    Los Angeles immigration lawyer Dmitry Paniotto, with 18 years of experience in the deportation defense field, offers his expertise to undocumented migrants in removal proceedings in connection with the new “prosecutorial discretion” policy recently implemented in U.S. immigration courts.

    According to Paniotto, the U.S government again decided to allow the Department of Homeland Security attorneys representing the U.S. government in immigration court to exercise favorable discretion to close deportation cases administratively without a deportation order. This means that if attorneys prosecuting deportation against an undocumented migrant believe that this migrant doesn’t pose a risk to the community, has no criminal record, has good moral character, and qualifies to pause his/her deportation for humanitarian reasons such as caring for a child or elderly, the government will close the deportation case against such person.

    “However, even if you have some criminal record but you showed some rehabilitation and your record was not an aggravated felony or particularly violent offense, you also may qualify for PD (prosecutorial discretion) based on certain factors,” Paniotto added.

    The process to apply for PD is complicated and requires the preparation of a bona fide PD package to show that a person qualifies for this relief. 

    “There must be a detailed explanation included of how you qualify, what mitigating factors you can show, how you are not a risk to national security or public safety in the U.S., etc. Our office has the necessary experience to prepare such PD applications and help you in immigration court to process them,” said Paniotto.

     After a Federal Judge ordered the Trump Administration to reinstate the Deferred Action for Childhood Arrivals program (DACA), The DHS subsequently posted on its website that it is accepting first-time requests for DACA consideration, advanced parole requests, as well as renewal requests. Dmitry Paniotto, an immigration lawyer in Los Angeles, advises those who are eligible to apply.

    The program provides protection from deportation for undocumented immigrants who entered the United States as children.

    According to NPR, DACA currently protects about 640,000 undocumented immigrants. There are an estimated 300,000 additional people who are eligible to apply.

    The DACA program began accepting applications in Summer 2012, by way of an executive branch memorandum from then-President Barack Obama. Since then, Paniotto has assisted numerous individuals in successfully applying for the program. In 2017, the Trump administration took actions to roll back the program and halt new applications, thus putting the fate of the program in question.

    Just weeks ago, a U.S. District Court Judge in Brooklyn ordered the Department of Homeland Security (DHS) to reinstate the program to how it was before the Trump Administration began to end the program in September 2017. Officials in the department are ordered to resume issuing two-year permits for qualifying applicants.

    DACA allows those young undocumented immigrants who have good moral character, arrived prior to 2007 and graduated from high school to apply for temporary relief from deportation that includes a work permit.     According to United States Citizenship and Immigration Services (USCIS), over half of the people who have participated in the program reside in California and Texas.

    ​​United States Citizenship and Immigration Services (USCIS) has announced that it will raise its fees on several key applications for immigration and citizenship. According to major news reports, many of the key applications will see a hike in as much as several hundred dollars to apply. Los Angeles Immigration Lawyer Dmitry Paniotto is advising potential applicants to file their paperwork before the changes go into effect on Oct. 2. 

    Specific application fee hikes were laid out in the final rule in the Federal Register issued by USCIS, under the Department of Homeland Security. 

    According to USA Today, most of the fee waivers that were available to low-income immigrants seeking legal naturalization are being done away with along with the rate hikes. According to Paniotto, the best course of action that applicants can take is to file their paperwork before the date the rate hikes take place.

    For two decades, Los Angeles Immigration Attorney Dmitry Paniotto has represented undocumented immigrants in immigration court and asylum proceedings.

    Paniotto said that the most drastic filing fee increases will impact I-601 and I-601A applications filed by immediate relatives for their spouses and adult children who entered the U.S. illegally and require waivers of inadmissibility. Also, asylum applicants who never had to pay a fee before will now have to pay $50 fee to submit their application.

    “There will be a significant fee increase for U visas, so if you have a U visa certification signed by the detectives already, file the U visa application before October 2020,” said Paniotto.
