    Activision Blizzard to pay $55 million to settle California civil-rights lawsuit

    Videogame maker Activision Blizzard has agreed to pay nearly $55 million to settle a California civil-rights lawsuit brought over complaints of sexual harassment, discrimination and pay disparities by women employees that helped trigger the company’s acquisition by Microsoft.

    The settlement, announced by the California Civil Rights Department on Friday evening, resolves the lawsuit filed against the “Call of Duty” videogame studio by the agency in 2021 over claims that it “discriminated against women at the company, including by denying promotion opportunities and paying them less than men for doing substantially similar work,” CRD said.

    The agreement, subject to court approval, will see Activision pay nearly $46 million into a settlement fund dedicated to compensating women employees and contract workers at the company, plus more than $9 million in attorneys’ fees and costs. Additionally, Activision will take steps “to help ensure fair pay and promotion practices at the company,” including retaining an independent consultant to evaluate its compensation and promotion policies.

    Yet the settlement also sees CRD withdraw its initial claims alleging a culture of widespread, systemic workplace sexual harassment at Activision, according to a copy of the agreement provided to MarketWatch. The document notes that the department is filing an amended complaint that removes the sexual-harassment allegations against the company and focuses on the gender-based pay and promotion claims.

    CRD made no note of its prior sexual-harassment claims against Activision in its announcement Friday. A spokesperson for the department said the statement “largely speaks for itself with respect to the historic nature of this more than $50 million settlement agreement, which will bring direct relief and compensation to women who were harmed by the company’s discriminatory practices.

    Representatives for Activision declined to comment.

    The Wall Street Journal first reported the news of the settlement Friday.

    The California agency’s complaint was one of several high-profile investigations by both state and federal regulators in recent years into alleged workplace misconduct at Activision and failures by its leadership to respond appropriately. 

    While Activision repeatedly denied the allegations, they ramped up pressure on the Santa Monica, Calif.-based company and its CEO, Bobby Kotick, and eventually led to a $68.7 billion takeover bid by Microsoft

    in January 2022. The acquisition closed this October after receiving approval by U.K. and E.U. antitrust regulators, though the U.S. Federal Trade Commission continues to challenge the deal in court. Kotick is expected to leave the company, which he led for more than three decades, at the end of this year.

    The settlement would be the second-largest ever for the California Civil Rights Department, according to the Journal, after its $100 million agreement with another Los Angeles-area videogame developer, Riot Games, to resolve gender-discrimination allegations in 2021. The agency had initially sought a much-larger settlement with Activision, the publication reported, citing how the state had estimated the company’s liability at nearly $1 billion to some 2,500 employees with potential claims.

    One of Fox News’ top hosts said that many of the world’s problems would be solved if women were to vanish from the planet.

    Greg Gutfeld, the right-wing channel’s resident jester who was recently promoted to host his own prime time hour, made a series of brazenly sexist comments on Monday’s edition of “The Five” during a discussion on looting.

    As surveillance video played showing a smash-and-grab that occurred over the weekend at a Los Angeles Nordstrom, Gutfeld went on a rant portraying women as soft on crime and effectively blaming the entire gender for supposed policies that would prevent such crimes from being committed.

    “What would happen if all the women took a ladies week off and they went to Venus … How many of these problems would still exist?” Gutfeld wondered aloud.

    Gutfeld, who allowed for the possibility that new problems would emerge in the absence of women, confidently argued that “smash and grabs” and “rampant recidivism” would “disappear.”

    At one point during the discussion, Gutfeld acknowledged that what he was saying might not sit well with Jeanine Pirro, a tough-on-crime co-host of “The Five” who previously worked as a prosecutor and served as a New York state judge.

    “I know this is offensive to the judge because she thinks like a dude,” Gutfeld joked.

    Gutfeld concluded his rant, shouting, “What I’m saying is that we have gotten so soft and it is because we have decided that discipline and punishment is wrong.”

    A Fox News spokesperson did not respond to a request for comment on Tuesday.

    Gutfeld is no stranger to controversy, having made a number of comments during his time at Fox News that have ignited significant backlash.

    Just last month, the White House condemned Fox News over comments Gutfeld made about the Holocaust, describing the remarks as a “horrid, dangerous, and extreme lie” that “insults the memory of the millions of people who suffered from the evils” committed by Adolf Hitler’s Nazi regime.

    Gutfeld never apologized and Fox News did not comment.

    When Kaneko Miyuki reported her sexual assault as a seven-year-old in Japan, she remembers the police laughing at her. “I was already confused and scared,” she said. “They wouldn’t take me seriously as a child.”

    The following investigation made things worse. After being questioned, she was taken back to the scene of her assault without a guardian present, against all modern guidelines.

    The police never did bring her attacker to justice. The whole experience was so traumatizing for Kaneko that she repressed her memory of it until she began having flashbacks in her twenties, and didn’t come to terms with the fact she had been sexually assaulted until her 40s.

    Kaneko is among countless Japanese women who say their experiences of sexual assault and abuse were ignored because they “didn’t fit the criteria” of a victim. About 95% of survivors never report their assault to police, and nearly 60% never tell anyone at all, according to a 2020 government survey.

    But that could be about to change. On Friday, the Japanese parliament passed a raft of bills overhauling the country’s sex crime laws, long criticized as outdated and restrictive, reflecting conservative social attitudes that often stigmatize and cast doubt on victims.

    The new laws expand the definition of rape to place greater emphasis on the concept of consent; introduce national legislation against taking explicit photos with hidden cameras; and raise the age of consent to 16. The previous age of consent, at 13, had been among the lowest in the developed world.

    It marks a major victory for sexual assault survivors and activists, some of whom have spent decades lobbying for these changes.

    “We … would like to express our deepest gratitude to all the victims of sexual violence who have raised their voices together with us,” Spring, a survivor advocacy group, said on Friday.

    While cautioning there was still more work to be done, such as extending the statute of limitations and in recognizing power imbalances in cases involving authority figures, it said the bills were nonetheless a sign of progress.

    “Our earnest wish is that those who have been victims of sexual violence will find hope in their lives, and that sexual violence will disappear from Japanese society,” it said.

    One of the biggest reforms passed on Friday is to change the language used to define rape to include a greater emphasis on the concept of consent.

    Rape had previously been defined as “forcible sexual intercourse” committed “through assault or intimidation,” including by taking advantage of a victim’s “unconscious state or inability to resist.”

    The law had also previously required evidence of “intent to resist.”

    But activists had argued this is too hard to prove in many cases, such as when a victim experiences the common “freeze” response, or is too afraid to resist physically.

    Tadokoro Yuu, a representative of Spring, said the law had discouraged victims from coming forward due to “a fear of acquittal” if courts found insufficient evidence of resistance.

    The new law replaces “forcible sexual intercourse” with “non-consensual sexual intercourse,” and expands the definition of assault to include victims under the influence of alcohol or drugs, those with mental or physical disorders, and those intimidated through their attacker’s economic or social status. It also includes those unable to voice resistance due to shock or other “psychological reactions.”

    Other major changes include raising the age of consent to 16 years old except for when both parties are underage – on par with many US states and European nations including the United Kingdom, Finland and Norway.

    The amendments also expand protections for minors, establishing grooming as a crime for the first time. They further criminalize activity like asking those under 16 for sexual images, or asking to visit a minor for sexual purposes.

    It also makes it easier to prosecute people accused of taking or distributing photos of a sexual nature without the subject’s knowledge or consent – a hot button issue in Japan where upskirting and hidden cameras taking explicit photos of women has long been a problem.

    A survey last year found that nearly 9% of more than 38,000 respondents across Japan had experienced this kind of “voyeurism,” according to public broadcaster NHK. Victims described having photos taken up their skirt and shared on social media; others had photos secretly taken in changing rooms and bathrooms.

    They also described the long-term impact on their mental health, with many feeling unsafe in public spaces including trains and schools. Reporting the issue rarely helped: often, peers and even police officers would place the blame on their clothing, arguing that they had placed themselves at risk by wearing skirts, NHK reported.

    Until now, laws against voyeurism have been enforced only by local governments, and can vary across prefectures, complicating matters.

    In one notorious incident in 2012, a plane passenger took an upskirt photo of a flight attendant, was caught with several images on his phone, and admitted guilt – but was ultimately never charged, according to NHK. The problem? The crime had taken place midair on a moving plane – so it was impossible to know which prefecture they had been traveling over at the time, thus which location’s law should be applied.

    These amendments build on the work of an entire generation of activists who have tried with little success to push forth change, said Nakayama Junko, a lawyer and member of the non-profit Human Rights Now.

    “It’s been a long time … It’s not just a movement that has been going on for 50 years, it’s a voice that has been heard for decades,” she said.

    These previous attempts were blocked by governmental inertia and sometimes outright opposition from parliament members who believed the changes unnecessary, she said. Many people, including Japanese media, had a limited understanding of consent and believed “the crime of rape was being properly punished,” meaning little attention was paid to the issue.

    Things began to change in 2019 when the country was gripped by several high-profile rape acquittals, handed down within the span of a few weeks.

    In the most controversial case, a father was acquitted of raping his 19-year-old daughter in the central Japanese city of Nagoya. The court recognized that the sex was non-consensual, that the father had used force, and that he had physically and sexually abused his daughter – but judges argued she could have resisted, according to Reuters, which reviewed the verdict.

    The father’s acquittal prompted nationwide protests, with women from Tokyo to Fukuoka taking to the streets for months and calling for legal change. Demonstrators held flowers as a sign of protest, and signs with slogans against sexual violence, including #MeToo.

    In the Nagoya case, the father’s acquittal was eventually overturned by Japan’s high court. But the spark had been lit, finally setting into motion the proposed reforms that have for years failed to take hold.

    The protests “conveyed (that) the reality of the damage was very significant,” Nakayama said, calling it a “main driving force that led to this amendment.”

    Both nonprofit organizations CNN interviewed praised the bills as an important step forward – but cautioned that much work remains to be done.

    Japan still lags far behind other developed nations in its ideas toward sex and consent, Nakayama said. Other countries have already begun amending their laws to reflect a “Yes means yes” mentality – meaning sexual partners should seek clear affirmative consent, rather than assuming consent unless told otherwise. Meanwhile, “in Japan, it seems that (the concept of) ‘No means no’ has just been communicated,” she said.

    Tadokoro, the Spring representative, echoed this point, saying it was important to recognize that consent isn’t inherently or permanently granted between couples, and can be withdrawn; that “it’s wrong to assume it’s a ‘yes’ even if they come over, or do not say no clearly.”

    There are other legal reforms they want to tackle in future amendments: better laws protecting people with disability from sexual abuse, and outlining the ways they can give consent, and extending the statute of limitations since many survivors go decades before coming to terms with what happened to them – as in Kaneko’s case.

    Others spend most of their life dealing with post-traumatic stress disorder (PTSD) and other mental health consequences, before reaching a point where they have healed enough to consider pursuing justice.

    But perhaps the biggest obstacle is the Japanese public itself, and the harmful views on sexual abuse and victimhood that are still widespread.

    “When I talk to other people about (my assault), I get avoided, and am not accepted,” said Kaneko, recalling people who told her she would “forget with time” or that that’s just life.

    Sometimes their responses are far crueler. “I get ruthless reactions like, ‘You got done?’” she said.

    There are some positive signs of change, she said, pointing to public awareness campaigns by the government and increasing sexual education in schools. But there is still a gaping lack of systemic support for survivors like counseling, therapy, and public services to help them re-enter society.

    “Survivors of sexual assault like myself cannot even work, or go about your life – you become mentally ill, and you can’t take care of yourself,” she said.

    Authorities also need to introduce trauma-informed training for law enforcement and other workers dealing with survivors, said Tadokoro, adding that “some police investigators understand (how to approach the situation), while others do not understand at all.”

    For Kaneko, who went on to become the general secretary of Spring, the damage done at the police station when she was seven years old compounded the trauma from her assault – leaving scars that took decades to untangle.

    “I was implanted with a distrust of people when I experienced that kind of thing in an institution that is supposed to protect citizens, such as the adults and the police,” she said.

    “For many years, despite a lot of pain, I had no idea what (the source) was for many years … Having PTSD is not easy to heal on your own.”

    Abby Grossberg, the former Fox News producer who accused the right-wing network of pressuring her into giving misleading testimony in the Dominion defamation case, told NBC News Thursday in her first TV interview that she was “bullied, intimidated and coerced” into protecting the right-wing network to keep her job.

    “It felt awful. I mean it felt terrible because I knew that I was bullied, intimidated, and coerced into saying that just to keep my job and stay at the company,” Grossberg told NBC.

    Asked why she did that, Grossberg said “Because I made the decision to keep my job so that I can keep paying my bills. It seemed like the safer decision for me at the time.”

    Her latest comments echo what she said last week in an interview with CNN’s Oliver Darcy, where she said she filed the lawsuit to protect her career and “expose the lies and deceit” that she says is rampant at the right-wing network.

    Fox News contests all of her allegations, and said in a prior statement that, “the assertion that Ms. Grossberg was coached or intimidated into being dishonest during her Dominion deposition is patently false.”

    Fox News also denies wrongdoing in the underlying Dominion case, and says it didn’t defame anyone.

    Last week, Grossberg filed explosive lawsuits in New York and Delaware accusing Fox News lawyers of pressuring her into providing misleading testimony in the Dominion case – testimony that would protect the network and its top talent. Since filing the lawsuit, she submitted new sworn testimony in the Dominion defamation case that undermines some of Fox’s defenses.

    She also claimed in her lawsuit that she had been subjected to a toxic and sexist work environment while at Fox News. The network has vehemently pushed back against these allegations.

    After filing the lawsuit, Grossberg was fired from Fox News. The right-wing network said in a statement that she violated corporate rules improperly exposed legally privileged information in her lawsuit.

    During Thursday’s interview, Grossberg said that she experienced harassment so severe that she thought about killing herself.

    “I reached a breaking point where the harassment was so bad that I called a crisis line,” Grossberg told NBC News. “I thought I could just walk in front of a car and I wouldn’t have to go to work tomorrow.”

    Describing the allegedly toxic workplace at the right-wing network, Grossberg said: “Women were objectified. It was a game. It was a sport. Female politicians who came on the show were mocked. There were debates about who they’d rather sleep with. C-word all the time.”

    A Fox News spokesperson didn’t offer any comment when asked about Grossberg’s mention of suicide. But the spokesperson denied Grossberg’s claims of workplace misogyny, saying her lawsuit was “riddled with false allegations against the network and our employees.” The spokesperson also noted that women are currently serving as the CEO of Fox News Media and the presidents of two of its networks.

    Fox News is no stranger to claims of workplace sexism. Fox News founder Roger Ailes, former primetime star host Bill O’Reilly and other men were forced out amid sexual harassment allegations, and the network has paid tens of millions to settle related lawsuits.

    Wall Street investors are reaching for their neck braces in preparation for yet another volatile swing in stock markets: A surging US dollar.

    The greenback — which is not just the dominant global currency but also “the key variable affecting global economic conditions,” according to the New York Federal Reserve — reached a 20-year high last year after the Fed turned hawkish with its aggressive rate hikes.

    Since then, inflation seemed to have softened, pushing the dollar down. But in recent weeks, as a slew of economic data has shown the Fed’s inflation battle is far from over, the currency soared by about 4% from its recent lows, and now sits near a seven-week high.

    Investors are stressing about this sudden rebound, since a stronger dollar means American-made products become more expensive for foreign buyers, overseas revenue decreases in value and global trade weakens.

    Multinational companies, naturally, aren’t thrilled about any of this. And around 30% of all S&P 500 companies’ revenue is earned in markets outside the US, said Quincy Krosby, chief global strategist for LPL Financial.

    What’s happening: The US dollar “finds itself at a significant crossroads yet again,” said Krosby. “While the Fed remains steadfastly data dependent, the dollar’s course as well remains focused on inflation and the Fed’s monetary response.”

    “The strong US dollar has been a headwind for international earnings and stock performance (for US investors),” wrote Wells Fargo analysts in a recent note.

    February was a rough month for markets: The Dow ended February down 4.19%, the S&P 500 fell 2.6% and the Nasdaq lost just over 1%.

    What’s next: Investors are clearly focused on the next Fed policy meeting, which is still three weeks away, for signals about the direction of rates. But until then, investors may gain some insight Tuesday when Fed Chairman Jerome Powell speaks before the Senate Banking Committee.

    They’ll also be watching next Friday’s jobs report for any softening in the labor market that could temper the Fed’s hawkish mood.

    Don’t forget the debt ceiling: Another significant threat to the dollar is looming in Congress — the ongoing debt ceiling fight. The United States could start to default on its financial obligations over the summer or in the early fall if lawmakers don’t agree to raise the debt limit — its self-imposed borrowing limit — before then, according to a new analysis by the Bipartisan Policy Center.

    That could potentially lead to a disastrous downgrade to America’s credit rating and could send the dollar spiraling as investors start to sell off their US assets and move their money to safer currencies.

    “It would certainly undermine the role of the dollar as a reserve currency that is used in transactions all over the world. And Americans — many people — would lose their jobs and certainly their borrowing costs would rise,” Treasury Secretary Janet Yellen told CNN in January.

    ▸ A lot has changed in the last twenty years. The gender pay gap hasn’t.

    In 2022, US women on average earned about 82 cents for every dollar a man earned, according to a new Pew Research Center analysis of median hourly earnings of both full- and part-time workers.

    That’s a big leap from the 65 cents that women were earning in 1982. But it has barely moved from the 80 cents they were earning in 2002.

    “Higher education, a shift to higher-paying occupations and more labor market experience have helped women narrow the gender pay gap since 1982,” the Pew analysis noted. “But even as women have continued to outpace men in educational attainment, the pay gap has been stuck in a holding pattern since 2002, ranging from 80 to 85 cents to the dollar.”

    ▸ Initial jobless claims, which measures the number of people who filed for unemployment insurance for the first time last week, are due out at 8:30 a.m. ET on Thursday.

    This will be the last official jobs data investors see before February’s heavily anticipated unemployment report next Friday.

    Economists are expecting 195,000 Americans to have filed for unemployment, which is higher than the seasonally adjusted 192,000 who applied two weeks ago.

    Initial claims have come in lower than expected in recent weeks and remain well below their pre-pandemic levels.

    The white-hot labor market in the US added more than 500,000 jobs in January, blowing analysts’ expectations out of the water and bringing the unemployment rate to its lowest level since May of 1969.

    That’s bad news for the Federal Reserve where policymakers have been attempting to tame inflation by cooling the economy through painful interest rate hikes.

    ▸ It’s a big day for groceries. Kroger (KR), Costco (COST) and Anheuser-Busch (BUD) all report earnings on Thursday.

    Investors will be watching closely for clues about consumer sentiment during an uncertain retail earnings season. On Tuesday, Kohl’s reported that it had a rough holiday season and executives at the company put the blame on inflation. The company said higher prices squeezed sales and forced it to mark down some products to entice shoppers — which hurt its profit margin.

    Those comments echoed those of other big box retailers like Walmart (WMT) and Target (TGT), who have said consumers are feeling the pinch of inflation.

    Still, Target and Walmart’s bottom lines were bolstered by food sales even as consumers pulled back on discretionary purchases.

    The US Senate voted on Wednesday to overturn a Biden administration retirement investment rule that allows managers of retirement funds to consider the impact of climate change and other ESG factors when picking investments.

    As my CNN colleagues Ali Zaslav, Clare Foran and Ted Barrett write: The rule is not mandated – it allows, but does not require, the consideration of environmental, social and governance factors in investment selection.

    Republicans complained that the rule is a “woke” policy that pushes a liberal agenda on Americans and will hurt retirees’ bottom lines.

    “This rule isn’t about saying the left or the right take on a given environmental, social, or governance issue is ‘correct,’” countered Senator Patty Murray (D-WA) on the Senate floor Wednesday. “It’s about acknowledging these factors are reasonable for asset managers to consider.”

    The measure will next go to President Joe Biden’s desk as it was passed by the House on Tuesday. The administration, however, has issued a veto threat. As a result, passage of the resolution could pave the way for Biden to issue the first veto of his presidency.

    A lot can change in two decades. Or… not.

    In 2022, US women on average earned about 82 cents for every dollar a man earned, according to a new Pew Research Center analysis of median hourly earnings of both full- and part-time workers.

    That’s a big leap from the 65 cents that women were earning in 1982. But it has barely moved from the 80 cents they were earning in 2002.

    “Higher education, a shift to higher-paying occupations and more labor market experience have helped women narrow the gender pay gap since 1982,” the Pew analysis noted. “But even as women have continued to outpace men in educational attainment, the pay gap has been stuck in a holding pattern since 2002, ranging from 80 to 85 cents to the dollar.”

    Before getting to potential reasons why the pay gap hasn’t narrowed for two decades — let alone disappeared — it’s worth noting that the top-line average doesn’t tell the whole story of what’s been going on for women in different cohorts.

    Take age: Women between the ages of 25 and 34 are much closer to achieving pay parity with men than they are likely to be when they get older.

    Since 2007, younger women have been earning about 90 cents on the dollar, according to Pew: “But even as pay parity might appear in reach for women at the start of their careers, the wage gap tends to increase as they age.”

    Having children is a factor, Pew found. For example, parenthood leads some women to put their careers on hold, or put in a shorter workweek. For employed fathers between the ages 35 and 44, having children at home is a time that often coincides with receiving higher pay even though the pay of employed mothers that same age is unaffected.

    “In 2022, mothers ages 25 to 34 earned 85% as much as fathers that age, but women without children at home earned 97% as much as fathers. In contrast, employed women ages 35 to 44 — with or without children — both earned about 80% as much as fathers,” the report said.

    Or take race and ethnicity: Pew found that Black women last year earned just 70% as much as White men. Hispanic women earned 65% as much. For White women, the gap was less, at 83%. Asian women were closest to parity, at 93%.

    “To some extent, the gender wage gap varies by race and ethnicity because of differences in education, experience, occupation and other factors that drive the gender wage gap for women overall,” the Pew analysis noted.

    “But researchers have uncovered new evidence of hiring discrimination against various racial and ethnic groups, along with discrimination against other groups, such as LGBTQ and disabled workers,” the report continued. “Discrimination in hiring may feed into differences in earnings by shutting out workers from opportunities,”

    Lastly, consider occupation: Women are still overrepresented in lower-paying occupations such as personal care and service jobs; and underrepresented in higher-paying ones, like managerial and STEM jobs.

    Regardless, the gender pay gap is typically narrowest when you pick any single occupation and control for measurable factors between men and women like education, tenure and hours worked.

    “But it never goes away,” said Rakesh Kochhar, a Pew senior researcher.

    The persistence of a gap over the past 20 years, even when comparing apples to apples, suggests there are other factors at play.

    These can include potential discrimination. When Pew asked Americans in October what factors they believed played a role in the gender wage gap, half indicated a major reason is that employers treat women differently. Women were much more likely than men (61% vs 37%) to cite this as a major reason.

    Another factor that may help explain the stickiness of the pay gap is that the wage premium for those with college degrees has grown smaller. So while more employed women (48%) now have at least a bachelor’s degree than men (41%), it is worth less.

    Individual choices such as taking periods away from the workforce to care for children also continue to play a role. Those choices may be borne of cultural norms, societal issues such as a lack of affordable child care, or personal preference.

    Narrowing the gender pay gap from here may be tough sledding.

    “More sustained progress in closing the pay gap may depend on deeper changes in societal and cultural norms and in workplace flexibility that affect how men and women balance their careers and family lives,” Pew researchers suggested.

    And even then, progress may be slower than desired, since, as they noted, “even in countries that have taken the lead in implementing family-friendly policies, such as Denmark, parenthood continues to drive a significant wedge in the earnings of men and women.”

    CNN anchor Don Lemon will return to the network’s air on Wednesday after he participates in formal training following sexist comments he made last week, the network’s chief executive, Chris Licht, said in an email to employees Monday night.

    “I sat down with Don and had a frank and meaningful conversation,” Licht wrote in a memo. “He has agreed to participate in formal training, as well as continuing to listen and learn. We take this situation very seriously.”

    “It is important to me that CNN balances accountability with a fostering a culture in which people can own, learn and grow from their mistakes,” Licht added. “To that end, Don will return to CNN This Morning on Wednesday.”

    Lemon previously apologized to employees for his comments, which prompted internal and external backlash, during Friday’s daily editorial meeting.

    “When I make a mistake, I own it,” Lemon said. “And I own this one as well.”

    Lemon made the sexist comments during a Thursday discussion on “CNN This Morning” over former South Carolina Gov. Nikki Haley’s presidential candidacy.

    When declaring her run for the presidency, Haley called for mental competency tests for politicians over the age of 75. Lemon argued that Haley, 51, “isn’t in her prime.”

    Lemon attempted to support his argument by saying that a woman is only “considered to be in their prime in 20s and 30s and maybe 40s.”

    The comments were met with pushback from co-anchors Poppy Harlow and Kaitlan Collins, but Lemon kept advancing his argument, even doubling down on it in a segment in the following hour.

    Haley herself weighed in later in the day on Twitter, attacking Lemon for the comments and even using them to fundraise.

    During CNN’s Friday editorial meeting, Licht, the network’s chief executive, said that he had heard from a number of people inside the organization about Lemon’s remarks.

    Licht described Lemon’s comments as “unacceptable” and said they were “unfair to his co-hosts.”

    Licht added that he believed it was necessary to foster a culture of accountability and felt it was important for Lemon to appear at the morning meeting, which took place virtually, so that he could apologize.

    Lemon thanked Licht for the opportunity to directly address staffers and said that he wanted to be “really clear” about his regret for making the comments.

    “I believe that women of any age… can do whatever they set their minds to,” Lemon said.

    “The people I am closest to in this organization are women,” Lemon added, citing his relationships with various hosts and executives. “The people I seek counsel from most in this organization are women.”

    Lemon has not appeared on CNN’s air since he made the comments.

    A group of 25 Republican governors called on the Biden administration Friday to withdraw or delay recently proposed rule changes to Title IX that could prevent states from enforcing anti-transgender sports bans.

    As several bills that aim to ban transgender students from participating on sports teams consistent with their gender identity make their way through GOP-led state legislatures across the country, the governors argued in a letter sent to Education Secretary Miguel Cardona that such bans ensure fairness.

    Led by Mississippi Gov. Tate Reeves, the group – including the governors of Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Missouri, Montana, Nebraska, Nevada, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia and Wyoming – slammed the administration’s proposal as “a blatant overreach.”

    In April, the Biden administration proposed a new federal rule change for Title IX that would prohibit policies that “categorically” ban transgender students from participating on sports teams consistent with their gender. However, according to a public notice from the department, the proposal would allow schools to enforce some restrictions in “competitive” environments.

    “Leaving aside the Department’s utter lack of authority to promulgate such a regulation, neither states nor schools should be subjected to such a fluid and uncertain standard,” the governors said in the letter. “Nor, most importantly, should the historic advancements and achievements of our sisters, mothers, and daughters be erased.”

    The governors went on to argue that the proposed changes create confusion for states and schools and claimed that the government was threatening to withhold federal funds to coerce schools to comply with a “completely subjective standard that is based on a highly politicized gender ideology.”

    CNN has reached out to the Department of Education for comment.

    Seventeen of the states signed onto the letter have enacted such bans with a few facing legal challenges, according to the Movement Advancement Project, a nonprofit think tank that advocates for issues including LGBTQ rights. This week, Missouri lawmakers passed a bill prohibiting students from competing in gendered athletic competitions that do not match their biological sex as listed on a birth certificate or government record, and the governor is expected to sign the measure.

    Proponents of such limitations in sports have argued that transgender women have a physical advantage over cisgender women and allowing them to compete would be unfair. However, a 2017 report in the journal Sports Medicine found “no direct or consistent research” on any such advantage.

    When the proposed rule changes were announced, advocates celebrated the new protections but called on the administration to eliminate the exemptions.

    “Every student deserves to be treated with dignity and respect. This includes transgender girls of all ages and in all sports, without exception,” said Kelley Robinson, president of the Human Rights Campaign, the largest LGBTQ advocacy group.

    “The new rule should be clarified to ensure that all transgender students should be presumed eligible to participate in sports consistent with their gender identity,” Robinson added in a statement at the time. “This moment we’re in is truly a crisis for transgender young people – and we’re calling on elected leaders at every level of government to fight harder for our kids.”

    Democratic governors of several states whose legislatures have pushed anti-trans sports bans were not listed among the letter’s signers, including from North Carolina, Kansas and Kentucky. According to the American Civil Liberties Union, more than 470 anti-LGBTQ bills have been introduced nationwide this legislative session.
