The “drag show ban” bill that aims to prohibit adult live performances for minors has advanced in the Florida Legislature and is now heading towards the office of Florida Governor Ron DeSantis.

Last Wednesday, the House sent the bill to DeSantis’ desk. Under the proposed legislation, the state would have the authority to revoke food and beverage licenses of establishments that permit children to attend adult performances.

Senate Bill 1438, also known as the “Protection of Children” bill, was advanced by senators with a vote of 28-12 earlier this month. The bill received broad support in the Republican-controlled state senate. Advocates argue that the legislation safeguards children and is a component of a more overall effort to empower parents and enhance the welfare of children. On the other hand, critics contend it is excessively expansive and stifles the LGBTQ+ community.

Nevertheless, the legislation forbids individuals from allowing a minor to attend “adult live performances,” which it broadly characterizes as “an exhibition that portrays or mimics nudity, sexual behavior, or particular sexual acts.” If SB 1438 is ratified, establishments with such performances could forfeit liquor licenses. Additionally, those who violate the regulation could be charged with a first-degree misdemeanor.
