(FOX40.COM) — In a victory for California and Oregon Attorneys General, a federal judge temporarily blocks President Donald Trump from deploying California National Guard troops to Oregon on Sunday night.
U.S. District Court Judge Karin Immergut, who was appointed by President Donald Trump, has granted California Attorney Rob Bonta and Oregon Attorney General Dan Rayfield’s emergency motion to temporarily block Trump from deploying at least 200 California National Guard troops to Portland, ORE.
Immergut also issued a similar temporary ruling preventing the Trump Administration from deploying Texas National Guard troops from being deployed to Oregon.
Trump previously said the deployment of the National Guard to Portland was necessary to combat crime and unrest in the city.
Minutes after the judge’s decision was made, Bonta released the following statement and said that this disrespect for the rule of law cannot stand and he’s “glad the court agreed.”
“The Trump Administration’s flagrant disregard for the courts was on full display when it sought to circumvent Judge Immergut’s order blocking the federalization of the Oregon National Guard by redeploying troops from Los Angeles to Portland,” Bonta said. “The President’s move to deploy the National Guard of one state over the objections of a governor to another state over the objections of a second is well outside of the norms or practices of any President in recent history. This President is determined to take as much power as the courts will give him. This fight isn’t over, but today’s rebuke of the President’s illegal actions is a step in the right direction.”
After Bonta released his statement, Gov. Gavin Newsom took to X and posted “we just won in court, again” along with the following.
“A federal judge BLOCKED Donald Trump’s unlawful attempt to DEPLOY 300 OF OUR NATIONAL GUARD TROOPS TO PORTLAND. The court granted our request for a Temporary Restraining Order — HALTING ANY FEDERALIZATION, RELOCATION, OR DEPLOYMENT of ANY GUARD MEMBERS TO OREGON FROM ANY STATE. Trump’s abuse of power won’t stand.“
Newsom also said, “This ruling is more than a legal victory; it’s a victory for American democracy itself. “Donald Trump tried to turn our soldiers into instruments of his political will, and while our fight continues, tonight the rule of law said ‘h*** no.’”
In a virtual press conference on Sunday evening, Bonta announced he joined Rayfield in filing an emergency court order to stop President Donald Trump from deploying 300 California National Guard troops to Portland.
“Trump is not king. He is not above the law,” Bonta said. “It’s our national guard…not Trump’s royal guard.”
The judge argued and ruled that Trump’s deployment of California and Texas National Guard troops to Oregon violates the 10th Amendment. Officials said that this ruling is temporary and is set to last up to 14 days.
After the virtual conference, officials released an update stating a teleconference was being set up for Sunday night for Bonta’s temporary restraining order motion to stop President Trump from deploying 300 California National Guard troops.
What’s next? The Trump Administration is now expected to appeal; however, at this time, no comment has been released from the White House.
