The Justice Department has filed a lawsuit alleging that several mortgage loan modification service providers have violated the federal Fair Housing Act and Equal Credit Opportunity Act by discriminating against Hispanic homeowners.
The defendants, The Home Loan Auditors LLC, Century Law Center LLC, SOE Assistance Center Inc., Spieker Law Office, targeted Hispanic homeowners for predatory mortgage loan modification services and impeded the homeowners’ ability to receive financial assistance to maintain their homes.
The complaint filed August 23rd, 2016 in the U.S. District Court for the Northern District of California alleges that the defendants marketed and encouraged Hispanic homeowners to pay approximately $5,000 for unnecessary and ineffectual loan audits. The defendants indicated to the homeowners that audits were essential for a loan modification while in fact the audits did not impact the loan modification process and did not provide any financial benefit.
As part of their mortgage service the defendants encouraged their clients to stop making mortgage payments and to end all communication with their lenders. This led many homeowners to default on their mortgage payments and ultimately led them to lose their homes.
This lawsuit originates from complaints filed with the U.S. Department of Housing and Urban Development (HUD) by two of the defendants’ former clients.
“Intentionally targeting any community or person with predatory mortgage services because of their ethnicity or national origin violates federal law, harms working families and hurts our entire economy,” said Principal Deputy Assistant Attorney General Vanita Gupta, head of the Justice Department’s Civil Rights Division. “The defendants in this case tried to exploit Hispanic communities and homeowners already suffering from abusive, discriminatory financial practices during the Great Recession that drove the American housing market into crisis and our economy into freefall. The Justice Department’s lawsuit serves as a stark reminder and sends a clear message that we will work tirelessly to ensure that all homeowners can access mortgage services free from discrimination.”

Summer and the holiday season may put a strain on your marriage. According to research and anecdotal reports from lawyers, divorce rates follow a biannual pattern, spiking in August and March.
An analysis by University of Washington sociologists presented in 2016 revealed that the chances of a couple filing for divorce rose considerably during those two months. One possible explanation researchers gave for the trend is the raised expectations, and inevitable disappointment, that comes with the winter and summer holidays.
“[The holidays] represent periods in the year when there’s the anticipation or the opportunity for a new beginning, a new start, something different, a transition into a new period of life,” researcher and associate sociology professor Julie Brines said in a press release. “It’s like an optimism cycle, in a sense.”
Brines also points out that these seasons represent “culturally sacred times,” so filing for divorce in the middle of summer vacation or before a trip to see the in-laws might be seen as inappropriate. In same cases, the forced togetherness that comes from trips and family visits may be what sends an already precarious marriage over the edge. If kids are involved, parents may feel pressured to stick it out until school is back in session. Though the study was limited to couples in Washington state, researchers said they found comparable patterns in Minnesota, Florida, and Arizona where divorce laws are similar but demographics and economic conditions diverge.
Data based on general break-ups rather than divorces specifically also suggests that spring is a rough time for love. When data visualization expert David McCandless searched 10,000 Facebook statuses for the phrases “break up” and “broken up” around 2010, March was one of the months that came up the most. The second peak he saw also occurred around the winter holidays, but Facebook users tended to get their splits out of the way two weeks ahead of Christmas rather than riding the relationship out until the new year. Fewer presents to buy that way.

President Lyndon B. Johnson once said, “If you can convince the lowest white man he’s better than the best colored man, he won’t notice you’re picking his pocket. Hell, give him somebody to look down on, and he’ll empty his pockets for you.”
As we’ve had occasion to point out previously, U.S. President Lyndon B. Johnson had a complicated relationship with issues of race. Born and raised in the South in the early part of the 20th century, Johnson grew up immersed in the prejudices of that time and place, then carried them with him into his nascent political career. MSNBC reporter Adam Serwer wrote:
For two decades in Congress he was a reliable member of the Southern bloc, helping to stonewall civil rights legislation. As [biographer Robert] Caro recalls, Johnson spent the late 1940s railing against the “hordes of barbaric yellow dwarves” in East Asia. Buying into the stereotype that blacks were afraid of snakes (who isn’t afraid of snakes?) he’d drive to gas stations with one in his trunk and try to trick black attendants into opening it. Once, Caro writes, the stunt nearly ended with him being beaten with a tire iron.
Yet by the time Johnson became president after the assassination of John F. Kennedy in 1963, he was ready to plow all of his political capital to the passage of the civil rights legislation initiated by his predecessor. By most accounts, the Civil Rights Act of 1964 couldn’t have become law when it did had not LBJ personally wheedled, cajoled, and shamed his former colleagues in the House and Senate into voting for it. One of the secrets of his success was the ability to speak the racially insensitive language of his fellow Southerners. He understood them. He understood their reluctance and in some cases downright refusal to tear down the walls of racial segregation. He knew racism from the inside, and he knew well the role the rich and powerful played in promulgating it.
That’s the context of one of the most famous statements on race ever attributed to President Johnson, an off-the-cuff observation he made to a young staffer, Bill Moyers, after encountering a display of blatant racism during a political visit to the South. Moyers tells it in the first person:
We were in Tennessee. During the motorcade, he spotted some ugly racial epithets scrawled on signs. Late that night in the hotel, when the local dignitaries had finished the last bottles of bourbon and branch water and departed, he started talking about those signs. “I’ll tell you what’s at the bottom of it,” he said. “If you can convince the lowest white man he’s better than the best colored man, he won’t notice you’re picking his pocket. Hell, give him somebody to look down on, and he’ll empty his pockets for you.”
In the blunt vernacular that he loved to use, LBJ was describing what the television pundits of today would probably call the politics of resentment and divisiveness. It is still very much with us.

Making the Perfect Scrambled Eggs
When it comes to breakfast food, celebrity chef Joe Borio of the YouTube cooking show, “Cooking Italian with Joe”, knows that nothing says good morning better than a plate of freshly made scrambled eggs. They are simple, filled with flavor, hot, and offer the perfect accent to toast or a side dish of grilled potatoes and a cup of hot coffee. As simple as scrambled eggs are, chef Joe Borio, wants to share some do’s and don’t and some tips that will make your next morning breakfast dish of scrambled eggs go from oh hum to OMG delicious, and the best eggs I have ever had.
Let’s start with one of the most overlooked yet important part of scrambled eggs, the eggs. If possible you will want to shop for farm fresh, one to two day old, free range large to extra-large eggs. A healthy chicken who gets to run around and eat naturally is always going to offer you up a better tasting healthy egg. When you crack open a local farm fresh egg you will notice a bright and deep orange color yolk with perfectly clear egg white and a good density gel like feel.
With 3 locally grown eggs per person we are now on our way to total deliciousness for our hot breakfast for two.
Start your pan with a very low heat, where the pan begins to be just above warm, but not hot, as we are not frying the eggs but gently and slowly convincing them to marry under candlelight if you will. Too hot a pan will stiffen the eggs immediately, and make them too firm while removing the flavor of the yolk and egg white.
Next comes the scramble. Working or beating an egg too much will change the protein and fat consistency leading to a flat scramble and a loss in flavor. So good news, crack six eggs in a bowl and then with a fork offer up just enough scramble to break the yolks and mix them without blending them. General rule is a 30 to 40 second scramble or mix leaving a lot of streaks in color offering up a lot more flavor and texture, when it comes to seasoning, many times there is the tendency to season before the pan, and this is a big no. Adding salt to anything will draw water from the food, so adding salt now will cause water to be drawn from the egg white and yolk, which will cause them to harden or stiffen. Salt and pepper is best added after the eggs are plated, offering a beautiful balance of egg and seasoning with every bite.
As we prepare to meet the warmed pan that has been heating for less than 60 seconds, we need a heat resistant spatula as we will be slowly folding the eggs as they heat and we want a clean pan with every fold. The pan will be prepared with just a splash of extra virgin olive oil. I can think of nothing better than my own olive oil, Vito and Joe’s Extra Virgin Italian Olive Oil, and only a teaspoon is needed. Make a few swipes with spatula to coat the pan with olive oil, which will prepare the pan and prevent sticking of the eggs as well as add some flavor to the dish as fat, especially extra virgin olive oil, offers you a gentle back drop of warmth to the palate with the olive fruit.
Now it is time to slowly pour the egg mixture into the pan with a gentle folding of the spatula. One of the old Italian secrets here is to hold back a few tablespoons of egg mixture to add to the pan near the end of heating, offering a soft moist texture to your perfect eggs. Butter is the next ingredient and unsalted is the only way to go here as we discussed the problems of salt above. The chef Joe Borio recipe calls for 1/2 of a tablespoon with every egg, so with 6 eggs we want three tablespoons of unsalted butter and just let the butter stay in the middle of the eggs and slowly melt as you stir and fold the eggs every 15 to 30 seconds. The butter adds a little moisture but more than this it adds the butter fat which makes the eggs more flavorful, silky, light, and rich in flavor. Adding the butter first to the pan and heating the butter cause the butter to separate and change its flavor and texture, where the olive oil handles the low heat perfectly.
Now, grab a plate, start the toast and don’t leave the pan, while you slowly fold in the eggs as the heat and firm at the pan surface. I like to put the plate on the stove top near to the heat to warm the plate, as I keep an attentive eye on the eggs with 15 second gentle folds, five minutes is the general time here maybe seven, but know with every passing minute the egg mixture is heating up and rising in temperature, so the firming of the eggs as they heat will occur faster as time goes by.
Now when you will be thinking they are almost done, they are almost there, immediately turn off the heat. Remember they are hot and will continue to cook so waiting till they are done in the pan will result in over done dry eggs. While keeping the pan on the stove with the heat off, slowly add the last few tablespoons of egg mixture that you held back in the beginning. These will cook and mix well while immediately bringing down the temperature of the eggs. Most importantly, this will add a silky texture and flavor to the scramble that is unmatched by any other method I have tried.
With 30 to 40 seconds of an intermittent slow fold, remove the eggs from the pan onto your warmed plates with toast off to the side. As I like my toast firm and crunchy, with a toasted texture upon the bite.
I finish with a small sprinkle of gray sea salt and two to three spins with my fresh pepper grinder. Lastly, I love a tablespoon sized sprinkle of freshly chopped raw spinach. This adds a beautiful color, as well as just a drop of the great flavor of the farm, without taking away from the bold, silky fresh flavor of the best scrambled eggs recipe you will ever have. Enjoy!

A circulating list of nine historical “facts” about slavery accurately details the participation of non-whites in slave ownership and trade in America.
One of the less well known aspects of the history of slavery is how many and how often non-whites owned and traded slaves in early America. Free black slave holders could be found at one time or another “in each of the thirteen original states and later in every state that countenanced slavery,” historian R. Halliburton Jr. observed. That black people bought and sold other black people raises “vexing questions” for 21st-century Americans like African-American writer Henry Louis Gates Jr., who writes that it betrays class divisions that have always existed within the black community. For others, it’s an excuse to deflect the shared blame for the institution of slavery in America away from white people.
In the latter vein, a “9 Facts About Slavery They Don’t Want You to Know” meme lays out a mixture of true, false and misleading historical claims. We’ll address each one in turn below:
The first legal slave owner in American history was a black tobacco farmer named Anthony Johnson.
Possibly true. The wording of the statement is important. Anthony Johnson was not the first slave owner in American history, but he was, according to historians, among the first to have his lifetime ownership of a servant legally sanctioned by a court.
A former indentured servant himself, Anthony Johnson was a “free negro” who owned a 250-acre farm in Virginia during the 1650s, with five indentured servants under contract to him. One of them, a black man named John Casor, claimed that his term of service had expired years earlier and Johnson was holding him illegally. In 1654, a civil court found that Johnson in fact owned Casor’s services for life, an outcome historian R Halliburton Jr. calls “one of the first known legal sanctions of slavery — other than as a punishment for crime.”
North Carolina’s largest slave holder in 1860 was a black plantation owner named William Ellison.
False. William Ellison was a very wealthy black plantation owner and cotton gin manufacturer who lived in South Carolina (not North Carolina). According to the 1860 census (in which his surname was listed as “Ellerson”), he owned 63 black slaves, making him the largest of the 171 black slaveholders in South Carolina, but far from the largest overall slave holder in the state.
American Indians owned thousands of black slaves.
True. Historian Tiya Miles provided this snapshot of the Native American ownership of black slaves at the turn of the 19th century for Slate magazine in January 2016:
Miles places the number of enslaved people held by Cherokees at around 600 at the start of the 19th century and around 1,500 at the time of westward removal in 1838-9. (Creeks, Choctaws, and Chickasaws, she said, held around 3,500 slaves, across the three nations, as the 19th century began.) “Slavery inched its way slowly into Cherokee life,” Miles told me. “When a white man moved into a Native location, usually to work as a trader or as an Indian agent, he would own [African] slaves.” If such a person also had a child with a Native woman, as was not uncommon, the half-European, half-Native child would inherit the enslaved people (and their children) under white law, as well as the right to use tribal lands under tribal law. This combination put such people in a position to expand their wealth, eventually operating large farms and plantations.
In 1830 there were 3,775 free black people who owned 12,740 black slaves.

There were approximately 319,599 free blacks in the United States in 1830. Approximately 13.7 per cent of the total black population was free. A significant number of these free blacks were the owners of slaves. The census of 1830 lists 3,775 free Negroes who owned a total of 12,760 slaves.
Many black slaves were allowed to hold jobs, own businesses, and own real estate.
Somewhat true. There were exceptions, but generally speaking — especially after 1750, by which time slave codes had been entered into the law books in most of the American colonies — black slaves were not legally permitted to own property or businesses. From the Oxford Companion to American Law (2002):
Under these early codes, slaves had virtually no legal rights IN most areas they could be executed for crimes that were not capital offenses for whites. Their testimony was restricted in legal cases and could not be used either for or against whites. Trials of slaves were usually by special courts. Slaves could not own property, move about without consent of their owners, or legally marry.
Brutal black-on-black slavery was common in Africa for thousands of years.
True, in the sense that the phenomenon of human beings enslaving other human beings goes back thousands of years, but not just among blacks, and not just in Africa.

Some independent slave merchants did in fact stage raids on unprotected African villages and kidnap and enslave Africans. Most professional slave traders, however, set up bases along the west African coast where they purchased slaves from Africans in exchange for firearms and other goods. Before the end of the seventeenth century, England, France, Denmark, Holland, and Portugal had all established slave trading posts on the west African coast.
Yet to simply say that Europeans purchased people who had already been enslaved seriously distorts historical reality. While there had been a slave trade within Africa prior to the arrival of Europeans, the massive European demand for slaves and the introduction of firearms radically transformed west and central African society. A growing number of Africans were enslaved for petty debts or minor criminal or religious offenses or following unprovoked raids on unprotected villages. An increasing number of religious wars broke out with the goal of capturing slaves. European weapons made it easier to capture slaves.
Slavery was common for thousands of years.
True, as noted above — though how “common” slavery has been and what the specific nature of that slavery was has varied according to time and place.
White people ended legal chattel slavery.
It’s rather self-serving to claim that “white people” ended legal chattel slavery in the United States (much less ended chattel slavery, period), given that the overwhelming majority of blacks in the U.S. could not vote, could not run for political office, and, in every other way conceivable, were excluded from institutional power. Moreover, even as some white people were laboring to put an end to slavery, many others were fighting to preserve it.
Slavery was eliminated in America via the efforts of people of various ethnicities, including Caucasians, who took up the banner of the abolitionist movement. The names of the white leaders of that movement tend to be better known than those of the black leaders, among whom were David Walker, Frederick Douglass, Dred Scott, Harriet Tubman, Sojourner Truth, Nat Turner, and many others. When Congress passed (and the states ratified) the 13th Amendment in 1865, it was the culmination of many years of work by that multi-racial movement.

2. Share good deals. Even if you can’t afford to buy a ton of extra school supplies for the classroom, you can share extra-special deals that you run across. “I make a list of businesses that are offering freebies during Teacher Appreciation Week and give them to my kids’ teachers,” says one mom. “It doesn’t cost me anything and they love knowing about places like Chipotle and Chick-fil-A that offer freebies or BOGO deals.” Sites like Donors Choose and Fund My Classroom let teachers in high-needs communities post requests for financial assistance for specific projects, equipment, field trips and events. “I would donate $25 and then use a promo code I’d find online to get a matching the donation from the Bill & Melinda Gates Foundation, so the teacher would instead get $50 toward her project,” says another mom. “Then I’d share the code with the teacher and other parents, so any parent in the class who donated funds could double their money.”
3. Donate supplies. Time magazine reports that teachers spent, on average, $500 of their own money on classroom supplies. If you have contacts at stores or large companies, ask if they can donate supplies. (Some schools will even supply you with their tax ID number in order for the company to get a write-off.) You can also check yard sales and thrift shops to pick up cheap deals, or ask the teacher to create a list of classroom “needs” and “wants” that you can offer to copy and share with other parents.
