HOUSTON, Texas (KTRK) — A lawsuit obtained by ABC13 alleges a student fell out of a Katy ISD bus, and now the parents are suing the district and the bus company.
The lawsuit filed in October by the parents’ attorneys on behalf of the child is asking for compensation for medical expenses and physical pain.
The lawsuit alleges that back in January, as students were on their way to school, “the bus driver operated recklessly and at a high rate of speed,” causing the student to be “thrown against the emergency exit of the door and falling outside the bus to the ground.”
It stated the student had severe injuries as a result, but the lawsuit did not specify which school the bus was heading to.
The parents are suing the school district for alleged negligence and also SelectTransportation Resources LLC for strict liability when it comes to design defect, manufacturing defect, marketing failure, failure to warn, negligence, and gross negligence.
ABC13 reached out to Katy ISD as well as the transportation company. The district sent the following response on Thursday evening, saying:
“Due to pending litigation, the District is not able to comment on this matter.”
