  • ‘Get to the rifles,’ Prairieland ICE shooter commanded in body-worn camera audio

    The black clothing worn by 11 people made it difficult for law enforcement to determine the precise acts of each person late on July 4, when one of them is accused of shooting a local police lieutenant outside an Immigration and Customs Enforcement detention facility in Johnson County.

    Although much of the activity was recorded on video, the defendants’ use of monikers in encrypted written messages in advance of the shooting, avoidance of cellphones that would indicate their location and employment of other methods to maintain “op-sec,” has stymied the connection of behavior to defendant.

    In a case in which the criminal complaint’s top count is attempted murder but in which the relative culpability of each defendant is in question by their defense attorneys, their individual roles were a focus of a joint probable cause hearing on Tuesday in U.S. District Court in Fort Worth.

    The Prairieland Detention Facility defendants’ attorneys refer to their clients as protesters. The FBI and U.S. Attorney’s Office describe them as attackers.

    Some ignited fireworks, others spoke from a bullhorn, still others spray-painted anti-ICE slogans on vehicles and an unoccupied guard booth.

    One of the defendants, Benjamin Song — a 32-year-old former Marine Corps reservist who associates described to authorities as a cult-like ringleader who opposes the government on immigration enforcement and on other matters — shot Alvarado Police Department Lt. Thomas Gross, authorities allege.

    The lieutenant suffered one gunshot wound that entered near his shoulder and exited his back.

    The evidence that Song was the shooter comes from a green mask the assailant wore from which samples that tested positive for Song’s DNA were taken and from interviews with cooperating sources, FBI Special Agent Clark Wiethorn testified at the hearing.

    “Get to the rifles,” Song commanded before he fired upon Gross, the agent testified. A recording of the statement from Gross’ body-worn camera was played at the hearing.

    Ejected cartridge casings that law enforcement collected from the scene were fired from one rifle also found there, but Special Agent Wiethorn could not answer a question on cross-examination on the results of a possible comparison examination between the projectile that left Lt. Gross’ body and was found in his clothing or uniform and that rifle.

    Song was the only non-law enforcement shooter, the government alleges. He is accused of firing 11 rounds from a rifle. Gross returned fire with three rounds.

    Song and the other defendants were motivated by the position that the migrants who are detained at the ICE facility are political prisoners, Assistant U.S. Attorney Shawn Smith asserted at the hearing.

    A total of 17 people are charged in the case. Beyond Song, the defendants whose probable cause hearing was held on Tuesday were Autumn Hill (referred to in court documents as Cameron Arnold), Nathan Baumann, Zachary Evetts, Joy Gibson, Meagan Morris (referred to as Bradford Morris in court documents), Maricela Rueda, Seth Sikes, Elizabeth Soto and Ines Soto.

    Whether residue swabs from the hands of the defendants who were arrested near the detention facility revealed firearm primer or suggested fireworks use, indicating, perhaps, their proximity to Song, were among the elements of physical evidence that the defense attorneys probed on Tuesday.

    U.S. Magistrate Judge Jeffrey Cureton found there was probable cause that the defendants had committed the offenses with which they are charged.

    If convicted, the defendants face from 10 years to life in prison.

    The suspects used the fireworks to lure ICE personnel from the facility, the U.S. Attorney’s Office argues.

    The July 4 conflict began at 10:37 p.m. when people in the group started shooting fireworks at the detention facility, authorities have alleged.

    About 10 minutes later, one or two members of the group broke off to spray-paint vehicles and the guard booth.

    Two corrections officers emerged from inside the facility about 10:58 p.m. shortly after calling 911.

    Gross was shot about a minute later.

    CHICAGO (WLS) — An off-duty Chicago police officer was shot to death on the Southwest Side early Sunday morning, CPD said.

    CPD Supt. Larry Snelling said the shooting happened in the 8th Police District as the uniformed officer was heading home from his shift.

    Officers responded to a gunshot detection alert in the 5500 block of South Kedzie Avenue the city’s Gage Park neighborhood just before 3 a.m., Snelling later said in a statement. The officers toured the area and drove to the 3100 block of West 56th Street, where they found the off-duty officer, who had been shot multiple times.

    During a press conference later Sunday morning, Snelling said the 30-year-old officer was taken to the University of Chicago Medical Center, where he was pronounced dead.

    CPD Supt. Larry Snelling said the shooting happened in the 8th Police District as the uniformed officer was heading home from his shift.

    Snelling said the officer’s vehicle was taken following the shooting.

    The officer had served with the department for six years, Snelling said. He was just two days shy of his 31st birthday.

    A procession transported the officer from the hospital to the Cook County Medical Examiner’s Office later Sunday morning.

    CPD said investigators are still looking for a suspect and that a motive for the shooting is still unknown.

    CHICAGO (WLS) — A Chicago police officer was shot Thursday night on Chicago’s West Side. A suspect who was also shot in the shootout died at a hospital.

    The video in the player above is from a 10 p.m. report, prior to the announcement of the suspect’s death.

    The officer was shot around 6 p.m. in the 3800-block of West Ferdinand Street in Garfield Park after a traffic stop led to an exchange of gunfire, Chicago police officials said.

    The officer was taken to Stroger Hospital with non-life threatening injuries, CFD said. They are expected to make a full recovery.

    The suspect was also shot and was initially taken to Mt. Sinai Hospital in critical condition.

    The suspect was later pronounced dead, Chicago Police Superintendent Larry Snelling said at a Thursday night press conference after 10:30 p.m.

    Snelling also spoke earlier Thursday night at the Chicago Police Board meeting.

    “We hope that officer will make a speedy recovery,” Snelling said. “They’re out there working hard, trying to keep the streets safe, and as a result of that was injured. But the officer, it sounds like, will be okay.”

    A second officer was taken to Stroger with shortness of breath, according to CFD.

    Video shared on the Citizen app captured multiple back-to-back gunshots, as neighbors listened in horror.

    It was not immediately clear what led up to the shooting.

    Chopper 7 was over the scene about 7 p.m., and there was a large police presence with dozens of apparent evidence markers in a large crime scene, with CPD officers staged throughout multiple blocks as part of the investigation.

    A white SUV could be seen with a large number of apparent bullet holes on its driver’s side, as well.

    The Chicago Civilian Office of Police Accountability said it responded to the scene, as well.

    HAMILTON TWP., New Jersey (WPVI) — The Hamilton Township police officer who was shot last week while responding to a domestic violence call was released from the hospital on Friday.

    The shooting happened around 10 p.m. on March 8 on the 1800 block of Orchard Avenue in Mercer County.

    According to the New Jersey Attorney General’s office, a man armed with a rifle began shooting at two police officers as they arrived on the scene.

    One of the officers was shot during the incident.

    In a statement, Hamilton Chief of Police Kenneth DeBoskey said the officer is “recovering well” and thanked the community for their support.

    The New Jersey State PBA released a photo of the officer leaving the hospital on Friday.

    Authorities say the armed man was fatally shot by police and pronounced dead at the scene.

    Many residents said the gunfire drew them from their homes to see what was going on.

    “He shot at the cops first and then the cops fired back at him,” said Elizabeth Juliff, a neighborhood resident.

    When asked if she expected this from her neighbor, Juliff told Action News it came as a surprise.

    One resident said his son came running into the home, saying, “The neighbor just got shot by the cops.”

    Further details, including the identities of both the officer and the armed man, have not been released.

    The wounded officer has been with the department for at least 10 years and is very active in the community, officials say.

    The New Jersey Attorney General’s Office is leading the investigation.

    PHILADELPHIA (WPVI) — Officials released new surveillance video Tuesday from last week’s deadly police-involved shooting that injured an officer and left a man dead in North Philadelphia.

    Philadelphia police and the district attorney’s office partnered to release the video, sharing two angles from inside the store.

    Police release new surveillance video from Friday’s deadly police-involved shooting that left an officer injured and one man dead.

    “Today is the day for the public to see the truth about what it is that is visible and occurred inside of the store,” Philadelphia District Attorney Larry Krasner said during Tuesday’s press conference.

    “I want to acknowledge my officers who were involved in a difficult and life-threatening situation,” said Philadelphia Police Commissioner Kevin Bethel, noting that the department remains extremely limited in the type of information they can release at this time.

    The shooting happened on January 26 inside Jennifer Tavern on the corner of N. Mascher and W. Cambria streets.

    Alexander Spencer, 28, was shot and killed during a scuffle with police. During that scuffle, officials say Spencer fired a shot, hitting one of the officers in the leg. This prompted the injured officer’s partner to return fire, according to police.

    The officer who fired the shot has been identified as 33-year-old Ofc. Raheem Hall of the 24th Police District. He is a 6-year veteran of the force.

    The officers were on routine patrol in the area while also keeping an eye out for a person wanted in a recent non-fatal shooting, Bethel said.

    In the newly released video, one of the officers walks into the store, asking if anyone has a gun and checking waistbands.

    “One of the bystanders apparently says something that alerted the group and that often heightened the officer’s presence,” Bethel said.

    The officer then gets to Spencer and signals to his partner that he is armed.

    The two officers and Spencer are seen in a short scuffle on the ground before you hear a shot and see blood coming from the leg of an officer.

    Officials point out that at the time of the initial gunshot, both officers’ guns are holstered.

    Seconds later, the wounded officer’s partner, now identified as Hall, fires at Spencer, killing him, before radioing for backup.

    The injured officer, who was crouching, suffered four wounds when he was shot by a single bullet, Deputy Commissioner Frank Vanore said. He may have tried to fire back, but could not, he said.

    “I think he tried, but it did not operate. The other officer did and that was the shot that struck Mr. Spencer,” Vanore said.

    While officials did release surveillance video from inside the store, Bethel said the officers did not activate their body cameras, which were knocked off their clothing during the struggle.

    A social media video circulating online is now part of the investigation. In the video, Spencer can be seen on the ground with officers on top of him moments before two gunshots are heard. The wounded officer’s partner can then be seen calling for help over the radio.

    New video from the night of the shooting is being used in the investigation that left a man dead and an officer injured.

    “We acknowledge the concerns of the community and the anger it has sparked by a video – a short video that was put online most recently. The dangerous rumors that come from that, the untruths that come from that are difficult to deal with. And so we’re working hard to disprove those rumors,” Bethel said.

    Police are also still searching for a man identified as 42-year-old Jose Quinones-Mendez, who they say stole Spencer’s gun after the shooting.

    Quinones-Mendez is considered armed and dangerous. The Philadelphia FOP Lodge #5 is offering a $10K reward for any information that leads to his arrest.

    The officer who was wounded was released from Temple University Hospital on Monday. The department has not yet released his name.

    In the last three years, Bethel noted that there have been five homicides, 17 non-fatal victims were shot 23 robberies, 62 aggravated assaults, 225 narcotics arrests and 14 illegal guns within 750 feet of the location.

    “Where this incident happened is one of our primary districts that has a significant level of violence in that particular area. Where those officers are working is one of the most violent pockets in our area with almost 15 times the violence that we see in other areas of the city,” he said.

    Philadelphia police are working with the DEA’s office and the two officers involved have been placed on administrative duties, per protocol.

    “Our goal is to be transparent in this work. Our goal is to hold ourselves accountable for our work,” Bethel said.

    While transparency was the main topic hammered home in this press conference, as well as the desire for the public to see what happened, the media was not allowed to ask any questions.

    Action News has reached out to the police department to answer lingering questions, such as what happened in the store before the shooting, whether the “stop and frisk” was justified and if the officer’s actions before the shooting followed protocol. We have not yet heard back.

    PHILADELPHIA (WPVI) — We are learning new details about the deadly officer-involved shooting in North Philadelphia on Friday night that left a man dead and an officer injured.

    This, as the search continues for a man who police say stole a gun from the scene of the shooting where 28-year-old Alexander Spencer was shot and killed by police.

    There is also new video that has surfaced from the night of the shooting, which is being used in the investigation.

    The officer who was shot was released Monday afternoon from Temple University Hospital. His name has not yet been made public.

    Now, those who were on the scene are questioning why police initially went into the grocery store.

    Action News is showing the beginning of a social media video from a witness who started recording after police were already in a struggle with Spencer on the ground. It has also been blurred.

    “Yo, what y’all doing, bruh? What y’all doing?” the witness recording the video can be heard saying.

    Police say they are aware of this 30-second clip and that it’s part of the investigation.

    The incident happened Friday night inside Jennifer Tavern on the corner of N. Mascher and W. Cambria streets in North Philadelphia.

    Police say two officers entered the store and tried to stop Spencer before they got into a scuffle.

    Spencer is then on the ground with one officer.

    Officers say that’s when Spencer allegedly shot one officer in the leg and the officer’s partner returned fire, killing Spencer.

    However, by watching the video, it’s unclear who fired shots first.

    You can then hear the bystander who was recording questioning police and then an officer calls for help.

    “I need someone right now. My partner is shot,” one of the officers is heard saying to his radio.

    Investigators have not said why they tried to stop Spencer or what led to it.

    During the incident, police say 42-year-old Jose Quinones-Mendez fled the scene with Spencer’s gun. However, that part isn’t seen on the video clip shot by the witness.

    Right now, police are searching for Quinones-Mendez, who is facing several charges, including obstruction of justice and tampering with evidence. He is considered armed and dangerous, according to police.

    The Philadelphia Fraternal Order of Police Lodge #5 is offering a $10,000 reward for any information that leads to Quinones-Mendez’s arrest.

    “Our reward is payable immediately, if the tip information leads to the whereabouts of this individual,” said, FOP Lodge #5 President, Roosevelt Poplar.

    Quinones-Mendez is described as being 5’8″ tall and approximately 160 lbs. His last known address was on the 2900 block of North Hancock Street.

    Spencer’s friends have since created a memorial in his honor outside of the store where they say he often went to play the slot machines.

    “I just feel like I just want to know what really happened. What did he do? Y’all could’ve just arrested him. Y’all could’ve just done way better,” said one of Spencer’s friends who did not want to be identified.

    The names of the two officers have not been released. The wounded officer has been on the force for nine years and the officer who fired has been on the force for five years.

    The investigation is still ongoing.

    Anyone with information on Quinones-Mendez’s whereabouts is being asked to call the Philadelphia police homicide unit at 215-686-3334 or 9-1-1.
