Russell Simmons Asks Judge to Dismiss Assault Case

Russell Simmons is asking a federal judge to dismiss a sexual assault case filed against him, claiming his status as a “stateless” citizen who is now permanently residing in Indonesia exempts him from U.S. jurisdiction. The suit, brought forward by a former Def Jam employee known as Jane Doe, alleges that Simmons raped her in his New York apartment during the 1990s. Simmons contends that since he has no formal U.S. residency and is living under a retirement visa in Indonesia, the New York federal court does not have the jurisdiction to proceed with the case.

In a recent response to Simmons’ motion, Doe urged the court to reject his claims, asserting that his “stateless” status is a strategic maneuver to avoid accountability. “Defendant is running from the court’s jurisdiction to avoid taking accountability for his actions,” she stated, describing his move as a calculated attempt to shield himself from U.S. legal consequences.

Doe further argued that Simmons’ claims of retirement are contradicted by his ongoing business ventures abroad. She pointed out that Simmons has testified to expanding his entrepreneurial activities in locations like Dubai and Singapore, both of which require morality clauses that could bar him due to the pending allegations. “Building an empire and being retired are mutually exclusive,” Doe wrote in her motion, emphasizing that Simmons’ active business involvement should disqualify him from claiming retirement status under Indonesian law. She argued that Indonesia’s retirement visa requires certification of inactivity every few years, making it incompatible with his current projects.

Simmons, however, insists that he has fully cut ties with the U.S., selling off his American properties and living exclusively in Bali with a permanent retirement visa granted by Indonesian authorities. He has described his life in Indonesia as a legitimate retirement, free from U.S. jurisdiction. The court has not yet decided if his “stateless” status will impact the case’s ability to proceed, leaving Doe’s allegations and Simmons’ defense arguments pending further review.
