Immigration drama. 90 Day Fiancé star Andrei Castravet learned that he hit a snag in his immigration journey in the midst of his drama with the family members of his wife, Elizabeth “Libby” Castravet (née Potthast). But is he really facing deportation and why could he be deported? Keep scrolling below to find out more about Andrei’s immigration status.

Why Is ’90 Day Fiance’ Star Andrei Castravet Facing Deportation?

“Today I’m meeting with my immigration attorney to discuss the upcoming interview with USCIS (U.S. Citizenship and Immigration Services),” Andrei said in his confessional during an October 2022 episode of 90 Day Fiancé: Happily Ever After?

He explained, “My two-year green card expired and I got an extension, but now I have get actually the permanent green card done.”

“My immigration attorney wants me to meet with her in person,” the Moldova native continued. “I don’t know why she didn’t give me a call, it must be something important that I need to go and see her.”

After sitting down with his lawyer, Emel Ersan, he quickly learned about how serious his case had become.

“The good news is you have an interview. The bad news is you have an interview,” Emel said. “And what I mean by that is, normally, 95 percent of my cases like yours don’t get interviewed, they just get an approval letter and you get the green card in the mail. I gotta tell you, I’ve never had a case where there was a child together and that they called you for an interview. I’ve never had a case like that.”

Andrei looked visibly upset and he was concerned that the USCIS thought that his marriage with Libby was a case of marriage fraud. “Why would they not believe us? What’s going on?” he asked.

“I don’t think it has anything to do with your marriage, I think it has more to do with your past in Moldova,” Emel explained. “Here’s the thing, I fear that they saw something in the Moldovan records that would have made you ineligible to get a green card, but for some reason they were overlooked or they didn’t really dig deep into it. So I fear that they’re going back to that original first green card application and saying, ‘You know what, somebody made a mistake here.”

Andrei insisted that his past is in his past, but Emel stressed that USCIS doesn’t see it that way. “Don’t let me find out something that I don’t know. I need to know, if you have ever been arrested anywhere in the world, you gotta tell me”

The Florida resident admitted in his confessional that he never told his attorney about the investigation he was a part of while he was working as an officer in the Moldova police department. He came clean during their meeting.

“I was part of an interior investigation into the police department because somebody just like [questioned] our work, you know what I mean?” he explained. He added that he testified in court in front of a judge on his own behalf in the investigation.

“I said that I did my work right and everything was cool,” Andrei added. Emel asked if they ever told him he did something wrong and Andrei answered, “No.”

Andrei said the situation was “weird” to him as he tried to figure out what could have alerted the USCIS. “Could someone have complained about you? Do you have any enemies here in America?” Emel asked. Andrei said that there are a lot of people that he doesn’t get along with, hinting at Libby’s family, but he wasn’t sure if they would “go that low” to report him to immigration. “Happens all the time,” Emel said.

In her confessional, she opened up about why this issue is so serious. “I’m very concerned that something unusual is happening in his case. Something is in file that’s causing these issues. That concerns me because I’ve seen clients that have been arrested at these interviews, I’ve seen clients that have been given deportation letters. So at any point, Andrei could erase everything that they’ve already accomplished.”

Andrei shared his thoughts regarding his immigration issues in his confessional. “I don’t think there’s something from my past that they’re concerned about. I think there’s somebody whispering over here,” he said. “I don’t know how low can any of those people can go.”

Who Called USCIS on Andrei?

Andrei assumed that it was one of Libby’s family members who allegedly called immigration on him. However, they all denied calling ICE on Libby’s husband during a family group therapy session on the season 7 finale of 90 Day Fiancé: Happily Ever After? Libby’s mom, Pamela, asked Andrei and Libby would announce their pregnancy with baby No. 2 on social media without telling her or Libby’s brothers and sisters first and Andrei explained it’s because they were “isolating” themselves from the family because of his immigration issues.

“The [broken] trust come [sic] from recent events that we had in our life cause I have, like, some problems with immigration right now,” he told his mother-in-law in front of the rest of the family. “We had an immigration interview when they told me that, “Somebody might [have] reported you and they want you not to achieve your green card.”

Andrei and Libby said their lawyer “advised” them that someone could have “sabotaged” their green card process. “And I was like, ‘I cannot trust anybody.’ How can I trust somebody that they may have reported me?”

Libby’s sisters Jenn Davis and Becky Lichtwerch did not believe that Andrei was telling the truth about the situation and asked to see proof from his lawyer. Libby’s brother Charlie Potthast flat-out denied calling immigration on his brother-in-law.

“Like we even f–king care about you, bro?” Charlie said. “Like, we’re gonna report you? What are you talking about? Like I’m gonna be like, ‘Oh, I’m gonna get Andrei deported, bro.’ Like, no. Nobody f–king does that.”

Charlie doubled down on his denial that anyone his family would have reported Andrei to USCIS. “The fact that he would accuse our family, saying we called immigration on him? Like bro, nobody even knows about your immigration status or cares. Like, you’re not that important. Nobody called immigration on Andrei.”

However, Andrei is still convinced someone in Libby’s family “narced.” During part one of the season 7 tell-all, which premiered in January 2023, Andrei was shocked to find out that Jovi Dufren’s wife, Yara Zaya, had already received her 10-year green card.

“For me, it’s like on the edge, honestly. ‘Cause they said to me, like if they have to look into some things, and they’re not giving me an answer,” Andrei told the New Orleans resident during a heated conversation. “And they gave me a period, and they said the next step, they not going to approve me. You know, there might be a possibility that I might get deported.”

Did Libby’s Family Call USCIS on Andrei?

While hashing out the drama on part 2 of the 90 Day Fiancé: Happily Ever After season 7 tell-all, Charlie made a comment about Andrei’s immigration status that sparked speculation he could have been the one who called ICE.

“If you’re gonna treat somebody’s family the way you treat people, like, yeah, there might be a chance somebody might report you,” Charlie said. Andrei responded, “Motherf–ker, you’re the bastard, now?”

When tell-all host Shaun Robinson asked Charlie what he meant by that, he said, “Because, if you’re the f–king a–hole that f–king fights with all the family members, like yeah, somebody might f–king snitch on you.”

Their costar, Kim Menzies, asked Charlie if he did it. “Hell no,” Charlie said. “Like, I don’t care, I don’t think about him.”

Becky defended him and the rest of the Potthasts. “I really highly doubt that anyone from my family called the office,” she said. When Shaun asked her why, Becky said, “Because I know my family, my family doesn’t do petty s–t like that. They really don’t.”

Andrei didn’t agree and slammed Becky’s comments as “delirious.” When Shaun asked him which family member he thinks called immigration, Andrei said he thinks Charlie was the one who did it but Charlie continued to deny it.

However, when Shaun asked the cast who thought that there was a “mole” in Libby’s family, most of them agreed and raised their hands but Angela Deem said that she didn’t think Charlie would “stoop that low.”

“You’re right,” Becky said. “No one would do that intentionally because we know it would hurt Libby. I’m sorry but no one in my family has done this.”

Did Andrei Overstay His Visa?

During the tell-all, Andrei’s lawyer joined them via video call to discuss his case. Becky said that there could be something else in Andrei’s past that flagged immigration and revealed that he previously overstayed a visa before he met Libby.

“It was a student, work and travel J-1 visa, you come for three months during the summertime, exchange experience, come, go back. That’s what it was,” Andrei said. He said he did it twice in the summers of 2007 and 2008 and stayed for three months each time. One of those times, he overstayed a visa by a few days but at that point, his lawyer interjected and advised Andrei not to answer any more questions about how long he overstayed.

Fortunately for Andrei, it seems he is still in America. He took to Instagram on October 7 to announce the birth of his son, his second child with Libby. He and Libby are also parents to daughter Ellie, who was born in 2019.

“I’m so proud and excited to be a Dad again to my son Winston Leo!! Welcome to the world!” the proud dad of two gushed in his caption. “And now You are our favorite reason to lose sleep at night❤️❤️ #winstonleo #prouddad #tlc #iloveit.”

Andrei and Libby also celebrated the 2022 holiday season together as a family of four.
