Hernandez Santana faces a list of a local and federal charges.

SACRAMENTO, Calif. — The suspect who fired into the lobby of the ABC10 building in Sacramento is facing both federal and local charges in connection to the shooting.

It happened Friday afternoon, when the suspect Anibal Hernandez Santana allegedly fired into the lobby of the building. While our own coworkers were inside, no one was hurt.

Hernandez Santana was arrested hours later, posted bail but was then arrested again by the FBI. He’s scheduled for appearances in court both federal and Sacramento County Superior Court.

In the complaint filed with U.S. District Court, Eastern District of California, it said detectives found a dark-colored satchel worn by the suspect, and seen on surveillance video, with a Sub Compact 9mm handgun inside. Gun residue test on Hernandez Santana also came back presumptive positive, according to the complaint.

On his refrigerator, there was a whiteboard planner with a handwritten note saying “Do the Next Scary Thing” under Friday, according to the complaint.

The complaint added that police found a handwritten note after searching his car, saying “For hiding Epstein & ignoring red flags. Do not support Patel, Bongino, & AG Pam Bondie. They’re next. – C.K. from above.”

Here’s a breakdown of the charges Hernandez Santana faces.

Local Charges

Sacramento police arrested Hernandez Santana on suspicion of assault with a deadly weapon, shooting into an occupied building and negligent discharge of a firearm. 

On Monday, Sacramento County District Attorney Thien Ho said he’d be filing a felony violation of firing a gun into an inhabited dwelling and assault with a semi-automatic gun along with a personal use of a firearm allegation.

He also said he’d be requesting the defendant be held in custody without bail.

Federal Charges

After posting bail, Hernandez Santana was arrested by the FBI. His was arrested on suspicion of violating a federal statute related to interfering with federally licensed stations.

On Monday, the federal charges were amended to include possession of a firearm within a school zone and discharge of a firearm within a school zone.

According to the criminal complaint, about two minutes before Hernandez Santana fired into the ABC10 building, he fired a shot while standing on the sidewalk along the 2500 block of 3rd Street, about 834 feet from the fence line of Health Professions High School and not far from Leataata Floyd Elementary School.

“Targeted acts of violence are unacceptable and will be pursued to the fullest extent of the law,” FBI Director Kash Patel said on X about the shooting.

Hernandez Santana’s History

According to online court records, Hernandez Santana filed a wrongful termination lawsuit against the nonprofit California Rural Indian Health Board. Variety reported that the lawsuit was withdrawn in 2020 and that when he was fired, he got into a verbal confrontation with supervisors who called the police.

Sacramento police told ABC10 they’ve had interactions with Hernandez Santana in the past, but did not share details on those interactions. They have not released a motive for the shooting.

Facebook and ‘X’ accounts matching the suspect’s name and picture posted frequently, criticizing the Trump administration. In the past week, posts on X were daily.

A post on X in July, read in part, quote: “The authoritarian oligarchy is now complete…” and “Rules don’t apply if election was stolen. FIGHT!”

Hours before the shooting, the same X account reposted a video of a Republican Congressman saying the late conservative activist Charlie Kirk would have been the 13th disciple. In the repost, the account commented in part: “This is blasphemy. Can’t believe these Republicans sucking up to their own twisted show.”
