NORTH OLMSTED, Ohio (WJW) – A Cleveland police officer who is under investigation for an OVI crash is expected in court Thursday.

North Olmsted officers believe the off-duty officer was under the influence when he lost control of his vehicle around 3 a.m. Wednesday and crashed inside a pizza shop.

Officers found officer Gary Kane II behind the wheel, police said, with the music blasting and the car still running and in drive while inside Romeo’s Pizza on Lorain Road.

The front of the pizza shop was in shambles, the front window shattered.

On the body camera video, you can hear the interaction between police and the driver.

One officer said, “Hey bud. Let’s unlock your car. Unlock your car for me. Shut the car off. Yeah, shut the car off. Put the car in park. Put the car in park. Shut the car off.”

As the driver activated the windshield wipers, the officer went on, “No, no. Give me the keys. Give me the keys.”

Kane didn’t answer questions and refused a field sobriety testing.

When asked for his ID, police noted the badge in his wallet.

Kane was arrested for OVI and failure to control his vehicle.

Kane works in Cleveland’s 5th district. He was hired by the Division of Police in 2015. Cleveland Police tell Fox 8 that Kane is on restricted duty while the case is investigated and prosecuted.

Thursday evening, Kane is set to appear in the North Olmsted Mayor’s Court.

A hearing is set for 5 p.m.
