed.

    To further rein in those elected, Mswati directly appoints most of the upper house and some of the lower house. And just to make sure, he picks the prime minister and cabinet, can veto legislation and remains constitutionally above the law.

    It’s a system that serves merely to fulfil a kingly fantasy of consultation and pretend to the outside world that democracy exists in Eswatini. Official results from the last two elections were never published, but it’s little wonder than turnout in this electoral farce has reportedly been low.

    With the king unwilling to concede even the smallest demands, evidence suggests that repression is further intensifying ahead of voting. The king has imported South African mercenaries – described as ‘security experts’ – to help enforce his reign of terror. There are reports of a hit list of potential assassinations. Lawyers who might defend the rights of criminalised activists and protesters report coming under increasing threat.

    Time for international pressure

    People have been killed, jailed and forced into exile, but desire for change hasn’t gone away. After all, people in Eswatini aren’t asking for much. They want a competitive vote where they can choose politicians who serve them rather than the king, and they want a constitutional monarchy where the king has limited rather than absolute powers. If they got that, they might even get an economy that works in the public interest, rather than as a vast mechanism designed to funnel wealth to the royal family while everyone else stays poor.

    The pretence of an election shouldn’t fool the outside world. Civil society keeps calling on African regional bodies not to let them down. In May the Multi-Stakeholder Forum urged the African Commission on Human and Peoples’ Rights to back an eight-point plan to respect human rights and enable dialogue. The demands were presented by Tanele Maseko, Thulani Maseko’s widow.

    Eswatini’s activists also expect more of SADC, and of the government of South Africa, the country where so many of them now live in exile. Governments and organisations that claim to stand for democracy and human rights need to exert some pressure for genuine dialogue leading to a transition to democratic rule. They shouldn’t keep letting the king get away with murder.

    Myanmar: Military Junta Gets a Free Pass

    Even humanitarian aid is restricted. Recently the junta refused to allow in aid organisations trying to provide food, water and medicines to people left in desperate need by a devastating cyclone. It’s far from the first time it’s blocked aid.

    Crises like this demand an international response. But largely standing on the sidelines while this happens is the regional intergovernmental body, the Association of Southeast Asian Nations (ASEAN). Its recent summit, held in Indonesia in May, failed to produce any progress.

    ASEAN’s inaction

    ASEAN’s response to the coup was to issue a text, the Five-Point Consensus (5PC), in April 2021. This called for the immediate cessation of violence and constructive dialogue between all parties. ASEAN agreed to provide humanitarian help, appoint a special envoy and visit Myanmar to meet with all parties.

    Civil society criticised this agreement because it recognised the role of the junta and failed to make any mention of the need to restore democracy. And the unmitigated violence and human rights violations are the clearest possible sign that the 5PC isn’t working – but ASEAN sticks to it. At its May summit, ASEAN states reiterated their support for the plan.

    A major challenge is that most ASEAN states have no interest in democracy. All 10 have heavily restricted civic space. As well as Myanmar, civic space is closed in Cambodia, Laos and Vietnam.

    It wouldn’t suit such states to have a thriving democracy on their doorstep, which could only bring greater domestic and international pressure to follow suit. States that repress human rights at home typically carry the same approach into international organisations, working to limit their ability to uphold human rights commitments and scrutinise violations.

    Continuing emphasis on the 5PC hasn’t masked divisions among ASEAN states. Some appear to think they can engage with the junta and at least persuade it to moderate its violence – although reality makes this increasingly untenable. But others, particularly Cambodia – a one-party state led by the same prime minister since 1998 – seem intent on legitimising the junta.

    Variable pressure has come from ASEAN’s chair, which rotates annually and appoints the special envoy. Under the last two, Brunei Darussalam – a sultanate that last held an election in 1965 – and Cambodia, little happened. Brunei never visited the country after being refused permission to meet with democratic leaders, while Cambodia’s prime minister, Hun Sen, visited Myanmar last year. The first post-coup visit to Myanmar by a head of government, this could only be construed as conferring legitimacy.

    Indonesia, the current chair, hasn’t appointed a special envoy, instead setting up an office headed by the foreign minister. So far it appears to be taking a soft approach of quiet diplomacy rather than public action.

    Thailand, currently led by a pro-military government, is also evidently happy to engage with the junta. While junta representatives remain banned from ASEAN summits, Thailand has broken ranks and invited ASEAN foreign ministers, including from Myanmar, to hold talks about reintegrating the junta’s leaders. A government that itself came to power through a coup but should now step aside after an election where it was thoroughly defeated looks to be attempting to bolster the legitimacy of military rule.

    ASEAN states seem unable to move beyond the 5PC even as they undermine it. But the fact that they’re formally sticking with it enables the wider international community to stand back, on the basis of respecting regional leadership and the 5PC.

    The UN Security Council finally adopted a resolution on Myanmar in December 2022. This called for an immediate end to the violence, the release of all political prisoners and unhindered humanitarian access. But its language didn’t go far enough in condemning systematic human rights violations and continued to emphasise the 5PC. It failed to impose sanctions such as an arms embargo or to refer Myanmar to the International Criminal Court (ICC).

    Civil society in Myanmar and the region is urging ASEAN to go further. Many have joined together to develop a five-point agenda that goes beyond the 5PC. It calls for a strategy to end military violence through sanctions, an arms embargo and a referral of Myanmar to the ICC. It demands ASEAN engages beyond the junta, and particularly with democratic forces including the National Unity Government – the democratic government in exile. It urges a strengthening of the special envoy role and a pivoting of humanitarian aid to local responders rather than the junta. ASEAN needs to take this on board.

    A fork in the road

    ASEAN’s current plan is a recipe for continuing military violence, increasingly legitimised by its neighbours’ acceptance. Ceremonial elections could offer further fuel for this.

    The junta once promised to hold elections by August, but in February, on the coup’s second anniversary, it extended the state of emergency for another six months. If and when those elections finally happen, there’s no hope of them being free or fair. In March, the junta dissolved some 40 political parties, including the ousted ruling party, the National League for Democracy.

    The only purpose of any eventual fake election will be to give the junta a legitimising veneer to present as a sign of progress – and some ASEAN states may be prepared to buy this. This shouldn’t be allowed. ASEAN needs to listen to the voices of civil society calling for it to get its act together – and stick together – in holding the junta to account. If it doesn’t, it will keep failing not only Myanmar’s people, but all in the region who reasonably expect that fundamental human rights should be respected and those who kill, rape and torture should face justice.

    Hong Kongs Lights of Freedom Extinguished

    Hong Kong’s authorities are evidently determined to erase any form of acknowledgement that the massacre ever happened. Memorials and artworks commemorating it have been removed. Books that mention the tragedy have disappeared from libraries. Shops selling the LED candles commonly used to mark the occasion were visited by the authorities in the run up to this year’s anniversary.

    The organisation behind the vigil, the Hong Kong Alliance in Support of Patriotic Movements in China, closed itself down in 2021 following a police investigation. Several of its leaders were jailed in March.

    Instead of hosting the usual vigil, this year Hong Kong’s Victoria Park was home to a carnival celebrating Chinese rule. People wanting to mark the occasion had to do so in private.

    This is only the tip of the iceberg. People are mourning not only the many who died on 4 June 1989 but also the Hong Kong vanishing before their eyes.

    Further than ever away from democracy

    When Hong Kong was handed over to China by the UK in 1997, China agreed to maintain the country’s distinct political and economic structures for the next 50 years, under the banner of ‘one country, two systems’.

    Hong Kong’s Basic Law guaranteed civic rights, including freedoms of association, peaceful assembly and expression. China committed to move towards universal suffrage for the election of Hong Kong’s Chief Executive, the head of government.

    But following the democracy protests that burst out in 2019, China has unilaterally torn up that agreement. Three years ago, the government passed the National Security Law, a sweeping piece of legislation that criminalises criticism of the authorities. It’s been used alongside existing laws, such as the law on sedition, to jail leaders of the democracy movement.

    China never made good on its promise of universal suffrage. It’s gone in the opposite direction. Current Chief Executive John Lee – who as security chief led the violent crackdown on democracy protests – was chosen last year by a hand-picked 1,500-member Election Committee, which duly endorsed him as the sole candidate.

    The Legislative Council, Hong Kong’s parliament, had already been neutered. The number of directly elected seats has been slashed and people are disqualified from standing if they question China’s sovereignty over Hong Kong.

    Now the District Councils are in the firing line. When the last elections for the municipal bodies were held, in the thick of democracy protests in November 2019, pro-democracy parties triumphed.

    Such a result is now impossible. In 2021, a law was passed requiring all district councillors to swear an oath of allegiance affirming their ‘patriotism’ for China. Most of the pro-democracy candidates elected in 2019 were disqualified or resigned.

    Now when new district councillors are chosen in November, only 20 per cent of seats will be directly elected. The authorities will fill the rest with their supporters, all vetted to ensure their ‘patriotism’. Little wonder that the Civic Party, one of Hong Kong’s leading pro-democracy parties, recently announced it was closing down.

    A hollowed-out Hong Kong

    Hong Kong was once a country where people felt safe to protest. It had a flourishing media and publishing industry. Now journalists are criminalised and key independent media have shut down.

    Civil society organisations and trade unions have done the same. The remaining organisations are scattered, practising self-censorship. Protests continue to be heavily restricted: this year a planned International Women’s Day march was cancelled after police threats.

    People continue to try to find ways to express dissent, but any small gesture can attract the state’s ire. The death of Queen Elizabeth II gave people an opportunity to use public mourning to express at with the regression since handover. But when a vigil was held during the Queen’s funeral, a harmonica player was arrested for daring to play the tune Glory to Hong Kong, associated with the democracy protests.

    Last year five speech therapists were convicted of producing ‘seditious publications’. Their crime was to produce children’s books in which sheep defend their villages from wolves. This was taken to be an allegory of China’s control of Hong Kong.

    Everyday repression is making Hong Kong a hollowed-out country, its population falling. Some schools face closure due to falling student numbers. Many have fled, not wanting their children to grow up in a country where education is indoctrination. The curriculum has been reworked to teach students loyalty rather than independent thought. Many teachers are leaving the country or taking early retirement.

    With the legal system facing increasing interference and political pressure, lawyers are also among those fleeing.

    A key test will be the trial of Jimmy Lai, former media owner and democracy campaigner. He’s already been found guilty on numerous counts. His newspaper, Apple Daily, once Hong Kong’s most widely read pro-democracy paper, shut down in 2021. He faces trial under the National Security Law, which could mean a life sentence.

    The judges who will try Lai have been handpicked by John Lee. Meanwhile the authorities have tried to prevent Lai’s defence lawyer, UK barrister Tim Owen, representing him in court. In March they passed a law giving Lee the power to ban foreign lawyers working on national security cases. It isn’t looking promising.

    Lai is one of Hong Kong’s 1,508 political prisoners. Even as the population shrinks, the imprisoned population just keeps getting bigger. The candles that commemorate the Tiananmen Square Massacre and the yearning for democracy will continue to flare around the world in exile – but those lights are being extinguished in Hong Kong.

    Uzbekistan: A President for Life?

    Repression betrays image of reform

    Mirziyoyev took over the presidency in 2016 following the death of Islam Karimov, president for 26 years. Karimov ruled with an iron fist; Mirziyoyev has tried to position himself as a reformer by comparison.

    The government rightly won international recognition when Uzbekistan was declared free of the systemic child labour and forced labour that once plagued its cotton industry. The move came after extensive international civil society campaigning, with global action compensating for the inability of domestic civil society to mobilise, given severe civic space restrictions.

    While that systemic problem has been addressed, undoubtedly abuses of labour rights remain. And these are far from the only human rights violations. When one of the proposed constitutional changes announced last July sparked furious protests, the repression that followed belied Mirziyoyev’s reformist image.

    Among the proposed changes was a plan to amend the status of Uzbekistan’s Karakalpakstan region. Formally, it’s an autonomous republic with the right to secede. The surprise announcement that this special status would end brought rare mass protests in the regional capital, Nukus. When local police refused to intervene, central government flew over riot police, inflaming tensions and resulting in violent clashes.

    A state of emergency was imposed, tightly restricting the circulation of information. Because of this, details are scarce, but it seems some protesters started fires and tried to occupy government buildings, and riot police reportedly responded with live ammunition and an array of other forms of violence. Several people were killed and over 500 were reported to have been detained. Many received long jail sentences.

    The government quickly dropped its intended change, but otherwise took a hard line, claiming the protesters were foreign-backed provocateurs trying to destabilise the country. But what happened was down to the absence of democracy. The government announced the proposed change with no consultation. All other channels for expressing dissent being blocked, the only way people could communicate their disapproval was to take to the streets.

    Civic space still closed

    It remains the reality that very little independent media is tolerated and journalists and bloggers experience harassment and intimidation. Vague and broad laws against the spreading of ‘false information’ and defamation give the state ample powers to block websites, a regular occurrence.

    Virtually no independent civil society is allowed; most organisations that present themselves as part of civil society are government entities. Independent organisations struggle to register, particularly when they have a human rights focus. New regulations passed in June 2022 give the state oversight of activities supported by foreign donors, further restricting the space for human rights work.

    It’s been a long time since Uzbekistan held any kind of recognisably democratic vote. The only presidential election with a genuine opposition candidate was held in 1991. Mirziyoyev certainly hasn’t risked a competitive election: when he last stood for office, to win his second term in 2021, he faced four pro-government candidates.

    A flawed vote and a self-serving outcome

    The referendum’s reported turnout and voting totals were at around the same levels as for the non-competitive presidential elections: official figures stated that 90-plus per cent endorsed the changes on a turnout of almost 85 per cent.

    Given the state’s total control, voting figures are hard to trust. Even if the numbers are taken at face value, election observers from the Organization for Security and Co-operation in Europe pointed out that the referendum was held ‘in an environment that fell short of political pluralism and competition’. There was a lack of genuine debate, with very little opportunity for people to put any case against approving the changes.

    State officials and resources were mobilised to encourage a yes vote and local celebrities were deployed in rallies and concerts. State media played its usual role as a presidential mouthpiece, promoting the referendum as an exercise in enhancing rights and freedoms. Anonymous journalists reported that censorship had increased ahead of the vote and they’d been ordered to cover the referendum positively.

    Mirziyoyev is clearly the one who benefits. The key change is the extension of presidential terms from five to seven years. Mirziyoyev’s existing two five-year terms are wiped from the count, leaving him eligible to serve two more. Mirziyoyev has taken the same approach as authoritarian leaders the world over of reworking constitutions to stay in power. It’s hardly the act of a reformer.

    The president remains all-powerful, appointing all government and security force officials. Meanwhile there’s some new language about rights and a welcome abolition of the death penalty – but no hint of changes that will allow movement towards free and fair elections, real opposition parties, independent human rights organisations and free media.

    The constitution’s new language about rights will mean nothing if democratic reform doesn’t follow. But change of this kind was always possible under the old constitution – it’s always been lack of political will at the top standing in the way, and that hasn’t changed.

    Democratic nations, seeking to build bridges in Central Asia to offer a counter to the region’s historical connections with Russia, may well welcome the superficial signs of reform. A UK-based public relations firm was hired to help persuade them. But they should urge the president to go much further, follow up with genuine reforms, and allow for real political competition when he inevitably stands for his third term.

    Fiji: Deeper Democracy or Continuing Danger?

    Rabuka was hardly a new face, having been prime minister in the 1990s, and both Bainimarama and Rabuka had previously led military coups. For Fiji’s civil society, the question was whether this political shift would bring improvements in civic and democratic freedoms. Bainimarama’s government had shown itself increasingly intolerant of dissent.

    People who criticised the government were subjected to harassment and arrest. In July 2021, nine opposition politicians were arrested, questioned and accused of inciting unrest. In 2020, opposition party offices were raided by police in response to social media posts critical of the government.

    The outgoing government used the Public Order Act to restrict protests, including by opposition parties. The Fiji Trade Union Congress was repeatedly denied permission to march and its leader charged with public order offences. Police often used excessive force against protests, with impunity. There was, in short, much room for improvement.

    Positive steps on media freedom

    The most encouraging move so far is the repeal of the Media Industry Development Act. This law, passed under the Bainimarama government, established a highly interventionist government-controlled media regulator. Journalists could be jailed for two years and media outlets slapped with heavy fines if their reporting was judged to go against the national or public interest – vague terms open to broad interpretation. This encouraged self-censorship.

    The law was one of the main reasons Fiji was the lowest-ranking Pacific Island nation on Reporters Without Borders’ World Press Freedom Index. Media freedom constraints came from the top, with the government favouring state-aligned media, including by withholding advertising from more critical outlets.

    Now the media and civil society will be looking for the government to go further. A sedition law that can bring extensive jail sentences remains in need of reform. And beyond this, the government needs to actively support the development of independent Fijian media, including through the fairer distribution of ad spending.

    The new government has also moved to rebuild relationships with trade unions. In February it confirmed it would re-establish an effective tripartite forum that brings together government, trade unions and employers; its predecessor was accused of not taking this seriously. The new government has said it will bring to an end the harassment, intimidation and arrest of union leaders. Unions will work to hold the government to these promises.

    A fall from grace

    These changes have come against a backdrop of continuing political polarisation. It’s been quite the journey for Bainimarama since losing power. In February he was suspended from parliament. This came after he used his first speech as leader of the opposition to deliver a stinging critique of Fiji’s president, Ratu Wiliame Katonivere.

    In his speech, Bainimarama appealed to the military to ‘not forsake their constitutional role’. This seemed a coded plea for military intervention: the 2013 constitution, introduced by Bainimarama, gives the military the power to intervene to ensure the ‘safety and security of the country’. When he was still prime minister, as post-electoral negotiations were taking place, Bainimarama had ordered the military onto the streets.

    Bainimarama’s response to his suspension was to resign from parliament. But he made clear his intent to stay politically active and remains party leader.

    Last month Bainimarama was charged with abuse of office while prime minister. He was granted bail after pleading not guilty. He’s alleged to have intervened to stop a police investigation into alleged corruption at the University of the South Pacific. Police Commissioner Sitiveni Tukaituraga Qiliho, currently suspended, is also charged with abuse of office for the same case and has also pleaded not guilty.

    Dangers ahead

    The obvious danger is that Bainimarama, no longer confined by parliamentary niceties, could seek to stir unrest through sensationalism and disinformation, which could offer a pretext for his supporters in the military to intervene. The spectre of military rule is never far away in Fiji. There have been four coups since independence in 1970. Rabuka led two in 1987 and then Bainimarama headed coups in 2000 and 2006. In this context, it’s ominous that in January the head of the army expressed concern about ‘sweeping changes’ being introduced by the new government.

    On all occasions the pretext for coups has been ethnic unrest, with Fiji’s population broadly divided between Indigenous Fijians and people of Asian heritage. Civil society and the international community will need to stay alert to any attempts to foster division and mobilise one population group against the other.

    At the same time the new government needs to beware of fuelling narratives that it’s being vindictive towards Bainimarama and his party. There’s a need to ensure that diverse points of view can be aired – including from the new opposition. As a former coup leader, Rabuka needs to keep proving his commitment to democracy.

    What happens next in Fiji is of concern not just for Fijians but for the region, since the country is a major hub and host of key regional institutions. China and the USA, along with Australia, are trying to build closer relations with Fiji as they compete for influence among Pacific Island nations. So whether Fiji becomes more democratic and opens up civic space matters.

    In these early days of the new government there can be no room for complacency. Fiji’s civil society must be supported and enabled as a vital democratic force. And it must keep on engaging constructively to ensure that government promises are followed by deeds that advance rights.

    On one side is the army, headed by Sudan’s current leader, General Abdel Fattah al-Burhan. On the other are the Rapid Support Forces (RSF), a paramilitary group led by General Mohamed Hamdan Dagalo, commonly known as Hemedti. Both sides blame the other and say they will refuse to negotiate.

    The two worked together in the October 2021 coup that overthrew a transitional government, put in place in August 2019 after long-time dictator Omar al-Bashir was ousted following a popular uprising. They were never committed to democracy. Military forces initially tried to suppress democracy protests with lethal violence. The grimmest day came on 3 June 2019, when the RSF ended a sit-in with indiscriminate gunfire, killing over 100 people. There has been no accountability for the violence.

    The October 2021 military coup, which brought mass protests and civil disobedience, was followed by a short-lived and palpably insincere attempt at a civilian-military power-sharing deal that only lasted from November 2021 to January 2022. Protests, and military violence against them, continued. December 2022 saw the signing of a deal between the military and some civilian groups.

    This deal was supposed to kickstart a two-year transition to democracy. Some pro-democracy groups and political parties rejected the plan, but the international community urged all sides to get behind it.

    The army was already seeking to backtrack on its commitments before the fighting began. Now those who doubted the sincerity of the two forces’ intentions and willingness to hand over power have been proved right.

    Civilians in the firing line

    Relations between the two military leaders had become increasingly strained, and fighting finally broke out on 15 April. Attempts at a humanitarian ceasefire have so far come to nothing.

    Civilians are in the firing line. There’s much confusion on the ground, making it hard to get accurate numbers of casualties, but currently over 300 civilians are reported killed, with thousands injured.

    Khartoum’s major sites of contestation, such as the airport and military bases, nestle side by side with civilian housing, leaving people vulnerable to airstrikes. People are stuck in their homes and at workplaces with limited supplies of food, and water and electricity have been cut. Some have had their homes seized by RSF soldiers. Thousands have fled.

    Many hospitals have been forced to evacuate or are running out of vital supplies, and there are reports of attacks on health facilities. There are also reports that UN staff and other aid workers are being targeted and offices of humanitarian organisations have been looted.

    A battle for power

    The origins of the current crisis lie in al-Bashir’s deployment of paramilitary forces, the Janjaweed, to brutally crush a rebellion in Darfur in 2003. The violence was such that al-Bashir remains subject to an International Criminal Court arrest warrant on charges of genocide, crimes against humanity and war crimes.

    In recognition of its brutal effectiveness, al-Bashir formally reorganised the Janjaweed into the RSF. It suited him to have two forces he could play off against each other, although ultimately they worked together to oust him. The tensions that have built since partly reflect a clash of cultures between the two leaders and Hemedti’s evident ambition for the top job.

    But mostly it’s a competition for political and economic supremacy. The army has always been the power behind the presidency, and it’s said to control major companies, having taken over many businesses once owned by al-Bashir and his inner circle.

    Hemedti has his own sources of wealth, including illegal gold mining – something that connects him with Russia, with mercenary forces from the shadowy Wagner Group reportedly guarding goldmines in return for gold exports to Russia. Now Wagner is allegedly supplying the RSF with missiles.

    Hemedti had positioned himself as supportive of transitional processes, a ruse that enabled him to dispute the army’s power. Al-Burhan was always a compromised figure, supposedly leading Sudan through transition while also defending the army’s extensive interests. Proposals to integrate the two forces appear to have been the final straw, threatening to erode Hemedti’s power base, making this an existential struggle.

    International failure

    Democratic states that backed the transition plan wanted to believe in it and basically hoped for the best.

    Self-interest has never been far away from the calculations of outside forces either. In recent years, EU funding indirectly found its way to the RSF for its border control role, helping prevent people making their way to Europe; the EU’s preoccupation with controlling migration trumped democracy and human rights concerns.

    The Egyptian government, an influential player in Sudan, is meanwhile squarely behind al-Burhan: it wants its domestic model of repressive government by a military strongman applied in its southern neighbour. Russia strongly backs Hemedti, while Saudi Arabia and the United Arab Emirates might have no strong preference between the two as long as the outcome isn’t democracy.

    What all the approaches taken have in common is that they’re largely top-down, investing faith in leaders while failing to address the tensions that led to violence. Now the limitations of that approach should be evident.

    Sudan’s democracy movement has been consistently ignored. But people don’t want their futures to come down to a dismal choice of two warlords. This conflict must put an end to any notion that either military head can be expected to lead a transition to democracy.

    Democratic states need to hold a stronger line on demanding not only that the conflict ends but that a genuine, civilian-led transition follows. With this must come accountability for violence.

    From now on, the outside world must listen to and be guided by Sudanese civil society voices – in restoring peace, and in bringing about democracy.

    Civil Society a Vital Force for Change Against the Odds

    The world has seen a great wave of protests in 2022 and 2023, many of them sparked by soaring costs of living. But these and other actions are being met with a ferocious backlash. Meanwhile multiple conflicts and crises are intensifying threats to human rights.

    Vast-scale human rights abuses are being committed in Ukraine, women’s rights are being trampled on in Afghanistan and LGBTQI+ people’s rights are under assault in Uganda, along with several other countries. Military rule is again being normalised in multiple countries, including Mali, Myanmar and Sudan, and democracy undermined by autocratic leaders in El Salvador, India and Tunisia, among others. Even supposedly democratic states such as Australia and the UK are undermining the vital right to protest.

    But in the face of this onslaught civil society continues to strive to make a crucial difference to people’s lives. It’s the force behind a wave of breakthroughs on g abortion rights in Latin America, most recently in Colombia, and on LGBTQI+ rights in countries as diverse as Barbados, Mexico and Switzerland. Union organising has gained further momentum in big-brand companies such as Amazon and Starbucks. Progress on financing for the loss and damage caused by climate change came as a result of extensive civil society advocacy.

    The latest State of Civil Society Report from CIVICUS, the global civil society alliance, presents a global picture of these trends. We’ve engaged with civil society activists and experts from around the world to understand how civil society is responding to conflict and crisis, mobilising for economic justice, defending democracy, advancing women’s and LGBTQI+ rights, calling for climate action and urging global governance reform. These are our key findings.

    Civil society is playing a key role in responding to conflicts and humanitarian crises – and facing retaliation

    Civil society is vital in conflict and crisis settings, where it provides essential services, helps and advocates for victims, monitors human rights and collects evidence of violations to hold those responsible to account. But for doing this, civil society is coming under attack.

    Catastrophic global governance failures highlight the urgency of reform

    Too often in the face of the conflicts and crises that have marked the world over the past year, platitudes are all international institutions have had to offer. Multilateral institutions have been left exposed by Russia’s invasion of Ukraine. It’s time to take civil society’s proposals to make the United Nations more democratic seriously.

    People are mobilising in great numbers in response to economic shock – and exposing deeper problems in the process

    As it drove a surge in fuel and food prices, Russia’s war on Ukraine became a key driver of a global cost of living crisis. This triggered protests in at least 133 countries where people demanded economic justice. Civil society is putting forward progressive economic ideas, including on taxation, connecting with other struggles for rights, including for climate, gender, racial and social justice.

    The right to protest is under attack – even in longstanding democracies

    Many states, unwilling or unable to concede the deeper demands of protests, have responded with violence. The right to protest is under attack all over the world, particularly when people mobilise for economic justice, democracy, human rights and environmental rights. Civil society groups are striving to defend the right to protest.

    Democracy is being eroded in multiple ways – including from within by democratically elected leaders

    Economic strife and insecurity are providing fertile ground for the emergence of authoritarian leaders and the rise of far-right extremism, as well for the rejection of incumbency. In volatile conditions, civil society is working to resist regression and make the case for inclusive, pluralist and participatory democracy.

    Disinformation is skewing public discourse, undermining democracy and fuelling hate

    Disinformation is being mobilised, particularly in the context of conflicts, crises and elections, to sow polarisation, normalise extremism and attack rights. Powerful authoritarian states and far-right groups provide major sources, and social media companies are doing nothing to challenge a problem that’s ultimately good for their business model. Civil society needs to forge a joined-up, multifaceted global effort to counter disinformation.

    Movements for women’s and LGBTQI+ rights are making gains against the odds

    In the face of difficult odds, civil society continues to drive progress on women’s and LGBTQI+ rights. But its breakthroughs are making civil society the target of a ferocious backlash. Civil society is working to resist attempts to reverse gains and build public support to ensure that legal changes are consolidated by shifts in attitudes.

    Civil society is the major force behind the push for climate action

    Civil society continues to be the force sounding the alarm on the triple threat of climate change, pollution and biodiversity loss. Civil society is urging action using every tactic available, from street protest and direct action to litigation and advocacy in national and global arenas. But the power of the fossil fuel lobby remains undimmed and restrictions on climate protests are burgeoning. Civil society is striving to find new ways to communicate the urgent need for action.

    Civil society is reinventing itself to adapt to a changing world

    In the context of pressures on civic space and huge global challenges, civil society is growing, diversifying and widening its repertoire of tactics. Much of civil society’s radical energy is coming from small, informal groups, often formed and led by women, young people and Indigenous people. There is a need to support and nurture these.

    We believe the events of the past year show that civil society – and the space for civil society to act – are needed more than ever. If they really want to tackle the many great problems of the world today, states and the international community need to take some important first steps: they need to protect the space for civil society and commit to working with us rather than against us.

    A proposed ‘foreign agents’ law would have required civil society organisations (CSOs) and media outlets in Georgia receiving over 20 per cent of funding from outside the country to register as a ‘foreign agent’. Non-compliance would have been punishable with fines and even jail sentences.

    The law’s proponents, including Prime Minister Irakli Garibashvili, claimed it was modelled on one passed in the USA in 1938. The US law was introduced to check the insidious spread of Nazi propaganda in the run-up to the Second World War, and wasn’t targeted at CSOs.

    For civil society it was clear the source of inspiration was much more recent and closer to home: Russia’s 2012 law, since extended several times, which allows the state to declare a ‘foreign agent’ any person or organisation it judges to be under foreign influence. The law has been used extensively to stigmatise civil society and independent media. It’s been imitated by other repressive states looking for ways to stifle civil society.

    In Georgia, as in Russia, the ‘foreign agent’ terminology is deeply suggestive of espionage and treachery. Any organisation it’s applied to can expect to be instantly viewed with suspicion. This meant the law would stigmatise CSOs and media organisations.

    Alarmingly, the proposed law was no isolated event: the government has been ramping up the rhetoric about groups ‘opposing the interests of the country’ and the need to save Georgia from foreign influence.

    The initial proposal for the law came from a populist political faction, People’s Power, that split from the ruling party, Georgian Dream, but works in coalition with it. People’s Power has a track record of criticising foreign funding, particularly from the USA, which it claims undermines Georgia’s sovereignty, and has accused CSOs and the main opposition party of being US agents.

    CSOs insist they already adhere to high standards of accountability and transparency, making any further regulations unnecessary. They point to the vital role civil society has played over the years in establishing democracy in Georgia, providing essential services the state fails to offer and helping to introduce important human rights protections.

    This work necessarily requires financial support, and since there are few resources within Georgia, that means foreign funding, including from the European Union (EU) and other international bodies – sources the government is also happy to receive funding from.

    The power of protest

    The scale of the reaction took the government by surprise. Many states around the world have enacted repressive civil society laws, and it’s often hard to get the public to take an interest. But the issue cut through because of the larger concerns many people have about Russian influence, heightened by the war on Ukraine.

    Russia is an ever-present issue in Georgian politics. The two countries went to war in 2008, and two breakaway parts of Georgia – Abkhazia and South Ossetia – claim autonomy and receive heavy Russian support. Georgian Dream, founded by billionaire business tycoon Bidzina Ivanishvili, has an official policy of pragmatism towards Russia while also cultivating links with the EU – but opponents accuse it and People’s Power of being too close to Russia.

    Many see the country’s future as lying within a democratic Europe and fear returning to Russia’s domination. This made the proposed law about a fundamental question of national identity.

    That’s why, when parliament started discussing the bill in early March, thousands gathered over several nights, many waving Georgian and EU flags and chanting ‘no to the Russian law’.

    When the bill passed its hurried first reading it sparked some violent clashes. Some people threw stones and the police responded disproportionately with teargas, stun grenades, pepper spray and water cannon. But people kept protesting and the government feared the situation could spiral out of its control. So, at least for the time being, it backed down.

    What next?

    The immediate threat may have passed, but it isn’t game over. The government hasn’t said the law was a bad idea, merely that it failed to explain it properly to the public and withdrew it to reduce confrontation.

    Georgia was one of three countries that applied to join the EU following the start of Russia’s invasion of Ukraine. While the other two, Moldova and Ukraine, were quickly granted EU candidate status, Georgia wasn’t.

    The EU cited the need for both economic and political reforms. This includes measures to reduce corruption, organised crime and oligarchic influence, improve the protection of human rights and enable civil society to play a stronger role in decision-making processes. In introducing the proposed law, the government took steps further away from the EU and made clear it doesn’t trust civil society.

    This raises concerns the bill could return in some revised form, or other restrictions on civil society could be introduced. In numerous countries, the kind of verbal attacks on civil society recently made by the government have led to restrictions.

    But Garibashvili should be more attentive to the message of the protests. By taking to the streets, people told the government they’re paying attention and disagree with its current direction – and forced it to back down. Civil society has shown its power, and deserves to be listened to rather than treated with suspicion.

    But Bialiatski couldn’t travel to Oslo to collect his award. He’d been detained in July 2021 and held in jail since. This month he was found guilty on trumped-up charges of financing political protests and smuggling, and handed a 10-year sentence. His three co-defendants were also given long jail terms. There are many others besides them who’ve been thrown in prison, among them other staff and associates of Viasna, the human rights centre Bialiatski heads.

    Crackdown follows stolen election

    The origins of the current crackdown lie in the 2020 presidential election. Dictator Alexander Lukashenko has held power since 1994, but in 2020 for once a credible challenger slipped through the net to stand against him. Sviatlana Tsikhanouskaya ran against Lukashenko after her husband, democracy activist Sergei Tikhanovsky, was arrested and prevented from doing so. Her independent, female-fronted campaign caught the public’s imagination, offering the promise of change and uniting many voters.

    Lukashenko’s response to this rare threat was to arrest several members of Tsikhanouskaya’s campaign staff, along with multiple opposition candidates and journalists, introduce additional protest restrictions and restrict the internet. When all of that didn’t deter many from voting against him, he blatantly rigged the results.

    This bare-faced act of fraud triggered a wave of protests on a scale never seen under Lukashenko. At the peak in August 2020, hundreds of thousands took to the streets. It took a long time for systematic state violence and detentions to wear the protests down.

    Everything Lukashenko has done since is to suppress the democracy movement. Hundreds of civil society organisations have been forcibly liquidated or shut themselves down in the face of harassment and threats. Independent media outlets have been labelled as extremist, subjected to raids and effectively banned.

    Jails are crammed with inmates: currently it’s estimated Belarus has 1,445 political prisoners, many serving long sentences after trials at biased courts.

    Lukashenko’s only ally

    Lukashenko’s repression is enabled by an alliance with an even bigger pariah: Vladimir Putin. When the European Union and democratic states applied sanctions in response to Lukashenko’s crackdown, Putin provided a loan that was crucial in helping him ride out the storm.

    This marked a break in a long strategy of Lukashenko carefully balancing between Russia and the west. The effect was to bind the two rogue leaders together. That’s continued during Russia’s war on Ukraine. When the invasion started, some of the Russian troops that entered Ukraine did so from Belarus, where they’d been staging so-called military drills in the days before. Belarus-based Russian missile launchers have also been deployed.

    Just days after the start of Russia’s invasion, Lukashenko pushed through constitutional changes, sanctioned through a rubber-stamp referendum. Among the changes, the ban on Belarus hosting nuclear weapons was removed.

    Last December Putin travelled to Belarus for talks on military cooperation. The two armies took part in expanded military training exercises in January. Following the constitutional changes, Putin promised to supply Belarus with nuclear-capable missiles; Belarus announced these were fully operational last December.

    Belarussian soldiers haven’t however been directly involved in combat so far. Putin would like them to be, if only because his forces have sustained much higher-than-expected losses and measures to fill gaps, such as the partial mobilisation of reservists last September, are domestically unpopular. Lukashenko has struck a balance between belligerent talk and moderate action, insisting Belarus will only join the war if Ukraine attacks it.

    That may be because Belarus’s enabling of Russia’s aggression has made people only more dissatisfied with Lukashenko. Many Belarussians want no involvement in someone else’s war. Several protests took place in Belarus at the start of the invasion, leading to predictable repression similar to that seen in Russia, with numerous arrests.

    Crucially, Belarus’s security forces stuck by Lukashenko at the peak of protests; if they’d defected, the story could have been different. Full involvement in the war would likely see even Lukashenko loyalists turn against him, including in the military. Soldiers might refuse to fight. It would be a dangerous step to take. As Russia’s war drags on, Lukashenko could find himself walking an increasingly difficult tightrope.

    Two countries, one struggle

    It’s perhaps with this in mind that Lukashenko’s latest repressive move has been to extend the death penalty. State officials and military personnel can now be executed for high treason. This gives Lukashenko a gruesome new tool to punish and deter defections.

    As well as worrying about their safety, Belarus’s activists – in exile or in jail – face the challenge of ensuring the cause of Belarussian democracy isn’t lost in the fog of war. They need continuing solidarity and support to make the world understand that their struggle against oppression is part of the same campaign for liberty being waged by Ukrainians, and that any path to peace in the region must also mean democracy in Belarus.

    Russia and Ukraine: Civil Society Repression and Response

    Ukraine’s civil society is doing things it never imagined it would. An immense voluntary effort has seen people step forward to provide help.

    Overnight, relief programmes and online platforms to raise funds and coordinate aid sprang up. Numerous initiatives are evacuating people from occupied areas, rehabilitating wounded civilians and soldiers and repairing damaged buildings. Support Ukraine Now is coordinating support, mobilising a community of activists in Ukraine and abroad and providing information on how to donate, volunteer and help Ukrainian refugees in host countries.

    In a war in which truth is a casualty, many responses are trying to offer an accurate picture of the situation. Among these are the 2402 Fund, providing safety equipment and training to journalists so they can report on the war, and the Freefilmers initiative, which has built a solidarity network of independent filmmakers to tell independent stories of the struggle in Ukraine.

    Alongside these have come efforts to gather evidence of human rights violations, such as the Ukraine 5am Coalition, bringing together human rights networks to document war crimes and crimes against humanity, and OSINT for Ukraine, where students and other young people collect evidence of atrocities.

    The hope is to one day hold Putin and his circle to account for their crimes. The evidence collected by civil society could be vital for the work of United Nations monitoring mechanisms and the International Criminal Court investigation launched last March.

    As is so often the case in times of crisis, women are playing a huge role: overwhelmingly it’s men who’ve taken up arms, leaving women taking responsibility for pretty much everything else. Existing civil society organisations (CSOs) have been vital too, quickly repurposing their resources towards the humanitarian and human rights response.

    Ukraine is showing that an investment in civil society, as part of the essential social fabric, is an investment in resilience. It can quite literally mean the difference between life and death. Continued support is needed so civil society can maintain its energy and be ready to play its full part in rebuilding the country and democracy once the war is over.

    Russia’s crackdown

    Vladimir Putin also knows what a difference an enabled and active civil society can make, which is why he’s moved to further shut down Russia’s already severely restricted civic space.

    One of the latest victims is Meduza, one of the few remaining independent media outlets. In January it was declared an ‘undesirable organisation’. This in effect bans the company from operating in Russia and criminalises anyone who even shares a link to its content.

    Independent broadcaster TV Rain and radio station Echo of Moscow were earlier victims, both blocked last March. They continue broadcasting online, as Meduza will keep working from its base in Latvia, but their reach across Russia and ability to provide independent news to a public otherwise fed a diet of Kremlin disinformation and propaganda is sharply diminished.

    It’s all part of Putin’s attempt to control the narrative. Last March a law was passed imposing long jail sentences for spreading what the state calls ‘false information’ about the war. Even calling it a war is a criminal act.

    The dangers were made clear when journalist Maria Ponomarenko was sentenced to six years in jail over a Telegram post criticising the Russian army’s bombing of a theatre where people were sheltering in Mariupol last March. She’s one of a reported 141 people so far prosecuted for spreading supposedly ‘fake’ information about the Russian army.

    CSOs are in the firing line too. The latest targeted is the Moscow Helsinki Group, Russia’s oldest human rights organisation. In January, a court ordered its shutdown. Several other CSOs have been forced out of existence.

    In December an enhanced law on ‘foreign agents’ came into force, giving the state virtually unlimited power to brand any person or organisation who expresses dissent as a ‘foreign agent’, a label that stigmatises them.

    The state outrageously mischaracterises its imperial war as a fight against the imposition of ‘western values’, making LGBTQI+ people another convenient target. In November a law was passed widening the state’s restriction of what it calls ‘LGBT propaganda’. Already the impacts are being felt with heavy censorship and the disappearance of LGBTQI+ people from public life.

    The chilling effect of all these repressive measures and systematic disinformation have helped damp down protest pressure.

    But despite expectation of detention and violence, people have protested. Thousands took to the streets across Russia to call for peace as the war began. Further protests came on Russia’s Independence Day in June and in September, following the introduction of a partial mobilisation of reservists.

    Criminalisation has been the predictable response: over 19,500 people have so far been detained at anti-war protests. People have been arrested even for holding up blank signs in solo protests.

    It’s clear there are many Russians Putin doesn’t speak for. One day his time will end and there’ll be a need to rebuild Russia’s democracy. The reconstruction will need to come from the ground up, with investment in civil society. Those speaking out, whether in Russia or in exile, need to be supported as the future builders of Russian democracy.

    Among those Maseko litigated against was the country’s tyrannical ruler, King Mswati III. Mswati, in power since 1986, is Africa’s last remaining absolute monarch. In 2018, in one indication of his unchecked power, he changed the country’s name to Eswatini from Swaziland, unilaterally and without warning. Maseko was planning to take Mswati to court to challenge the renaming on constitutional grounds.

    Maseko was chair of the Multi-Party Forum, a network bringing together civil society groups, political parties, businesses and others to urge a peaceful transition to multiparty democracy. He was also the lawyer of two members of parliament – Bacede Mabuza and Mthandeni Dube – arrested and detained in 2021 on terrorism charges for calling for constitutional democracy.

    It isn’t yet clear why Maseko was killed or whether those who did the deed were acting on their own initiative or following someone else’s orders. But for many in the country’s democracy movement, it’s more than a little suspicious that just before the killing Mswati is reported to have said the state would ‘deal with’ people calling for democratic reforms. Maseko had reportedly received death threats.

    Civil society is calling for Maseko’s killing to be properly investigated. Those carrying out the investigation should be independent and ensure whoever is behind it is held to account, however high the trail goes. But there seems little hope of that.

    Blood on the king’s hands

    If Maseko’s killing was a reaction to his human rights work, it’s an extreme form of reprisal, but it’s not the only recent mysterious death. In May 2021, law student Thabani Nkomonye disappeared. When his body was discovered a few days later, it bore signs of torture. The police did little to investigate; many believed they were responsible for the killing.

    When news of Nkomonye’s killing broke, students protested to demand justice – and multiparty democracy, because only under democracy can state institutions be held accountable. This was the trigger for months of protests that swept Eswatini in 2021.

    As protests went on some people started to target businesses owned by the monarchy. When protesters started fires, the state’s response was lethal. Dozens were killed and around a thousand injured as security forces fired indiscriminately at protesters, in a shoot-to-kill policy evidently ordered by Mswati. Even if Mswati doesn’t turn out to have Maseko’s blood on his hands, there are plenty of other killings he’s likely responsible for.

    Part of a pattern?

    Amid continued repression, people have little hope that the killing of Maseko will be the last, and if anything the fear is that it could mark an escalation. If the state is behind the attack, it suggests an increased boldness to its repression: it may be targeting high-profile figures in confident expectation of impunity.

    There are other indications this may be the case: Penuel and Xolile Malinga of the People’s United Democratic Movement, the major political party, have twice had their home fired upon in the last few months. In December 2022, human rights lawyer Maxwell Nkambule survived an apparent assassination attempt when his car was fired on.

    The state signalled it had more interest in repression than investigating Maseko’s killing when two protesters were shot in a march demanding justice. The danger is of growing lawlessness and further waves of state lethality in response to any protest violence.

    Genuine dialogue needed

    What the democracy movement is asking for is commonplace elsewhere: the right for people to have a say in the decisions that affect their lives. People want to pick the prime minister themselves, instead of the king doing it. They want to be able to vote for political parties, which are banned from elections. They want the king to be subject to the law, which requires a constitutional rather than absolute monarchy. And they want an economy that works for everyone: currently Mswati lives a life of rockstar luxury, funded through his family’s direct control of key state assets, while most people live in dire poverty.

    An agreement to hold a national dialogue – struck with South Africa’s President Cyril Ramaphosa and the Southern African Development Community (SADC) following the 2021 protests – hasn’t been honoured. Even if it happened, many doubt such dialogue would be genuine.

    South Africa has a special responsibility to urge democracy, as the country that’s home to Eswatini’s many civil society and political exiles. It’s time for South Africa and SADC to stand up to Mswati, demand genuine accountability over the killing of Maseko and push harder for real dialogue, constitutional reform and a path towards democracy.
