Update 4/22/23: Another residual check was sent out now, aside from the initial payout in 2020. (ht Looney Tunes)
Airbag Class Settlement
The lawsuit alleges that Toyota, Mazda, Subaru, BMW, Honda, and Nissan sold vehicles containing defective inflators manufactured by Takata Corporation that could rupture and expel debris into the occupant compartment.
Each of these auto makers has separately agreed to pay tens or hundreds of millions of dollars to consumers who were affected by the airbag issue. Even those not affected can get up to $250.
Who is Eligible?
Anyone who owned or leased an eligible vehicle in the United States or territories after April 11, 2013 and through June 9, 2017.
The easiest way to see eligibility is by simply checking your VIN here.
How Much Will We Get?
- If the faulty airbag somehow cost you money, file a Registration/Claim for reimbursement of the reasonable expenses you incurred related to the Takata Airbag Recall
- If not, file a Registration/Claim for a Residual Distribution of up to $250
Note: if you still own the vehicle, you can only take part in the settlement if you first bring the car into a dealership for the Takata Airbag Recall Remedy
Important Dates
The Honda and Nissan cases are not yet available for filing claims, we’ll have to wait on dates for those.
For Toyota, Mazda, Subaru, and BMW, the court will issue a decision on October 25, 2017. You should be able to file for another year from that date.
Final Thoughts
This will hopefully amount to real money ($250) for many, many people, though it’s not absolutely guaranteed since it depends how many reimbursement claims are filed. Definitely worth filing a claim.
As noted, thus far it’s only possible to file a claim for Toyota, Mazda, Subaru, and BMW. Honda and Nissan are not up for filing yet, but it looks like they’ve recently agreed to settle too, and we should see a form available at some point in the future. We’ll try to repost this when that happens.
