Federal judge denies alleged ABC 10 gunman bail, documents reveal he visited elementary school asking to 'read to the children' days before shooting

(FOX40.COM)—A federal judge denied Annibal Hernandez Santana bail Thursday afternoon. The man accused of shooting into ABC10’s building last Friday will remain in custody until trial.

After hearing arguments from both sides, the judge quickly decided they cannot assure Hernandez Santana is not a threat to society. This decision came amid new findings presented by prosecutors.

Fox40 obtained access to new court documents, which provided greater insight into why prosecutors believe the 64-year-old man is a threat to the public. Security footage shows — just three days before Hernandez Santana allegedly fired three shots into Sacramento’s ABC news affiliate’s station along Broadway — the man went to a nearby elementary school and requested to read to the children. Staff members did not report this incident at the time, but they went to police after hearing of Friday’s shooting and Hernandez Santana’s alleged involvement.

Earlier this week, prosecutors confirmed the shooting is believed to be politically motivated. Investigators found a whiteboard planner in the defendant’s home saying “Do the Next Scary Thing.” At Thursday’s federal hearing, the defense argued that was not a threat, rather a “self-help mantra” Hernandez Santana uses to encourage himself to step out of his comfort zone.

Still the judge ruled the defendant will remain in custody pending trial. In the federal courts, he’s facing charges of firing a weapon in a school zone and interfering with a radio communications station.

On Thursday Fox40 spoke with Hernandez Santana’s defense attorney, Mark Reichel.

“Everything is not always exactly as it seems at first,” Reichel said. “There are always two sides to every story.”

While the defense attorney said he ‘cannot comment on the innocence nor guilt of anyone,’ Reichel also reiterated a statement his team released on Monday.

“America is a nation held together by the rule of law and if we don’t have the rule of law, we don’t have anything,” Reichel said.

Keep in mind, Hernandez Santana is facing both federal and state charges.
